L'idée de « liberté économique privée » est centrale à la fois pour la conception de l'équité au sein d'un marché libre – conception développée par John Tomasi – ainsi que pour l'école du libéralisme néo-classique dont les travaux de Tomasi sont peut-être l'exemple le plus largement discuté. Dans cet article, j'examine le rôle joué par la conception de la liberté économique privée dans la conception de la justice de Tomasi. Je critique la conception de Tomasi en présentant un certain nombre d'arguments dérivés des travaux de l'économiste et critique social du 19e siècle Henry George, qui constituent le fondement d'une critique immanente de la vision de Tomasi. Le principal argument avancé dans cet article est que les arguments avancés par George et développés par les économistes georgistes ultérieurs – que je présente mais ne tente pas de défendre – ont permis de conclure que l'institution de la pleine propriété privée sur des terres est incompatible avec la stricte protection de la liberté économique privée que Tomasi défend.

This article examines the institutions of private property in a Property-Owning Democracy (POD). It aims at determining in which system, POD or Welfare State Capitalism (WSC), the requirements of the arguments justifying private property rights are better satisfied. It had been classically argued that private property rights are legitimate (a) because the worker has a (natural right) on the fruits of his labour (the labour justification), (b) because securing private property rights implements a structure of economic incentives that ultimately benefits all individuals in the society (the efficiency justification), and (c) because private property promotes individual autonomy (the liberty justification). In each section of this article, I briefly sketch the logic of each argument and examine how it is satisfied or not in a POD in comparison to WSC. The article examines the way Romanian political thought in the early 19th century connected with the major trends of Western political thought. Romanian political thought was often reluctant to adopt the mainstream liberal ideas, forged in reaction to the French Revolution, as well as to synchronize with the pace of political change it set. Hence, concepts like constitutional regime, rule of law, liberty and order are to be read as indicators of the Romanian definition of political modernity as shown by several texts of that time. Their authors combined several themes and concepts as sovereignty or political legitimacy in a hesitating philosophical context, drawing a thin line between Ancient and Modern.
[extract] From the most remote Western civilizations, the disabled person has always been marginalized in society under the stigma of inferiority. This reality, however, has been suffering from the impacts of a worldwide trend towards the promotion of its social inclusion, especially in the last decades.This work aims to analyze this social phenomenon, with an emphasis on the right of freedom of the disabled, in their legal-normative perspective. Given the repercussion of recent legislative innovations in numerous spheres of action of the individual, this theme is relevant and requires more in-depth reflection from the operators of the Law. In addition, statistical data reveal that this social segment corresponds to a significant percentage of the Brazilian population - 23.9% (twenty-three point nine percent) have some type of physical disability and 8.3% (eight point three percent) presents a severe deficiency - which claims the state and society at large - which seeks to be guided by the supreme values of freedom, security, well-being, development, equality and justice in a context of fraternity, pluralism and absence of prejudice - special attention.After delimiting the concept of handicapped, we will make a brief historical retrospect of the social insertion of the disabled person, from antiquity to the present.Next, we will approach the notions of autonomy and human dignity as guidelines of the legal rule and, subsequently, the freedom of the disabled, in light of Brazilian legislation, specifically Law 13,146, of July 6, 2015 Deficiency.The available jurisprudential collection is very small, thus the research will be supported predominantly by a bibliographical and normative one, by reading scientific works and articles published in national and international journals, that directly or indirectly face the proposed issues.Without intending to exhaust the subject, we will discuss the right of liberty of the disabled person from an eminently normative perspective, with the aim of contributing to the debate on the scope of the legislation of regency.

Resumé Dans son film L'homme qui tua Liberty Valance , John Ford montre comment une société démocratique se constitue et se remémore cette constitution. Nous montrerons que c'est l'intermittence entre visibilité et invisibilité qui constitue pour Ford le secret de cet événement fondateur, marqué par une nécessité simultanée de le celer et de le montrer, de l'ignorer et de le connaître. Ford propose ainsi une conception originale du pouvoir constituant, que seuls les moyens propres du cinéma permettent d'illustrer avec autant d'efficacité.
