General theoretical aspects of the administration of the public administration
The statute is assigned to the theoretical foundations of the sphere of public administration, and the very establishment of such theories and practices in the organs of the microscopic self-regulation and organs of the viconavcha power. Problem setting. Legal support for the processes that have been observed in the political and socio-economic fields of Ukraine over the last decade have become increasingly relevant and urgent. The scrupulous and compulsory observance and implementation of the norms adopted in a civilized society is the key to the stable development of the state, therefore the consolidation of efforts to strengthen the rule of law and order is a paramount task of all the state and governmental institutions. Implementation by the state of administrative functions in the field of justice is the vector that determines the course and direction of actions for the development of Ukrainian statehood.Recent research and publications analysis. Such researchers as I. Artemenko, N. Zhelezniak, Y. Melnyk, I. Mykulets, L. Nalyvaiko, I. Onopchuk, S. Thurin et al. in their scientific works raised the questions dedicated to the main principles of public administration in the field of justice. However, their publications mainly reflect only certain aspects of the concept of justice, legal status of justice bodies and peculiarities of public administration in the mentioned area, while complex approach to understanding of the problems of organizational and legal principles of public administration in the field of justice of Ukraine is not disclosed.Highlighting previously unsettled parts of the general problem. The purpose of this article is to evaluate theoretical approaches to understanding the essence of organizational and legal foundations of public administration in the field of justice of Ukraine, to analyze the activities and powers of the main authorities in the field of justice and to present proposals for development of Ukrainian justice in general.Paper main body. The article considers theoretical approaches to understanding the essence of organizational and legal principles of public administration in the field of justice of Ukraine. It is determined that administration in the field of justice should be understood as activities aimed at fulfillment of tasks of organizational nature for exercise of rights and interests of legal entities, individuals and the state, as well as the task of strengthening the law and order in the country. Specific features inherent in the administration of justice are considered, their characteristics are presented.Emphasis is placed on the fact that one of the peculiarities of justice is the plurality of objects in this area of administration. Such objects of justice as judicial institutions, notary offices, civil registration bodies, forensic institutions and the bar are presented for consideration. It was also notes, that they all have different legal status, differ in their purpose and nature of competence.Attention was focused on the organizational aspect of the activities of the judicial bodies, since in most cases they address organizational issues. It is argued that this feature is characterized by the fact that the vast majority of judicial bodies in the course of their activity is independent and carry out actions that are advisory.It was substantiated that the organizational aspect of functioning of judicial bodies is closely related to the legal one, since statutory instruments are the basis for functioning of institutions providing law and order in the society. It was noted that the main purpose of administration in the field of justice is to ensure the legality, organization of protection of rights and legitimate interests of individuals and legal entities, as well as the state. Administrative and legal regulation in the field of justice is carried out on the basis of the following statutory instruments: the Laws of Ukraine "On Notaries", dated September 02, 1993, "On the Bar and Advocacy", dated December 19, 1992, "On State Registration of Civil Status Acts", dated July 01, 2010, "On Bodies and Persons Who Perform the Enforcement of Court Decisions and Decisions of Other Authorities", dated June 02, 2016, Regulation on the State Migration Service of Ukraine, dated September 20, 2014, etc.The interrelation between organizational and legal aspects of the public administration in the field of justice is presented; it is noted that this interrelation can be traced on the example of the Ministry of Justice of Ukraine. It is noted that, along with the Ministry of Justice, State Archive Service of Ukraine, State Executive Service of Ukraine, State Penitentiary Service of Ukraine, State Registration Service of Ukraine, State Service of Ukraine for the Protection of Personal Data also belong to the system of entities in the field of justice of Ukraine. It is noted that the Constitution stipulates that the judicial bodies of Ukraine have a prominent place among the law enforcement agencies of the state.The basic powers of the entities in the field of justice are considered. It is noted that in practice in practice, there is a distinction between two categories: judicial bodies and bodies of the Ministry of Justice of Ukraine. It is substantiated that the bodies of the Ministry of Justice of Ukraine are a part of the bodies of justice, as these bodies as it is much wider in structure and in the range of authorities.Conclusions of the research and prospects for further studies. It is argued that the priorities for the development of the Ukrainian justice today are the following: formation of a new, higher level of legal awareness and legal culture of citizens; reforming of the judicial system to ensure the accessibility of justice and the effectiveness of judicial protection; reforming of the criminal justice and the criminal executive system; creating legal frameworks for prevention and counteraction to corruption; ensuring the efficiency of the enforcement of court decisions; improvement of the system of protection of state interests in the courts of Ukraine; formation of a free legal aid system.Perspective of further research in this area is represented by the study of institutional aspects of public administration in the field of justice and priorities for development of the institutional sector. ; Розглянуто теоретичні підходи до розуміння сутності організаційно-правових засад державного управління у сфері юстиції України. Представлено авторське трактування сутності управління у сфері юстиції. Розглянуто особливі риси юстиції у контексті здійснення управлінських дій та подано їх характеристику. Обґрунтовано, що здійснення управлінських дій у сфері юстиції передбачає виконання їх органами, які уповноважені від імені держави реалізовувати відповідні функції, зважаючи на багатооб'єктність у цій галузі управління, та представлено перелік об'єктів юстиції. Розглянуто взаємозв'язок організаційного та правового аспектів у контексті державного управління у сфері юстиції. Запропоновано пріоритетні напрями розвитку української юстиції на перспективу.

