Türkiye, planlı dönemle birlikte uygulamaya başladığı bölgesel gelişme ve bölgeler arasındaki dengesizlikleri giderici yöndeki politikalarını günümüzde yeniden gözden geçirme zorunluluğu ile karşı karşıyadır. Bu zorunluluğun esas nedeni Avrupa Birliği'ne katılım sürecinde bölgesel gelişme politikalarının entegre edilmiş olmasıdır. Bu nedenle Türkiye, yaklaşık 40 yıldır uygulamakta olduğu bölgesel gelişme model, politika ve araçlarını bir yana bırakarak yeniden bir yapılanma süreci içine girmiştir. Bu yeni yapılanmanın ana öğesini Bölgesel Kalkınma Ajansları (BKA) olarak adlandırılan birimler oluşturmaktadır. Kalkınma Ajansları, bir ülkenin belli bir coğrafi bölgesi içerisindeki özel ve kamusal tüm şirketler, yerel otoriteler ile sivil toplum kuruluşları arasında işbirliği sağlayarak, o bölgenin ekonomik açıdan gelişmesini hedefleyen ve yasal bir hükme dayanarak kurulan yapılar olarak tanımlanmaktadır. Küreselleşme süreci beraberinde getirdiği yapısal uyum politikaları ile birçok konuda özgün süreçler ve araçlar geliştirilmesini gerekli kılmıştır. Bu süreçte Türkiye'ye de AB tarafından bölge planlamanın yeni bir anlayışla ele alınması gerektiği ve bunun aracının da BKA'lar olduğu ifade edilmiş ve konu ilk kez AB'ye tam üyelik müzakereleri ile başlamıştır. Bu dönemin başlangıcı sayılacak süreç ise adaylığın ilk kez tescil edildiği 1999 Helsinki Zirvesi sonunda olmuştur. AB Komisyonu'nun hazırlamış olduğu Katılım Ortaklığı Belgesi'nde orta vadede yapılması gereken düzenlemeler arasında yer alan BKA'ları oluşturmak amacıyla yasal düzenlemeler süreci başlatılmıştır. Bu doğrultuda öncelikle Topluluk kurallarına uygun olarak kısa vadede istatistiksel bölge olarak bilinen AB (NUTS) sistemi 22 Eylül 2002 tarih ve 4720 sayılı Bakanlar Kurulu kararı ile kabul edilmiştir. Daha sonra da 2003 yılı Katılım Ortaklığı Belgesinde, katılım öncesi mali yardım programından yararlanabilmek için BKA'ların kurulması öngörülmüştür. Takip eden süreçte 32 esas ve 5 geçici maddeden oluşan, 5449 sayılı Kalkınma Ajanslarının Kuruluşu, Koordinasyonu ve Görevleri Hakkında Kanun, 25.01.2006 tarihinde TBMM Genel Kurulunda görüşülerek kabul edilmiş, 08.02.2006 tarihli ve 26074 sayılı Resmi Gazetede yayımlanarak yürürlüğe girmiştir. Ülkemizde, 5449 sayılı Kanunun birinci maddesinde ifade edildiği üzere; ?kamu kesimi, özel kesim ve sivil toplum kuruluşları arasındaki işbirliğini geliştirmek, kaynakların yerinde ve etkin kullanımını sağlamak ve yerel potansiyeli harekete geçirmek suretiyle, ulusal kalkınma plânı ve programlarda öngörülen ilke ve politikalarla uyumlu olarak bölgesel gelişmeyi hızlandırmak, sürdürülebilirliğini sağlamak, bölgeler arası ve bölge içi gelişmişlik farklarını azaltmak amacıyla? BKA'lar kurulmaktadır. 6 Temmuz 2006 tarih ve 26220 sayılı Resmi Gazete'de yayımlanan ?Bazı Düzey 2 Bölgelerinde Kalkınma Ajansları Kurulmasına Dair Bakanlar Kurulu Kararı? ile ilk olarak 06.01.2007 tarihinde Adana ve Mersin illerini kapsayan Çukurova Kalınma Ajansı ve 13.01.2007 tarihinde de İzmir ilini ve çevresini kapsayan İzmir Kalkınma Ajansları kurulmuştur. Kalkınma ajansları; ? Bölgesel gelişme uygulamalarımız ile bölge planlarımızın etkinliğinin ve başarısının yükseltilmesini; bölgelerin ülkemizin genel büyümesine, gelişmesine, refahına ve istikrarına katkısının artırılmasını; sosyal uyum ve adaletin güçlendirilmesini ve değişen küresel rekabet şartlarına adaptasyonunun hızlandırılmasını sağlayacak, ? Yüksek nitelikli personeli, esnek kaynak ve istihdam yapısı ile kurum, kuruluş ve şahıslara sağladığı idari, mali, teknik desteklerle başta girişimciler olmak üzere bütün yerel aktörlerin kalkınma çabalarına katılımını teşvik edecek, ? The main reason of this necessity is that regional development policies weren't integrated in the process of participation of European Union. Therefore, Turkey went into a reconstruction process by abandoning the regional development model, policy and tools that it had been has been using for 40 years. The units called Regional Development Agencies (RDA) constitute the main element of this construct. Development Agencies, all private and public enterprises within a certain geographical region of a country, are defined as structures that aim the economic development of that region by providing cooperation between local authorities and civil society organizations, and that are founded on the basis of a legal provision. As is known, globalization process entails the development of authentic processes and tools in many cases regarding structural adaptation policies that it brought along. In this process, it was explained