the constituency of the "youth" object in public law is delicate due to the lack of a unified legal concept, which is all the more difficult because in common language the concept of "youth" is also difficult to grasp. However, it is possible to establish the existence of legal provisions in public law which focus on young people. These systems in turn fall under general administrative law, public health law, social action law, sport law, etc. In addition to an undeniable functional diversity, the rules and public policies aimed at young people seem to be axiologically consistent. ; La circonscription de l'objet « jeunesse » en droit public est délicate en raison de l'absence de notion juridique unifiée. La tache est d'autant plus ardue que dans le langage commun la notion de « jeunesse » est également difficile à saisir. Pour autant, il est possible de constater l'existence de dispositifs juridiques en droit public qui se donnent pour objet la jeunesse. Ces dispositifs relèvent tour à tour du droit administratif général, du droit de la santé publique, du droit de l'action sociale, du droit du sport, etc. A l'examen, par-delà une indéniable diversité fonctionnelle, les règles et politiques publiques ayant pour objet la jeunesse semblent présenter une cohérence axiologique.
La mise en oeuvre des règles de responsabilité implique de choisir entre un régime de responsabilité pour faute ou sans faute. Dans cet article, nous analysons les déterminants du respect des règles de droit lorsqu'il existe des coûtes liés à la stigmatisation en plus des incitations économiques standard. Ce coût de stigmatisation ne correspond donc pas à un simple transfert de ressources. Nous montrons que lorsque le standard définissant le régime de responsabilité pour faute est égal au niveau de dissuasion, le résultat n'est jamais optimal. The ecological debt is a concept which was developed at the beginning of the 90s in order to fight against the burden of financial debts which crippled the budgets of developing States. States and the civil society used the theoretical and practical knowledge developed by researchers in social and economic sciences to criticize an unequal worldorder, leading to continuous environmental degradation and as such, a characteristic of an unequal ecological exchange. For the different actors, the concept of ecological debt took on various meanings so that we can now dissociate four different discourses. For each discourse, we have identified one or more legal mechanism, but most of them often turn out to be unfit to meet the claims of ecological debt advocates. It appears that only the community version of ecological debt is efficient without being counter-productive. After being confined in the Transport policy by the EEC Treaty, the public service obligation is now related on several Union's areas. Mainly linked to the networking activities within the European Union's exercise of competences, the public service obligation is being used as an overall way to identify the SGI substance within the field of European Law. Shaped on a sectoral basis in order to maintain the Member States margin of discretion about the definition, the operation, and the funding of such services, it partially contributes to unify the SGEI notion. By justifying specific interpretations of Eu legal categories, the public service obligation however promotes it in a European integration process based on Member States'interests. Bonded to the market monitoring ensured by Member States, the public service obligation continues to be a mean to override ordinary law.This link is becoming less intense. La place de cet objet est pourtant devenue telle, notamment au travers du droit constitutionnellement protégé de mener une vie familiale normale, ou des multiples interventions publiques vers les familles, que l'on ne peut plus se contenter d'observer la présence de cet objet dans les énoncés juridiques et qu'il faut essayer de rendre compte de l'objet famille lui-même. C'est l'ambition de cette thèse. Cela nécessite de recourir à des méthodes d'analyse permettant de dépasser l'apparente diversité qui entoure en droit public le concept de famille, pour essayer de dévoiler sa cohérence. En s'intéressant, en amont de l'objet construit, au processus de construction juridique de l'objet famille, on peut proposer une grille d'analyse globale. Elle saisit l'Etat et la famille comme des phénomènes sociaux, entre lesquels s'établissent des liens directs de dépendance et d'opposition. Le droit public apparaît comme un instrument permettant la reconstruction de la réalité sociale s'attachant à ces liens, à travers la construction de cet objet juridique famille. On peut dès lors montrer comment, grâce à cette reconstruction, l'Etat protège la seule famille qui, dans ses formes et surtout dans ses fonctions, est utile à sa propre construction et comment, ce faisant, il l'inscrit dans une perspective de contrôle social, par la mise en oeuvre de techniques juridiques assurant sa représentation et son administration.
The financial equalisation system in France has become crucial in the management of local authorities. By way of illustration, there is an ongoing growth of financial resources, systems and plans of action to reduce inequalities between local governments and districts. Despite the encouraging results in the national equalisation implementation, its consistency and complexity mechanisms are to be enhanced. The disability to define freedom and equality contains the legislator in the design of stable and defined framework for equalisation. As such, the theory on a uniform distribution raised since the Age of Enlightenment, is to be considered. Unlike the German laws and regulation, the legislator is free to set up rules of financial interdependency among local authorities in the French Constitution. The constitutional judge, precursor and equalisation decision-maker, supervise an insufficient control to the detriment of financial and fiscal autonomy of local authorities. From the basis of equalisation benefits, there are some evident difficulties surrounding the limit of this system in respect to the degree of local authority's financial autonomy. An operational review of both horizontal and vertical equalisation mechanisms, as well as the choice of redistribution criteria should be undertaken. The stakes are high to adjust and put right the shortcomings of the equalisation system, recently modified by a financial regulation reform for 2010 and 2011. ; La péréquation française est devenue un enjeu fort des finances publiques locales.
