Glavni je problem priopćenja vanjska politika Republike Hrvatske (RH) u vezi s Ustavom BiH jer nedovoljno pridonosi rješavanju društvenih, političkih, ekonomskih, kulturnih itd. slabosti Bosne i Hercegovine (BiH) koje mogu i trebaju biti rješavane unutar prava. Ta je politika nedovoljno uspješna jer nije državna, nego strančarska. Matica politike je narodnjačka, tj. etnička. Alternativa zanemaruje činjenicu da je RH, kao stranka Daytonskoga mirovnog sporazuma, čiji je dio Ustav BiH, internacionalnim pravom ovlaštena zahtijevati od drugih stranaka, uključujući BiH, da poštuju i primijene Sporazum. Sporedni je problem priopćenja nedostatna znanstvena spoznaja glavnog problema. Posljedica je pomanjkanja interesa pravnih znanstvenika u RH i previda pravnih slabosti politike. Temeljna je svrha priopćenja priprema istraživačkog projekta unutar integralne pravne znanosti dopunjene izvornom pravnom dogmatikom i prilagođenom pravnopolitičkom analizom. Hipoteze, koje su dijelom ispitane, pripisuju politiku uvjetima te predviđaju razvoj problema ako se politika ne promijeni i ako se prromijeni u skladu s prijedlogom izloženim u priopćenju. ; The paper deals with the main problem of the Republic of Croatia's foreign policy on the Constitution of Bosnia and Herzegovina, which fails to alleviate the social (political, economic, cultural, etc.) inadequacies of Bosnia and Herzegovina that can and ought to be solved within the limits of the law. It is of meagre success because it is a policy of political parties rather than of a nation-state. The mainstream policy is ethnicist. Its alternative ignores the fact that the Republic of Croatia, as a party to the Dayton Peace Agreement, whose part is the Constitution of Bosnia and Herzegovina, is by international law entitled to demand other parties, including Bosnia and Herzegovina, to observe and change the Agreement. The subordinate problem is a paucity of knowledge provided by legal scholars in the Republic of Croatia about the main problem. The knowledge deficit is a consequence of the lack of interest in the policy and oversight of its legal ramifications. The principal goal of the paper is the preparation of a research-project within integral legal scholarship supplemented by original legal dogmatics and adjusted policy analysis. The principal hypotheses are that the past policy can be ascribed to Croatian institutions (legalistic order, ethnic state, parochial studies) and their environment (dependence on foreign powers, pre-political and pre-legal conditions of the Croatian population); and that the same policy, even in a stable environment, should be expected to facilitate threats to the very existence of Bosnia and Hercegovina and Bosnian Croats, thus greatly endangering the Republic of Croatia. On the assumption that the environment, as well as the institutions and doctrines improve, the paper proposes a state policy as an alternative to past partisanship, with a view of re-instituting Bosnia and Hercegovina as a functional nation-state, establishing local and cultural autonomy, and retaining the constitution-making power of each major ethnic community in Bosnia and Hercegovina. The expected consequences are the strengthening of Bosnia and Hercegovina, Bosnian Croats, and the Republic of Croatia, in line with the values and principles of the inquiry.
U tekstu se rastvara pojam "dekonstrukcije" administrativne države u SAD-u kao njen reprezentativni primjer. Polazeći od dominacije moderne administrativne države, puna slika suvremenog konstitucionalizma u SAD-u mora uključivati administrativni konstitucionalizam kao svekoliko razumijevanje i interpretaciju suvremene administrativne države i njene strukture od strane agencija i drugih aktivnih aktera upravnoga prava. Administrativni konstitucionalizam danas je jedan od najintenzivnije izučavanih predmeta istraživanja komparativnog ustavnog i upravnog prava. Razlog egzegeze ovoga pitanja nisu samo njegove različite dimenzije već i činjenica da on predstavlja glavni mehanizam kojim se danas elaborira i implementira ustavno značenje. ; This paper opens up the concept of "deconstruction "of administrative states in the USA as its representative example. Starting from the domination of a modern administrative state, the full picture of modern constitutionalism in the USA must include administrative constitutionalism as overall understanding and interpretation of a modern administrative state and its structure by agencies and other active participants in administrative law. Administrative constitutionalism is today one of the most intensively studied subjects of investigation of comparative constitutional and administrative law. The reason for exegesis of this issue is not only its various dimensions but also the fact that it represents the main mechanism which today elaborates and implements constitutional meaning.
