Özet: İkinci Dünya Savaşı sonrası kurulan Birleşmiş Milletler (BM), kurulduğu andan bugüne değin hiç olmadığı kadar derin bir kriz ile yüz yüze kalmış du-rumdadır. BM'nin varlık ve etkinlik sorununu oldukça etkileyen bu kriz; meşruiyet krizidir. BM'nin bu krizden hasıl çıkacağı, hayata geçireceği reformlara ve kaybettiği siyasi kararlılığı yeniden kazanıp kazanamayacağına bağlıdır. Öncelikle üyelerin reform çalışmaları konusunda samimi olmaları ve Genel Ku- rul'daki görece demokratik ortamın başta Güvenlik Konseyi olmak üzere BM'nin diğer tüm organ ve kuruluşları için de sağlanması gerekiyor. Örgütün kurulduğu ilk yıllardan beri gelen reform ihtiyacı karşılanamadığı, Konsey'deki veto ve temsil adaletsizliği giderilemediği sürece BM'nin meşruiyeti büyük yara almaya devam edecektir. Bu bağlamda, meşruiyet sorunu sadece bir etkinlik değil aynı zamanda bir varlık sorunu olarak da değerlendirilmelidir. ; Abstract: The United Nations (UN), having founded following the World War II, is face to face with a deep crisis that never experienced before. This is the legitimacy crisis heavily affecting the raison d'etat and the UN's question of efficiency. The way how the UN will break through this crisis is conditional upon its reforms and will to regain its political determination. Before all else, the member states have to be sincere about the reform endeavors and there is a certain need to settle the relatively democratic medium of the General Assembly in all bodies of the UN. The legitimacy crisis of the UN will continue to bleed unless the needs for the reforms since the early years is fulfilled and the injustice of veto and representation in the Security Council are removed. Yet, the UN does not seem to overcome the legitimacy crisis in the foreseeable future due to problems such as anachronic structure, disproportionate representation, very limited veto authority, financial difficulties, lack of political determination, malfunctionality of collective security, the rising effectiveness of regional integrations and such organizations and convulsion of international trust towards the UN. Moreover, as much as this crisis continues the norms founded with the UN Charter and adopted on a large scale could wither away substantially. In this context, legitimacy crisis should be evaluated not as a matter of strength but also a question of existence.
ÖZBu çalısma modernite ve liberalizmi Weber teorisi çerçevesinde ele alarakbulgularını ulusüstü bir otoritenin mesruiyet arayısına uygulamaya çalısır. Temeliddia, modernitenin ötesine geçen bir çok özelligi içinde barındırsa bile AvrupaBirlgi'nin hala Max Weber tarafından ayrıntılarıyla gösterilen moderniteninikilemlerinin etkisi altında oldugu ve mesruiyet açıgının bu çeliskili çerçevededegerlendirilmesi gerektigidir. Bu perspektif bize çagımızda ve özelikle AvrupaBirligi'nde iktidar ve süje arasındaki tahakküm iliskilerinin çok fazla degismediginihatta sıradan insan aleyhine ve iktidar lehine gelistigini göstermektedir; ulus-üstüiktidar kompleks ve anarsik dogasına ragmen ve hatta bazı durumlarda bu dogasınedeniyle güçlenmektedir.Anahtar Kelimeler: Max Weber, mesruiyet, Avrupa Birligi ABSTRACTThe work focuses on Weberian theoretical approach to modernity and liberalism andapplies its findings to the quest of a supranational order for legitimacy. Its mainclaim is that the Union, despite to the fact that it shows many characteristics of anentity beyond modernity, still suffers from the dilemmas of modernity and liberalismwhich have extensively been shown by Max Weber and its legitimacy deficit is to beevaluated in that dilemmatic context. This perspective shows us that the dominationrelation between authority and subject has not changed much but only developedmore in favor of authority and at the expense of layman at our age and especially inthe context of the European Union; this is so despite to, in some cases due to,complex and anarchic nature of the supra-national politics.Keywords: Max Weber, legitimacy, European Union
