The paper considers the problem of interrelations between democratic political regime and legitimacy of government within a liberal and republican models of democracy. The author analyses various approaches and establishes interconnection between evolution of democracy and conceptions of legitimacy. ; В статтi розглядається проблема спiввiдношення мiж демократичним полiтичним режимом та легiтимнiстю влади в рамках лiберальної та республiканської моделей демократiї. P. Rosanvallon's philosophic concept's democracy legitimacy has been studied in light of interpretation by the philosopher of the legitimacy, social generality and democratic regime. The legitimacy term's interpretation has been considered, and perception of democratic legitimacy,which provided a background for XX century democratic regimes, has been analyzed. The notion and variations of social generality, which is considered to be part of the so called shifted democracy center, has been analyzed. It is suggested to consider three types of democracy: proximity, participation and cooperation. Розанвалона крізь призму тлумачення філософом концептів легітимності, суспільної загальності та демократичного режиму. Розглянуто тлумачення терміну легітимність та проаналізовано сприйняття демократичної легітимності, яке забезпечило основу демократичним режимам ХХ ст. Проаналізовано поняття та різновиди суспільної загальності, яку у своїй основі вважають частиною так званого зміщення центру демократій. Запропоновано до розгляду три форми демократії: наближеності, участі та взаємодії. Reviewed in historical prospect development and incipience legitimacy of political power in primitive and modern societies. Special emphasis put on a transformation of democratic ideas and legitimacy of power typical for them: from beginning to modern crisis of electoral democracy. The origin and significance of modern concepts and reasons legitimacy crisis in electoral democracy are found out. The new democratic institutes representing non-classical type of power legitimacy are considered, the key concepts of modern political rhetoric and practice are investigated. The key ways of development of modern democracy, the main problems which arise on its path, risks and prospects are investigated.Key words: legitimacy, idea of democracy, proximity, crisis of legitimacy, postdemocracy. ; Розглянуто в історичній перспективі розвиток і становлення типів легітимації політичної влади – від премодерних суспільств до сучасності. З'ясовано походження та сучасне значення поняття легітимності та причини теперішньої кризи системи представницько-виборчої демократії. Досліджено становлення нових демократичних інститутів, які репрезентують некласичні типи легітимації влади, розглянуто ключові поняття сучасної політичної риторики і практики. З'ясовано головні напрямки розвитку сучасної демократії, основні проблеми, які виникають на її шляху, ризики та перспективи.Ключові слова: легітимність, демократія, наближеність, криза легітимації, постдемократія.
The article analyses connection between effectiveness of bureaucracy as a component of power and legitimacy of power. The data collected from the sociological monitoring of the Institute of Sociology of the National Academy of Sciences of Ukraine "Ukrainian society1992-2013" and Worldwide Governance Indicators (WGI) were used in this investigation. WGI for Ukraine have been compared with WGI for Poland. We have pointed out that number of bureaucrats has been increased during last eight years and they have become more influent. By the way, it was happen when Party of Region had come to the ruling position under conditions of decline of confidence in political and state institutions and deepening of crisis of legitimacy. These sequences are appropriate because society evaluates legitimacy of political regime not according its attributes but according quality of governance and Worldwide Governance Indicators for Ukraine demonstrated regressive tendency in comparison with WGI for Poland. Results of both countries which have been reflected in world rates emphasize that Ukrainian bureaucracy has become the factor of delegitimation of power. In Ukrainian situation level of trust in government and its policy and support from ordinary people and businessmen fell dawn but in Poland level of trust in political and state institutions grew even at the crises time as result of considered and responsible economic policy and clearness prediction actions. Ukrainian government bureaucracy viewed the way of change as reducing the number of public servants but not set of functions that were redistributed and remained the same with old laws and rules. Therefore bureaucrats considering themselves as ruling class restricted opportunities for people and business activity. During the past twenty years as result of this situation data from the sociological monitoring of the Institute of Sociology showed that society demonstrated the lowest indicator