Z problematyki prawa pracy i polityki socjalnej
Reserved Contracts – Issues of Interpretation and Application of the Public Procurement Law ; Zamówienia zastrzeżone – z problematyki wykładni i stosowania
Reserved contracts are a legal instrument that allows the promotion of those economic operators who, as part of their business, pursue also social goals. Pursuant to Article 22 (2) of the Act of 29 January 2004 – Public Procurement Law (Journal of Laws 2018, item 1986 as amended), they may only be applied for by sheltered workshops and other economic operators whose activities include the social and professional integration of members of socially marginalised groups. Unfortunately, the use of reserved contracts is in practice marginal, which is also caused by difficulties in interpretation of national laws. The article discusses the institution of reserved contracts and the terms of application thereof, in the context of the EU legislation. ; Zamówienia zastrzeżone są prawnym instrumentem pozwalającym promować tych wykonawców, którzy w ramach prowadzonej działalności realizują także cele społeczne. O ich udzielenie, na gruncie art. 22 ust. 2 ustawy z dnia 29 stycznia 2004 r. – Prawo zamówień publicznych (Dz.U. 2018, poz. 1986 z późn. zm.), mogą ubiegać się wyłącznie zakłady pracy chronionej oraz inni wykonawcy, których działalność obejmuje społeczną i zawodową integrację osób będących członkami grup społecznie marginalizowanych. Niestety, zastosowanie zamówień zastrzeżonych w praktyce jest marginalne, czemu sprzyjają także trudności interpretacyjne przepisów krajowych. W artykule została omówiona instytucja zamówień zastrzeżonych oraz warunki jej zastosowania w kontekście regulacji prawa unijnego.

Proces Boloński a Prawo o szkolnictwie wyższym i nauce ; The Bologna Process and the Law on Higher Education and Science
The subject of the study is the Bologna Process, its assumptions and course. The article contains an analysis of the Act on university education and science in order to indicate solutions for the harmonization in Poland under the Bologna movement. This movement is characterized as an example of European integration (harmonization) in the sphere of higher education, which was initiated by the Bologna Declaration of 19 June 1999. The main idea behind this declaration was the joint creation of the European Higher Education Area. The process initiated then goes beyond the scope of activities undertaken only by European Union governments. The analysis covers the following parts: The scope of the Bologna Process, Further European actors and the Sorbonne Declaration, The Bologna Process today, Implementation barriers was well as criticism. Pomoc państwa dla mediów publicznych w prawie Unii Europejskiej ; State Aid to Public Service Media in the Law of the European Union
Przedmiotem artykułu są regulacje unijne dotyczące dozwolonej pomocy udzielanej mediom publicznym przez państwa członkowskie Unii Europejskiej oraz praktyka ich stosowania. Celem badań jest weryfikacja następującej tezy: prawo Unii Europejskiej w sposób ogólny reguluje kwestie dozwolonej pomocy państwa dla mediów publicznych, natomiast szczegółowe wytyczne formułowane są ad causum, w wyniku kontroli Komisji Europejskiej i pod wpływem orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej. W pierwszej części autorka przedstawi regulacje unijne obowiązujące w przedmiotowej dziedzinie. Istotne znaczenie dla sektorowych zasad udzielania i kontroli pomocy państwa w obszarze radiofonii i telewizji ma komunikat Komisji z 2009 roku w sprawie stosowania zasad pomocy państwa wobec radiofonii i telewizji publicznej (Dz. Urz. UE C 257 z dnia 27 października 2009 roku). Następnie omówione zostaną wybrane orzeczenia Trybunału Sprawiedliwości Unii Europejskiej, istotne z punktu widzenia zasad udzielania przez państwo pomocy dla mediów publicznych. ; The article discusses the European Union regulations on permitted aid provided to the public media by member states of the European Union (EU) and the practice of their application. The aim of the research is to verify the following thesis: European Union law regulates the permitted state aid to public media only generally, but detailed guidelines are formulated ad casum, as a result of the control of the European Commission and according to the case law of the Court of Justice of the European Union. The first part will discuss the EU regulations in this area. The important document for sectoral policies and the provision of State aid control in the area of radio and television is the Commission Communication of 2009 on the application of State aid rules to public service broadcasting (OJ. EU C 257 of 27 October 2009). Then it will be discussed selected judgments of the Court of Justice of the European Union, important for the relevant rules of granting state aid to public media.