Kao rezultat izbora 2005. Pravo i pravda (PIS) postaje dominantna stranka u poljskom parlamentu s dominantnom braćom Kaczyński na čelu. Od 2007. do 2015. je oporbena politička sila, a onda 2015. uvjerljivom većinom i u donjem i u gornjem domu parlamenta opet dolazi na vlast. PiS je radikalna stranka desne orijentacije ili desnog centra. Zbog svojih je radikalnih stavova često spominjan kao uzrok slabijeg razvoja Poljske i njenog slabog međunarodnog položaja. U radu se konzervativna vlast te stranke prikazuje s obzirom na neovisnost rada sudova, slobodu medija i zaštitu ljudskih prava i sloboda. Status zaštite ljudskih prava i stupanj demokracije utjecao je na odnos EU prema Poljskoj, a nacionalizam PiS-a na odnos Poljske prema EU, Rusiji, Njemačkoj i ukupnoj međunarodnoj zajednici. ; As a result of the 2005 election, the Law and Justice party (abbreviated as PiS in Polish for Prawo i Sprawiedliwość) became the dominant party in the Polish parliament under the leadership of the Kaczyński brothers, Lech and Jaroslaw. From 2007 to 2015, PiS was a force in its role as the political opposition. It came to power again in 2015 after winning persuasive majorities in the Lower and Upper Houses. PiS is a radical party of right or center-right orientation. Because of its radical positions, it often is mentioned as a cause of Poland's weaker national development and international status. This work discusses the party's conservative government with regard to the relationship between legislative and judicial authorities, freedom of the media, and the protection of human rights. Poland's state of human rights protection and its degree of democracy has influenced its relationship with the EU. PiS's nationalism also has had an impact on Poland's relations with the EU, Russia, Germany, and the larger international community.
With the publication of the work "Potential GNP: its measurement and significance" (Okun, 1962), the concept of Okun's law became an important part of global macroeconomic issues. The empirically determined connection between the national product and unemployment, which is manifested through Okun's law, belongs to a fundamental part of economic empiricism. Gross domestic product and unemployment are among the main macroeconomic variables that reflect the movement of a country's economy. The countries we observe in this paper went through a transition period in the 1990s, namely a period of great economic, institutional and economic changes. Precisely because of these changes, we are interested in comparing the Slovak and Croatian economies and testing Okun's law. The aim of this paper is to show whether Okun's law is valid for Croatia and Slovakia, or whether there is a correlation between the observed variables for these countries. The final purpose of the paper is to show whether there are similarities between the two observed economies when it comes to Okun's law. We will show this similarity based on the analysis of data for the period from 2000 to 2018 using vector autoregression. The results of the research have been presented at the end of the paper and they are related to the implications of economic policy in the sphere of the labour market that directly affect economic growth and development. ; Objavom djela "Potential GNP: its measurement and significance" (Okun, 1962) koncept Okunova zakona postaje važan dio globalne makroekonomske problematike. Empirijski utvrđena povezanost nacionalnog proizvoda i nezaposlenosti koja se očituje kroz Okunov zakon temeljnim dijelom pripada ekonomskoj empiriji. Bruto domaći proizvod i nezaposlenost su među glavnim makroekonomskim varijablama koje prikazuju kretanje gospodarstva jedne zemlje. Zemlje koje promatramo u ovome radu su 90-ih godina prošlog stoljeća prošle kroz tranzicijsko razdoblje odnosno razdoblje velikih gospodarskih, institucionalnih i gospodarskih promjena. Upravo zbog tih promjena zanimljiva nam je usporedba slovačkoga i hrvatskoga gospodarstva te testiranje Okunova zakona. Cilj ovoga rada je prikazati vrijedi li Okunov zakon za Hrvatsku i Slovačku, odnosno postoji li međusobna povezanost promatranih varijabli za te zemlje. Svrha rada je prikazati postoje li sličnosti između dva promatrana gospodarstva kada je u pitanju Okunov zakon. Ta sličnost će se prikazati na temelju analize podataka za razdoblje od 2000. do 2018. godine primjenom vektorske autoregresije. Na kraju rada prikazani su rezultati istraživanja te su povezani s implikacijama ekonomske politike u sferi tržišta rada koje izravno utječu na ekonomski rast i razvoj.
