The American stingless bees species have been used in management and breeding practices by local civilizations since the pre-Columbian era. Currently, many of these species are managed commercially and maintained in meliponaries. However, divergences exist among authors about the ecological utility of these practices. Some argue that meliponaries could serve to maintain local biodiversity while others argue that they have the opposite effect. Due to pressure from beekeepers and environmentalists there are efforts to draft specific rules that legislate production and market focusing on conservating native bees. In recent years, these norms have become more specific due to the use of empirical data from the scientific community and demands from social groups and producers. This paper presents a revision on Brazilian legislation as well its applicabilities and proposes alterations in the Environmental Crimes Law. ; As espécies de abelhas produtoras de mel e própolis nativas do continente americano têm sido usadas em práticas de manejo e reprodução por civilizações locais desde tempos pré-colombianos. Atualmente, muitas dessas espécies são manejadas comercialmente e mantidas em meliponários. No entanto, existem, na literatura, divergências sobre a utilidade ecológica dessas práticas. Alguns autores argumentam que os meliponários são fontes de manutenção da biodiversidade local, enquanto outros argumentam que eles têm o efeito oposto. Devido à pressão dos meliponicultores e ambientalistas, há esforços para elaborar regras específicas que legislem a produção e o mercado, focando na conservação das abelhas nativas. Nos últimos anos, essas normas tornaram-se mais específicas devido ao uso de dados empíricos da comunidade científica, e buscam atender a demanda dos grupos sociais e produtores. Este artigo propõe uma revisão da legislação brasileira, bem como sua aplicabilidade, e propõem alterações na Lei de Crimes Ambientais.

This article analyzes the use of water as ballast to balance the vessels, as well as the existing legislation in the country that protects, monitors and punishes those who are responsible for illegal shedding in national jurisdiction waters. That is important, considering ballast water has become a national and international risk with serious consequences such as bioinvasion. It was discovered that ballast water has become one of the fastest forms of marine pollution because it acts quietly. In an attempt to avoid environmental and economic losses, several conventions and international treaties were agreed between countries such as the United Nations Convention on the Law of the Sea, 1982, adopted in Montego Bay. At the national level, Brazil has important institutions for marine environmental protection such as ANVISA, the National Health Surveillance Agency; ANTAQ, National Agency of Waterborne Transport and broad legislation such as Law (6938/81), the National Environmental Policy; the Criminal Environmental Law (9.605/98) and, specifically, NORMAM 20, issued by the Brazilian Navy's Directorate of Ports and Coasts, which states that every ship to moor at national ports must prove the exchange of ballast water at sea. The research used the legal and theoretical methodology, deductive reasoning and literature from technical and government sites. The results show that Brazil has a concern over the issue and the national legislation proves the effort to prevent marine pollution. After the Lisbon Summit of 2009, the whole matter of fundamental rights in the European Union has taken a new connotation. Local economic interests and social protests – in opposition to the "neoliberal agenda" of EU institutions – have played an important role in stopping the enforcement of the "Constitutional Treaty" and boosted an anti-Euro mobilization. In the meanwhile, the European bodies and transnational corporations have continued to settle a new and alternative basis for the integration. A radical shift can be observed, from the research of synthetic set of principles – as those established on the EU Charter of Fundamental Rights – to a deeply technical and detailed normative production. The regulation on safety and healthy workplaces is one of the best point of view to study this change. Far from calling into question the unbalanced positions between the parties in contemporary labour relationships, the European strategy for workers' protection move through procedural issues and voluntary obedience to the soft law instruments. In the past, the legal doctrine described the creation of a multilevel architecture of institutions, sometimes implemented in a top-down approach. Along with this, recently, it was implemented the establishment of common organizational standards associated to a specific system of corporate governance to pursue a better integration between business and fundamental rights. ; Após o Summit de Lisboa de 2009, toda a questão dos direitos fundamentais na União Europeia tomou uma nova conotação. Os interesses econômicos locais e os protestos sociais – em oposição a "agenda neoliberal" promovida pelas instituições europeias – têm desempenhado um papel importante em parar a execução do "Tratado Constitucional" e impulsionaram uma mobilização anti-Euro. No enquanto isso, os organismos europeus e as empresas transnacionais instalaram uma base nova e alternativa para a integração. Uma mudança radical pode ser observada, a partir da pesquisa de um conjunto (ainda) sintético de princípios – como os estabelecidos na Carta dos Direitos Fundamentais da União Europeia – para uma produção normativa profundamente técnica e detalhada. A regulação da segurança no lugar de trabalho é um dos melhores pontos de observação para estudar a transformação mencionada. Longe de pôr em causa as posições desequilibradas entre as partes nas relações de trabalho contemporâneas, a estratégia europeia para a proteção da saúde dos trabalhadores prefere as questões procedimentais e a adesão voluntária aos instrumentos de soft law. No passado, a doutrina jurídica descrevia a criação de uma arquitetura multi-nível de instituições, as vezes implementada por meio de uma abordagem de cima para baixo (top-down approach). Junto com isso, recentemente, teve a implementação de padrões organizacionais comuns para a criação de um sistema específico de governança corporativa, finalizado a buscar uma melhor integração entre os negócios e os direitos fundamentais.

