[EN] Between 1674 and 1678, a land and naval war occurred just off the east coast of Sicily, between France and Spain. The town of Augusta had a wide natural harbour but an inadequate defence system: thus, it was easily conquered by the French army. After the war the fortifications of the town were updated. In this respect, the military engineer Carlos De Grunenberg built new fortifications on the isthmus that connected the town to the mainland. Historical and landscape value of De Grunenberg's fortifications derives from their specific position in the area where the old town, surrounded by the sea, meets the mainland and the modern quarters. Unfortunately, the fortress was conceived as to be built on a flat ground, rather than on a slope. Its clay foundation wasn't taken into account and serious instabilities, caused by earthquakes and the action of the sea, now urge for consolidation and restoration works, which represent the issue of the present proposal. ; Di San Lio, E.; Vitale, MR.; Aliffi, F.; Macca, S. The wave of protests that, starting from the end of 2010, hit some countries in the Middle- East North-Africa region, leading to the fall of long-standing autocratic regimes and referred to as the Arab Spring, has renewed the interests of researchers on youth bulges. The youth bulge theory links the demographic transition to political instability, by asserting that countries characterized by a particularly young population tend to be more vulnerable to political violence. The aim of the thesis is to test empirically this hypothesis on a sample of 160 countries in the post-World War II period. For this purpose, we adopt an econometric strategy alternative to the one prevailing in the literature on the determinants of civil conflicts: we employ a simple linear regression model which accounts for country and time fixed effects.
Although in comparison to other key Gramscian concepts, ideology has not been among the most studied, this is beginning to change. In particular, recent scholarship has demonstrated a diffuse and variegated usage of the term in the Prison Notebooks, as well as an innovative extension of the concept, which is articulated around a network of closely correlated terms and concepts. Nevertheless, debates remain over how to understand its meaning in Gramsci's carceral discourse, with some arguing that his distinctive conception of ideology has a "neutral", and arguably, also "positive" meaning, while others contend that it is neither "neutral", nor "positive", but a critical concept. This essay argues that Gramsci's conception of ideology is neither neutral nor positive, but rather, an eminently critical and differentiated analysis of the diverse ideological forms of consciousness through which the popular masses are enveloped within the web of a class's hegemony through the mediation of the philosophers' philosophies, the fruit of his attempt to rethink philosophy politically. In short, understanding Gramsci's conception of ideology in the full sense can only be ascertained by following the threads of his philosophical investigations in their shifts and re-elaborations. Georges Canguilhem has never systematically discussed Sigmund Freud's thinking. This essay aims to reconstruct Canguilhem's reading of Freudian psychoanalysis, highlighting its strategic use within the framework of Canguilhem's controversy against psychology. From this point of view, knowledge is established as a field of political struggle: unlike psychology and its deterministic and normalizing drifts, psychoanalysis allows Canguilhem to affirm the irreducibility of thought to brain localizations, to emphasize its erratic power and to think the constitution of an eccentric subjectivity. ; Georges Canguilhem non ha mai trattato in maniera sistematica il pensiero di Sigmund Freud. Il presente saggio propone di rintracciare la lettura della psicoanalisi freudiana operata da Canguilhem, mettendone in evidenza l'utilizzo strategico nel contesto della sua polemica contro la psicologia. In tale prospettiva, il sapere risulta istituito come campo di una lotta politica: al contrario della psicologia e delle sue derive deterministiche e normalizzanti, la psicoanalisi permette di affermare l'irriducibilità del pensiero alle localizzazioni cerebrali, di enfatizzarne la potenza erratica e di pensare la costituzione di una soggettività eccentrica.
