The research demonstrated the limitedness of Kant's and Rawls' approaches to the understanding of correlation of responsibility and justice. For Rawls, as well as for Kant, responsibility first of all relates to individual's freedom (and with existence of just political institutions). In other words, the American philosopher concentrates on the problem of justice of institutes and individual actions. But the questions of human responsibility for environment, responsibility for realization of the principles of justice, at last, the problem of collective responsibility stay outside this approach. It is demonstrated that responsibility is determined not only and not so much by individual's autonomy. Responsibility is connected with a feeling of guilt for the actions of community (to which the individual identifies himself), with a necessity of realization of the principles of justice through transformation of institutes and practices. At last, responsibility can be anthropologically determined in the case when we speak about the preservation of life on the earth. Interpretations of the sphere of responsibility and sphere of justice as coinciding ones were also refuted in the work. It was established, that the bounds of the former are wider at least because they include practices which are not regulated by the principles of justice. ; ***
The article considers the introduction of electronic justice in Ukraine. It is stated that the provision of effective information resources of administrative proceedings guarantees compliance with the principles of publicity, openness and transparency of consideration and resolution of public disputes. It is concluded that some steps have already been taken in this direction. And it was the pandemic that became, so to speak, a "push" for faster development in this direction, as the parliament, having passed the "anti-coronavirus" law, gave the parties more opportunities to participate in the processes remotely. Previously, this possibility was also available, but the party had to appear at the nearest court, where his identity was identified and his remote participation in the trial, which took place in another court, was ensured. Now the procedure has been simplified. And with the help of various video conferencing programs, the parties have more opportunities to hold remote hearings, and the courts have more tools to identify the parties. It was stated that European experts have repeatedly stressed that the four levels of electronic interaction between citizens and government, developed in the EU, namely: the first level: online information on public services; second level: one-way interaction: downloading forms from sites; third level: two-way interaction: form processing (including authentication), procedural actions in digital form; fourth level: transaction: work with the case, decision-making and announcement, payment, etc., the key to the effectiveness of any system, including judicial. It is concluded that despite the fact that the crisis caused by the pandemic has revealed problems related to imperfect legal regulation, technical unpreparedness of courts to move to e-justice, which is an urgent need of the time, the state strongly supports and develops this area. In particular, the Ministry and the Committee for Digital Transformation have been established, and a working group on the digitalization of the judiciary has been set up in the Verkhovna Rada Committee on Legal Policy to discuss innovations for the launch of the EITC. ; У статті розглянуто питання впровадження електронного судочинства в Україні. Вказано, що забезпечення дієвих інформаційних ресурсів адміністративного судочинства гарантує дотримання принципів гласності, відкритості й транспарентності розгляду й розв'язання публічно-правових спорів. Зроблено висновок, що окремі кроки на цьому шляху вже зроблено. І саме пандемія стала, можна сказати, «поштовхом» для швидшого розвитку в цьому напрямі, оскільки парламент, ухваливши «антикоро-навірусний» закон, надав сторонам більше можливостей брати участь у процесах дистанційно. Раніше ця можливість також була, але учасник процесу мав з'являтися до найближчої судової установи, де ідентифікували його особу й забезпечували його віддалену участь у процесі, що відбувся в іншому суді. Зараз процедуру спростили. І за допомогою різних програм відеоконфе-ренцзв'язку сторони отримали більше можливостей на проведення дистанційних засідань, а суди - більше інструментів для ідентифікації сторін. Констатовано, що європейські експерти неодноразово наголошували, що чотири рівні електронної взаємодії між громадянами й владою, що розроблені в Європейському Союзі, є запорукою ефективності будь-якої системи, в тому числі й судової. Це такі рівні: перший -онлайнова інформація про загальнодоступні послуги; другий - одностороння взаємодія: завантаження форм із сайтів; третій - двостороння взаємодія: обробка форм (у тому числі аутентифікація), процесуальні дії в цифровій формі; четвертий - транзакція: робота зі справою, прийняття та оголошення рішення, оплата тощо. Підсумовано, що незважаючи на те, що криза, викликана пандемією, виявила проблеми, пов'язані з недосконалістю правового регулювання, технічною неготовністю судів переходити до електронного судочинства, що є нагальною потребою часу, держава потужно підтримує та розвиває цей напрям. Зокрема створено Міністерство й Комітет цифрової трансформації, а також у Комітеті Верховної Ради України з питань правової політики створено робочу групу із цифровізації судочинства, де обговорюються питання інновацій для запуску Єдиної судової інформаційно-телекомунікаційної системи.