Her ne kadar tüm devletler uluslararası sistemin egemen ve eşit birer aktörüyseler de; bunların sistemiçindeki etkinlikleri genellikle sahip oldukları güç nispetinde sınırlanmaktadır. Diğer bir ifade ile bir devlet nekadar güçsüzse o kadar sınırlandırılabilir, ne kadar güçlüyse o kadar sınırlandırılamaz olur. Ancak, çağımızdakibüyük güçler, örneğin ABD ve Rusya, kendilerine meydan okuyacak veya hesap sorabilecek bir güçbulunmamasına rağmen gerçekleştirdikleri uluslararası eylemlerde hep bir meşruiyet arayışı içerisindeoluyorlar. Bu çalışmanın temel amacı bu arayışın nedenini anlamaktır. Bunun için ABD'nin 2003 Irak veRusya'nın 2015 Suriye müdahaleleri örnek vakalar olarak ele alınmış. Bu vakalar Putnam'ın İki Aşamalı Oyunteorisine ara değişken olarak meşruiyet kavramının eklenmesi ile oluşturulan model ışığında anlaşılmayaçalışılmıştır. ; Although, all of the states are sovereign and equal actors of the international system, their influence in the system is limited with the power they possessed. In other words, the weaker a state is, the more likely it is to be limited in its actions; the powerful a state is, it is difficult to be limited in its actions. However, great powers of our era, such as USA and Russia, although there is no power who can challenge or call for an account against them, they are always in a search for legitimacy in their international actions. The main objective of this paper is to understand this search for legitimacy. Accordingly, 2003 USA's Iraq and Russia's 2015 Syria interventions have been chosen as the cases. These cases are analyzed through a model that is consisted of Putnam's Two Level Game and the concept of legitimacy

Çalışma, meşruiyetin; statükonun haklılaştırılması, kendi dışındakileri olumsuzlaması ve toplumun siyasal, sosyal ve ekonomik olarak yeniden kurulması fonksiyonlarını tartışmaktadır. Bu çalışma, siyasal iktidar geleneğinin kendisini meşrulaştırmak için kullandığı yöntemleri de ele almaktadır. ; The study analyzes the relationship between the most important concepts of political science, political power and legitimacy and evahlates the phases, deflnitions and critiques of legitimacy in the history of political thought. it examines the political power's pursuit of social obedience before and after the theories of the modern state. The function of legitimacy and the relationship between political power and society are discussed. These functions consist of the legitimizaüon and justification of the statü s quo, the creation and exclusion of the "others", and thereconstnıction of the society in terms of social, economic and political engineering. The study, in detail, examines and criticizes the means that the legitimacy resorts to justify the political power.
Çalışmada millet iradesinin yasal meşruiyetin temelini teşkil edip edemeyeceği sorunu ele alınmaktadır. Çoğunluğun iradesinden doğan yasaların meşru olup olmayacağı, şayet bu soruya verilecek cevap olumsuz ise meşruiyetin temelini neyin teşkil edeceği hususları millet ve irade kavramlarının tarihi analizinden yola çıkılarak değerlendirilmiştir. Millet iradesi düşüncesi, Rousseau'nun genel irade kavramının içeriği ile günümüzde de cari olduğundan özellikle Rousseau'nun genel iradesinden doğan milli irade mefhumu ele alınmıştır. ; This question of whether the general will can form the basis of legitimacy was discussed in this thesis. "Can we say that a law made by the will of the majority is directly legitimate? If our answer is negative, where should we look for legitimacy?" We are looking for answer to these questions. In this context, we use Rousseau's concept of general will. This idea is still valid in contemporary political athmosphere. Because of that we'll critisize Rousseau's general will idea and modern concept of nation.
Our aim in this study is to evaluate the corporate social responsibility practices of Koza Mining Operations from the perspective of institutional mechanisms, and to reveal the society-based nature, which was inadequate in previous studies that explain the concept in particular.In particular, the fact that the institutional environment is subject to insufficient scrutiny by researchers and the studies conducted so far mainly on the place of responsibility practices related to financial performance have caused the concept to be subject to limited research in the literature. The study was carried out through in-depth interviews and archive scans with company officials in three mining sites (Bergama, Balıkesir and Gümüşhane) where the highest number of administrative lawsuits were filed against Koza Mining Operations. The case study method was chosen among the qualitative research methods in the study. According to the findings obtained from the study, it was determined that the company uses its corporate social responsibility practices as a public relations policy to solve or eliminate local or national problems (corporate legitimacy crisis) in the region.