Il testo vuole presentare il lavoro di Vanda, gruppo fondato alla Facoltà di Architettura del Politecnico di Milano da tre docenti e una ricercatrice. Vanda ha intrapreso la ricerca su "teorie e opere femminili in architettura" con un seminario dal titolo "Osare pensare la città femmina" e nel corso di un decennio (I990-2000) ha operato con studentesse e ricercatrici in molte tesi di laurea dentro l'Università e fuori, nelle amministrazioni comunali, con le politiche temporali. Nella storia dell'architettura, insegnata esclusivamente come storia dei grandi maestri, sono comparse le madri dell'architettura anglosassone di fine Ottocento, le "architettrici" del periodo fascista, le arredatrici e le futuriste degli anni trenta, e le figure delle grandi professioniste come Margarete Shutte Lihotsky o Charlotte Perriand. Si è ricostruita la storia dell'abitare femminile e sono stati affrontati temi di studio importanti: la cura e i tempi della città. Questi ultimi, dopo avere prodotto i nuovi P.R.O. per migliorare gli orari pubblici dei negozi, dei tram, delle scuole, hanno avuto una ricaduta spaziale in un sistema di piccoli accorgimenti architettonici chiamati microarchitetture del quotidiano. ; The text presents the work of Vanda, a group based in the Milan Polytechnic where it was founded by three professors and a researcher of the Faculty of Architecture. Vanda has been researching about "theories and women's work in architecture". The group started its activities with a seminar entitled "Dare to think the city female." During a decade (I990-2000) the team developed many research directions involving students and researchers, working also with local municipalities in time oriented policies.The history of architecture has long been taught only as great masters history. Only recently the historians highlighted the late nineteenth century work of the so-called Anglo-Saxon Mothers work of architecture. In this way new figures emerged like the "architettrici" of the fascist period, the decorators and the futurist in the thirties, up to the figures of the great professionals like Margarete Shutte Lihotsky or Charlotte Perriand.Vanda reconstructed the history of living according women point of view, and addressed important study topics as the care and time in the city. The latter, after producing the new Regulatory Plan of hours to improve public times of shops, tram, schools, relapsed space in a system of small architectural devices called the everyday micro-architecture.

Social impact finance has emerged in recent years in response to the crisis of traditional welfare systems and the gradual decrease in public funding to the Third Sector, by offering new financial instruments to convey private capital to social entrepreneurship in order to create positive social impact combined with economic returns (Agrawal and Hockerts, 2019; Daggers and Nicholls, 2016; Hochstadter and Scheck, 2015). The debate on the effective application of these instruments has so far focused on social impact as a measurement for return on invested capital, neglecting the role of motivations driving involved agents (investors and social entrepreneurs). In this work, we investigate the impact of different financial instruments on governance structures and on the motivations of social enterprise stakeholders, both from a theoretical point of view and through pilot experiments that mimic the main features of social impact finance. Our experimental design aims to recreate in the laboratory the relationship between social enterprise, beneficiaries and financiers, including the following characteristics: extremely diversified/personalized goods/services (complexity); quality of the good/service; risk (linked to the effectiveness of the intervention provided) and components related to: information asymmetries, evaluation (impact), parameters of the financial instrument. Starting from this setting, we intend to evaluate the effect on motivations of alternative evaluation methods (input, output, outcome) linked to the financial instrument.

The main aim of this paper is to examine the presence of the strict liability category in the legal system of the Latin Catholic Church. According to the correct understanding of the objective responsibility in the legislation of modern states, the Author, after having considered profound analysis concerning the offices' duties of the hierarchical Superior, studied the specific content of the can. 128 CIC/1983 and indicated it as the benchmark in order to establish possible, not only theoretical, answer of the problem. The research has found that, it is highly probable to assign some negative consequences (a real responsibility) to ecclesial Superiors even without their fault. ; Il presente studio s'interrgoa sull'effettiva presenza dell'istituzione della responsabilità oggettiva all'interno dell'ordinamento canonico vigente. This article contains a review of the literature dealing with the attitudes ofemployers that need to hire an employee with disabilities within their organizations.The articles were selected using some databases (such as ERIC and Psych-Lit) through the introduction of several keywords: "attitudes of employers","employees with disabilities" combined with the terms "recruitmentprocess", "reasonable accommodation" and "supported employment". Wesubsequently restricted the period of the researches between 2000 and2014. The main results were synthesized around some broad categories:personal characteristics of employers (perceptions about the legislation,emotional reactions, obstacles and concerns), characteristics of the organization(type of the activity and methods