La tesi di laurea si propone di esplorare il ruolo che le corti supreme o costituzionali possono svolgere nella risoluzione delle controversie secessioniste che si verificano in Stati federali e/o regionali le cui costituzioni non disciplinano espressamente l'argomento della secessione, attraverso l'analisi di cinque casi di studio concreti riguardanti altrettanti Paesi e le rispettive corti. Nella prima parte si esamina l'importanza assunta dai fenomeni secessionisti in tempi recenti, si introducono i concetti fondamentali per l'analisi e si espone la struttura generale dell'elaborato. Nella seconda parte si cerca di stabilire se una parte del territorio di uno Stato possa ricavare un diritto alla secessione dall'architettura costituzionale dello Stato federale o dal diritto internazionale pubblico, con riferimento alle divergenti posizioni della dottrina e ai possibili legami con il diritto di resistenza; infine si accenna all'argomento delle clausole costituzionali di secessione e di quali siano le ragioni che militano a favore o contro la loro previsione. Nella terza parte si introduce lo studio dei vari casi concreti partendo da quello degli Stati Uniti, per illustrarne l'evoluzione costituzionale ed il mutamento di atteggiamento del mondo politico e giuridico verso la secessione, dapprima comunemente ritenuta lecita e, poi, dopo la Guerra civile, riconosciuta contraria alla Costituzione dalla sentenza Texas v White della Corte Suprema. Nella quarta parte ci si concentra sul Canada, ripercorrendo le vicende della sua origine federale e dei due referendum sull'indipendenza del Québec, per approdare poi all'esame della reference della Corte Suprema del 1998, che ha ritenuto possibile a certe condizioni la secessione ed ha avuto una forte influenza politica e scientifica anche all'estero. Nella quinta parte viene preso in esame il caso di maggiore attualità, quello della Spagna, e del ruolo che il Tribunal Constitucional ha avuto nel gestire la crisi catalana. Si sottolinea a tale proposito come il giudice costituzionale, nonostante alcuni tentativi di mediazione fra le parti, abbia finito, a causa dei contenuti di certe sue sentenze, soprattutto quella del 2010 sul nuovo Statuto catalano, per essere percepito dalla Catalogna come un attore non neutrale e schierato sulle posizioni del Governo spagnolo, con grave danno per la sua legittimazione. La sesta parte tratta del Regno Unito, analizzando in dettaglio gli sviluppi della devolution e la vicenda del referendum sull'indipendenza della Scozia del 2014, che è stato possibile grazie ad un accordo consensuale fra i due governi. Si parla inoltre della sentenza Miller del 2017 della Corte Suprema, che ha affrontato anche la questione del possibile ruolo svolto dalle devolved jurisdictions nel meccanismo innescato dalla c.d. Brexit, e di come questa sentenza sia stata accolta da Scozia e Irlanda del Nord, rafforzando i sentimenti favorevoli alla secessione. Nella settima parte si esamina il caso dell'Italia, dapprima con riferimento alle varie sentenze della Corte Costituzionale che hanno respinto le pretese di esercizio di poteri sovrani di alcune Regioni, in seguito con focus sulla sentenza 118/2015 che ha stabilito l'incostituzionalità della legge che prevedeva un referendum consultivo sull'indipendenza della Regione Veneto. Nell'ottava parte, infine, vengono tratte le conclusioni dell'intero lavoro, evidenziando come le cinque corti prese in esame si siano mostrate in linea di principio più o meno aperte a mettere in discussione il principio dell'unità nazionale e ad ammettere la possibilità di una secessione a seconda che abbiano natura di federalismi "puri" o semplici Stati regionali decentrati. This paper is aimed at exploring the possible role of supreme and constitutional courts in handling secessionist disputes taking place in federal or regional States whose constitutions do not explicitly take secession into account. We will do that by analising five actual cases involving five countries and their courts. In the first part we will examine the importance of secessionism in recent times, we will introduce the fundamental concepts for our analysis and we will outline the general plan of the paper. In the second part we will try to clear whether a portion of a State's territory can derive a right to secession from federal States' constitutional structure or internationl public law. We will refer to the different authors' conflicting viewpoints and to the possible links with the concept of "right to revolution". Finally we will briefly discuss the subject of constitutional secession clauses and their pros and cons. In the third part we will introduce the case study by analysing the United States. We will explain their constitutional evolution and the change of political and jurisprudencial attitudes towards the subjects of secession, which was at first thought to be legal. After the Civil War, the U.S. Supreme Court ruled it as unconstitutional in Texas v White (1869). In the fourth part we will focus on Canada and we will discuss its federal origin and the two Quebec independence referenda . We will then examine the Supreme Court's Quebec Secession Reference of 1998, which ruled the secession as constitutional, provided some conditions are met, and which had a strong political and jurisprudencial influence in Canada as well as abroad. In the fifth part we will examine the most important recent case, that is Spain, and we will discuss the role the Spanish Tribunal Constitucional had in handling the Catalan crisis. We will show that, despite some attempts to mediate, the Court came to be perceived by Catalonia as a partial actor, aligned with the Spanish Government. This happened because of the contents of some of the Court's decisions, such as the one in 2010 on the Catalan Statute, and it severely damaged its legitimacy. The sixth part discusses the United Kingdom, and it analyses the devolution system's developments and the Scottish independence referendum in 2014, which was made possibile by the two governements' agreement. We will also discuss the UK Supreme Court Miller judgement in 2017, which dealt with the devolved jurisdictions' possible role in the Brexit mechanism, and Scotland's and Northern Ireland's reactions to it, as it strenghtened secessionism. In the seventh part we will discuss the Italian case; first we will refer to the the several judgments by Italy's Corte Costituzionale which rejected some Regions'claims to sovereign powers. We will then focus on Judgement 118/2015, which ruled as unconstitutional the law providing for an advisory referendum on the independence of the Veneto Region. In the eighth part we will draw some conclusions, highliting the five court's different attitudes towards the principle of national unity and secession and their relationship with the States' nature as "true" federalisms or mere devolved regional States.
La seguente tesi è frutto di una ricerca attraverso i manuali del diritto amministrativo e l'unione di testi specifici per ogni argomento trattato. Siamo di fronte ad una tesi di matrice compilativa e non sperimentale, questo perché non ritengo la necessità di dover apportare nuove scoperte o nuove analisi in aggiunta al materiale presente nel nostro diritto, dal momento che ritengo la nostra giurisprudenza dotata di grande vastità per quel che riguarda i contenuti e di una spiccata specificità per quanto riguarda l'ambito della normazione. In conseguenza a ciò, il mio fine, sarà quello di riuscire a creare un piccolo manuale che possa essere di aiuto a tutti coloro che per la prima volta si ritroveranno a confrontarsi con la tematica dei vari servizi pubblici, riuscendo così a creare un collegamento sul piano pratico tra le nozioni presenti nel seguente elaborato e i servizi pubblici. Nel particolare andremo a mettere in relazionare i servizi che riteniamo di maggiore utilizzabilità nella quotidianità con l'aspetto normativo. L'elaborato seguente si articola in cinque capitoli. Nel primo capitolo troveremo la matrice storica e il percorso susseguitosi per arrivare alla normazione attuale attraverso un percorso cronologico che porrà le proprie radici nel 900, fino ad arrivare agli inizi del ventesimo secolo, attraverso un processo di unificazione della normativa Nazionale a quella di matrice Europea. Verrà presa in analisi la parte del diritto pubblico attinente all'economia e analizzeremo le novità istituzionali che hanno permesso l'attuazione dei servizi pubblici locali. Il secondo capitolo metterà in collegamento la parte normativa dei servizi a quella operativa, introducendo i principi fondamentali e il processo attraverso il quale verrà assunta un'attività a regime di servizio pubblico; caratterizzata dalla gestione diretta e indiretta del servizio, utilizzando collegamenti temporali per riuscire a comprendere il risultato attualmente ottenuto. Il terzo capitolo verterà sui servizi con rilevanza economici, come abbiamo già detto abbiamo preso in considerazione servizi la cui osservabilità è vicina a tutti noi, ci riferiamo ancora una volta al primo paragrafo del seguente capitolo il quale esplicherà il settore dei trasporti attraverso esempi di natura pratica. Gli altri servizi che tratteremo sempre nel seguente capitolo riguarderanno il settore energetico e quello delle telecomunicazioni. Il quarto capitolo tratterà i servizi senza rilevanza economica, tre saranno le tipologie di servizio prese in considerazione, con una piccola parantesi, la quale andrà a contenere specificazioni per quel che riguarda il servizio sanitario in relazione agli articoli costituzionali e alla struttura/organizzazione stessa del servizio. Abbiamo ritenuto di fondamentale importanza accostarci accanto al settore sanitario il servizio scolastico e l'assistenza sociale. L'ultimo capitolo interesserà il regime delle autorizzazioni ovvero gli ultimi stadi processuali del servizio pubblico, i quali andranno a precedere la fruizione di esso da parte della collettività, nel particolare le fasi saranno attraversate da un'analisi di quei principi ritenuti fondamentali nel codice dei contratti pubblici fino ad arrivare all'esecuzione del contratto stesso. Il tutto cercherà di seguire un filo temporale per quel che sarà possibile, poiché apriremo dei piccoli collegamenti spazio/temporali che faranno capire al nostro lettore le modifiche susseguitesi negli anni. Il tutto sarà spesso analizzato attraverso la correlazione con la legge fondamentale dello Stato italiano, la quale occupa il vertice della gerarchia delle fonti nell'ordinamento giuridico della repubblica, ovvero la nostra Costituzione. The following thesis is the result of research through the manuals of administrative law and the combination of specific texts for each topic covered. We are faced with a compiling and not experimental thesis, this is because I do not consider the need to make new discoveries or new analyzes in addition to the material present in our law, since I consider our jurisprudence to be endowed with great breadth for what it concerns the contents and a marked specificity as regards the standardization field. As a consequence of this, my aim will be to be able to create a small manual that can be of help to all those who for the first time will find themselves confronted with the issue of various public services, thus managing to create a link on the practical plan between the concepts present in the following paper and public services. In particular, we will relate the services that we believe are most usable in everyday life with the regulatory aspect. The following paper is divided into five chapters. In the first chapter we will find the historical matrix and the subsequent path to arrive at the current standardization through a chronological path that will have its roots in the 900, up to the beginning of the twentieth century, through a process of