After the Lisbon Summit of 2009, the whole matter of fundamental rights in the European Union has taken a new connotation. Local economic interests and social protests – in opposition to the "neoliberal agenda" of EU institutions – have played an important role in stopping the enforcement of the "Constitutional Treaty" and boosted an anti-Euro mobilization. In the meanwhile, the European bodies and transnational corporations have continued to settle a new and alternative basis for the integration. A radical shift can be observed, from the research of synthetic set of principles – as those established on the EU Charter of Fundamental Rights – to a deeply technical and detailed normative production. The regulation on safety and healthy workplaces is one of the best point of view to study this change. Far from calling into question the unbalanced positions between the parties in contemporary labour relationships, the European strategy for workers' protection move through procedural issues and voluntary obedience to the soft law instruments. In the past, the legal doctrine described the creation of a multilevel architecture of institutions, sometimes implemented in a top-down approach. Along with this, recently, it was implemented the establishment of common organizational standards associated to a specific system of corporate governance to pursue a better integration between business and fundamental rights. ; Após o Summit de Lisboa de 2009, toda a questão dos direitos fundamentais na União Europeia tomou uma nova conotação. Os interesses econômicos locais e os protestos sociais – em oposição a "agenda neoliberal" promovida pelas instituições europeias – têm desempenhado um papel importante em parar a execução do "Tratado Constitucional" e impulsionaram uma mobilização anti-Euro. No enquanto isso, os organismos europeus e as empresas transnacionais instalaram uma base nova e alternativa para a integração. Uma mudança radical pode ser observada, a partir da pesquisa de um conjunto (ainda) sintético de princípios – como os estabelecidos na Carta dos Direitos Fundamentais da União Europeia – para uma produção normativa profundamente técnica e detalhada. A regulação da segurança no lugar de trabalho é um dos melhores pontos de observação para estudar a transformação mencionada. Longe de pôr em causa as posições desequilibradas entre as partes nas relações de trabalho contemporâneas, a estratégia europeia para a proteção da saúde dos trabalhadores prefere as questões procedimentais e a adesão voluntária aos instrumentos de soft law. No passado, a doutrina jurídica descrevia a criação de uma arquitetura multi-nível de instituições, as vezes implementada por meio de uma abordagem de cima para baixo (top-down approach). Junto com isso, recentemente, teve a implementação de padrões organizacionais comuns para a criação de um sistema específico de governança corporativa, finalizado a buscar uma melhor integração entre os negócios e os direitos fundamentais.

The problem to be addressed in this article is related to the precautionary principle and its incorporation into the Brazilian law. As it is beknown, this principle has been widely cited by Brazilian case law and it is an important part of the legal and environmental scholarly production. However, it follows that its application has been made fairly randomly, and even so there is no clear and operational definition of its content. The hypothesis being examined is that since the Rio Declaration's - in its translation into Portuguese - environmental legislation has termed as legal principle, which internationally is an approach, a precautionary measure, as can be seen in both the texts in English and French of the Rio Declaration and other relevant legal instruments. The methodology to be used is the research of the case law and relevant legal rules, as well as the examination of the scholarly production on the subject. As a result, the conclusion is that there is an overuse of the precautionary principle by the Brazilian courts, especially by the Superior Court of Justice and that, in this case, the Federal Supreme Court has played a moderating role in relation to the application of the precautionary principle.

In every country, behind the official law composed of the Constitution, statutes, rules edited by the Executive branch, and legal precedents, there is also another concealed regulation, based on the structure of ruling powers within society and legitimized by social mentality. Such duplicity of legal systems has always existed in Brazil. Apart from the official law, which follows valid civilization standards of countries that we consider to be culturally more advanced, there is a tacit law in force, whose role is to protect the interests of dominant social groups. This article illustrates this twofold reality of Brazilian law with the historical cases of slavery and democracy. In order to change this social structure, whose appearance does not reflect effective reality, the author highlights the need for a wide and continual denunciation of its illegitimacy. ; Em todos os países, por trás do direito oficial, composto pela Constituição, pelas leis, as normas editadas pelo Poder Executivo e os precedentes judiciais, existe sempre outro ordenamento encoberto, fundado na estrutura de poderes dominantes na sociedade e legitimados pela mentalidade social. No Brasil, essa duplicidade de regimes jurídicos sempre existiu. Além do direito oficial, que acompanha os padrões de civilização vigentes nos países que consideramos culturalmente mais avançados, vigora um direito não escrito, cuja função consiste em proteger os interesses dos grupos sociais dominantes. O artigo ilustra essa realidade bifronte do direito brasileiro com os casos históricos da escravidão e da democracia. Para mudança dessa estrutura social cuja aparência não condiz com a realidade efetiva, o autor sublinha a necessidade de uma ampla e contínua denúncia de sua ilegitimidade.

