The article explores the contribution of the purity of Kelsen's theory of international law to the exclusion of ethics and political analysis from the workfield of the international lawyer. It is argued that Kelsen's own approach is an epistemologically grounded argument against involvement in the emotional dimension of political relations, which he dismisses as irrational. This is what justifies professional evasiveness in the face of the continuing self-assertiveness of the nation-state. Kelsen is now such a formidable obstacle to the development of the discipline because the profession lacks his general intellectual culture and so is unable to question the foundations of his system.
In der Fachwelt und in der Politik scheint ein Konsens darüber zu herrschen, dass neue Pflegemodelle das Potenzial haben, die Qualität und die Effizienz der Gesundheitsversorgung zu verbessern. Die rechtliche Umsetzung orientiert sich an den Prinzipien des Krankenversicherungsrechts. Diese müssen allerdings auch im Lichte übergeordneter, verfassungsrechtlicher Vorgaben diskutiert werden.
Die vorliegende Dissertation befasst sich mit der Rechtsstellung des Einzelnen als völkerrechtliches Individuum und die historische Entwicklung des Art. 25 Satz 2 GG seit Erlass des Grundgesetzes im Jahr 1949. Vereinzelt befürworten Stimmen des Schrifttums Art. 25 Satz 2 GG als individuelle Anspruchsgrundlage gegen Verletzungen allgemeiner Völkerrechtsregeln, und auch die deutsche Rechtsprechung hat jedenfalls obergerichtlich seit 2000 Sympathie für diese Haltung entwickelt. Die Dissertation betrachtet kritisch, wie Art. 25 Satz 2 GG zu werten ist und berücksichtigt dabei auch Entscheidungen internationaler Gerichte. ; The present dissertation deals with the legal status of the individual as an individual under international law and the historical development of Article 25 sentence 2 of the Basic Law since the Basic Law was passed in 1949. Os avanços tecnológicos possibilitam o acesso e compartilhamento rápido de dados e informações pessoais, o que demanda maior segurança e exigência de atitudes conscientes dos diversos profissionais que lidam com essas questões. Os profissionais de contabilidade se destacam neste universo por serem responsáveis por dados de clientes, fornecedores e colaboradores. O cenário de insegurança informacional levou à criação da LGPD, legislação específica para o tratamento de dados pessoais. Motivada por esse contexto, a presente pesquisa objetivou analisar os determinantes para conformidade da LGPD junto aos profissionais de contabilidade. Para alcançar tal propósito foi realizado um estudo quantitativo, descritivo e de levantamento. Na coleta dos dados desenvolveu-se e aplicou-se um questionário on-line com profissionais de contabilidade. A amostra final pesquisada totalizou 194 respondentes. A análise dos dados foi realizada por meio da Modelagem de Equações Estruturais. O modelo validado apresentou as dimensões de comportamentos e atitudes pessoais e os mecanismos de governança como determinantes, explicando 26,3% da conformidade com a LGPD. Esta pesquisa contribui para a compreensão de aspectos comportamentais dos profissionais da contabilidade frente à nova legislação, é uma abordagem inédita e supre uma lacuna na área contábil, apresentando contribuições úteis para instituições de ensino, órgãos de classe e empresas da área. ; Technological advances make it possible to quickly access and share personal data and information, which demands greater security and requires conscious attitudes from the different professionals who deal with these issues. Accounting professionals stand out in this universe for being responsible for customer, supplier, and employee data. The information insecurity scenario led to the creation of the General Data Protection Law (GDPL), a specific legislation for personal data handling. Driven by this context, this research aimed to analyze the GDPL compliance determinants among accounting professionals. In order to achieve this purpose, we conducted a quantitative, descriptive, survey study. For data collection, we developed and applied an online questionnaire addressed to accounting professionals. The final surveyed sample totaled 194 respondents. We performed the data analysis through Structural Equation Modeling. The validated model showed the dimensions of personal behaviors and attitudes and governance mechanisms as determinants, explaining 26.3% of GDPL compliance. This research contributes to the understanding of behavioral aspects of accounting professionals in face of the new legislation. It is an unprecedented approach and fills a gap in the accounting area, presenting useful contributions for educational institutions, class associations, and companies in the area.
