This article is generically dedicated to the legal effects of the acts practiced by young people, both minors and those of legal age, under the influence of drugs. In Part I, our attention is called to the legal-civil consequences of these acts. Thus, we shall begin with a brief preliminary note on the concept of civil law. Having noted this, we will examine the main topic to speak of the legally existing mechanisms (within the scope of civil law) to protect those people, and for this purpose, we distinguish between minors and adults (or equated to adults, which is the case of minors who are emancipated by marriage): the minor regime, in the first case, and possibly, the regime of incapacitation (an incapacity that is not generic and permanent), or even accidental incapacity (not permanent or transitory), caused by the consumption of alcohol or drugs, in the case of adulthood (or equated with adulthood). In the second part, initially, we give a general presentation of criminal law, with this part divided into two large sections: the sale and consumption of narcotics and the legal treatment given to minors. From a general standpoint, when an analysis of the agent's guilt cannot be made, the law considers him to be unimputable. From an internal standpoint, we shall analyze the most relevant legal aspects of the Decree-Law referring to traffic and to drugs. One particular aspect of this regime lies in the fact that in Macau, drug consumption is considered to be a crime (article 28), unlike in European countries, like Portugal, since 2000. We shall also take into account other legislation in Macau in which drugs play a crucial role, as is the case of the misdemeanor established in article 68 of the Highway Code, which consists, among other items, in driving under the influence of alcohol or narcotics (note that this Code was recently altered by the Highway Traffic Law, which entered into effect in October 2007). Kanunda öncelikle memur hakkında idari ön soruşturma yapılıp izin verilmesi halinde savcılar genel usule göre soruşturma açacak diğer vatandaşlarla aynı usulde mahalli idare memurları yargılanacaktır. Mahalli idare seçilmiş organları İçişleri Bakanınca geçici bir tedbir olarak görevinden uzaklaştırılabilecektir. Diğer memurlar yönünden ise atamaya yetkili amir ve müfettişlerin görevden uzaklaştırma yetkisi vardır. Görevden uzaklaştırma ve soruşturma izni konusundaki kararlara karşı yargı yolu açıktır. Este trabalho apresenta um estudo comparativo das principais características dos modelos de regulação adotados em assuntos relacionados à saúde do trabalhador no setor petroleiro no Brasil e na Noruega. As legislações de ambos os países estão inseridas na tradição da lei escrita, mas cada nação tem uma abordagem particular de sua regulação. O Brasil conta com uma típica postura regulatória, enquanto a Noruega apresenta traços do direito consuetudinário, com modelos legais baseados na presunção de que as partes envolvidas são capazes de agregar boas e seguras práticas profissionais. Percebe-se que ambas as abordagens regulatórias relacionam-se com o panorama social de cada nação. Porém, como o tempo e a cultura se modificam, os dois países talvez tenham algo a aprender um com outro. ; The purpose of this article is to compare the regulations on work related health issues in the offshore petroleum sector in Brazil and Norway. The regulation of reporting and handling of work related illness has been used as a case for the study. We aim to show that even though the legislation both in Brazil and Norway relies upon similar legislative traditions, emphasising statute law, with written norms given by national authorities, there are considerable differences in how the regulation is developed and how the this kind of norms are formulated in the two countries. The differences will be interpreted in view of the governance cultures in the petroleum sector in the two countries. What can be learnt from this comparison may be of general interest when working with development of legislation and regulations.

