The paper shows changes in the judiciary, in connection with the liquidation and creation of local courts in Ukraine. The necessity of creating more convenient access to the cases through the Internet is described, so that they will be solved more quickly, and the burden on the court specialists will be reduced. The positive changes and changes were analyzed, with the beginning of the second stage of judicial reform in 2018. The urgency of creating a separate electronic cabinet, for each case, where the court and participants in the trial process will be able to review all documents at any time, is substantiated. This minimizes the probability of delaying the cases when the parties challenge all decisions of the courts without exception.It has been determined that judicial reform involves the need for access to cases through the Internet. In the same way, different documents must be translated to higher authorities. Due to electronic circulation, they will be solved more quickly, the burden on the court experts will be reduced, and public money will be saved. In order for this innovation to work in full, amendments will be made to the legislation. It is noted that an important step forward: a court session can be held in a video conference. For example, the lawyer, from his e-office, can represent the interests of the company: send documents, get video communications during meetings. It is substantiated that a separate electronic cabinet should be created for each case, where the court and trial participants will be able to review all documents at any time. Of course, to use this technology, you need to register in the system email and digital signature. This minimizes the probability of delaying cases when the parties challenge all, without exception, court decisions. Now the electronic review will be not only possible, but also mandatory. If, within five days, the court will not be able to provide electronic proceedings, documents will be translated into paper form. In order for these provisions to work, the State Judicial Administration should publish an instruction on the website of the Verkhovna Rada, solve the issue of setting up electronic cabinets, registering electronic addresses and video fixing.

The study concerns the factors influencing the shape of the Polish administrative judiciary, ranging from their conceptual patterns in the interwar period to the present day. Therefore, the article presents the history of administrative judiciary reforms as well as the constitutional and statutory foundations of the Polish administrative judiciary and their most important changes. The following parts of the study discuss issues related to the structure and internal organization of administrative courts, their jurisdiction and the concept of "administrative court case" as the subject of proceedings before an administrative court. The basic principles of administrative court proceedings as well as the types and nature of court decisions, including their appealability, validityand enforceability, were also discussed. The last part highlights the challenges faced by the Polish administrative judiciary and the prospects for its further reforms. ; Opracowanie dotyczy czynników mających wpływ na kształt polskiego sądownictwa administracyjnego, począwszy od ich koncepcyjnych wzorców w okresie międzywojennym, po czasy współczesne. W związku z tym w artykule przedstawiono historię reform sądownictwa administracyjnego oraz konstytucyjne i ustawowe podstawy polskiego sądownictwa administracyjnego i ich najważniejsze zmiany. W kolejnych częściach opracowania omówiono zagadnienia dotyczące struktury i organizacji wewnętrznej sądów administracyjnych, ich właściwość oraz pojęcie "sprawy sądowoadministracyjnej" jako przedmiotu postępowania przed sądem administracyjnym. Przybliżono też podstawowe zasady postępowania sądowoadministracyjnego oraz rodzaje i charakter rozstrzygnięć sądowych, w tym ich zaskarżalność, prawomocność i wykonalność. W ostatniej części zwrócono uwagę na wyzwania stojące przed polskim sądownictwem administracyjnym oraz perspektywy jego dalszych reform.

"Do EU institutions have an influence on the implementation of the rule of law in potential candidate countries and, if so, of what kind? During the compliance monitoring process related to the effective rule of law and democracy the EU Commission tests and criticizes the effectiveness of the judiciary and strengthens the rule of law in preparation for accession. In the Western Balkans this was a process fraught with difficulties. Despite the fact that academic scholarship and democratic politics agree on rule of law as a legitimizing principle for the exercise of state authority, there is no uniform European standard for institution-building or monitoring activities by the EU in this area. With focus on the reform of the judiciary in five case study countries of Bosnia and Herzegovina, Kosovo, Macedonia, Montenegro, and Serbia, this empirical research investigates the EU's transformative power with regard to the effectiveness of rule of law and judicial sector reform in its infancy. It analyses the depth and limitations of EU rule of law promotion in the Western Balkans and presents policy recommendations intended to address the shortcomings in judiciary reform."--