JACEK ZALEŚNY (ED.) Constitutional Courts in Post-Soviet States. Between the Model of a State of Law and Its Local Application

The monography provides a comparative analysis of the constitutional review bodies' activities, their status and efficiency in different Post-Soviet States. It deals with the complex description of the constitutional provisions' compliance, the problems of legal mechanisms and stability, evolution of the local legislation. In this book the authors provide a detailed report of the constitutional review institutions' problems in the process of ensuring its legislative position. In this context we find in the research a description of the legal, political risks of the constitutional control in Post-Soviet States, its social perception and the predictability of its legal systems' development. This work integrates the unique structure of presentation and research materials. By the reflection of this type the authors lay the base for continuing further researches of constitutional review development dynamics in the countries of the region.
Law and Lawyers vs "Political Turn" and the "Return of Political Philosophy" ; Prawo i prawnicy wobec "zwrotu politycznego" i "powrotu filozofii politycznej"
The title of the article refers to P. Manent's essay, describing "the return of political philosophy". Using the distinction between science and art, suggested by thinkers such as J.S. Mill, an analysis was made of the possible responses of legal theory to the so-called "political turn" in social sciences and humanities. Attempts were made to show that transplanting such terms as "politics", "the political", "polity" (in the text they function under more theoretically neutral term: "politicalness") into the field of legal discourse leads to the rejection of the so far dominant (referring to the ideal of Ch. Montesquieu) image of the activity of lawyers as "artisans" practicing the art of law and to replacing it with the image of a lawyer-artists or lawyer-scientist. ; Tytuł artykułu nawiązuje do eseju P. Manenta, opisującego "powrót filozofii politycznej". Korzystając z rozróżnienia między nauką a sztuką, zaproponowanego przez J.S. Milla, dokonano analizy możliwych reakcji prawników i teorii prawa na wyraźny "zwrot polityczny" w naukach społecznych i humanistycznych. Starano się wykazać, że przeszczepienie takich terminów jak "polityka" i "polityczność" na grunt nauk prawnych prowadzi do odrzucenia dominującego dotąd (nawiązującego do ideału K. Monteskiusza) wyobrażenia działalności prawników jako "rzemieślników" uprawiających sztukę prawniczą oraz do zastąpienia go wyobrażeniem prawnika-artysty lub prawnika-naukowca.

Niezależność sądów i niezawisłość sędziów z perspektywy prawa Unii Europejskiej ; Independence of the courts and judicial independence from the European Union law perspective
Niezależność sądów i niezawisłość sędziów stanowią jedną z podstaw państwa prawnego, należącego do podstawowych wartości Unii Europejskiej. Do zasad państwa prawnego należy zasada trójpodziału władz, stanowiąca równocześnie istotną gwarancję niezależności władzy sądowniczej. Zasada podziału władz oznacza, że do wyłącznej kompetencji władzy sądowniczej należy sprawowanie wymiaru sprawiedliwości i organy innych władz nie mogą ingerować w wykonywanie funkcji orzeczniczych przez sądy. W państwach demokratycznych istnieje potrzeba gwarancji niezależności władzy sądowniczej na poziomie norm konstytucyjnych. Podstawową funkcją niezależności sądów i niezawisłości sędziów jest zapewnienie obywatelom prawa do sądu w rozumieniu art. 6 Konwencji o ochronie praw człowieka i podstawowych wolności oraz art. 45 Konstytucji RP. Z punktu widzenia prawa do sądu ważne jest istnienie związku między niezależnością sądów i niezawisłością sędziów a gwarancją bezstronności sądu oraz gwarancją do sprawiedliwego rozpoznania sprawy przez sąd. Niezależność sądów i niezawisłość sędziów są ściśle powiązane z zasadą odpowiedzialności władzy sądowniczej. ; The independence of the courts and the judiciary constitutes one of the foundations of the rule of law and is one of the basic values of the European Union. Judicial independence is also guaranteed by the principle of the separation of powers. According to this principle courts are the only competent body to execute judiciary powers and no other organs may be permitted to interfere in judicial decisions or their making. Democratic states must have the independence of the courts ensured in their constitutions. The basic function of judicial independence is ensuring citizens the right to a fair trial as provided in Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Article 45 of the Constitution of the Republic of Poland. From the point of view of the right to a fair trial the relationship between the independence of the courts and judicial independence on the one hand and the guarantee of the impartiality of the courts and of a fair trial on the other, is important. The independence of the courts and the judiciary is closely related to the principle of the responsibility of judicial authority.