of trust in government, prosecutors, courts and local government in 2013. Obviously that only legitimate power with bureaucracy as its important component might achieve growing of trust and support from people. In contemporary conditions legitimacy of power could be analyse not as a defined state but as a process of current creation and achievement through openness and quality of state governance and public services with affective institutions that supported by citizens. ; У статті досліджується взаємозв'язок між ефективністю бюрократії та легітимністю влади, компонентом якої вона є. In article natural and legal models of legitimacy of the government are considered. Two main models of legitimacy of the government are investigated: the natural and legal model and model of legitimacy of representatives of the theory of legal positivism, detail analyzed concepts of each of these models. It was found that the work of I. Kant was of fundamental importance for the development of the theory of the rule of law. Like many other thinkers of the time, he believed that the state replaced the natural state, in which there was no guarantee of legitimacy. Moral duty, a sense of respect for natural law motivate people to leave this state and through a social contract to move to life in civil society, the state. The social contract is concluded between morally developed people, so the state is forbidden to treat them as beings who do not know the moral law and can not choose the right course of action. It is determined that I. Kant's statement and substantiation of claims that each person is an absolute and self-sufficient value, that individuals refuse unlimited and arbitrary freedom of natural state in favor of true freedom in the legal state, that the purpose of the state is perfect law, maximum compliance state system, the principles of law, etc., give reason to consider him one of the main creators of the theory of the rule of law. As a result, we draw the conclusion that most fully the problem of legitimacy of the government was covered by founders of sociological school of the law. Characteristic signs of the concept of legitimacy of the government of sociological school of law is the identification of the concept "legitimacy" and "legality" it is considered that any legal power automatically is also legitimate; only the legal, rational power has legitimate character; the power belongs to the people which not only create, but also exercises control of the public power, the power and the people act as uniform political whole. The state power is not insane, absolutely, therefore, having grasped the need to grow up, people immediately learn how to organize the power of the state in the process of building up their functions to achieve the norm. ; У статті розглядаються природно-правові моделі легітимності державної влади. Досліджуються дві основні моделі легітимності державної влади: природно-правова модель і модель легітимності представників теорії юридичного позитивізму, детально проаналізовані концепції кожної з цих моделей. З'ясовано, що принципово важливе значення для розвитку теорії правової держави мала творчість І. Канта. Як і багато інших тогочасних мислителів, він вважав, що держава прийшла на зміну природному станові, в якому не було ніякої гарантії законності. Моральний борг, почуття поваги до природного права спонукають людей полишити цей стан і шляхом суспільного договору перейти до життя у громадянському суспільстві, державі. Суспільний договір укладають між собою морально розвинені люди, тому державі забороняється поводитися з ними як з істотами, котрі не знають морального закону і не можуть самі обрати правильну лінію поведінки. Визначено, що висунення й обґрунтування І. Кантом тверджень про те, що кожна людина є абсолютною і самодостатньою цінністю, що індивіди відмовляються від необмеженої та свавільної свободи природного стану на користь справжньої свободи у правовому стані, що призначення держави полягає в досконалому праві, максимальній відповідності державного устрою принципам права тощо дають підстави вважати його одним із творців теорії правової держави. Доходимо висновку, що найповніше проблема легітимності державної влади була висвітлена основоположниками соціологічної школи права. Характерними ознаками концепції легітимності державної влади соціологічної школи права є ототожнення поняття «легітимність» і «легальність»: вважається, що будь-яка легальна влада автоматично є і легітимною; лише легальна, раціональна влада має легітимний характер; влада належить народу, який не лише формує, але і здійснює контроль за публічною владою, влада і народ виступають як єдине політичне ціле. Державна влада не є безумовною й абсолютною, тому, усвідомивши необхідність їй підкорятися, людина одночасно усвідомлює, що органи державної влади зобов'язані у процесі здійснення своїх функцій дотримуватися юридичних норм, які розмежовують інтереси влади й інтереси особи та суспільства.
