Bu çalışmada üniversitede okuyan öğrencilerin kimlik ve siyaset algıları ölçülmüştür. Araştırmaya katılanların ,2'si kadın, ,8'i erkektir. Araştırma kapsamında Gümüşhane Üniversitesi'nde farklı bölüm ve sınıflarda okuyan öğrenciler arasından basit tesadüfü örneklem yöntemi kullanılarak belirlenen 233 öğrenciye anket uygulanmıştır. Araştırmanın saha çalışması Aralık 2017'de yapılmıştır. Araştırma tarama modeline uygun şekilde tasarlanmıştır. Araştırmanın amacı, üniversite öğrencilerinin kimlik ve siyaset algılarını tespit etmektir. Bu bağlamda araştırma, üniversite öğrencilerinin kimlik ve siyaset algıları nasıldır?, siyasete katılım düzeyleri nedir?, siyasi-dini-ideolojik olarak ve modern-geleneksel düzlemde hangi kimlikleri kendisine uygun görüyorlar?, vatandaşlığı nasıl tanımlıyorlar? gibi soruların cevaplarını aramaktadır. Araştırmanın sonuçlarından bazıları şöyledir: Katılımcıların çok yüksek bir oranı (,5), modern-gelenek düzleminde, kendilerini biraz modern biraz geleneksel olarak görmektedir. Katılımcıların önemsedikleri ve önceledikleri üç toplumsal aidiyetin/kimliğin Müslüman gibi dini, Türkiye Cumhuriyeti vatandaşı gibi siyasi ve Türk gibi etnik/siyasi aidiyetler olduğu görülmektedir. Araştırmanın bir başka sonucu ise, katılımcıların siyasal katılımlarının daha çok seçimlerde oy verme şeklinde olduğudur. Ayrıca, katılımcıların sivil toplum örgütlerine katılım düzeyi çok düşüktür. Yine katılımcılara göre, Türkiye Cumhuriyeti vatandaşı olmak için, hukuki statü yeterlidir; ancak bir kişinin Türkiye'nin Cumhurbaşkanı olması için ise Müslüman olması gerekmektedir. Araştırma sonuçlarına göre, Türkiye'nin en önemli sorunları arasında öne çıkan ilk üç sorun sırasıyla; terör, adaletsizlik ve eğitim olduğu görülmektedir. ; In this study, the identity and political perceptions of the students studying at university are measured. 54.2% of the participants were female and 45.8% were male. Within this research from the University of Gumushane students studying in different sections and classes using a simple coincidence sampling method was applied to 233 students in the survey. The fieldwork of the research was carried out in December 2017. The research was designed in accordance with the screening model. The aim of this study is to determine the identity and political perceptions of university students. In this context, how is the identity and political perceptions of university students?, What are the levels of political participation?, What identities do they see fit politically, religiously, ideologically and on a modern-traditional level?, How do they define citizenship? are looking for answers to such questions. Some of the results of the survey are as follows: A very high proportion of participants (88.5%) regard themselves as somewhat modern and somewhat traditional on the modern-tradition level. They care about the participants and they preceded the three social belonging / religious identity as Muslims, citizens of the Republic of Turkey as well as political and ethnic Turks as / is observed that political affiliations. Another consequence of the survey is that the political participation of the participants is more like voting in the elections. In addition, the level of participation of NGOs in civil society organizations is very low. According to the participants, to be citizens of the Republic of Turkey, it is sufficient legal status; but for a person to become Turkey's president must be a Muslim. According to the survey, Turkey's most important outstanding issue between the top three issues respectively; terror, injustice and education.
Tarihsel süreç içinde yaşanan sosyo-ekonomik, teknolojik ve siyasal değişimlere bağlı olarak devletin üstlendiği görev tanımları yenilenmiştir. Dönemsel açıdan devlet güvenlik ve adalet gibi temel kamu hizmetlerini üstlenmiştir. Nüfus artışına bağlı olarak toplumsal kesimlerin çeşitlenmesi farklı talep ve beklentiler devletin özellikle mali açıdan yükünü arttırmıştır. Bu durum devletin kamu hizmetlerinin sunumu noktasında konumunu tartışmalı hale getirmiş ve minimal devlet olgusu ortaya çıkmıştır. Yeni sistem kamu hizmetlerinin sunumunda merkezi yetkileri yerel unsurlar, özel sektör ve sivil toplum kuruluşları arasında paylaştıran bir modeli ortaya çıkarmıştır. Bu modelde devletin doğrudan üreten değil düzenleyen ve denetleyen bir pozisyona geçmesi öngörülmüştür. Devletin yeni konumu ise yönetim süreçlerinde demokratik ve katılımcı anlayışı gerektirmiştir. Devlete biçilen yeni pozisyon sosyo-ekonomik kalkınma ve toplumsal refahın geliştirilmesi hedefini ertelemiş değildir. Küreselleşme süreci kalkınma hedefinin sağlanmasında devletin sivil toplum ve özel sektör vb. aktörler ile ortaklık kurmasına yol açmıştır. Küreselleşme süreci yönetsel kademe olan yerel yönetimleri iki başlıkta öne çıkarmıştır. Birincisi; katılım ve demokrasinin birincil uygulama alanı olarak yerel yönetimler ön plana çıkmıştır. İkincisi; yerel yönetimler sahip olduğu imkan ve potansiyel itibariyle kalkınma açısından merkez(ler) olarak kabul edilmiştir. Türkiye planlı kalkınma olgusu ile Cumhuriyetin ilanı ile tanışmıştır. Türkiye açısından 1923 İktisat Kongresi, Devlet Planlama Teşkilatının kurulması ve 1963 tarihli ilk Kalkınma Planı temel hamleler olmuştur. Kalkınma hamleleri içinde yerel unsurlar ve yerel yönetimler çeşitli dönemlerde öne çıkmışlardır. Bu açıdan kalkınma planları ülkemizin sosyo-ekonomik hedeflerinin belirlenmesinde yerel yönetimleri de bir aktör olarak görmüştür denilebilir. Cumhuriyetin ilk yıllarında köy kalkınması öne çıkarılırken sayısının ve nüfusunun artması ile kent sorunları kalkınma planlarında ele alınmaya başlanmıştır. Kalkınma planlarında kent daha çok yetki, görev ve mali yapıları ile ele alınmış bu konularda kısmi iyileştirmelere gidilmiştir. Dünya toplumlarının yaşadığı siyasal değişimler yerel yönetimlerin demokratik ve katılımcı yönünü ortaya çıkarmıştır. Bunun yansıması olarak ülkemizde de yerel yönetimlerin demokratik ve katılımcı bir modele evrilmesine yönelik temel hedefler kalkınma planlarına yansımıştır. Kent yönetimleri demokratik ve katılımcı yapılar olarak tanımlanmaya başlanmıştır. Ayrıca kalkınma planları yerel yönetimlerin asıl sorumluluk alanı olan kent hizmetlerinin nitelikleri ve türleri açısından vizyon ve hedef belirleme aracı olmuştur. Bu çerçevede Kalkınma planlarında kent odaklı; ulaşım, alt yapı, barınma, sosyo-kültürel, sosyo-ekonomik vb. pek çok alanda hedefler konulmuştur. Türkiye'de 1963'den bu yana 10 kalkınma planı hazırlanmıştır. Son olarak 23 Temmuz 2019'da 11. Kalkınma Planı uygulamaya girmiştir. Kalkınma planları sosyo-ekonomik açıdan öne çıksa da aslında tüm kurumsal yapılara yönelik hedef ve politikalar belirler. Türkiye'de hazırlanan kalkınma planları da yerel yönetim alanında da değişim ve dönüşüm odaklı olmuştur. Yayınlanan 11. Kalkınma planının içeriğinde geçmiş dönem planlarına ait atıflar bulunmaktadır. En önemli nokta ise; yerel yönetimlere ilişkin yeniden reform yapılacağı belirtilmesidir. Ayrıca insan odaklı şehir; yeşil şehir; akıllı şehir; kaliteli hizmet sunumu; katılımcılık; şeffaflık; hesap verilebilirlik; optimum coğrafi alan vb. kavramlara yer verilmektedir. Tüm bunlar 11. Plan döneminde yerel yönetimlere ilişkin değişimin devam edeceğini göstermektedir. ; Depending on the socio-economic, technological and political changes in the historical process, the responsibility of the state has been renewed. As far as the era is concerned, it undertook basic public services such as state security and justice. Diversification of social segments due to population increase, different demands and expectations have increased especially the financial burden of the state. This situation rendered the status of the state controversial in terms of offering public services and introduced the phenomenon of a minimal state. The new system introduced a model that distributes central powers among local elements, the private sector, and non-governmental organizations in the offering of public services. The model provides that the