Article investigates into topical issues of interaction between legal acts of international intergovernmental organizations and national law in terms of legal nature of international organizations which in fact determines its law-making activity. Legal acts of international organizations phenomenon is examined, as well as peculiarities of its intercommunication with international legal reality and national mechanisms of implementation of international obligations. European Union is taken into account in relation to its impact on regulation in international law through the process of adoption of legal acts.Key words: international intergovernmental organization, legal nature, legal personality, legal acts, law-making, international legal regulation.

The dynamics of the formation of the arbitral tribunal in the international law was analyzed in the article. The attention is focused on the basic historical stages of the arbitration justice (arbitral tribunal), and their characteristics is given. It is proved that the arbitration justice (arbitral tribunal) is one of the legal means of international disputes regulation. The regularities of the development of the arbitration justice (arbitral tribunal), which stage-by-stage include the usage of internal models of legal proceedings, the usage of analogies of the legal regulation of the phenomena of internal law to the phenomena of international law, also, the formation of the authentic legal international models of the legal international disputes regulation were discovered in the article. It is advocated that legal disputes, in which the decision was made as a result of the application of legal models, and not the search for a compromise, were the basis of the differentiation of arbitration justice (arbitral tribunal) and reconciliation (agreement) or the mediation. The preservation of the main features of arbitration justice (arbitral tribunal) formed in ancient states throughout the process of the formation peaceful international disputes regulation means, mainly fairness, impartiality, expertise and understanding of the case by the arbitrators was emphasized in the article. It is discovered that arbitration justice (arbitral tribunal) is a special category of international law which includes the elements of legal regulation and the possibility of political (compromising) elements inclusion.Key words: arbitration justice (arbitral tribunal); mediation, arbitration; cruiser «Alabama» case; arbitrage. ; Проаналізовано динаміку становлення третейського правосуддя в міжнародному праві. Акцентовано увагу на основних історичних етапах третейського правосуддя та охарактеризовано їх. Доведено, що третейське судочинство є одним із судових засобів врегулювання міжнародних суперечностей. Виявлено закономірності розвитку третейського правосуддя, які поетапно включають використання внутрішніх моделей судочинства, застосування аналогій правового регулювання явищ внутрішнього права до явищ міжнародного права, а також формування автентичних міжнародно-правових моделей врегулювання міжнародно-правових спорів. Відстоюється позиція, що основою розмежування третейського правосуддя і примирення (погодження) або посередництва виступили спори правового характеру, у яких рішення приймали внаслідок застосування правових моделей, а не пошуку компромісу. Наголошено на збереженні основних рис третейського правосуддя, сформованого в античних державах упродовж усього процесу формування цього засобу мирного врегулювання міжнародних спорів, а саме – справедливість, неупередженість, кваліфікація і розуміння суті справи арбітрами. Досліджено, що третейське правосуддя є особливою категорією міжнародного судочинства, яке включає елементи правового врегулювання та можливість включення політичних (компромісних) елементів.Ключові слова: третейське правосуддя; посередництво; арбітраж; справа крейсера «Алабама»; третейський суд.

Treaty provisions and Union legislation are only part of the story of how law can actually take effect in reality. A quite decisive factor is their implementation through administrative action. This chapter looks at the steps which take place after legislation has been passed: Who does what and by which means to make sure that value decisions made in a legislative act do not only remain 'law on the books'? Which rights exist in that context? How can they be protected? With other words, this chapter deals with sub-legislative setting of rules and making of decisions. It asks which principles and rules exist to ensure the legality and legitimacy of such action.

If legal liability in all its forms has been regulated since the publication of the legislation, environmental liability is relatively new and, from the point of view of the authors, still not sufficiently and coherently regulated. We continue to apply the rules and the legal regime of the "classical" common law liability, although the environmental damage (ecological damage) presents an extreme degree of danger and although in terms of environmental law the principle of restoring the parties to the previous situation and repairing in the nature of the damage often becomes impossible to apply.

The article deals with the problem of legal nature of the legal doctrine as a source (form) of law. The article substantiates the idea that the legal doctrine has a twofold meaning, since it has an independent meaning in the system of forms of law of various legal systems, as well as is fully a source of law that forms the foundation, methodological basis for the creation, interpretation and application of legal norms in other legal systems, in particular the Russian state. The author draws attention to the characteristic features inherent in the legal doctrine, analyzes its role in various legal systems, where it acts as a form of law. The author compares the positions of various points of view of Russian scientists on the legal nature of legal doctrine as a form of law. The author identifies and describes the characteristic features of legal doctrine as a source of law in the activity of the mechanism of the Russian state in the sphere of legislative and executive implementation. ; В статье рассматривается проблема правовой природы юридической доктрины как формы (источника) права. Обосновывается идея о том, что юридическая доктрина имеет двуединое значение, поскольку имеет самостоятельное значение в системе форм права различных правовых систем, а также в полной мере является источником права, составляющим фундамент, методологическую основу при создании, интерпретации и применения правовых норм в иных правовых системах, в частности Российского государства. Автор обращает внимание на характерные черты, присущие юридической доктрине, осуществляет анализ ее роли в различных правовых системах, где она выступает формой права. Дается сравнение позиций различных точек зрения отечественных ученых на правовую природу юридической доктрины как формы (источника) права. Выделяются и описываются характерные особенности проявления юридической доктрины как источника права в деятельности механизма Российского государства в сфере осуществления законодательной, исполнительной и судебной власти. The thorough implementation of the cadastre and removal of the shortfalls existing therein and, especially, the creation of a legal mandate in favor of the proper cadastre system's execution would play a very effective role in compelling the veneration of citizenship rights in the private law within the urban community as well as human rights in the general law within the international community. Considering the fact that the exact placement of cadastre in the country and the delimitation of the counties' borders would seminally cause the discrepancies to be reduced to a minimum and, secondly, other individuals or governments would be prevented from abusing and invading the borders of the adjacent and neighboring persons and countries through the specification of a legal mandate in this regard.

A journal article on the conflict between customary law and general law in Zimbabwe. ; Under Zimbabwean law and despite the achievement in April 1980 of majority rule, with regard to family law and personal law, discriminatory treatment of Africans and women persists. Despite the passage since Independence of two Acts designed to help eradicate racism and sexism in Zimbabwe (the Customary Law and Primary Courts Act, "the Primary Courts Act" and Legal Age of Majority Act, "the Legal Age of Majority Act") the statute books still contain pre-Independence legislation preventing equal treatment of Africans and women. The Primary Courts Act eliminated racially based criteria for determining which system of law should apply to a particular dispute. It introduced new guidelines for resolving conflicts between customary law and general law, a significant move towards equality under the law. It repealed an Act containing a provision that exempted disputes between Africans from many general family law statutes.