The article reveals the institutional and organizational dimensions of the legitimacy of public power.In the context of the Weberian tradition of understanding the legitimacy of order, it is determined that ensuring the legitimacy of individual political actors – individuals and organizations – is impossible without the legitimacy of the conventional and legal order. It is noted that not only the distinction between institutions and organizations, but also the refusal to reduce the whole organizational diversity of the "state" to a single actor is of utmost importance for ensuring the legitimacy of public power.It is emphasized that democratic rules of the political game should not just be declared by individual political players, but be recognized by the majority of citizens as at the level of convictions, and be implemented at the levels of daily life and political activity. This means that the social convention on the implementation of democratic institutions should become legitimate for all social activities and social relations. Using the Weberian category of "octroying", another legitimate way of establishing a new order for the post-authoritarian regimes is demonstrated. It is noted that artificially established institutions (the rules of the game that operate in the societies of consolidated democracy) are often not effective in the post-Soviet space and do not always contribute to the legitimacy of power. At the same time, the "constitutionalization" of the political process, even if it takes place through a vote in the parliament or is passed in a referendum, does not ensure the automatic establishment of democracy and legitimacy of public power.Based on the distinction of institutions and organizations (D. North), there are shortcomings in both electoral democracy and the octroying of the legal order in terms of the theory of legitimacy. It is determined that one of the main tasks for post-Soviet societies is to establish the legitimacy of the democratic order, without which the transition from the electoral democracy to the consolidated one cannot be completed.The necessity of simultaneous institutional and organizational political transformations to ensure the legitimacy of the social order and public power under conditions of democratization in Ukraine is substantiated. ; У статті досліджуються інституційний та організаційний виміри легітимності публічної влади.У контексті веберіанської традиції розуміння легітимності порядку визначено, що забезпечення легітимності окремих політичних акторів – індивідів та організацій – неможливе без легітимності конвенціонального та правового порядку. The article is devoted to the study of the factors of the legitimacy of power in the Ancient World. Legitimacy is "the Sword of Damocles" of the era of antiquity; the doubts of citizens about the legitimacy of power is a direct way to its loss. That is why the rationale for the authority of power and the right to power become one of the central one for ancient philosophy and politics.The factors of the legitimacy of the power of the monarchy (religion, traditional domination), aristocracy (noble origin, military victories), tyranny (charismatic legitimacy of personal power), demos (collective legitimacy, rationalism) are singled out. "Ostracism" as an obvious result of the process of delegitimization of power is interpreted. The peculiarities of Pericles' reforms, which are based on rational organization of power, introduction of payment for work for the sake of public benefit ("mystophoria"), democracy, are noted.In the era of antiquity, firstly, in the political world history the need for power to be recognized, supported and legitimated was clearly articulated. Economic well-being, political stability and security of policies depended on the level of legitimacy of power. In the era of antiquity, the "Sword of Damocles" of needs for recognition and support hung over power, from this time onwards – forever. However, the authorities can choose what will be the basis of legitimate governance, what factors will determine the fate of power.The era of the early Archaic in Athens was characterized by the decisive influence of the aristocracy, whose power was based on wealth and economic strength. In addition, an important source of legitimacy of the aristocracy was religion.The citizens of the Athenian Police not only realized that they were the source of power, but also sought a foundation of power that would ensure its legitimacy. The abandonment of violence was the main aspect in this search for legitimacy.Solon, using his own authority, received extraordinary powers, i.e., he legitimized his own power both among the aristocracy and for the demos. One of the most important lessons of Solon's reforms for the legitimacy of the era of antiquity is that the authority of a centrist, who, as an archon, carried out reforms, lasted only for a year. The innovations, introduced by Solon, remained valid in Athens over the next dec- ades; instead, the problem of the legitimacy of the aristocracy's power was not solved.The archaic stage was characterized by the rule of the kings (basileans), whose legitimacy relied on royal origin and found its basis in traditional domination, religion, military valour and victories in the Panhelenic games. A very important, even decisive component of legitimacy was the identity of the Greeks as free citizens as opposed to the Persians who worshiped the king as God and their "hospitality", which became the foundation of cosmopolitan legitimacy.The classic stage of the development of the Athenian policy is the domination of the aristocracy, which