Ovaj rad se sastoji od pet poglavlja. U prvom poglavlju rad se bavi pregledom pojma neutralnosti, povijesnog razvoja instituta trajne neutralnosti, glavnih razlika između privremene i trajne neutralnosti te modusa osnivanja trajne neutralnosti na međunarodnom polju. U drugom poglavlju rada analiziraju se prava i dužnosti neutralnih država uz poseban naglasak na postojanje distinkcije između onih prava i dužnosti koje se odnose kako na trajno neutralne tako i na privremeno neutralne države te onih koji vrijede isključivo za trajno neutralne države. Fokus trećeg poglavlja sastoji se u obradi pitanja članstva u međunarodnim organizacijama, naročito analize problematike glede članstva trajno neutralnih država u organizacijama s ustrojenim sustavima kolektivne sigurnosti. U ovom poglavlju daje se pregled različitih reakcija i stajališta koje su pojedine trajno neutralne države zauzimale prilikom odlučivanja o pristupanju pojedinim međunarodnim organizacijama te se daje osvrt na njihov današnji položaj unutar međunarodne zajednice. Četvrto poglavlje prvenstveno se bavi Švicarskom, Austrijom i Maltom kao primjerima trajno neutralnih država. U ovom poglavlju analizira se povijesni kontekst stjecanja svojstva trajne neutralnosti, njegov razvoj, specifičnosti te prava i obveze koje vežu ove tri države. Konačno, u posljednjem petom poglavlju daje se osvrt na ulogu trajno neutralnih država u očuvanju mira i stabilnosti u međunarodnoj zajednici uslijed sve kompliciranijih odnosa između subjekata međunarodnog prava. ; This thesis consist of of five chapters. Autorica u radu daje pregled i analizu kaznenog zakonodavstva Republike Hrvatske u vezi s kriminalnim djelatnostima krijumčarenja ljudi i trgovanja ljudima. Upućuje na sličnosti i razlike između kaznenih djela protuzakonitog prebacivanja osoba preko državne granice odnosno protuzakonitog ulaženja, kretanja i boravka u RH, drugoj državi članici EU-a ili potpisnici Šengenskog sporazuma i trgovanja ljudima, uspoređujući i analizirajući pravne norme starog i novog Kaznenog zakona Republike Hrvatske, međunarodne dokumente te sudsku praksu. Ističe se nužnost što ranijeg prepoznavanja počinjenog kaznenog djela, naročito s aspekta žrtve. Skreće se pozornost na neujednačenost sudske prakse u pogledu pitanja koristoljublja kao bitnog elementa kaznenog djela, ali isto tako i na nepostojanje jasno definiranog pokušaja pri počinjenju kaznenog djela protuzakonitog ulaženja, kretanja i boravka u RH, drugoj državi članici EU-a ili potpisnici Šengenskog sporazuma. U radu se istražuje i analizira postojeće stanje u vezi s nezakonitim prelascima državne granice Republike Hrvatske na temelju dostupnih statističkih podataka. Učinjena je i analiza stanja de lege lata u sudskoj praksi u odnosu na prijavljene, optužene i osuđene osobe za krijumčarenje ljudi te, isto tako, posebno za trgovanje ljudima. Zaključno se daju prijedlozi i mjere de lege ferenda koje je nužno provesti u cilju suzbijanja krijumčarenja ljudi i trgovanja ljudima te što uspješnije borbe s ovom vrstom organiziranog kriminala. ; The author of the paper provides an overview