state should adopt a regulating and supervising position instead of directly producing one. And the new position of the state required democratic and participatory understanding in the governing processes. This new position seen fit to the state has not delayed the goal of socio-economic development and social welfare. The process of globalization enabled the state to form a partnership with actors such as the civil society and the private sector in fulfilling the aims of development. The globalization process called for local administrative governments, in two ways. First; local governments were at play as the means of primary application of participation and democracy. Second; local governments were accepted as the center(s) concerning development thanks to their capabilities and potential. Turkey was introduced with the concept of planned development with the proclamation of the Republic. For Turkey, the Economic Congress of 1923, the establishment of the State Planning Organization and the first Development Plan of 1963 have constituted the main steps. In the development steps, local elements and local administrations came to the fore in different periods. In this respect, it is safe to say that development plans also regarded the local governments as actors in determining the socio-economic goals of our country. While rural development was emphasized in the first years of the republic, increasing urban population and urban problems necessitated these problems to be addressed in development plans. In the development plans, a city was mostly treated keeping in mind the authorities, duties and financial structure; and partial improvements were made on these issues. Political changes experienced by the world's societies revealed the democratic and participatory aspects of local governments. As a repercussion of this, the main aims for the evolution of local governments into a democratic and participatory model in our country are reflected in the development plans. City administrations started to be defined as democratic and participatory structures. Besides, development plans have been a vision and goal setting tool in terms of characteristics and types of urban services, which are the main areas of responsibility of local governments. In this framework, in city development plans, cityfocused aims have been defined in various fields such as transportation, infrastructure, shelter, socio-economics, etc. Since 1963, 10 development plans have been issued in Turkey. Finally, on July 23 2019, the 11th Development Plan was issued. Although development plans come to the forefront from a socio-economic point of view in general, they actually set goals and policies for all institutional structures. In Turkey, the development plans prepared has been focused on the changes and transformations in the local government area. The 11th Development Plan contains references to these previous plans. The most important point seems to be the strong emphasis on the re-reform of local governments. Also; people oriented cities, green cities, smart cities, quality service delivery, participation, transparency, accountability, optimum geographical area and etc. concepts take part in the plan. All this shows that change in local administrations will continue in the 11th plan period.
1990'lı yıllar Türkiye'de önemli değişim ve gelişmelerin yaşandığı yıllardır. Gelişen teknolojiler ve küreselleşme ile birlikte yönetişim ve katılımcılık gibi kavramlar öne çıkmıştır. Bu dönemde gündeme gelen "Sivil Toplum" kavramı ise dönemin parlayan yıldızlarındandır. Tüm Dünya'da sivil toplum ve katılımcılık ile ilgili pek çok konferans ve zirve düzenlenmiş, pek çok rapor yayınlanmıştır. 1992 yılında Rio Çevre ve Kalkınma Zirvesi ve özellikle 1996 yılında BM Habitat II Zirvesi, Türkiye'deki STK'lar açısından önemli bir dönüm noktası olmuştur. Yine 2001'de Türkiye'nin AB üyelik süreci kapsamında kabul ettiği Kopenhag Kriterleri ve 2000'li yılların ortasında yerelde sivil toplumun gelişmesi adına uygulanan Yerel Gündem 21 projeleri ve kent konseylerinin kurulması önemli gelişmelerden bazılarıdır. Bu dönemde yapılan yasal düzenlemeler ile sivil toplum kuruluşları (STK) kent konseyleri, federasyon, konfederasyon ve platformlar vb. şekillerde örgütlenmeye ve ağlar kurmaya başlamış, bunun yanında gelişen teknoloji ve artan iletişim araçları da STK'ların hem yerelde hem de uluslararası seviyede iletişimlerini geliştirmesine ve ağlar kurmasına olanak sağlamıştır.Tez araştırması kapsamında yapılan literatür taramasında STK'ların ağ kurmalarına ve ağ kurma şekillerine yönelik çalışmalara rastlanırken doğrudan "STK Ağları" kavramını ağırlıklı olarak merkeze alan bir çalışmaya rastlanılmamıştır. Bu nedenle çalışmamızda STK ağı ifadesi özellikle kavramsallaştırılmaya çalışılmış ve bu kavram çerçevesinde farklı platformların STK ağı olup olmadığı özelliklerine göre değerlendirilmiştir. Buradan yola çıkarak Kocaeli'de faaliyet gösteren yedifarklı STK ile görüşmeler yapılmıştır. Bu araştırmada nitel araştırma metotlarından olan yarı yapılandırılmış mülakat metodu kullanılmıştır. Yapılan görüşmelerde STK'ların ağ özelliği gösteren oluşumlara dahil olduktan sonra etki alanlarına etkisi analiz edilmiştir. Tezin hipotezi kapsamında geliştirilen araştırma soruları ışığında seçilen kuruluşların kapasite ve etkileri analiz edilmiştir. İlgili bölümde detayları ile açıklanacağı gibi analiz edeceğimiz STK'lar için öncelikle birincil kaynaklar ile durum analizi yapılması ve arkasında önceden belirlenen mülakat soruları ile sonuca gidilmesi planlanmıştır. Ancak tüm bunlardan önce, bu tür bilimsel araştırmalarda olması gerektiği gibi, ilgili alanda kapsamlı bir kavramsal çerçeve literatür analizi yapılmıştır. Bu kapsamda kamu yönetimde değişim, yönetişim, sivil toplum kuruluşlarının gelişimi ve ağ oluşum stratejileri üzerinde durulmuştur. --- In Turkey, there were significant changes and developments in 1990s. Such as governance and participation concept have come to the fore with the developing technologies and globalization. The concept of "Civil Society", which came to the fore during this period, is one of the shining stars of the period. Many conferences and summits on civil society and participation have been held all over the world, and many reports have been published. Rio Environment and Development Summit in 1992 and specifically the UN Istanbul HABİTAT II Summit in 1996, have been a major turning point for CSOs in Turkey. Again in 2001, the Copenhagen criteria adopted by the scope of Turkey's EU membership process, Agenda 21 projects implemented for the development of local civil society in the mid-2000s, and the establishment of city councils are some of the important developments. In this period, Civil Society Organizations (CSOs) began to organize and establish networks such as city councils, federations, confederations, and platforms, etc. with the legal regulations made in. In addition, developing technology and increasing communication tools have enabled CSOs to improve their communication and establish networks both at local and international levels.In the literature review conducted within the scope of the thesis research, while studies on the networking and networking styles of CSOs were encountered, no study directly focused on the concept of "CSO Networks" was found. For this reason, the term CSO network has been tried to be conceptualized and within the framework of this concept, different platforms are evaluated according to their characteristics. Based on this, interviews were made with seven different CSOs operating in Kocaeli. Semi-structured interview method, which is one of the qualitative research methods, was used in this study. In the interviews, after CSOs joined into the organizations which show CSO network characters, the change in their domains was analyzed. In terms of the results obtained as a result of the thesis study, it has been observed that the domains of CSOs have expanded after joining the formations that have network functions.
