İkinci Dünya Savaşından sonra uluslararası hukukta meydana gelen en önemli gelişme, devletler arası İlişkilerin kurumsallaştırılmasını sağlayan uluslararası örgütlerin ortaya çıkmasıdır. İşlevselliği ve geniş kapsamlı faaliyetalanı ile Birleşmiş Milletler, kendisinden sonraki örgütlenmelerin öncüsü olmuştur. Uluslararası kurumsallaşmanın önemli bir parçası olarak Güvenlik Konseyi, bütünüyle eksiksiz bir kurum olmasa da,Birleşmiş Milletlerin kurumları arasında öne çıkmıştır. Güvenlik Konseyi Demir Perde yıkılıncaya kadar çok aztartışma konusu olmuştur. Ancak, uluslararası toplumun devlet dışı aktörler gibi yeni ve zor tanımlanır hadiselerle karşı karşıya kalarak farklı bir evreye geçmesi ve Güvenlik Konseyi'nin, kural koyucu bir kimliğe bürünerek söz konusu hadiselere karşı aktif tutum takınması, egemen devletlerin işbirliğini kolaylaştırmak için kurdukları sistemin, onların aleyhine bir yöne yönelmesi nedeniyle reform taleplerine konu olmaya başlamıştır. Böylece siyasetçilerin kullandığı bir mekanizma olarak hukuk, ulusal ve uluslararası düzeyde, yeniden çok zor bir görev üstlenmek zorunda bırakılmıştır. ; One of the most Umportant changes in Unternational law order since WW II has taken place with in the area of institutionalization of states' relationship that has given rise to Unternational organizations. Characterising subsequent ones in their own activity of fields, the United Nation (UN) has become the leader of the subsequent Institutions by establishing a functional and far reaching system for maintaining the international peace and security. As one of the key Unstitution of international institutionalization, the Security Council has stand out with the role which has designed in the Charter, one may claim that it has not been thoroughlydone. The Security Council has rarely been a topic on agenda of Unternational community until the end of theperiod of the Iron Curtain. Together wUth the transformation of Unternational communUty by confronting newchallenges, such as non-state actor phenomenon, that have moved Unternational community into a dixerentstage of impetus on the one hand, and the Security Council's active deployment over the new challenges, as if it was a law maker on the other, the cooperatUon system established sovereign state turns into them that callsurgent reform especially for the Security Council. One more time the law as a machinery of politicians in bothnational and international level is invited for a conundrum.

WOS: 000461078400001 ; Citizenship education was influenced by fundamental changes that happened following the end of the Cold War in 1989. Traditional citizenship education aiming to build a monolithic national identity, disseminate an image of homogeneous society and transmit the knowledge of political system has evolved towards modern citizenship education characterised by an emphasis on human rights, democracy, the rule of law, respect for diversity and a concern to develop students' political participation skills. The transition to modern citizenship education in Turkey started with the pushing of international educational projects and is still underway. Drawing on critical discourse analysis, this study explores what kind of citizenship education the 2018 Social Studies Courses Programme of Study envisages. The study found that the new programme intensely reflects the characteristics of traditional citizenship education. Taking into account this study's findings might lead to more effective implementation of the programme and increase the success of future curriculum reforms.