to Turkey by EU that regional planning should be approached with a new understanding and RDA?s are the means for this and this first started with the negotiations of full membership to EU. The process that can be counted as the beginning of this period is the end of Helsinki Summit of 1999 when the candidateship was first enrolled. The legal regulations process was initiated so as to constitute RDA?s that are among regulations which should be implemented in medium term in Accession Partnership that European Commission arranged. Accordingly, EU (NUTS) system that is known as short term statistical region was initially approved by Cabinet decree no 4720 in September 22 of 2002 in accordance with the rules of congregation. Later in the Accession Partnership of 2003, it was anticipated that RDA's be constituted in order to be able to utilize the pre-accession financial support programmes. In the following process, the law number 5449 regarding the Establishment, Coordination and Missions of Development Agencies that consists of 32 major and 5 temporary articles was debated and approved in General Assembly of Grand National Assembly of Turkey and went in effect after being published in Official Journal of number 26074 and date 02.08.2006. In our country, as stated in the first article of law number 5449, RDA?s are constituted ?in order to accelerate the regional development, to insure its maintainability, reduce the differences of interregional and regional development, compatible with the principles and policies anticipated in national development plans and programmes by developing the cooperation among public sector, private sector and civil society organizations, ensuring the effective usage of resources and activating the local potency?. By ?the Cabinet Decree Regarding the Establishment of Development Agencies in Certain Level 2 Regions? that was published in Official Journal number 26220 of July, 6, 2006, Development Agencies were constituted in Cukurova regions that include Adana and Mersin and Izmir regions including Izmir, and Cukurova Development Agency officially opened in 01.06.2006 and Izmir Development Agency in 01.13.2007. Development agencies; ? Will ensure the promotion of effectiveness and success of our region plans with our regional development applications; increasing of regions' contributions to the general growth, development, welfare and stability of our country; reinforcement of social adaptation and justice and, acceleration of adaptation to changing conditions of global competition, ? Will encourage the participation of all local actors in development attemps, especially administrative, financial and technical supports that it provides to corporations, establishments and persons with its highly qualified crew, flexible resource and employment structure, ? Will improve the culture and ability to produce and manage associate projects that are based on co-financing of person, corporation and establishment in project and activity supports; reinforce the sense of ownage and cooperation; active the entrepreneurship potency of the region and keep improving it, ? Will activate the local potency, dynamics, individualities by revealing the resources and possibilities, and turn into an economic, social and cultural values in international market; Consequently, will contribute to the improvement of economic and social indicators, especially employment and income in both national and regional- local level; reduction of differences of interregional and regional development and thus increasing of general prosperity of the country and solidifying of stability.
ÖZET1980 sonrası yaşanan yönetsel değişim sonucu sivil toplum kuruluşları yönetişim kapsamında politika belirleyici bir aktör olarak kamu ve özel sektör kuruluşları ile birlikte karar mekanizmasında yer almaya başlamıştır. Böylelikle sivil toplum kuruluşları temsiliyet düzeyinin geliştirilmesi ve demokratik bir topluma ulaşma yolunda hak ve özgürlüklerin gerçekleşmesi açısından önemli bir rol kazanmıştır. Bu çerçevede siyasi katılım kavramına bir alternatif olarak sunulan sivil toplum kuruluşları temsili demokrasinin yaşadığı çoğulculuk problemini çözerek hukuk devletini gerçekleştirmenin bir aracı haline gelmiştir. Bu vesile ile sivil toplum kuruluşları vatandaşların katılımcı, çoğulcu, şeffaf bir demokratik yapı içerisinde aktif yurttaş olarak yer almalarını sağlayacaktır. Bu noktada, özellikle Türkiye'de yönetişim mekanizmasının etkili bir şekilde işlemesi için sivil toplum kuruluşlarının yeterli kurumsal kapasiteye sahip olup olmadığı sorusu ortaya