To understand the essence of a legal system, one of the priority tasks is to study the doctrine of its sources of law. The situation with Islamic law is similar. The doctrine of sources of law is one of the most developed because it has been studied by a large number of lawyers and orientalists. At the same time, we see insufficient research on this doctrine due to a large number of approaches to understanding the term «source of law». In this paper, we have explored the sources of Islamic law in accordance with the Twelvers madhhab, as it is a basic school of Shiite legal doctrine. As a theoretical basis for the analysis of approaches to understanding the «sources of law», we have chosen approaches and their characteristics that would correspond to current approaches to the study of legal phenomena and processes in domestic legal science. Thus, the sources of Shiite Islamic law were analyzed in accordance with the following dominant approaches to understanding the meaning of the term «source of law»: epistemological (source of law is defined as a source of knowledge of the law, ie where we get our knowledge of the law. Most often it is legal monuments of history); material (social relations in general, natural, cultural, political, religious and other factors that determine the emergence, development and content of law); institutional (the law-making activity of state authorities and civil society institutions that establish or sanction legal norms); ideological (legal ideas, concepts, legal awareness of the subjects of lawmaking, which form a certain legal understanding and are the basis of the rules of law, affect their content); formal-legal (various forms (methods) of external expression of legal norms). After analyzing different approaches, we came to the conclusion that depending on the approach, the sources of Shia Islamic law are: according to the classical approach (ie, which is followed by Muslim scholars of Islamic law) - the Quran, Sunnah, ijma, akl; according to the epistemological approach - the ...
The worldwide recognition of the effectiveness of British higher education is largely echoed by state administration in this sphere. The Quality Assurance Agency for Higher Education and the central government of Great Britain are coordinating education, but the national governments of England, Northern Ireland, Wales and Scotland are primarily responsible for education and its development. This explains a number of differences in the classification of qualification levels, different training requirements, and sometimes in the prescribed periods of training. The key idea that currently dominates is that law school programmes should provide unified knowledge and general skills, which involves a retreat from the autonomy of the university in matters relating to the development of the programme and its content to meet the interests and needs of society. The main thing here is to take into account the demand for qualified representatives of legal professions that dominate the labor market.Since April 2018, issues of policy, funding and access to master and postgraduate education have fallen into two new bodies set up under the Higher Education and Research Act 2017, in particular the Office for Students, and an independent regulating organ – the UK Research and Innovation.The quality and content of higher legal education in Great Britain depends not only on government policy and existing regulations; equally important role is played by various organizations and associations that involve law practitioners and prominent scholars, professors from about 115 law schools in the UK.Much of the quality assessment work is carried out at law schools through internal university quality assurance mechanisms, including regular reports on individual courses, curricula that are considered at the school and university level. ; Світове визнання ефективності британської вищої освіти значною мірою залeжить від державного управління цією галуззю. Це пояснює низку відмінностей в класифікації кваліфіка-ційних рівнів, різних вимог до підготовки, а інколи і до встановлених термінів навчання. Основна ідея, яка домінує наразі, полягає у тому, що програми юридичних шкіл повинні надавати уніфіковані знання та формувати загальні навички, що передбачає відступ університету від абсолютної автономії у питаннях, пов'язаних з розробкою програми та її змісту для задоволення інтересів та потреб суспільства. Головним тут є врахування попи-ту на кваліфікованих представників юридичних професій, які домінують на ринку праці.