The Underwater Cultural Heritage is a kind of heritage that is little studied and, for that reason, protection to Underwater Cultural Heritage is yet one of the greatest novelties of the present times. There was no standard to regulate it at the international level by 2001. In turn, at a domestic level, the legislation of the Spanish State fails to have a law to protect it in a specific way, except for Law 16/1985 dated June 25 and issued by the Spanish Historic Heritage - LPHE, which includes it within the archeological heritage.The present legal paper addresses the legislation in force in the Spanish State on Underwater Cultural Heritage, with special attention given to Law 16/1985 dated June 25 of the Spanish Historic Heritage.

ABSTRACT Objective: to analyze the knowledge of nurses on the management of nursing and health services, of a hospital located in Rio das Ostras, Rio de Janeiro. Method: descriptive and exploratory study with a qualitative approach. The research subjects will be nurses from a hospital located in Rio das Ostras, Rio de Janeiro. The data will be collected in 2013, through semi-structured interviews and submitted to the categorization process. The research project was submitted to the CEP/UFF, with CAAE No. 12724513.4.0000.5243. Expected results: this research will make it possible to know the areas of management and law, related to nursing and health services, that nurses have more doubts or ignorance. Countless benefits are attributed to whole grain foods, especially due to the concentration of dietary fiber in these products. It is widely known that whole grain cookies are part of the consumers' diet, that food labeling is the primary means of communication between producers and consumers, and that a relevant legislation for this class of food is required. Thus, the present study aimed to verify whether nutrition claims and/or terms displayed on the labels of whole grain cookies are in compliance with the applicable labeling legislation, and also to ascertain consumer's perception on these claims as well as their preference for and consumption of these products. The study was carried out in three supermarkets in the city of Videira-SC, split into two stages: label analysis through a checklist and administration of a questionnaire to consumers. Results showed non-compliances, especially the use of terms not foreseen by the law, which could mislead consumers. Regarding the perception of consumers, they mostly believe that a product may contain at least 50% of whole grains to be called a whole grain food, and associate them with health benefits. It is necessary to develop and promote nutrition education actions as well as constitutional rigidity and compliance with the applicable legislation, and new and relevant technical standards for whole grain foods in order to improve requirements for this class of food. ; Inúmeros benefícios são atribuídos aos alimentos integrais, especialmente pela concentração de fibras nesses produtos. Sabe-se que biscoitos integrais compõem a dieta dos consumidores, sendo a rotulagem o principal meio de comunicação entre indústria produtora e consumidores, e que não existe legislação específica para essa categoria de alimentos. Assim, este trabalho objetivou verificar se as informações e/ou discursos nutricionais presentes nos rótulos de biscoitos integrais estão de acordo com a legislação geral de rotulagem, e também averiguar a percepção dos consumidores frente às alegações, bem como sua preferência e consumo desses produtos. O estudo foi realizado em três supermercados da cidade de Videira-SC e contemplou duas etapas: análise de rótulos por meio de check-list e aplicação de questionário com consumidores. Os resultados evidenciaram inadequações, destacando-se a utilização de informações não previstas em lei, que podem induzir o consumidor a erros. Quanto à percepção dos consumidores, estes majoritariamente acreditam que para um alimento ser considerado integral, deve conter no mínimo 50% dessa fonte de ingrediente, e os associam a benefícios à saúde. Verifica-se a necessidade de desenvolver ações que promovam educação nutricional, bem como rigidez, cumprimento das leis vigentes e novos planejamentos de normas técnicas específicas para alimentos integrais, a fim de estabelecer critérios quanto à determinação desse grupo de alimentos.