After World War II, all forms of administrative judiciary were abolished and reinstated as early as 1952, when the competence to resolve administrative disputes was entrusted to common courts, which adjudicated these cases in special chambers. The last phase of the development of administrative judiciary began anew with the creation of specialized judiciary, namely with the establishment of an administrative court in 2010. This court is no longer part of the administration, as it was before World War II, but part of the judicial system. Judicial control of administration is based on the constitutionally guaranteed right to afair trial. This means that the administrative court decides within areasonable time on the basis of the law and facts established in the course of apublic hearing, and its judgment may be delivered in limited jurisdiction (resulting in acassation judgment) or full jurisdiction (where the court itself decides the case). This phase of the development of judicial control of the administration is not finished, however, as the administrative judiciary in Serbia has asingle-stage structure, and therefore administrative court proceedings are always one-instance. Oznacza to, że sąd administracyjny orzeka w rozsądnym terminie na podstawie prawa i faktów ustalonych w toku publicznej rozprawy, a jego wyrok może zostać wydany w ramach jurysdykcji ograniczonej (czego skutkiem jest wyrok kasacyjny) lub jurysdykcji pełnej (w ramach której sąd sam rozstrzyga w sprawie). Ta faza rozwoju sądowej kontroli administracji nie jest jednak zakończona, bowiem sądownictwo administracyjne w Serbii ma jednostopniową strukturę, a w związku z tym postępowanie sądowoadministracyjne jest zawsze jednoinstancyjne. Rodzi to potrzebę dalszych reform, mających na celu wprowadzenie dwuinstancyjności sądownictwa administracyjnego oraz zwiększenie jego efektywności.

Administrative courts have only been envisaged in the Ukrainian Constitution as independent judicial organs since 2016, and the current system of these courts includes: the Supreme Court, appellate courts and district administrative courts. Proceedings before administrative courts are governed by the Code of Administrative Judiciary of Ukraine of 2005. The aim of the study is to present the challenges facing the Ukrainian administrative judiciary and to formulate postulates aimed at improving its functioning. The most important of these include ensuring the uniformity of the case law of the Supreme Court and modernizing the provisions on administrative proceedings. ; Historia powstania sądownictwa administracyjnego wUkrainie sięga XIXw., jednak dopiero po odzyskaniu niepodległości rozpoczął się właściwy proces jego rozwoju. Sądy administracyjne, jako niezależne organy wymiaru sprawiedliwości, zostały przewidziane wukraińskiej Konstytucji dopiero od 2016r., aobecny system tych sądów obejmuje: Sąd Najwyższy, apelacyjne irejonowe sądy administracyjne. Postępowanie przed sądami administracyjnymi reguluje Kodeks sądownictwa administracyjnego Ukrainy z2005r. Celem opracowania jest ukazanie wyzwań stojących przed ukraińskim sądownictwem administracyjnym oraz sformułowanie postulatów mających na celu poprawę jego funkcjonowania. Do najważniejszych znich należy zapewnienie jednolitości orzecznictwa Sądu Najwyższego oraz unowocześnienie przepisów opostępowaniu administracyjnym.

The aim of the article is to present the basic assumptions of the reforms of the Polish administrative judiciary. The planned and implemented reforms concerned both the model of administrative judiciary system, as well as the model of adjudication and rules of procedure before administrative courts. The analysis of the implemented solutions, starting from the period of the Second Polish Republic, made it possible to formulate a thesis that the administrative judiciary was subject to evolutionary (developmental) reforms. The article mainly concerns systemic issues, as the creation of a separate, independent, two-instance administrative judiciary was a priority postulate for reforms initiated after Poland regained independence, which appeared in later reform proposals. As the analysis shows, this postulate was fully implemented after the entry into force of the Constitution of the Republic of Poland of 1997. ; Celem artykułu jest przedstawienie podstawowych założeń reform polskiego sądownictwa administracyjnego. Projektowane i realizowane reformy dotyczyły zarówno modelu ustrojowego sądownictwa administracyjnego, jak również modelu orzekania i reguł postępowania przed sądami administracyjnymi. Analiza wdrażanych rozwiązań, począwszy od okresu II Rzeczypospolitej, pozwoliła postawić tezę, że sądownictwo administracyjne podlegało reformom o charakterze ewolucyjnym (rozwojowym).
