Un'immagine dell'abuso del diritto è quella del fuoco sotto la cenere perché esprime il pericolo al quale espone legalità e colpevolezza. Sebbene l'ermeneutica penalistica sia vincolata, la materia tributaria rappresenta l'ultimo caso in cui forza normativa dei principi ed interpretazione teleologica hanno consentito incriminazioni in malam partem. Nemmeno la rilevanza costituzionale del bene consente di incriminare l'elusione oltre la riserva di legge: al giudice è vietato "creare un regime legale penale, in luogo di quello realizzato dalla legge". Il tema delle infrazioni di origine giurisprudenziale introduce una seconda accezione di legalità come concepita dall'art. 7 CEDU: la norma incriminatrice è valida allorquando - prescindendo dalla fonte - sia accessibile e prevedibile. Di fronte alla sentenza "Dolce e Gabbana" può affermarsi che incriminare l'elusione non è conforme alla legalità costituzionale, perché la commistione tra evasione ed elusione fiscale modifica il tipo in via interpretativa, né convenzionale perché le conseguenze non erano prevedibili quando furono realizzate le operazioni elusive. L'antagonismo delle concezioni di legalità trova soluzione avuto riguardo ai fini di garanzia. Se è contrario alla Costituzione accogliere un'idea di legalità-prevedibilità che prescinda dalla riserva di legge, la finalità di maggior garanzia possibile, esplicitata all'art. 53 della CEDU, non consente alternative alla sinergia: la legalità convenzionale sarà più garantista se integra quella costituzionale. La trasposizione sul piano interno della prevedibilità rileva sul distinto piano della colpevolezza, trova aggancio all'art. 5 c.p. e sposta la questione sulla conoscibilità dell'illecito. Alla rilevanza penale dell'abuso del diritto in materia tributaria ostava anche il principio di colpevolezza non potendosi muovere un rimprovero a fronte di un'ignoranza scusabile. L'affermata irrilevanza penale avrebbe dovuto spegnere definitivamente il fuoco dell'abuso del diritto, se non che alcune posizioni favorevoli al recupero in chiave di artificio espongono ancora il principio di legalità al pericolo di un fuoco sotto la cenere. ; Metaphorically speaking, the relationship between criminal liability and abuse of law may be described as a flame beneath ashes. In summary, a punishment based on the abuse of law is not consistent with the principle of legality recognized by the Italian Constitution: according to the Article 25, paragraph 2, in fact, no one may be punished except on the basis of a law enacted by the Parliament. Nevertheless, an infringement of the constitutional principle of legality occurred in the Dolce & Gabbana case where a criminal conviction for tax avoidance was pronounced by the Criminal Courts. In the lack of an express provision punishing tax avoidance, only tax evasion may be punished under Italian criminal law. Moreover, the punishment for tax avoidance was not foreseeable according to the principle of legality enshrined in Article 7 of the ECHR due to the fact that prior to the "Dolce & Gabbana" case tax avoidance was not qualified as an offence in the Italian case-law.