OBJETIVO: Caracterizar o perfil dos farmacêuticos responsáveis técnicos em drogarias e avaliar o conhecimento sobre alguns aspectos da legislação que rege o funcionamento de drogarias e da profissão. MÉTODOS: Com base em 175 drogarias de Ribeirão Preto, Estado de São Paulo, foram selecionados, por meio de sorteio aleatório, 100 farmacêuticos responsáveis técnicos. A coleta de dados foi feita por meio de entrevista face a face, orientada por um questionário que avaliava conhecimentos e atitudes. O dados foram processados e analisados utilizando-se Epi Info e Stata e houve busca de associações entre variáveis dependentes e independentes, usando o teste do qui-quadrado de Pearson e o teste exato de Fisher. RESULTADOS: A maioria dos farmacêuticos eram mulheres (64%), entre 22 e 29 anos (47%), formadas há cerca de três anos, com habilitação na área industrial (36%) ou em análises clínicas (29%). O conhecimento dos farmacêuticos sobre a legislação sanitária foi avaliado como insuficiente para 28% deles, regular para 50% e bom para 22%. Observou-se baixo conhecimento sobre a exigência legal da permanência de farmacêuticos nas drogarias durante todo o horário de funcionamento, suas atribuições, venda de antibióticos e aplicação de penicilina. Constatou-se que a maioria tem dificuldades com a conceituação de medicamentos genéricos e similares. O baixo nível de conhecimento não se associou com nenhuma variável independente, mostrando que está generalizado, ou seja, presente entre farmacêuticos de várias faixas etárias, de ambos os sexos, independente do tempo de formado e instituição formadora, modalidade de formação entre outros. CONCLUSÕES: Concluiu-se que a formação na área de atenção farmacêutica de medicamentos, durante a graduação e, sobretudo, o estágio em farmácia e drogaria está deficiente. Faz-se necessária a divulgação de informações sobre a legislação sanitária para o pleno exercício da profissão, sem ameaças penais ou prejuízo da população. ; OBJECTIVE: To characterize the profile of pharmacists employed as technical supervisors in drugstores and evaluate their knowledge regarding certain aspects of the legislation controlling drugstores and the profession in general. METHODS: Based on 175 drugstores in the city of Ribeirão Preto, southeastern Brazil, 100 pharmacists/technical supervisors were randomly selected. Data collection was done by means of in-person interviews, and was guided by a questionnaire evaluating knowledge and attitudes. Data were processed and analyzed using Epi Info and Stata software. Associations were sought between dependent and independent variables using Pearson's chi-squared and Fisher's exact tests. RESULTS: Most pharmacists were women (64%), aged 22-29 years (47%), graduated approximately three years prior to data collection, trained to work in the pharmaceutical industry (36%) or in clinical analysis (29%). Pharmacist's knowledge of sanitary legislation was considered as insufficient for 28% of subjects, regular for 50%, and good for 22%. Low levels of knowledge were observed regarding the legal requirement for the presence of a pharmacist during the entire drugstore opening hours, pharmacists' attributions, sale of antibiotics, and penicillin administration. It was found that most professionals have difficulties handling the concepts of 'generic' and 'similar' drugs. Low level of knowledge was not associated with any of the independent variables, indicating that this is a generalized phenomenon, i.e., one present among pharmacists of all age groups and both sexes, irrespective of the time since graduation, institution attended, and modality of graduation, among others. CONCLUSIONS: We conclude that training in the field of drug pharmaceutical care, during undergraduate studies and, especially, during traineeship in pharmacies and drugstores is deficient. It is necessary to divulge information concerning sanitary legislation so that pharmacists may fully exert their profession, without risk of legal threats or hazard to the population.