of recruitment) and characteristicsof the worker (physical, intellectual or acquired disabilities). ; L'articolo racchiude la revisione della letteratura che tratta degli atteggiamentidei datori di lavoro che devono assumere un dipendente con disabilitàall'interno delle loro organizzazioni.Gli articoli sono stati selezionati all'interno di alcuni database (come ERIC ePsychLit) attraverso l'introduzione di diverse parole chiave: "atteggiamentidei datori di lavoro", "dipendenti con disabilità" combinate con i termini"processo d'assunzione", "accomodamento ragionevole" e "supported employment".Successivamente è stato ristretto l'arco temporale al periodo ditempo compreso tra l'anno 2000 e il 2014. Il presente contributo esamina il consiglio d'amministrazione delle società aventi azioni quotate in Borsa Italiana, e le retribuzioni destinate ai suoi membri, alla luce delle numerose innovazioni dell'ordinamento giuridico italiano e seguendo quella linea di analisi recentemente proposta dalla letteratura avente alla propria base l'idea che gli amministratori possono influenzare a proprio vantaggio i termini del pay-package loro corrisposto. A tal fine l'elaborato presenta una struttura articolata in due parti, nella prima delle quali viene fornita una visione organica dell'assetto istituzionale in cui l'analisi empirica, prodotta nella seconda, trova il proprio presupposto. Più specificatamente, la prima parte della tesi fornisce un'analisi giuridico-finanziaria della figura dell'amministratore (Capitolo 1) e del consiglio d'amministrazione (Capitolo 2), che risulta, oltre che assente in letteratura, quantomai attuale alla luce delle numerose e recenti riforme normative introdotte in materia. La normativa primaria, costituita dagli articoli del codice civile riguardanti gli amministratori ed i sistemi d'amministrazione e controllo (libro V, sezione VI bis, del Codice Civile) e dalle disposizioni contenute nel T.U.F., va oggi infatti completata con le nuove disposizioni contabili derivanti dall'applicazione degli IAS, ed in particolare dell'IFRS2, con le novità introdotte dalla cosiddetta Nuova Legge sul Risparmio (D. L. n. 262/2006), con le linee di comportamento descritte nella terza versione del Codice di Autodisciplina (Best Practice Code, 2006), con le prescrizioni di tipo previdenziale e fiscale contenute nelle Leggi "Finanziaria" del 2006 e del 2007, nonché con le novità in materia di governance bancaria volute da Mario Draghi (emanate a Marzo di quest'anno ma da recepire entro il 30 Giugno 2009). La seconda parte dell'elaborato, prendendo spunto dai diversi approcci utilizzati in letteratura (Capitolo 3), e con riferimento al contesto italiano, fornisce invece un'analisi empirica del sistema di compenso applicato agli amministratori. Dapprima è tracciata, relativamente al periodo indagato (1999-2006), la dinamica temporale della ricchezza distribuita ai propri amministratori dalle società italiane. Successivamente viene fornita una stima dell'intensità degli incentivi impliciti nei directors' pay-packages (i.e. pay-performance sensitivity), unitamente ad una analisi delle determinanti che ne sono alla base. L'ipotesi che guida tale parte del lavoro è che in un contesto caratterizzato da proprietà concentrata, a causa della capacità dell'azionista di maggioranza di estrarre risorse dalla società, è ragionevole presumere che gli amministratori risultino destinatari di una remunerazione meno sensibile alle performances dell'impresa e tendenzialmente più elevata. Più semplicemente la questione che viene posta è se gli amministratori scontano la possibilità d'espropriazione, componendo convenientemente il proprio pacchetto di compenso. I risultati ottenuti confermano la validità dell'impianto d'ipotesi proposto ed evidenziano che la qualità della corporate governance è la variabile chiave. Le imprese dotate di un efficace ed efficiente governo societario riescono a controllare il processo di formazione delle remuneration policies impedendone manipolazioni opportunistiche. Le imprese caratterizzate da weak corporate governance risultano invece non solo incapaci di attuare politiche retributive volte alla massimizzazione del valore d'impresa, ma anche esposte all'estrazione di risorse da parte dei propri amministratori. ; What the largest corporation pay their top managers is one of the most analyzed topics in corporate finance since Jensen and Murphy, 1990. As they noted (Jensen and Murphy 2004), a well-designed remuneration package for executives attracts the right executives at the lowest cost; retains them at the lowest cost (i.e. encourage the right executives to leave the firm at the appropriate time); and motivates executives to take actions that create long-run shareholder value and avoid actions that destroy value. However, several recent studies have shown that the characteristics of real world compensation contracts rarely meet their counterparts in compensation contracting theory because of the executives' capability to influence the terms of their compensation package to their personal advantage. For example, Yermack (1997) provides evidence that executives influence timing of their stock option awards, receiving at-the money options just prior to releasing news that increases company stock prices. Bebchuk, Fried, and Walker (2002) and Bebchuk and Fried (2003, 2004) argue that the practice of granting options at-the-money (rather than out-of-the-money or with exercise prices indexed to market movements) reflects the influence of rent-seeking managers trying to maximize their compensation in ways that are largely camouflaged to investors and the public. Going ahead, others