Dottorato di ricerca in Diritto dei mercati europei e globali. Crisi, diritti, regolazione ; Il presente lavoro affronta il tema delle trasformazioni del diritto penale economico indotte dalla recente crisi economico-finanziaria, con l'intento di evidenziare come e in quale misura il contesto di crisi abbia influito sulle decisioni (legislative e giudiziarie, politiche e tecniche) di gestione, tramite pena, dei conflitti sociali. Passando per lo studio dei rapporti che storicamente intercorrono tra crisi e diritto, l'analisi si è sviluppata attraverso una sistematizzazione per tipologia dei fenomeni criminali associati alla crisi economico-finanziaria. Lo studio della risposta punitiva ai vari comportamenti criminali legati alla crisi, ossia i comportamenti crisis-related (le frodi finanziarie che s'inseriscono nella spiegazione multifattoriale della crisi), i comportamenti compulsati dalla crisi (in particolare, i reati d'obbligo in materia fiscale) e, infine, quelli incentivati (criminalità organizzata e criminalità del profitto in senso ampio) dalla crisi stessa, ha fatto emergere una caratterizzazione altamente congiunturale dell'intervento penalistico, segnato da un generale riorientamento dal fatto al fenomeno. Il lavoro ha altresì preso in esame, per operare un confronto e saggiarli nel contesto d'interesse, alcuni paradigmi penalistici di "crisi" già reperibili in dottrina (segnatamente, il diritto penale di transizione, d'eccezione e di lotta), anch'essi caratterizzati da congiunturalità e orientamento al fenomeno, finendo tuttavia col constatarne l'incapacità di spiegare compiutamente le torsioni subite dal diritto penale economico in relazione al fenomeno della crisi attuale. ; The aim of the present work is to analyse the impact of the latest global financial crisis of 2007-09 on the economic criminal law. In particular, I investigate whether and how the context of crisis has affected the various (legislative and judicial, political and technical) justifications behind the use of penalty as a tool to manage social conflicts. To this end, the analysis suggests a classification of the unlawful phenomena associated with the economic-financial crisis by making use of a criminological systematization. The use of penalty is thus observed as responding to criminal behaviours which are either crisis-related (financial frauds included in the multifactorial explanation of the crisis), crisis-compelled (in particular tax crimes) or, finally, crisis-incentivized (organized crime and "profit" crime in the broad sense). From this standpoint, criminal intervention shows a highly conjunctural characterization and appears to be much more phenomenon-oriented than fact-oriented. In the final part of the thesis, some classical criminal law paradigms of crisis were tested within the framework of the economic crisis (namely, the "transitional justice", the "criminal law of exception" and the "criminal law of fight" paradigms), also characterized by conjuncturality and orientation to the phenomenon. However, none of them seems able to fully explain the torsions undergone by economic criminal law in relation to the experience of the crisis.
Oggetto della ricerca è la rilevanza nell'ambito del diritto penale del principio di precauzione. Quest'ultimo deve la sua diffusione e popolarità al fatto di presentarsi come criterio guida al problema del rischio e dell'incertezza. L'esigenza di adottare scelte normative in condizioni di incertezza scientifica è infatti oggi ineludibile. Si cercherà in primo luogo di circoscrivere l'oggetto dell'indagine analizzando il rilievo che il principio di precauzione ha a livello legislativo e giurisprudenziale. Quindi si analizzeranno le problematiche che il ricorso allo stesso suscita con riferimento alla struttura classica del reato e legate al contesto di incertezza nel quale viene invocato. Tali problematiche si riferiscono alla possibilità o meno di dare rilevanza al modello del reato di pericolo, alla ricostruzione del nesso causale e all'influenza che il principio di precauzione può determinare nell'accertamento dell'elemento soggettivo delle colpa. Si concluderà l'analisi analizzando le diverse posizioni assunte dalla dottrina italiana circa l'opportunità o meno dell'intervento penale in contesti di incertezza scientifica, individuando, in caso di risposta affermativa, le modalità di intervento. ; The precautionary principle states that if an action or policy has a suspected risk of causing harm to the public or to the environment, in the absence of scientific consensus that the action or policy is harmful, the burden of proof that it is not harmful falls on those taking the action. This principle allows policy makers to make discretionary decisions in situations where there is the possibility of harm from taking a particular course or making a certain decision when extensive scientific knowledge on the matter is lacking. The principle implies that there is a social responsibility to protect the public from exposure to harm, when scientific investigation has found a plausible risk. In some legal systems, as in the law of the European Union, the application of the precautionary principle has been made a statutory requirement. Transposed in a criminal law context precautionary principle meets him with the characteristics of this branch of law. Criminal law is in fact a retrospective law and the classic type of crime (behaviour and event) clashes with a criminal policy time to avoid harmful events. The first stage of the research will be the analysis of actual characteristics of criminal law with particular regards to the meaning of that principle, according to the law and to the case law. The second proposal of the present project is to investigate whether the criminal intervention is feasible in case of scientific uncertainty, according to the different points of view of the Italian doctrine and I will try to identify a method of intervention, if it is possible.
