This article presents a history and development of the institution of justices of the peace in the United States from the beginning of formation of American democracy until modern times. It presents jurisdiction, the scope of the activities and the role of justices of the peace in several states through different periods of times. It includes a thorough discussion concerning pros and cons of justices of the peace in the U.S. legal system and general tendency of declining the institution of justices of the peace in modern times. The article includes also a discussion of the major court decisions concerning justices of the peace. ; Niniejszy artykuł jest próbą prześledzenia rozwoju instytucji sędziów pokoju od czasów tworzenia się demokracji amerykańskiej w XVIII w. do współczesności, a także oceny ich funkcjonowania. Opisano funkcjonowanie sędziów pokoju w różnych stanach oraz to, w jaki sposób rola tej instytucji zmieniała się przez ponad 200 lat funkcjonowania demokracji amerykańskiej. Analizie poddano wyroki sądów amerykańskich (włącznie z wyrokami Sądu Najwyższego) odnoszące się do problematyki umiejscowienia i roli sędziów pokoju w amerykańskim wymiarze sprawiedliwości.

The Amsterdam Treaty has established the Area of Freedom, Security and Justice (AFSJ). Since then, it is an example of a policy-making area creating its way quickly and comprehensively. However, in this paper the main dilemma is to what extent the Schengen development has modified the framework of AFSJ and how it adapts in this policy while being an example of enhanced cooperation and differentiated integration model. Developments in this area are part of a realisation that European states need to act together to better face new challenges to peace and internal security, while ensuring respect for democracy and human rights. It is important to add, that cooperation in the Area of Freedom Security and Justice has been driven by forces different from that seen in other policy areas.

Istnienie państwa dobrobytu może być uzasadniane za pomocą argumentacji zarówno ekonomicznej, politycznej, jak i filozoficznej. W artykule scharakteryzowano sprawiedliwość dystrybutywną z perspektywy liberalnego egalitaryzmu, co stanowi jednocześnie analizę filozoficznej argumentacji na rzecz państwa dobrobytu. Odwołano się przy tym do dwóch najbardziej wpływowych koncepcji: teorii sprawiedliwości jako bezstronności autorstwa Rawlsa oraz idei równości zasobów zaproponowanej przez Dworkina. Celem artykułu była ocena modeli państwa dobrobytu w świetle wymagań stawianych w obu koncepcjach sprawiedliwie urządzonemu społeczeństwu. Autor dowodzi, że mając na względzie realne możliwości jednostek do formułowania, rozumnego realizowania oraz korekty swych własnych planów życiowych, jedynie socjaldemokratyczny (nordycki) model państwa dobrobytu można uznać za akceptowalny z perspektywy egalitarystycznej. ; The existence of the welfare state can be justified by economic and political arguments as well as philosophical ones. The paper analyses the liberal-egalitarian view on distributive justice and hence on the philosophical justification of the welfare state, based on two most influential egalitarian concepts: Rawls's theory of justice as fairness and Dworkin's equality of resources theory. The aim of this article was to evaluate the welfare state regimes in the light of requirements of both theories that just society must satisfy. It is argued that with respect to the individual capacity to formulate, rationally pursue, and revise one's life plans, the social-democratic (Nordic model) may be deemed as the only regime capable of being accepted from the egalitarian perspective.