unification of the national legislation to that of a European . The part of public law relating to the economy will be analyzed and we will analyze the institutional innovations that have allowed the implementation of local public services. The second chapter will link the regulatory part of the services to the operational one, introducing the fundamental principles and the process through which a public service activity will be assumed; characterized by the direct and indirect management of the service, using temporal links to be able to understand the result currently obtained. The third chapter will focus on services with economic relevance, as we have already said we have taken into consideration services whose observability is close to all of us, we refer once again to the first paragraph of the following chapter which will explain the transport sector through examples of nature practice. The other services that we will always deal with in the following chapter will concern the energy sector and the telecommunications sector. The fourth chapter will deal with services without economic relevance, three types of service will be taken into consideration, with a small paranthesis, which will contain specifications as regards the health service in relation to the constitutional articles and the structure / organization of the service. We considered it to be of fundamental importance to approach the school service and social assistance alongside the health sector. The last chapter will concern the authorization regime or the last procedural stages of the public service, which will precede the use of it by the community, in particular the phases will be crossed by an analysis of those principles considered fundamental in the code of public contracts up to the execution of the contract itself . Everything will try to follow a temporal thread for what will be possible, since we will open small space / time connections that will make our reader understand the changes that have taken place over the years. Everything will often be analyzed through the correlation with the fundamental law of the Italian state, which occupies the top of the hierarchy of sources in the legal system of the republic, that is our Constitution.
Le fusioni e acquisizioni (M&A) sono operazioni che hanno l'effetto di ridefinire la struttura dell'azienda, l'organico del personale nonché i suoi assetti organizzativi. Si tratta di operazioni complesse caratterizzate da un elevata rischiosità e non sempre riescono a consentire il raggiungimento degli obiettivi di creazione di valore e miglioramento delle posizioni competitive prefissati. Negli ultimi anni le operazioni di M&A si sono fatte sempre più frequenti coinvolgendo sia grandi gruppi industriali che piccole e medie imprese . Significativo è tuttavia il numero di operazioni di M&A che risultano fallire. Il tema, particolarmente attuale, è stato trattato muovendo anzitutto dai motivi che spingono le aziende ad intraprendere fusioni e acquisizioni, soffermandosi poi sulle ragioni, legate alla conflittualità tra gli individui ed in particolare nella dirigenza aziendale, che portano all'insuccesso di tali operazioni. Con il presente lavoro utilizzando uno schema bottom-up si intende, dopo aver dato una definizione generica di governance nonché di M&A, arrivare ad analizzare le determinanti di un eventuale insuccesso della fusione o acquisizione, il quale, il più delle volte, è riconducibile ad una sottovalutazione della necessità di un adeguata pianificazione e al disinteresse rispetto alle problematiche legate alle human resources coinvolte. La letteratura evidenzia come la scarsa attenzione a tali aspetti è riscontrabile soprattutto nella fase di pre-M&A, dove ci si concentra principalmente su questioni strategiche finanziarie e giuridiche, lasciando alla fase post-M&A l'eventuale considerazione e risoluzione delle problematiche organizzative e di integrazione delle risorse umane. Nell'esposizione verranno sottolineati il ruolo delle human resources in tali operazioni, la funzione chiave della leadership come guida sicura per lo human capital coinvolto nell'operazione, nonchè l'essenzialità di un adeguata analisi preliminare della compatibilità e complementarietà delle organizzazioni che si combinano (in termini di competenze, cultura, politiche, ecc…) considerando che qualunque variazione dello status dell'impresa può avere un più o meno accentuato impatto anche sulle persone che operano al suo interno. L'obiettivo della trattazione è evidenziare come, nell' intraprendere operazione del genere la società partecipante che ricopre un ruolo di maggior peso nella stessa, normalmente tende a prevalere sui membri della dirigenza delle altre partecipanti schiacciando la loro posizione o facendo in modo che abbandonino la società, sarebbe piuttosto più opportuna un integrazione tra i membri delle rispettive governance, per valorizzare le capacità e le professionalità dei membri di ciascuna, evitando così di disperdere skills utili e potenzialità valide per la nuova organizzazione, realizzando dunque collaborazione, cercando punti di incontro e mettendo in atto dibattiti costruttivi: la collisione fra diversi punti di vista, metodologie, e impostazioni del vedere le cose, derivanti dalla differente provenienza (e dunque dall'esperienza accumulata in diversi contesti) se ben gestita è sempre costruttiva, pertanto sicuramente da preferire a una ''lotta'' distruttiva e di esclusione o sovrastazione. Si vuol far notare che la maggior parte della letteratura si concentra su conflitti di interesse tra dirigenti e azionisti a seguito di M&A o tensioni nelle risorse umane in generale, più scarna appare invece la letteratura sulle tensioni che si creano nella dirigenza dopo tali operazioni. Si intende dunque, con la seguente analisi, partendo dai contributi esistenti sui conflitti nelle HR in generale, accendere un faro sulla problematica, e dare uno spunto su come possano essere presi in considerazione e risolti i conflitti nel management e nel CdA formatosi nella risultante dopo l'operazione di M&A. Mergers and acquisitions (M & A) transactions which had the effect of redefining the structure of the company, the staff as well as its organizational structure. They are complex operations characterized by a high risk and not always able to allow the achievement of the objectives of value creation and improvement of previous competitive positions. In recent years, M & A have become more and more frequent, involving both large corporations and small and also medium enterprises. It is significant, however, the number of M & A operations that appear to fail. The theme, particularly relevant, was treated first by moving motives that drive companies to undertake mergers and acquisitions, then focusing on reasons related to the conflict between individuals and particularly in the company management, which lead to failure of such operations. With the present work after having given a general definition of governance as well as M & A, by using a bottom-up scheme i want to get to analyze the determinants of a possible failure of the merger or acquisition, which, more often than not, is attributable to an underestimation of the need for adequate planning and disinterest with respect to issues related to the human resources involved. The literature shows that the lack of attention to these aspects is especially noticeable in the pre-M & A, where their focus is on financial and legal policy issues, leaving the post-phase M & A any consideration and resolution of organizational issues and integration human resources. In this paper will be highlighted the role of human resources in such operations, the key function of leadership as a sure guide for the human capital involved in the operation, as well as the simplicity of a proper preliminary analysis of the compatibility and complementarity of the organizations that are combined ( in terms of skills, culture, policies, etc .) whereas any change in the status of the undertaking may have a more or less accentuated impact also on the people who work within it. The goal of the discussion is to highlight how, in to undertake an M&A company that plays a greater role normally tends to prevail over the leadership members of the other participants enterprises crushing their position or making then sure that abandon companies, would be rather more appropriate to integrate the members of their governance, to enhance the skills and professionalism of the members of each, thus avoiding release skills useful and potential valid for the new organization, thus making cooperation, looking and meeting points putting in place constructive debates: the collision between different points of view, methodologies, and settings of seeing things, arising from different origins (and therefore from the experience accumulated in different contexts) if well managed is always constructive, therefore definitely preferable to a destructive '' fight ''. Most of the literature focuses on conflicts of interest between managers and shareholders as a result of M & A or tensions in human resources in general, more It is lacking literature on the tensions that are created in the leadership after these operations. It therefore intends, with the following analysis, building on existing contributions on the conflicts in HR in general, turn on a light on the problem, and give a hint of how they can be considered and resolved the conflicts in the management and the Board of directors and management created after an M&A
Oggetto della ricerca è l'analisi della gestione del conflitto sindacale nelle relazioni industriali nell'Unione europea, e in particolare l'assenza del riconoscimento dello sciopero tra le materie legislative di competenza della Comunità europea. Lo studio è strutturato in tre capitoli. Il primo è dedicato all'esame degli aspetti fondamentali del sistema di relazioni industriali in Europa; in particolare vengono ripercorse le tappe dell'evoluzione del dialogo sociale, i principali attori e regole, le differenti modalità di organizzazione delle parti sociali, le forme di partecipazione dei lavoratori nonché il sistema delle relazioni industriali nell'Unione Europea. Il secondo capitolo è incentrato sul tema del riconoscimento all'interno dei diritti sociali fondamentali "comunitari", del diritto di sciopero. In particolare, nei paragrafi centrali l'attenzione si incentra, sul diritto dei lavoratori a ricorrere ad azioni collettive per la difesa di propri interessi, così come sancito nella Carta dei Diritti Fondamentali dell'Unione Europea, (proclamata a Nizza il 18 dicembre 2000). Nonostante tale importante riconoscimento, la regolamentazione del diritto di sciopero non rientra tra le materie legislative di competenza della Comunità europea (art. 137.5, del TUE, ora art. 153.5 TFUE). L'esclusione può essere letta come espressione della volontà politica degli Stati membri di rispettare gli standard nazionali, rinunciando a qualsiasi interferenza del diritto comunitario su un terreno nel quale è difficile prospettare armonizzazioni normative, in ragione della eccessiva difformità delle discipline nazionali. Tale scelta ha, tuttavia, determinato una grande differenziazione tra le discipline nazionali, con particolare riferimento alla regolamentazione dello sciopero nei servizi pubblici essenziali. Il tema dell'esclusione si è riproposto e acutizzato negli ultimi anni a seguito di una serie di pronunce della Corte di Giustizia, relative ai casi Viking, Laval e recentemente Commissione vs Germania. In particolare, nel secondo paragrafo sono analizzate le sentenze Viking e Laval, abbinate non solo dal contenuto, ma anche dalla prossimità temporale, la prima dell'11 dicembre, la seconda del 18 dicembre 2007 che registrano un cambiamento rispetto alla precedente fase di indifferenza, in quanto per la prima volta, il