Bu çalışmanın temel amacını, Avrupa Birliği için bir anayasa oluşturulmasına dair atılan adımların incelenmesi oluşturmaktadır. Bu bağlamda çalışmada izlenilen yöntem; önce Nice ardından da Laeken Zirvelerinde ortaya koyulan hedefler (Avrupa Birliği içerisinde yetkilerin tanımı ve genel işleyişi, Avrupa Birliği araçlarının basitleştirilmesi, Avrupa Birliği içerisinde daha fazla demokrasi, şeffaflık ve etkililik, Avrupa Birliği Anayasası oluşturulması) çeperinde anayasalaşmaya dair iki önemli belgenin, yani Avrupa Birliği Anayasa Taslağı ve Lizbon Antlaşması'nın içeriğinin analiz edilmesidir. Bu analiz çerçevesinde Avrupa Birliği'nin anayasalaşamayan anayasallaşma çabası detaylı biçimde ortaya koyulmaya çalışılmıştır; sonuç olarak Avrupa Birliği, her ne kadar anayasa taslağı ile anayasalaşma ülküsüne yaklaşmış ise de Lizbon Antlaşması ile bu ülküsünden uzaklaşmış bulunmaktadır. Bir başka deyişle Avrupa Birliği'nin Nice ve Laeken Zirveleri temelinde başlayan anayasallaşma süreci, Lizbon Antlaşması zemininde anayasalaşamayan bir yapı arz etmektedir. ; In this paper the main aim is analyzing the steps have been taken in order to form a constitution for the European Union. Therefore, the methodology stated on the exami¬nation of the Treaty Establishing a Constitution for Europe and the Treaty of Lisbon under the scope of the Nice and Laeken Summits' conclusion goals; which are identifying authorities and general structure in European Union, reducing the structure of European Union's tools, gaining more democracy, transparency and efficiency in European Union and creating a European Constitution. Through this examination, the constitutionalisation endeavor of the European Union has been deeply implied. In conclusion, the Treaty of Lisbon was a back step comparing to Draft of Constitution. Consequently, the Treaty of Lisbon -which came into force in 1 December 2009- is not a constitution for European Union but another constitutive European Union Treaty which is the very close law document to be a constitution for European Union because it does not brings any federational features to the European Union and also reduces or removes some (as flag, anthem, European Union Foreign Minister) which have been designed in Draft of Constitution. In other words, the constitionalisation process of the European Union, which has begun under the scope of the Nice and Laeken Summits' conclusion goals, temporarily ended to a withdraw with the Treaty of Lisbon.

Genel bir tanımlama ile serbest bölgeler, ülke sınırları dahilinde olmakla beraber, dış ticaret, vergi ve gümrük mevzuatının uygulanması bakımından ülkenin gümrük hattı dışında sayılan bölgelerdir. Bu bölgelerde ilgili ülkeye ait yasal düzenlemeler uygulanmamakta, bunun yanında yapılan faaliyetler için çeşitli teşvikler sağlanmaktadır. Serbest bölgelerin kurulmasındaki amaçlar; ihracatın arttırılması, dış ticaret ve yatırımlar ile ilgili bürokrasinin azaltılması, ithalatın daha kolay ve daha az maliyetli gerçekleştirilebilmesi ve üretim ve istihdamın arttırılmasıdır. Bugün ülkemizde faaliyet gösteren serbest bölgelerin sayısı yirmi bire ulaşmıştır. 1985 yılında 3218 sayılı Kanun'la kurulmaya başlanan serbest bölgeler kuruldukları günden bu yana ekonomiye belirgin katkılar sağlamışlardır. Ağırlıklı olarak sanayi faaliyetlerinin yürütüldüğü serbest bölgelerimizdeki faaliyetlerden elde edilen her çeşit kazanç vergi dışı bırakılmaktadır. Avrupa Birliği'nde serbest bölge uygulamaları incelendiğinde ise, bölgelerde ağırlıklı olarak ticaret faaliyetlerinin yürütüldüğü, dış ticaret, gümrük ve vergi uygulamaları açısından da formalitelerin kısmen daha az olmakla birlikte, ülkemizdeki kadar muafiyet tanınmadığı görülmektedir. Türkiye'deki serbest bölgelerin AB'ye uyum sürecinde tartışma konusu olacağı ve Birlik yasal mevzuatına uyum sağlaması gerektiği açıktır. ; In general, free zones can be described as the zones which are within the borders of country, but are out of customs line of the country in terms of foreign trade, tax and administration of customs legislation. Legal regulations of the country are not carried out in these zones; however, various supports are available for the actions performed. The aims of establishing free zones are to increase export, to decrease the bureaucracy related to foreign trade and investments, to perform easier and cheaper import and to raise production and employment. Today, in our country, the number of free zones has reached twenty one. In 1985, the free zones that started to be established through Law number 3218 have had remarkable contributions to economy since then. Every sort of earning gained from our free zones, at which mostly industrial actions are carried out, is tax-exempted. When free zone administrations are examined in EU, it can be seen that in these zones usually trade actions are carried out and although the formalities are partially fewer in terms of foreign trade, customs and taxation, exemption is not as much as in our country. It is very clear that the free zones in our country will possibly be a debatable subject during EU adaptation process and will have to adapt to Union legal legislation.