In the article author states and justifies three theses on the lay judges and their participation in the exercise of justice in Poland. First thesis claims that the statement about the lack of integration in the community of lay judges in Poland is not true any longer and it is possible to observe the beginning of a process of its integration and cooperation connected with the recent establishment and activity of the Association National Council of Lay Judges. The second thesis states, that it is necessary to broaden the participation of citizens in the exercise of justice as a remedy for a low level of legitimacy and credibility of the judiciary. According to the third thesis Poland is presently in need of a widespread public debate concerning the reform of the institution of lay judges which should lead to a real fulfilment of the constitutional right of citizens to participate in the exercise of justice. ; In the article author states and justifies three theses on the lay judges and their participation in the exercise of justice in Poland. On 16 March 2019 the amendment of the Act – the Industrial Property Law, which implemented the European Parliament and EU Council Directive 2015/2436 of 16 December 2015, aiming the rapprochement of legislation within the membership countries regarding trade marks. The essential change, that the amendment implemented is the cancellation of the necessity of graphical representation of the trade mark, what allows to simplify the registration of the unconventional trade marks. The purpose of the article is to present how the registration of unconventional trade marks looked within the light of the Luxembourg tribunal's statements. ; W dniu 16 marca 2019 r. weszła w życie nowelizacja ustawy Prawo własności przemysłowej, która implementowała dyrektywę Parlamentu Europejskiego i Rady (UE) 2015/2436 z dnia 16 grudnia 2015 r. mającą na celu zbliżenie ustawodawstw państw członkowskich odnoszących się do znaków towarowych. Istotną zmianą, jaką wprowadziła nowelizacja, jest zniesienie wymogu graficznej przedstawialności znaku towarowego. Umożliwi to łatwiejszą rejestrację niekonwencjonalnych znaków towarowych. Celem niniejszego artykułu jest zaprezentowanie, jak w świetle orzecznictwa trybunału luksemburskiego przedstawiała się rejestracja niekonwencjonalnych znaków towarowych.

The inauguration of Nelson Mandela as South Africa's first democratic president on 10 May 1994 became a symbol of the end of apartheid and the beginning of a new chapter in the country's history. As South African society was deeply divided, the 1993 Interim Constitution expressed the need for reconciliation between the people of South Africa and the reconstruction of its society. The legacy of apartheid was to be addressed based on 'a need for understanding but not for vengeance, a need for reparation but not for retaliation, a need for ubuntu but not for victimization'. Due to its introduction into the Constitution, ubuntu – a philosophy of unity, cooperation, compassion and respect for human dignity, which originated in small African communities – became a source of values for the whole legal system. The goal of the text is to present the ubuntu philosophy and to describe its role in the South African transitional justice process and in selected areas of South African law (criminal law, evictions and defamation). On the whole, South Africapresents a unique case in which both the political transformation and the legal system were strongly shaped by the said philosophical and ethical concepts, which bear close resemblance to the idea of restorative justice. ; Zaprzysiężenie 10 maja 1994 r. Nelsona Mandeli na pierwszego demokratycznie wybranego prezydenta Republiki Południowej Afryki stało się symbolem końca apartheidu i otwarcia nowego etapu w historii tego państwa. Wobec istniejących w społeczeństwie głębokich podziałów przejściowa Konstytucja RPA z 1993 r. wyrażała potrzebę pojednania pomiędzy obywatelami RPA, a także rekonstrukcji wspólnoty. Przezwyciężenie spuścizny apartheidu miało być oparte na potrzebie "zrozumienia, a nie zemsty", "rekompensaty, a nie odwetu" oraz "ubuntu, a nie wiktymizacji". Filozofia ubuntu (wywodząca się z małych afrykańskich wspólnot filozofia jedności, kooperacji, współczucia i respektu dla ludzkiej godności), do której odwołanie zamieszczono w Konstytucji – stała się rezerwuarem wartości dla całego systemu prawa. Celem artykułu jest przedstawienie filozofii ubuntu oraz omówienie jej roli w rozliczeniach z przeszłością w Republice Południowej Afryki i w wybranych obszarach południowoafrykańskiego prawa: w prawie karnym, regulacjach dotyczących eksmisji z nielegalnie zajmowanego gruntu oraz w regulacjach przewidujących odpowiedzialność deliktową za zniesławienie. RPA jawi się przy tym jako wyjątkowy kazus, w którym zarówno polityczna transformacja, jak i system prawny kształtowały się pod istotnym wpływem omawianych koncepcji filozoficznych i etycznych, silnie nawiązujących do idei sprawiedliwości naprawczej.