diritto di sciopero è riconosciuto come diritto fondamentale dell'Unione europea. L'attenzione è posta anche sulla recentemente pronuncia della Corte di Strasburgo sul diritto di sciopero che con la sentenza Enerij del 21 aprile 2009 marcherebbe una netta evoluzione giurisprudenziale, in quanto si potrebbe sostenere che la Corte abbia ritenuto che il diritto di sciopero, fintantoché è esercitato per sostenere la contrattazione collettiva, è ugualmente essenziale alla libertà sindacale e pertanto direttamente riconosciuto e tutelato dall'art. 11 della Convenzione Europea per i Diritti dell'Uomo. Il terzo capitolo, infine, si propone, pertanto, di analizzare comparativamente le soluzioni legislative adottate dall'ordinamento italiano, francese, inglese e tedesco, riguardo la disciplina dell'azione di autotutela collettiva e del diritto di sciopero nei servizi pubblici essenziali nei principali Paesi dell'Unione Europea dove, i differenti ordinamenti nazionali rendono difficile un confronto teso al raggiungimento di una disciplina comune. In particolare, la legislazione italiana con la previsione di una apposita Commissione di garanzia, quale autorità pubblica indipendente, cui sono affidati compiti di verifica e anche di statuizione in relazione alle prestazioni indispensabili da effettuare per garantire ai cittadini la possibilità di continuare a fruire, seppure con delle limitazioni, dei propri diritti costituzionalmente tutelati, rappresenta un caso unico in Europa che pone l'Italia sotto questo profilo in una posizione più avanzata rispetto all'Europa. ; Object of the search is the analysis of the management of the trade-union conflict in the industrial relations in the European Union, and in particular the absence of the acknowledgment of strike between the legislative matters of competence of the European Community. The study is structured in three chapters. The first one is dedicated to the examination of the fundamental aspects of the system of industrial relations in Europe; in particular they go over again the stages of the evolution of the social dialogue, the main actors and rules, the different kind of organization of the social parts, the forms of participation of the workers let alone the system of the industrial relations in the European Union. The second chapter focuses on the topic of the acknowledgment inside of "communitarian" fundamental of the social rights and of the strike right. In particular, in the middle paragraphs the attention is focused on the right of the workers to resort to collective actions for the defense of own interests, thus like sanctioned in the Paper of the Fundamental Rights of European Community, (proclaimed in Nizza 18 December 2000). Although such important acknowledgment, the regulation of the strike right is not included between the legislative matters of competence of European Community (art. 137.5, del TUE, ora art. 153.5 TFUE). The exclusion can be read like expression of the political will of the Member States to respect the national standards, renouncing to any interference of the communitarian right in a branch in which it is difficult to show normative agreements in reason of the excessive difference of the national disciplines. Such chosen it has, however, determined a great differentiation between the national disciplines, with detail reference to the regulation of strike in the essential public services. The topic of the exclusion has been reproposed and intensified during the last few years as a result of a series of judgment of the Law court, relative to the cases Viking, Laval and, recently, Commission vs Germany. In particular, in the second paragraph are analyzed the Viking and Laval sentences, matched not only by content but also by the temporal proximity, the first of 11 December, the second of December 18 2007. They records a change regarding the precedence phase of indifference, as for the first time, the strike right is recognized like fundamental right of the European Union. The focus is also on the recent ruling by the Strasbourg Court on right to strike, in its judgment of 21 April 2009 Enerij would mark a clear development of the case, as it could be argued that the Court has held that the right to strike, as long as it is exercised to support collective negotiation, it is equally essential to freedom of association and therefore directly recognized and protected by art. 11 of the European Convention on Human Rights. The third chapter, at last, proposes, therefore, to analyze comparatively the legal approaches adopted by the Italian, French, English and German rules, about the discipline of the collective self-defense and the right to strike in essential public services in main countries of European Union, where the different national rules make difficult a compare aimed to the reach of a common framework. In particular, the Italian legislation with a provision for a special Commission of guarantee, represents a unique case in Europe and place Italy in a more advanced position than the member States. This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, theFerghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan andKyrgyzstan.A basis of the research, field trips spread over the past three years enabled the development ofinstruments such as border analysis, analytical cartography, qualitative interviews with experts andinhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent– noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to thefield trips in Central Asia, a research period in France permitted both a consolidation in geopoliticaltheory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, andadditional bibliographical research at the French National Library (BNF).The topic of the research is hence the analysis of power rivalries between "territorial actors" overthe "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the largergeopolitical context of Central Asia. Always a stake disputed by various territorial actors over time,the Fergana Valley now experiences power rivalries from contemporaneous territorial actors firstand foremost on the border and transborder levels.By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis:the cultural regionalism. The dissertation hence offers a detailed presentation of the culturalregionalism as well as an evaluation of its past and current importance.First focusing on the centrasiatic context and the peculiarities which stem from its borders, theintroduction presents the "stake" Fergana and its economic and physical resources which explainits importance as a territory. A rapid summary of the theory of geopolitics follows, with thejustification of the choice of the French Lacostian school as the theoretical frame of this work. Theintroduction closes on a first analysis of the Fergana as a space of border or frontier.First partThe thesis is structured in two main parts. The first, more theoretical, analyses each of the threeterritorial actors which aim for power over the Fergana: the Nation, the Religion, and the CulturalRegionalism. The presentation of the actors, of their respective embodiments and of theirmanifestations within the ferganian territory is organised according to a conceptual rationale; eventsthat occurred simultaneously are thus not considered following a chronological order, butseparately, according to their respective relations with the actors evoked.The first chapter focuses on the actor Nation. By this word we understand not only the effectiveentity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but alsothe Nation as an ideology which acts upon the territory through nationalistic policies. The force oflegitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in theFerganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchyin the region. This chapter also analyses the representations of the Fergana which are defined andimplemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first becamea transborder region only in these years, through its integration to the Union of the Socialist SovietRepublics (USSR) and its partition between three of the five newly created Socialist SovietRepublics in Central Asia. In the 1990s, following the fall of the USSR and the independence of thethree Republics, the borders which divided the Ferghana stopped being only internal, but becamereal and proper international borders. Among the main representations that this study looks at, aparticular attention is devoted to the study of the national borders , their creation and theirevolution. The chapter also looks at the relations between the different Nation-States, which form aunique actor when they rival against the other territorial actors – the Religion and the CulturalRegionalism –, but three well different ones when they rival among themselves.The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valleyis one of the most pious and practicing region of Central Asia, and the Islamic religion alwaysplayed a major role in the society's administration and organization.The chapter proposes first an analysis of the religion's representations in the Fergana: theautochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam ofthe soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in theFergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistanand Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it inducedbetween the soviet muslims and the afghan mujaheddins.It is then examined how the different variations of the actor opposed themselves to the actor Nation,over the years, for the control over the power and the resources of the Fergana. We look at how thegeopolitical rivalries vary dramatically from the soviet era to that of the independence. A specialattention is devoted to the phenomenon of politization of the actor Religion and the way this led theReligion to endorse a role of protagonist in many of the Fergana's events.The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of thisregional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as theFergana has existed as a place, it has always constituted a geographical, political and social whole.Although its population has been characterized during the past centuries by high levels ofmultiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation ofpopulations which always held multiethnicity as normality, and always attributed to each "group" aspecific social role within the system Fergana.Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic,these populations always shared, each in its own social role, a common life within the region. Thisvery phenomenon is the main characteristic of what we call the Cultural Regionalism of theFergana.However, this equilibrium changes with the loss of political sovereignty of the region and the rise ofnationalism under the soviet sovereignty. This chapter analyzes the main representation of the actorCultural Regionalism over time, and how it took stand against the other territorial actors, especiallythe Nation.Second partThe second part of the dissertation as dedicated to the current manifestations of the territorial actorsin the Fergana valley, particularly in its border zones. This part results from the interviews and fieldobservation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010.The first chapter analyzes the border of this region from a theoretical point of view, especially in thelight of the geostrategical categories of "first line of defence" or "last line of defence".In the context of a transformation of the border from the soviet era to that of the independence, thesecond chapter explores the definition of the centrasiatic border, mainly through the analysis ofborder bureaucracy, control posts and documents required to cross the border. The chapter looks atthemes connected to the commercial transborder relations : how the "three" Fergana still manage tointeract despite growing border rigidity, which social relationships subsist today. The qualitativeinterviews led in the Fergana are a major source in this process of reviewing the difficulties ofpassage and communication within the valley, and of tracking the actual presence of the threegeopolitical actors which play a major role in the border relations and conflicts.The third chapter focuses on the Ferganian urban centres: their history, the relations that theFerganians have with them, et above all the internal and external representations of these centres ina now fully transborder region.The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Upuntil then a land of immigration, the Fergana became a land of emigration following theindependence and the materialization of the borders.The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, andtheir relationship of reciprocal influence with the mutation of the borders in the region.The sixth chapter builds on the theoretical interrogations evoked in the introduction of thedissertation and develops a conclusive analysis of the Fergana of the borders nowadays.ConclusionThe conclusion of this research depicts the current Fergana, the relations between the differentgeopolitical actors and underscores the persistence of the actor Cultural Regionalism.It establishes the existence of tremendous changes in the region Fergana from various viewpoints:the Ferganian population has new frames of cultural, political and social reference whoseimportance increased dramatically ; new political forms and cultural structures influenced its selfimage,its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz),atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian".However, although the territory, its borders and inhabitants changed, and despite the strongobstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, byadapting to the new tendencies and ways of interpretation of the Fergana.The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 andthe Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries whichpersist in the region. ; IntroductionCette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asiecentrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, duTadjikistan et du Kirghizistan.Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers del'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts ethabitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèkeTachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). La force de légitimation de l'acteur Nation n'est pas étrangère àl'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de lahiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations duFerghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avecson intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre troisdes cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans lesannées 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières quidivisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bieninternationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre,une attention particulière est portée aux frontières nationales, leur création et leur évolution. Lechapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent unacteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et leRégionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoireFerghana entre eux.Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée duFerghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religionislamique y a toujours eu un rôle important dans la gestion de la société.Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : lesoufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans leFerghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée parMoscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbiterécemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite del'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivieentre les musulmans soviétiques et les moudjahiddines afghans.Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sontopposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources duterritoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie dutout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien aucours de l'ère ayant succédé à l'indépendance.Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à lamanière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans denombreux évènements du Ferghana.Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence àl'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes etreligieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana atoujours constitué un ensemble géographique, politique et social à part entière. Bien que sapopulation se soit distinguée au cours des derniers siècles par une grande multiethnicité ethétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui atoujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » unrôle social déterminé au sein du système Ferghana.Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque etsédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé,chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomèneest la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana.Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènementdu nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations del'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteurRégionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteursterritoriaux, en particulier à l'acteur Nation.Seconde partieLa seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dansla vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat desentretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours deséjours en 2007, 2009 et 2010.Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumièrenotamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne dedéfense".Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle del'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, autravers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et desdocuments requis pour le passage de la frontière. Les thématiques liées aux relations commercialestransfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagirmalgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent ausein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôlemajeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dansles descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujoursjouent un rôle fondamental dans les relations et conflits de frontière.Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que lesFerghaniens entretiennent avec eux, et surtout les représentations internes et externes que lescentres urbains assument au sein d'une région désormais tout à fait transfrontalière.Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque làterre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu uneterre d'émigration avec l'indépendance et la concrétisation des frontières.Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré etroutier, et leur rapport d'influence réciproque mutations frontalières de cette région.Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développeune analyse conclusive sur le Ferghana des frontières aujourd'hui.ConclusionLa conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre lesdifférents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel.Force est de constater l'existence de changements dans la région Ferghana à différents points devue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques etsociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structuresculturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin"ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne".Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré lesobstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, ens'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana.La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoirgéopolitique qui persistent encore dans la région.
[ita] La presente tesi si concentra sui processi di decentramento in Italia e Spagna, analizzando l'impatto dei mutamenti del quadro giuridico europeo sull'autonomia finanziaria regionale. L'ordinamento finanziario sovranazionale è stato infatti ampiamente modificato negli ultimi anni (specialmente con riferimento alla c.d. "Eurozona") per affrontare le pressanti sfide di natura macroeconomica derivanti dalla crisi del debito sovrano, che ha coinvolto svariati Stati Membri. L'analisi del tema proposto viene effettuata con il metodo della comparazione, prendendo in considerazione gli ordinamenti italiano e spagnolo. Tale scelta metodologica riposa essenzialmente su due elementi, che integrano il requisito della comparabilità tra i due ordinamenti: a) la vicinanza strutturale e l'influenza reciproca che storicamente si è verificata tra i due modelli di decentramento (che vengono usualmente riportati alla forma – o tipo – di Stato regionale); b) la comune soggezione ai vincoli finanziari derivanti dall'ordinamento europeo, unita a una condizione di grave difficoltà finanziaria che coinvolge il sistema regionale in generale, e – in maniera più acuta – le Regioni e Comunidades Autónomas (d'ora in poi, CC.AA.) che sono state (o sono) colpite da fenomeni di mala gestio. Si presenterà ora brevemente la struttura del lavoro. I primi due capitoli parlano dello Stato regionale in Italia e in Spagna, ossia il contesto, lo "sfondo", nel quale si inserisce il tema dell'autonomia finanziaria, seguendo la contrapposizione astratto/concreto, statico/dinamico: da un lato i modelli elaborati dalla dottrina, dall'altro l'evoluzione storica delle esperienze regionali, in entrambi i casi con particolare riferimento ai profili finanziari. Il primo capitolo descrive dunque la modellistica che viene generalmente utilizzata rispetto alle forme di distribuzione territoriale del potere politico (unione di stati, confederazione, stato federale, stato regionale, stato unitario), con un particolare approfondimento per la problematica categoria dello Stato regionale e, rispetto ad esso, registrando sia le posizioni critiche sull'utilità della categoria sia la particolare rilevanza che il livello di autonomia finanziaria regionale può avere a fini classificatori. Il secondo capitolo tratta invece partitamente le due linee storiche che si incrociano nella tematica in esame. Da un lato, lo sviluppo del regionalismo in Spagna e in Italia e le varie fasi dell'autonomia finanziaria nei due ordinamenti: non sfugge infatti a chi scrive che l'attuale stato delle finanze pubbliche territoriali sia in entrambi i casi il frutto di un complesso processo di evoluzione; tuttavia – ai fini della comparazione – pare opportuno privilegiare l'aspetto sincronico a quello diacronico, concentrandosi sull'ultimo stadio di questo percorso, nel suo intreccio con un sistema normativo e decisionale sempre più complesso, nazionale e sovranazionale. Dall'altro lato, si fa appunto un quadro dell'evoluzione della governance finanziaria europea sotto l'impatto della crisi economico-finanziaria che si è originata a livello globale a partire dal 2008. Tale evoluzione costituisce infatti il presupposto dei mutamenti costituzionali e normativi che si vogliono analizzare nel presente lavoro. Il terzo capitolo, che è il più ampio del lavoro, descrive l'ordinamento finanziario di Regioni e CCAA nel quadro di un sistema normativo che ormai affonda le sue radici nel livello sovranazionale. Obiettivo di questa parte del lavoro è tanto dare conto del sistema delle fonti dell'autonomia finanziaria da un punto di vista formale, quanto esporre ed analizzare le scelte normative compiute in concreto. Al suo interno, il capitolo è tripartito: ordinamento UE, ordinamento italiano e ordinamento spagnolo. La ragione di una trattazione separata dei due Paesi sul piano delle fonti è evidente: si