This work analyzes the Agenda 2030 in its main potentiality to lead public policies and private actions towards a more sustainable path. At the same time it acknowledges its dependency on measurements and finance mechanisms for the Sustainable Development Goals implementation. The main argument is that public expectations face difficulties to be translated in public actions, due to, among other factors, the lack of measurement and finance mechanisms. With this purpose it starts describing what is the Agenda 2030, and how this United Nations lead international declaration is structured to be monitored and implemented by States and others multi stakeholders. Secondly it analyses the importance of the measurements to address critical social environmental challenges and to allow comparison between the achievements of each member state. Third it remarks the role-played by international financial institutions, by international investment and by the private sector in general. Forth, the article highlights the drawbacks the methodology of goals can represent when used to overcome collective challenges marked by moral issues and diffuse impacts, being highly dependent on measurements and finance tools. The methodology chosen was the descriptive and normative, the techniques used were documentary, legislative and bibliographic research.

This is a documentary research that researched the legislation and recommendations published from June 1978 to December 2015, by consultation of digital documents of the Ministry of Labor and Employment, Ministry of Health/National Agency of Sanitary Vigilance and "riscobiologico.org". There were 37 rules and laws, of which 25 published by the Ministry of Health, 10 by the Ministry of Labor and Employment and two by the Chief of Staff. The analyzed documents cover the various areas of health services and have specific provisions into their scope for worker's protection. The evolution of legislation and recommendations show important contributions to the protection of workers' health and has added new determinations from scientific and technological advances, subsidized by epidemiological information. ; Estudo objetivou identificar e analisar as recomendações e as legislações brasileiras relacionadas ao risco biológico entre trabalhadores da área da saúde. Pesquisa documental, com busca às legislações e recomendações publicadas a partir de junho de 1978 até dezembro de 2015, mediante consulta aos documentos digitais do Ministério do Trabalho e Emprego, do Ministério da Saúde/Agência Nacional de Vigilância Sanitária e "riscobiologico.org". Foram encontradas 37 normas e legislações, sendo 25 publicadas pelo Ministério da Saúde, 10 pelo Ministério do Trabalho e Emprego e duas pelo Gabinete da Casa Civil. Os documentos analisados abrangem as diversas áreas dos serviços de saúde e trazem em seu escopo determinações específicas para a proteção do trabalhador. Conclui-se que a evolução das legislações e recomendações mostra contribuições importantes para a proteção da saúde do trabalhador e, tem agregado novas determinações advindas dos avanços científicos e tecnológicos, subsidiados pelas informações epidemiológicas.