çıkmaktadır. Türkiye'de sivil toplum kuruluşlarına yönelik bulunan mevzuat STK'ların kurumsal kapasitelerini geliştirmeleri açısından zayıftır. In this way, civil society organizations have an important role in terms of improving the level of representation and realizing the rights and freedoms in reaching a democratic society. In this context, civil society organizations presented as an alternative to the concept of political participation has been a means of realizing the rule of law by solving the pluralism problem of representative democracy. By this means, civil society organizations will ensure that citizens take part in a participatory, pluralistic, transparent democratic structure as active citizens. At this point, the question arises as to whether or not civil society organizations have sufficient corporate capacity for the effective functioning of the governance mechanism. Located legislation for civil society organizations in Turkey is weak in terms of developing corporate capacities of civil society organizations. In this respect, the need for the regulation of legislation that will comply with the current conditions to be developed by the participation mechanisms of civil society organizations within the framework of governance effectively continues. This requires undoubtedly increasing the institutional capacity of civil society organizations in order to effectively manage and fulfill these duties and responsibilities defined for them. In this thesis, Corporate Capacity Development Difficulties of Civil Society Organizations have been addressed and a model has been formed within the scope of Corporate Capacity Building Strategies. In this thesis; literature analysis, content analysis, legislation analysis and semi-structured interview method which is one of the qualitative research methods had been used. In this context, with various civil society organizations operating in Turkey it was carried out semi-structured interviews. Then, institutional capacity analyzes of these non-governmental organizations were carried out. In terms of the results achieved in the thesis, civil society organizations implementing strategic management are managed effectively; strategic management, corporate governance and corporate communication accelerate institutional capacity development, and the corporate capacity development of civil society organizations brings about institutionalization.

Her ne kadar teknoloji insanoğlunu değiştirse de ve insanoğlu bu değişimlere uyum gösterse de aslında demokrasi ışığında insanoğlunun mülkiyet hakları özgürlükleri güvensiz ortamlar oluşturmadıkça değişimden söz etmemiz doğru olmayacaktır. These theories came upon on 17th and 18th centuries and predicate the individuals on society. 20th century world wars that shaped post-modernism are the foundation of the new world order and the concept of democracy.The individuals involved in the governance process are in communication, interaction and in the action within the public domain. We can say that the new forms are shaped on the basis of the involvement in the social movements and the governance of the individuals. Rapidly emerging scientific and technological developments led to the need for a radically revised understanding of all policies and conventional governance. Since 1990s, sovereignty is not considered as the strongest power of the government while there is the emphasis on the international law and human rights. Countries aim to eliminate the concerns on the expectations of future world by both realizing technology prediction studies and designing new scientific and technological policies. The term "good governance", which is mentioned frequently in the reports of the institutions like United Nations, World Bank, IMF and OECD, has become the most examined term within the recent two decades.At this point, dependency and the limitedness are the essentials on protecting the principle of separation of powers, which is a prerequisite of democracies. Even if we could say that the technology shapes and changes the actions of the individuals and the individuals can adapt to these changes, it would not be right/realistic to talk about real changes unless the property rights and the freedom of the human beings become insecure in the light of the democracies.To sum up, no matter how, human being will demonstrate his social movements in any case and the governments getting away from the democracies will experience great losses. Time will be one of the most important determinants at this juncture and for the societies having the desire to become more modernized these variables will never change.