tratta di sistemi peculiari e non sovrapponibili. In Spagna il metodo di finanziamento delle CCAA è determinato da due importanti leggi organiche, la LOFCA (Ley Orgánica de Financiación de las Comunidades Autónomas) e la LOEPSF (Ley Orgánica de Estabilidad Presupuestaria y Sostenibilidad Financiera): diventa dunque essenziale approfondire natura e ambito di competenza di ciascuna di esse, assieme al discusso problema del rapporto tra leggi organiche e Statuti delle CCAA nel sistema delle fonti del diritto. In Italia il quadro delle fonti si è fatto nel tempo sempre più articolato: basti ricordare la previsione di una specifica legge rinforzata da parte della nuova formulazione dell'art. 81, c.6, Cost. e il ruolo della legge delega sul federalismo fiscale (l. n. 42 del 2009) nel condizionare il contenuto dei relativi decreti legislativi di attuazione. All'interno dei paragrafi relativi all'uno e all'altro Paese si cerca di porre in luce i due versanti dell'autonomia finanziaria già esplicitati in precedenza, entrata e spesa. Rispetto al''autonomia di entrata, si dà conto tanto dello spazio concesso alla potestà impositiva di Regioni e CCAA – e quindi il potere di istituire tributi propri regionali e i ccdd. tributos cedidos anche dal punto di vista normativo nel caso spagnolo – quanto del problema centrale del finanziamento delle autonomie territoriali mediante risorse derivanti dai tributi statali, nelle forme della compartecipazione al gettito degli stessi e dei trasferimenti statali. Il profilo dell'autonomia di spesa riceve poi una considerazione altrettanto approfondita. In sistemi regionali in cui la decisione sulle entrate è ancora sostanzialmente in mano al livello di governo centrale, è chiaramente l'autonomia di spesa a concretare più direttamente l'autonomia finanziaria regionale, fino a spingere taluno a coniare la categoria del federalismo fiscale "di spesa". Proprio sull'autonomia di spesa hanno però impattato in maniera più diretta la crisi economico- finanziaria, i vincoli finanziari europei e la loro attuazione a livello interno: quest'ultima è avvenuta non soltanto tramite provvedimenti del legislatore statale volti a porre un limite globale alla spesa delle autonomie, al fine di garantire il rispetto dei vincoli sovranazionali da parte del complesso dei soggetti che compongono la c.d. finanza pubblica allargata (limiti diretti all'autonomia di spesa), ma anche tramite norme di legge che incidevano su ambiti rientranti nella competenza delle Regioni, fra i quali gli aspetti ordinamentali, giustificati dallo scopo di contenimento della spesa pubblica (limiti indiretti). Il quarto capitolo approfondisce il tema delle relazioni finanziarie fra Stato e Regioni/CCAA sul piano dei principi costituzionali: a differenza del capitolo precedente, la trattazione viene svolta trasversalmente fra i due ordinamenti, nella convinzione che vi siano alcune linee fondamentali in comune fra di essi. Si delinea quindi un vero e proprio statuto costituzionale dell'autonomia finanziaria nello Stato regionale che si sostanzia nei seguenti principi: autonomia finanziaria e corresponsabilità fiscale; solidarietà; sufficienza finanziaria (connessione risorse-funzioni); coordinamento finanziario; equilibrio di bilancio e sostenibilità finanziaria; leale collaborazione. Per ciascun principio non si dà conto soltanto dei riferimenti normativi ma soprattutto dell'interpretazione che ne è stata data dalla giurisprudenza costituzionale, istanza deputata a far "vivere" i principi nei mutamenti istituzionali e sociali tramite l'interpretazione costituzionale. Il quinto capitolo approfondisce infine un profilo spesso trascurato a livello dottrinale, ossia quello dei sistemi finanziari delle autonomie differenziate, nell'uno e nell'altro ordinamento. Nel caso italiano, il tema è quello della c.d. specialità finanziaria, che configura un percorso originale e peculiare nel quadro del regionalismo italiano. Il tema parrebbe porsi in maniera più complessa nel caso spagnolo, in virtù della potenziale asimmetria che caratterizza il sistema: tuttavia, in virtù della portata omogeneizzatrice della LOFCA, la maggior parte delle comunità autonome presenta un sistema di finanziamento sostanzialmente unitario. La reale differenziazione si coglie piuttosto rispetto al sistema del convenio e concierto autonómico seguito da País Vasco e Navarra, sistema che costituisce il portato di un lungo percorso storico e concreta una delle peculiarità del regimen foral di questi territori. Specialità finanziaria e regime forale presentano tratti di somiglianza e costituiscono esperienze meritevoli di approfondimento: essi sono da un lato oggetto di critica in entrambi i Paesi in quanto considerati "privilegi fiscali", allo stesso tempo non di rado la estensibilità dei sistemi ad alcune (o a tutte le) Regioni viene fatto oggetto di studio. ; [spa] The first two chapters deal about the "regional State" in Italy and Spain. The first chapter describes the categories that are generally used to classify the forms of territorial distribution of political power (union of States, confederation, federal State, regional State, unitary State), with particular attention to the problematic category of the regional State. The second chapter concerns the two historical aspects of the matter. On the one hand, the development of regionalism in Spain and Italy and the various phases of financial autonomy in the two systems; on the other hand, the evolution of European financial governance under the impact of the economic crisis since 2008. This evolution is, in fact, the precondition of the constitutional and legislative changes that the thesis aims to analyse. The third and fourth chapters are devoted to regional financial autonomy according to a general constitutional perspective: the third from the formal point of view, with reference to the system of sources of law, and the fourth from the substantive standpoint (constitutional principles). In particular, the third chapter deals with financial autonomy and, respectively, with tax power and power of expenditure in the Italian and Spanish cases, considering both the European Union and the internal sources of law. In relation to the tax autonomy, the thesis focuses mainly on the problem of the power of Regions and Autonomous Communities to establish their own regional taxes (and their limits), as well as on the taxes assigned by the State to the Autonomous Communities in Spain. Then, the thesis deepens the central problem of financing territorial autonomies through resources derived from State taxes, in the form of revenue sharing and State transfers. The topic of spending power also plays a central role in the research: the European financial rules and their application have a direct impact on regional spending autonomy. The problem of public debt, which is significantly regulated by the new supranational legal context, will also be considered. The fourth chapter is devoted in particular to the constitutional case law on the following principles: the principle of financial autonomy, the principle of financial sufficiency, the principle of coordination, the balance budget principle, the principle of solidarity and its limits, the principle of institutional loyalty and cooperation. Finally, the fifth chapter deals with a matter often neglected at the doctrinal level, which is the financial systems of differentiated autonomies, in both countries. In the Italian case, the Financial Specialty represents an original and peculiar way within the framework of Italian regionalism. In the Spanish case, the most important differentiation is the system of the convenio/concierto autonómico (agreement) of the Basque Country and Navarre.
2009/2010 ; Lo scopo di questa ricerca di dottorato è l'analisi geopolitica di una regione transfrontaliera dell'Asia centrale: la valle del Fergana. Tre anni di ricerca sul campo: l'analisi delle frontiere di questa regione attualmente divisa politicamente tra Uzbekistan, Tagikistan e Kirghizistan, la cartografia analitica, le osservazioni, le interviste alla popolazione e agli esperti, la ricerca nelle biblioteche della regione, nella capitale dell'Uzbekistan, Tashkent (presso l'Istituto Francese di Studi sull'Asia centrale – IFEAC) e la ricerca svolta in Francia principalmente presso l'Istituto Francese di Geopolitica (IFG) e la Biblioteca Nazionale di Francia (BNF), sono gli strumenti che hanno permesso lo studio di questo territorio. Il principale obiettivo del lavoro è l'analisi delle rivalità di potere della valle del Fergana. Grazie alla sua fertilità e alla sua importante posizione strategica all'interno del contesto geopolitico centrasiatico, il bacino del Fergana è stato e continua tuttora ad essere una posta in gioco ambita da differenti attori territoriali. La rivalità di potere tra i diversi attori si gioca soprattutto sullo scenario transfrontaliero della regione. Il secondo scopo di questa ricerca è la presentazione e la valutazione di un particolare attore territoriale della valle, il Regionalismo culturale. La parte introduttiva della ricerca si concentrerà su una presentazione del contesto centrasiatico e sulle peculiarità derivanti dalle sue frontiere. In seguito verrà introdotta la "posta in gioco" Fergana con le sue risorse fisiche ed economiche al fine di legittimare l'importanza del territorio. Infine l'introduzione si concluderà con la teoria geopolitica: il perché della scelta della scuola di geopolitica del geografo francese Yves Lacoste per questa ricerca e una prima analisi dello spazio Fergana come regione divisa tra confine e frontiera. Il lavoro è strutturato in due grandi parti. La prima, più teorica, è relativa all'analisi dei tre attori territoriali. Le rappresentazioni dei differenti attori che verranno presentate, non seguiranno un ordine cronologico, ma un ordine concettuale: eventi simultanei verranno dunque analizzati non nello stesso momento, perché relativi a rappresentazioni differenti del territorio Fergana. Il primo capitolo è consacrato all'attore Nazione. Con questa espressione si intende non solo l'attore Stato-Nazione in sé, o meglio gli Stati-Nazione (Uzbekistan, Tagikistan e Kirghizistan), ma anche la Nazione come idea, come politica nazionalistica applicata ad un territorio. La valle del Fergana è diventata una regione transfrontaliera da quando, negli anni '20, fu divisa tra i tre Stati, allora all'interno della Unione delle Repubbliche Socialiste Sovietiche (URSS). Negli anni '90, in seguito alla caduta dell'URSS, il Fergana divenne una regione divisa da frontiere non più interne ma internazionali. Questo capitolo ha come scopo l'analisi di tutte le rappresentazioni dell'attore Nazione per quanto riguarda il contesto Fergana, dalla sua nascita (anni '20) fino all'indipendenza delle Repubbliche (anni '90). Sicuramente la rappresentazione più importante da analizzare è quella della creazione delle sue frontiere. L'attore Nazione è senza dubbio l'attore geopolitico più importante anche perché quello più legittimato in questo contesto territoriale. Il capitolo approfondirà anche le relazioni tra i differenti Stati-Nazione che rappresentano allo stesso tempo: un unico attore (contro la Religione e il Regionalismo culturale) e tre attori differenti quando competono tra loro per il territorio Fergana. Il secondo attore è la Religione. La valle del Fergana è una delle aree centrasiatiche più credenti e praticanti e la religione islamica ha sempre avuto un ruolo importante nella gestione della società ferganiana. Verrà proposta un'analisi di tutte le rappresentazioni della religione nel Fergana: il sufismo autoctono con un'analisi sulla geografia sacra dei luoghi ferganiani importanti per questa corrente dell'Islam; l'Islam tradizionale del periodo sovietico, divenuto un'arma legale utilizzata da Mosca per combattere l'ortodossia religiosa sufi del Fergana; il