Борба против корупције спада у најважније задатке сваког друштва и државе, због чега се предузимају бројне активности усмерене у правцу адекватне превенције и сузбијања корупције. Најзначајније активности посвећене су изградњи свеобухватног нормативног оквира у борби против корупције, дефинисању корупције, инкриминацији коурптивних дела, успостављању специјализованих органа за борбу против корупције и изградњи оперативних и техничких капацитета тих органа у циљу успешне борбе против корупције. Мада појам корупције још увек није на јединствен начин дефинисан, корупција се може одредити као злоупотреба овлашћења ради личнекористи. Имајући у виду чињеницу да корупција води осиромашењу друштва и државе и губитку поверења грађана у демократске институције, Република Србија је донела нови Закон о организацији и надлежности државних органа у сузбијању организованог криминала, тероризма и корупције, којим су прописана коруптивна кривична дела и предвиђена је специјализација државних органа ради кривичног гоњења и суђења за та кривична дела. Такође, овим законом прописано је увођење финансијске форензике, службеника за везу са Тужилаштвом за организовани криминал и посебним одељењима за сузбијање корупције и формирање ударних група при надлежним тужилаштивма, а све у циљу успешног истраживања и доказивања коруптивних кривичних дела. У раду су представљени резултати рада Посебног одељења за сузбијање корупције при Вишем јавном тужилаштву у Београду у првој години рада, односно анализирана су: коруптивна кривична дела која су процесуирана, практична имплементација нових законских одредаба којима се унапређује истраживање и доказивање коруптивних кривичних дела и број судски окончаних поступака. Посебно је указано на одређене недостатке у законским решењима који отежавају ефикасну борбу против корупције. ; The fight against corruption is the overriding task of every society and state because of which many activities are undertaken that are directed towards adequate prevention and suppression of corruption. The most important activities are dedicated to building comprehensive normative framework in the suppression of corruption, through defining corruption, incrimination of the corruption offenses, establishment of specialized state bodies for the suppression of corruption and defining operational and technical capacities of these bodies in order to successfully fight against corruption. Although the concept of corruption has not yet been uniquely defined, corruption can be defined as abuse of power for private gain. Bearing in mind the fact that corruption leads to impoverishment of the society and state and loss of citizens` confidence in democratic institutions, the Republic of Serbia adopted the new Law on Organisation and Jurisdiction of Government Authorities in the Suppression of Organised Crime, Terrorism and Corruption that prescribes corruptive criminal offenses and foresees specialization of state bodies in order to prosecute and try such criminal offenses. Also, the law provides for the establishment of financial forensics units, connecting officials within the Prosecutor`s Office for Organised Crime and the Special Department of the Public Prosecutor`s Offices for the Suppression of Corruption and establishment of task forces within mentioned Public Prosecutor`s Offices, in order to successfully investigate and prove corruptive criminal offenses. Since more than one year has passed from the beginning of the application of this law, we will present the work results of the Special Department for the Suppression of Corruption within the Higher Public Prosecution Office in Belgrade. Therefore, in this paper we will analyse: corruptive criminal offenses prosecuted during the first year; practical implementation of the new legal provisions which improve investigation and proving of corruptive criminal offenses and the number of court-terminated proceedings. Special attention will be paid to cooperation between specialized bodies for the suppression of corruption. In addition to the practical application analysis of the Law on Organisation and Jurisdiction of Government Authorities in the Suppression of Organised Crime, Terrorism and Corruption focusing on the example of the Special Department for the Suppression of Corruption in Belgrade, we will point out certain deficiencies in the legal provisions that make it difficult to efficiently fight against corruption.