Organizational and functional particularities of judicial and law enforcement activities in Ukrainian Military Forces have been researched in the article within the scope of historical aspects and international experience. It has been emphasized, that strength of military forces is defined not only by quantity of staff, their professionalism, aptitude, quality of military stuff etc. Readiness of troops to oppose threats directly depends on the state of legality and legal order. International experience demonstrated, that in majority of developed countries, that have contemporary military forces and are known as democracies (USA, Great Britain, France, Canada, Spain – about 40 in total) the bodies of military justice reach significant success in strengthening military discipline and order. The Committee of European Council on Human Rights in June 2003 highlighted necessity of military justice bodies, as to the military courts the Committee stated, that their existence did not violate the UN Convention on Human Rights. It was indicated that military courts could be independent and unprejudiced courts. It`s highlighted, that military justice bodies are being currently eliminated even under conditions of antiterroristic operation in Ukraine (currently – Operation of United Forces), and factually under conditions of war at some territories of Ukraine. Military courts were eliminated in 2010, with no hope for renewal, although this issue has been considered at all levels of state authorities. Moreover, now it`s the turn for militaryprosecution bodies to be eliminated. In total there left the only Service of Military Order, with reduced capability and functions. There was provided additional evidence in favor of further Ukrainian military justice reformation by creation of specialized courts and law enforcement bodies: military courts, military prosecution service and future military police. Only in that case necessary lever of legality, legal order and discipline will be obtained in Ukrainian Military Forces. ; У статті, з урахуванням історичного аспекту проблеми та міжнародного досвіду, розкрито організаційні та функціональні особливості здійснення судової та правоохоронної діяльності у Збройних Силах України. Підкреслено, що оборонна міць збройних сил визначається не тільки кількістю військовослужбовців, рівнем їх професіоналізму та майстерності, якістю військової техніки. Боєздатність військових частин та з'єднань напряму залежить від стану законності та правопорядку в них. Тому міжнародний досвід свідчить про те, що у більшості розвинутих країн, які мають сучаснізбройні сили і які у той же час відомі своїми демократичними традиціями (США, Великобританія, Франція, Канада, Іспанія – всього близько 40) органи військової юстиції успішно діють і виконують завдання по зміцненню військової дисципліни та правопорядку. Постійним Комітетом Ради Європи з прав людини (м. Страсбург) у червні 2003 р. була взагалі визначена потреба органів військової юстиції, а щодо військових судів висловлена думка про те, що їх наявність в країні не суперечить Конвенції про захист прав людини і її основоположних свобод, а також зобов'язанням держав, які підписали цю конвенцію. Зазначено, що військові суди можуть бути визнані незалежними і неупередженими судами. Звертається увага на те, що в Україні, в умовах раніше – антитерористичної операції, а зараз – операції об'єднаних сил, а фактично проведенні реальних бойових дій на певних територіях країни, нажаль, йде процес ліквідації органів військової юстиції. Так, військові суди були ліквідовані ще у 2010 році, й до цього часу не відновлені, хоча це питання вирішувалося на всіх необхідних рівнях органів державної влади, військові прокуратури зараз на межі ліквідації. У наявності лише органи Військової служби правопорядку, але з вельми обмеженими повноваженнями, виключно профілактичної спрямованості. Наведені аргументи на користь подальшого реформування військової юстиції у Збройних Силах України, з формуваннями спеціалізованих судових і правоохоронних органів, а саме, їх тріади у складі: військових судів, військової прокуратури та органів Військової служби правопорядку (у майбутньому – військової поліції). Тільки у такому разі буде реально забезпечений належний рівень законності, правопорядку та військової дисципліни у Збройних Силах України.