This article aims to study the changes brought by Federal Law 13,655/18 to the Law of Introduction to the Rules of Brazilian Law - LINDB from the perspective of the control of the Public Administration. We intend to analyze the new provisions added to the original legal diploma and its implications regarding the control of the activities performed by the Public Administration entities. One of the most relevant changes concerns the necessary assessment of the consequences of decisions taken by the public control bodies, the assessment related to the efficiency concerning the Public Administration activities, the greater role played by social participation, and, therefore, a more democratic scenario. On this basis, consensuality also acquires greater relevance. The analysis took place here starts from a historical retrospective of the control of Public Administration in Brazilian Law. Secondly, the different forms of control of the Public Administration are analyzed, and then the new concepts brought by the LINDB, as it was altered in the year 2018, are analyzed. ; O presente artigo tem por escopo o estudo das alterações trazidas pela Lei Federal 13.655/18 à Lei de Introdução às Normas do Direito Brasileiro – LINDB, sob a perspectiva do controle da Administração Pública. Nesse esteio serão apreciados os novos dispositivos acrescidos ao diploma legal original e suas consequências no que toca o controle das atividades da Administração Pública. Nota-se que uma das mais relevantes alterações diz respeito à necessária apreciação das consequências das decisões a serem adotadas pelos órgãos de controle, a percepção de eficiência na ação administrativa, além da maior participação social e viés democrático. Nessa égide, a consensualidade também adquire relevância. A análise do tema partirá de um retrospecto histórico do controle da Administração Pública no Direito Brasileiro, passando pelas formas de controle da Administração Pública, para então analisarmos e discutirmos os novos conceitos inseridos na LINDB no ano de 2018.

This work analyzes the Agenda 2030 in its main potentiality to lead public policies and private actions towards a more sustainable path. At the same time it acknowledges its dependency on measurements and finance mechanisms for the Sustainable Development Goals implementation. The main argument is that public expectations face difficulties to be translated in public actions, due to, among other factors, the lack of measurement and finance mechanisms. With this purpose it starts describing what is the Agenda 2030, and how this United Nations lead international declaration is structured to be monitored and implemented by States and others multi stakeholders. Secondly it analyses the importance of the measurements to address critical social environmental challenges and to allow comparison between the achievements of each member state. Third it remarks the role-played by international financial institutions, by international investment and by the private sector in general. Forth, the article highlights the drawbacks the methodology of goals can represent when used to overcome collective challenges marked by moral issues and diffuse impacts, being highly dependent on measurements and finance tools. The methodology chosen was the descriptive and normative, the techniques used were documentary, legislative and bibliographic research.

The pandemic caused by the spread of the coronavirus has profoundly derranged our habits of life and constitutes a socioeconomic challenge as we have not known in the post-World War II. Law, as a phenomenon of social regulation, was also put to the test, in its conformative and adaptive capacities. This text aims, on the one hand, to provide an overview of the responses of the Member States of the European Union to the constitutional problems posed by the need to manage the pandemic and, on the other hand, to point out aspects that should constitute lessons for the future. ; La pandemia provocada por la diseminación del coronavirus trastocó profundamente nuestros hábitos de vida y constituye un desafío socioeconómico como el que no conocíamos después de la Segunda Guerra Mundial, en el siglo pasado. La Ley, como fenómeno de regulación social, también fue puesta a prueba, en sus capacidades conformacionales y adaptativas. Este texto pretende, por un lado, lanzar un panorama de las respuestas de los Estados miembros de la Unión Europea a los problemas constitucionales que plantea la necesidad de gestionar la pandemia y, por otro lado, señalar aspectos que deben constituir lecciones para el futuro. ; A pandemia originada pela disseminação do coronavírus transtornou profundamente os nossos hábitos de vida e constitui um desafio socioeconómico como não conhecêramos no pós II Guerra mundial, ainda no século passado. Much of the moral and political debate about the rights of migrants has concerned their rights once admitted to a state. Although these issues around the rights of migrants once within the destination country are obviously of great importance, in this chapter I want to focus on the border itself and on the border posts and camps that spring up along the world's frontiers. It ishere that, in the name of national sovereignty and security, universal moral claims are disregarded and the rights derived from them glaringly ignored.

