At the beginning of the investigative process there were concepts and perceptions, that although they were far from objective reality, they were not substantial reality. The direct contact with people who belong to LGBTI really overcame what at the beginning could be validated just in some specific social areas, this without leaving aside the main shaft which consistedof public policy for LGBTI people It is clear that the effectiveness of legal norms is constantly fragmented in practice, because of multiple factors that influence the objective social reality. The effectiveness of public policies to protect LGBTI people are not an exception. In the course of research activity, it is permanently observed that the purpose of the state aimed at achieving the protection and participation of all inhabitants of the Colombian state is not factually a concrete reality and instead it goes on the contrary way of its recipients, who are constantly permeated by a number of dynamics that prevent an effective approach to this type of regulations that lead to the protection and visibility standards in contrast with other subjects of society. Therefore, it is proposed a handy tool called community responsability. If this tool is used, it shall ensure LGBTI as concrete materialization of their true interests as a community. ; Al inicio del proceso investigativo se tenían conceptos y percepciones que pese a no estar alejados de la realidad objetiva, sí carecían de contenido sustancial; el contacto directo con las personas pertenecientes a la población LGBTI realmente logró traspasar todo aquello que, en principio, sólo era posible validar sumariamente en relación a diferentes ámbitos sociales concretos. Es claro, que la eficacia de las normas jurídicas se ve continuamente fragmentada en la praxis a causa de múltiples factores que condicionan la realidad social objetiva; la eficacia de las políticas públicas de protección a las personas LGBTI no son la excepción. En el trans- curso de la actividad investigativa se observó de forma permanente en que los fines del estado orientados a lograr la protección y participación de todos los habitantes, no se concreta en la realidad fáctica y por el contrario, avanzan por caminos distintos y paralelos a los que recorren sus destinatarios, los cuales se ven constantemente permeados por un sin número de dinámicas que les impide un acercamiento efectivo a este tipo de normatividad, que como consecuencia, los conduzca a estándares de protección y visibilización aptos, en contraste con otros sujetos de la sociedad. Por lo anterior, se formula una herramienta práctica denominada responsabilidad comunitaria, que de ser utilizada, será determinante para la población verdaderos intereses como comunidad.

In this article, I use the current struggle over recognition of rights for same-sex couples in Italy as a window on larger policymaking processes. Associazione Radicale Certi Diritti is leading the charge for the recognition of rights for same-sex couples in Italy with its innovative national campaign Affermazione Civile that seeks to obtain marriage equality for same-sex couples in Italy through the deployment of judicial initiatives. Through the Affermazione Civile project, Italian LGBTI rights activists successfully circumvent national politics and advance recognition of same-sex couples' rights in Italy. I argue that recent policy changes with respect to the treatment of this group are direct products of the EU's influence on the national judicial system and demonstrate a continuing trend towards increased judicial activism at the expense of national politics. This article illustrates how the EU influences the making of national public policy outside the economic realm in unanticipated and unintended ways.

This study takes its point of departure in human rights, equality and personal freedom, including support for the rights of LGBTI persons. Its intention is to combine these principles with respect for African communities, cultures, and the fortitude with which Africans face many challenges. Human rights law demands that people be protected against human rights violations committed by private actors. The Human Rights Based Approach to Development (HRBA) looks at the potential of non-state actors as partners. In contexts where many public services are delivered by non-state actors, many areas of family and private law are governed by customary or religious institutions and norms, and where the outreach of the state is limited, examining the roles of non-state actors takes on a particular urgency. Thus, this study devotes as much or more attention to structures and norms based in religion and society as in the state. In practice, these various norm sets are very often mixed together with one another. Some may argue that African societies are not yet ready to take on the challenges of a debate on issues such as sexual orientation and gender identity. There are many responses to this. Most obviously, African societies are taking on this challenge, either on their own account or as a consequence of living in our globalized world. African LGBTI persons and activists, like those in other parts of the world, are not waiting for a date in the future to start challenging prejudice. Neither are their opponents. All sectors of society, including media, politics, religion and the education and health sectors are increasingly addressing these issues. Representatives of all of these sectors testify to the public's thirst for knowledge, as well as for a firm moral foundation on which communities can live together. African societies and the deeply human values they embody contain resources to face challenges, including in this sensitive domain.

Includes bibliographical references ; The interests of this thesis lie in the way in which solidarities are imagined within the South African feminist movement, one which is deeply conscious of the intersectional nature of gender and of the politics of sexuality as part and parcel of any analysis of social justice concerns. Theoretically informed by the work of Castells, Hassim, and other theorists exploring the dynamics of 'movement building,' the thesis focuses upon the discourses of solidarity used within one particular feminist organisation as it imagines new alliances. The organisation (Sonke Gender Justice Network) concentrates on the work of transforming violent hegemonic masculinities and plans to develop programmes working with new partners whose work focuses on justice and the lives of transgendered, lesbian, gay, and intersex people and communities ('LGBTI'). The research draws on qualitative data drawn from interviews with Sonke staff and on the researcher's own experience as an intern within the organisation, and analyses the material in order to explore the shape and implications of discourses on new alliances. The conclusions of the thesis speak to the complexities of imagining solidarity across differences of theory, identity, and experience.