ABD, Birleşmiş Milletler'in onayı olamadan Irak'ı işgal etme gerekçesi olarak, Irak'ın zenginleştirilmiş uranyum elde etmeye çalıştığını; kitle imha silahları (KİS) projesini devam ettirdiğini ve El Kaide'yle işbirliği yaptığını, öne sürmüştür. Dolayısıyla Irak Hükümetini, hem ABD açısından ve hem de dünya barış ve güvenliğine karşı açık bir tehdit olarak nitelendirmiştir. Buradan hareketle, Birleşmiş Milletler Güvenlik Konseyi'nin 1991 Tarih ve 678 Sayılı Kararında Irak'a karşı kuvvet kullanmaya izin verildiği ve ayrıca 2002 Tarih ve 1441 Sayılı Kararın 13. Paragrafında, "Irak'ın ciddi sonuçlarla karşılaşacağı" ifadesinin, kuvvet kullanılacağını öngörüyor olduğu iddiasından yola çıkarak, ABD'nin Irak'a Müdahalesi için yeni bir karara gerek olmadığını öne sürmüştür. Binaenaleyh II. Bush Yönetiminin, 20 Mart 2003'te Irak'a başlattığı saldırının ardından gündeme gelen en önemli tartışmalardan biri, ABD hangi hukuksal nedenlere dayanarak Irak'ı işgal ettiği ve bu müdahalenin uluslararası hukuk bakımından nasıl değerlendirileceği hususu olmuştur. Güvenlik Konseyi'nin 1991 yılında aldığı 678 sayılı kararın amacı; Irak güçlerini Kuveyt'ten çıkarmaktı ve 2002 yılında çıkan 1441 sayılı kararın amacı da; Irak'ın silahsızlandırılmasını ve silahlarının denetlenmesini güvence altına almaktı. Ayrıca UNMOVIC'in (The United Nations Monitoring, Verification and Inspection Commission) başkanı Hans Blix'in 14 Şubat 2003'te sunduğu raporlar ve sonraki dönemde de Irak'ta herhangi bir KİS'in bulunamaması, ABD iddia ve tezlerinin doğru olmadığını açıkça göstermiştir. Birleşmiş Milletler Antlaşmasının kuvvet kullanma ve silahlı zorlama yollarının; uluslararası hukukta öngörülen mekanizmalar işletilmeksizin ve dünya kamuoyunun yoğun muhalefetine rağmen Irak'a karşı gerçekleştirilen bu savaş ve işgal, Birleşmiş Milletler Antlaşmasının "kuvvet kullanma yasağı" çerçevesinde oldukça yoğun tartışmalara sebep olmuştur. Ayrıca işgal sonrası, ABD'nin Irak'ta izlediği politikalar ve işkence iddiaları, insan hakları ve savaş hukuku itibariyle de ABD'nin ağır uluslararası hukuk ihlalinde bulunduğu eleştiri ve tartışmalarını beraberinde getirmiştir. ; The USA claimed that Iraq tried to obtain enriched uranium, sustained the projects for mass destruction weapons (MDW) and ganged with El Kaide as the reason for occupying Iraq without the consent of the United Nations. Thus, it qualified the Iraq Government as a clear threat to both the USA and the peace and security of the world. Starting from this point of view, it was claimed that the USA didn't need a new decree to Interference to Iraq since necessary permission was given with the decree of the United Nations with the date of 1991 and number of 678, and the expression stating that "Iraq will have serious conclusions" in the decree dated 2002 and with the number of 1441, article 13 allowed using forces against Iraq. Consequently, one of the discussions which arose after the attack of the Administration of Bush the II on March 20, 2003 was the legal reasons for the USA's occupying Iraq and how this intervention would be evaluated from the point of international law codes. The purpose of the decree of Security Council dated 1991 and with the number of 678 was to take the Iraqi forces out of Kuwait and the purpose of the decree with the date of 2002 and number of 1441 was to unarm Iraq and control the weapons in Iraq. Moreover, the reports of Hans Blix, the Chairman of UNMOVIC (The United Nations Monitoring, Verification and Inspection Commission) dated February 14, 2003 and non-existence of MDW's in Iraq during the following periods has clearly shown that the claims and hypothesis of the USA weren't true. This war and occupation executed against Iraq despite the severe opposition of world public opinion and without trying the ways of the Charter of United Nations about using forces and armed forcing and the mechanisms prescribed in the international law caused dense discussions within the frame of "the prohibition of the use of force" by the Charter of the United Nations. Moreover, the policies that the USA pursue in Iraq after the occupation and allegations of torture and the claims that the USA executed severe violations of law from the points of human rights and laws of war brought the critics and discussions along.