The research paper deals with the social and criminal law characteristics of such phenomenon as "bullying". The conducted research shows that bullying is a phenomenon that is no longer purely administrative and legal, and is now subject to criminal law characteristics because it often entails criminal consequences. A detailed analysis of the provisions of the Criminal Code of Ukraine allows concluding that certain manifestations of bullying were reflected in corpus delicti as torture, driving to suicide, hooliganism. With respect to the subjective nature of these criminal offenses, it should be noted that "bullying" is defined as the unlawful activity of school-age children. At the same time, persons over the age of 16 are responsible for the criminal offense in the form of a torture. Under Article 120 "Driving to Suicide, responsibility is born only by persons aged above 16. And only for hooliganism responsibility is born by persons aged above 14. That is, now we have a situation where, on the one hand, bullying is a problem for pupils, and on the other, criminal responsibility for committing actions that actually constitute bullying is born in most cases from the age of 16, when the pupils mostly leave school. We believe that the illustrated situation should be resolved at the legislative level as soon as possible. Examples of law enforcement practice indicate that judges increasingly recognize bullying as a criminal offense, prejudging the legislator. The research paper describes the judgements of the Ukrainian courts that oblige law enforcement agencies to enter information about the facts of bullying to the Unified Register of Pre-trial Investigations. In view of the above, it is proposed to enshrine corpus delicti of "bullying" in the Criminal Code of Ukraine. Such a proposal meets the requirements of the present time and will help protect the rights of victims of school bullying. The fact that corpus delicti of the criminal offense will be different from corpus delicti of the administrative offense enshrined in Article 173-4 of the Code of Ukraine on Administrative Offenses "Bullying (Harassment) of a Participant in the Educational Process". ; У статті досліджено соціальну та кримінально-правову характеристику такого явища, як «булінг». У результаті ускладнення ситуації в соціально-політичній, економічній, освітній та інших сферах суспільного життя рівень насильства в суспільстві нині збільшився в декілька разів. Підлітки є найбільш вразливою категорією суспільства. Оскілки саме в так званому перехідному віці активно формуються власна система сприйняття світу, система цінностей та пріоритетів, то діти переймають різні моделі поведінки дорослих, і, на жаль, насильство стає однією з таких моделей. Однією з найпоширеніших проблем у дитячому середовищі сьогодні є булінг, який прийнято розглядати як небажану агресивну поведінку дітей шкільного віку, що призводить до цькування дитини іншою дитиною або групою дітей з метою приниження, залякування та демонстрації сили. Проведене дослідження свідчить, що булінг – це явище, яке вже давно перестало бути суто адміністративно-правовим, і нині воно підпадає під кримінально-правові характеристики через те, що його наслідками часто стають тілесні ушкодження, моральні страждання, тобто наслідки, які містяться у складах кримінальних правопорушень. На жаль, «деякі жерти знущань настільки страждають, що закінчують або намагаються покінчити з життям самогубством. Буліцид – поняття, яке означає вчинення самогубства жертвами знущань у школі з метою припинення страждань. Детальний аналіз норм Кримінального кодексу України дає можливість зробити висновок, що окремі прояви булінгу знайшли своє відображення у таких складах кримінальних правопорушень, як катування, доведення до самогубства, хуліганство. Приклади правозастосовної практики свідчать про те, що судді все частіше визнають булінг кримінальним правопорушенням, упереджуючи в цьому законодавця. З урахуванням наведеного пропонується закріпити в Кримінальному кодексі України склад кримінального правопорушення «булінг». Така пропозиція відповідає вимогам часу та сприятиме захисту прав потерпілих від шкільного цькування.

