The article is about the level of adaptation Ukrainian legislation to the European Union standards in the area of environmental assessment. In the material the main European and Ukrainian documents are analysed: Directive 2011/92/EU of The European Parliament and The Council of 13 December 2011 on the assessment of the effects of the certain public and private projects on the environment, Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment and The Law of Ukraine "On the environmental assessment". Due to the above it is necessary to emphasize that, in spite of large legislation base in Ukraine in this area, the level of its adaptation to the EU standards is low.

The subject of this paper touches upon the prohibition to use force, and military force in particular, by States in self-defence. This is a classical example of an important and still very topical issue in international law practice. The right of each State to self-defence is perceived as one of the fundamental rights provided for in customary as well as positive international law. And yet, the exercise of this right has always raised many controversies and questions resulting, on the one hand, from the fact that the concept of self-defence has evolved over years, and, on the other hand, because of the recent tendencies to legalise different military actions carried out outside the framework of the United Nations Charter. These tendencies, presented in the paper in the context of military actions taken by states in situations of a potential terrorist attack, are described as either a pre-emptive, or a preventive use of military force. The author then concludes that although in the event of a pre-emptive military action taken by a State in reliance of its right to self-defence it may be justified to rely on the legal construction of self-defence, in the context of a preventive military operation, such reliance would be much more risky, if not inadmissible. A preventive use of military force fails to meet the criteria of legality of self-defence set forth in the UN Charter, as well as those resulting from international customary law.

Zostały one pogrupowane w obrębie czterech rozdziałów - O sprawiedliwości, O prawie karnym w ogólności, O prawie karnym w szczególności, O kryminologii i polityce kryminalnej - by nawiązać do najistotniejszych wątków dorobku naukowego Jubilata. Pro dignitate legis et maiestate iustitiae, żywiąc głęboki szacunek wysokie uznanie dla Profesora Witolda Kuleszy, składamy tę księgę Jubilatowi w hołdzie i darze."--
The goal of the article is to provide on the theoretical area, above all, a legal historical and a legal comparative analyzes of the criminal-law aspects of contracting marriage in an unlawful manner. As an institution, marriage invalidity functioned both in civil law and criminal law during the interwar period. The role of the criminal law of that time was to enforce the rules following from civil law, so the legislator provided for a criminal sanction against those who violated legally protected interests. Protecting the permanence of marriage was in the interest of not only the individual but also the state. At that time marriage was becoming the basis of the family, the fundamental social structure, upon which society and the state were being built. The family was in charge of public peace and morals, therefore any violation of the permanence and indissolubility of marriage union was tantamount to attacking the rules of social intercourse, which in turn led to an erosion of statehood. Given the foregoing, this article discusses the prerequisites under the marriage law for a marriage to be challengeable, as well as penal sanctions against culprits responsible for the conclusion of a statutorily invalid marriage. The choice of the topic was dictated by the fact that the literature of the subject lacks studies of this issue. Wybór tematu uzasadnia brak opracowania w literaturze przedmiotu niniejszego zagadnienia.

The article addresses the slightly anachronistic, in the author's opinion, institution of state's evidence witness, whose current legislative shape may raise objections, in particular from the point of view of the application of the principle of equality before the law. The study presents a few conclusions on the law as it should stand (de lege ferenda), which, if implemented, could be used to optimize the legal solutions provided for in the Act on State's Evidence. The article puts forward, among other things, the proposal to include the subsidiarity principle in the discussed institution, kind of like the requirement relating to operational surveillance, which is also debatable in moral and juridical terms, as it leads to restrictions, which is also not indisputable in the moral and juridical sense. The article also refers to the wording of Article 6 of the aforementioned Act, which provides for a rule that eliminates evidence from the suspect who ultimately did not acquire the status of a state's evidence witness. According to the author, the approach under this rule is too broad and imprecise, thus it requires an appropriate correction.

Nowadays, most people use the Internet and social media. However, the Internet is a space in which there are various types of violations that are difficult to counteract with the use of legal institutions and tools, which are often not compatible with the fast-developing environment. The COVID-19 pandemic, which forced people to rearrange their lives in all fields and often move a significant part of their activities to the network, intensified negative phenomena including spreading false and socially harmful information. This article is an original reflection on the effectiveness of Polish legislation against the backdrop of the current activities of European Union bodies aimed at increasing the security of Internet users on the example of counteracting the dissemination of misinformation. In the author's opinion, both national and EU authorities do not seem to be interested in searching for alternatives based on technological solutions that could foster prevention of such infringements on the Internet, but rather focus on improving conventional protection models, whose effectiveness seems to be questionable. The article aims to start an interdisciplinary debate on the possibility to reduce the number of negative phenomena in the social media environment using blockchain technology, including the discussion on the possibility of developing appropriate regulations in this regard.