Il presente lavoro trae origine dal dirompente ingresso della figura dell'abuso del diritto tributario sul palcoscenico penale, divenuto protagonista di una tra le più discusse rappresentazioni di cd. 'diritto penale giurisprudenziale' e portato per la prima volta in scena dal celebre filone interpretativo Dolce&Gabbana. Così, una volta introdotto il concetto generale di abuso del diritto, lo si distinguerà dalle nozioni di evasione fiscale e di risparmio (lecito) d'imposta; tre concetti fondamentali i cui rispettivi limiti e interazioni costituiranno uno dei fil rouge dell'analisi. Si darà conto, poi, dell'operato del 'diritto vivente' in materia: una stagione giurisprudenziale caratterizzata, come si vedrà, più da ombre che da luci, intrisa di frequenti contrasti applicativi (sia diacronici che sincronici) e portatrice – in conseguenza – di una forte imprevedibilità del giudizio penale per le condotte classificate come abusive. L'analisi della genesi e dell'ascesa della punibilità dell'abuso del diritto in materia fiscale costituirà poi un'occasione per proiettarsi in una più ampia riflessione sulla crisi di legalità che affligge ormai da decenni l'ordinamento penale, di cui il filone Dolce&Gabbana ne costituisce paradigmatico esempio. Dopo avere ricondotto il fenomeno dell'abuso del diritto nell'alveo della più ampia crisi che investe la scienza penale contemporanea, si tornerà ad apprezzare il dato legislativo, rappresentato dal nuovo art. 10-bis dello Statuto del contribuente. Infine, l'indagine toccherà l'interrogativo che permane, latente, sulla materia: esistono perduranti ipotesi penalmente rilevanti di condotte riconducibili al genus dell'abuso del diritto? Come si avrà modo di osservare, oltre a fornire una risposta diretta a tale interrogativo, la riflessione sarà un'occasione per procedere ad una ridefinizione – concettuale e terminologica – degli 'attori' che hanno da sempre recitato in questo complesso settore del diritto penale tributario. ; The PhD thesis draws its origin from the appearance of the tax abuse of right in criminal procedures and by becoming one of the main actors in one of the most controversial performances of cd. 'ciminal jurisprudential law', brought to our attention by the renowned interpretative branch of Dolce&Gabbana. Therefore, once introduced the general concept of tax abuse, it will be separated from the notions of tax evasion and tax savings (legal); these three fundamental concepts and their limits and interactions will be the leitmotiv of the analysis. Moreover, there will be a study on the action of the "living law": a jurisprudential season characterized, as it may be noticed, by light and shadow, full of application contrasts (diachronic and synchronic) and with a strong unpredictability on the criminal judgement for those behaviors assessed as violations. The analysis of the origin and the development of the punishability of the violation of the law in tax policy will allow a broader consideration on the crisis of the criminal law principles. After tracing back the phenomenon of violation in the broader trend that has struck contemporary criminal science, the study will concentrate on the law data represented by the new Article 10-bis of the l. 212/2000 The novelty represented by the legislative decree 128/2015 represents a fundamental achievement on the topic: not only it (finally) gives a fundamental definition of the concept of violation of law, but also the legislator has expressly stated expressis verbis the criminal irrelevance. However, the interpretation of the article 10-bis and of its interactions with the Criminal Tax Law has its own critical points. Therefore, this study will try to suggest a possible solution.