ÖZETAlternatif uyuşmazlık çözümü, uyuşmazlıkları resmi yargılama ve yargıç kararı olmaksızın çözmek için kullanılan yöntemlere verilen isimdir. Bu yöntemler tarafların karşılıklı oarak üzerinde anlaştıkları çözümlere ulaşmalarına olanak tanır. Alternatif uyuşmazlık çözümü, arabuluculuk, müzakere, tahkim, ombudsman, özet jüri duruşması, mini-duruşma gibi çok çeşitli yöntemleri içerir. Bu yöntemler tarafların yüz yüze görüşmelerine ve uyuşmazlıkla ilgili meseleleri gayri resmi ve özel bir biçimde değerlendirmelerine imkan verir.Uyuşmazlık çözüm yolları genel olarak üç ana başlıkta ele alınabilir. Bunlar, yargılama, alternatif uyuşmazlık çözümü ve şiddet ya da kaçınma gibi geleneksel yöntemlerdir. Farklı uyuşmazlık tipleri farklı yöntemlerin uygulanmasını gerektirebilir. Hangisinin uygun olduğu kültürel yapı, toplumsal olgular ve kişisel özellikler tarafından belirlenir. Bu tez, uyuşmazlık işleyişinin antropolojik ve sosyolojik boyutlarına yoğunlaşmakta ve alternatif uyuşmazlık çözümünü bu açıdan değerlendirmektedir. Çalışma iki ana bölümden oluşmaktadır. İlki uyuşmazlık çözümünün antropolojik ve sosyolojik kökenleriyle ilgilidir. Kültür, çatışma, geleneksel ve modern toplumlarda uyuşmazlık çözümü ve alternatif uyuşmazlık çözümünün tarihsel öncülleriyle ilgilidir. Alternatif hareketin teorik dayanakları, ideoloji, iktidar ve uyuşmazlık süreci bağlantısı, alternatif uyuşmazlık çözümü adı altında kullanılan genel yöntemler ve Türk hukuk kültürüne yansımalarını kapsamaktadır.SUMMARYAlternative dispute resolution is the name given to the processes, which are used to resolve disputes, without formal adjudication and decision by a judge. These processes allow parties to reach mutually acceptable solutions. Alternative dispute resolution includes a variety of different processes including mediation, negotiation, arbitration, ombudsman, summary jury trial, mini-trial, etc. These methods let parties to meet face to face and consider the issues in a dispute by an informal and private way.Dispute resolution methods can be classified into three main ways. These are, adjudication, alternative dispute resolution and traditional methods as violence or avoidance. Different kinds of disputes may require different kinds of processes. Cultural structure, social facts and personal properties ascertain the appropriate one. This thesis concentrates on the anthropological and sociological aspects of dispute processing and commentate alternative dispute resolution in this perspective. This work includes two main parts. First one is about the anthropological and sociological sources of dispute resolution. It involves culture, conflict, dispute resolution in traditional and modern societies, historical antecedents of alternative dispute resolution. Second part is about alternative dispute resolution in modern societies. It includes theoretical basis of alternative movement, the relation between ideology, power and dispute process, general methods that are used under the name of alternative dispute resolution and its reflection to Turkish law culture.

Bu kavramın hukuksal bir anlamı olduğu kadar siyasî bir anlamı da mevcuttur ve bu iki anlam iç içe geçmiş durumdadır. Egemenlik devletin gücünü temsil etmektedir. Uluslar işbirliğine girdikçe egemenlik gündeme gelmektedir.Küreselleşme; ülkeler arasındaki iktisâdi, sosyal ve siyasal ilişkilerin gelişmesi, farklı toplum ve kültürlerin inanç ve beklentilerinin daha iyi tanınması, uluslar arası ilişkilerin yoğunlaşması gibi birbirleriyle bağlantılı konuları içeren bir kavramdır. Küreselleşme süreci, ulus devlet yapısı içindeki hükümetlerin gücünü ve etkinliğini azaltmakta, hükümetler; ekonomik nesnelerin, teknolojik yeniliklerin, bilgi, haber ve fikirlerin akışını kontrol etmekte güçlük çekmekte, ulus devletlerin millî ekonomik politika izleme imkânı giderek azalmakta, ekonomik sınırların aşınması millî siyasî sınırların da aşınmasına yol açmaktadır. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.