İlk toplumların oluşmasından günümüze kadar değişen şekillerde hep var olan sosyal güvenlik, 19. yüzyılda toplumların sanayi toplumlarına dönüşmeye başlaması ile birlikte zorunlu bir kavram olarak karşımıza çıkmıştır. Ancak, II. Dünya Savaşı'ndan sonra bir insan hakkı olarak uluslararası ve ulusal belgelerde yer alarak gün geçtikçe önemi daha da belirginleşmiştir. 1970'li yıllarda meydana gelen ekonomik krizlerin sonucu olarak gündeme gelen neo-liberal düşünceler ve küreselleşme olgusunun sosyal güvenlik hakkının uygulanmasında meydana getirdiği değişim ve dönüşümler, ülkemizde de sosyal güvenlik reformu yapılmasını gündeme getirmiştir. Özellikle, 1990'lı yılardan itibaren sosyal güvenlik sisteminin bütçe açığının artması nedeniyle reform tartışmaları yoğunluk kazanmış, 2005 yılından itibaren ise sosyal güvenlik reformuna ilişkin yasal çalışmalara başlanmış, 2008 yılı itibariyle sosyal sigortalara reform ilişkin çalışmalar tamamlanmıştır. Bu çalışma konusunun seçilmesinin nedeni, bir insan hakkı olarak sosyal güvenlik reformu nedeniyle oldukça fazla tartışılmaya başlanan sosyal güvenlik hakkının kavramsal çerçevesi ile gelişimi; bu hakkın uluslararası belgelerde ve mukayeseli hukukta nasıl yer aldığı; son olarak da Türk hukukunda sosyal güvenlik hakkı ve bu hakkın uygulama araçlarını ortaya koyacak bir çalışma yapmaktır. Bu bağlamda, sosyal güvenlik reformunun sosyal güvenlik hakkına etkisi ayrıca tartışılacaktır. Bu çalışma, üç bölümden oluşmakta olup, birinci bölümde, sosyal güvenlik hakkının kavramsal çerçevesi ve gelişimi; ikinci bölümde, uluslararası belgelerde ve mukayeseli hukukta sosyal güvenlik hakkı; üçüncü bölümde ise, sosyal güvenlik hakkının Anayasal temelleri ve uygulama araçları incelenecektir. ; Social security, which we have faced with a compulsory concept when communities were transformed to the industrialized communities at 19 th century, has been existed with the different forms from formation of first communities to today. Besides, its importance got crystallized by taking part in national and international documents as a human right after World War II. Transformation and changes of neo liberal taught, which became on an agenda as a result of economic crises occurred at nineteen seventies, and globalization fact on application of social security right has forced to make social security reform in our country too. Especially from nineteen nineties discussions on reform had increased because increasing budget deficit of social security system. Legal studies related to the social security system had started at 2005 and the studies about social security reform completed at 2008. The reason of choosing this topic is making studies on and to explain; conceptual framework and progress of social security right as a human right which has started to be discussed more because of the social security reform, how is this right take parts in international documents and comparative law, and lately social security right in Turkish Law and its application tools. This study consists of three chapters. In the first chapter, the conceptual framework of social security right and its progress; in the second chapter, social security right in international documents and comparative law; in the third chapter, constitutional bases of social security right and its application tolls are being debated.
Anahtar Kelimeler: Yerel Özerklik, Yerel Yönetimler, İdari VesayetÖZET YEREL ÖZERKLİK VE YEREL YÖNETİMLER ÜZERİNDEKİ İDARİ VESAYET Yaşadığımız yüzyıl içinde dünyada meydana gelen değişim ve dönüşümler yerel yönetimler alanına da yansımış ve var olan yapıları değiştirmiştir. Demokrasinin yaygınlaştırılması ve toplumsal gelişmenin dengeli ve hızlı bir şekilde gerçekleşebilmesi için yerel yönetimlerin güçlendirilmesi ve geliştirilmesi gerektiği ortaya çıkmıştır. Dünyada yaşanan bu gelişmelere Türkiye'de kayıtsız kalmamış ve gerek küreselleşme gerekse Avrupa Birliği süreçleri sebebiyle yerel yönetimler mevzuatında ve uygulamada önemli değişiklikler yaşanmıştır. Türkiye'de yakın zamanda yasalaşarak yürürlüğe giren 5393 sayılı Belediye Kanunu, 5216 sayılı Büyükşehir Belediyesi Kanunu ve 5302 sayılı İl Özel İdaresi Kanunu yerel yönetimler reformunun gerçekleşmesinde imzalanmış olan Avrupa Yerel Yönetimler Özerklik şartı etkili olmuştur. Yeni yasal düzenlemeler kapsamında, yerel yönetimlerin kuruluş ve teşkilatlanmaları, görev ve yetkileri ile denetimleri konularından daha önceki hukuki düzenlemelere göre yerel yönetimlerin özerkliğini güçlendirici nitelikte hükümler getirilmiştir. Bu çalışmada öncelikle yerel özerklik ve idari vesayet kavramları açıklanmaya çalışılmış ve yerel yönetim mevzuatında yapılan değişiklikler bu anlamda Anayasa Mahkemesi ve Danıştay kararları ışığında değerlendirilmiştir. Sonuçta, yeni yerel yönetimler mevzuatı, daha önceki yerel yönetimler mevzuatına oranla idari, mali ve hukuki açıdan özerklik anlamında daha cesurdur. Yapılan reformlarla idari vesayet denetiminin, sadece hukukilik denetimi ve idari yargıyı harekete geçirme