Pendant les vingt premières années de son parcours d'étude et d'enseignement du droit, l'auteur a côtoyé le pluralisme juridique sans l'identifier, fidèle en cela aux enseignements dispensés au cours de son cursus ; cette rencontre s'est faite essentiellement à travers la fréquentation de l'anthropologie, de la comparaison et de l'histoire. Au début des années 1970, donc vingt ans plus tard, il s'est trouvé devant l'obligation de s'aventurer sur la voie périlleuse d'un « essai de définition » du phénomène. Du 18 mars au 05 avril 2013, le CAL Charleroi a accueilli l'exposition « Juvenile in Justice » réalisée par Richard Ross. Bibliothèque d'images, cette exposition dévoile différentes facettes de la politique américaine en matière de justice des mineurs, dont notamment celle de fonctionner comme une politique particulièrement plus sanctionnelle et répressive que protectionnelle. En marge de cette exposition, un colloque a été organisé sur la politique belge de protection des mineurs en voie de défédéralisation. Women are a rapidly growing minority in prisons. Prison systems, however, have always been determined by the behaviour of men. The 2010 UN Bangkok Rules form a body of rules that is specifically aimed at the needs of women in prison. Being the first international instrument on this subject, the Bangkok Rules can be considered a milestone. Thus this volume focuses on the topic of women in prison in general, and on the Bangkok Rules in particular. The volume comprises an introductory chapter, seven thematic chapters, and 23 chapters dedicated to individual countries around the world. Themes discussed in these chapters include, among others, the (international) human rights framework applicable to women in prison, statistics and criminological factors relevant to women in prison, and the actual conditions of women in prison worldwide. An extensive collection of expert knowledge, this volume intends to highlight both good practice in the context of women in prison and the many challenges that lie ahead

Les premières lois sociales apparaissent en Europe au 19e siècle à la suite de la révolution industrielle. Elles constituent alors une réponse ponctuelle à la misère des travailleurs. Elles résultent indéniablement de l'action ouvrière, mais aussi du souci des classes dirigeantes de maîtriser les classes laborieuses devenues dangereuses. L'invention du droit social, va contribuer au cours du 20e siècle à la disparition des « travailleurs pauvres ». En revanche, ce début de 21e siècle est marqué par leur augmentation dans un bon nombre de pays. Des personnes ayant une activité, généralement salariées, y ont un revenu familial inférieur au seuil de pauvreté et sont dans l'incapacité d'accéder à certains droits fondamentaux, alors même qu'existent des droits du travail et de la protection sociale substantiels, des réglementations, des statuts d'emploi, des salaires minima légaux et/ou conventionnels. Comment le droit social et les politiques publiques permettent-ils ou limitent-t-ils l'existence de « travailleurs pauvres » ?Intégrant l'éclairage d'autres disciplines et des points de vue internationaux, cet ouvrage réunit et croise les analyses de spécialistes reconnus de droit social de pays d'Europe mais aussi d'Afrique du sud, d'Australie, du Canada, des États-Unis et du Japon. Main description: The interdisciplinary essays gathered in this book reconstruct the history of democracy and democratic theories from the perspective of the minority issue. How do democracies deal with their minorities? Do minorities participate in the construction of political will? By what mechanisms does social discrimination against minorities turn violent? How does it happen that minorities are considered "enemies"? What are the normative foundations of the UN minority protection system and the establishment of an International Criminal Court for crimes committed mainly against "groups"? How can universal human rights be reconciled with minority rights? To discuss these questions, the common theoretical reference for the essays in this book is the work of the jurist Hans Kelsen. In 1925, Kelsen criticized democracy as based on a fiction: the "fiction of representation". Since political freedom means the faculty of a people to give themselves their own law, only the represented majority is free - but not the minority. Kant, Hegel, Tocqueville, Benjamin, Lemki, Foucault, Habermas, Honneth and Taylor are some of the authors who are addressed herein for further reflection on the minority issue.