empirical research give proofs that the executives' power to influence their pay package is stronger when shareholders are diffuse and more passive (Bertrand and Mullainathan, 2001), and when the corporate governance is weaker (Garvey and Milbourn, 2006; Harford and Li, 2007). At the same time, the expropriation literature shown that dominant shareholders, especially in firms with poor corporate governance (Klapper and Love, 2004; Durnev and Kim, 2005; Dahya, Dimitrov and McConnell, 2008) and in countries with weak legal protection (La Porta, Lopez-de-Silanes, Shleifer and Vishny, 2002; Claessens, Djankov, Fan and Lang, 2002; Durnev and Kim, 2005), are able to divert resources from others shareholders to himself for personal consumption. Since expropriation implies fewer resources assignable to marginal shareholder, the firms which are ex ante more likely to be expropriated, trade at discounted valuations. Despite the considerable empirical evidence on the costs bore both by the dominant shareholder and by the minorities in case of expropriation, the literature doesn't provide evidence of the cost supported by directors. Expropriation, in fact, represents, ex ante, a cost also for directors. First, it's a direct cost which negatively affects the expected overall compensation rewarded, when directors have part of their remuneration which is tied to company's performances. Since expropriation is a net loss for the company, which leads to a correspondent fall in the company market valuation, the closer is the alignment of directors' interests with those of shareholders, the bigger is this cost. Second, since directors have to perceive the maximization of shareholders' wealth (i.e. avoid loss of it), expropriation should affect negatively the director's reputation capital. This work examines the director's compensation in firms which are more likely to be expropriated by their dominant shareholders. In essence, the question I address is whether directors discount the expropriation's possibility, setting up conveniently their compensation's contract. I explore this issue using a sample of directors' compensation data of Italian Listed firms made up over the period 1999-2006. The case of Italian Listed companies is of particular interest for several concomitant reasons. First, Italian firms have been historically more prone to choosing a closely-held ownership structure characterized by a wide separation between ownership and control (Johnson, La Porta, Lopez de Silanes and Shleifer, 2000; Faccio and Lang, 2002; Volpin, 2002; and Barontini and Caprio, 2006; Mengoli, Pazzaglia, and Sapienza, 2006). Second, Italy is a country where the low protection of minority shareholders allows controlling shareholder to extract a considerable amount of private benefits (Bigelli and Mengoli, 2004; McCahery and Vermeulen, 2004; and Bigelli, Merhotra and Rau, 2006). Finally, Italy is a country where the high dominant shareholder's capability to replace directors and where the low efficiency of the job-market of directors, provide narrowed incentives to directors in order to effective monitoring dominant shareholder's actions (Barontini and Caprio, 2002; Volpin, 2002). Overall, results confirm the testable hypotheses, and provide evidence of the key-role exerted by corporate governance. Firms with strong corporate governance are able to monitor the compensation policies creation process avoiding opportunistic manipulation. On the opposite, firms with weak system of corporate governance seem unable to implement compensation policies directed at the firm value maximization, and, going ahead, seem to be expropriated also by theirs directors.
This paper defends the functional theory of citizenship on the grounds of the conceptual map of contemporary models of citizenship that I have developed elsewhere. I address three different types of criticisms. First, the focus is on the arguments of those who believe the legal model of citizenship needs to be abandoned or rejected all together. Several reasons against this suggestion are highlighted. Second, a short discussion follows of some points made by those contributors to this volume who instead think that the legal model should be not be rejected, but that it still needs to be amended or requires development to fit contemporary migration patterns. Finally, I address the criticisms of those who believe the whole enterprise of developing a general theory of citizenship is flawed since there would be no concept of citizenship independently of political contingencies.
If culture is growing and transforming creation, productive action directed, vía paideia, the social being, the work of Bolívar Echeverría on the role of the symbolic or immaterial constitutes a fundamental contribution to a critical theory of ideology in the era of hypermediacy. From the Marxism to Baroque, politics and the political, the interconnections of thoughts projected break points and vital breakup for the social change that is just considered in current studies of spin-colonial Latin America. This article analyzes the contribution of Bolívar Echeverría works from analysis of ideology considering the semiotic work from the whole cultural dimension or symbolic production in relation to social practices and processes of reproduction of capitalism. Accepting that our time is the Neo-Baroque era, the era of the image, the cornucopia of language and culture of gamification, the article explores the highlights interpretive elements in the thesis of the baroque ethos of the author to analyze the dominant forms of symbolic power in the struggle for their own code called Cognitive Capitalism.
