ESTATUTOS DE AUTONOMÍA Y FRAGMENTACIÓN DE LA ADMINISTRACIÓN. LA LEALTAD FEDERAL
In Spain the different Statutes of Autonomy are undergoing substantial revision. That revision is being made with repeated invocations of the federal model, without noticing that it would never permit a process in which the federated pieces did not form a whole with the federal pieces. There must first exist an overall agreement on such fundamental questions as competencies, financing, institutional relations, etc. Lacking such an agreement at the political level, the situation must be corrected at the legal level. In Germany, which has been the great model for Spanish constitutional design, the notion of constitutional loyalty has been a key element, developed, among others, by the Federal Constitutional Court. The Spanish Constitutional Court, however, until now has not gone into the sacramental foundation of the principle, there where it hides its ultimate authority and, therefore, it finds itself detained for the moment at the starting point of a road it has yet to cover.Because loyalty is the hinge of the state, the lubrication that "serves to facilitate movement", it reconciles the pieces of the decentralised federal system (federal, regional, or whatever you want to call it). Loyalty acts as the backdrop, which is what in the theatre strictly speaking closes the scene, giving sense to the whole set. ; En España se está realizando una gran renovación de los diferentes estatutos de autonomía. Esa renovación se está haciendo con reiteradas invocaciones al modelo federal, sin advertir que éste jamás permitiría un proceso en el que las piezas federadas no formen un todo con las piezas federales. Debe existir un acuerdo previo de conjunto acerca de cuestiones fundamentales como las competencias, la fi nanciación, las relaciones institucionales, etc. A falta de un acuerdo tal en el nivel político, la situación debe ser corregida en el nivel jurídico. En Alemania, que ha sido el gran modelo del diseño constitucional español, ha sido un elemento clave la noción de lealtad constitucional, desarrollada firmemente, entre otros, por el Tribunal Federal Constitucional. El tribunal español, sin embargo, hasta ahora no ha entrado en el fondo sacramental del principio, allá donde el mismo esconde su máxima autoridad y, por consiguiente, se encuentra detenido de momento en un punto inicial del camino que aun ha de recorrer. Porque la lealtad es el gozne del Estado, la bisagra que "sirve para facilitar el movimiento", el acomodo entre las piezas del sistema político descentralizado (federal, regional, o como se lo quiera bautizar). La lealtad actúa así como telón de foro que es el que en el teatro cierra en rigor la escena prestando su sentido a la decoración toda.
