La Relativizacion sociologica de la teoria de la justicia

The notion of justice can be analyzed from various viewpoints, eg, as a phenomenon to be studied for its own sake, or as a goal of the political system. The latter viewpoint was given considerable impetus in the Anglo-Saxon countries by the publication of John Rawls's Theory of Justice (1971 [no further publication data given]). However, in spite of his intentions of providing a transhistorical conceptualization of justice, Rawls's theory was linked too closely to the presuppositions of Anglo-Saxon political association to have universal validity. In this light, various concepts of justice are examined from Ancient Greece & Rome, the Middle Ages, the Renaissance, Marxist theory, & the Viennese jurist Hans Kelsen (What is Justice, Law, and Politics in the Mirror of Science, Los Angeles: U Calif Press, 1957), leading to the conclusion tha the idea of justice is closely tied to the predominant political values of the specific epoch. Saint Augustine's Critic to Cicero's Notion of Republic ; La crítica de San Agustín a la noción ciceroniana de República
The article starts with a comparison between the Ciceronian and Augustinian definitions of "Republic", whose key is harmony based on justice. Then, it presents the different meanings that the concept of justice acquires in both cases. Politically, it is for Cicero the legal body that belongs to a community, based on natural law. Augustine, on the other hand, conceived it as the just relationship of man with God. On this basis, the work seeks to point out that: 1) in fact, by elevating the Ciceronian characterization of "Republic" and bringing it to a higher and more universal order than the juridical-political, Augustine does not invalidate what Cicero affirmed on this last theme. And that 2) Augustine's intention was not to reject but rather to use the prestigious concept elaborated by the Romans, changing its meaning to, thus, have another glorious name with which to designate the City of God. ; El punto de partida de este trabajo es una comparación de las definiciones ciceronianas y agustinianas de "República", cuya clave es la armonía basada en la justicia. A continuación, el artículo presenta a continuación los diferentes significados que adquiere el concepto de justicia en ambos casos. Políticamente es para Cicerón el cuerpo jurídico que pertenece a una comunidad, basado en la ley natural. Agustín, por otro lado, lo concibió como la justa relación del hombre con Dios. Sobre esta base, el trabajo busca señalar que: 1) en efecto, al elevar la caracterización ciceroniana de "República" y llevarla a un orden más alto y universal que el orden jurídico-político Agustín no invalida lo afirmado por Cicerón sobre este último tema. Y que 2) la intención de Agustín no era rechazar sino más bien utilizar el prestigioso concepto elaborado por los romanos, cambiando su significación para, así, tener otro nombre glirioso con el que designar a la Ciudad de Dios.

De la crisis de la energía al concepto del patrimonio económico de la humanidad : criterios para reestructurar el sistema económico internacional
The successive crises that have been shaking the international economic system in recent years palpably reveal its inadequacy in the face of the requirements of contemporary international society, in its complex political, social, cultural and economic dimension. The present study aims, on the one hand, to examine the causes that have led to the obsolescence of the economic premises and legal principles of the currently prevailing system and, on the other, to explore the bases and trends on which general restructuring of the international economy may eventually rest, depending on contemporary reality. The sense of any restructuring that is attempted must be to seek a solution to the needs that have become evident in an international community characterized by its interdependence; it must advance towards a new stage conceived as the economic heritage of humanity. ; Las sucesivas crisis que han venido estremeciendo el sistema económico internacional en los últimos años, revelan palpablemente su inadecuación frente a los requerimientos de la sociedad internacional contemporánea, en su compleja dimensión política, social, cultural y propiamente económica. El presente estudio tiene por objeto, por una parte, examinar las causas que han llevado a la obsolescencia de las premisas económicas y los principios jurídicos del sistema actualmente imperante y, por otra parte, explorar las bases y tendencias en que eventualmente pueda descansar la reestructuración general de la economía internacional, en función de la realidad contemporánea. Sostenemos que el sentido de cualquier reestructuración que se intente, debe ser el de buscar una solución a las necesidades que se han hecho evidentes en una comunidad internacional caracterizada por su interdependencia, debiendo avanzar hacia una etapa concebida como el patrimonio económico de la humanidad.