Modern devletin vazgeçilmez unsurlarından biri olan egemenlik anlayışı önemli bir dönüşüme uğramıştır. Bugün Jean Bodin'in kurumsallaştırdığı; mutlak, bölünemez ve sürekli olarak nitelendirilen klasik egemenlik anlayışından bahsetmemiz mümkün değildir. Klasik egemenlik anlayışının geçirdiği dönüşümün çeşitli sebepleri bulunmaktadır. Bu sebepleri hukuk devleti, insan hakları, kuvvetler ayrılığı prensibi ve uluslararası kuruluşlar olarak ifade etmemiz mümkündür. Özellikle Birinci ve İkinci Dünya Savaşı sonrasında ortaya çıkan uluslararası kuruluşlar devletlerin egemenliğine müdahale konusunda oldukça dikkat çekicidir. Egemenlik anlayışının geçirdiği bu dönüşüm sırasında dünya birçok katliama ve savaşlara tanıklık etmiştir. Bu doğrultuda da önce ad hoc mahkemeler kurulmuş ardından da Uluslararası Ceza Mahkemesi'nin kuruluşuna giden süreç başlamıştır. 17 Temmuz 1998 tarihinde kabul edilip, 1 Temmuz 2002'de yürürlüğe giren Roma Statüsü ile de Uluslararası Ceza Mahkemesi kurulmuştur. Devlet egemenliğine önemli bir müdahale anlamına gelen Uluslararası Ceza Mahkemesi'nin yargılama yetkisi konusunda tamamlayıcılık ilkesinin kabul edilmesiyle, devlet egemenliğine yapılan müdahalenin daha aza indirgenmesi amaçlanmıştır. Aynı zamanda da Statü'ye taraf olacak devlet sayısını arttırmak amaçlanmıştır. ; Our understanding of sovereignty, which is one of the essential factors of modern state, has undergone a significant transformation in time. Today, it is impossible to mention a classical understanding of sovereignty which was institutionalized by Jean Bodin as; absolute, indivisible and perdurable. There are various reasons that caused the transformation of classical sovereignty; it can be said that these reasons are constitutional state, human rights, principle of separation of powers and international organizations. The international organizations, especially established after the First and Second World Wars, are quite significant instruments in the process of intervening to the sovereignty of states. During the transformation of understanding of sovereignty, the world had witnessed numerous massacres and wars. In this respect, firstly ad hoc tribunals had been established, after that the process towards the establishment of International Criminal Court started. International Criminal Court was established with Rome Statute which was acknowledged on July, 17, 1988 and inured on July, 1, 2002. Through the acceptance of complementarity principle in terms of International Criminal Court's jurisdiction, it is intended to minimize the intervention to the sovereignty of states. Also, it is aimed to increase the number of states parties to the Statute.
In recent years, there has been an increase in the international activities of local governments in Turkey. Local governments conduct international activities by establishing sister city relations, becoming members of international organizations, and signing cooperation protocols, and memoranda of understanding/goodwill letters. The present study aimed to investigate the activities regarding the international activities of local governments in Turkey. In the study, lectures on international activities, following the description of theoretical, historical and legal backgrounds of international relations, the statistical data on the activities of local governments in Turkey are presented, and some observations and assessments were made through the information obtained from the relevant unit managers of six metropolitan municipalities in Turkey which have the strongest memberships in international organizations. As a result, it was determined that there has been an increase in the number of international activities of local governments in Turkey, memberships to these organizations have been effectively carried out, the municipalities have become a member of international organizations which are expected to benefit from, a purpose was determined by these municipalities before becoming a member, and these municipalities have become stakeholders of international organizations and have gained significant benefits through these joint projects.