The article examines the problematic issues of the formation of the national school of legal Byzantine studies, the existence of which determines the effectiveness of the use of scientific potential to ensure the adaptation of domestic civil legislation to the law of Europe in the context of integration processes.The need for the scientific research concerning the Byzantine (Eastern European) tradition of law (the totality of which, to a certain extent, can be named here as "legal Byzantine studies") is due, first of all, to the fact that the legacy of the Byzantine Empire at one time was partially broadcast to Kievan Rus, and with time, many scholars began to recognize that Ukraine objectively (together with Greece and Russia) was the main successor to the Byzantine heritage.The largest activity of research in the field of legal byzantinisties took place in about ten years – from 1997 to 2012 when theses were defended and a number of publications of domestic lawyers in this field appeared.The article also focuses on the "troistic" significance of Justinian's systematization: as the basis for the formation and improvement of the Greco-Roman (Byzantine) law; as the empirical basis for the reception of Roman law in later legal systems; as a positive experience large in scope and successful in the systematization of lawHowever, after ten years of active research (including dissertation), the interest of lawyers in issues related to the Byzantine legal system, the reception of Byzantine law, etc., has dropped markedly. After 2012, only a few publications appear in this area (not counting sections in comparative law teaching manuals, etc.).Based on the analysis of the state of affairs in this area, taking into account scientific research in the field of Byzantine (Greco-Roman) law and the problems of its reception in the civil law of Ukraine, the conclusion is substantiated that the formation of a national school of legal Byzantine studies has not yet occurred in Russian jurisprudence. Therefore, so far we can only talk about the election of a certain area of research, about an attempt to create such a school. At the same time, the conclusion that there are prerequisites for the creation of a scientific school of legal Byzantinistics allows determining the objectives of activities in this direction. ; В статье исследуются проблемные вопросы формирования отечественной школы юридической византи-нистики, от существования которой зависит эффективность использования научного потенциала для обеспе-чения адаптации отечественного гражданского законодательства к праву Европы в условиях интеграционных процессов.На основании анализа состояния дел в этой области, учитывая научные исследования в области византийс-кого (греко-римского) права и проблем его рецепции в гражданском праве Украины, обоснован вывод, что сей-час в отечественном правоведении формирования отечественной школы юридической византинистики еще не произошло. Поэтому пока можно говорить лишь об избрании определенного направления исследований, о попытке создания такой школы. У статті висвітлено окремі аспекти модернізації шкільної освіти Республіки Польща. Визначено та охарактеризовано такі ключові тенденції розвитку освіти, як модернізація структури освіти, змісту освіти, демократизація та децентралізація освіти. Зазначені стратегічні цілі розвитку сектора освіти Республіки Польща синхронізуються із загальноєвропейськими цілями. Проведено аналіз нового Закону «Про освіту» (2016 р.) у Польщі. У статті охарактеризовано оновлену систему шкільної освіти Польщі, вказано на основні її структурні зміни, що відбулися після реформування; на модернізаційні трансформації у змісті освіти, які полягають в оновленні змісту традиційних дисциплін на компетентнісних засадах, у поглибленні автономії шкіл та подальшого посилення демократизації та децентралізації управління системою освіти. Вказано на посилення ролі інклюзивної освіти. ; The article highlights certain aspects of the school education modernization in the Republic of Poland. The key trends in the education development are identified and characterized as the education structure modernization, the modernization of the education content, the democratization and decentralization of education.The indicated strategic goals for the development of the education sector of the Republic of Poland are synchronized with the pan-European goals. The analysis of the new Law "On Education" (2016) in Poland is carried out. The article describes the updated system of school education in Poland, indicates its main structural changes that occurred after the reform; on modernization transformations in the content of education, consisting in updating the content of traditional disciplines on a competence basis; changes in deepening the autonomy of schools and the further strengthening of democratization and decentralization of education management. The role of inclusive education is indicated. It is emphasized that democratization of education is one of the leading tendencies of modern education development. One of the components of the education democratization is decentralization. With Poland's accession to the EU, its unique experience is an example for Ukraine in the consistent reform of all society sections, in creating an effective model for deepening partnerships with the European institutions. Establishing and building strong and independent local self-government, with the gradual transfer of certain powers and responsibilities from central to local authorities, has been for many years a major focus of governance reform in Poland. It is noted that Poland has made considerable progress along the way. The trends we have highlighted in the school education development in Poland have revealed a systematic, purposeful movement of the country towards effective, qualitative changes in education.