The author offers his vision of the regulatory framework application problems.
The reforms carried out in 1990, which included the reactivation of local self-government, constituted one of the most important elements of the systemic transformation in our country. They were also an important element of the reform measures undertaken to implement the three main goals of the political transformation after 1989: democracy, the free market and decentralization. The postulate of restoring local self-government was included in the Solidarity programme in 1981, and it was the subject of renewed focus during the Round Table talks in 1989. Among the supporters and propagators of this idea in the anti-communist opposition were representatives of the study of administrative law, who envisioned the creation of a completely new institution that would not be indebted to the communist regime. It was therefore assumed that the old system of local authorities had been rejected. The self-government reform carried out in 1990 was at the same time a powerful shock to the study of systemic administrative law, which lost its subject of research, namely the issues of national councils, which from then on were treated only in the context of 'negative experiences'. The reactivation of the local self-government in 1990 was accompanied by discussions and disputes on the concept of its essence, basic political assumptions and detailed rules of functioning. However, the reform did not come to an end in 1990, as local government law is characterized by a significant dynamic of changes concerning specific solutions, which is reflected in numerous amendments to local government laws. Subsequent reforms were accompanied by the activities of experts in the field of administrative law. At the same time, one should note significant development in the study of administrative law with regard to the consideration of local self-government issues. ; Przeprowadzone w 1990 r. reformy obejmujące reaktywowanie samorządu terytorialnego stanowiły jeden z najważniejszych elementów przemian ustrojowych w naszym kraju i były one istotnym elementem działań reformatorskich w ramach realizacji trzech głównych celów transformacji ustrojowej po roku 1989: demokracja, wolny rynek, decentralizacja.

Climate law is a fast-developing branch of law. It is regulated in a multi-centric way, since as a global issue, it needs systemic solutions that would be broader than national ones. Climate protection can also be achieved through the implementation of human rights, including the right to court. Thus, the multi-level regulation as a lex generalis is accompanied with a lex specialis regulation governing the right to court from a collective perspective and linked strictly with climate law under Article 9 of the Aarhus Convention. The theoretical and indirect aim of the article is to emphasise the relationship of environmental law in general and climate law in particular with human rights, using the example of the right to court. The direct and practical aim is to demonstrate in a horizontal manner the role of the Convention in the case law of the Polish Supreme Administrative Court. The essence of the problem is the finding of the lack of direct effect of the Convention, which weakens this protection. The article is of a scientific and research nature and the analysis of the previous case law may have cognitive value for practice. The first part provides a theoretical and legal outline of introductory issues, showing the links between human rights and climate law and the scope of application of the Aarhus Convention. The second part, concerning research materials and methods, contains an analysis of the provisions of Article 9 of the Convention made using the logical-linguistic method and teleological interpretation. The third part shows the results of the interpretation search carried out by the Supreme Administrative Court, some of them being widely accepted and some controversial. Polish administrative courts, when deciding on environmental matters under Polish administrative law, co-apply together with Polish national law the normative acts of European law, including the Aarhus Convention. However, the wording of its provisions precludes, according to the established case law, the possibility of their direct application, thus pointing to the importance of legislative actions, and administrative courts cannot substitute the legislature in this activity. It was noted in the conclusion that the implementation of the Convention is "generally correct", which does not mean, however, that it implements the Aarhus-type principles in full and comprehensive. Do wielopoziomowej regulacji jako lex generalis dochodzi więc regulacja lex specialis, w myśl której prawo do sądu uregulowano w ujęciu kolektywnym i powiązano stricte z prawem klimatu w art. 9 Konwencji z Aarhus. Pierwsza część zawiera rys teoretycznoprawny i dotyczy zagadnień wprowadzających, ukazując połączenia praw człowieka z prawem klimatu oraz zakres obowiązywania Konwencji z Aarhus.

The inauguration of Nelson Mandela as South Africa's first democratic president on 10 May 1994 became a symbol of the end of apartheid and the beginning of a new chapter in the country's history. As South African society was deeply divided, the 1993 Interim Constitution expressed the need for reconciliation between the people of South Africa and the reconstruction of its society. The legacy of apartheid was to be addressed based on 'a need for understanding but not for vengeance, a need for reparation but not for retaliation, a need for ubuntu but not for victimization'. Due to its introduction into the Constitution, ubuntu – a philosophy of unity, cooperation, compassion and respect for human dignity, which originated in small African communities – became a source of values for the whole legal system. The goal of the text is to present the ubuntu philosophy and to describe its role in the South African transitional justice process and in selected areas of South African law (criminal law, evictions and defamation). On the whole, South Africapresents a unique case in which both the political transformation and the legal system were strongly shaped by the said philosophical and ethical concepts, which bear close resemblance to the idea of restorative justice.