The paper analyzes the regulation of the institute of the test procedure, especially institutes simplified procedure, as well as administrative actions to the decision in the Law on Administrative Procedure of the Republic of Srpska. Specially processed actions authorized officials in this part of the administrative procedure, which can take place to resolve the administrative matter.Thus, first, in the preamble emphasizes the importance that arranging direct solving has to conduct efficient and cost-effective administrative procedures. In the central part of the shortened institutes and special examination procedures are analyzed in detail, with particular attention paid compared institute immediate resolution of the Institute a summary procedure . In conclusion, the paper briefly discusses the work point out the basic problems and theses, and stresses the duty of officials and that when immediate resolution of protecting the rights of the parties.

Electronic media in many countries have from their inception been linked and defined with commercial content. However, together with the development of the system of commercial radio, democratic countries very soon began to build and/or revamp the alternative systems of public and/or uncommercial radio. The 1994 Croatian Law on telecommunications again allowed private owner-ship of electronic media and consequently the number of radic-stations doubled. There are 114 of them today (excluding Croatian Radio stations). However, the expected democratization of the media resulted only in an increase of commercial and entertaining broadcasts. The true role of the radio as a public media whose purpose is public dissemination of information has been replaced by a new (and profitable) role of public entertainer. Should radio be left there? In Serbia, in the aftermath of 5 October 2000, the process of desecularization, including the revitalization of the Serbian Orthodox Church (SOC), overlapped with the democratization of its political institutions, as well as with the political and social pluralism. The desecularization of the Serbian society had already started in the socialist Yugoslavia, but the process itself intensified in the early period of political pluralism and establishment of the democratic political institutions. Is Orthodoxy compatible with democracy, viewed not only as the will of the majority or an election procedure, but also as a political culture of pluralism and rule of law? Is Orthodoxy possible as a "civic" church, in line with the European political tradition of democracy and pluralism? The author contends that the contemporary Orthodoxy, including the SOC, accepts globalization in its technical, technological and economic sense, with a parallel tendency towards cultural fragmentation. This paper analyses the connection of interests and corruption, especially corruption and political interests. It first considers the notion of interest, i.e. its meanings and significance, both for an individual and for a society. It presents the classification if interests by Albion Woodbury Small. A special emphasis is given to the encounter of different interests as the beginning of clash between humans. The paper analyses individual, special and general interests, as well as their relations. The paper also analyses two levels of conflict of interest: the conflict between public and private interest and the conflict between interests within the public offices. The relation of interests in society and politics is solved in the best way by adopting laws, i.e. by introducing the rule of law into political order. Without that the interest orientation of politicians can easily end up in abuse and illegality. In turn, abuses and illegalities open the possibilities for various kinds of corruptive acts.

The author studies a group of some one hundred Croatian students who studied in Prague in the period 1882-1918. Special attention is given to the group that came to Prague after 1895 when they were expelled from the Zagreb University because of burning Magyar flag. He analyses two journals, Hrvatska misao and Novo doba in which students expressed their ideas regarding a variety of issues relative to their homeland. He also examines reactions of leading journals in Croatia, which exhibited a variety of degrees of acceptance of new student ideas. The author notices a great influence of the Czech professor G. Masaryk on Croatian students. Among those students there were future politicians, such as S. Radic, M. Heimerl, I. Lorkovic, and S. Pribicevic. The author also supplies statisticaI tables, which show that there were 290 students of law, 91 of philosophy, and 63 of medicine. (SOI : CSP: S. 314f.)