This paper analyses the problems of the rule of law in today's legal and constitutional discourse. The criticisms the rule of law principle is subjected to, which contribute to its downgrading and to changes in the legal standards that had been progressively achieved, are especially examined, namely, the so-called hyper-protection of fundamental rights and the difficult harmonization with the idea of efficiency. Furthermore, the author identifies the de facto conditions that accentuate the identified problems, such as the systemic deficit of the European Union and the jurisdictional deficit that has become evident since the economic crisis. ; O artigo analisa a problemática do Estado de Direito no discurso jurídicoconstitucional contemporâneo. Reflete-se, em particular, sobre as críticas a que o princípio está hoje sujeito, que conduzem à relativização e mudança dos "standards" de juridicidade progressivamente sedimentados, designadamente, o alegado excesso de garantismo e a difícil compatibilização com as ideias de eficácia e a eficiência. Por fim, identificam-se várias condições de facto que acentuam os problemas identificados, como o défice sistémico existente no quadro da União Europeia e o défice de juridicidade que se tornou evidente com a crise económica.

A complexidade das relações sociais impõe o reconhecimento da impossibilidade de previsão de todas as situações fáticas passíveis de descrição na hipótese normativa "in abstracto". Nesse sentido, o legislador passou a empregar uma série de técnicas legislativas que, visto providas de substancial grau de indeterminabilidade, têm o poder de aumentar consideravelmente o alcance da norma jurídica. A tendência acima descrita tem especial repercussão nas relações jurídicas que envolvam o Estado. Nesses casos, atribui-se ao administrador público uma maior amplitude para a aplicação do direito (visto que não mais se faz por automática subsunção). No entanto, na mesma medida em que se dá a ampliação da atribuição de aplicar o direito ao caso concreto, exige-se uma maior responsabilidade ao atingimento da finalidade estabelecida na norma aplicada. Nesse quadro, é de se reconhecer que haverá casos aos quais a aplicação desse expediente utilizado pelo legislador não apresentará uma única resposta justa e razoável pelo direito. O resultado disso é a aproximação da atividade estatal, no caso, à competência discricionária. É necessário, todavia, que se identifiquem os limites que o Direito impõe à atividade administrativa no que concerne à sua aplicação, de forma que a Administração Pública não se utilize indevidamente do ordenamento com o escopo de mascarar arbitrariedade. Com isso, o princípio da boa administração apresenta relevante papel norteador da atividade estatal. ; The complexity of the social relationships leads to the conclusion that it is impossible to foresee all social facts within the normative prescription "in abstracto". This article uses the Newcomb-Benford(NB-Law), or Law of Anomalous Numbers, to analyze the values of Electronic Bidding Processes that occurred in the Purchasing Portal of the Brazilian Federal Government and contained in the newly created website "DadosAbertos.gov.br". In the analysis, all services contracted in the period from 2014 to 2018 were considered. The objective of the research was to analyze the conformity of the Electronic Auction referred to the NB-Law, aiming to verify anomalies, which represent signs of fraud. It can be said that there was a statistically significant anomaly in the analysis of the first digit of the values bid in the Electronic Bidding Tenders. It is also noted that the trading sessions with the first digit of numbers 4, 8 and 9 are those with the largest differences between expected and observed values, strengthening the hypothesis that these represent the trading sessions with the highest incidence / probability of deviations, to be tested in future studies. The study, pioneer in this type of analysis in the Brazilian data source, aims to contribute to the literature focused on the detection of accounting or financial fraud in the public sector. The results collected here can also contribute to the practice of inspection in public management. It is recommended to deepen the studies based on the Economics of Corruption, on issues that involve the detection of fraud, so that corruption becomes unviable or inopportune. ; Este artículo utiliza la Ley de Newcomb-Benford(Ley-NB), o Ley de Números Anómalos, para el análisis de los valores de las Sesiones de Comercio Electrónico realizadas en el Portal de Compras del Gobierno Federal de Brasil y contenidas en el sitio web recién creado "DadosAbertos.gov.br". En los análisis, fueron considerados todos los contratos de servicios, de 2014 a 2018. El objetivo de la investigación fue analizar el cumplimiento de las Sesiones de Comercio Electrónico mencionadas a la Ley-NB, con el fin de verificar anomalías que representan evidencia de fraude. Se puede afirmar que hubo una anomalía estadísticamente significativa en el análisis del primer dígito de los valores licitados en las ofertas de las Subastas Electrónicas. También se observa que las sesiones de trading con el primer dígito de los números 4, 8 y 9 son las que presentaron el valores intermedios más altos que contribuyen al chi-cuadrado (²) calculado, fortaleciendo la hipótesis de que estas representan las sesiones de trading con la mayor incidencia/probabilidad de desviaciones. El estudio, pionero en este tipo de análisis en la base de datos brasileña, tiene como objetivo contribuir a la literatura centrada en la detección de fraudes contables o financieros en el sector público. Los resultados aquí recogidos también pueden contribuir a la práctica de la supervisión en la gestión pública. Se recomienda profundizar en el análisis de las ofertas estudiadas, con el fin de confirmar las evidencias aquí recogidas, y centrarse en estudios basados en la Economía de la Corrupción en cuestiones relacionadas con la detección de fraude, de modo que la corrupción se vuelva inviable o impropia. ; Este artigo utiliza a Lei de Newcomb-Benford (Lei-NB), ou Lei dos Números Anômalos, para análise empírica exploratória dos valores de pregões eletrônicos ocorridos no Portal de Compras do Governo Federal brasileiro e constantes no recém-criado site "DadosAbertos.gov.br". Nas análises foram consideradas todas as contratações de serviços no período de 2014 a 2018. O objetivo da pesquisa foi analisar a conformidade dos pregões eletrônicos mencionados à Lei-NB, visando a verificar anomalias que representam indícios de fraude. Pode-se afirmar que há anomalia estatisticamente significante na análise do primeiro dígito dos valores licitados nos pregões eletrônicos das licitações. Constata-se também que os pregões com primeiro dígito de números 4, 8 e 9 são os que apresentaram maiores diferenças entre o valor observado e o valor esperado, fortalecendo a hipótese de que esses representam os pregões com maior incidência/probabilidade de desvios. O estudo, pioneiro nesse tipo de análise na base de dados brasileira, visa a contribuir para a literatura focada na detecção de fraudes contábeis ou financeiras no setor público. Os resultados da pesquisa indicam que podem contribuir, também, para a prática da fiscalização na gestão pública. É recomendado aprofundar a análise das licitações estudadas, visando a confirmar os indícios constatados, e focar em estudos baseados na economia da corrupção nas questões que envolvem a detecção de fraudes, a fim de que a corrupção se torne inviável ou inoportuna.

A reforma operada no regime dos recursos cíveis pelo decreto-lei 303/2007, de 24 de agosto, introduziu um novo fundamento de recurso extraordinário de revisão. De acordo com o disposto na alínea f) do artigo 771.º do Código de Processo Civil português, uma decisão transitada em julgado pode ser objeto de revisão quando seja inconciliável com decisão definitiva de uma instância internacional de recurso vinculativa para o Estado Português. O presente texto constitui uma reflexão sobre a (in)conformidade com o direito da União Europeia da solução erigida pelo legislador português para conseguir o equilíbrio entre segurança jurídica e validade (aqui reconduzida à jurisprudência do Tribunal de Justiça da União Europeia), ao estabelecer para o recurso extraordinário de revisão um prazo de caducidade máximo de cinco anos, contado desde o trânsito da decisão a rever, nos casos em que esta decisão tenha sido tomada por órgão jurisdicional de última instância que não cumpriu a sua obrigação de reenvio prejudicial. ; The reform operated in the regime of civil appeals by the Decree-law 303/2007, from 24 August 2007, introduced a new basis for an extraordinary appeal for review. This paper states our views on the (in)conformity with EU law of the solution put forward by the Portuguese legislator in order to ensure, on the one hand, the legal certainty and, on the other hand, the validity (here entailed in the jurisprudence of the CJEU), by establishing for the extraordinary appeal for review a maximum preclusion time limit of five years from the moment the ruling under review is passed, in cases in which the decision was made by a court of last resort, that failed to fulfill its obligation to ask for a preliminary ruling.