and analysis of Croatian criminal legislation with regard to criminal activities of human smuggling and trafficking. She points out to the similarities and differences between the criminal acts of illegal transfer of persons across the state border or illegal entering, movement and residence in the Republic of Croatia, other EU Member States or signatories of the Schengen Agreement and human trafficking, comparing and analyzing the legal norms of the old and the new Criminal Code of the Republic of Croatia, international instruments and jurisprudence. Emphasized is the importance of early recognition of the criminal act, especially for the victims. Attention is drawn to the disparity of case law on matters of personal gain as an essential element of this criminal activity, but also to the absence of clearly defining the act of attempting illegal entering, movement and residence in the Republic of Croatia, other EU Member States or signatories of the Schengen Agreement. This paper investigates and analyzes the current situation regarding illegal crossing of state borders of the Republic of Croatia on the basis of available statistical data. Conducted was the analysis of the situation de lege lata in case law in relation to persons registered, accused and convicted of human smuggling and, also, especially for human trafficking. In conclusion, given are the proposals and measures de lege ferenda that need to be implemented in order to combat human smuggling and trafficking, and to successfully fight this type of organized crime.
This paper presents the results obtained in an investigation of the role of heritage in current education regulations as a vehicle for the formation of citizens. The analysis was conducted on the Spanish state education regulations and their implementation in the Autonomous Region of Andalusia corresponding to the stages of pre-primary and primary education. A qualitative, descriptive-interpretative method was used. It was based on document analyses. To this end, a system of categories was prepared, organized into subcategories, variables and descriptors. From the results, there stands out the need to continue working on incorporating heritage into the formation of global citizens. For this, it is essential to build an integrated curriculum structured on the basis of "relevant socio-environmental problems". ; U ovom se radu prikazuju rezultati istraživanja o ulozi kulturne baštine u obrazovanju građana u sklopu aktualnoga obrazovnog zakonodavstva. Provedena je analiza državnih obrazovnih propisa u Španjolskoj i njihove provedbe u Autonomnoj zajednici Andaluziji, u predprimarnom i primarnom obrazovanju. Korištena je kvalitativna, deskriptivno-interpretativna metoda, a istraživanje je temeljeno na analizi dokumenata. U skladu s tim, pripremljen je niz kategorija podijeljenih u podkategorije, varijable i deskriptore. U rezultatima se ističe potreba nastavka rada na uključivanju kulturne baštine u globalno građansko obrazovanje, za što je neophodno izraditi integrirani kurikul koji se temelji na "relevantnim socio-ekološkim problemima".