Doktrinde anlaşmazlık ve uyuşmazlık terimlerini genellikle birbirinin yerine kullanılmasına rağmen, bu iki terim arasında önemli bir farklılık bulunmaktadır. Anlaşmazlık, birbirine zıt veya düşmanca bir durum ya da bir mücadele veya kavga olarak tanımlanır. Bir uyuşmazlık, dava konusu olabilen meseleler şeklinde ortaya çıkan bir anlaşmazlık çeşidi olarak görülebilir. Uyuşmazlık, müzakere, arabuluculuk veya üçüncü kişinin hüküm vermesi yoluyla çözülebilecek meseleler üzerinde anlaşmazlığa düşülmesini gerektirir. Buna ek olarak ADR de diğer bir gelişme 1988?de Birleşik Devletler Kongresinin on adet bölge mahkemesinde zorunlu tahkim programı kurması ve diğer on adet bölge mahkemesini gönüllü tahkim programı oluşturması için yetkilendirmesiyle görülmüştür. ADR nin hızlı gelişimine katkıda bulunan büyük bir etken, 1976 da Amerika Barolar Birliğince düzenlenen Adalet Yönetimindeki Kamusal Tatminsizliklerin Nedenleri Hakkında Ulusal Konferans olmuştur. Bu konferansta, uyuşmazlık çözümündeki alternatif usûllerin, özellikle arabuluculuk ve tahkimin, tıkanmış halde bulunan mah-kemeleri rahatlatacağı, uyuşmazlıkların çözüm süresini kısaltacağı ve giderlerini asgariye indireceği sonucuna varılmıştır. Arabuluculuk hizmeti sunan mahalli adalet merkezlerinin ve çok seçenekli mahkeme teşkilatı programlarının kurulması teşvik edilmiştir. Çok seçenekli mahkeme teşkilatı terimi (ya da çok seçenekli ADR), bir dizi seçimlik uyuşmazlık çözüm usûlü sunan mahkemeleri ifade eder. Bu programlar, ihtilaflı tarafları, onlar için en uygun olan uyuşmazlık çözüm yöntemine yönlendirirler. Bunlar: Kolaylaştırma, arabuluculuk veya tahkimdir. Bazı çok seçenekli mahkeme teşkilatı prog-ramları belli türdeki bütün davaları belirli bir ADR programına havale et-mekteyken, diğer bazı programlar davacılara seçimlik bir liste sunmaktadırlar. ADR, uyuşmazlık çözümü için mahkemeler vasıtasıyla yürütülen davalarda alternatif olarak işleyen, genellikle tarafsız bir üçüncü kişinin aracılığı ve yardımını içeren bir dizi usûller olarak tanımlanır. Doktrine göre ADR usûlleri aşağıdaki yararları içerebilir: 1. Mahkemelerin iş yükünü ve giderlerini azaltmak, 2. tarafların yargılama için harcadıkları giderleri ve zamanı azaltmak, 3. topluluklara veya tarafların ailelerine zarar veren uyuşmazlıkların hızlı bir şekilde çözümünü sağlamak, 4. bireylerin adalet sisteminden daha iyi bir şekilde tatmin olmasını sağlamak, 5. tarafların ihtiyaçlarına uygun olan çözümleri teşvik etmek, 6. tarafların uyuşmazlık çözüm usûllerine gönüllü olarak uymalarını sağlamak, 7. komşuluk ve topluluk değerlerini ve toplulukların ilişkilerini onarmak, 8. ihtilaflı taraflarca ulaşılabilecek usûller oluşturmak, 9. halka, uyuşmazlıkların çözümünde ihlâl ya da dava yolu yerine daha etkili olan usûlleri denemelerini öğretmek, ADR tarafların bir araya getirilmesinde pek çok farklı yöntem gerektirir; bununla birlikte temel ADR usûlleri arabuluculuk ve müzakeredir. Arabuluculuk ve uzlaştırma terimleri eş anlamlı olarak kullanılırlar. Arabuluculuk (veya uzlaştırma), tarafların bir anlaşmayı müzakere etmeleri için onlara yardım eden tarafsız bir üçüncü kişice gerçekleştirilen bağlayıcı olmayan bir müdahaledir. Üç tür arabuluculuk vardır. Bunlar geleneksel arabuluculuk, yargısal arabuluculuk ve modern arabuluculuktur. Arabulucunun yapısı ve işlevi, arabuluculuk usûlünü diğer uyuşmazlık çözüm usûllerinden ayırmaktadır. Arabulucu bir kolaylaştırıcıdır. Arabulucu, ihtilaflı konular üzerindeki kendi kararını taraflara dikte etmemelidir. Arabulucululuk esnek yapısıyla şekillenerek farklı bir usûl haline bürünür. Arabulucunun yaklaşımı doğrudan veya dolaylı ya da bunların arasında bir usûlde kendini gösterebilir. Arabuluculukta bir ya da birden fazla oturum olabilir. Arabuluculuyla caucuses adında ayrı toplantılar yapılabilir. Arabuluculuk oturumları gizlidir ve tarafların iletişimine yadım etmek amacıyla gerçekleştirilir. Arabuluculuk geliştikçe, kolaylaştırma ve değerlendirme arabuluculuğu gibi farklı arabuluculuk türleri ortaya çıkmaktadır. Mahkeme veya arabulucu tarafından hangi arabuluculuk modelinin izlendiğine bakılmaksızın, arabuluculuk usûllerinin çoğu aşağıdaki aşamaları izler: Arabuluculuk öncesi aşama, arabuluculuk aşaması ve arabuluculuk sonrası aşama. Türk hukuk sisteminde Avukatlık Kanunu, Ceza Muhakemesi Kanunu, İş Kanunu, Tüketicinin Korunması Hakkında Kanun ve Vergi Usûl Kanunu gibi kanunlarda ADR ile doğrudan ilgili düzenlemeler bulunmaktadır. Türk hukukunda, ADR ye ilişkin iki temel düzenleme mevcuttur. ADR yi destekleyen ilk yasal