Böyle bir incelemeye geçilmeden önce hem demokrasi hem de yerel yönetimler açısından zengin tarihi tecrübesi bulunan Türkiye'nin yerel yönetim sistemi incelenmekte, sonrasında ise Türkmenistan'ın genel yönetim yapısı ve yerel yönetimleri anlatılmakta ve bu bilgiler ı?ığında Türkmenistan ile Türkiye'nin yerel yönetim sisteminin kar?ıla?tırılması yapılmaktadır. Böyle bir kar?ıla?tırma, hem genel yönetim hem de yerel yönetimler olarak her iki ülkenin farklılıklarını ve benzerliklerini ortaya koymakta, her iki ülkenin yerel yönetimler konusundaki tecrübesi aydınlatılmakta ve demokrasinin önemli kurumlarından olan yerel yönetimlerin daha da geli?tirilmesi açısından her iki ülkenin birbirlerinin tecrübelerinden faydalanabilmesinin yolu aranmaktadır. Günümüzde birçok ülkenin yönetimi, merkezden yönetim ve yerinden yönetim ilkelerine göre düzenlenmektedir. Kamu hizmetlerinin tek bir merkezden v yönetilmesine merkezden yönetim denirken yerinden yönetim ise kamu hizmetlerinin merkez hiyerar?isi dı?ındaki kamu tüzel ki?iliklerince görülmesidir. Devletler merkezden yönetimle kamu hizmetlerini görmede yeterli olamamalarından dolayı tarihsel geli?im içerisinde yerel bazdaki hizmetleri görmek ve yerel halkın mü?terek ihtiyaçlarını gidermeye yönelik, merkezi idare te?kilatından ayrı olarak ama yine de merkezi idare tarafından denetlenen kamu tüzel kurulu?ları kurma yoluna gitmi?lerdir. Dolayısıyla zaman içerisinde devletler hem merkezden yönetim te?kilatına hem de yerinden yönetim te?kilatına sahip olmu?lardır. Yani yönetim sistemleri karma yönetim sistemine dönü?mü? ve böyle bir karma yönetim sistemi de günümüzde birçok ülke tarafından benimsenmi?tir. Türkiye'nin yerel yönetim kurumlarını il özel idareleri, belediyeler ve köy yönetimleri olu?turmaktadır. Büyük yerle?im yerleri içinde özel yönetimler getirilebilmekte ve büyük?ehir belediyeleri böyle bir düzenlemenin sonucudurlar. Türkiye'de bu mahalli idare kurumlarının her biri için ayrı kanun kabul edilmi?tir ve bu kanunlarda kurulu?ları, görevleri, organları, te?kilatları ve diğer açılardan düzenlenmi?lerdir. Türkiye'deki gibi doğrudan halk tarafından seçilmemektedir. ; In this study it is aimed to analyze general administrative structure and the local governments within the general administrative structure of Turkmenistan, one of the CIS countries, which have gained independence after collapsing of USSR and which are in transition period from the remnants of socialism and totalitarianism to democracy. Before such an analysis, the local governments in Turkey which has rich historical experience of democracy and local governments are studied, and then Turkmenistan?s general administrative structure and local governments are discussed and in the light of these discussions local governments of Turkey and Turkmenistan are compared. Such a comparison gives differences and similarities of countries from the standpoint of general administration and local governments and the local government experience of both countries are enlightened and the way of benefiting from both countries? local government experience from the standpoint of improving local governments as one of the important institutions of democracy is sought. In our days many countries are governed with principles of centralization and decentralization. In centralization public services are governed from one center and in decentralization the public services are rendered by public corporations out of the viii center hierarchy. States have established public corporations separate from central government organization hierarchy, but nevertheless controlled by the central government in order to render local services and to meet local needs of local people within the historical development due to the insufficiency of the centralization for rendering public services. Therefore the states had both central and local government organizations within time. Namely, government systems have been transformed into mixed system of government and such a mixed system of government is adopted by many countries. Turkey?s local government institutions are special provincial administrations, municipalities and village administrations. Special administrations can be established for large settlement places and metropolitan municipalities are the result of such arrangements. In Turkey a separate law was passed for each of these local government forms, and their foundation, duties, organs, organizations and other issues related with them are subject to these laws. The main local government form foreseen in the Constitution of Turkmenistan is municipalities. In accordance with 16th Article of the Constitution of Turkmenistan the civilian administration divisions are consisted of provinces, cities with status of provinces, counties, cities with status of counties, cities in counties, towns and gengeshliks. Local services in the level of provinces, cities with status of counties, counties are rendered by governorships established based on the rule of delegation of authorities. Municipalities are established in the cities in counties, towns and gengeshliks. Gengeshliks are formed by the union of one or more villages. There aren?t any institutions like special provincial administrations in Turkey and which are established based on decentralization. Moreover, there is no special act passed for village administrations in Turkmenistan. Therefore, the local government system of Turkmenistan is mainly consisted of municipalities. Special government forms like metropolitan municipalities also do not exist in Turkmenistan. Instead, there exist city governorships similar to metropolitan municipalities. Cities with population more than thirty thousand people gain the county status and such cities are governed by city governorships. Municipalities in Turkmenistan are established in gengeshliks, towns with population more than two thousand people and in cities within counties and their boundaries are the boundaries of related civil administration divisions. In Turkmenistan mayors are representatives of the central government and the also the head of the municipality, the local government. Mayors are responsible to governor by their duty as representatives of central government. Mayor is elected by municipal council among the members of the municipal council. They are not elected by the people directly like in Turkey.