The author analyses political, philosophical, ethical and legal implications o the trial in which, in August of 1997, some former members of the Politburo of the United Socialist Party of the former Democratic Republic of Germany were sentenced to prison terms after they had been found guilty for the murders committed by the East German border patrols when trying to prevent people from fleeing to the West. The legal grounds for such a sentence is dubious, not only because it runs counter to the ban on the retroactive enforcement of legal provisions but also because it presupposes the universal validity of the western concept of human rights. If the intention was to react legally to what, from the Western point of view were unpardonable acts during the communist reign, then the most prominent representatives of that system should have been - in accordance with wartime law - treated as the enemies defeated in a (cold) war. The aim of this paper is to establish and clarify the relationship between corruption level and development among European Union countries. Out of the estimated model in this paper one can conclude that the level of corruption can explain capital abundance differences among European Union countries. Also, explanatory power of corruption is higher in explaining economic development than in explaining capital abundance, meaning stronger relationship between corruption level and economic development than between corruption level and capital abundance. There is no doubt that reducing corruption would be beneficial for all countries. Since corruption is a wrongdoing, the rule of law enforcement is of utmost importance. However, root causes of corruption, namely the institutional and social environment: recruiting civil servants on a merit basis, salaries in public sector competitive to the ones in private sector, the role of international institutions in the fight against corruption, and some other corruption characteristics are very important to analyze in order to find effective ways to fight corruption. Further research should go into this direction.

Ovaj ppocec nije nov, ali poctaje cve komplekcniji. Na početky cy to bile vlada i političke partije, ali ce vpemenom bpoj cybjekata koji ygpožavajy zakonodavny nadležnost paplamenta povećavao. U ovom konkpetnom pitanjy, parlament ce cyočava ca ozbiljnim izazovima, dijeleći nadležnost još i ca šefom dpžave, yctavnim cydom, nezavicnim pegylatopim tijelima. Nažaloct, ty nije kpaj. Ppocec evpopckix integpacija, kpoz evpopcky legiclativy, kpeipao je jedny novy oblact zakonodavne djelatnocti izyzete od nadležnosti nacionalnix parlamenata. Cnažne i veoma dicciplinovane političke partije dominipajy, ne camo političkim ppocecima, već i kompletnim parlamentarnim ppocedypama i njixov napactajyći yticaj ygpožava podjely vlacti kojy ycpoctavlja yctav i ppoyzpokyje probleme y fynkcionicanjy parlamenta yopšte. C obzipom na njixov značaj, one cy y ovom pady analizipane kao nepocpedni aktep, ali i indipektno, kao činilac koji kontpoliše odpeđene inctitycije koje ygpožavajy zakonodavny nadležnost parlamenta. Značaj diceptacije ogleda ce y tome što ovoj ppoblematici do cada nije pocvećena pyna pažnja, koja ykljyčyje ppocec evpopckix integpacija i nezavicnix pegylatopnix tijela. Zakljyčak koji cmo donijeli nakon ictpaživanja je da očigledno poctoji potpeba za parlamentarnom pefopmom koja će yčiniti zakonodavni poctypak efikacnijim, a zakonodavno tijelo cnažnijim. Genepalno, cmatpamo da je neopxodno cnaženje tpadicionalne podjele vlacti. Diceptacija takođe ppedlaže cpecifična konkpetna pješenja y kontekcty pefopme zakonodavnog poctypka. ; This dissertation is dealing with legislative parliament function and its relation with other particular institutions that take away stipulated powers from parliament causing his marginalization. This process is not new but it"s become more complex to deal with. In the beginning there was government and political parties, but during the time, number of actors that threaten the legislative competence of parliament increased. On this particular issue, modern parliament facing difficult challenges, sharing his competence with head of the state, constitutional court, independent regulatory agencies. Unfortunatelly, that is not the end. EU integration process, through the European legislation, creates new area of legislative activity excluded from the national parliaments. Strong and highly disciplined political parties are dominating not only political process but whole parliamentary procedures, and its increasing influence causes further damage to separation of powers that constitution establishes and harms parliament particulary. Considering their impact in this process, they are studied in this work directly, and indirectly – as an acter that control other particular institutions which threaten legislative competence of parliament. The importance of the dissertation is reflected in the fact that this issue does not have full attention including EU integration process, indepedent regulatory bodies. The conslusion that we made after the research is that obviously there is a need for parliamentary reform which will make law-making process more efficient, and legislative body stronger. Basically, we find it necessary strengthening of the traditional separation of powers. Dissertation also proposes specific solutions in the context of the law-making process reform.
