Input legitimacy e output legitimacy dell'Unione europea. A che punto siamo
Nell'ultimo decennio del XX secolo la vecchia dicotomia tra "governo del popolo" e "governo per il popolo" fu adattata al sistema istituzionale dell'Unione Europea in termini di opposizione tra una input legitimacy fondata sulla investitura democratica dei rappresentanti, e una output legitimacy fondata sulla capacità delle politiche governative di ottenere risultati.

In the gap between legality and legitimacy
It may be challenging to see how illegal hunting, a crime that ostensibly proceeds as shoot, shovel and shut up in remote rural communities, at all communicates with the regime. Examining the socio-legal interplay between hunters and state regulation, however, clarifies illegal hunting to be part of a politically motivated pattern of dissent that signals hunters' disenfranchisement from the polity. While few contemporary illegal hunters cut conscientious figures like Robin Hood, their violation of illegitimate law may likewise testify to a profound disjuncture between legality and legitimacy. This is the premise taken in the following research. Here it is observed contemporary Swedish hunters experience the deliberative system pertaining to wildlife and wolf conservation to be systematically stacked against them and unable to serve as a site for critical law-making that provides equal uptake of all voices. One manifestation of their growing disenfranchisement is the establishment of a counterpublic mobilised on the basis of shared semantics for the sorts of deliberative deficits they argue befall them in the present. Within the remit of their counterpublic, hunters undertake and justify illegal hunting along with other forms of disengaging dissent like abstentions, non-compliance, boycotts and conscientious refusals with state agencies. The research captures hunters' dissent in Smith's deliberative disobedience, a deliberative and Habermasian grounded reinterpretation of the more familiar classical theory of civil disobedience. On this perspective, illegal hunting signals a deficit in the deliberative system, which hunters both bypass by taking an alternative conduit for contestation, and draw attention to when they undertake dissent. The dissent in this case study is deconstructed in terms of its grammar—as simultaneously engaging and disengaging with the premises of power—and in terms of its communicative content. Set within the field of Environmental Communication, the dissertation is intended as an empirical and theoretical contribution to a discussion on the boundaries of political dialogue in the context of civic disenfranchisement: it asks whether some of hunters' dissent may be parsed as a call for a more inclusive debate, or as dialogic acts in themselves. Finally, it presents ways toward short-term and longer-term reconciliation of hunters with the deliberative system, drawing on the work of contestatory citizen mini-publics from the third wave of deliberative democracy.

This paper addresses the issue of legal pluralism and the plurality of legal systems starting from the book 'The legacy of pluralism. The continental jurisprudence of Santi Romano, Carl Schmitt and Costantino Mortati'. In particular, through the valuable leitmotif introduced by the Authors, consisting of the double relationship between 'juristic and political conceptions of law' and between 'matter and nomic force', the contribution of the doctrine following the publication of 'L'ordinamento giuridico' by Santi Romano is analysed, with particular attention to the comparison with Carl Schmitt and Costantino Mortati, focusing on the axiological innovation of the Republican Constitution.

"A suitable successor": Building Legitimacy in Hilary's Sermon on the Life of Honoratus
The monastic and hagiographical contents of Hilary's Sermon on the Life of Honoratus (430-431) have received substantial consideration. Much less attention has been paid to the role the sermon played in the specific context of Arles. In this article, I will focus attention on the social and political dimension of the text and will argue that Hilary's main purpose was to justify his election as bishop of Arles. Hilary portrayed Honoratus as the ideal bishop and exploited the similarities between the two in order to present himself as the suitable successor.

Il lavoro offre una ricostruzione storica ed empirica delle logiche legittimanti nelle unità politiche complesse – sovrannazionale e multinazionale federativo. L'Unione europea e l'URSS sono i due casi studio analizzati nei quali la legittimità viene strumentalizzata dalla prospettiva classica del conflitto sociale. Mentre la dimensione sociale ne è considerata il quadro per la strumentalizzazione. La legittimità europea e i suoi canali di legittimazione sono ricostruiti empiricamente, mentre la legittimità sovietica è analizzata nel quadro della retorica intorno alle politiche sociali su un ricco materiale propagandistico. La legittimità sovrannazionale europea avviene in due direzioni – al livello dei Paesi membri e al livello sovrannazionale. Una sfida per l'Ue è, come risulta, è quella di conciliare i due discorsi contradditori, mirando il cittadino come desinatario principale delle sue logiche legittimanti. Nel caso dell'URSS si ha un discorso abbondante rivoltosi direttamente al cittadino, di sostanza gravemente ideologica, che però non riesce a sostenere la legittimità dell'URSS nel momenti delle grandi fratture economiche. Il lavoro rappresenta una combinazione metodologica della classica scienza politica e studi dell'integrazione regionale, cui concetto del driver della regionalizzazione aiuta a strumentalizzare la legittimità politica come meta da raggiungere. ; The work provides a historical reconstruction of the logical and empirical legitimating in complex political units - supranational and federative multinational. The European Union and the USSR are the two case studies analyzed, which legitimacy is exploited from the classical perspective of social conflict. While the social dimension is taken as the framework for the exploitation. The European legitimacy and its legitimacy channels are reconstructed empirically, while the Soviet legitimacy is analyzed in the context of the rhetoric surrounding the social policies based on the rich propagandistic material. The European supranational legitimacy occurs in two directions – at the level of Member states and supranationally. A challenge for the EU is, as it turns out, to reconcile the two contradictory discourses, targeting citizens as the main addressee of its legitimizing logics. In the case of the USSR, its abundant speech targeting directly the citizens, with a serious ideological substance, fails to uphold the Soviet legitimacy in the great economic fractures. The work is a methodological combination of classical political science and regional integration studies, which concept of regionalization drivers is helpful to frame the political legitimacy as a goal.

L'intento di questo articolo è quello di analizzare il significato ideologico e la funzione propagandistica delle principali caratteristiche iconografiche dei ritratti ufficiali dell'imperatore Federico II di Svevia in affreschi, sculture, monete e sigilli. Prima di tutto, per fare questo, si sono dovuti individuare gli aspetti fondamentali della suddetta iconografia relativa a Federico II. Dopo questo, il passo successivo è stato quello di provare a delineare quale messaggio politico si voleva propagandare attraverso di essi: un'idea, cioè, di legittimità e sacralità fondato sulla "renovatio" dell'Antico Impero Romano e sul valore sacro delle leggi. Un messaggio, quindi, alternativo a quello che era basato sul rito dell'incoronazione sostenuto dal papato. ; The aim of this article is to analyse the ideological significance and the propagandistic function of the main iconographic characteristics of the official portrayals of the Emperor Frederick II of Swabia on frescos, sculptures, coins and seals. First of all, in order to do this, the fundamental aspects of this iconography related to the Emperor Frederick had to be singled out. After that, the next step was to try to outline which political significance was meant to be propagandized through it: a message, that is, of legitimacy and sacredness founded on the "renovatio" of the ancient Roman Empire and upon the sacred value of the laws. An alternative message, therefore, to that which was based on the coronation rite advocated by the papacy.
