Small Medium Entreprises (SMEs) and Cooperative have not received a proper law protection in facing trade liberation of ASEAN Economic Community (AEC) and economic globalized world. In 2015 AEC has been established that would bring a huge change in Southeast Asia regionS and definitely will have a wide impact to business people in Indonesia. SMEs and Cooperative contribute to more than 90 percent of total Indonesian national economy. However, they are weak on investment and information technology and management skill as well as competition law among ASEAN Member States. Economic policies do not give a sufficient protection to SMEs and Cooperative. This article tries to seek solutions for SMEs problems especially their legal structure in order to enhance their competitiveness. This article argues that the government can provide legal protection by reforming SMEs economic sectors similar to the AEC's priority sectors by which the Indonesian' SMEs would become world class corporate.
The reforms carried out in 1990, which included the reactivation of local self-government, constituted one of the most important elements of the systemic transformation in our country. They were also an important element of the reform measures undertaken to implement the three main goals of the political transformation after 1989: democracy, the free market and decentralization. The postulate of restoring local self-government was included in the Solidarity programme in 1981, and it was the subject of renewed focus during the Round Table talks in 1989. Among the supporters and propagators of this idea in the anti-communist opposition were representatives of the study of administrative law, who envisioned the creation of a completely new institution that would not be indebted to the communist regime. It was therefore assumed that the old system of local authorities had been rejected. The self-government reform carried out in 1990 was at the same time a powerful shock to the study of systemic administrative law, which lost its subject of research, namely the issues of national councils, which from then on were treated only in the context of 'negative experiences'. The reactivation of the local self-government in 1990 was accompanied by discussions and disputes on the concept of its essence, basic political assumptions and detailed rules of functioning. However, the reform did not come to an end in 1990, as local government law is characterized by a significant dynamic of changes concerning specific solutions, which is reflected in numerous amendments to local government laws. Subsequent reforms were accompanied by the activities of experts in the field of administrative law. At the same time, one should note significant development in the study of administrative law with regard to the consideration of local self-government issues. ; Przeprowadzone w 1990 r. reformy obejmujące reaktywowanie samorządu terytorialnego stanowiły jeden z najważniejszych elementów przemian ustrojowych w naszym kraju i były one istotnym elementem działań reformatorskich w ramach realizacji trzech głównych celów transformacji ustrojowej po roku 1989: demokracja, wolny rynek, decentralizacja. Postulat przywrócenia samorządu terytorialnego znalazł się w 1981 r. w programie Solidarności i powrócono do niego podczas obrad Okrągłego Stołu w 1989. Wśród zwolenników i propagatorów tej idei w opozycji antykomunistycznej byli przedstawiciele nauki prawa administracyjnego, którzy przewidywali stworzenie całkowicie nowej instytucji, niemieszczącej się w ramach ustroju komunistycznego. Zakładano zatem jednoznaczne odrzucenie starego systemu władz lokalnych. Przeprowadzona w 1990 r. reforma samorządowa stanowiła jednocześnie potężny wstrząs dla nauki ustrojowego prawa administracyjnego, które utraciło swój przedmiot badań w postaci problematyki rad narodowych, traktowanych odtąd wyłącznie w kontekście "negatywnych doświadczeń". Reaktywowaniu samorządu terytorialnego w 1990 r. towarzyszyły dyskusje i spory wokół koncepcji jego istoty, podstawowych założeń ustrojowych i szczegółowych zasad funkcjonowania. Reforma nie zakończyła się w 1990 r., gdyż prawo samorządowe charakteryzuje się znaczną dynamiką przemian dotyczących konkretnych rozwiązań, co znajduje swój wyraz w licznych nowelizacjach ustaw samorządowych. Kolejnym reformom towarzyszyła działalność ekspertów z zakresu nauki prawa administracyjnego. Jednocześnie odnotować należy znaczny rozwój nauki prawa administracyjnego w zakresie problematyki samorządowej.

The aim of the study is to present the challenges facing the Ukrainian administrative judiciary and to formulate postulates aimed at improving its functioning. The article discusses the problem of the reform of the system of the protection of personal data in the context of changes, new tasks and challenges faced by the European data protection authorities, in particular the European Data Protection Supervisor, Article 29 Working Group or the national supervisory authorities. The proposals of regulations and directives submitted in recent years by the European Commission related to data protection in general, as well as the specific rules governing the functioning of the EU agencies involved in the fight against crime clearly show that the proposed changes are intended to increase the role of these bodies at both the E. U. and the national level by ensuring a more effective implementation of the new rules. The planned strengthening of the relationship between the national authorities as well as the coordination of their activities also aims to meet this objective.