Environmental Kuznets Curve as a Framework of Favours Reciprocity in the Policy of Law ; Środowiskowa krzywa Kuznetsa jako rama wzajemności świadczeń w polityce prawa
The Environmental Kuznets Curve (EKC) is a descriptive formula used to reflect on asymmetries in economic development and consequential conflict of interests arising between various states of the world. These asymmetries and conflicts of interests have their reflection inthese states' environmental policy mix –implemented domestically and pursued inthe international context. The emerging map of mutual interests and dependences results from the consideration of external costs and benefits pertaining torespective national environmental policies. The EKC makes it evident that these costs and benefits cannot be evenly spread over all the states. This urges these states toadopt such interjurisdictional arrangements which are based on the identification of apossible multilateral exchange of economic policy favours and international financial transfers. Such an exchange, whenever occurs, has ageneralized reciprocity formula. The function of such an arrangement is tomake it possible for Nash equilibria toemerge, as such are most likely toproduce the highest possible level of effectiveness inthe long run. Such abehavior may notbe cooperative inthe short and medium term, yet the bottom-line cooperativeness is achieved because most states have similar if notthe same long-term environmental goals. ; Środowiskowa krzywa Kuznetsa jest formułą opisu asymetrii uwarunkowań rozwoju gospodarczego i wynikających stąd sprzeczności interesów pomiędzy państwami. Owe asymetrie i sprzeczności znajdują odzwierciedlenie w realizowanej przez nie wewnętrznie i poszukiwanej w przestrzeni międzynarodowej policy mix w dziedzinie ochrony środowiska. Na mapie interesów i zależności naturalnie pojawiających się w kontekście ochrony środowiska muszą być uwzględnione korzyści i koszty zewnętrzne, które stwarza polityka ochrony środowiska poszczególnych państw. Z EKC wynika, że owe korzyści i koszty nie mogą być rozłożone równomiernie, co powoduje, że istotne jest zapewnienie takich rozwiązań międzyjurysdykcyjnych, które zapewniają identyfikację świadczeń opartych na wzajemności zgeneralizowanej i realizację ich w jakiejś formule wymagającej międzynarodowego porozumienia o wymianie świadczeń w postaci kooperatywnych elementów polityki ochrony środowiska oraz transferów finansowych. Wzajemność, o której w tym wypadku mowa, ma charakter zgeneralizowany. Jej funkcją jest zapewnienie takich równowag Nasha, które długookresowo zapewniają najwyższy poziom efektywności. Jakkolwiek wyzwala to pewien stopień niekooperatywności w krótkim i średnim okresie, to jednak nie jest ona zupełna, gdyż fundamentalne, długookresowe cele polityki środowiska większości państw są podobne.