Yüksek Lisans Tezi ; Kuvvet kullanılmasını içeren orantılı karşı tedbirlere ülke dışında da başvurulabileceğine ilişkin iddiaları BM Antlaşması md. 51 temelinde meşrulaştırmaya çalışan iddialar, teoride olmasa bile uygulamada artan şekilde uluslararası toplum tarafından kabul görmektedir. Doktrinel bakış açısından, böyle bir yaklaşım, elbette BM Antlaşması md. 2/4 tarafından güvence altına alınan "bir devletin ülkesel bütünlük hakkı" ile diğer devletin md. 51'de korunan Meşru müdafaa hakkı arasında bir çatışmayı da beraberinde getirmektedir. BM Antlaşması md. 51'de düzenlenen meşru müdafaa hakkı, kuvvvet kullanma yasağının tek istisnası olarak, bir silahlı saldırıya karşı düzenlenmiştir. Md. 51'de meşru müdafaa hakkından doğal bir hak olarak söz edilmesi, BM Antlaşması'ndan hemen önce örf ve adet hukukundaki meşru müdafaa hakkının saklı tutulduğu anlamına gelmez. Bush Doktrini'nin önleyici meşru müdafaa hakkının hukuka uygunluğunu iddia ederken geleneksel "gereklilik"kriterini esnetmesidir. Bir başka ifade ile uluslararası hukukun öteden beri "vukuu muhakkak"bir silahlı saldırı tehdidine karşı önleyici meşru müdafaa hakkını tanıdığını iddia eden ve yapılması gerekenin "vukuu muhakkak tehdit" kavramını terör eylemlerine, kitle imha silahlarına güvenen haydut devletler ve teröristler gözönünde bulundurularak yeniden yorumlamak olduğunu belirten Bush Doktrini açısından sadece bir saldırı varsayımı, potansiyel bir tehdit, bir risk, "silahlı saldırı" teşkil etmektedir. BM Genel Kurulu'nun İsrail temsilcileri, Güvenlik Konseyi'nde, devamlı olarak ülkesinin yakın bir saldırı tehlikesine maruz kaldığını ve İsrail'in de önleyici meşru müdafaa hakkı'nı kullandığını iddia etmiştir. From the doctrinaire point of view, such an approach definitely brings about a conflict between the right of territorial unity of a nation which is secured by the article 2/4 of the United Nations Treaty and the right of self defense of another nation preserved in the article 51. The right of self defense arranged in the article of the United Nations Treaty has been arranged considering an armed attack as the only exception of prohibition of using force. The fact that the right of self defense is mentioned as a natural right in the article 51 does not mean that the right of self defense in the Common Law is preserved just before United Nations Treaty. It means that Bush Doctrine stretches traditional necessity criterion while it claims that the right of preventive self defense is lawful. In other words, just an assumption of an attack is seen as a potential threat, a risk, and an armed attack in terms of Bush Doctrine which claims that International Law has approved the preventive self defense against a certain armed attack threat for a long time, and emphasizes that the necessary thing to do is reinterpreting certain threat decision considering rogue states, and terrorists relying on Weapons of Mass Destruction. In the Security Council, Israel representatives of the United Nations General Assembly claim that their country is continuously exposed to a close attack and Israel has the right of preventive self defense. In the first part of this study; the right of self defense, prohibition of using force, definition and history of attack crime, prohibition of using force and the right of self defense in the documents of the United Nations ; In the second part of the study; findings about the origin of the disagreement between in 2006 Israel and Lebanon, definition, history, and the role of terror in the prohibition of using force and in the right of self defense, and evaluation of the disagreement between Israel and Lebanon in accordance with the right of self defense; In the third part of the study; the relations between Turkey and Israel, the relations of Turkey and Lebanon in the period of (AKP) Justice and Development Party, and also the attitude of Turkey towards the disagreement between Israel and Lebanon have been examined. Türkiye, planlı dönemle birlikte uygulamaya başladığı bölgesel gelişme ve bölgeler arasındaki dengesizlikleri giderici yöndeki politikalarını günümüzde yeniden gözden geçirme zorunluluğu ile karşı karşıyadır. Bu zorunluluğun esas nedeni Avrupa Birliği'ne katılım sürecinde bölgesel gelişme politikalarının entegre edilmiş olmasıdır. Bu nedenle Türkiye, yaklaşık 40 yıldır uygulamakta olduğu bölgesel gelişme model, politika ve araçlarını bir yana bırakarak yeniden bir yapılanma süreci içine girmiştir. Bu yeni yapılanmanın ana öğesini Bölgesel Kalkınma Ajansları (BKA) olarak adlandırılan birimler oluşturmaktadır. Kalkınma Ajansları, bir ülkenin belli bir coğrafi bölgesi içerisindeki özel ve kamusal tüm şirketler, yerel otoriteler ile sivil toplum kuruluşları arasında işbirliği