fondamentalismo wahabbita degli ultimi anni importato dall'Afghanistan, dal Pakistan, dall'Arabia Saudita, come conseguenza dell'invasione sovietica dell'Afghanistan del 1979 e dunque in seguito all'incontro tra i musulmani sovietici e i mujaheddin afgani. In seguito verrà analizzato come le differenti varianti dell'attore Religione si sono opposte, negli anni, all'attore Nazione per il controllo del potere e delle risorse del territorio Fergana. Un fenomeno particolarmente analizzato sarà la politicizzazione dell'attore Religione e come questa politicizzazione ha portato l'attore in questione ad essere l'elemento protagonista di numerosi eventi nel Fergana. Il terzo attore è il Regionalismo culturale. Con questa espressione si fa riferimento all'identità geo-culturale di questo insieme regionale che persiste nonostante le pressioni nazionalistiche e religiose. La valle del Fergana è sempre stata un insieme geografico, politico, sociale, malgrado negli ultimi secoli la sua popolazione si è sempre distinta per il suo alto livello di multietnicità e di disomogeneità linguistica. Questo però, non ha impedito un'amalgamazione sociale di tale popolazione che ha sempre considerato la multietnicità come la normalità e ha sempre attribuito ad ogni "etnia" un ruolo sociale integrato all'interno del sistema Fergana. Popolazioni di lingua e cultura persiana e sedentaria e popolazioni di lingua e cultura turca, sedentaria o nomade hanno sempre condiviso, ognuna con il proprio ruolo sociale, una vita comunitaria all'interno della regione e questa è sicuramente la caratteristica principale del Regionalismo culturale del Fergana. Questo equilibrio cambiò con la perdita di sovranità politica della regione, con l'istituzione dei nazionalismi e la conseguente spartizione della regione tra tre dei cinque nuovi Stati nazionali dell'Asia centrale sovietica. In questo capitolo verranno analizzate le principali rappresentazioni nel tempo dell'attore Regionalismo culturale e come esso si sia opposto agli altri attori territoriali, soprattutto all'attore Nazione. La seconda parte di questo lavoro è stata dedicata all'impatto che gli attori territoriali hanno oggi nella valle del Fergana, soprattutto nelle sue aree di frontiera. Questa parte è il risultato delle interviste e delle osservazioni sul campo effettuate in Asia centrale e in particolare nel Fergana nelle spedizioni del 2007, 2009 e del 2010. Nel primo capitolo verrà analizzata la frontiera di questa regione dal punto di vista teorico, in particolar modo con l'analisi del Fergana come" prima o ultima linea di difesa". Nel secondo capitolo, all'interno di un contesto di base: la differenza tra la frontiera all'epoca sovietica e all'epoca dell'indipendenza, ci sarà un approfondimento della definizione di frontiera centrasiatica, l'esame della burocrazia di frontiera, del posto di blocco e dei documenti del soggetto transfrontaliero. Saranno trattate, inoltre, le tematiche relative alle relazioni commerciali transfrontaliere, come i "tre" Fergana riescono ancora ad interagire malgrado la crescente rigidità delle frontiere e verranno studiate le relazioni sociali transfrontaliere sempre all'interno del panorama ferganiano di oggi. In questo contesto, verranno considerate le interviste svolte nel Fergana, le opinioni riguardo le difficoltà di passaggio e di comunicazione nella valle ed analizzeremo la presenza dei tre attori geopolitici che tuttora giocano un ruolo fondamentale nelle relazioni e nei conflitti di frontiera. Il terzo capitolo sarà dedicato ai centri urbani del Fergana; la loro storia, il rapporto dei ferganiani con le città e soprattutto le rappresentazioni interne ed esterne che i centri urbani hanno assunto all'interno di una regione oggi del tutto transfrontaliera. Il quarto capitolo si concentrerà sulle evoluzioni demografiche della popolazione: il Fergana, che durante gli anni zaristi e sovietici era terra di immigrazione, con l'indipendenza e dunque con la concretizzazione delle frontiere, si ritrova terra di emigrazione. Il quinto capitolo sarà dedicato al Fergana delle infrastrutture: come la strada ferrata e la rete stradale influiscono e sono influenzate dalle mutazioni frontaliere di questa regione. Il sesto capitolo riprenderà degli interrogativi teorici posti all'inizio del lavoro, con un analisi conclusiva sull'odierno "Fergana delle frontiere". La conclusione di questa ricerca, in realtà, è una vero e proprio capitolo di analisi, dove si farà il punto della situazione e si constaterà la persistenza dell'attore Regionalismo culturale, la sua evoluzione e il suo rapporto attuale con gli altri attori geopolitici. Un punto di arrivo fondamentale della ricerca è il fatto che la regione Fergana è cambiata, sotto differenti punti di vista e la popolazione ferganiana ha nuovi punti di riferimento culturali, politici e sociali. Differenti forme politiche e nuove strutture culturali hanno portato la popolazione del Fergana, nel tempo, a mutare la propria immagine e la propria identità: "russa, musulmana, ferganiana", in seguito "sovietica, uzbeca (o tagica o kirghiza), atea, ferganiana" e infine "uzbeca (o tagica o kirghiza), laica, ferganiana". Il territorio, le sue frontiere e la società che lo abita sono cambiati, ma vedremo che, nonostante i forti ostacoli posti dall'attore Nazione, il Regionalismo culturale riuscirà a sopravvivere, adattandosi alle nuove tendenze e ai nuovi modi di interpretare il Fergana. Come ultimo studio sul territorio, faremo degli esempi riguardanti gli eventi più recenti concernenti il Fergana (massacro di Andijan nel 2005, scontri ad Osh nel giugno 2010) ed analizzeremo questi fenomeni alla luce delle rivalità di potere geopolitiche che ancora persistono nella regione. ; Cette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asie centrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, du Tadjikistan et du Kirghizistan. Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers de l'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts et habitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèke Tachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). Ces périodes de terrain ont été complétées par un séjour de recherche en France, articulé principalement autour d'un approfondissement théorique à l'Institut Français de Géopolitique (IFG) de l'Université Paris VIII-Vincennes et de recherches bibliographiques à la Bibliothèque Nationale de France. L'objet de ce travail est donc l'analyse des rivalités de pouvoir entre les acteurs territoriaux sur l'enjeu territorial de la vallée du Ferghana, bassin fertile à la position stratégique dans le contexte géopolitique centrasiatique élargi. Si le Ferghana a toujours constitué un enjeu disputé par différents acteurs territoriaux, les rivalités des acteurs actuels jouent aujourd'hui surtout au niveau frontalier et transfrontalier. Ce faisant, cette thèse introduit un nouvel acteur dans le schéma d'analyse géopolitique classique: le Régionalisme culturel. Le Régionalisme culturel en tant qu'acteur territorial y fait donc l'objet d'une présentation approfondie ainsi que d'une évaluation de son importance passée et actuelle. Concentrée d'abord sur le contexte centrasiatique et les particularités qui découlent de ses frontières, l'introduction présente ensuite « l'enjeu » Ferghana et ses ressources physiques et économiques, qui expliquent l'importance de ce territoire. Elle se poursuit sur un rapide point théorique sur la géopolitique et la justification du choix de l'école de pensée géopolitique de Yves Lacoste comme cadre théorique de cette recherche, avant de s'achever sur une première analyse de l'espace Ferghana à l'aune des catégories de frontières et de confins. La thèse est structurée en deux grandes parties. La première, à dominante théorique, analyse à tour de rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de la Nation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leurs différentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsi abordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsi pas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués. Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons non seulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan, Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers de politiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère à l'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de la hiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations du Ferghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années 1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avec son intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre trois des cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans les années 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières qui divisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bien internationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre, une attention particulière est portée aux frontières nationales, leur création et leur évolution. Le chapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent un acteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et le Régionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoire Ferghana entre eux. Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée du Ferghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religion islamique y a toujours eu un rôle important dans la gestion de la société. Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : le soufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans le Ferghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée par Moscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbite récemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite de l'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivie entre les musulmans soviétiques et les moudjahiddines afghans. Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sont opposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources du territoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie du tout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien au cours de l'ère ayant succédé à l'indépendance. Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à la manière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans de nombreux évènements du Ferghana. Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence à l'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes et religieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana a toujours constitué un ensemble géographique, politique et social à part entière. Bien que sa population se soit distinguée au cours des derniers siècles par une grande multiethnicité et hétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui a toujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » un rôle social déterminé au sein du système Ferghana. Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque et sédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé, chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomène est la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana. Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènement du nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations de l'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteur Régionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteurs territoriaux, en particulier à l'acteur Nation. La seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dans la vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat des entretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours de séjours en 2007, 2009 et 2010. Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumière notamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne de défense". Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle de l'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, au travers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et des documents requis pour le passage de la frontière. Les thématiques liées aux relations commerciales transfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagir malgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent au sein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôle majeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dans les descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujours jouent un rôle fondamental dans les relations et conflits de frontière. Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que les Ferghaniens entretiennent avec eux, et surtout les représentations internes et externes que les centres urbains assument au sein d'une région désormais tout à fait transfrontalière. Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque là terre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu une terre d'émigration avec l'indépendance et la concrétisation des frontières. Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré et routier, et leur rapport d'influence réciproque mutations frontalières de cette région. Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développe une analyse conclusive sur le Ferghana des frontières aujourd'hui. La conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre les différents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel. Force est de constater l'existence de changements dans la région Ferghana à différents points de vue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques et sociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structures culturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin "ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne". Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré les obstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, en s'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana. La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en 2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoir géopolitique qui persistent encore dans la région. ; This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, the Ferghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan and Kyrgyzstan. A basis of the research, field trips spread over the past three years enabled the development of instruments such as border analysis, analytical cartography, qualitative interviews with experts and inhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent – noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to the field trips in Central Asia, a research period in France permitted both a consolidation in geopolitical theory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, and additional bibliographical research at the French National Library (BNF). The topic of the research is hence the analysis of power rivalries between "territorial actors" over the "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the larger geopolitical context of Central Asia. Always a stake disputed by various territorial actors over time, the Fergana Valley now experiences power rivalries from contemporaneous territorial actors first and foremost on the border and transborder levels. By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis: the cultural regionalism. The dissertation hence offers a detailed presentation of the cultural regionalism as well as an evaluation of its past and current importance. First focusing on the centrasiatic context and the peculiarities which stem from its borders, the introduction presents the "stake" Fergana and its economic and physical resources which explain its importance as a territory. A rapid summary of the theory of geopolitics follows, with the justification of the choice of the French Lacostian school as the theoretical frame of this work. The introduction closes on a first analysis of the Fergana as a space of border or frontier. The thesis is structured in two main parts. The first, more theoretical, analyses each of the three territorial actors which aim for power over the Fergana: the Nation, the Religion, and the Cultural Regionalism. The presentation of the actors, of their respective embodiments and of their manifestations within the ferganian territory is organised according to a conceptual rationale; events that occurred simultaneously are thus not considered following a chronological order, but separately, according to their respective relations with the actors evoked. The first chapter focuses on the actor Nation. By this word we understand not only the effective entity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but also the Nation as an ideology which acts upon the territory through nationalistic policies. The force of legitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in the Ferganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchy in the region. This chapter also analyses the representations of the Fergana which are defined and implemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first became a transborder region only in these years, through its integration to the Union of the Socialist Soviet Republics (USSR) and its partition between three of the five newly created Socialist Soviet Republics in Central Asia. In the 1990s, following the fall of the USSR and the independence of the three Republics, the borders which divided the Ferghana stopped being only internal, but became real and proper international borders. Among the main representations that this study looks at, a particular attention is devoted to the study of the national borders , their creation and their evolution. The chapter also looks at the relations between the different Nation-States, which form a unique actor when they rival against the other territorial actors – the Religion and the Cultural Regionalism –, but three well different ones when they rival among themselves. The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valley is one of the most pious and practicing region of Central Asia, and the Islamic religion always played a major role in the society's administration and organization. The chapter proposes first an analysis of the religion's representations in the Fergana: the autochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam of the soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in the Fergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistan and Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it induced between the soviet muslims and the afghan mujaheddins. It is then examined how the different variations of the actor opposed themselves to the actor Nation, over the years, for the control over the power and the resources of the Fergana. We look at how the geopolitical rivalries vary dramatically from the soviet era to that of the independence. A special attention is devoted to the phenomenon of politization of the actor Religion and the way this led the Religion to endorse a role of protagonist in many of the Fergana's events. The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of this regional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as the Fergana has existed as a place, it has always constituted a geographical, political and social whole. Although its population has been characterized during the past centuries by high levels of multiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation of populations which always held multiethnicity as normality, and always attributed to each "group" a specific social role within the system Fergana. Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic, these populations always shared, each in its own social role, a common life within the region. This very phenomenon is the main characteristic of what we call the Cultural Regionalism of the Fergana. However, this equilibrium changes with the loss of political sovereignty of the region and the rise of nationalism under the soviet sovereignty. This chapter analyzes the main representation of the actor Cultural Regionalism over time, and how it took stand against the other territorial actors, especially the Nation. The second part of the dissertation as dedicated to the current manifestations of the territorial actors in the Fergana valley, particularly in its border zones. This part results from the interviews and field observation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010. The first chapter analyzes the border of this region from a theoretical point of view, especially in the light of the geostrategical categories of "first line of defence" or "last line of defence". In the context of a transformation of the border from the soviet era to that of the independence, the second chapter explores the definition of the centrasiatic border, mainly through the analysis of border bureaucracy, control posts and documents required to cross the border. The chapter looks at themes connected to the commercial transborder relations : how the "three" Fergana still manage to interact despite growing border rigidity, which social relationships subsist today. The qualitative interviews led in the Fergana are a major source in this process of reviewing the difficulties of passage and communication within the valley, and of tracking the actual presence of the three geopolitical actors which play a major role in the border relations and conflicts. The third chapter focuses on the Ferganian urban centres: their history, the relations that the Ferganians have with them, et above all the internal and external representations of these centres in a now fully transborder region. The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Up until then a land of immigration, the Fergana became a land of emigration following the independence and the materialization of the borders. The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, and their relationship of reciprocal influence with the mutation of the borders in the region. The sixth chapter builds on the theoretical interrogations evoked in the introduction of the dissertation and develops a conclusive analysis of the Fergana of the borders nowadays. The conclusion of this research depicts the current Fergana, the relations between the different geopolitical actors and underscores the persistence of the actor Cultural Regionalism. It establishes the existence of tremendous changes in the region Fergana from various viewpoints: the Ferganian population has new frames of cultural, political and social reference whose importance increased dramatically ; new political forms and cultural structures influenced its self-image, its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz), atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian". However, although the territory, its borders and inhabitants changed, and despite the strong obstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, by adapting to the new tendencies and ways of interpretation of the Fergana. The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 and the Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries which persist in the region. ; XXIII Ciclo
