Das Urteil des Bundesverfassungsgerichts zur EZB-Politik vom 5. Mai 2020 wird der strategischen Problematik der Geldpolitik nicht gerecht. Insbesondere die künstliche Unterscheidung zwischen erlaubter "Geldpolitik" und nicht erlaubter "Wirtschaftspolitik" ist unangemessen. Die daraus resultierende Forderung nach einer Abwägungsprüfung stellt nicht nur die institutionellen Prinzipien der Geldpolitik in Deutschland auf den Kopf, sondern erweist sich, abgesehen von der Forderung nach mehr Transparenz, auch als engstirnig und kaum anwendbar.

Die politische, wirtschaftliche und rechtliche Lage Großbritanniens gegenüber der Europäischen Union nach dem EU-Mitgliedschaftsreferendum und im Vorfeld der Austrittsverhandlungen stellt sich ungewiss dar. Die Autoren fassen die verfassungsrechtliche Kontroverse über die Kompetenz- und Verfahrensfragen zur rechtmäßigen Brexit-Durchführung zusammen. Darüber hinaus geben sie einen Überblick, inwiefern der Vertrag über die Europäische Union und der Vertrag über die Arbeitsweise der Europäischen Union die Entscheidungsfi ndung der Verhandlungspartner determinieren. Vermutlich wird Großbritannien, um den Zugang zum europäischen Markt nicht zu verlieren und um seine Rolle als Finanzzentrum sowie als Tor zu Europa für private Investoren aus Drittländern weiter spielen zu können, Transferleistungen an die EU akzeptieren und wesentliche Bereiche des Acquis Communautaire beachten müssen. ; The political, economic and legal situation of Great Britain vis-à-vis European Union in the aftermath of the membership referendum and awaiting the commencement of withdrawal negotiations is interesting. The authors summarise the legal controversy in the UK over the powers and procedures needed to be complied with in order to duly trigger the Brexit. They then sketch the legal framework as provided by the Treaty on European Union and the Treaty on the Functioning of the European Union to reconstruct the decision-making architecture under which parties to the upcoming negotiations will have to make their choices. After outlining the opportunity cost for Great Britain associated with leaving the Union, in particular those regarding the fi nancial institutions and foreign direct investments, they conclude that decision-making architecture governing the upcoming withdrawal negotiations puts Brussels in pole position vis-à-vis London. It is likely that Britain will have to accept transfer payments to the EU similar to, if not higher than the net transfers that have been due so far. Some degree of the compliance with the acquis communautaire, at least with regard to the treaty's fundamental freedoms (goods, workers, services, establishment and capital) will most likely also be expected from London, if it wants to benefit from access to the European market after the termination of its EU membership.

Spain is the Member State of the European Union whose public opinion is most in favour to exit the Eurozone. In this context, there is a growing social and political debate on this issue in this Member State. This paper analyses at a theoretical level the main economic and socio political determinants that Spain would face if it were considering to take a decision to leave the EMU.

Services are regulated for a variety of reasons. Regulation is typically influenced by political economy forces and may thus at times reflect protectionist motivations. Similar considerations arise for goods, but the potential for protectionist capture may be greater in services as many sectors are self-regulated by domestic industry. There are specific disciplines on regulation of goods (product standards) in the WTO Agreement on Technical Barriers to Trade (TBT). This encourages the use of international standards and requires that norms restrict trade only to the extent necessary to achieve the regulatory objective. WTO disciplines on domestic regulation of services are weaker and differ in key respects from those for goods. We discuss reasons for this discrepancy and assess whether consideration should be given to seeking to adopt the TBT-type disciplines that apply to trade in goods.

Die gegenwärtige, seit 2007 Wissenschaft, Wirtschaft und Politik intensiv beschäftigende internationale Finanzmarktkrise hat die Bedeutung von interdisziplinärer Forschung zu konstitutionellen Grundlagen globalisierter Finanzmärkte im Spannungsverhältnis von Stabilität und Wandel deutlich vor Augen geführt. Allerdings ist das wissenschaftliche Interesse an dieser Thematik nicht situationsbezogen auf die Ereignisse seit 2007 beschränkt, im Gegenteil: Die aktuellen Diskussionen beziehen sich im Kern in weiten Bereichen auf wissenschaftlichen Fragen, die schon vor 2007 immer wieder thematisiert wurden. Allerdings fehlte und fehlt es bis heute an übergreifenden inhaltlichen und methodischen Ansätzen, die die Komplexität globalisierter Finanzmärkte insgesamt erfassen. An dieser Stelle setzt das Forschungsprogramm zu konstitutionellen Grundlagen globalisierter Finanzmärkte an. Konkret geht es insofern um drei Untersuchungsfelder, die sachlich eng miteinander verzahnt sind: I. Finanzsystemstabilität als internationale Regulierungsaufgabe, II. Adäquanz der Internationalen Finanzarchitektur, III. Finanzmärkte und Realwirtschaft.

L'article aborde du point de vue de l'État en développement l'« Instrument international juridiquement contraignant sur la conservation et l'utilisation durable de la diversité biologique marine des zones ne relevant pas de la juridiction nationale » et les évolutions du droit international de la mer qu'il comporte. Le maintien de la diversité biologique marine éloignée pour elle-même ou en situation d'être exploitée représente un domaine original du droit international du développement qui implique une coopération forte dédiée aux transferts de connaissances scientifiques et de technologies marines. Cette étude analyse la volonté des pays les moins avancés et leur organisation en un Groupe consultatif en vue d'influencer la gouvernance économique mondiale, dans le cadre de l'Organisation mondiale du commerce, lors du programme de Doha pour le développement À partir d'une analyse positiviste des textes officiels, l'article montre qu'il ne s'agit que d'une tentative chimérique de redéfinition de la gouvernance économique mondiale : le néolibéralisme reste la doctrine en vigueur et les tentatives de démocratisation des relations commerciales internationales ne constituent qu'une stratégie politique destinée à préserver l'ordre actuel. We enrol our approach in the context of activating Article 50 of the Treaty of Lisbon, in which United Kingdom expressed its clear and firm intention to leave the European Union. Britain's relations with the European Union have had a difficult path from the start. Since 1957, the UK refused to join the EU founding group, and later was twice refused its membership requests. The Common-Law leadership position offered to the UK, compared to other states, a privileged status, and yet this status did not bring the desired benefits to the six European states that created the EU. In the context created by Brexit, the most important message is related to the lack of clarity and predictability in all areas of social life, both in the UK and within the European Union. It is argued that, following the enlargement to the East of the EU, the British have witnessed a migration of East Europeans, which has led to employment and the creation of a real estate crisis. Withdrawal from the EU is just as spectacular and "original" as joining the European Community space.