düzenleme Avukatlık Kanunundadır. Avukatlık Kanunu nun 35/A maddesine göre, müvekkilin talep etmesi halinde bir avukat, dava veya duruşma başlamadan önce ihtilaflı tarafları uzlaştırabilir. Kanun, tarafların uzlaştırma süreci sonunda bir anlaşmaya varmaları halinde, taraflar ve avukatların uyuşmazlığı çözen bir yazılı anlaşma yapmalarını hükme bağlamıştır. Uzlaşma tutanağı olarak adlandırılan bu anlaşma avukatlar ve müvekkillerince imzalanır. Uzlaşma tutanağı diğer mahkeme hü-kümleri gibi icra edilebilir. İkinci düzenleme, 1 Nisan 2005 te yürürlüğe giren yeni Ceza Muhake-mesi Kanunu ve Ceza Kanununda bulunmaktadır. Ceza Muhakemesi Kanununun 253. maddesi ve Ceza Kanununun 73. maddesi, savcının veya hâkimin kararına bağlı olarak, bir ceza davasında mağdur-fail uzlaştırmasına ilişkin hükümler içermektedir. Sadece takibi şikâyete bağlı suçlar uzlaştırmaya uygundur. Kanımca, ADR Türk yargı sisteminde medenî hukuk, ticaret hukuku ve ceza hukuku uyuşmazlıklarının çözümünde temel bir işleve sahip olacaktır; zira, yargılama üzerinde çalışan veya dava yolunda büyük güçlüklerle karşılan avukatlar, ADR nin, hukuk davalarının tamamına teşmil edilmesini be-lemektedirler. Hukuk Muhakemeleri Kanunu hâlen, ADR nin kullanılması için gereken yetkiyi vermemektedir. Ancak, ADR yollarının hukuk davalarının tamamında kullanılması için, Hukuk Muhakemeleri Kanunda geniş bir yetki verilmesi gereklidir. Yakın bir gelecekte, özel hukukun bütün alanlarında ADR nin daha önemli ve merkezî bir rol oynayacağı açıktır. There is an essential distinction between conflicts and disputes, though the literature often uses the two terms interchangeably. Conflict is defined as a stole of opposition or hostilities a fight or struggle. A dispute may be viewed as a class or kind of conflict which manifests itself in distinct, justiciable issues. It involves disagreement over issues capable of resolution by negotiation, mediation or third party adjudication. A dispute is an interpersonal conflict that is communicated or manifested. A conflict may not become a dispute if it is not communicated to someone in the form of a perceived incompatibility or a contested claim. Alternative dispute resolution (ADR) represents a movement, away from formal adversarial proceedings on the part of the courts, toward informal processes. ADR can be seen as lying within the framework of the world-wide access-to-justice movement. The beginning of ADR is usually traced to the 1970s in the United States. In the federal district courts, the first mediation and arbitration programs date from the 1970s. Additional expansion of ADR occurred in 1988 when the United States congress authorized ten district courts to implement mandatory arbitration programs and an additional ten to establish voluntary arbitration programs. A major impetus for ADR s rapid growth was a 1976 American Bar Association sponsored National Conference on the Causes of Popular Dissatisfaction with the Administration of Justice. The Conference concluded that alternative forms of dispute resolution, in particular mediation and arbitration, would ease congested courts, reduce settlement time, and minimize costs. The development of neighborhood justice centers (which practice mediation) and multi-door courthouse programs were encouraged. The terms of multi-door courthouse or multi-option ADR describe courts that offer an array of dispute resolution options. These programs direct disputants to the most appropriate dispute-resolving mechanism: facilitation, mediation or arbitration. Some multi-door courthouses refer all cases of certain types to particular ADR programs, while others offer litigants a menu of options. ADR is defined as a range of procedures that serve as alternatives to litigation through the courts for the resolution of disputes, generally involving the intercession and assistance of a neutral and impartial third party. Accordingly in literature the benefits provided by ADR processes may include: 1. lower court caseloads and expenses, 2. reduce the parties? expenses and time, 3. provide speedy settlement of those disputes that were disruptive of the community or the lives of the parties? families, 4. improve public satisfaction with the justice system, 5. encourage resolutions that were suited to the parties? needs, 6. increase voluntary compliance with resolutions, 7. restore the influence of neighborhood and community values and the cohesiveness of communities, 8. provide accessible forums to people with disputes, and 9. teach the public to try more effective processes than violence or litigant for settling