The objective of this study was to evaluate the physicochemical and microbiological mineral water parameters in the city of Macapá and verify their compliance with the legislation. The accepted legal standards for potable water for human consumption in Brazil are established by Board Resolution - RDC 274/2005 of the National Health Surveillance Agency (ANVISA) - which regulates mineral water and Ordinance 518/2004 of the Ministry of Health which defines minimum standards for drinking water. Water samples in 20 L bottles of three different trademarks acquired in six commercial localities were analyzed monthly. Physicochemical parameters were compared with those predicted in the legislation for turbidity, pH, nitrate, iron, manganese, aluminum, fluoride, and microbiological indicators such as total coliform and Escherichia coli. The results indicated that the pH was often below the limit allowed by public supply. Deviation from the recommended concentration was most exceeded for aluminum, presenting values significantly high to the standards allowed in two trademarks. Fluoride concentrations were close to zero, although the legislation recommends values between 1 mg/L and 2 mg/L. The microbiological parameters in some localities and all trademarks registered total coliform, but Escherichia coli were present in only one sample. The mineral water consumed has been considered a safe product compared to other sources, but this study showed that the mineral water marketed in Macapá was often not in accordance with the law. Special attention is recommended for monitoring water quality in 20 L bottles. ; O objetivo deste estudo foi avaliar parâmetros físico-químicos e microbiológicos da água mineral comercializada na cidade de Macapá e verificar sua conformidade com a legislação. Os padrões legais aceitos para potabilidade de água para consumo humano no Brasil são estabelecidos pela Resolução Diretória Colegiada – RDC 274/2005 da Agência Nacional de Vigilância Sanitária (ANVISA) - que regulamenta as águas minerais e a Portaria 518/2004 do Ministério da Saúde, que estabelece a potabilidade para o abastecimento público. As análises mensais foram feitas em amostras de água em garrafões de 20 L de três marcas diferentes adquiridas em seis locais comerciais. Parâmetros físico-químicos foram comparados com os descritos pela legislação como turbidez, pH, nitrato, ferro, manganês, alumínio e fluoreto, e os microbiológicos como coliformes totais e Escherichia coli. Os resultados indicaram que o pH encontra-se frequentemente abaixo do limite permitido ao abastecimento público. A elevada concentração de alumínio foi considerada grave, com valores significativamente acima dos padrões permitidos em duas marcas. O flúor apresentou concentrações próximas de zero, apesar da legislação sugerir valores entre 1 mg/L e 2 mg/L. Os parâmetros microbiológicos em todas as marcas apresentaram coliformes totais, mas Escherichia coli foi registrado em apenas uma amostra. This article aims to study the changes brought by Federal Law 13,655/18 to the Law of Introduction to the Rules of Brazilian Law - LINDB from the perspective of the control of the Public Administration. We intend to analyze the new provisions added to the original legal diploma and its implications regarding the control of the activities performed by the Public Administration entities. One of the most relevant changes concerns the necessary assessment of the consequences of decisions taken by the public control bodies, the assessment related to the efficiency concerning the Public Administration activities, the greater role played by social participation, and, therefore, a more democratic scenario. On this basis, consensuality also acquires greater relevance. The analysis took place here starts from a historical retrospective of the control of Public Administration in Brazilian Law. Secondly, the different forms of control of the Public Administration are analyzed, and then the new concepts brought by the LINDB, as it was altered in the year 2018, are analyzed. ; O presente artigo tem por escopo o estudo das alterações trazidas pela Lei Federal 13.655/18 à Lei de Introdução às Normas do Direito Brasileiro – LINDB, sob a perspectiva do controle da Administração Pública. Nesse esteio serão apreciados os novos dispositivos acrescidos ao diploma legal original e suas consequências no que toca o controle das atividades da Administração Pública. Nota-se que uma das mais relevantes alterações diz respeito à necessária apreciação das consequências das decisões a serem adotadas pelos órgãos de controle, a percepção de eficiência na ação administrativa, além da maior participação social e viés democrático. Nessa égide, a consensualidade também adquire relevância. A análise do tema partirá de um retrospecto histórico do controle da Administração Pública no Direito Brasileiro, passando pelas formas de controle da Administração Pública, para então analisarmos e discutirmos os novos conceitos inseridos na LINDB no ano de 2018.

The problem to be addressed in this article is related to the precautionary principle and its incorporation into the Brazilian law. As it is beknown, this principle has been widely cited by Brazilian case law and it is an important part of the legal and environmental scholarly production. However, it follows that its application has been made fairly randomly, and even so there is no clear and operational definition of its content. The hypothesis being examined is that since the Rio Declaration's - in its translation into Portuguese - environmental legislation has termed as legal principle, which internationally is an approach, a precautionary measure, as can be seen in both the texts in English and French of the Rio Declaration and other relevant legal instruments. The methodology to be used is the research of the case law and relevant legal rules, as well as the examination of the scholarly production on the subject. As a result, the conclusion is that there is an overuse of the precautionary principle by the Brazilian courts, especially by the Superior Court of Justice and that, in this case, the Federal Supreme Court has played a moderating role in relation to the application of the precautionary principle.