DOI:10.1590/2179-8966/2020/46944ResumoEste artigo objetiva, em geral, caracterizar o regime jurídico da Lei Geral de Proteção de Dados sob os conceitos apresentados pelo capitalismo de vigilância, tendo como objetivos específicos: (I) descrever a economia política da vigilância e o papel do titular de dados/ usuário de serviços digitais e (II) identificar a inserção da LGPD no contexto da exploração econômica dos dados pessoais por meio do instrumento do consentimento do titular. Resultados: (I) A LGPD pode ser considerada um suporte jurídico para a acumulação capitalista na era informacional, possibilitando a condição de um titular de direitos relativos aos dados que pode negociar os seus dados com as empresas capazes de lidar com o contexto do Big Data e extrair desses dados comportamentos a serem vendidos em um mercado de dados que vende previsões de consumo e de vida cotidiana; (II) O grande mecanismo econômico identificado com a exploração é a extração de mais-valia comportamental, que é o processo que extrai das experiências da vida cotidiana dos usuários dados relevantes que são transformados em mercadoria; (III) Da mesma forma que o trabalhador assalariado do capitalismo é aquele que tem parte de sua produção extraída como mais-valor pelo capitalista, na era digital, os usuários conectados ao serem considerados titulares de dados tem sua vida cotidiana transformada em dados rentáveis, expandindo os limites da acumulação capitalista. O método de procedimento utilizado é o dialético-materialista, com abordagem qualitativa e técnica de pesquisa bibliográfica com revisão da literatura em um estudo exploratório.Palavras-chave: Lei Geral de Proteção de Dados; Capitalismo de vigilância; Mais-valia comportamental. AbstractThis article aims, in general, to characterize the legal regime of the General Data Protection Act (LGPD) under the concepts presented by surveillance capitalism, having as specific objectives: (I) describe the political economy of surveillance and the role of the data owner / user of digital services and (II) identify the insertion of LGPD in the context of the economic exploitation of personal data through the instrument of consent of the holder. Results: (I) LGPD can be considered a legal support for capitalist accumulation in the information age, enabling the condition of a data rights holder who can negotiate his data with companies capable of dealing with the Big Data context and extract from these data behaviors to be sold in a data market that sells forecasts of consumption and daily life; (II) The great economic mechanism identified with exploitation is the extraction of behavioral surplus value, which is the process that extracts relevant data from the users' daily life experiences that are transformed into merchandise; (III) In the same way that capitalist salaried workers are those who have part of their production extracted as more-value by the capitalist, in the digital age, users connected to being considered data holders have their daily lives transformed into profitable data, expanding the limits of capitalist accumulation. The method of procedure used is the dialectical-materialist, with a qualitative and technical approach of bibliographic research with literature review.Keywords: General Data Protection Act; Surveillance capitalism; Behavioral added value.

O trabalho analisa as interpretações dadas à Lei de Responsabilidade Fiscal nos 19 anos de sua implantação. Como uma instituição que procura regular a gestão fiscal de governos por todo o País, parte significativa da coerção da Lei no nível regional e local cabe aos Tribunais de Contas de Estados e Municípios. Adotou-se o modelo teórico de mudança institucional de Mahoney e Thelen (2009), com evidências coletadas por questionário, para dar uma primeira explicação para a mudança incremental na legislação fiscal. A Lei de Responsabilidade Fiscal tem sido interpretada pelos órgãos de auditoria, de tal forma que, em alguns casos, surgem práticas de contabilidade criativa, diminuindo a contenção do gasto excessivo e gerando sobre-endividamento. ; The paper analyzes the interpretations given to the Fiscal Responsibility Law after 19 years of its implementation. As an institution that seeks to regulate the fiscal management of governments throughout the country, a significant part of the enforcement of the law at the regional and local level rests with the State and Municipal Courts of Accounts. We adopted the theoretical model of institutional change by Mahoney and Thelen (2009), with evidence collected by questionnaire, to give a first explanation for the incremental change of such fiscal legislation. The Fiscal Responsibility Law has been interpreted by the auditing bodies, in such a way that, in some cases, creative accounting practices emerge, reducing the containment of excessive spending and generating over-indebtedness.