DOI:10.1590/2179-8966/2020/46944ResumoEste artigo objetiva, em geral, caracterizar o regime jurídico da Lei Geral de Proteção de Dados sob os conceitos apresentados pelo capitalismo de vigilância, tendo como objetivos específicos: (I) descrever a economia política da vigilância e o papel do titular de dados/ usuário de serviços digitais e (II) identificar a inserção da LGPD no contexto da exploração econômica dos dados pessoais por meio do instrumento do consentimento do titular. Resultados: (I) A LGPD pode ser considerada um suporte jurídico para a acumulação capitalista na era informacional, possibilitando a condição de um titular de direitos relativos aos dados que pode negociar os seus dados com as empresas capazes de lidar com o contexto do Big Data e extrair desses dados comportamentos a serem vendidos em um mercado de dados que vende previsões de consumo e de vida cotidiana; (II) O grande mecanismo econômico identificado com a exploração é a extração de mais-valia comportamental, que é o processo que extrai das experiências da vida cotidiana dos usuários dados relevantes que são transformados em mercadoria; (III) Da mesma forma que o trabalhador assalariado do capitalismo é aquele que tem parte de sua produção extraída como mais-valor pelo capitalista, na era digital, os usuários conectados ao serem considerados titulares de dados tem sua vida cotidiana transformada em dados rentáveis, expandindo os limites da acumulação capitalista. AbstractThis article aims, in general, to characterize the legal regime of the General Data Protection Act (LGPD) under the concepts presented by surveillance capitalism, having as specific objectives: (I) describe the political economy of surveillance and the role of the data owner / user of digital services and (II) identify the insertion of LGPD in the context of the economic exploitation of personal data through the instrument of consent of the holder. Results: (I) LGPD can be considered a legal support for capitalist accumulation in the information age, enabling the condition of a data rights holder who can negotiate his data with companies capable of dealing with the Big Data context and extract from these data behaviors to be sold in a data market that sells forecasts of consumption and daily life; (II) The great economic mechanism identified with exploitation is the extraction of behavioral surplus value, which is the process that extracts relevant data from the users' daily life experiences that are transformed into merchandise; (III) In the same way that capitalist salaried workers are those who have part of their production extracted as more-value by the capitalist, in the digital age, users connected to being considered data holders have their daily lives transformed into profitable data, expanding the limits of capitalist accumulation. The method of procedure used is the dialectical-materialist, with a qualitative and technical approach of bibliographic research with literature review.Keywords: General Data Protection Act; Surveillance capitalism; Behavioral added value.
Die gegenständliche Diplomarbeit beschäftigt sich mit dem Rechtsinstitut der Einwilligung nach den Regelungen der DS-GVO. Neben grundrechtlichen Aspekten in Bezug auf das europäische und österreichische Datenschutzrecht werden allgemeine Begrifflichkeiten erläutert, bevor auf den Anwendungsbereich der DS-GVO sowie die Grundsätze und Rechtmäßigkeit der Verarbeitung personenbezogener Daten eingegangen wird. Hierbei wird das Kernthema dieser Arbeit das Rechtsinstitut der Einwilligung näher erläutert und die Charakteristika und die Bedingungen für das Vorliegen einer wirksamen Einwilligung beschrieben. In weiterer Folge finden besondere Fälle der Einwilligung Erwähnung, bevor abschließend einige Rechte thematisiert werden, die mit der Einwilligung einhergehen. Diese Diplomarbeit soll einerseits dazu dienen, dem Leser das Rechtsinstitut der Einwilligung näher zu bringen, andererseits werden Unklarheiten und Meinungsverschiedenheiten iZm der Einwilligung diskutiert. This extensive case note adds an original contribution to the debate on the ECJ ruling in Mangold, which established that the ban of discrimination (on grounds of age) constitutes a general principle of Community law (now: EU law). The ECJ derived from this finding that a Member State is barred from introducing new legislation discriminating on grounds of age while under an obligation of implementing Directive 2000/78, banning such discrimination. This had been interpreted in literature as recognising direct horizontal effects of the directive and/or the general principle of non-discrimination, resulting in a challenge of compliant case law before the German Constitutional Court. The author argues that the Court did not accept direct substituting horizontal effect of a Directive, but instead used the general constitutional principle of non-discrimination to establish exclusive effects of directives in horizontal relations. This argument was taken up by the Constitutional Court in its ruling accepting the case law of the Federal Labour Court which implemented ECJ case law. In the framework of the partnership between Arbeit und Recht and the Industrial Law Journal, an English language version of this article was also published in Industrial Law Journal, confirming its fundamental relevance. The Journal editors' summary of the article in English reads: "By classifying the anti-discrimination directives as a positivization of the constitutional principle of equal treatment in European Community law, the European Court of Justice has raised high expectations by hinting at horizontal effects of directive statutes between private parties. This will have long-term importance and, in the short term, affect the development of German anti-discrimination law. Thus it has become questionable whether hierarchies between different causes of discrimination can be maintained with regard to Community law, whether national law may acknowledge such differences, and how these may be justified."