disputes. ADR involves many different techniques of bringing parties together, however the main ADR processes are negotiation and mediation. The terms mediation and conciliation are used synonymously. Mediation (or conciliation) is the non-binding intervention by a neutral third party who helps the disputants negotiate an agreement. These are traditional mediation, judicial mediation and modern mediation. The nature and role of the mediator is what distinguishes the process of mediation from other dispute resolution processes. The mediator is a facilitator. The mediator should not impose his or her own judgment of the issues upon that of the parties. Mediation is characterized by its flexibility, taking shape in a variety of models. Mediator approach may manifest in either directive or non directive fashion, or somewhere in between. There may be only one session or several. There may or may not be separate meetings, called caucuses, with the mediator. Mediation sessions are confidential and structured to help parties communicate. As mediations develops, distinct mediation strategies such as facilitative and evaluate are emerging. Regardless of which mediation model a court or mediator follows, most mediations progress through the following stages: Pre-mediation phase, the mediation proper and post-mediation phase. There are direct interested provisions about ADR in the Turkish law system such as Code of Lawyer, Code of Criminal Procedure, Code of Labor, Code of Consumer Protection, and Code of Tax Procedure. There are two main provisions on ADR in the Turkish Law. The first statutory provision that supports ADR is in the Code of Lawyer. According to the article 35/A of the Code of Lawyer if the client claims for conciliation, an attorney may invite the opposite sides to conciliation when the case or the trial is not commenced. If the parties reach an agreement at the end of the conciliation, the statue provides that the parties and the attorneys will execute a written agreement disposing of the dispute. The agreement called conciliation minute? signed by clients and their attorneys. Conciliation minute is enforceable in the same manner as any other final judgment. The second provision is in the new Code of Criminal Procedure and in the Penal Code which came into force on June 1, 2005. Article 253 of the Code of Criminal Procedure and article 73 of the Penal Code, contain provisions about victim-offender mediation in a criminal case, depend on a decision by the prosecution or the judge. Only offenses which can be prosecuted by the public prosecutor only upon complaint of the injured party are suitable for mediation. In my view, ADR will be recognized in Turkish judicial system as having a fundamental role to play in the resolution of civil, commercial and criminal disputes. Because lawyers who work on trials or those who encounter enormous difficulties in litigation expect the ADR to be extended to all civil cases. Nowadays, the Code of Civil Procedure does not provide necessary authority to use ADR. However, a broad authority for using ADR process in all civil actions must be given in the Code of Civil Procedure. It is clear that in all fields of civil dispute resolution ADR will play a central and rather important role in the near future.

The debts to foreign countries are decreased to 9.8 milliard dollars with precautions in 1994 and end of 1996.Financial balance are obtained again in the first months of 1995, reduced the inflation and also rate of interests to 72 percent.Rate of exchange (Leva/$) was 503 percent between Jan 1 and Feb 12,1997. Especially, that increasing was 20-percent/each day in Feb 1997.Rate of interest was 300 percent in Sep.1996. 14 Banks are bankrupted in that period. Bulgaria had been 1st of the world from inflation increasing speed of view.Inflation, devaluation, unemployment and also wages are on the lowest level in transition period in Bulgaria. Sivil Toplum, sivil toplum kuruluşları, Sivil toplum kuruluşlarının devlet içerisindeki yeri, demokrasi, devlet, devlet kurumları, emniyet teşkilatı, Polisin Sivil Toplum kuruluşlarına bakış açısı, özgürlükler, Avrupa birliği kavramları dünyanın olduğu gibi ülkemizin gündemini de uzun süre meşgul etmiştir. Küreselleşen dünyada devletler etkisini kaybetmekte, özgürlükler alanı genişlemektedir. Toplulukların devlet gibi düşünmediği veya devletin düşünmediği konularda bir araya gelerek organize oldukları, devletin boş bıraktığı alanlarda faaliyet gösterdikleri, devletin bazı yetkilerini kullandıklarını görmekteyiz. Ülkemizde sivil toplum kuruluşlarının