sağlayarak, o bölgenin ekonomik açıdan gelişmesini hedefleyen ve yasal bir hükme dayanarak kurulan yapılar olarak tanımlanmaktadır. Küreselleşme süreci beraberinde getirdiği yapısal uyum politikaları ile birçok konuda özgün süreçler ve araçlar geliştirilmesini gerekli kılmıştır. Bu süreçte Türkiye'ye de AB tarafından bölge planlamanın yeni bir anlayışla ele alınması gerektiği ve bunun aracının da BKA'lar olduğu ifade edilmiş ve konu ilk kez AB'ye tam üyelik müzakereleri ile başlamıştır. Bu dönemin başlangıcı sayılacak süreç ise adaylığın ilk kez tescil edildiği 1999 Helsinki Zirvesi sonunda olmuştur. AB Komisyonu'nun hazırlamış olduğu Katılım Ortaklığı Belgesi'nde orta vadede yapılması gereken düzenlemeler arasında yer alan BKA'ları oluşturmak amacıyla yasal düzenlemeler süreci başlatılmıştır. Bu doğrultuda öncelikle Topluluk kurallarına uygun olarak kısa vadede istatistiksel bölge olarak bilinen AB (NUTS) sistemi 22 Eylül 2002 tarih ve 4720 sayılı Bakanlar Kurulu kararı ile kabul edilmiştir. Daha sonra da 2003 yılı Katılım Ortaklığı Belgesinde, katılım öncesi mali yardım programından yararlanabilmek için BKA'ların kurulması öngörülmüştür. Takip eden süreçte 32 esas ve 5 geçici maddeden oluşan, 5449 sayılı Kalkınma Ajanslarının Kuruluşu, Koordinasyonu ve Görevleri Hakkında Kanun, 25.01.2006 tarihinde TBMM Genel Kurulunda görüşülerek kabul edilmiş, 08.02.2006 tarihli ve 26074 sayılı Resmi Gazetede yayımlanarak yürürlüğe girmiştir. Ülkemizde, 5449 sayılı Kanunun birinci maddesinde ifade edildiği üzere; ?kamu kesimi, özel kesim ve sivil toplum kuruluşları arasındaki işbirliğini geliştirmek, kaynakların yerinde ve etkin kullanımını sağlamak ve yerel potansiyeli harekete geçirmek suretiyle, ulusal kalkınma plânı ve programlarda öngörülen ilke ve politikalarla uyumlu olarak bölgesel gelişmeyi hızlandırmak, sürdürülebilirliğini sağlamak, bölgeler arası ve bölge içi gelişmişlik farklarını azaltmak amacıyla? BKA'lar kurulmaktadır. 6 Temmuz 2006 tarih ve 26220 sayılı Resmi Gazete'de yayımlanan ?Bazı Düzey 2 Bölgelerinde Kalkınma Ajansları Kurulmasına Dair Bakanlar Kurulu Kararı? ile ilk olarak 06.01.2007 tarihinde Adana ve Mersin illerini kapsayan Çukurova Kalınma Ajansı ve 13.01.2007 tarihinde de İzmir ilini ve çevresini kapsayan İzmir Kalkınma Ajansları kurulmuştur. Kalkınma ajansları; ? Bölgesel gelişme uygulamalarımız ile bölge planlarımızın etkinliğinin ve başarısının yükseltilmesini; bölgelerin ülkemizin genel büyümesine, gelişmesine, refahına ve istikrarına katkısının artırılmasını; sosyal uyum ve adaletin güçlendirilmesini ve değişen küresel rekabet şartlarına adaptasyonunun hızlandırılmasını sağlayacak, ? The main reason of this necessity is that regional development policies weren't integrated in the process of participation of European Union. Therefore, Turkey went into a reconstruction process by abandoning the regional development model, policy and tools that it had been has been using for 40 years. The units called Regional Development Agencies (RDA) constitute the main element of this construct. Development Agencies, all private and public enterprises within a certain geographical region of a country, are defined as structures that aim the economic development of that region by providing cooperation between local authorities and civil society organizations, and that are founded on the basis of a legal provision. As is known, globalization process entails the development of authentic processes and tools in many cases regarding structural adaptation policies that it brought along. In this process, it was explained to Turkey by EU that regional planning should be approached with a new understanding and RDA?s are the means for this and this first started with the negotiations of full membership to EU. The process that can be counted as the beginning of this period is the end of Helsinki Summit of 1999 when the candidateship was first enrolled. The legal regulations process was initiated so as to constitute RDA?s that are among regulations which should be implemented in medium term in Accession Partnership that European Commission arranged. Accordingly, EU (NUTS) system that is known as short term statistical region was initially approved by Cabinet decree no 4720 in September 22 of 2002 in accordance with the rules of congregation. Later in the Accession Partnership of 2003, it was anticipated that RDA's be constituted in order to be able to utilize the pre-accession financial support programmes. In the following process, the law number 5449 regarding the Establishment, Coordination and Missions of Development Agencies that consists of 32 major and 5 temporary articles was debated and approved in General Assembly of Grand National Assembly of Turkey and went in effect