from time to time gave power to tyrants. The governance of the latter represented a reliance on the charismatic type of legitimacy. They relied on their own authority, and their descendants could not сlaim to power. The tyrants, as charismatic leaders, introduced reforms, and most importantly, they actively fought against the aristocracy (the descendents of which, in fact, they were), considered the aristocracy as rivals in the struggle for power, and thus prepared the ground for strengthening the power of the demos.The democratic stage, which began with the reforms of Kimon and reached its peak during the reign of the "first citizen" Pericles, can be called a period of domination of a rational-legal type of legitimacy. After all, Pericles himself was a "great rationalist"; his power was based neither on tribal relations, nor on religion and tradition.This list is not exhaustive, but it allows us to see that in the era of ancient Greece, the boundary principles and fundamental ideas about the phenomenon of the legitimacy of power were formed. Its role in the political life of the policy was determined. All the risks, disadvantages and dangers of each type of legitimacy also appeared in the policy. In the end, the Athenians themselves developed and implemented the extreme form of delegitimization of the political leader – ostracism. ; Статтю присвячено дослідженню чинників легітимності влади у Стародавньому світі. Легітимність – це «Дамоклів меч» влади епохи Античності. Сумніви громадян щодо легітимності влади спричиняють її втрату. Обґрунтування авторитету влади, права на владу та чинників її визнання стає однією з центральних проблем для античної філософії та політики. Виокремлено чинники легітимності влади монархії (релігія, традиційне панування), аристократії (знатне походження, військові перемоги), тиранії (харизматична легітимність особистісної влади), демосу (колективна легітимність, раціоналізм). Інтерпретовано «остракізм» як наочний результат процесу делегітимації влади. Відзначено особливості реформ Перикла, в основі яких раціональна організація влади, введення оплати за працю задля суспільної користі («містофорія»), демократія.

The article is devoted to the study of the legitimacy of power and control over violence in a transitional society. It is noted that the problem of violence in a transitional society has a special political weight and, therefore, a scientific relevance. The solution to this problem is directly related to the ability of the political class to ensure the legitimacy of power. In classical concepts of legitimacy, it is stated that only the state has a monopoly on violence. However, in transitional societies, individual groups and political organizations can also resort to violence to preserve power and property. According to the noninstitutional theory, this situation is a hallmark of limited access orders. ; Статтю присвячено дослідженню легітимності влади та контролю над насильством у перехідному суспільстві. Зазначено, що в умовах перехідного суспільства особливої політичної ваги, а відтак і наукової актуальності набуває проблема насильства. Її вирішення пов'язується зі здатністю класу забезпечити легітимність влади. У класичних концепціях легітимності наголошується, що лише держава має монополію на насильство. Проте у перехідному суспільстві до насильства можуть вдаватись і окремі групи та політичні організації з метою збереження влади та власності. Відповідно до неоінституційної теорії така ситуація є характерною ознакою суспільства обмеженого доступу.

This article is devoted to the research of the topical issue of the organization in a democratic society of proper regulation of the right of every person to freely express their beliefs and views. The paper argues that the human right to express one's thoughts and beliefs is an element of information freedom as a defining and fundamental principle of democracy, humanity and justice. However, the right to freedom of expression, like other civil liberties, cannot be unlimited. When it hinders the exercise or threatens other rights of a person, such as honor, dignity, business reputation of a particular person, it is logical that certain state restrictive regulators may apply. The article analyzes the issues of balanced measures of interference in the right to self-expression by the authorities, comparing these measures with the duties and responsibilities of the state in the need to take positive action to ensure the free exercise of information rights. It emphasizes that intervention must be necessary in a democratic society. This is a defining prerequisite for its compliance with European principles of civilization. At the same time, according to the position of the European Court of Human Rights, the concept of "necessary" means the existence of an urgent public need to respond to public authorities. Closely related to the criterion of social necessity is the factor of "duty and responsibility". Specific examples from the decisions of the European Court of Human Rights show the legal approaches of the international law enforcement institution to determining the proportionality of power - the main element of the principle of the need to intervene in the right to freely express their views. Taking into account the conducted research in the work the basic conclusions are made. The right to free expression of personal opinions and positions may be limited only if it encroaches on other fundamental human freedoms, the principles of functioning of the state and society. But in any case, the application of state intervention should clearly establish the necessary