Cilj je ovoga rada raščlaniti razloge koji ukazuju na potrebu donošenja kodificiranih pravila upravnoga postupka u pravu Unije te ocijeniti kvalitetu predloženih rješenja. U ovome radu najprije se nastoji odgovoriti na pitanje postoji li u Europskoj uniji potreba za kodificiranjem pravila upravnoga postupka. To se čini analizom nekih njezinih propisa, ali i stajališta iznesenih u znanstvenoj i stručnoj literaturi. Ukazuje se na dosadašnje "kodifikacijske neuspjehe" te se kratko prikazuje geneza donošenja i danas aktualnoga prijedloga Uredbe o otvorenoj, učinkovitoj i neovisnoj upravi Europske unije. Zatim se analiziraju ciljevi ovoga prijedloga propisa i u njemu sadržana rješenja. Ona se uspoređuju s aktualnim rješenjima sadržanima u hrvatskom pravnom sustavu i pravnim sustavima nekih država članica Unije, kako bi se utvrdilo hoće li eventualno usvajanje predložene uredbe u praksi zahtijevati značajnije odstupanje u radu institucija, tijela, ureda i agencija Unije od pravila vođenja upravnoga postupka uvriježenih u nacionalnim pravnim sustavima država članica. Time se ukazuje na neke prednosti, ali i nedostatke predloženoga teksta. Konačno, zaključuje se hoće li Unija eventualnom predloženom "kodifikacijom" stvoriti nove pravne režime ili će se zadovoljiti zakonskim utvrđenjem već postojećih pravila u okviru jednoga propisa. ; The aim of this paper is to analyse reasons pointing out the need to codify the rules for administrative procedure in EU law and to assess the quality of suggested solutions. Firstly, an attempt is made to answer the question of whether the European Union needs to codify rules of administrative procedure. This is done by analysing some of its regulations as well as the views purported in scientific and professional literature. RIJEČ UREDNIŠTVAZa tematiku i aktualnost ove rubrike Šumarskoga lista očito nije potrebno brinuti. Naime, svako malo mediji nam prenose vijesti o novim nesporazumima pa i sukobima šumarske struke i amaterskih udruga, koje si umišljaju da sve znaju o šumarstvu. Interesantno, primjerice u kirurgiju se ne petljaju! Tako ovih dana u Glasu Istre čitamo: Nastavlja se fajt oko Motovunske šume – Tartufari uzvraćaju udarac: Hrvatske šume ponašaju se kao feudalac! Šire o tome pisat ćemo na temelju egzaktnih podataka u jednoj od rubrika sljedećeg dvobroja Šumarskoga lista. Ovdje ćemo komentirati Zakon i ulogu Hrvatskih šuma d.o.o.Feudalizam je oblik društvenog odnosa koji je prevladavao u srednjem i dijelu novoga vijeka, ukinut 1848. godine, a feudalac je vlasnik zemljišta za kojega drugi rade. Da li su Hrvatske šume d.o.o. vlasnik zemljišta-šume i da li odgovaraju tome kriteriju? Za odgovor na ovo pitanje pozivamo se ponajprije na zakon, u ovome slučaju Zakon o šumama, koji u članku 2. (1) kaže: Šume i šumska zemljišta dobra su od interesa za Republiku Hrvatsku te imaju njezinu osobnu zaštitu, a u istom članku (3) Vlada Republike Hrvatske upravlja šumama i šumskim zemljištem u interesu Republike Hrvatske, prema u daljnjem tekstu navedenim načelima. Članak 3. (1) navodi: Šume i šumska zemljišta specifično su šumsko bogatstvo te s općekorisnim i gospodarskim funkcijama šuma uvjetuju poseban način planiranja, gospodarenja i korištenja na načelu održivog gospodarenja šumama. (2) Održivo gospodarenje šumama znači korištenje šuma i šumskog zemljišta na način, i u mjeri, koja održava njihovu bioraznolikost, produktivnost, kapacitet za regeneraciju, vitalnost i potencijal da trenutačno i ubuduće ispune odgovarajuće ekološke, gospodarske i društvene funkcije na lokalnoj, nacionalnoj i globalnoj razini te koja ne uzrokuje štetu drugim ekosustavima. Po tome načelu potrajnosti, hrvatskim šumama šumarska struka gospodari već više od 250 godina. Uz gospodarske funkcije šuma (proizvodnju drvnih sortimenata, proizvodnju šumskog reprodukcijskog materijala i proizvodnju nedrvnih šumskih proizvoda), treba imati na umu da ona osigurava i njene općekorisne funkcije navedene u članku 4. (1) do (9). Dakle, u gospodarenju s tim najsloženijim ekosustavom nema mjesta amaterizmu i interesnim skupinama! Žalosno je i nelogično, ali istinito, da je politika koja treba strogo zagovarati Zakon, češćesklonija njima nego struci. Imajući u vidu prethodno rečeno o šumi kao specifičnom šumskom bogatstvu, logično je da operativno njima može upravljati i gospodariti specifična pravna osoba koja posjeduje potrebnu