Subjects of Military Administration vs Bodies of Military Administration: Legal Aspect
The article deals with subjects of military administration based on the analysis of features of state agencies. It has been established that by using interdisciplinary analysis it is possible to disclose their main features. Attention has been drawn that each state agency has its features based on legal nature, designation, specifics and operation activities. It has been established that the main functions of the state agencies are that they are established in accordance with the procedure and on the grounds provided for by legislation; they have powers of authority which the state vest them to fulfill the functions on behalf of it; they have a certain organizational and economic independence in the structure of state apparatus and in the mechanism of the state; they have types and forms of activities, cooperation with other state agencies provided for by law; they have their place and role in the state mechanism, in other words, they have their 'legal status'; they are vested with powers of authority, competence and necessary means for fulfillment of tasks of the state when it manages certain spheres of public life. It has been confirmed that various subjects of military administration have a willful and forceful power which is more evident comparing to other types of public power (effective legislation stipulates legal liability including criminal one for failure to follow the commander's order). It has been stated that military administration which follows from provisions of legal acts is exercised not only by these bodies but by its management. Management is not included in bodies of military administration, but they are subjects of military administration with all the features. It has been proposed to use more general definition like 'subjects of military administration' which will allow to solve unsolved issues.

Functions of democracy in the organization of the judiciary and the administration of justice ; ФУНКЦІЇ НАРОДОВЛАДДЯ В ОРГАНІЗАЦІЇ СУДОВОЇ ВЛАДИ ТА ЗДІЙСНЕННЯ ПРАВОСУДДЯ
The main scientific achievements of foreign and domestic legal scholars in the field of research of the functions of rights in general are analyzed in order to reveal the concept of the functions of the people's right to the formation of justice and the mechanism of their implementation. It is pointed out that in the legal literature there is almost no legal construction of the right of citizens to form (participate) in the formation (organization) of the judiciary. Therefore, in view of the above, the concept of the right of the people to form and implement justice through the prism of political rights, which are the guideline that promotes the realization of democracy, has been clarified. This clarifies the meaning and essence of political rights, in particular, the right to elect power and the right to participate in government. Emphasis is placed on the fact that the Constitution of Ukraine proclaims the fundamental principle of a democratic state: "The bearer of sovereignty and the only source of power in Ukraine is the people." This principle provides an opportunity for the people to independently form a vision of their future and the future of the state, to determine the powers and composition of public authorities, which are responsible for meeting the expectations of the people, and to control their activities is difficult. It is established that society controls the functioning of the court not only through the participation of citizens in the judicial process as jurors and lay judges, but also through the mechanisms of election of judges and their recall. That is, through the exercise of the right to form the judiciary and administer justice. Therefore, given that the formation of the judiciary by the people is carried out through elections, we consider it necessary to fully clarify the content and type of functions of democracy in the exercise of such a right, to explore the functions of elections in general. ; Проаналізовано основні наукові здобутки зарубіжних та вітчизняних вчених-юристів у сфері дослідження функцій прав взагалі для того, щоб розкрити поняття функцій права народу на формування здійснення правосуддя та механізму їх реалізації. Вказується, у юридичній літературі майже відсутня юридична конструкція права громадян на формування (участь) у формуванні (організації) судової влади. А тому з огляду на зазначене, з'ясовано поняття права народу на формування та реалізацію правосуддя через призму політичних прав, які є тим орієнтиром, що сприяє реалізації народовладдя. Для цього з'ясовано значення та сутність політичних прав, зокрема, права обирати владу та права брати участь в управлінні держави. Акцентовано увагу на тому, що Конституцією України проголошено основоположну засаду демократичної держави: «Носієм суверенітету і єдиним джерелом влади в Україні с народ». Цей принцип передбачає можливість народу самостійно формувати бачення свого майбутнього і майбутнього держави, визначати повноваження і склад органів державної влади, на які покладається реалізація очікувань народу, та контролювати їх діяльність складно. Встановлено, суспільство контролює функціонування суду не тільки через участь громадян у процесі судочинства в якості присяжних і народних засідателів, але і через механізми виборності суддів та відкликання їх з посади. Тобто через реалізацію права на формування судової влади та здійснення правосуддя. А тому з огляду на те, що формування народом судової гілки влади здійснюється шляхом виборів, вважаємо за необхідне для біль повного з'ясування змісту та виду функцій народовладдя в ході реалізації такого права, дослідити також функції виборів взагалі.