gelişme dönemi 1980 yılından sonra olduğu görülmekle birlikte, topluma hizmeti görev kabul etmiş bir sivil toplum kuruluşu olan vakıfların kuruluş tarihinin asırlar öncesine dayandığını söyleyebiliriz. Türkiye'de 1995 yılında çeşitli Sivil Toplum Kuruluşları arasındaki ilişkilerin serbest bırakılması önemli bir karar olmakla birlikte 2004 yılında dernekler kanununda yapılan değişiklik ve emniyet teşkilatından bağımsız yapılanma imkânı tanınması, sivil toplum kuruluşlarının gelişmesi ve faaliyetlerinin çeşitliliğinin artması bakımından önemlidir. Bu çalışmamızda sivil toplum, sivil toplum kuruluşları ve bağlantılı terimlerin açıklanmasının yanında görevi sivil toplum kuruluşlarının faaliyetlerini yasalar çerçevesinde güvenli bir şekilde yapmasını sağlamak, yasa dışı söylem ve hareketleri yargıya intikal ettirmek olan Polisin sivil toplum kuruluşlarına bakışını ele alacağız. Emniyet Müdürlüğü bünyelerinde kuruluşu bulunan Güvenlik Şube Müdürlüğü Sivil Toplum Kuruluşları ile yasalardan kaynaklanan ilişkiler kurmak zorundadır. Aynı ilişki kurma zorunluluğu sivil toplum kuruluşları içinde geçerlidir. Polis ilişkilerini kurarken sivil toplum kuruluşlarını kategorize eder ve yasaların izin verdiği ölçüde görev niteliğine bakılarak iletişim içine girer. Bu iletişim ve ilişki sınırlı ve ölçülüdür. Bu çalışmamızda sivil toplum kuruluşları ile Polis ilişkisini incelerken ilgili yasaların neler olduğunu bu yasaların güncelliği ile birlikte eksiklerini, yasalardan kaynaklanan ilişki bozukluklarını inceleyeceğiz Sivil Toplum Kuruluşları demokrasi hayatı ve kültürü için ne kadar önemli olursa olsun faaliyetlerinin belli ölçüde sınırlandırılmasının gerektiği bunun demokrasinin gerekliliği olduğu ve demokrasi hayatının gelişmesinde Polisin davranışı ve yasaların özelliğinin ne kadar önemli olduğudur. Ülkemizdeki Sivil toplum kuruluşları ile Dünya'daki sivil toplum kuruluşları arasında büyük farklılıklar vardır. Bunun çok yönlü sebepleri olsa da demokrasi kültürünün tam anlamıyla yerleşmemiş olması en büyük sebeptir. Ankara Emniyet Müdürlüğü Güvenlik Şube Müdürlüğü bu eksikliğin farkında olarak hareket etmekte, sivil toplum kuruluşlarının faaliyetlerinde davranışları ve iletişimiyle örnek olmaya çalışmaktadır. Bu davranışlar başkente özel ve kişilere bağlı olsa da Türkiye'de uygulanması gereken davranış özelliğini kazanması açısından önemlidir. Çalışmamızda polis teşkilatının tamamının görüşünü yansıtmasa da resmi ve sivil çalışan polislere uyguladığımız ankette; Türkiye'de Polisin ilişki kurduğu sivil toplum kuruluşlarına nasıl baktığı, onları nasıl değerlendirdiği, faaliyetlerdeki tutumu yasaların sivil toplum kuruluşlarına tanıdığı özgürlükler polisin bu konudaki düşünceleri incelenmeye ve bir çerçeve çizilmeye çalışılmıştır. Sivil toplum kuruluşları denince polisin aklına ilk gelen düşüncenin sokaklarda eylem yapan, kaldırım taşlarını söküp kendisine taş atan öğrenci grupları, illegal söylemleri dile getiren, polis ile çatışmaktan çekinmeyen öğrenci platformları ve sendikalar gelir. İllegal örgütlere altyapı sağlayan dernekler, vakıflar, devlet değerlerini ve sistemini tanımayan, yazılı olarak kanuna uygun parti kabul edilen ama söylemlerinde devlete karşı tavır alan veya bölücü, irticai faaliyetleri bulunan siyasi partilerin de bulunduğunu unutmamak gerekir. Her Sivil toplum kuruluşu göründüğü kadar masum değildir. Bu masumiyet halkımız tarafından zamanla anlaşılmakta ve tepkisini yeri geldiğinde ortaya koymaktadır. Kuruluş amacı doğrultusunda hareket eden yasalara saygılı, dürüst, topluma hizmet eden Sivil Toplum Kuruluşlarının polis ile olan ilişkisi sadece evrak üzerinde kalmakta veya güvenlik talebi şeklinde kalmakta ve sorun yaşanmamaktadır. Türkiye'nin küreselleşen dünyanın saygın bir üyesi olabilmesi için, STK'larının çok sayıda, değişik türde ve ölçekte, yüksek potansiyeli, dünyaya açık, işlevlerini başarıyla yerine getirebilen, kendilerine güven duyulan bir biçimde gelişmesini sağlayabilmesi gerekir.Bu çalışma sonucunda elde edilecek verilerle demokrasi kültürüne katkı sağlayacağımızı düşünerek sivil toplum kuruluşlarının polis ile ilişkilerinin ne kadar önemli olduğunu, faaliyet istatistikleri ve Emniyet verileri kullanılarak açıklanmaya çalışılmaktadır. Bu ilişkilerin geliştirilmesinin demokrasinin gelişimi, demokrasi kültürünün topluma ve kurumlara hakim olması için şart olduğu değerlendirilmeleri yapılacaktır ; Civil Societies, Civil Society Institutions, place of the Civil Society Organizations within the State, democracy, state, state institutions, Police Organization, point of view of the Police organization