Una "grande dicotomia", di cui si trova traccia nei codici pre-Repubblicani, nella Costituzione, nelle leggi ordinarie e finanche nelle Convenzioni post-belliche. Nel quadro giuridico post-moderno, tuttavia, la distinzione del pubblico dal privato è divenuta vieppiù dispendiosa e gravida d'incertezze. Orfana dei capisaldi teorici ottocenteschi che la sorreggevano, sembra conservare un'efficacia puramente evocativa, apparendo ormai incapace di descrivere i confini e le ragioni della sua esistenza. Nel diritto penale, però, essa mantiene una forte centralità applicativa, operando (a tacer d'altro) da spartiacque tra il severo statuto penale della Pubblica amministrazione, e quello dedicato alle società di diritto privato. Lo studio che si propone, pertanto, ambisce a individuare le caratteristiche e la funzione che la distinzione del pubblico dal privato assolve nel diritto penale, eleggendo quale suo principale campo d'indagine i delitti a soggettività ristretta contenuti (anzitutto) nel Titolo II del codice Rocco. In buona sostanza, si cercherà di verificare a che condizioni, e secondo quali limiti, questa dicotomia possa conservare una sua validità teorica, e una qualche utilità pratica, nel sistema giuridico in cui ci si trova a operare. ; The Public-Private Law Divide represents one of the cornerstones of legal modernity. A "great dichotomy", traces of which can be found in the pre-Republican codes, in the Constitution, in the ordinary laws and even in the post-war Conventions. In the post-modern legal framework, however, the distinction of the public from the private has become increasingly expensive and fraught with uncertainty. Deprived of the nineteenth-century theoretical cornerstones that supported it, it seems to retain a purely evocative effectiveness, appearing by now incapable of describing the boundaries and the reasons for its existence. In criminal law, however, it maintains a strong applicative centrality, operating (moreover) as a watershed between the strict penal regime dedicated to the Public Administration, and the one dedicated to private companies. The proposed study, therefore, aims to identify the characteristics and the function that the distinction between public and private offenders absolves in the criminal law, electing as its main field of investigation the offenses contained (mainly) in Title II of the penal code. Basically, efforts will be made in this thesis to verify at what conditions, and according to what limits, this dichotomy can preserve its theoretical validity, and some practical use, in the juridical system in which it is most likely to operate.
The paper takes into account a feature of Hans Kelsen's juridical thinking that has been so far rather underestimated: the weight of normativism on his theory of private law. The author closely connects Kelsen's critical approach to the notion of subjective right and further relates the legal norms to the institutions of the market economy. The interepretative assumptions of Kelsen are constantly confronted with the theoretical background that propelled the development of the modern constitutional state based on the rule of law.
This article studies the crimes of child pornography and possession of child pornography in the context of the Vatican criminal law system. Starting from the connection between pedophilia and child pornography, the study focuses on the analysis of the differences between these two types of crime in order to identify the defining characteristics of each. The difference between child pornography and pornography of minors was also highlighted. A close reading of the laws comprising the Zanardelli Code discloses its limitations, an inability to prove or punish new criminal cases. Thus, the legislative body proceeded to update and adapt the criminal law with a range of measures designed to enable the Vatican system meet emerging needs in relation to new types of crime. The final section of the paper explores the evolving Vatican regulatory response to the crimes of child pornography and possession of child pornography. ; Este artículo estudia los delitos de pornografía infantil y posesión de pornografía infantil en el contexto del ordenamiento penal del Vaticano. A partir de la conexión entre pedofilia y pornografía infantil, el estudio se centra en analizar las diferencias entre estos dos tipos de delitos, para identificar las características definitorias de cada uno. También se destaca la diferencia entre pornografía infantil y pornografía de menores. Una lectura atenta de las leyes que constituyen el Código Zanardelli revela sus limitaciones, esto es, la imposibilidad de probar o sancionar nuevos casos penales. Así, el Legislador procedió a actualizar y adaptar el derecho penal con una serie de medidas, diseñadas para permitir que el ordenamiento del Vaticano satisfaga las necesidades emergentes en relación con nuevos tipos de delitos. La sección final del documento explora la evolución de la respuesta regulatoria del Vaticano a los delitos de pornografía infantil y posesión de pornografía infantil.
Il saggio concerne il ruolo che la responsabilità da prodotto difettoso è suscettibile di svolgere nel governo dei nuovi rischi insiti nello sviluppo delle tecnologie digitali, tenuto conto di alcuni profili problematici, tra cui il concetto di prodotto (e di produttore), nonché quello di difetto (con le connesse questioni relative all'accertamento dello stesso). L'analisi dei suddetti profili viene svolta, oltre che sulla base della interpretazione della pertinente disciplina, anche alla luce di alcuni recenti esperimenti di soft law. The essay deals with the role that liability for defective product is likely to play in the governance of new risks inherent in the development of digital technologies, taking into account some debated aspects, including the concept of product (and producer), as well as the concept of defect (and its assessment). The analysis of these issues is carried out not only on the basis of the interpretation of the relevant legislation, but also in the light of recent forms of soft law regulations.