The article aims to investigate the contribution that research in business administration is able to offer in forensic field concerning the accounting fraud. On this contribution exists a debate, due to the numerous modification of the regulatory framework that have taken place in recent years, as well as to jurisprudential interpretations often oriented in a diametrically opposite way. Through the comparison between epistemology and accounting theory, the Author presents an interpretation of the objective assumption of the crime, suggesting a solution that takes into account the problematic link between truth and accounting. However, this is a purely theoretical solution, at least until the Regulator decides to adapt the discipline concerning financial accounting to the most recent results of the debate on accounting theory. ; Il lavoro si pone l'obiettivo di indagare sul contributo che l'aziendalista è in grado di offrire nelle cognizioni giurisdizionali aventi a oggetto il reato di false comunicazioni sociali. Tale contributo è oggetto di dibattito in dottrina, anche a cagione delle numerose revisioni dell'impianto normativo susseguitesi negli ultimi anni, oltre che di interpretazioni giurisprudenziali spesso orientate in modo diametralmente opposto. Attraverso il confronto tra epistemologia e teoria del bilancio, l'Autore presenta una ricostruzione interpretativa del presupposto oggettivo del reato, suggerendo all'aziendalista una soluzione che tenga conto del nesso problematico tra verità e accounting. Si tratta, tuttavia, di una soluzione che rischia di rivelarsi meramente teorica, almeno finché il legislatore non decida di adeguare la disciplina avente a oggetto l'informativa esterna d'impresa ai più recenti risultati del dibattito scientifico in tema di teoria del bilancio.
La recente Direttiva 31/2010 dell'Unione Europea impone agli stati membri di riorganizzare il quadro legislativo nazionale in materia di prestazione energetica degli edifici, affinchè tutte le nuove costruzioni presentino dal 1° gennaio 2021 un bilancio energetico tendente allo zero; termine peraltro anticipato al 1° gennaio 2019 per gli edifici pubblici. La concezione di edifici a energia "quasi" zero (nZEB) parte dal presupposto di un involucro energeticamente di standard passivo per arrivare a compensare, attraverso la produzione preferibilmente in sito di energia da fonti rinnovabili, gli esigui consumi richiesti su base annuale. In quest'ottica la riconsiderazione delle potenzialità dell'architettura solare individua degli strumenti concreti e delle valide metodologie per supportare la progettazione di involucri sempre più performanti che sfruttino pienamente una risorsa inesauribile, diffusa e alla portata di tutti come quella solare. Tutto ciò in considerazione anche della non più procrastinabile necessità di ridurre il carico energetico imputabile agli edifici, responsabili come noto di oltre il 40% dei consumi mondiali e del 24% delle emissioni di gas climalteranti. Secondo queste premesse la ricerca pone come centrale il tema dell'integrazione dei sistemi di guadagno termico, cosiddetti passivi, e di produzione energetica, cosiddetti attivi, da fonte solare nell'involucro architettonico. Il percorso sia analitico che operativo effettuato si è posto la finalità di fornire degli strumenti metodologici e pratici al progetto dell'architettura, bisognoso di un nuovo approccio integrato mirato al raggiungimento degli obiettivi di risparmio energetico. Attraverso una ricognizione generale del concetto di architettura solare e dei presupposti teorici e terminologici che stanno alla base della stessa, la ricerca ha prefigurato tre tipologie di esito finale: una codificazione delle morfologie ricorrenti nelle realizzazioni solari, un'analisi comparata del rendimento solare nelle principali aggregazioni tipologiche edilizie e una parte importante di verifica progettuale dove sono stati applicati gli assunti delle categorie precedenti ; The recent Directive 31/2010 of the European Union requires that the member states reorganize their national legislative framework in the field of energy performance of buildings. so that from 1 January 2021 the energy balance of all new buildings will tend to zero (1 January 2019 for public buildings). The concept of nearly Zero Energy Buildings (nZEB) is based on the assumption that the envelope follows the standard of the passive houses and the small energy consumption required on annual basis is compensated by the production of renewable energy, preferably on-site. In this context, the rethinking of the potential of solar architecture allows to identify concrete tools and valid methodologies to support the design of increasingly efficient envelopes that take full advantage of an inexhaustible, common and affordable energy source, such as the solar energy. This should be achieved considering the necessity of no longer delaying the reduction of the energy load due to buildings, known as responsible for over 40% of world consumption and 24% of greenhouse gas emissions. According to these premises, the central theme of the research is the integration of the heat gain systems, so-called passive, and the solar energy production, so-called active, in the envelope. The carried out analytical and operational path has set the objective of providing practical and methodological tools for the design of the architecture, in need of a new integrated approach to achieve the goals of energy savings. Through a general survey of the concept of solar architecture and its theoretical assumptions and terminology, the research has envisioned three types of outcome: a codification of the recurring morphologies in solar constructions, a comparative analysis of the solar performance in the principal types of building aggregations and a significant design verification, where the assumptions of the previous categories have been applied