infrastrukturu, opremu i posebice visoko stručne kadrove. Kada je riječ o visokostručnim kadrovima opetovano ističemo, kako se još u 19. stoljeću odlučilo da šumama trebaju upravljati i gospodariti fakultetski obrazovani stručnjaci, pa ističemo da je i šumarska fakultetska nastava u Hrvatskoj uspostavljena već 20. listopada 1898. godine. Stoga je logično da upravljanje i gospodarenje šumama Vlada Republike Hrvatske povjerava javnom šumoposjedniku Hrvatske šume d.o.o. čiji je osnivač. Članak 44. (1) propisuje: Javni šumoposjednik i Ustanova (kada se radi o zaštićenim šumama) dužni su osigurati zaštitu šuma i šumskih zemljišta u vlasništvu Republike Hrvatske od protupravnog prisvajanja, korištenja i drugih protupravnih radnji te provoditi šumski red. Iz svega je razvidno da je sve zakonom propisano i da su Hrvatske šume d. o. o. provoditelj Zakona o šumama, a nikako feudalac. No, kada raspravljamo o stanju u našoj Državi, počevši od društvenih odnosa, gospodarstva, pa sve do prevelikog uvoza "svega i svačega", svima su "puna usta" Pravne države, naravno samo kada to njima ide u prilog, a briga ih za opći interes.Uredništvo ; EDITORIALWe should never be concerned about the themes and topicality of this column of Forestry Journal. Every now and then the media reports on the latest misunderstandings and even conflicts between the forestry profession and amateur associations which imagine that they know everything about forestry. Interestingly, they never meddle in surgery, for example. The Voice of Istria recently wrote: The battle of the Motovun Forest continues - Truffle hunting people strike back: The company Croatian Forests Ltd behaves like a feudal lord! This topic will be dealt with more extensively on the basis of exact data in one of the columns of the next double issue of Forestry Journal.Feudalism is a form of social system that prevailed in the Middle and part of the New Age and was abolished in 1848. A feudal lord was a land owner who had other people working for him. Is the company Croatian Forests Ltd the owner of the land - forest and does it match these criteria? To answer these questions we should first consult the law, in this case the Forest Law. Article 2 (1) of the said Law states: Forests and forest land are natural goods of interest to the Republic of Croatia and enjoy its particular protection. In the same article (3) it is stated that the Government of the Republic of Croatia manages forests and forest land in the interest of the Republic of Croatia according to the principles listed further on. Article 3 (1) states: Forests and forest land constitute specific forest wealth and together with non-market and market forest functions dictate a particular manner of planning, management and usage according to the principles of sustainable forest management. (2) Sustainable management of forests means using forests and forest land in the manner and to the extent to which it maintains its biodiversity, productivity, regeneration capacity, vitality and potential to, now and in the future, fulfil the relevant ecological, economic and social functions locally, nationally and globally without inflicting harm to other ecosystems. The Croatian forestry profession has applied the principle of sustainability to Croatian forests for over 250 years. In addition to commercial forest functions (production of wood assortments, production of forest reproductive material and production of non-wood forest products), we should bear in mind that it also ensures its non-market functions listed in article 4 (1) to (9). Therefore, management of this most complex ecosystem excludes amateurism and interest groups! Sadly and illogically, but true, politics which should strictly enforce the Law, is more often inclined to them than to the profession. In view of what was said above about the forest as specific forest wealth, it is logical that it should operatively be managed by a specific legal entity which has the necessary infrastructure, equipment and highly skilled personnel in particular. As for highly skilled personnel, we repeatedly point out that it was decided no later than 19th century that forests should be managed by academically educated experts. Furthermore, the university forestry education in Croatia was established as early as 20th October 1898. It is logical, therefore, that the Government of the Republic of Croatia entrusted