after being published in Official Journal of number 26074 and date 02.08.2006. In our country, as stated in the first article of law number 5449, RDA?s are constituted ?in order to accelerate the regional development, to insure its maintainability, reduce the differences of interregional and regional development, compatible with the principles and policies anticipated in national development plans and programmes by developing the cooperation among public sector, private sector and civil society organizations, ensuring the effective usage of resources and activating the local potency?. By ?the Cabinet Decree Regarding the Establishment of Development Agencies in Certain Level 2 Regions? that was published in Official Journal number 26220 of July, 6, 2006, Development Agencies were constituted in Cukurova regions that include Adana and Mersin and Izmir regions including Izmir, and Cukurova Development Agency officially opened in 01.06.2006 and Izmir Development Agency in 01.13.2007. Development agencies; ? Will ensure the promotion of effectiveness and success of our region plans with our regional development applications; increasing of regions' contributions to the general growth, development, welfare and stability of our country; reinforcement of social adaptation and justice and, acceleration of adaptation to changing conditions of global competition, ? Will encourage the participation of all local actors in development attemps, especially administrative, financial and technical supports that it provides to corporations, establishments and persons with its highly qualified crew, flexible resource and employment structure, ? Will improve the culture and ability to produce and manage associate projects that are based on co-financing of person, corporation and establishment in project and activity supports; reinforce the sense of ownage and cooperation; active the entrepreneurship potency of the region and keep improving it, ? Will activate the local potency, dynamics, individualities by revealing the resources and possibilities, and turn into an economic, social and cultural values in international market; Consequently, will contribute to the improvement of economic and social indicators, especially employment and income in both national and regional- local level; reduction of differences of interregional and regional development and thus increasing of general prosperity of the country and solidifying of stability.

ÖZETAvrupa Topluluğu'nun sosyal yönü, Avrupa entegrasyon sürecinin başlangıcından beri vardır. Ancak, Avrupa Topluluğu'nun temel amacı, Topluluk üyeleri arasında etkin bir ortak pazar oluşturarak ekonomik bütünleşmeyi sağlamak olduğundan sosyal politikanın genel Topluluk politikaları içindeki rolü küçüktü. Üye ülkeler arasında Topluluk'un sosyal alandaki rolü konusunda hiçbir zaman bir konsensüs oluşmadı. Ancak, zaman içinde, Topluluk üyeleri ekonomik bütünleşmesinin başarısı için etkin sosyal politikaların gerekliliğini kavradılar. Dolayısıyla, Toplululuk'un sosyal yönüne dikkat çekildi ve 1980'lerin sonlarında bu yönde adımlar atılmaya başlandı. Topluluk seviyesinde etkin bir sosyal politika 1980'lerin sonunda siyasi destek kazandı ve Avrupa entegrasyon süreci boyunca, birbiri ardına gelen Antlaşma revizyonlarıyla devam etti. AB sosyal politikasının bu tarihsel gelişme sürecine paralel olarak, Tek Avrupa Senedi (TAS) ile başlayarak, sosyal politikanın yasal ve yönetişim yönlerinde bir dönüşüm gerçekleşmiştir. AB'de sosyal politika alanı hala üye devletlerin yetkisinde olmasına rağmen, özellikle 1990'lardan itibaren, AB sosyal politikasının yönetişiminde hiyerarşik yapıdan hiyerarşik olmayan yapıya doğru bir gelişim olmuştur. Bu yönetişim yaklaşımında, AB'de değişik katmanlardan çok sayıda aktör, sosyal politika yapım sürecine dahil edilmiştir. AB sosyal politikasının geçirdiği bu gelişim süreci, Avrupa sosyal ortaklarının sosyal politika yapım sürecine katılmalarıyla sosyal diyaloğun yolunu açmıştır. Bu açıdan, Avrupa sosyal diyaloğu, 1985'te o günkü Komisyon Başkanı Delors'un başlattığı 'Val Duchesse' görüşmelerinden bu yana AB'nin gündeminde yer almaktadır. Avrupa sosyal diyaloğunun Maastricht ve Amsterdam Antlaşmaları'yla kurumsallaşmasıyla sosyal diyaloğun etkisi, bağlayıcı olmayan ortak görüşlerden, Komisyon tarafından denetlenen ve Konsey kararıyla uygulanan çerçeve anlaşmalara kadar ulaştı. Avrupa sosyal diyaloğunun bu aşamalı gelişiminde, sürecin temel aktörlerinden olan sosyal ortakların rolü ön plana çıkmıştır, çünkü bunların Avrupa seviyesinde temsili, sosyal diyaloğun Avrupa seviyesinde kurumsallaşması açısından önemlidir. Bu doğrultuda, sosyal ortakların gücü, sosyal ortaklara Laeken Avrupa Konseyi ile 'otonom çerçeve anlaşmalar' hazırlama