In der vorliegenden Arbeit wird der gewährleistungsrechtliche Austauschanspruch beziehungsweise der Ersatzlieferungsanspruch beim Spezieskauf näher betrachtet. Es wird versucht, die in diesem Zusammenhang auftretenden rechtlichen Fragen und Probleme herauszuarbeiten, um danach die in den beiden Rechtsordnungen vertretenen Ansichten zu veranschaulichen. Bevor auf das Kernthema konkret eingegangen wird, erfolgt eine, nach österreichischem und deutschem Recht unterteilte, allgemeine Einführung in die jeweiligen zu behandelnden Bereiche, nämlich der Leistungsart und des Gewährleistungsrechts. Aufgrund der Verbrauchsgüterkaufrichtlinie der Europäischen Union wurde das Gewährleistungsrecht in den Mitgliedstaaten weitgehend harmonisiert. Der Kernbereich dieser Arbeit beschäftigt sich mit der Frage der Möglichkeit beziehungsweise der Zulässigkeit eines Austauschanspruchs beziehungsweise eines Ersatzlieferungsanspruchs bei einer nach individuellen Merkmalen bestimmten mangelhaften Leistung, um den Käufer neben der Verbesserung unter Umständen auch den zweiten zur Verfügung stehenden Primärbehelf der jeweiligen Rechtsordnung zu gewähren. Dazu werden rechtsvergleichend, zwischen dem österreichischen und dem deutschen Recht, die in der Literatur vertretenen Meinungen mit den dazugehörigen Begründungen aufgezeigt. Because of the Consumer Sales Directive of the European Union, the warranty law in the member states has been largely harmonized. The core area of this work deals with the question of the possibility or the admissibility of an exchange claim or a replacement delivery at a certain individual characteristics to defective performance, to ask the buyer in addition to the improvement may also granted the second available primary substitute from the legal system. For this purpose, a legal comparison between the Austrian and German law, demonstrated in professional literature opinions with the corresponding justifications. Vor dem Hintergrund der ständig steigenden Bedeutung des Gemeinschaftsrechts insbesondere auch für den Bereich des Zivilprozesses behandelt die Arbeit die Frage, wie in einem österreichischen Zivilprozess vorzugehen ist, wenn jene generell-abstrakte oder individuell-konkrete Norm des österreichischen Rechts, die das Zivilgericht grundsätzlich auf den festgestellten Sachverhalt anzuwenden hätte, den generell-abstrakten Normen des Gemeinschaftsrecht widerspricht. Da ein prozessrelevanter Normwiderspruch nur dann vorliegt, wenn das Zivilgericht sowohl an die Normen des Gemeinschaftsrechts als auch an die widersprechenden Normen des österreichischen Rechts gebunden ist, stellt der Autor zunächst dar, inwieweit die österreichischen Zivilgerichte an die generell-abstrakten und individuell-konkreten Normen des österreichischen Rechts sowie an die generell-abstrakten Normen des Gemeinschaftsrechts gebunden sind. Sodann wird gezeigt, dass grundsätzlich den österreichischen Zivilgerichten selbst die Kompetenz zukommt, festzustellen, ob eine österreichische Rechtsnorm, die grundsätzlich auf den Sachverhalt anzuwenden wäre, generell-abstrakten Normen des Gemeinschaftsrechts widerspricht und daher gemäß den gemeinschaftsrechtlichen Vorgaben in bestimmten Konstellationen nicht angewendet werden darf. Die Arbeit zeigt aber auch auf, inwieweit die diesbezügliche Entscheidungsautonomie der Zivilgerichte durch Entscheidungen des EuGH beschränkt werden kann. Zudem bespricht der Autor die neueste Judikatur des EuGH zur Frage, ob der Anwendungsvorrang des Gemeinschaftsrechts auch gegenüber individuell-konkreten Normen des nationalen Rechts gilt. Daneben gibt die Arbeit einen Überblick über die Rechte der Parteien des Zivilprozesses hinsichtlich der Bekämpfung von Fehlern bei der zivilgerichtlichen Beurteilung der Frage, ob grundsätzlich anzuwendende Normen des österreichischen Rechts generell-abstrakten Normen des Gemeinschaftsrechts widersprechen und daher nicht anzuwenden sind. ; Against the background of the increasing importance of European Community law in the field of civil litigation, the thesis deals with procedural questions concerning the application of general and individual norms of Austrian law that are potentially contrary to general norms of Community law by Austrian civil courts. At first, it is shown that in principle Austrian civil courts are bound to the general and individual norms of Austrian law as well as to the general