Soft law, as law not legally binding in the traditional sense, can be approached in a systematic perspective. Particularly, soft law raises two central issues: the mechanisms of compliance to soft law and its relationship with the law, or, better, with hard law, that is law legally binding. In European Union order the systematic perspective emerges with greater clarity: European soft law regulates relations between the European institutions; it is halfway between the sources of law and institutional gover nance. In the European dimension, soft law is a particular tool that removes an original "vice of competence" of the Union. In this way soft law recalls the implied powers of the European institutions, as it erodes in the same way the spheres of competence of the Member States. But even at national level, the lack of binding force in the traditional sense hides the political force of soft law: soft law represents a typical source for legal order which asks for instruments other than the formal procedures of constitutional institutions.
This volume investigates interdisciplinary intersections between law and the humanities from the Renaissance to the present day. It allows for fruitful encounters between different disciplines: from literature to science, from the visual arts to the post-human, from the postmodern novel's experimentation to most recent approaches towards the legal interpretation of literary texts. This productive dialogue fosters original perspectives in the interpretation of and reflection upon identity, justice, power and human rights and values, thus underlining the role of literature in the articulation of relevant cultural issues pertaining to specific periods.

From Kant's cosmopolitan proposal, over and above its placing w it h in t he more specif ic space of doctrine of right, important elements emerge in connection with the project of a "critiue of reason", considered in all its architectural extension, and therefore, ultimately, in relation to what Kant really means by "human reason". And indeed - this is the hypothesis that guides the present work - precisely starting from what the treatment of cosmopolitan law reveals about the complexity of the concept of reason it becomes possible to understand in a theoretically informed way the meaning of the political-legal proposal that pervades Kant's late maturity. In order to verify this hypothesis, the present paper aims, first of all, to highlight the elements of tension in Kant's text which, if they do not always justify, certainly encourage the proliferation of various, of ten no t reconcilable readings of cosmopolitan law and the theme of hospitality; secondly, it aims to reconsider cosmopolitan law in a broader perspective, linked to the way in which Kant conceives the relationship between humanity and rationality; and finally, in the light of this perspective, to re-examine the antagonistic tension that, within the Kantian concept of hospitality, runs through the relations between visitor and visited, host and guest.
L'indagine è dedicata all'esame della disciplina delle società a partecipazione pubblica ed, in particolare, delle società c.d. "legali", muovendo in prima battuta dall'interrogativo relativo alla rilevanza, a fini "qualificatori", dell'interesse pubblico quale profilo ordinante dell'azionariato pubblico da un punto di vista "politico-economico" – e dunque quale dato di rilevanza meta-postiva – ovvero quale elemento di qualificazione della fattispecie, in senso proprio, delle società medesime. Le riflessioni che ne seguono si sviluppano, in primo luogo, tenendo conto del progressivo affievolimento, nel nostro ordinamento, della distinzione tra "pubblico" e "privato" quali "insiemi regole" il cui presupposto di applicazione è da ravvisare nella "qualità" e nella natura del soggetto agente nei rapporti di diritto privato. Previa analisi diacronica della traiettoria seguita dal legislatore in materia di società pubbliche e previa illustrazione del panorama normativo odierno delle società a statuto singolare, l'indagine si sofferma (i) dapprima, sulla esposizione, in chiave critica, dell'orientamento caratteristico della giurisprudenza e della dottrina amministrativa, nelle quali è invalsa – ai fini dell'individuazione della disciplina applicabile – la tendenza a riqualificare le società di che trattasi, con assimilazione di esse agli enti pubblici; e (ii) in un secondo momento, ferma la ritenuta non omologabilità delle richiamate tesi "riqualificatorie", si è ritenuto di poter individuare il proprium delle c.d. società legali, a fattispecie esclusiva, negli effetti determinati dalla costituzione legale, da intendere quale sottrazione alla disponibilità delle parti della libera attuazione del programma associativo, nella quale sottrazione è dato ravvisare - anche per effetto dell'interpretazione analogica dell'art. 2451 cod. civ. - l'interesse pubblico sotteso alla costituzione della società medesima. Interesse, questo, al