Judicial control of the administration in Serbia has along tradition of over 150years. Initially, this control was exercised by the Council of State, organized according to French models. After World War II, all forms of administrative judiciary were abolished and reinstated as early as 1952, when the competence to resolve administrative disputes was entrusted to common courts, which adjudicated these cases in special chambers. The last phase of the development of administrative judiciary began anew with the creation of specialized judiciary, namely with the establishment of an administrative court in 2010. This court is no longer part of the administration, as it was before World War II, but part of the judicial system. Judicial control of administration is based on the constitutionally guaranteed right to afair trial. This means that the administrative court decides within areasonable time on the basis of the law and facts established in the course of apublic hearing, and its judgment may be delivered in limited jurisdiction (resulting in acassation judgment) or full jurisdiction (where the court itself decides the case). This phase of the development of judicial control of the administration is not finished, however, as the administrative judiciary in Serbia has asingle-stage structure, and therefore administrative court proceedings are always one-instance. In 2009, following the election of Barack Obama to the Presidency of the United States, the American public entered into a fierce debate on how to reform its health care system. The intense debate on health care reform, however, is not a new phenomenon in American political life. Debate over health care has cycled its way into the American political discourse every twenty-years or so. History suggests that forceful opposition has prevailed against most major efforts to alter the health system in the United States. Yet, once again the Democratically-controlled Congress and Presidency in the United States aspire to break this cycle of history. With both houses in Congress passing a bill with significant reforms, it seems that this time may be different. While it is very likely some reforms will pass in 2010, no law has been signed yet56. In the end, only time will dictate the outcome of this round of health reform debates. Through a thorough literature review, this article provides the Polish reader a sense of health care reform efforts in the U.S. from the historical perspective and discusses the current proposed reforms. Particular attention is paid to the evolution of the American health insurance system, failed efforts of past health reform initiatives, their contrast with today's efforts, and current health and economic indicators that could lead to reform in 2010.
This paper attempts to present a review of higher education reform processes in Poland in 1990-2015 and 2016-2018 (when a draft of the so‑called Act 2.0 was prepared) and an assessment of the domestic "art of reforms". As the author has adopted the perspective of the public policy science, she focuses on issues of public policy making, i.e. the development and strategic programming policy, drafting legislation, and accompanying public consultations. Furthermore, the paper discusses three past and one current attempt to reform higher education in the context of the political economy of reforms that are globally perceived as a benchmark. The long, nearly 30‑year period covered by the paper's analyses allowed the author to draw conclusions with regard to the evolution of higher education policy, highlighting the problem of its quality (standards) as a public policy.

Oznacza to, że sąd administracyjny orzeka w rozsądnym terminie na podstawie prawa i faktów ustalonych w toku publicznej rozprawy, a jego wyrok może zostać wydany w ramach jurysdykcji ograniczonej (czego skutkiem jest wyrok kasacyjny) lub jurysdykcji pełnej (w ramach której sąd sam rozstrzyga w sprawie). Ta faza rozwoju sądowej kontroli administracji nie jest jednak zakończona, bowiem sądownictwo administracyjne w Serbii ma jednostopniową strukturę, a w związku z tym postępowanie sądowoadministracyjne jest zawsze jednoinstancyjne. Rodzi to potrzebę dalszych reform, mających na celu wprowadzenie dwuinstancyjności sądownictwa administracyjnego oraz zwiększenie jego efektywności.
The study is the result of a legal comparative analysis of the directions of reforms in the administrative judiciary in the countries of young democracy: Poland, the Czech Republic, Lithuania, Croatia, Serbia, Hungary, Ukraine, Georgia and Kazakhstan. Papers on reforms of the administrative judiciary in each of these countries were delivered at the international scientific conference: Reforms of administrative judiciary in the countries of young democracy (10–11.06.2021, Faculty of Law and Administration, University of Lodz). They focused on three issues: 1) contemporary challenges of the rule of law and administrative judiciary, 2) directions of changes in the national systems of administrative judiciary, 3) the future of administrative judiciary. The content of the study refers to this system of issues, which reflects the stages of development of administrative judiciary in the countries of young democracy. Zasadniczym celem artykułu jest przybliżenie prób reformy systemu wyborczego do Rady Najwyższej Ukrainy podejmowanych w okresie przypadającym po Euromajdanie. Analizie zostały poddane rozwiązania prawne zawarte w zarejestrowanych i poddanych pod głosowanie w parlamencie projektach ordynacji wyborczych. Przybliżono także stanowisko poszczególnych sił politycznych wobec potrzeby reformy systemu wyborczego, na co pozwoliła analiza programów wyborczych, zapisów umowy koalicyjnej zawartej w RN VIII kadencji, jak również wyników głosowania nad poszczególnymi projektami ustaw w parlamencie. Ponadto uwaga została skupiona na wynikach badań opinii publicznej, pozwalających ukazać, który z wariantów systemu wyborczego jest najbardziej pożądany przez ukraińskie społeczeństwo. ; The main aim of the article is to present the attempts to reform the electoral system for the Supreme Council of Ukraine in the period after Euromaidan. Additionally, analysis of the results of public opinion polls made it possible to determine the electoral systems most desired by the Ukrainian public.
Zasadniczym celem artykułu jest przybliżenie prób reformy systemu wyborczego do Rady Najwyższej Ukrainy podejmowanych w okresie przypadającym po Euromajdanie. Analizie zostały poddane rozwiązania prawne zawarte w zarejestrowanych i poddanych pod głosowanie w parlamencie projektach ordynacji wyborczych. Przybliżono także stanowisko poszczególnych sił politycznych wobec potrzeby reformy systemu wyborczego, na co pozwoliła analiza programów wyborczych, zapisów umowy koalicyjnej zawartej w RN VIII kadencji, jak również wyników głosowania nad poszczególnymi projektami ustaw w parlamencie.