yetkisiyle sınırlı kalması sağlanması istenmiş, ancak diğer yandan da yerel yönetimler üzerinde, kendilerine verilen yetkileri kötüye kullanmamaları için rasyonel bir denetim kurulmaya çalışılmıştır. Bu bağlamda, tüm eksik ve aksaklıklarına rağmen, merkezin idari vesayet yetkisini mümkün olduğunca az seviyelere indirmeye çalışıp, yerel özerkliği ön plana çıkaran yeni düzenlemelerin başarılı olduğunu söyleyebiliriz. Keywords: Local Autonomy,Administrative Tutelage, DecentralizationABSTRACT LOCAL AUTONOMY AND ADMINISTRATIVE TUTELAGEOVER LOCAL GOVERNMENTSWe can see that the changes and transformations the world has gone through in the past decade we've been living in are also reflected in local governments and has changed the current settings. In order for democracy to spread and for a stable and fast social development, it is necessary to strengthen and improve local governments. Turkey has matched these developments as well, and there has been serious changes in laws of local governments and implementations due to both globalization and European Union processes. The European Charter of Local Self-Government that has been signed, has been effective in the local administration reform in Turkey by recently passed laws such as Law No:5393 Municipal Law, Law No: 5216 Metropolitan Municipality Law and Law No:5302 Special Provincial Administration Law. In the context of new legal regulations, when it comes to establishing and reorganizing local governments, their duties and authority as well as auditing, the autonomy of local governments have been strengthened. In this study, first of all, the concepts of local autonomy and administrative tutelage are examined and the changes that have been made in the local administration laws and regulations are evaluated in the light of the decisions made by the Constitutional Court as well as the State Council. Finally, the new local administration laws and regulations are much bold administratively, legally and financially in terms of autonomy as opposed to the previous local administration laws and regulations. With these reforms the intention was to make the auditing of the administrative tutelage a legal audit and limit the authority of these audits by putting administrative judgement in action. However, on the other hand, a rational auditing system has been tried to be formed over local administrations so that they do not abuse the authority given to them. In this context, despite all the shortcomings and deficiencies, we can say that the new regulations which limit the administrative tutelage of the central government to a minimum and raises the importance of local autonomy, is successful.
II. Dünya Savaşı'nın ardından kurulan Birleşmiş Milletlerde, savaşın galibi beş devletin daimî üye olarak yer aldığı Güvenlik Konseyi oldukça güçlü ve geniş yetkiler- le donatılmış, buna mukabil tüm üye devletlerin eşit bir şekilde temsil edildiği Genel Kurul bir müzakere organı olarak şekillendirilmiştir. Ancak Güvenlik Konseyinin be- lirleyici ve hükmedici bir konuma sahip kılındığı bu sistemin, temel amaç olan ulus- lararası barış ve güvenliğin sağlanması açısından başarısız olduğu ortaya çıkmıştır. Özellikle daimî üyelerin Birleşmiş Milletler Andlaşması ile kendilerine tanınan veto yetkilerini sıkça kullanmaları sebebiyle, Güvenlik Konseyinden karar almak neredey- se imkânsız hâle gelmiştir. Uluslararası barış ve güvenliği tehdit eden veya ihlâl eden olaylar karşısında Güvenlik Konseyinin etkin bir şekilde harekete geçememesi, Gü- venlik Konseyi özelinde Birleşmiş Milletleri haklı eleştirilerin hedefi haline getirmek- tedir. Birleşmiş Milletler sisteminin yaşanan bu tür sorunlar ve günümüz ihtiyaçları doğrultusunda yeniden şekillendirilmesi yönündeki çabaların sonuç vermediği dikkate alındığında, daimî üyelerin sahip oldukları veto yetkilerini kötüye kullanmaları karşı- sında, Genel Kurulun 1950 tarihli Barış İçin Birlik Kararı kapsamında harekete geç- mesinin en uygun ve elverişli seçenek olduğu görülmektedir. ; The Security Council, being one of the main bodies of the United Nations es- tablished after the Second World War, is composed of five permanent members and empowered with large and strong powers, in contrast with General Assembly desig- ned just as negotiation organ although all member states are represented only in this body. However, it is obvious that the Security Council dominant UN system aiming international peace and security has not been successful. Especially due to frequent use of veto power by permanent members has blocked decision making. The inability and immobility of Security Council against the actions creating threats to international peace and security has made the UN system a target of rightful criticism. Taking into consideration these problems and futile reform efforts for restructuring the UN sys- tem, the most appropriate and convenient option to prevent abuses of veto powers by permanent members is to act according to Uniting for Peace Resolution of the General Assembly dated 1950.