The article deals with the interpretation of the principle of justice in Islam as a religion of society's prosperity based on social justice. The author proves that the category of "justice" in Islam has several meanings: firstly, it is equally the same treatment of any person to anybody in the community; secondly, it is the equality between people; thirdly, these are actions corresponding to the generally accepted moral and legal standards; fourthly, these are conscience, accuracy, impartiality, faithfulness, certainty, correctness and truth; fifthly, it is justice; and finally, it is a kind of counterweight to tyranny injustice and evil. But the Islamic understanding of justice differs in interpretation of it not only as a personal virtue, but as a principle of organization of community of believers and political system. The use of different values of justice aims to fi ll the very meaning of justice by means of these terms. It includes equity, equality, sincerity and control. On the one hand, it is justice between creator and creation, when power of Allah consider above you own happiness, His prosperity above your own whims and desires, and also when follow His commandments and keep His prohibitions. On the other hand, justice is reflected in relationships between people and their own "I", when it rejects any destruction. Thirdly, there must be justice between among all Allah's creations for them to be guided by law, to help each other with advice and deed, but not to cheat and bring any harm, to endure insults patiently and always follow the middle path. It has been proved that the Muslim idea of justice is based on the principle of coordination of own actions according to the requirements of natural order of things, where the law refers to the God's established order of life relationships, derived from human nature, the nature of things and the nature of relationships. The requirements of justice in this order presuppose the need to return to its original state in case of violation of this order. Muslims are expected just to follow this order, including the way of social cohesion in mind (community), limits of which coincide with the limits of the Islamic world itself. ; У статті розкрито трактування принципу справедливості в ісламі як релігії процвітання суспільства на основі соціальної рівності. Доведено, що уявлення про даний принцип в ісламі базується на основі узгодження своїх дій з вимогами природного стану речей, де під справедливістю розуміється порядок життєвих відносин, встановлений Богом; порядок, який випливає з природи людини, природи речей і природи відносин. Вимоги справедливості в ісламі полягають у необхідності повернення до початкового стану у випадку порушення даного порядку. The article presents and solves the scientific problem of identifying the legal nature and content of social justice as an integral part of the principle of justice. The theoretical and normative basis of the study were scientific works of domestic and foreign scientists in the field of jurisprudence, philosophy, political science, sociology, history. They are devoted to the general problems of the essence of the principle of justice, its value and normative content, social and legal nature of the principle of justice, issues of legal certainty and stability of legal regulation, specific problems of implementation of the constitutional principle of justice. The problem of justice, namely social justice becomes especially relevant in the context of globalization. The practice of the Constitutional Court of Ukraine shows that the Constitution of Ukraine does not enshrine the principle of social justice in a direct form, but the entire legal system is based on the idea of justice. It is established that justice essentially reflects the realities of a society, the level of its cultural and legal maturity. It can manifest itself at different social levels, in different spatial and temporal dimensions. Thus, correlating the concepts of justice and law, justice can be considered as a legal standard with which the real socio-economic, political, financial, moral and ideological relations. Justice is not only a moral, philosophical category, but, first of all, a legal one. Justice is a legal phenomenon that relates to the very essence of law and is the distinguishing feature between law and the principles of law. In addition, it is a phenomenon of morality, because it is an idea that determines the moral principles of society. It should be noted that in some cases the application of the principle of justice is complicated, for example, when it conflicts with the principle of legality. Attention is drawn to the fact that in our state the principle of justice is not fully implemented. Social justice is the most important social value, a creative phenomenon that contributes to the reform of society on the basis of democ-racy and humanism. ; Стаття поставлена і вирішена наукова проблема виявлення юридичної природи та змісту соціальної справедливості як складова частина принципу справедливості. The author upholds the thought that the human's being "under guidance of numerous things", the diversity of spheres of human activities as if gives cause for objecting the architectonic character of politics. However it is the diversity of spheres in each society, in the author's opinion, that is a result of the global institution of the society which gives every reason for the recognition of the architectonic role of politics, as well as the complex unity under the name of the objective mind. The present distribution of market in the social sphere nourishes individualistic comprehension of human rights. Thus, the philosopher concludes, the objective mind is anxious of modern subjectivism and individualism as never before. ; ***