norms of Community law. After that, the author outlines that in principle Austrian civil courts themselves have competence to decide whether an Austrian legal norm, which is relevant to a case, is contrary to the general norms of Community law and whether this Austrian norm must therefore be ignored in this particular case. But the thesis also reveals that the ECJ indirectly exerts wide influence on this decisions by national civil courts. Furthermore, the author discusses the latest judicature of the ECJ concerning the question whether the general norms of Community law also take precedence over individual norms of national law. Since classical Greece was not politically united, modern scholars have questioned whether one Greek law existed or every city-state (polis) had its own. The latest contribution by Gagarin (2005) denies unity in substantive law, but finds it in legal procedure. This article shows that under the surface of highly differentiated legal institutions within Greek city-states one can find general juristic conceptions. It just depends on the observer, not on the object observed. Looking at general conceptions is necessary also for a deeper understanding of any city-states' particular law, substantive or procedural. From Homer to Athens and Gortyn legal procedure developed in secularizing decisive oaths. A process from horkos to psêphos, from decisive oaths to the voting pebbles used by the Athenian judges, can thus be reconstructed.
Diese Dissertation befasst sich mit dem derzeit geltenden Datenschutzrecht in Liechtenstein sowie mit der seit Mai 2016 in Geltung stehenden europäischen Datenschutz-Grundverordnung. Ziel dieser Arbeit ist es insbesondere, die Auswirkungen dieser Verordnung auf das Datenschutzrecht in Liechtenstein in der Theorie und in der Praxis zu untersuchen und abzubilden. Im Vordergrund dieser Untersuchung stehen der Anwendungsbereich des Datenschutzrechts, die allgemeinen Grundsätze der Datenverarbeitung, zentrale Pflichten des Verantwortlichen und Rechte der betroffenen Person, die Datenschutzstelle als Kontrollstelle bzw Aufsichtsbehörde sowie die Möglichkeiten der betroffenen Person, ihre datenschutzbezogenen Rechte geltend zu machen, zu sichern und zu verteidigen. In diesem Zusammenhang wird auch das Recht auf den Schutz personenbezogener Daten in Liechtenstein auf grundrechtlicher Ebene dargestellt; dabei wird ein Vergleich mit der Rechtslage in Österreich und der Schweiz vorgenommen. Durch die Datenschutz-Grundverordnung wird das liechtensteinische Datenschutzrecht einer Vielzahl von Veränderungen und Weiterentwicklungen unterworfen. Diese betreffen einerseits die Rechte der betroffenen Person sowie eine Stärkung der Rechtssicherheit zu deren Gunsten; andererseits geht mit der Verordnung eine Vielzahl neuer bzw strengerer Pflichten des Verantwortlichen einher, was die datenschutzrechtliche Praxis nachhaltig verändern wird. ; This thesis considers the currently applicable data protection law in Liechtenstein as well as the European General Data Protection Regulation which has been applicable since May 2016. In particular, the aim of this thesis is to determine and describe the impact of this regulation on the data protection law in Liechtenstein in theory and in practice. The scope of the data protection law, the general tenets of data handling, the controller's key obligations and the data subject's rights, the Data Protection Office as a supervisory authority as well as the data subject's possibility to assert, to secure and to defend their rights in terms of data protection. In this context, the right to protection of personal data in Liechtenstein as a fundamental right is depicted as well; a comparison to the legal situation in Austria and Switzerland is carried out in the process. The General Data Protection Regulation leads to a multitude of changes and developments in the Liechtenstein data protection law. Beim GV handelt es sich um einen zwischen Ärzten und KVtr abgeschlossenen Normenvertrag zur Verwirklichung des durch den Gesetzgeber im ASVG an die KVtr gerichteten Versorgungsauftrags.Er stellt das gesetzgeberische Ideal zur Durchsetzung des durch die Sozialversicherung begründeten öffentlich-rechtlichen Leistungsanspruchs der Versicherten auf die durch die KVtr zu gewährleistende Sachleistungsvorsorge dar.Obzwar der GV als privatrechtliche Rechtsquelle durch den überwiegenden