the company Croatian Forests Ltd, a public forest owner which it founded, with forest planning and management. Article 44 (1) states: The public forest owner and Institution (in case of protected forests) are obliged by law to ensure the protection of forests and forest land owned by the Republic of Croatia from unlawful appropriation, use and other illegal activities, as well as enforce the forest order. Clearly, everything is regulated by law: hence, the company Croatian Forests Ltd is the law enforcer and by no means a feudal lord. Yet, when we discuss the situation in our State, starting from social relations, economy and excessive import of "anything and everything", we all swear by the legal State, but only when it is in our favour, while public interest is of no concern whatsoever.Editorial Board
Students enter the labour market through a Student Service to have the opportunity to pay for tuition fees or to earn additional income that would allow for the parents or guardian's budget to be disbursed. Although almost 70% of full-time students were working through a student contract in 2016, the Regulation on intermediaries for employment of full-time students from 1996 was the only legal document that was regulating student employment. Due to improperness of this document and the fact that student employment is not under the Labour Law, in November 2017 the Croatian Government published a proposal for the new Student Employment Act, which was passed in November 2018. Subsequently, the reform of regulatory framework of student employment is important to student work force. According to the Regulation in force, there is no constraint on the maximum weekly working hours or maximum annual earnings. Nevertheless, student income can become taxable under the rules of Personal Income Tax Law if it exceeds the annual limit of 60,600.00 HRK. Consequently, the reform of personal income tax is also significant for students if they do not want to become a taxpayer of personal income tax. Based on this, the main goal of this paper is to analyse attitudes of students towards the regulatory framework of student employment, reform of personal income tax and their work under the mediation of the Student Centre. In order to question student attitudes, the questionnaire was used and the results of the analysis carried out before changes in legislation, in February and March 2018, indicate that students were not satisfied with the existing regulatory framework and the personal income tax reform, and that they expect the improvement of working conditions with the implementation of the new Student Employment Act. ; Studenti se uključuju na tržište rada preko studentskog servisa kako bi imali priliku platiti školarinu ili zaraditi dodatne prihode s ciljem financijskog rasterećenja roditelja ili staratelja. Iako je gotovo 70% redovnih studenata radilo preko studentskog ugovora u 2016. godini, jedini pravni dokument koji je regulirao zapošljavanje studenata je bio Pravilnik o posredovanju pri zapošljavanju redovitih studenata iz 1996. godine. Zbog neprimjerenosti ovog dokumenta i činjenice da zapošljavanje studenata nije regulirano Zakonom o radu, u studenome 2017. godine Vlada Republike Hrvatske objavila je prijedlog novog Zakona o obavljanju studentskih poslova, koji je izglasan u studenom 2018. godine. Zbog toga, reforma regulatornog okvira zapošljavanja studenata važna je za studentsku radnu snagu. Prema važećem Pravilniku, ne postoji ograničenje maksimalnog tjednog radnog vremena ili maksimalne godišnje zarade. Unatoč tome, dohodak studenata može postati oporeziv prema pravilima Zakona o porezu na dohodak, ako premašuje godišnju granicu od 60.600,00 kuna. Slijedom toga, reforma poreza na dohodak je također značajna za studente ako ne žele postati poreznim obveznikom poreza na dohodak. Na temelju toga, glavni je cilj ovoga rada analizirati stavove studenata prema regulatornom okviru zapošljavanja studenata, reformi poreza na dohodak i njihov rad pod posredovanjem Studentskog centra. Kako bi se ispitali stavovi učenika, korišten je upitnik, a rezultati analize provedeni prije izmjene zakonodavnog okvira, u veljači i ožujku 2018. godine, pokazuju da studenti nisu zadovoljni postojećim regulatornim okvirom i reformom poreza na dohodak, te da očekuju poboljšanje radnih uvjeta stupanjem na snagu novog Zakona o obavljanju studentskih poslova.