Toplumun gündelik ihtiyaçlarıyla ilgili kamu hizmetlerini görme işlevini yerine getiren idarenin, etkin bir işleyişe sahip olması ve kamu hizmetlerinden yararlananların haklarının korunması için idare, çeşitli şekillerde denetime tabi tutulmaktadır. Merkezden yönetim idarelerinin yerinden yönetim idareleri üzerindeki denetim yetkisi olan idari vesayet, günümüzde içeriği ve sınırı bakımından bütün dünyada sancılı bir sorun olup, uzun yıllardır ülkemiz gündemini meşgul etmeye devam etmektedir.Bu çalışma ile, merkezi idarenin yerel yönetimler üzerindeki idari vesayet denetimi, yeni kamu yönetimi anlayışı çerçevesinde ve yeni yapılan yasal düzenlemeler ışığında, değişmeye başlayan görünümü ile anlatılmaya çalışılmıştır. Çalışmamızda idari vesayetin bir denetim türü olması göz önünde bulundurularak, idarenin diğer denetlenme şekilleri olan; yargı denetimi, siyasi denetim, kamuoyu denetimi, hiyerarşik denetim ve ombudsman denetimi hakkında bilgi verildikten sonra, idari vesayet; tanımı, içeriği, ilişkili olduğu temel kavramlar ve diğer denetim yöntemleri ile farklılıkları ortaya konularak ele alınmıştır. İdari vesayet incelenirken, konunun daha iyi anlaşılması bakımından yerel özerklik kavramı ayrıca ele alınmıştır. Bu konular ele alınırken, ilgili kitap, makale, mevzuat, yargı kararları ve uluslararası metin ve sözleşme hükümleri incelenip tahlil edilmiştir.Merkezi idarenin yerel yönetimler üzerindeki idari vesayet denetiminin ağır bir şekilde uygulanması durumunda vesayetin, hiyerarşiye yakın bir görünüme kavuştuğu görülmektedir. Ülkemizde merkeziyetçilik geleneğinin de etkisiyle, günümüze kadar, merkezi idarenin yerel yönetimler üzerinde ağır bir vesayet denetimi uyguladığı görülmektedir. Ancak, Türkiye'nin taraf olduğu uluslararası antlaşmalar ve Avrupa Birliği'ne üyelik süreci ile birlikte, yerel yönetimlerle ilgili olarak yeni kabul edilen düzenlemelerde idari vesayet denetiminin hafifletilmeye başlandığı görülmektedir. Sonuç olarak, günümüzde yükselen yerelleşme ve özerklik kavramları karşısında, demokratik ülkelerde olduğu gibi ülkemizde de, hukuka uygunluğu sağlamaya yönelik idari vesayet denetiminin kabul edilmesi ve yerindelik denetiminden olabildiğince uzaklaşılması gereklidir. Yapılacak düzenlemelerde, idari vesayetin tamamen kaldırılması yerine bu ilkeye uygun hareket edilmesi, idarenin bütünlüğü ilkesinin çağdaş ve demokratik değerlerle sağlanması bakımından daha uygun olacaktır. The administration responsible for carrying out public services related to the daily needs of the public has been under control in different ways in order to secure its operation effective and efficient and protects those getting benefit from these public services. The administrative tutelage of the centralised administration which has the authoriy of monitoring over the local administration is a big problem in all over the world in terms of its content and limits and has been engaging the attention of our country's agenda for a time.With this study, the control of administrative tutelage of the central administration over local administration have been analyzed in the light of new public administration concept and recent legal regulations.Having explained the other controling ways such as sudicial control, political control, public control, hierarchical control and ombudsman control by cosidering the administrative tutelage as a controlling sort, the administrative tutelage has been explained by its related basic concepts, contents, definition and discussing the differences with the other control methods. While analyzing the administrative tutelage, the concept of local autonomy has also been analyzed to make the subject more precise. Moreover; while analyzing these topics it has also been referred to related books, current laws, international texts and contracts.When the central authority carries out the administrative tutelage power over the local administration, we observe that tutelage takes a shape closer to hierarchy. In our country, we observe that central administration have had a heavy tutelage control on the local administrations until now with the impacts of centralisation tradition. However, both in line with the treaties Turkey has agreed and the period that Turkey has entered in the way of European Union, we observe that the control is lessening with the new regulations that have been enacted recently. In conclusion, like in every democratic country and in the light of the concepts like decentralization and autonomy that have been gaining too much importance at the moment; it is necessary that we accept the administrative tutelage to provide law appropriateness in place and go as far as possible from aptness control. In the regulations that will be done, instead of removing administrative tutelage it is more appropiate to act in accordance with this principle in terms of providing administrative integrity by contemporary and democratic values.
Orta Asya cumhuriyetleri, bağımsız birer devlet olmalarından sonra, bir yandan jeopolitik yönelimlerini belirlemeye çalışmışlar, diğer yandan da çoğu Sovyet döneminin mirası olan birçok sorunla uğraşmak zorunda kalmışlardır. Bu bağlamda, bağımsızlık sonrası dönemde, iç siyasal yapıda karşılaşılan sorunlar, sınır sorunları ve etnik sorunlar, su rezervlerinin paylaşımında yaşanan sorunlar, enerji kaynaklan üzerinde yaşanan mücadelenin bir yansıması olarak Hazar'ın hukuki statüsü üzerinde yaşanan tartışmalar, geçiş sürecinin neden olduğu ekonomik sorunlar ve liderlerin otoriter yönetimleri nedeniyle yaşanan anti-demokratik uygulamalara bir tepki olarak radikal dini akımların canlanması ve terör hareketleri, Afganistan'da yaşanan karışıklıkların Orta Asya'ya yansıması ve bölge istikrarı üzerinde olumsuz etkilerde bulunması gibi güvenlik sorunlarıyla karşı karşıya bulunmuşlardır. Bu sorunlara ilaveten, Orta Asya cumhuriyetleri, stratejik konumu ve zengin enerji kaynaklanmn bir sonucu olarak, Rusya, ABD, Çin ve İran gibi bölge dışı aktörler arasında cereyan nüfuz mücadelesinin edilgen bir unsuru haline gelmiş ve bu mücadelenin güvenlikleri üzerinde yarattığı olumsuz etkileri göğüslemek zorunda kalmışlardır. 11 Eylül saldırılarından soma ABD'nin terörizme karşı savaş çerçevesinde Orta Asya'ya asker yerleştirmesi bölgedeki güç dengesini değiştirmiş, bu durum bir yandan Washington' a diğer aktörlerle rekabette büyük bir avantaj sağlarken, diğer yandan da Orta Asya cumhuriyetlerinin güvenlik algılamasını kökünden değiştirmiştir. Bölge ülkeleri ise ABD'nin Orta Asya'ya angajmanım memnuniyetle karşılamışlardır, çünkü bu şekilde Rusya'yı dengelemeyi ve yüz yüze bulundukları güvenlik sorunları karşısında Washington'un yardımım sağlamayı amaçlamışlardır. Fakat gerek Washington' un bölgedeki otoriter rejimlerden demokratikleşme ve insan haklan gibi konulardaki talepleri, gerekse de Orta Asya cumhuriyetlerinin de Gürcistan ve Ukrayna gibi bir örtülü devrime maruz kalma olasılığı, liderleri ABD 'ye verdikleri desteği yeniden değerlendirmeye itmiştir. ; After became independent states, the Central Asian republics have strive for determine their geopolitical orientation in one side, have forced to struggle with some problems many of whom are legacies of Soviet priod in another side. In this context, in the post-independence period, they have faced with security problems like problems faced in domestic political realm, border and ethnic problems, problems experienced in sharing of water reservoirs, discussions about the legal status of Caspian which is a reflection of struggle for energy resources, revival of radical religious trends and terrorist movements as a reaction to anti-democratic practises which is a result of authoritharian administration of leaders, reflection to Central Asia disorders in Afganistan and its negative effecs on regional stability. In addition to these problems, Central Asian republics, as a result of their strategic location and valuable energy resources, have been a passive element of struggle for influence which has been between non-regional actors like Russia, USA, China and Iran and have been forced to breast the negative effects of this struggle on their security. After the September 11 attacks, that USA set soldiers in Central Asia in the context of war against terorism changed the balance of power in the region, this condition in one side provided a great advantage to Washington in competition with other players, in another side changed perceptions of security of Central Asian republics completely. As for regional countries, they welcomed engagement of USA in Central Asia, because in this way they aimed to balance Russia and to get help of Washington against security problems faced with. But both demands of Washington for matters like democratization and human rights from authoritarian regimes in the region and possibility of facing a covered revolution of Central Asian republics like Geogia and Ukraina pushed leaders to reconsider their helps to USA which was given.