Teil der Lehre als Normenvertrag angesehen wird, löst die Festlegung der Rechtsnatur des GV einerseits einen Diskurs über eine zweiseitig zwingende Wirkung des GV und andererseits über das etwaige Merkmal seiner einseitig korporativen Natur, mit der ÄK als Korporation, aus.Im Zuge der Kategorisierung des GV als Normenvertrag ist dessen Vereinbarkeit mit der österreichischen Bundesverfassung zu prüfen, zudem ist dessen Bindung an die Grundrechte und das Unionsrecht zu erörtern.Da die Regelung der Beendigung des GV der Disposition der Abschlussparteien überlassen bleibt, stehen den Parteien grundsätzlich sämtliche Möglichkeiten zur Lösung eines Dauerschuldverhältnisses offen. In der Lehre bestehen allerdings verschiedene Ansichten über die Zulässigkeit befristeter GV sowie über die Rechtsfolgen der unzulässigen Teilkündigung eines wesentlichen Bestandteils des GV.Bei den wesentlichen Bestandteilen des GV handelt es sich um einen gesetzlich relativ ungenau vorgegebenen Mindestinhalt, der sich nach der hL aus dem Vertragsarztsystem, dem Zulassungssystem, der Honorierung der Ärzte durch die KVtr, der Regelung der Honorarhöhe sowie der Regelung der grundsätzlichen Arztpflichten zusammensetzt.Ziel dieser Arbeit ist es, das rechtliche "Konstrukt" des GV näher zu beleuchten, indem dessen Rechtsnatur, die Abschlussparteien, die Beendigung sowie der Mindestinhalt eingehend dargestellt und analysiert werden. ; The general contract or state health insurance fund contract is a normative contract for the realization of the provision of health services, which has been assigned by the legislator to the health insurance institutions as a public service task in the Law on general health insurance. It governs the relationship between the physicians and the health insurance institutions and constitutes the legislative ideal for the implementation of the public-law entitlement on part of those insured under compulsory insurance to the provision of health care services by the health insurance institutions.Although the general contract, as a source of private law, is regarded as a normative contract by the predominant part of legal scholars, the establishment of the legal nature of the general contract has triggered a discourse on the one hand on its mandatory binding effect on both, the parties to the general contract and the individual physicians, and, on the other hand on the possible feature of its one-sided corporative nature, the Medical Chamber constituting a corporation.In the course of the establishment of the general contract as a normative contract, its compliance with the Austrian Federal Constitution needs to be examined, and its conformity with fundamental rights and the law of the European Union must be discussed.Since the regulation to terminate the general contract is left to the disposition of the parties concluding the contract, in principle, all the possibilities to terminate a continuing obligation are open to the parties. However, different opinions exist among legal scholars on the admissibility of general contracts with a time limit as well as on the legal consequences of an undue partial termination of an essential component of the general contract.The essential components of the general contract consist in a minimum content which is however not defined exactly by law and which encompasses the system of panel physicians, the licensing system, the remuneration of the physicians by the health insurance institutions, the regulation of the fees as well as the regulation of the basic duties of the physicians.The aim of this thesis is to examine the legal "construct" of the general contract in more detail. In Europe, legislators are increasingly introducing sustainability goals into the system of private law. By prohibiting certain conduct, increasing transparency, nudging companies, as well as changing institutions, procedures and liability regimes, legislators complement private law with tools and goals traditionally attributed to public law. Die Dissertation befasst sich mit dem Allgemeinen Preußischen Landrecht von 1794 und der hierzu ergangenen Rechtsprechung des Berliner Obertribunals. Im Fokus der Untersuchung stehen die erbrechtlichen Regelungen des Landrechts und deren Anwendung sowie Auslegung in der Judikatur des höchsten preußischen Gerichts. Der Forschungsgegenstand ergibt sich aus dem im Landrecht kodifizierten speziellen