The subject of this paper is an analysis of behavior on the Polish political stage. Its starting point is a reflection on conflict and consensus in a democratic system. This general context requires us to approach these phenomena in terms of a range of aspects which can in turn affect the final assessment of conflict and consensus from the point of view of the quality of the political system. It turns out that the most important communication channels for this interaction are systematically and consistently closed by both sides involved in the conflict. The assumption that this political activity is inspired by marketing suggests that such a strategy has been planned in advance and is rationally implemented. ; The subject of this paper is an analysis of behavior on the Polish political stage. Since 2005, political life in Poland has been largely dominated by a dispute between two parties: Civic Platform (PO) and Law and Justice (PiS). This dispute is not just a rivalry between party leaders on political programs. It is rather a confrontation of the antagonistic views of the voters and supporters of both parties. The unsuccessful talks between the leadership groups of both parties, which did not lead to the formation of a coalition government in 2005 are often referred as a symbolic beginning of this conflict. The intensity of this dispute, prompts the observers of public and political life to formulatea thesis about two metaphoric Polands, two tribes that are alien to each other. Authors of the scientific and journalistic analyses of this phenomenon often point out the differences in demographic and social characteristics of the electorates of both parties. However, these differences are less important than dissimilarities in views and opinions of PO and PiS supporters on events, phenomena and persons relevant to party identities. The media also play a crucial role in supporting and reproducing different views of supporters of both parties. The purpose of this paper is to present a characteristics of the supporters of both parties and to analyze the evolution of their political likes and dislikes in the last several years. The conclusions are based on a analysis of the data collected in the years 2001–2019 by the Public Opinion Research Center (CBOS) and by other researchers. ; Od 2005 roku życie polityczne w Polsce w znaczącym stopniu zdominowane jest przez spór dwóch partii: Platformy Obywatelskiej (PO) oraz Prawa i Sprawiedliwości (PiS). Spór ten nie jest tylko rywalizacją liderów i członków partii na programy polityczne. To konfrontacja antagonistycznych światopoglądów wyborców oraz sympatyków obu partii. Jej symbolicznym początkiem są nieudane rozmowy między gremiami przywódczymi obu partii, które nie doprowadziły do powstania koalicyjnego rządu w 2005 roku. Intensywność sporu, toczonego w wielu środowiskach, skłania obserwatorów życia publicznego do formułowania tezy o dwóch metaforycznych Polskach, o dwóch obcych sobie plemionach. Autorzy naukowych i publicystycznych analiz tego fenomenu często wskazują na różnice w zakresie cech demograficznych i społecznych, jakimi charakteryzują się elektoraty obu partii. Odmienności te mają jednak drugorzędne znaczenie w stosunku do różnic w poglądach zwolenników PO i PiS na temat wydarzeń, problemów, zjawisk i osób istotnych dla partyjnych tożsamości. Istotną rolę w podtrzymywaniu i reprodukcji odmiennych światopoglądów sympatyków obu partii odgrywają media. Celem tekstu jest dokonanie charakterystyki cech oraz podzielanych poglądów sympatyków obu partii oraz analiza ewolucji ich sympatii i antypatii politycznych w ostatnich kilkunastu latach. Wnioski formułowane są na podstawie wtórnej analizy danych zebranych w latach 2001–2019 przez Centrum Badania Opinii Społecznej oraz przez innych badaczy.