THE LIABILITY OF THE UNITED NATIONS PEACE OPERATIONS FOR VIOLATION OF INTERNATIONAL HUMANITARIAN LAW ; Odpowiedzialność za naruszenie międzynarodowego prawa humanitarnego przez siły pokojowe Organizacji Narodów Zjednoczonych
Operations under the auspices of the Security Council mandate span over 70 years. Repeatedly involved in resolving armed conflicts, they have made a significant contribution to ensuring security and stability around the world. In practice, they have taken the form of operations by individual states, coalitions, other international organizations or simply as United Nations missions composed of contingents provided by Troop Contribution Countries (TCC). While operations under the auspices of the United Nations have been involved on several occasions in offensive activities under Chapter VII of the Charter of the United Nations, and the question of responsibility for these actions has been the subject of many legal analyses and judgments, missions organized by the United Nations are always recognized as neutral, and their activities as conciliatory and focused on monitoring the cessation of hostilities, or supervising the disengagement between the parties of the conflict, with the use of force limited to self-defence. Thus, such operations benefited from legal protection, and any action against them was considered a violation of international law. The current engagement of United Nations goes far beyond the traditional understanding of peacekeeping operations. UN missions are frequently authorized to employ all necessary means, up to and including the use of lethal force or even neutralization of the armed group. This creates a situation where in the light of International Humanitarian Law, such actions can be recognized as involvement in armed conflict. This article is intended to show the problems that the international community will soon face to in using United Nations' missions as an instrument for resolving armed conflicts and as a tool for restoring peace and providing stability and securityin the area of operations. Self-defence as a Circumstance Excluding Illegality in the Criminal Law of Ukraine ; Obrona konieczna jako okoliczność wyłączająca bezprawność w prawie karnym Ukrainy
The institution of self-defence comprises both provisions of the General Part (art. 36 and 37:self defence and imaginary self defence) and the Special Part (art. 118 and 124: intentional killing,causing grievous bodily harm as a result of exceeding the borders of self defence or using excessivemeasures necessary to catch the perpetrator) of the Criminal Code of Ukraine.There are diverse opinions in Ukrainian jurisprudence concerning the problem of how selfdefenceand other circumstances eliminate the illegality of a forbidden act. The aim of this paper isto present the main attitudes to these problems. The approach considering self-defence in the lightof legality is the most popular view. There is also an approach according to which one distinguishesthe prerequisites for self-defence and the elements of such self-defence taking into account elementssuch as: the subject – the aim – the objective side – the subjective control. The socially harmfulattack which justifies the use of self-defence should be analysed using both of these approaches.The features of a legitimate self-defence are: the subject – a private person; the aim – to causeinjuries to the attacker (the direct aim) in order to repel or stop the attack (the indirect aim) in orderto defend legally protected rights and interests of a person, interests of the society or the state (thefinal aim); the object – the attacker, his rights and interests; the objective side – actions casually connectedwith the causing of harm to the attacker, commensurable with the harmfulness of the attackand the state of the defence; subjective control – proper realisation by the subject of the prerequisitesand features of the defence and the will to cause commensurable harm to the attacker.Two types of exceeding the borders of self-defence are distinguished in the paper: exceedingthe borders of acceptable harm and exceeding the borders of adequate harm. Criminal responsibilityfor exceeding the borders of self-defence arises only in cases clearly provided for in art. 118 and 124of the Criminal Code of Ukraine. The sanctions in these articles are much more lenient than in thecase of corresponding offences not committed while exceeding of the borders of self-defence (art.115, 119 and 121 of the Criminal Code of Ukraine). ; Artykuł nie zawiera abstraktu w języku polskim

Artykuł dotyczy poziomu dostosowania ustawodawstwa ukraińskiego do norm Unii Europejskiej w zakresie oceny oddziaływania na środowisko. W materiale poddano analizie główne dokumenty unijne i ukraińskie przede wszystkim: dyrektywę Parlamentu Europejskiego i Rady 2011/92/UE z dnia 13 grudnia 2011 r. w sprawie oceny skutków wywieranych przez niektóre przedsięwzięcia publiczne i prywatne na środowisko, dyrektywę 2001/42/WE Parlamentu Europejskiego i Rady z dnia 27 czerwca 2001 roku w sprawie oceny wpływu niektórych planów i programów na środowisko, oraz ustawę Ukrainy o ekspertyzie ekologicznej. Na podstawie tego można stwierdzić, że pomimo rozbudowanej bazy ustawodawczej na Ukrainie w tym zakresie, poziom jego dostosowania do norm unijnych jest niski. ; The article is about the level of adaptation Ukrainian legislation to the European Union standards in the area of environmental assessment. Due to the above it is necessary to emphasize that, in spite of large legislation base in Ukraine in this area, the level of its adaptation to the EU standards is low. ; Artykuł dotyczy poziomu dostosowania ustawodawstwa ukraińskiego do norm Unii Europejskiej w zakresie oceny oddziaływania na środowisko. W materiale poddano analizie główne dokumenty unijne i ukraińskie przede wszystkim: dyrektywę Parlamentu Europejskiego i Rady 2011/92/UE z dnia 13 grudnia 2011 r. w sprawie oceny skutków wywieranych przez niektóre przedsięwzięcia publiczne i prywatne na środowisko, dyrektywę 2001/42/WE Parlamentu Europejskiego i Rady z dnia 27 czerwca 2001 roku w sprawie oceny wpływu niektórych planów i programów na środowisko, oraz ustawę Ukrainy o ekspertyzie ekologicznej. Na podstawie tego można stwierdzić, że pomimo rozbudowanej bazy ustawodawczej na Ukrainie w tym zakresie, poziom jego dostosowania do norm unijnych jest niski.

