In recent years in Latin America, the rights of lesbian, gay, bisexual and transgender (LGBT) people have received greater institutional attention, and legislative gains have been made across the continent. Using a typology of legal frameworks, this article explores trends, challenges and prospects for advancing efforts to address discrimination on the basis of sexual orientation in Latin America. It argues that deepening and adequately understanding LGBT rights and how they can be protected and promoted at multiple levels is an indispensable task for legal authorities, professionals and civil society. By proceeding in this direction, a fruitful dialogue can be established between law-making and jurisprudence, public policies, and civil society initiatives. This dynamic can help overcome an exclusionary and stigmatising culture in relation to LGBT, as well as resistance to freedom of sexual expression. (IDS Bull/GIGA)

In pluralist societies, corporate religious freedom might conflict with other fundamental rights. Corporate piety might collide with LGBT rights, notably when a company?s management does not accept, either as employees or clients, individuals whom it believes to have ?sinful? sexual orientations. Should African and Muslim-majority countries be obliged to protect LGBT rights or do such rights violate their cultures? Should Western-based corporations be held liable if their security guards injure union activists in another part of the world, or should such decisions be settled under local or domestic law? In this passionately argued book renowned human rights scholar Rhoda E. Howard-Hassmann vigorously defends the universality of human rights, arguing that the entire range of rights is necessary for all individuals everywhere regardless of sex, colour, ethnicity, sexuality or religion. Above all, she defends civil and political rights, such as the rights not to be tortured and the rights to vote, which are often so taken for granted as to be entirely neglected. Howard-Hassmann grounds her defense of universality in her conception of human dignity, which she maintains must include personal autonomy, equality, respect, recognition, and material security.