Right of access to a court, enshrined in Article 6 § 1 of the European Convention on Human Rights and Fundamental Freedoms forms one of the basis for reinforcement of the principle of rule of law. However, the right of access to a court may be limited by provisions of national legislation regulating the functioning of the judicial system and rules of judicial procedure. The higher the hierarchy of the court, the more limits may be placed on the right of access to it. Opisuje se oblikovanje sustava informacijskog zakonodavstva u kojem je novi Zakon o tajnosti podataka četvrti dio, pored Zakona o pravu na pristup informacijama, Zakona o zaštiti osobnih podataka i Zakon o medijima. Naglašavaju se temeljne novine, kao i pitanje prevođenja stupnjeva tajnosti prema prethodnim propisima u one prema novom Zakonu. Razmatraju se određene dileme u provedbi novog Zakona, od kojih su neke povezane s kaznenim pravom, a neke s pravom na pristup informacijama javnog sektora. Zanimljivi su postupovni problemi u vezi s testom razmjernosti. Autor upozorava na neusklađenost propisa, nedostatne nadzorne kapacitete, mogućnosti zloporabe propisa o tajnosti podataka, te na potrebu terminološkog i drugog preciziranja pravnih propisa. ; Design of the system of information legislation is described. The new Law on Data Confidentiality is the fourth part of this system, along with the Law on the Access to Public Sector Information, Law on Personal Data Protection, and Media Act. Basic novelties in the Law are stressed, such as the issue of transitional regulation about levels of confidentiality. There are a few dilemmas with regard to implementation of the new Law. Some of them are connected with criminal law, and some with the issue of access to public sector information. An interesting procedural problem is connected with the test of proportionality. The author warns about the gaps in legal regulation, lack of control capacity, possibilities of misusing legal regulation on data confidentiality, and the necessity of terminological and other clarifications in legal regulation.
Članak prikazuje recentne studije o novcu kao pravnom fenomenu, putem čijeg kreiranja različiti "stakeholderi" uređuju raspodjelu resursa i odnose između pojedinih dijelova društva. U ovoj koncepciji novac formira tržište, a ne obratno. Na primjeru "slobodnog kovanja" karakterističnog za Englesku od 12. do 14. stoljeća analizira se dilema nominalizam – metalizam, te tri ograničenja robnog novca u kojima se očituje Greshamov zakon, odnosno kontroverza likvidnosti. U članku se ne analizira na koje proturječnosti nailazi nominalistička politika novca. Pokazuje se da se ni u suvremenoj koncepciji robnog novca, eksplicitnoj u Hayekovoj studiji The Denationalization of Money, zbog proturječja likvidnosti ne može – u kreiranju i održanju novčanog sustava – izbjeći uloga društvenih, izvantržišnih faktora, uz ostalo i prava. Kako mnogi autori zaključuju da je i zajednička europska valuta koncipirana po uzoru na zlatni standard (robni novac), slijedi da i uspjeh njezina dizajna i funkcioniranja ne može biti prepušten samo tržišnom mehanizmu, nego ovisi o društvenoj, političkoj i pravnoj potpori. ; The paper describes money as a legal phenomenon, which means that stakeholders use money to allocate resources and manage social relations. In this understanding money creates markets and not vice versa. The system of money creation called free minting, which was common in England from the 12th to the 14th century, is described. Three constraints of commodity money are explained and the nominalism – metalism dilemma is analysed. The focus of the analysis is on Gresham's law and the problem of liquidity of commodity money. The similarity between medieval commodity money and a modern concept of commodity money in the book The Denationalization of Money by Friedrich von Hayek is shown. The conclusion is that the market mechanism cannot solve the problem of liquidity without social agents not included in the market exchange. Since the common European currency is to some degree similar to the gold standard, the same conclusion works for the euro.