quale deve conformarsi, in termini di coerenza e congruità, in concreto, l'attività sociale e, dunque, l'interpretazione della disciplina di diritto comune societario. ; This PhD thesis deals with the examination of rules regarding State-owned companies, especially the so-called "società legali", i.e. companies which specific statute is entirely (or in part) codified and regulated (for that company) by the Legislator or the Government. The starting point of the enquire is the question about the legal nature of these companies, since their qualification from a politic and economic point of view is important to understand if they have to follow or not special laws. In this framework, the identification of public interest for public shareholders is a decisive element. Reflections follow on the gradual fading of the distinction between "public law" and "private law" as rules whose application does depends on the "quality" and legal nature of the agent. After a diachronic analysis both of the historical evolution of State-owned companies which statute has been regulated by laws, and of legislative and regulatory framework of nowadays State-owned companies, the enquire focuses on jurisprudence and doctrine, underlining the difference between the thought of public and commercial law scholars. In particular, while public law scholars developed the tendency to re-qualify companies assimilating them to public authorities/public bodies, from the private law point of view there is the awareness that this assimilation is not approvable, since the core of the problem lies in the effects produced by the legal set of norms regulating the statute of the State-owned companies, to be understood as a subtraction to shareholders (both public and private ones) of free implementation of the company "programmed activity" as the result of the predominance of public interest, with which the company has to comply. ; Dottorato di ricerca in Diritto ed economia: interessi rilevanti e tutele (XXIV ciclo)
Dottorato di ricerca in Diritto dei mercati: crisi, diritti e regolazione ; La presente ricerca ha ad oggetto la eventuale configurabilità nell'ordinamento giuridico italiano di risarcimenti con funzione anche sanzionatoria e/o deterrente nelle ipotesi in cui la tradizionale funzione compensativa della responsabilità civile rischia di non assicurare un adeguato livello di tutela effettiva alle situazioni giuridiche soggettive lese (illeciti senza danno, microviolazioni, reati bagatellari, danni non patrimoniali). Il tema in esame si inscrive nel dibattito dottrinale e giurisprudenziale concernente la natura mono o polifunzionale dell'istituto aquiliano. Per procedere allo svolgimento di necessarie riflessioni sul punto, si è preliminarmente focalizzata l'attenzione sugli ordinamenti giuridici che per primi hanno concepito rimedi ultracompensativi nell'alveo della responsabilità civile (Paesi di common law capitolo I, parte I), sull'evoluzione registratasi nel tempo con riferimento alle problematiche e agli inconvenienti che hanno occasionato. Altrettanto indispensabile si è rivelata l'indagine sugli argomenti di segno contrario alla configurabilità dei risarcimenti punitivi e/o deterrenti adottati nelle esperienze giuridiche dei principali Paesi di civil law e le aperture, più o meno significative, che si possono riscontrare in tali sistemi giuridici (capitolo I, parte II). Dato atto delle aperture in chiave punitiva del risarcimento presenti in giurisprudenza alla luce del diritto europeo al fine di garantire l'effettività della disciplina sovranazionale, degli orientamenti della Corte di Giustizia e della Corte di Strasburgo rilevanti per il tema in esame, delle problematiche poste dal diritto unionale e convenzionale, nonché dei tentativi di armonizzazione del diritto della responsabilità civile (v. capitolo II), si è ricostruita la evoluzione storica dell'istituto aquiliano – dal diritto romano ad oggi (capitolo III, parte I) – e notato che le regole della responsabilità civile sono state concepite per riparare un "danno" e quindi il deterioramento o la distruzione di un bene sia esso materiale o spirituale - a differenza di altre forme di tutela civile o pubblicistica - con la conseguenza che la introduzione di sanzioni civili punitive e/o deterrenti richiede necessariamente una espressa previsione legislativa (nazionale o europea) e l'osservanza dei principi di prevedibilità e di proporzionalità (tra risarcimento riparatorio-compensativo e risarcimento punitivo e/o deterrente e tra quest'ultimo e la condotta censurata). Di qui l'analisi delle ipotesi tipiche previste all'interno dell'ordinamento giuridico italiano che rispondono a tale finalità sanzionatoria e/o deterrente (capitolo III, parte I e II) e i relativi corollari sostanziali e processuali muovendo, alla luce della disciplina della fattispecie e della conformazione dell'effetto giuridico, dalla necessaria differenziazione tra risarcimenti con funzione anche punitiva e/o