Gesetzesverständnisses. Nach diesem sollte die Gesetzesauslegung durch die Rechtsprechung auf ein Minimum, nämlich die Auslegung allein anhand des Wortlauts der Regelung reduziert werden, um dem absolutistischen Regierungsanspruch der preußischen Monarchen, namentlich Friedrich des Großen, hinreichend Rechnung zu tragen. In diesem Kontext wird der Frage nachgegangen, inwieweit das preußische Obertribunal das im Landrecht statuierte "Auslegungsverbot" beachtet hat und in welchen Fällen sich das Gericht von der Vorgabe emanzipierte und weitere Auslegungsmethoden anwendete und sich so eine unabhängige Rechtsprechung entwickeln konnte. Die Arbeit gliedert sich in drei Hauptabschnitte. Im Anschluss an die Einleitung, in der zunächst die rechtshistorische Bedeutung des Landrechts und des Erbrechts sowie der Untersuchungsgegenstand umrissen werden, folgt die Darstellung der Entstehungsgeschichte des Landrechts und des Berliner Obertribunals. Hieran schließt sich in einem dritten Abschnitt eine Analyse der erbrechtlichen Vorschriften des Landrechts an. In dieser wird auf die Entstehungsgeschichte der verschiedenen erbrechtlichen Institute wie beispielsweise der gesetzlichen und gewillkürten Erbfolge, dem Pflichtteilsrecht etc., unter Berücksichtigung des zeitgenössischen wissenschaftlichen Diskurses eingegangen. Im vierten Abschnitt geht es um die Judikate des Berliner Obertribunals aus den Jahren 1836-1865 in denen die zuvor dargestellten erbrechtlichen Regelungen entscheidungserheblich waren. Dabei wird der Forschungsfrage, inwieweit das Obertribunal das im Landrecht statuierte Auslegungsverbot beachtet hat und in welchen Fällen es von diesem abwich bzw. weitere Auslegungsmethoden anwendete, konkret nachgegangen wird. Insgesamt werden 26 Entscheidungen des Obertribunals unter dem Aspekt der Auslegungspraxis, der Kontinuität und der Beschleunigung der Rechtsprechung analysiert und ausgewertet. ; The thesis deals with the General Prussian Codex of 1794 and the related jurisprudence of the Prussian Supreme Court in Berlin. The spotlight of the investigation are the inheritance regulations of the prussian law and their application and interpretation in the judicature of the Prussian Supreme Court in Berlin. The subject of research results from the special understanding of the rule of law in the General Prussian Codex of 1794. According to this, the interpretation of the law by the jurisprudence should be reduced to a minimum, namely the interpretation solely on the basis of the wording of the regulation, in order to take sufficient account of the absolutist claim to government of the Prussian monarchs, namely Frederick the Great. In this context, the question of the extent to which the Prussian Supreme Court in Berlin observed the "prohibition of interpretation" stipulated in the General Prussian Codex of 1794 and in which cases the court emancipated itself from the requirement and applied further methods of interpretation and thus an independent judiciary was able to develop. The thesis is divided into three main sections. Following the introduction, in which the legal historical significance of the General Prussian Codex of 1794 and inheritance law as well as the subject of investigation are outlined, the history of the development of land law and the the Prussian Supreme Court in Berlin follows. This is followed by a third section with includes an analysis of the inheritance law provisions and rules in the General Prussian Codex of 1794. In this, the history of the origins of the various institutes of inheritance law, such as the legal and voluntary succession, the last will, the compulsory portion, etc., taking into account the contemporary scientific discourse, is dealt with. The fourth chapter deals with the judgments of the Prussian Supreme Court in Berlin from the years of 1836-1865 in which the previously described inheritance regulations were relevant to the decision. The research question of the extent to which the Prussian Supreme Court in Berlin has observed the "prohibition of interpretation stipulated in the General Prussian Codex of 1794 and in which cases it deviated from this or used other methods of interpretation of the law is specifically investigated. A total of 26 decisions of the higher tribunal are analyzed and evaluated under the aspect of interpretation practice, continuity and the acceleration of case law.