ÖZET10 Kasım 1938 tarihinde Mustafa Kemal Atatürk'ün hayatını kaybetmesi ile bir-likte Cumhurbaşkanı olan İsmet İnönü ülke yönetiminde en yetkili kişi haline gelmiştir. İnönü'nün CHP ve ülke yönetimindeki adete tek kişilik hakimiyeti ( Milli Şef ) Celal Bayar başta olmak üzere dönemin CHP'li milletvekili ve yöneticilerinde tepkiye neden olmuştur. Bir şahsın parti ve ülke yönetimindeki hakimiyetine İkinci Dünya Savaşı'nın da etkisiyle halkın büyük çoğunluğunda oluşan ekonomik sıkıntının ve iktidarın halkın muhafazakarlığı ile çelişen eğitim ve sosyal alanlardaki uygulamaları CHP ve dışındaki siyasi çevrelerde ve halkın büyük bir bölümünde muhalif bir tutumun oluşmasına neden olmuştur. Bu süreç hükümetin birtakım radikal uygulamaları ile birlikte örgütlü bir mu-halif hareketin doğmasına neden olmuştur. Yukarıda belirtilen nedenlerden kaynaklanan ve açıktan açığa bir söylem ve ey-leme dönüşmeyen CHP milletvekillileri içindeki bireysel tavırlar ilk defa Çiftçiyi Top-raklandırma Kanunu teklifi sırasında ortaya çıkmıştır. CHP milletvekilleri Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan, 14 Mayıs 1945 tarihinde bu kanun teklifinin TBMM'de görüşülmeye başlaması ile birlikte hükümetin bu uygulamasına karşı tavırlarını yaptıkları konuşmalar ile ortaya koymuşlardır. Fakat esasen bu kanun tasarısının TBMM'ye sunulmasından önce CHP içinde muhalif bir grubun oluşması Tevfik Rüştü Aras'ın evinde yapılan perşembe toplantılarıyla başlamıştır. 1945 yılının Nisan ayından itibaren Tevfik Rüştü Aras'ın evinde bir araya gelen Emin Sazak, Adnan Menderes ve Fuat köprülü CHP'nin, İsmet İnönü'nün otoritesi altında olduğunu ifade etmişler ve bu durumu değiştirmek gerektiği üzerinde durmuşlardır. İkinci defa bir ara-ya gelen Adnan Menderes ve Fuat Köprülü demokratik bir merkez oluşturma konusun-da görüş birliğine varmışlardır. Daha sonraki toplantılara Refik Koraltan da katılmıştır. Adnan Menderes, partide ve toplum içinde etkili olan Celal Bayar'ı bu gruba katmak gerektiğini açıklamıştır. Celal Bayar ile yapılan toplantı sonunda o da gruba dahil ol-muştur. Grup üyeleri 18 Mayıs 1945 tarihinde yapılan toplantıda CHP Meclis Grubuna vermeyi düşündükleri Dörtlü Takriri hazırlamışlardır.Takrir verilmeden önce TBMM'de 1945 yılı devlet bütçesinin oylamasına katı-lan üç yüz yetmiş üç milletvekilinden İzmir Milletvekili Celal Bayar, Aydın Milletve-kili Adnan Menderes, İçel Milletvekili Refik Koraltan, Kars Milletvekili Fuat Köprülü ve Eskişehir Milletvekili Emin Sazak bütçeye karşı aleyhte oy kullanmışlardır. Cumhu-riyet Dönemi'nde ilk defa bir bütçeye karşı aleyhte oy kullanılmıştır. Böylece muhalif tavırlarını ikinci defa ortaya koymuşlardır. Grup üyeleri 7 Haziran 1945 tarihinde Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan'ın imzası ile Dörtlü Takrir'i CHP Meclis Grubu Başkanlığı-na vererek muhalif tutumlarını somutlaştırmışlardır. Takrirde CHP'nin işleyişinin de-mokratik ilkelere uygun hale getirilmesini ve TC. Anayasası'nda var olan vatandaş hak ve hürriyetlerinin tanınması talep etmişlerdir. Bu takrir 12 Haziran 1945 tarihinde CHP Meclis Grubu'nda görüşülmüş ve red-dedilmiştir. Takririn reddedilmesi ile birlikte devam eden süreçte bu kadronun CHP içinde siyaset yapma imkanı kalmadığı gibi takrirde talep edilen bir düzenin kurulma-sının CHP içinde mücadele edilerek olamayacağı ortaya çıkmıştır. Takririn, CHP Meclisi Grubuna verildiği günlerde Cumhurbaşkanı İsmet İnönü, Rauf Orbay ile görüşmüş yeni parti kurulması fikrini ona açmıştır. Bu görüşmeden, İnönü'nün yaptığı diğer konuşmalardan cesaret alan grup üyelerine karşı CHP'li yöne-tici ve milletvekillerinin olumsuz tavrı, partinin yayın organı Ulus gazetesindeki ağır sözlerle dolu yazılar grup üyelerinin CHP'den ayrılmalarına neden olmuştur. Zaten Adnan Menderes ve Fuat Köprülü Vatan gazetesinde yayınlanan yazıları nedeniyle CHP Divanı tarafından 25 Eylül 1945 tarihinde CHP'den ihraç edilmişlerdir. Diğer isimlerde istifa etmişlerdir. Partisiz kalan grup üyeleri parti kurma çalışmalarına başla-mışlar ve Demokrat Parti 7 Ocak 1946 tarihinde resmen kurulmuştur. Demokrat Parti, Dörtlü Takrir'in imzacıları: Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan tarafından kurulmuştur. Demokrat Parti'nin simgesi "DP", genel merkezi ise Antalya Milletvekili Cemal Tunca'nın Ankara Sümer Sokaktaki sekiz numaralı binası olmuştur. Demokrat Parti'nin kuruluş gerekçesinde ve programında Türkiye'de demok-ratik bir rejimin kurulacağı, TC Anayasası'nda demokrasiye aykırı kanunların kaldırı-lacağı, vatandaşların hak ve hürriyetlerinin anayasal teminat altına alınacağı dile geti-rilmiştir. Muhalefet yıllarında ise CHP ve iktidar demokratik olmayan tutum ve davra-nışlar sergilemekle itham edilmiştir. Muhalefet yıllılarında iki parti arasında demokra-siye aykırı birçok olay yaşanmıştır. Hatta 7 Ocak 1947 tarihinde gerçekleşen Demokrat Parti Birinci Genel Kongresi'nde kabul edilen Hürriyet Misakı'nda TC Anayasası'na aykırı olan kanunların kaldırılması ve demokrasiye uygun kanunların yapılması talep edilmiştir. Bu istekler yerine getirilmez ise Demokrat Parti Genel Yönetim Kurulu'na sine-i millet kararı ( TBMM'den çekilme ) hakkı verilmiştir. Demokrat Parti yönetici-leri iktidara gelmeleri halinde vatandaşlara hak ve hürriyetlerinin tanınacağı, demokra-siye aykırı kanunların kaldırılacağı ve TC Anayasası'nın demokrasiye uyumlu hale ge-tirileceği sözlerini vermişlerdir. 