The issue of self-defence in light of the international law prohibition to use military force ; Problematyka samoobrony na tle zakazu użycia siły zbrojnej w prawie międzynarodowym
The subject of this paper touches upon the prohibition to use force, and military force in particular, by States in self-defence. This is a classical example of an important and still very topical issue in international law practice. The right of each State to self-defence is perceived as one of the fundamental rights provided for in customary as well as positive international law. And yet, the exercise of this right has always raised many controversies and questions resulting, on the one hand, from the fact that the concept of self-defence has evolved over years, and, on the other hand, because of the recent tendencies to legalise different military actions carried out outside the framework of the United Nations Charter. These tendencies, presented in the paper in the context of military actions taken by states in situations of a potential terrorist attack, are described as either a pre-emptive, or a preventive use of military force. The author then concludes that although in the event of a pre-emptive military action taken by a State in reliance of its right to self-defence it may be justified to rely on the legal construction of self-defence, in the context of a preventive military operation, such reliance would be much more risky, if not inadmissible. A preventive use of military force fails to meet the criteria of legality of self-defence set forth in the UN Charter, as well as those resulting from international customary law. ; Problematyka artykułu nawiązuje do klasycznej, ale niezwykle ważnej i aktualnej w praktyce międzynarodowej problematyki zakazu użycia siły, zwłaszcza siły zbrojnej. Dotyczy bowiem możliwości podejmowania i realizowania przez państwa działań zbrojnych pod postacią samoobrony. Prawo każdego państwa do użycia siły w ramach samoobrony było i jest postrzegane jako jedno z praw fundamentalnych, gwarantowanych zarówno przez zwyczajowe, jak i pozytywne prawo międzynarodowe. Jego realizacja w praktyce budzi jednak wiele kontrowersji i pytań. Są one związane zarówno z ewolucją samej instytucji samoobrony, jak również z nowymi tendencjami w zakresie legalizowania różnych akcji zbrojnych dokonywanych poza ramami Karty Narodów Zjednoczonych. Autor prezentuje te tendencje, zwłaszcza w kontekście działań zbrojnych podejmowanych przez państwa w sytuacji potencjalnego zagrożenia atakami terrorystycznymi, a określanych jako uprzedzające i prewencyjne użycie siły. W konkluzji autor stwierdza, że o ile w wypadku zbrojnej operacji uprzedzającej uzasadnione jest odwoływanie się do konstrukcji prawnej samoobrony, o tyle w wypadku zbrojnej operacji prewencyjnej jest to znacznie bardziej ryzykowne, a wręcz nieuprawnione. Prewencyjne użycie siły zbrojnej nie spełnia bowiem kryteriów legalności samoobrony – zarówno tych określonych w Karcie Narodów Zjednoczonych, jak i tych wynikających z prawa zwyczajowego.

Some Remarks for the Law as It Should Stand in the Matter of State's Evidence Witness' Testimony ; Z problematyki dowodu z zeznań świadka koronnego – kilka uwag de lege ferenda
The article addresses the slightly anachronistic, in the author's opinion, institution of state's evidence witness, whose current legislative shape may raise objections, in particular from the point of view of the application of the principle of equality before the law. The study presents a few conclusions on the law as it should stand (de lege ferenda), which, if implemented, could be used to optimize the legal solutions provided for in the Act on State's Evidence. The article puts forward, among other things, the proposal to include the subsidiarity principle in the discussed institution, kind of like the requirement relating to operational surveillance, which is also debatable in moral and juridical terms, as it leads to restrictions, which is also not indisputable in the moral and juridical sense. The article also refers to the wording of Article 6 of the aforementioned Act, which provides for a rule that eliminates evidence from the suspect who ultimately did not acquire the status of a state's evidence witness. According to the author, the approach under this rule is too broad and imprecise, thus it requires an appropriate correction. ; Przedmiotem artykułu jest nieco anachroniczna w ocenie autorki instytucja świadka koronnego, której obecny legislacyjny kształt może budzić zastrzeżenia, w szczególności patrząc z punktu widzenia obowiązywania zasady równości wobec prawa. W opracowaniu zaprezentowano kilka wniosków de lege ferenda, których ewentualne uwzględnienie mogłoby posłużyć do optymalizacji rozwiązań prawnych przewidzianych w ustawie o świadku koronnym. Przedstawiono m.in. postulat objęcia omawianej instytucji regułą subsydiarności na wzór wymogu odnoszącego się do kontroli operacyjnej, która także nie jest bezdyskusyjna w płaszczyźnie moralnej i jurydycznej. W artykule nawiązano również do brzmienia art. 6 wymienionej ustawy, przewidującego regułę eliminującą dowód z wyjaśnień podejrzanego, który ostatecznie nie nabył statusu świadka koronnego. Zdaniem autorki ujęcie tej reguły jest zbyt szerokie i mało precyzyjne, dlatego wymaga stosownej korekty.
