The applicability of traditional just war theory with contemporary states' struggles against terrorism is investigated. Overviews of traditional just war theory & of terrorism are provided, emphasizing the conditions under which the use of military force is permissible & the distinction between military force & terrorist actions; in addition, the extent to which just war theory has changed throughout the 20th century is discussed. Thomas Aquinas's criteria for rendering war morally permissible (eg, proper authority, just cause, & right intention) as articulated in his Summa Theologiae are then reviewed to illustrate how contemporary just war theory has incorporated or modified these conditions. Attention is then dedicated to determining whether states possess legitimate authority to respond to terrorism, whether responses to terrorist actions constitute just causes, & whether states are capable of employing right intent to answer terrorist activities. Even though states are morally obligated to protect the everyday lives of their citizens, it is concluded that struggles against terrorism also possess moral duties to achieve peace between warring parties. THIS ARTICLE DISCUSSES THE THEORY OF JUST WAR AND ITS PLACE IN THE POST-COLD WAR ERA. IT BRIEFLY TRACES THE PHILOSOPHICAL HISTORY OF JUST-WAR THEORY AND ILLUSTRATES HOW IT HAS CHANGED DURING THE PAST THREE DECADES. THE ARTICLE ALSO ARGUES THAT RECENT CHANGES REFLECT CONTINGENT JUDGMENTS ON THE NATURE OF MODERN WAR THAT DO NOT MATCH THE CHARACTER OF CONTEMPORARY ARMED CONFLICTS. THE ARTICLE CONCLUDES BY SUGGESTING THAT JUST-WAR THEORY REMAINS RELEVENT TO THE CHALLENGES FACED BY STATESMEN TODAY.

The ethical and legal problems raised by war loom large in the thinking of the theologians and jurists of Spain's Golden Age. In their reflections and pronouncements on these problems, however, they were not starting from nothing. They had before them a large body of teachings, mostly dating from the Middle Ages. An accurate assessment of their role in this field must therefore begin by recalling those mediaeval teachings on war. We shall thus start with an outline of those teachings, before moving on to consider how they were assimilated and modified by the Spanish authors of the sixteenth century.