14 Mayıs 1950 seçim faaliyetlerinde aynı vaatler tekrarlanmıştır. Hatta 2 Nisan 1950 tarihinde Kasımpaşa'da konuşan Demokrat Parti Genel Başkanı Celal Bayar, grev hakkının demokratik hak olduğunu ve demokrasinin olduğu ülkelerdeki gibi toplumsal düzene ve ekonomiye zarar vermeyecek biçimde işçilere grev hakkının verileceğini ifa-de etmiştir. Seçimleri kazanan Demokrat Parti adına Adnan Menderes 22 Mayıs 1950 tarihinde hükümeti kurmuş ve 29 Mayıs 1950 tarihinde hükümet programı TBMM'de onaylanmıştır.Hükümet programında partinin seçim beyannamesinde olduğu gibi iktidar deği-şikliğinin ülkede maddi ve manevi hiçbir sarsıntıya yol açmasına imkan tanınmayacağı ve özellikle devri sabık yaratılmayacağı vurgulanmıştır. Programda, TC Anayasası'nda vatandaş hak ve hürriyetlerine ve millet iradesine dayanan kararlı bir devlet düzeninin gerçekleşmesini sağlayacak düzenlemelerin yapılacağı ifade edilmiştir. Ayrıca CHP hükümetlerinden ( tek parti dönemi ) kalan, demokratik olmayan kanunların, alışkan-lıkların ve anlayışların değiştirileceği vurgulanmıştır. Programda, işçilere grev hakkının sosyal ve ekonomik düzeni bozmayacak şekilde tanınacağı açıklanmıştır. Demokrat Parti İktidarı Programı'nda sadece vatandaşlara tanınacak haklar yer almamıştır. Ayrıca o tarihlerde azınlıkta olsa da bazıları tarafından hak olarak görülen faaliyetlerin yasaklanacağı da yer almıştır. Cumhuriyet'in ve inkılapların korunması için aşırı sol akımlara ( komünizm ) izin verilmeyeceği ve bunlarla etkin bir biçimde müca-dele edileceği ifade edilmiştir. Bunlara karşı kanuni tedbirlerin alınacağı çünkü bu tür düşüncelerin günün şartlarında fikir ve vicdan hürriyeti olarak görülmediği vurgulan-mıştır. Bu fikir akımların hürriyet maskesi altında yayın yapmalarına izin verilmeyeceği çünkü bu düşünce akımlarının amacının özgürlükleri ortadan kaldırmak olduğu iddia edilmiştir. Komünizm fikir akımının yanı sıra irticai hareketlere de asla müsaade edil-meyeceği vurgulanmıştır. Demokrat Parti Dönemi'nde iktidarın sivil toplum kuruluşları ile ilişkilerine özetlemeden önce sivil toplumun örgütü tanımını yapmak yerinde olacaktır. Sivil top-lum kavramı farklı biçimlerde tanımlanan bir kavramdır. Özellikle devlet ile sivil top-lum arasındaki ilişki farklı tanımlamalara neden olmaktadır. Bu tanımlardan bazılarında sivil toplum, devletten tamamen bağımsız, devleti kontrol eden ve hatta devletin alter-natifi olan örgütlü bir güç olarak tarif edilmiştir. Diğer tanımlarda ise devlet ile sivil toplum arasında bu kadar keskin bir ayrılığın olmadığı, sivil toplumun devlete top-lumsal katılımı sağlama amacının var olduğu ileri sürülmüştür. Modern anlamda sivil toplum kavramı "Non Govern Mental Organizations" ( devletten bağımsız örgütlen-meler ) olarak tanımlamasının yanı sıra "gönüllü kuruluşlar", "kar amacı gütmeyen ku-ruluşlar" gibi ifadelerle de tanımlanmaktadır. Sivil toplum tanımını yaptıktan sonra Demokrat Parti iktidarları öncesi sivil toplum örgütlenmesine devletin müdahalesinin ne zaman kaldırıldığına kısaca yer verelim. Türkiye'de 28 Haziran 1938 tarihinde yürürlüğe giren 3512 sayılı Cemiyetler Kanunu ile Osmanlı Devleti döneminden kalma 1909 tarih ve 121 sayılı Cemiyetler Kanun'u ve bu kanunda yapılan 353 ve 387 sayılı kanunlar yürürlükten kalkmıştır. Bu kanunun dokuzuncu maddesinin h bendiyle "aile, sınıf, ırk, cins" esasına dayalı der-neklerin kurulması yasaklanmıştır. Bu madde ile sendika ve birçok derneğin kurulması yasaklanmıştır. Bu kanunun kabul gerekçesinde, o dönem de bazı ülkelerde var olan ko-münist ve faşist rejimlerin ülkenin yönetimin ele geçirmesini önlemek olduğu ileri sü-rülmüştür. İsmet İnönü'nün 10-11 Mayıs 1946 tarihinde CHP Kurultayı'nda yaptığı konuşmadan sonra 5 Haziran 1946 tarihinde 4919 sayılı Kanun ile dernek kurma işle-mindeki izin alma formalitesi kaldırılmıştır. Sınıf esasına dayalı dernek kurma yasağı da kalkmıştır. Bu kanunun kabulü sırasında Demokrat Parti adına bir konuşma yapan Adnan Menderes, kanunda yapılan değişikliği demokrasiye giden yolda önemli bir aşa-ma olarak adlandırmıştır. Sivil toplum örgütlenmesinin önündeki engeller Demokrat Parti İktidarı öncesinde kaldırılmıştır. Demokrat Parti İktidarı döneminde sivil toplum kuruluşları ile ilişkiler iki bölü-mde ele alınabilir. Birinci bölüm hükümetin sivil toplum alanında yaptığı düzenleme-lerden oluşur. İkinci bölüm ise iktidarın sivil toplum kuruluşlarına yaklaşımı yani onların faaliyetlerine karşı tutumu, ülke yönetimi ile ilgili alınan kararlara ilgili sivil toplum kuruluşlarının tepkileri ve sivil toplum kuruluşlarının kendi alanları ile ilgili alınan kararlarda bu kuruluşların isteklerinin ve itirazlarının dikkate alıp almamasından oluşur.Demokrat Parti İktidarı döneminde sivil toplum alanında birçok düzenleme yapılmıştır. Hükümetin yaptığı bu düzenlemelere günümüzün demokrasi düzeyi ile yaklaşmak zamanın koşullarını ve demokrasi kültürünün oluşum sürecini dikkate almamak anlamına gelir. Hükümetin sivil toplum alanında yaptığı ilk düzenleme 5680 sayılı Basın Kanunu'dur. Kanunun kabulü demokrasi ilkeleri ile bağdaşan bir uygulama olmuştur. Bu nedenle basın ve basın-yayın örgütleri bu yasayı doğru bir adım olarak görmüşlerdir. Hükümetin sivil toplum alanında yaptığı ikinci kanuni düzenleme 5844 sayılı Komünizm İle Mücadele Kanununu çıkarmasıdır. İktidarın programında komü-nizm fikir akımına ve komünist yayınlara karşı mücadele edileceği, bu fikir akımlarının faaliyetlerinin demokratik bir fikir ve vicdan hürriyeti olarak görülmediği aksine de-mokratik rejimi ortadan kaldırmaya yönelik bir tutum ve tavır olduğu vurgulanmıştır. Muhalefetin de bu konuda iktidarla aynı düşünceye sahip olması bu kanunun çıkarıl-masını kolaylaştırmıştır. Demokrat Parti İktidarı'nın bu tür düşünce akımlarına ve onların faaliyetlerine izin vermemesini değerlendirirken zamanın koşullarını ve demok-rasi kültürünün oluşum sürecini göz önünde tutmak yerinde olacaktır. İktidarın sivil toplum alanı ile ilgili yaptığı bir başka uygulama ise 5816 sayılı Atatürk Kanunu'nun çıkarılmasıdır. Atatürk'ün kişiliğine, ilke ve inkılaplarına saldırıların sonucunda kabul edilmiş olan bu kanun günümüzde de geçerlidir. Bu kanunun çıkarılmasına Atatürk'ün kurduğu parti olan CHP'li milletvekillerinin karşı çıkmış olmaları ise üzerinde durul-ması gereken önemli bir husustur. Hükümetin sivil toplum alanında gerçekleştirdiği bir başka düzenleme ise 6761 sayılı Vicdan ve Toplanma Hürriyetini Koruma Kanunu'nun kabul edilmesidir. Kanun, irticai hareketlerin artarak rejimi tehdit eder hale gelmesinin sonucu çıkarılmıştır. İrticai hareketlere izin verilmeyeceğini, demokratik rejimi koruya-cağını programında ilan eden hükümet bunun gereğini yerine getirmiştir. Dinin siyasi veya diğer çıkarlar için kullanılması ve bu tür örgütlenmelerin kurulmasını demokratik ilkelerle bağdaştırmak mümkün değildir. Hükümetin sivil toplum