National courts have become crucial participants of international law training. Judiciary regulations can contribute to the concretization of federal or contractual law, and sometimes function as promoter of international juridical-political concepts of private actors. In general, a kind of derived authority is granted to courts in offering supplementary jurisdiction. However, regarding international law and its training, correlation with the German federation should be calculated, since such connections with parliamentary legislation can, in principle, not be revised. Thus, foreign policy should be taken in consideration regarding federal courts and the independent interpretation and use of international law. Furthermore, political foundation in decision making is to be guaranteed, since federal governments can contribute in the setting of international law. References. O. van Zijl

Although IR scholars are increasingly focusing on the topic of international law, the interdisciplinary relations are, however, dominated by mutual misunderstanding. The phantasmagoria of unlimited political scope for social design stands vis-a-vis the legal utopianism arguing that only law is an appropriate means to realize the values of peace & humanity on the international level. Since the seminal works of E. H. Can & Hans J. Morgenthau on the one hand & Hans Kelsen & George Scelle on the other, IR as well as Legal Scholarship has regularly reproduced these dichotomies. In the course of a reformulation of the concepts of Volkerrechtspolitik (politics of international law & international law of politics) the article aims to transcend mono-dimensional observations of law & politics. The authors argue that an integration of actors of a global civil society into the concept of Volkerrechtspolitik opens up the chance to break with the conventional etatist dichotomies of dogmatic & political conceptions of law. According to the author of this article, two topics dominated the international news before the U.S. presidential election in 2004: 1) the U.N. Secretary General Annan's condemnation of the Iraq war as illegal, & 2) the Russian President Putin's decision to sign the Kyoto Protocol. To the author, both of these news items illustrate "American unilateralism.' In the former example, the U.S. evaded existing forms of international cooperation by attacking Iraq without a mandate from the U.N. Security Council. In the latter case, the U.S. opposed new forms of international cooperation when they refused to ratify the Kyoto Protocol. The article: 1) describes how to understand U.S. unilateralism; 2) examines the legal justification, & 3) critically assesses these both. The author contends that the U.S. argument [of basing unilateral action on the U.S. Constitution] cannot be justified. Handbuch Europäische Souveränität: zur inneren und äußeren Selbstbehauptung der Europäischen Union
Der Einzug des Souveränitätsbegriffs in Debatten um die geopolitische Behauptung und rechtliche Weiterentwicklung der Europäischen Union ist kein Zufall. In den Krisenlandschaften des 21. Jahrhunderts steht das Zuhöchstsein der Souveränität für Letztentscheidung, Selbstbestimmung, Gestaltungsmacht und legitime Autorität. Doch in welchem politischen und rechtlichen Umfang ist die Europäische Union heute - in ihrem Innenverhältnis zu den Mitgliedstaaten wie auch in ihren Außenbeziehungen - tatsächlich von Souveränität geprägt? Diese Frage nach der Souveränität der Union ist dabei stets auch die Frage nach ihrer (zukünftigen) inneren Struktur und Rolle in der internationalen Gemeinschaft. Elf Rechtswissenschaftlerinnen und -wissenschaftler leuchten die Orte und Bedeutungsebenen Europäischer Souveränität in ihren Grundlagen wie auch für zentrale Politikbereiche umfassend aus. Otto Depenheuer, who teaches public law in Germany, is rather influential among German conservative politicians, for example, the present minister of the interior. The article shows that the conceptual approach of the conservative Catholic Depenheuer depends nearly completely on the lessons taught by Carl Schmitt, who played a crucial role in the development of the Nazi's conception of law & state. Through the adoption of resolution 2005/35, the UN Commission on Human Rights has adopted a comprehensive scheme for reparation in instances of gross violations of international human rights law & serious violations of international humanitarian law. In a first part, the text deals with the civil consequences of such breaches, part two addresses the consequences under criminal law. The first part suffers from excessive generosity, going far beyond what is established under applicable customary law & culminating in a general programme for "good governance" as an expression of guarantees of non-repetition.