ve uygulama yetkisinin verilmesi ile daha bağımsız bir rol verilerek arttırılmıştır.Bu bağlam içinde, çalışma Avrupa sosyal diyaloğunun ve sosyal ortakların rolünün AB sosyal politika yapım sürecindeki etkisini yönetişim yaklaşımı bağlamında araştırmaktadır. Avrupa sosyal diyaloğunun bağlayıcılığı olan çıktıları ve kapsamı kısıtlı olduğu görülmektedir. AB kurumsal yapısının sosyal diyalog üzerindeki etkisi de kısıtlıdır. Avrupa sosyal ortakların temsil yapılarında da eksiklikler mevcuttur. Ancak, bütün bunlara rağmen, Avrupa sosyal diyaloğu, AB sosyal politikasının meşruluğuna katkısı açısından AB sosyal politkasının önemli bir parçasıdır. ABSTRACTThe social dimension of the Community exists since the inception of the European integration process. However, as the primary rationale of the Community was economic integration among the member states in order to create an effective internal market within the Community in the initial phases, the role of social policy in overall Community policy was minor. There has never been consensus among the member states as to the role of the Community in the social field. However, in time, the member states of the Community perceived the necessity of effective social polices for the accomplishment of economic integration. Thus, increased attention was paid to the social dimension of the Community, with a clear commitment to its development from the late 1980s. This idea for an active social policy, which began to gain political support in the late 1980s, continued its progress with the successive Treaty revisions throughout the European integration process. In parallel to this progressive historical development of European Union (EU) social policy, there has been a transformation in the legal and governance aspects of social policy, starting with the Single European Act (SEA). Although the social policy field is still within the domain of the member states, especially in the 1990s, there has been a transformation in the governance of EU social policy from a hierarchical mode of governance to a non-hierarchical mode of governance, producing soft law rather than the regulatory mode of hard law. According to the governance approach, multiple actors at multiple levels of the EU are involved in the social policy-making process with deliberation and problem-solving efforts. This development of EU social policy paves the way towards the European social dialogue through the active involvement of the European social partners in the social policy-making procedure. In that regard, the European social dialogue has been on the EU's agenda since 1985, when it was initiated with the 'Val Duchesse' talks under the presidency of Delors. With the institutionalization of the European social dialogue process through the Maastricht and Amsterdam Treaties, the influence of the European social dialogue has increased from merely issuing non-binding joint opinions to the point where it now makes framework agreements implemented by Council decision and monitored by the Commission. In this incremental development of the European social dialogue, the role of the social partners as the core actors of the process has come to the fore, since their representation at European level is important for the institutionalization of the social dialogue at European level. Thus, since the Maastricht Treaty, the European social partners, which represent trade union and employer organizations, has enjoyed an institutional role in the policy-making process and can negotiate legally binding agreements on labour market issues. Moreover, the power of the social partners has been enhanced with the Laeken European Council, when they were granted greater independence in the preparation and implementation of 'autonomous agreements'. In this context, the study explores the extent of the influence of the European social dialogue and the role of the social partners in EU social policy-making procedure with reference to governance in the EU. It is notable that, despite the limited outcomes of the European social dialogue process regarding binding legislation, the limited scope of the European social dialogue, the limited influence of the EU institutional framework on the social dialogue, and the deficiencies in the representative structures of the social partners, the European social dialogue is a significant part of EU social policy in terms of its contribution to its legitimacy. In that regard, the European social dialogue has emerged not only as one of the vital parts of the European social model, which comprises the concepts of compromise, consensus, and cooperation, but also as an important mechanism in the general framework of European governance and democratization of the EU.