In Italy, Protection System for Asylum Seekers and Refugees (SPRAR) manages the second reception of forced migrants. This organization was founded by the Bossi-Fini law n. 189/2002 and is composed by the network of local governments, which uses the available resources of National Fund for Asylum Policies and Services provided by Government finance law and managed by the Ministry of Interior. Its principal goal is to realize integrated reception projects for refugees, asylum seekers, subsidiary and humanitarian protection holders in order to ensure their socio-economic inclusion within local contexts in cooperation with voluntary and third sector organizations. On 10th July 2014, local governments were signed an agreement between national and regional executive to create a national reception system to face the growing number of people who have arrived on the Italian coasts. The main goal of this system is to overcome only a material reception (food and lodging), in order to offer a "widespread reception" within urban areas. The strategy is to create an individual project and an accompaniment to ensure the integration of each person in the local community. The services provided consist in inclusion of migrants in the national health and scholastic system, orientation and access to other local services, professional training, job placement, legal assistance and social and housing integration . Indeed, it is crucial to emphasize that the Italian reception system is characterized by extreme fragmentation. Only SPRAR provides these services with the goal of enabling social and economic inclusion of hosted people in local context, which is why we talk about second reception centres. In Italy, there are, however, many different types of first and extraordinary reception centres for migrants . They are managed by the prefectures and differ in terms of goals, structural characteristics, services and receptive capacity. Only 18.7% of migrants are hosted in the SPRAR structures, while the remainder incurs the possibility of carrying out the entire procedure of the asylum application in the centres of first and extraordinary reception (IDOS, 2017). In recent years, the Italian reception structures have undergone a reorganization and redenomination phase, in which the SPRAR should have become a reference standard. In fact, this system has positively distinguished itself for its objectives, the structuring of his interventions and many best practices. This did not prevent bad reception occurrences even within SPRAR structures, as well as a large number of violent and verbal conflicts, some of which carried out by Italian citizens to the detriment of asylum seekers and owners of a status of international protection. These episodes, exacerbated by a political and media discourse that represents migrants as a threat (Battistelli et al., 2016), are the consequence and symbol of the fragmentary and contradictory reception policies adopted at a European level, in the individual countries and at a local level (IDOS, 2016). Instability and political, economic and social uncertainty, rulers in this historical period, are manifested in an emergency approach that is characterized by insufficient planning and a lack of coordination between the reception agencies. This orientation, supported by many and incongruent legislative changes, deprives the system of a strong structure and facilitates the overturning of the same principles of "widespread reception" of migrants in local communities. Moreover, this facilitates the affirmation of nationalist, xenophobic and localist drifts, as well as reception situations in which human rights are violated and which do not provide real opportunities for inclusion in the territories in a safe and dignified manner. Therefore, the conceptual distinction of the terms danger, risk and threat, used as the interpretative line of this work, appears fundamental to understand why subjective responses, in terms of perception and actions, differ according to the situations, as well as to manage the effects that derive in a consistent manner (Battistelli e Galantino, 2018). In order to realize the analysis, I decided to use an ethnographic approach that is traced back to the constructivist philosophical paradigm, where the vision of facts is investigated locally. Ethnographers, indeed, study subjects, artefacts and actions in their interactions, from an interpretative-dialectical point of view, without the claim of absolute objectivity of the results (Piccardo and Benozzo, 1996). Then, I have chosen to use focused narrative interviews because they turn to individuals, they aim for their "understanding", and this is part of the renewed interest in the subject's centrality and in the "deliberately intentional" social action (Weber, 1922). It is also an approach that allows investigating deeply the phenomena. It is very interactive, flexible and able to empathize in the perspective of the subject being studied. This makes it easier to interview marginal subjects neglected by "official knowledge" and to rediscover the social function of research, which is "giving voice to those who do not have it" (Crespi, 1985, pp. 351) In addition, observation and fieldwork are supported by a strong theoretical basis that offers its help to the researcher for the understanding of the social world, providing an order that supports they in their critical analysis of the facts. So, empirical work and theory support each other (Silverman, 2002). Then, narrative approach is highly adaptable to the study of organizations and to analyse the collected data. In fact, this approach is characterized for attention given to concrete situations and not to general theorizations (Czarniawska, 2000). Hence, the empirical research carried out in 2016-2018 can be summarized in the following phases: 1- Analysis of secondary data and documents produced by European and national statistical institutes, private associations, protection bodies and by SPRAR itself. 2- Participant observation in: - a political protest demonstration against the opening of a SPRAR centre in XIII Town Hall, on the north-western suburb of Rome; - nine meetings of social operators working in SPRAR network of Rome and in the national CARA and CAS reception centres; - a SPRAR centre (20 reception places increased to 40 in the south-eastern suburbs of Rome, VII Town Hall). One year of observation and shadowing of operators: 16th January 2017 – 22th January 2018; - a SPRAR apartment (14 reception places for families in the residential area of Monte Sacro neighbourhood, Town Hall III). Five days of observation and shadowing of operators in January 2018; - a seminar of reflection organized by SPRAR and ANCI on the reception system in Lazio, focused on the role of the Regions and Municipalities. 3- Forty-one narrative focused interviews: - Twenty-four SPRAR operators working in SPRAR centres of Rome; - Seventeen asylum seekers and refugees from SPRAR centre observed in Town Hall VII of Rome. The intent behind this ethnographic research started in a restructuring phase aimed to make the SPRAR a reference standard of reception for all asylum seekers who came to our country. But it was characterized, as still today, by speculative situations, the high presence on the territory of large collective reception centres and managing bodies without the necessary experience (Olivieri, 2011; Lunaria 2016). Therefore, the analysis of the risk management and the operators perception of the SPRAR of Rome has the objective to unveil and analyse the contradictions and weaknesses that may arise within this model due to a reckless management that produces specific factors of risk. The hypothesis underlying the case study is that, although the SPRAR has been recognized as an ordinary model, it can also be reproduced in a distorted manner, not respecting the reference guidelines. The alteration between SPRAR in books, the theoretical expression of a principle, and SPRAR in action, its implementation (Pound, 1910), is caused by specific factors that can cause significant effects from several points of view. To bring to light these aspects, closely related to the risk management and the perception that its operators have, I achieve a classification of the risks that I applied to three different types of SPRAR structures (large, medium and single apartment). Then, I identified a series of outcomes involving the people hosted, the operators, the local community and the SPRAR organization itself. The decision to draw the case study at the SPRAR of the city of Rome is driven by the complexity that distinguishes this territory on a social, cultural and political level. In fact, I believe it can bring out the contradictions of the model as new forms of confinement compared to territories with reduced complexity. However, allowing a glimpse of a reception of asylum seekers and holders of a protection status also possible within urban and metropolitan areas. The empirical survey shows that an increase in the distortion compared to the assumptions of an integrated and widespread reception in the territories corresponds to a greater possibility that specific risk factors are produced. Which in their turn, crystallizing into unhealthy forms, can involve the people hosted, the operators, the local community and the SPRAR organization itself. The case study and the application of the risk classification, which I achieved based on the evidence revealed from the field, reveal how the identified risk areas (socio-spatial context, production of the service, recipients) and the corresponding categories, do not produce in itself a negative result. However, this can occur if a short-sighted management acts on these aspects and does not align with the proposed guidelines. Therefore, this classification appears to be a useful tool to identify problems and to develop preventive measures, aimed to improve the management of SPRAR centres in metropolitan cities such as Rome (and other contexts), by intervening on the identified risk categories and reducing the factors that eventually emerge. The analysis, focused on three different types of SPRAR structure (large, medium, single apartment) of the Capital, shows how this alteration occurs in a disruptive way in the large collective centres, the most represented in Rome. Meanwhile, greater adherence to the model is shown, with a modality proportional to the size, in the medium-sized structure and in the apartment. The distortion detected in the large SPRAR collective centres of Rome and partly also in the medium-sized centre, reflects the ambivalence of the general reception system. It promotes on the one hand the principles of a good reception that respects human rights and the autonomy of people and by another implements foreclosure practices and new forms of borders (Vacchiano, 2011; Van Haken, 2008). The field research shows that this happens on different levels due to specific material factors (location and capacity of the centres, management of internal spaces, activation of the services provided, etc.) and through the daily practices of the operators who, in a more or less assenting, controlling and disciplining the people hosted, shape their conduct. Therefore, in the daily life of the structures in which the situations described are involved, the principles of freedom, inclusion and autonomy supported by the rhetoric of reception system are governed by a neoliberal logic of citizenship that suggests the criteria to distinguish, in the same integration paths, who is more worthy than other beneficiaries (Van Haken, 2008). Although the case study highlights strong contradictions and weaknesses that come to life in the implementation of the SPRAR model, it also shows the realization of a good reception. That which, despite being included in an extremely complex context such as Rome, attempts to oppose the "logic of large numbers and profits" of large cooperatives and which implements functional inclusion paths to achieve the objectives. Alignment and consistency with the guidelines and the SPRAR operating manual, in fact, allow the construction of a real project of individualized socio-economic integration for the person hosted. Only by acting in a widespread manner on the territory, in apartments or small centres, the genesis of new forms of borders beyond those already present is avoided. In fact, through this management most of the risks identified are eliminated or at least reduced, precisely because the "trajectory of opportunities" of risk (Reason, 1997) towards unfavourable outcomes generally develops within large collective centres.