alanına bir başka müdahalesi Neşir Yolu ile veya Radyo ile İşlenecek Bazı Cürümler Hakkındaki Kanun'u çıkarması ile 6732 ve 6733 sayılı basın kanunlarının bazı maddelerini değiş-tirmesi ile olmuştur. Bu kanunlarda yer alan kişilerin şikayeti olmadan savcıların ya-yınlar ile ilgili kendiliğinden harekete geçebilmesi unsuru haber alma ve verme hür-riyetini engelleyen bir koşul oluşturmuştur. Yine gazetecilerin yaptıkları haberler ve köşe yazarlarının yazdıkları yazılar nedeniyle şikayet edilmeleri halinde kendilerini müdafaa edebilmeleri için ispat hakkının onlara verilmeyişi bazı konularda ( iktidar ve mülki amirler ile ilgili yolsuzluk vb) haber yapmalarına, yazı yazmalarına engel olacak ortamı oluşturmuştur. Ayrıca, halkın haber alma özgürlüğüne, gazetecilerin özgür ve bağımsız çalışmasına engel olmuştur. İspat hakkı verilmediği gibi bu tür yazı ve haberler için cezaların arttırılması basın hürriyetini ortadan kaldırmıştır. Bu nedenle bazı basın mensupları hareket içerikli haber ve yazıları nedeniyle ceza almış olsalar da hükümetin politikalarını eleştiren onlarca basın çalışanına hapis cezalarının verilmesi vatandaşlara hak ve hürriyetlerini vereceğini ve devri sabık yaratmayacağını söyleyen Demokrat Parti İktidarı'nın bu uygulamaları onun söylemleri ve adıyla çelişmesine ne-den olmuştur. Hükümetin sivil toplum alanında yaptığı bir başka kanuni düzenleme 6771 Sayılı Toplantılar ve Gösteri Yürüyüşleri Kanunu'nu çıkarmasıdır. Kanun, siyasi partilerin seçim varmış gibi çok fazla miting yaptığı ve bu mitinglerde konuşanların hükümeti ağır bir şekilde eleştirdiği ve hatta bazı hatiplerin hükümet üyelerine ağır sözler söylediği gerekçeleriyle kabul edilmiştir. Bu kanun ile partilerin miting ve kapalı alan toplantıları seçim zamanı ile sınırlandırılmıştır. Bu nedenle bu uygulama demokrasiye aykırı bir düzenleme olmuştur. Bir parti veya dernek kanunlara aykırı hareket etmediği sürece istediği zaman izin almak koşulu ile miting yapabilmelidir. Hükümetin sivil toplum kuruluşları ile ilişkilerine baktığımızda ise olumlu ve o-lumsuz tutum ve uygulamaların varlığından söz edebiliriz. İktidarın sivil toplum kuru-luşları ile ilişkileri dernekler, sendikalar ve basın teşkilatları ile olmak üzere üç ana bö-lüm halinde ele alınabilir. Derneklerle ilişkilere baktığımızda öğrenci dernekleri ile iliş-kilerin daha yoğun olduğunu söyleyebiliriz. Özellikle TMTF ve MTTB gibi öğrenci dernek federasyonları yönetimleri ile ilişkiler öğrenci dernekleri ile ilişkilerin en önemli bölümünü oluşturur. Bu konuda partilerin bugünde devam eden derneklerin yönetimle-rini elde etme isteği Demokrat Parti İktidarı'nın da faaliyetlerinden birisini oluşmuştur. Muhalif olan yönetimleri değiştirmek için çeşitli çalışmalar yapılmıştır. Bu doğrultuda Demokrat Partili dört milletvekili tarafından öğrenci derneklerine hükümetin verdiği ö-deneği dağıtma ve gençlik sorunlarını çözmek amacıyla kurulmuş olan Gençlik Bürosu' nun TMTF ve MTTB'nin yönetim kurulları seçimlerine müdahale etmesi ve sonrası yaşanan olaylar demokrasi ilkeleri ile bağdaşmamıştır. Ayrıca Türkiye Milli Gençlik Teşkilatı adında bir gençlik derneği varken Türk Milli Birliği'nin kurulması ve böylece geçliği farklı cephelerde örgütleme isteği gençliğin birbiri ile kavgalı hale gelmesine ne-den olmuştur. Radyo Dinlemeyenler Cemiyeti'nin İstanbul Valisi Ethem Yetkiner tara-fından kanunsuz bir biçimde kapatılması, Ankara Üniversitesi Siyasal Bilgiler Fakültesi Dekanı Turhan Fevzioğlu'nun görevden alınması nedeniyle eylem yapan öğrencilerin gözaltına alınması ve mahkemeye verilmesi, İTÜTB'nin üniversitedeki yemek boykotu nedeniyle öğrencilerin gözaltına alınmaları, mahkemeye verilmeleri ve hükümet yetki-lilerinin bu konuda yaptıkları açıklamalar demokratik bir iktidar sivil toplum kuruluşu ilişki tarzına aykırı olmuştur. Tahkikat Komisyonu kararları ile örfi idarelerin kurulması ve öğrencilerin tepkilerinin engellenmesi de demokrasi açısında doğru olmayan uygula-malar olmuştur. Kiracılar Cemiyeti'nin istekleri dikkate alınarak Kira Kanunu'nun ka-bul edilmesi, tüccar, esnaf ve sanayicilerin derneklerinin talepleri dikkate alınarak Milli Korunma Kanunu'nda yapılan değişiklik ve kredi imkanlarının artırılması gibi karar-larda dernekler ile ilgili hükümetin olumlu yönde uygulamaları olmuştur. Ayrıca hükü-metin irtica ve komünizm ile mücadeleleri de dernekler tarafından olumlu karşılan-mıştır. Hükümetin sendikalar ile ilişkilerine baktığımızda ise grev hakkı tartışmalarının en önemli sorun olduğunu söyleyebiliriz. İktidarın seçim vaatlerinde ve programında olan grev hakkı ile ilgili sendikalar tarafından onlarca talep gelmiştir. 1951 yılında bir tasarı hazırlanmış olmasına ve ilgili bakanların bu hakkın verileceğini yıllarca söyleme-lerine karşın grev hakkı verilmemiştir. Decentralization, rapid urbanization and metropolization processes that emerged by means of these changes have boosted authority, spending and responsibility of local governments. Local governments gradually came to the fore in the process of service delivery. However, especially, allocation of self-income and resources to local governments have not shown a similar level of increase. In this study, this dilemma is analyzed in cases of municipalities in Turkey. The purpose of this study is to reveal the contradiction between the increased burden of duty and income of the municipalities. By this way, it is aimed to provide a scientific basis for policy makers in solving self-income problems. In this context, the situation of the municipalities in Turkey has been analyzed. The case is studied with both theoretical and numerical data and the problem has been clearly demonstrated. 