In order to optimize the system of state financial control as an effective method of administration the financial mechanism of public administration by national economy of Ukraine in current conditions in the article methodological approaches to the formation of directions for improving the system of state financial control are developed, in particular, principles for functioning the state financial control are formulated, recommendations for reorganizing the structure of state financial control bodies are proposed, normative and legal norms for ensuring the state financial control are formed, a system of advanced control in process the financial mechanism of public administration by economy of Ukraine is introduced, that will prevent attempts to violate the financial legislation and, as a result, irrational use of financial resources.

Features of Military Administration: Administrative and Legal Aspect
The article researches the features of military administration in administrative legal aspect taking into account the features of public administration. First of all, it relates to the following features: organizational activity which results in administration relations; existence of the subject of public administration who has authoritative powers to exercise public administration in the structure of these relations (to have these relations not only subjects but an object who is influenced by the subject of administration should participate); relations of power between the subject and object of administration when only the state body which is the subject of administration has the power and the objects should fulfill orders of the subject; the state authoritative organizational activity when the laws should be followed and this activity is considered as regulatory based on effective legislation; public administration is exercised only within effective legislation; legal liability for violation of legislation. First, specific feature of military administration is its two levels when there are bodies of military administration and military command. Second, specific feature of military administration is its crisis orientation when under ordinary circumstances objects of such administration are servicemen, military base, military formations which means that it has a clear regulatory and internal organizational character. At the same time, during martial law, emergency or other situation provided for by legislation the sphere of military administration can increase and include objects out of the Armed Forces. Third, military administration is represented by administration exercised by a single person. Fourth, organizational unity has a significant meaning for military administration. Fifth, military discipline ensures a high level of procedural administrative relations, but majority of procedural norms are isolated and not represented by proceedings.

UK: Сьогодні в Україні від ефективності податкового адміністрування залежить стан податкових надходжень до бюджету (повнота та своєчасність податкових платежів), а відтак і спроможність держави вчасно та у належному обсязі оплачувати створення суспільних благ. Метою статті є вивчення складових елементів і обґрунтування напрямів покращення організації податкового адміністрування на прикладі територіальних органів ДФС у Запорізькій області. Розкрито структуру податкового адміністрування згідно Податкового кодексу України, яка включає: організацію податкових відносин, прогнозування та планування податкових надходжень, адміністративне регулювання податкових відносин, консультативну роботу, податковий контроль, адміністрування податкового боргу, впровадження сучасних технологій податкового адміністрування. Здійснено аналіз організаційних засад діяльності органів Державної фіскальної служби України. Виявлено неузгодженість функцій територіальних органів Державної фіскальної служби на прикладі їх функціонування в Запорізькій області. Обґрунтовано необхідність удосконалення податкового законодавства, зокрема в частині планування і проведення перевірок декларацій та звітності платників податків. Надано пропозиції щодо подальшого реформування діяльності територіальних органів Державної фіскальної служби задля покращення сервісного обслуговування платників податків. Зокрема автор рекомендує скасувати прив'язку платника податку до місця його реєстрації та здійснювати оподаткування об'єктів в місцях їхнього фактичного розміщення. Як вважає автор, запровадження електронного сервісу «Електронний кабінет платника податків» сприяє підвищенню якості обслуговування платників податків. EN: Today in Ukraine, the dynamics of tax revenues to the budget (completeness and timeliness of tax payments) and the ability of the state to pay for the creation of public goods in a timely and proper manner depend on the effectiveness of administration of taxes. The purpose of the article is to study the constituent elements and to substantiate the directions for improving the organization of administration of taxes by the example of the territorial bodies of the State fiscal service of Ukraine in the Zaporizhzhya region. The structure of administration of taxes was described in accordance with the Tax Code of Ukraine. It includes: the organization of tax relations, forecasting and planning of tax revenues, administrative regulation of tax relations, advisory work, tax control, administration of tax debt, introduction of modern technologies of administration of taxes. The analysis of organizational bases of activity of bodies of the State fiscal service of Ukraine was carried out. The inconsistency of the functions of the territorial bodies of the State Fiscal Service of Ukraine on the example of their functioning in the Zaporizhzhya region was revealed. The necessity of improving the tax legislation, in particular in the area of planning and conducting inspections of taxpayer declarations and reporting was grounded. Proposals were given on further reforming the activities of the territorial bodies of the State Fiscal Service of Ukraine to improve the servicing of taxpayers. In particular, the author recommends to cancel the taxpayer's connection with the place of his registration and the objects should be taxed in the places where they are actually located. According to the author's opinion, the introduction of the e-service "Taxpayer's Electronic Office" contributes to improving the quality of taxpayer services.