Nowadays in the United Kingdom of Great Britain and Northern Ireland a process of regulation of the correlation of secular and religious basis in the education of the country lasts. The legal basis of the educational system is viewed by the author. The legal basis of the British educational system includes the right for studying religion in the public educational establishments, formation of religious schools that are supported by the certain religious organizations and the child's right for going to a Sunday school. The peculiarities of Sunday schools' work as an additional educational establishment for children are also viewed in the article. Sunday schools are the schools of additional education that are founded by religious organizations. These schools provide educational, organizational and methodical work in the achievement of the programs of spiritual and moral education. A Sunday school is a juridical entity and, like other educational establishments, it builds its work on the basis of the valid law. The British law says that nobody can force any person to attend a Sunday school. Besides Sunday school education cannot hinder or fully substitute compulsory general education and such education should not be directed on the professional preparation of cult workers. Sunday schools are financed by religious organizations. Children do not have to pay for their studying except free paternal contribution. These schools are controlled both by religious establishments and by the government. Besides there exist Sunday school councils. In Great Britain «The Educational Law» (1996) says that a child should be accepted to the nearest Sunday school that is not farther than two miles for the children up to eight years old and not farther than three miles for the children older than eight years. Otherwise there should be special transport that will carry children from their houses to the school. When accepting a child to a Sunday school, the director should take into consideration his or her parents' religious belonging. In Great Britain the age of a child is not the main condition for taking to a Sunday school that is why there exist Sunday schools of different types. Among them there are family Sunday schools, mixed Sunday schools and Sunday schools for adults. If parents want their child to be accepted to a Sunday school they should fill in a special card with some information about the child. This information is confidential and can be used only by the certain school. The article shows the content and organizational forms of work of Sunday schools in Britain. The analysis of life and treacherous path of Oleksandr Sviatotskyi – a prominent contemporary Ukrainian lawyer, Doctor of Law, professor, full member (academician) of the National Academy of Legal Sciences of Ukraine, honored lawyer of Ukraine, director general of the oldest in Ukraine national law journal "Law of Ukraine", honorary professor at the Zaporizhzhya National University – is carried out.After graduating from the Ivan Franko State University of Lviv, he was appointed to the position of responsible secretary of the juvenile affairs commission of the Lviv City Executive Committee in 1980. From his student years, O. Sviatotskyi was attracted to scientific and pedagogical activity. During 1983–1990 he was a graduate student, assistant, senior lecturer, associate professor at the department of criminal law and process at the Law Faculty of the Ivan Franko State University of Lviv. Professor V. Kulchytskyi, who in the Soviet period formed patriotism among students, instilled in them a love of their mother tongue, Ukrainian traditions, introduced the students of the Law Faculty to such outstanding milestones of Ukrainian law, such as "The rights under which the people of Little Russia are being tried", "Extract of Little Russian rights", "Assembly of Little Russian rights", "Court and punishment in the rights of Little Russians" etc., had an important influence on O. Sviatotskyi. Professor V. Kulchytskyi was one of the few lecturers at the Law Faculty of the Lviv University who, during Soviet times, lectured and conducted seminars exclusively in Ukrainian. One of the well-known students and the followers of Professor V. Kulchytskyi was O. Sviatotskyi, who was interested in the problems of establishing and developing of the Bar in Ukraine. The research was completed in 1987, when the young scholar successfully defended his thesis for the degree of the Candidate of Law in a specialty 12.00.01 on the topic: "Establishment and Development of the Soviet Bar (Historical and Legal Aspect)". In 1990 he was awarded the scientific title of the associate professor. In 1990, he became a doctoral student at the Kyiv State University after T. Shevchenko. His research persistence and hard work allowed him to successfully defend in 1995 his thesis for the degree of the Doctor of Law in a specialty 12.00.01 on the topic: "The Bar in the Legal Mechanism for the Protection of Citizens' Rights (Historical and Legal Research)". Since 1994, O. Sviatotskyi has