Civil Societies, liberties, and European concept employed our country agenda as well of the world for a long time. States are loosing their effectiveness and widening liberties field in the globalize world. We begin to recognize that Civil Societies are performing their activities within the field?s state desolated and they are not thinking like the state. Progression period of the Civil Society?s Institutions in our country is after 1980?s. However, we can mention the history of the foundations that are accepted serving to society are based to centuries ago. While the important decision has been taking during the year 1995 on the release of relations between the various civil societies Institutions, changes made on the club law at 2004 it also important regarding to structuring independently from the police, given also self developing possibility to civil society organizations and in increasing variety of activities. In this study, we will undertake point of view of the police forces which are in obligation to provide to civil societies organizations to perform their activities safely within the legal frame work, beside to explain affiliated terms, civil society?s organizations and civil society . Security Department Directorate of the Police organization is obliged to establish relation with the Civil Society Organizations sourced from the laws. Same obligation is stand still for the Civil Society Organizations. Police, while establishing relation categorizes Civil Society organizations and enters in to the communication according to the nature of the duty and the laws are allowed. This communication is limited and moderate. In this study, while examining relation between the Police organization and Civil Society Organization, we will also study up to datedness these laws together with relation failures sourced from the law.Their activities necessary to be limited within the certain measures no matter how much important the Civil Society Organizations for democratic life and culture, and this limitation is also necessity of democracy and importance of the Police behavior and the characteristics of the laws. There is a large difference between Civil Society Organizations of our country and the Civil Society Organizations of the world. Notwithstanding multi-dimensional reasons, main reason is, democracy culture is not established in a proper sense. Ankara Directorate of Police, Security Department Directorate is acting well aware of this absence and runs to set a good example with his behavior and communication during the activities of the Civil Society Organizations. However, these behaviors in the Capital city, special and linked to the persons, it is important that behaviors gains necessary characteristics to apply in Turkey. In this study, even not reflecting the entire point of view of the Police Organization, we tried to draw an outline, on the police opinion and their evaluation on the liberty has been granted to the Civil Society Organizations the laws ad they are communicating with. We must not forget that when we speak about the Civil Society organizations, first thing considered by the police, are the students groups throwing pavement stones, students platforms with illegal pronunciations, syndicates not hesitating to clash with the police, clubs providing substructure to the illegal organizations, and the political parties considered legal according to laws, but not recognizing state values and system and with an attitude and pronunciations against the state in their speeches. Each Civil Society Organizations are that innocent as we are seen fro outside. However, this innocence understands by our public within the time and they betray their response in time. Relation of the Civil Society Organizations acting toward their constitutional aims, respecting laws, honest, and giving their services to the society with the police is only on the paper works such demand of security and posing no problems. For the Turkey becomes a respectful member of the global world, Civil Society organizations must provide progress in a manner of different kind and size, with his high potential and fulfill his functions with success within the trust. With the Data will be obtained at the result of this study, is trying to explain the importance of the relation between the police and Civil Society Organizations for to providecontribution to the democracy by using activity statistics together with security data?s. In this study evaluation on the progress of these relations which is a requirement for the progress of the democracy.