2. The second phase is the amount of discretion given to regional and local governments to determine their expenditures and revenues (both in aggregate and detail). This discretion gives regional and local governments the ability to determine their budgets by levying taxes and fees and allocating resources (Davey, 2003: 1). The essence of fiscal decentralization is the authority and responsibility of subnational governments to finance their local services to a certain extent (Ebel & Yılmaz, 2002: 34). In other words, fiscal decentralization occurs when higher levels of government cede influence over budgets and financial decisions to lower levels (Sharma, 2008). Decentralization and fiscal decentralization trend that has developed in the framework of thinking that local governments should be strengthened has also created the infrastructure of financial autonomy. Fiscal Autonomy aims to enable local governments to have adequate, healthy and sustainable resources in order to ensure the institutionalization of democracy and effective implementation of their services. To achieve this aim, local governments manage/spend assets and resources in line with their laws (in accordance with the interests of the local population). Increased Responsibility of Municipalities as a Result of Urbanization and Metropolization in Turkey The urbanization rate was very slow in the early years of the Republic of Turkey. The population living in rural areas began to migrate to urban areas in the 1950s due to improvements in transportation infrastructure, change of the land ownership regime, mechanization and modernization of agriculture, technological developments, increase in industrialization, and other economic/social changes. In particular, migration to cities increased in line with the population growth. This accelerated the need for better highway networks and settlement areas, and new housing (Tosun, 2015: 202- 203, Şahin, 2013: 79). There have been serious population increases in cities such as Istanbul, Izmir, Adana, Ankara and Bursa. This trend caused significant problems in terms of urban services in these cities (Keleş, 2009: 289). Local governments and especially municipalities took on the most important tasks of on-site analysis of the mentioned problems and solving them with practical - permanent proposals. 4. Comparative Analysis of Revenues and Expenditures of Municipalities in Turkey Municipalities became center-dependent units from financial, political and administrative aspects. It is mainly due to inefficient income structure that is dependent on central transfers, not on self-income. It is clear that this situation causes many negative effects on the functioning of municipalities. However, inadequacy of self-income or dependency needs to be demonstrated with numerical data in order to see the adverse trend in a concrete way. This enables a comparison in an international scale and identification of appropriate sample countries for the planned changes for these comparisons. Furthermore, it becomes possible to analyze financial interdependence among different municipal levels and all municipalities. Through detailed assessments, the dilemma between metropolization and fiscal decentralization in Turkey has been put forward in this study. 5. Basic Financial Problems of Municipalities in Turkey The main financial problems of the municipalities can be listed as lack of sustainable revenue sources, ineffective use of available resources, over-dependence on shares transferred from general budget tax revenues collection, inadequacy of self-income sources (Yüksel, 2004). Because of these financial problems, there are many negative situations faced at the local level. 6. Conclusion There is a trend of urbanization and metropolization in Turkey. 93% of the total population lives within the municipal boundaries. 84% of the population within municipal boundaries is within the borders of the metropolitan municipalities. Metropolitan municipalities have the highest burden of responsibilities. Then comes the provincial municipalities, district and town municipalities. However, amount of incomes is in the opposite order. This situation, prevents municipalities from enjoying the benefits of fiscal autonomy and fiscal decentralization. Instead, they become highly dependent on the central government. To get rid of this dilemma, a three-stage policy must be followed. Firstly, efficiency in spending should be achieved. Secondly, steps should be taken to make the most out of available income sources. Finally, municipalities should be provided with new sources of revenue in order to get rid of the fiscal dilemma. While these steps are being taken, rather than applying a general method, political characteristics and administrative, economic, cultural of Turkey should be taken into consideration and Turkey-specific system should be established.

AT'yi sui generis yapan ve diğer örgütlenmelerden ayıran en önemli özellik, belirlenen hedeflere ulaşırken hükümetler arası girişimler yerine, oluşturulan yapısal (anayasal) ve sürekli organlar vasıtasıyla bu amaçlara ulaşmasıdır.Avrupa Birliği'nin kurumlarının görev, yetki ve sorumlulukları kurucu antlaşmalarca belirlenmiştir. Antlaşmaların uluslar üstü düzenleme, uygulama ve yargılama yapma yetkisi vermiş olduğu kurumlar (Konsey, Komisyon, ATAD), Avrupa Birliği ulusları arasında uluslar üstü otorite olarak da değerlendirebilmektedir. Aynı şekilde gerek bu kurumları oluşturan antlaşmalar hukuku, gerekse yaptığı hukuk, üye devletlerde aynı etkiye sahip olup, üye devletler tarafından tek taraflı olarak değiştirilemez ve ortadan kaldırılamaz nitelikte olması da Avrupa Birliği hukukunun uluslar üstü (supranational) olduğu yaklaşımını geliştirmiştir.AB tam anlamıyla devletin ana öğelerini bünyesinde bire bir barındırmamakla beraber, devlete, özellikle federal devlet biçimine çok benzer yetkiler kullanmakta, AB Anayasal Antlaşması ile bir anayasal yurttaşlık oluşturmaya çabalamaktadır. Kuvvetler ayrılığı ilkesi çerçevesinde yasama, yürütme ve yargı yetkilerini birbirinden ayrıştırmış ve her biri için ayrı organlar yaratmış ve bunların işleyişini de kurucu antlaşmalara ve nihayetinde anayasa ile hukuk ilkelerine bağlamıştır. . Bireylerine AB Temel Haklar Şartı ile temel hak ve özgürlüklerin kullanımı ve hak arama özgürlüğünü tanımaktadır. Üyesi bulunan devletler ile yetki paylaşımı yaparak bunu anayasa metnine dâhil etmiştir. ; The State is an entire of the institutions. The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.