been at the same time engaged in the Bar, which enabled him to become a co-founder and senior partner of the Kairos Law Firm in 1995.One of the greatest achievements of O. Sviatotskyi is his highly professional work as the director general of the oldest law journal in Ukraine, "Law of Ukraine", which started in October 1995 and continues to this day.From 1996 to the present O. Sviatotskyi is a co-founder and president of the "In Yure" Publishing House". In 1997 he was awarded the academic title of professor. In 2000 he was elected an associate member of the National Academy of Legal Sciences of Ukraine. In 2000–2001 and 2003–2004 he was appointed Public Advisor to the Prime Ministers of Ukraine, and from 2002 to 2004 appointed as Advisor to the Minister of Transport and Communications of Ukraine, H. Kirpa. From 2001 to 2004, he held the position of Director of the Scientific Research Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine. In 2009, he was elected a full member (academician) of the National Academy of Legal Sciences of Ukraine. Since October 2014, a co-founder and president of the "All-Ukrainian Charitable Foundation for European Integration, Security and Humanitarian Projects "Revival of Ukraine". In November 2015, by the Bar Council he was appointed the chairman of the Scientific Advisory Board of the National Bar Association of Ukraine. From December 2015 to August 2017, Rector of the High Bar School of the National Bar Association of Ukraine. From June 2016 to August 2019, Adviser to the First Vice Prime Minister of Ukraine on a public basis. The main directions of scientific research are: constitutional law, organization of public authority, theory and history of state and law of Ukraine, philosophy of law, judiciary, intellectual property law, development and modern legal position of the institution of the Bar.Olexandr Dmytrovych's scientific work comprises more than 200 scientific works, among which are monographs, textbooks, manuals, scientific articles. Written sources relating to the beginning of the period of the seven strongest states "Chuntsu" (Spring and Autumn period) originated in the 7th century B.C.The first elements of the philosophical teachings of China originated in the 5th century B.C., the most significant being Taoism, Confucianism, Mohism, Legalism, the School of In-Yang, and Nominalism. The thorough analysis of the abovementioned teachings provides an insight into a contemptuous attitude to the law as a means of regulating social relations and conflict resolution, as well as the faith in the harmony of human relationships and justice, and the need for a search for consensus and agreement.These teachings demonstrate a vivid confrontation between the humanist (Confucian and partly the doctrine of Mohism) and anti-humanistic (Legalist) doctrine, morality and law. It was also common to the European tradition.They had significant influence on the nature of ancient Chinese law, although it was also based on customary law, as well as on the traditions of Eastern despotism, which held the sacramentality of the ruler's figure (him and his power, as well as the laws that emanated from him, deified), the political arbitrariness, qualitatively different from the European view of the relationship between the state and the individual on the basis of blind submission, the absolute dominance of the state over society, the lack of democratic traditions of the formation of state authorities and governance, the lack of controlling authorities based directly on force, and the lack of guarantees of individual rights as its grounding features.The ancient Chinese law of the period had a very obscure caste character. The status of a person depended on the social situation this person was in, and not on his/her origin. Therefore, the linchpin here was occupied by the representatives of the ruling dynasty, as well as representatives of the state power apparatus, whose status was derived from the ruler.The second grade was occupied by regular persons (scientists, landowners, artisans, and merchants) who entirely depended on the will of the ruler and his officials. As for certain categories of persons, the extent of their eligibility was different. The following categories were personally free (Lyangen, Zhuzhen, Pingmin) and personally unfriendly, "Underworld" (Jian-jen), in addition to landowners and tenants. There also existed different statuses of father and son, spouses, separate categories of children, age categories of persons in criminal law (in particular, persons under 10 and over 80 were not held liable).The law was also featured by collective responsibility for committing crimes (the perpetrators of the crime could be punished by relatives of the offender to the third degree), a combination of functions of administration and justice (the ruler belonged to the supreme judicial authority), as well as extremely cruel sanctions for committing crimes. Court proceedings had an inquisitive character, where the person completely depended on the discretion of the authorities.