In dieser Arbeit werden die Funktion des Generalsekretärs in den Bundesministerien und die Funktion Konferenz der Generalsekretäre untersucht. Der "Generalsekretär" wurde mit der Novelle zum Bundesministeriengesetz 1986 mit einer Vorgesetztenfunktion gegen-über den Sektionschefs und allen untergeordneten Abteilungen und Dienststellen ausge-stattet. Dadurch wurde diese Funktion wichtiger für die politische Führung. Von der Konferenz der Generalsekretäre gab es bis zur Amtsenthebung der Bundesregie-rung durch den Bundespräsidenten, infolge eines Misstrauensantrages im Mai 2019, keine öffentlichen Berichte. Anhand von Untersuchungen parlamentarischer Anfragen, Minister-ratsvorträgen, Lebensläufe der Generalsekretäre und einer historischen Betrachtung des Bundesministeriengesetz 1986 wurde die Tätigkeit und Funktion der Generalsekretäre und der Konferenz der Generalsekretäre erschlossen. Die Fragestellungen: "Welche Konsequenzen ergeben sich für die politische Führung und Verwaltung aus der Gesetzesnovelle zum Bundesministeriengesetz 1986, bezüglich der Generalsekretäre?" "Was wurde seit in Kraft treten der Gesetzesnovelle über das Wirken der Generalsekretä-re und der Konferenz der Generalsekretäre bekannt?" "Was wurde infolge der Beendigung der türkisen Alleinregierung über die weitere Tätigkeit der Generalsekretäre bekannt?" Die Fragestellungen lassen sich nur durch qualitative Forschung samt Inhaltsanalysen beantworten. Aufgrund der gemeinsamen, einheitlichen Politik der beiden Regierungsparteien, ÖVP und FPÖ, war es möglich, die Funktion der Generalsekretäre und der Konferenz der General-sekretäre als gemeinsames Instrument und der Kontrolle und Koordination der einzelnen Bundesministerien einzuführen. Eine besondere Bedeutung kommt dem Ministervortrag vom 08. Mai 2019 und den parlamentarischen Anfragen mit ihren Beantwortungen zu. ; In this assignment, the role of the general secretary in the federal ministries and the role of the conference of the general secretaries are being reviewed. In the amendment of the federal ministry law of 1986, the general secretary has been equipped with a superior po-sition above that of the head of department and all other departments and offices. Until the dismissal of the federal government by the federal president in May 2019 due to a motion of no-confidence, there have been no official reports of the conference of the gen-eral secretaries. After examinations have been done of inquiries of parliamentarian requests, speeches of the counsel of ministries and a historical view of the federal ministerial law have been viewed the function of the general secretary and conference of general secretaries was developed. Questions that arose from the above-mentioned examination could be summarised as follows: "Which consequences for the political leadership and management have resulted from the amendment of a general secretary?" "What has become known about the activity of the general secretary and conference of the general secretaries, after the enforcement of the amendment of the federal law of 1986?" "What has become known of the further activity of the general secretary after entourage of the late conservative government in their exclusivity?" Answers for these questions can only be found in the analysis of contents, which have been done in a qualified research. Based on the communal and unitary politics of both the conservative and right-winged par-ties, ÖVP and FPÖ, through the position of the general secretaries and conference of the general secretaries, it has been possible to create an instrument of control and coordina-tion of all federal ministries.