Стаття розглядає правосуддя перехідного періоду в контексті пошуків нових форм миротворчої діяльності. Перехідний період від конфлікту до миру потребує спеціальних заходів щодо відновлення та розвитку суспільного життя. Комплекс даних заходів у документах ООН та в наукових теоріях отримав назву «правосуддя перехідного періоду». Україна внаслідок збройного конфлікту на Донбасі та анексії Криму Російською Федерацією потребує механізмів постконфліктного врегулювання, адаптованих до національного контексту. Актуальним питанням є використання практичних та теоретичних напрацювань правосуддя перехідного періоду та визначення необхідних функцій держави в реалізації постконфліктних заходів. Серед даних ініціатив – акцент на державній політиці в регіонах, пошук шляхів допомоги слабким державам посилити власну суб'єктність і самостійно боротися з наслідками насилля. Вочевидь, різні інтерпретації минулого використовуються політиками, що є особливо характерним для розділених суспільств, де настроями окремих груп населення користуються заради отримання політичних дивідендів. З цієї точки зору завдання держави у постконфліктній відбудові – діяти автономно від короткострокових, кон'юнктурних політичних дискурсів, значна частина яких може розділити суспільство. Правосуддя перехідного періоду – сукупність процесів, пов'язаних зі спробами суспільства знайти спільну мову щодо спадщини минулих масштабних зловживань для забезпечення відповідальності, служіння справедливості та досягнення примирення. До функцій правосуддя перехідного періоду відносяться: сприяння демократизації; зменшення кількості випадків порушення прав людини; законодавче закріплення офіційних подій конфліктного минулого в офіційній версії; надання репарацій і насамперед матеріальних виплат жертвам; сприяння примиренню. Фактично правосуддя перехідного періоду не є нейтральним інструментом досягнення правди, відновлення жертв та примирення, оскільки завжди реалізується в певному політичному контексті. Крім юридичної експертизи імплементації транзитивного правосуддя, на нашу думку, має використовуватися соціально-політична експертиза. Важливим результатом такої експертизи є формування політики пам'яті, зокрема через вивчення громадської думки та врахування інтересів різноманітних соціальних груп суспільства. ; The end of the Cold War led to the search for new forms of peacemaking. These initiatives include a focus on public policy in the regions, finding ways to help weak states strengthen their capacity and deal with the effects of violence on the society. The transition from conflict to peace requires special measures to restore and develop social life. The set of measures in UN documents and scientific theories was called "Transitional Justice". As a result of the armed conflict in the Donbas and in the annexation of the Crimea, Ukraine needs mechanisms of post-conflict settlement, adapted to the national context. A topical issue is the use of practical and theoretical developments in transitional justice and defining the necessary functions of the state in the implementation of post-conflict measures. Obviously, different interpretations of the past are used by politicians, which is especially characteristic of divided societies, where the attitudes of particular groups of the population are used for political dividends. From this perspective, the task of the state in post-conflict reconstruction is to act autonomously from short-term, conjunctural political discourses, much of which can be divided by society. Transition justice is a set of processes related to society's attempts to find common ground on the legacy of past widespread violence to ensure accountability, serve justice and achieve reconciliation. The functions of transitional justice include: promoting democratization; reducing the number of human rights abuses; legislative consolidation of official events of the conflict past in the official version; reparations and, first and foremost, material payments to victims; promoting reconciliation. In fact, transitional justice is not a neutral tool for achieving truth, recovering victims and reconciliation, as it is always implemented in a particular political context. In addition to the legal expertise of transitional justice implementation, we believe that socio-political expertise should be used.