deterrente (capitolo III, parte II) e altre obbligazioni pecuniarie non risarcitorie, misure di coercizione indiretta o istituti sui generis riconducibili alla disciplina dell'arricchimento ingiustificato ovvero di altre obbligazioni indennitarie (capitolo III, parte I). Conclusa l'opera di inquadramento giuridico degli istituti implicati nell'attività di ricerca, sono state esaminate le controverse ipotesi di risarcimenti con funzione anche punitiva e/o deterrente e i profili problematici derivanti dal potenziamento della prevenzione e/o sanzione dell'illecito civile esaminando le aperture de jure condito e de jure condendo prospettabili nell'ordinamento giuridico italiano. ; This thesis is focused on punitive damages in Italian private law in the light of main Common law and Civil law perspectives. The latter object, particularly controversial, is widely discussed in doctrine and recent case law incresased interest in the subject manner. Although Italian private law knows different civil sanctions, there are no specific legislative (formal) provisions on "punitive damages". Neverthless some authors underline that traditional compensatory function of tort law (aquilian liability) could not ensure adeguate and effective protection in many problematic situations concerning infringments of rights. For example, mere compensation is not an effective method to deal with personality right infringements; undercompensation situations could take place in mass tort litigations, lucrative breach of contract or calculative torts; moreover, public enforcement does not produce satisfactory results in all situations of wrongdoing. In this sense, punitive damages could improve private enforcement of tort law, deterring and punishing wrongful conducts in society. In order to find out whether this civil remedy is avaible in Italy, it is firstly necessary to understand the meaning of punitive damages, the main characteristics and issues that it has dued in American and English common law (Cap I, par. II). Secondly it is necessary to focus on the reasons for the non-existence of punitive damages in continental Europe, the debate and possible developments in European civil law systems (Cap. I, part. II). The discussion addresses the positions of the European Court of Human Rights, the legislator of the European Union and the Court of Justice of the European Union on punitive damages, the increased attention and need for effective preventive, dissuasive and proportionate sanctions related to European law and the contribute to the enhancement and harmonization of tort law in Europe (PETL and DFCR) with particular reference to this subject matter (Cap. II). The research diffusely focuses on Italian tort law – from ancient Roman law tradiction to nowdays – and the so called multy-functionality conception that – according to some authors and case law – belongs to the system of tort liability. (Cap. III, part I and II). Under this point of view, it is noticed that in Italian tort law, punitive damages are not ontologically inconsistent with the legal system, but a series of fundamental limits have to be observed. In contrast of common law systems, Italian Courts cannot increase the amount of damages pursuing the aims of deterrence and punishment by introducing punitive damages without a typical legislative provision. It is central to ensure the predictability of decisions (cases and condictions in which such award applies and its amount) and punitive damages must comply with the principle of proportionality (among compensatory damages and non compensatory damages and among these one and the wrongful conduct sanctioned or the seriousness of tort). Consequently the research examinates Italian legislative provisions characterized by punishment and/or deterrence in private law. It is important to underline that not all these provisions concern with tort liability. Some special provisions deal with others civil remedies or others civil punitive and/or deterrent sanctions (Cap. III, part I) with relevant corollaries in order to the substantial and processual discipline. In specific cases the amount of damages (or indemnities) is determined having regard to some profiles referred to the wrongdoer (such as seriousness of the offence, the reiteration of the wrong, the enrichment of the wrongdoer, his economic wealth etc.) and, at the same time, to the victim (economic and non economic losses he/she has suffered) (Cap. III, part II). In these hypothesis tort law, specially with regard to immaterial and non economical damages, could have a deterrent and/or punitive function in addition to the traditional compensatory aim. The research, after reviewing the state of art, ends with the possible future developments.

In the context of antitrust law, this observation allows, on the one hand, to assess the impact of alternative instruments to the classic method that is usually applied in antitrust law: legislation, violation, formal warning, sanction.