The analysis presented in this article concerns the impact of Court of Justice of the European Union (CJEU) jurisprudence on the legal situation of Supreme Court and Supreme Administrative Court judges in Poland. The main assumption of the presented considerations is that the CJEU, in providing answers to preliminary questions submitted to it by Polish courts adjudicating cases related to judicial appointments and retirements, strengthens the independence of the courts and the independence of the judiciary, assuming that these are systemic elements of a functioning judiciary subject to EU law. For this reason, the CJEU considers itself competent to shape these systemic values under Polish law. At the same time, this body does not notice the problem of jurisdiction of Polish courts posing legal questions, which becomes an important theoretical and practical issue, because it may affect the legality and effectiveness of judgements passed on the basis of answers given by the CJEU. Detailed considerations focus on two types of judgements of the CJEU, which were made in connection with the retirement of judges, as a result of questions submitted to the Court by the Supreme Court and Supreme Administrative Court. The subject of the questions related to the compatibility with EU law of the scope of legal protection granted in Polish law to a judge against resolutions adopted in such cases by the National Council of the Judiciary. The considerations presented conclude that in the case of a CJEU judgement issued as a result of a question posed by the Supreme Court, the jurisdiction of the authority posing the question was infringed, and this should have consequences for the scope of binding the court adjudicating on the answer provided by the CJEU. ; Przedstawiona analiza odnosi się do wpływu orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE) na kształtowanie w Polsce sytuacji prawnej sędziów Sądu Najwyższego (SN) i Naczelnego Sądu Administracyjnego (NSA). Głównym założeniem przedstawionych rozważań jest stwierdzenie, że TSUE w ramach udzielanych odpowiedzi na pytania prejudycjalne, kierowane do niego przez polskie sądy, rozpoznające sprawy związane z powołaniami na stanowisko sędziowskie oraz z przejściem w stan spoczynku, wzmacnia niezależność sądów i niezawisłość sędziowską, przyjmując, że są to elementy ustrojowe funkcjonującego wymiaru sprawiedliwości podlegające prawu Unii Europejskiej. Z tego powodu TSUE uznaje się za właściwy do kształtowania tych wartości ustrojowych na gruncie prawa polskiego. Jednocześnie organ ten nie zauważa problemu właściwości polskich sądów występujących z pytaniami prawnymi, co staje się ważnym zagadnieniem teoretycznym i praktycznym, gdyż może rzutować na legalność i skuteczność orzeczeń zapadających na podstawie udzielonych przez TSUE odpowiedzi. Szczegółowe rozważania koncentrują się na dwóch rodzajach orzeczeń TSUE, które zapadły w związku z sędziowskim stanem spoczynku, na skutek wystąpienia do TSUE z pytaniami przez SN i NSA. Przedmiot pytań odnosił się do zgodności z prawem unijnym zakresu ochrony prawnej przyznanej w prawie polskim sędziemu od uchwał podejmowanych w tych sprawach przez Krajową Radę Sądownictwa. Konkluzją przedstawionych rozważań jest stwierdzenie, że w przypadku wyroku TSUE wydanego na skutek pytania SN doszło do naruszenia właściwości organu występującego z pytaniem, a to powinno mieć konsekwencje dla zakresu związania sądu orzekającego odpowiedzią udzieloną przez TSUE.

Główna hipoteza badawcza postawiona w artykule brzmi: postulatyprogramowe (wyborcze) partii PiS, PO i ZL, miały decydujący wpływ na sukces wyborczy tych partii w wyborach parlamentarnych w Polsce w 2015 roku. Celem autora była charakterystyka programów wyborczych prawicowych i lewicowych partii oraz koalicji wyborczych przed wyborami parlamentarnymi w 2015 r. Scharakteryzowane zostały programy wyborcze poszczególnych komitetów wyborczych. W artykulepodjęto próbę charakterystyki partii politycznych posiadających największy potencjał wyborczy i reprezentujących główne nurty ideowe w Polsce: konserwatywny, liberalny oraz socjaldemokratyczny. Tekst ma charakter interdyscyplinarny, problem badawczy został przeanalizowany z perspektywy politologicznej, socjologicznej i filozoficznej. Weryfikując hipotezę postawioną w pracy, zauważono, iż występuje dużeprawdopodobieństwo, że to właśnie (socjalny) program wyborczy partii PiS, miał kluczowy wpływ na jej wynik wyborczy. Próba odpowiedzi na postawione pytanie badawcze może wnieść istotny wkład w dalsze badanie procesu rywalizacji wyborczej partii politycznych w Polsce. ; The main research hypothesis of the article is as follows: the postulates of th electoral manifestos of the Law and Justice (PiS), Civic Platform (PO) and United Left (ZL) parties had a crucial impact on their success or failure in the 2015 parliamentary elections in Poland. The manifesto of each party is briefly described here.Owing to the interdisciplinary nature of the text, it applies political, sociological and philosophical approaches. During the verification of the main hypothesis it turns out that both PiS and PO emphasized social issues (mainly of economic character) during their electoral campaigns. This common factor was a feature distinguishing these two parties from the others during the elections. It can be assumed, with a fair degree of probability, that this was a key factor in the victory of PiS. The article attempts tospecify the underlying ideological currents of political parties in Poland in 2015 (Conservatives, Liberals, Socialists). The analysis may contribute to the further investigation of rivalry in the electoral process in Poland.