balance, taking into account the legitimacy of restrictions, their focus on achieving a legitimate goal and the need and acceptability in a democratic society. ; Стаття присвячена науковому дослідженню актуального питання щодо організації в демократичному суспільстві належного регулювання права кожної особи на вільне вираження своїх переконань і поглядів. У роботі обстоюється теза, що право людини на висловлення своїх думок і переконань є елементом інформаційної свободи як визначального й основоположного принципу демократії, гуманності і справедливості. Водночас право на висловлювання, як і інші громадянські свободи, не може бути безмежним. Коли воно перешкоджає здійсненню чи загрожує іншим правам особи, як-от честь, гідність, ділова репутація конкретної людини, цілком логічно, що можуть застосовуватися певні державні обмежуючі регулятори. У статті проаналізовані питання виваженості заходів втручання у право на самовираження з боку влади, зіставлення цих заходів з обов'язками та відповідальністю держави у сфері необхідності здійснення позитивних учинків для гарантування вільної реалізації інформаційного права. Підкреслюється, що втручання має бути необхідним у демократичному суспільстві. Це визначальна передумова його відповідності європейським цивілізаційним принципам. За позицією Європейського суду з прав людини поняття «необхідний» означає наявність нагальної суспільної потреби в реагуванні державних органів. Із критерієм суспільної необхідності тісно пов'язаний чинник «обов'язку і відповідальності». На конкретних прикладах із рішень Європейського суду з прав людини показані правові підходи міжнародної правозастосовної інституції до визначення пропорційності владного впливу - основного елемента принципу необхідності втручання у право вільно виражати свою думку. З урахуванням проведеного дослідження в роботі зроблено принципові висновки. Право на вільне висловлювання особистих думок і позицій може бути обмежене лише тоді, коли воно посягає на інші основоположні свободи людини, засади функціонування держави та суспільства. Але в кожному разі застосування державного втручання треба чітко встановити необхідний баланс з урахуванням законності обмежень, їхньої спрямованості на досягнення легітимної мети, необхідність і припустимість у демократичному суспільстві.
The phenomenon of power not only plays a key role in politics, but it is also central to the entire complex of social relations.The problem of power is an inexhaustible topic for scientific research, philosophical reflection, literary reading and artistic interpretations. For this reason, any research of power needs preliminary explanations regarding its subject and the introduction of distinctions to narrow the problematic field. The first distinction in this research is the opposition of power and violence, which allows focusing on one of the traditions in interpretations of the legitimacy of public power. The second distinction in the understanding of power is between approaches of atomism (individualism) and holism (collectivism). This is the distinction between intelligent and selfish individuals who pursue private interests and individuals (also intelligent, but not extremely selfish), who are aimed at achieving the common good. It is noted that the legitimacy of power cannot be justified by the potential threat of the use of violence; therefore the only source of it is the support of citizens. Only public power can be legitimate. The third distinction is the subject of this research: the analysis of the features of liberal, republican and discursive traditions in the treatment of publicity, public sphere (space), legitimacy of public power, etc. The research of publicity or public sphere was initiated in the liberal tradition. The representatives of the liberal tradition stressed the need for openness, rationality, and criticism in relations between power and citizens. The representatives of the republican tradition continued the research of public sphere and public power in terms of inclusiveness (inclusion) in the ruling process of the majority of citizens, their equality to choose and be elected. They reminded that democracy is, first and foremost, a «shared cause» for all citizens. Public sphere is characterized by the versatility and the competitiveness of citizens who possess civil (republican) virtues.In the works of the German researcher J. Habermas, who argues with the liberals and the republicans, the normative ideal of publicity (or «public sphere» in the English translation of the Habermas's term «Offentlichkeit») is presented in terms of the discursive approach.Thus, the prerequisite for the legitimacy of public power is democratic elections, the result of which gives winners the right to power; the legitimacy of public power is substantiated in the moral and political discourse; the process of ensuring the legitimacy of public power requires communication based on rational arguments between power and citizens.To sum up, the legitimacy of public power is created and reproduced as a result of rational interaction in the public sphere between power and citizens. This allows overcoming both the selfishness of individuals and the compulsion of the state. ; У статті досліджується проблема легітимності публічної влади. Визначено особливості розуміння феномена публічності, публічного простору у ліберальній, республіканській та дискурсивній традиціях. Увагу зосереджено на підходах Ф. Гаєка, Дж. Ролза (ліберальна традиція), Г. Арендт (республіканська традиція), Ю. Габермаса (дискурсивна традиція). Відзначено специфіку обґрунтування легітимності публічної влади у кожній із цих традицій.
