A superação da concepção liberal de liberdade em Hannah Arendt

This article intends to confront two notions about the notion of liberty, central theme on Political Philosophy. On one side, we'll start on some observations of political liberalism, where in the first moment, we'll explore the book "Two Concepts of Liberty" by Isaiah Berlin. To this author the negative liberty - "being free of" and, not the positive liberty - "being free to", should be the biggest worry of political bodies, that is, the State must exist to avoid that individual liberty is reduced by the own state interference or other subjects. Meeting this idea, and anchored in Arendt, we want to sustain that one of the big problems about political liberalism is the not action (negative liberty), that is, the lack of participation from the citizens on subjects and on political decisions. Showing this, we will defend in Arendt the central role of positive liberty (political freedom) of action and speak, and, thereafter, the possibility of a civic republicanism as an alternative to the isolation and the political apathy conceived by the bourgeois liberty, since, to Arendt, Berlin's bet and the liberal tradition are unsatisfying to think the events of contemporary politics.
CHALLENGES OF NURSES IN HEALTH CARE FOR PREGNANT WOMEN DEPRIVED OF LIBERTY ; DESAFIOS DO ENFERMEIRO NA ASSISTÊNCIA À SAÚDE DA GESTANTE PRIVADA DE LIBERDADE
Objectives: To describe nursing care challenges for pregnant women in the prison system and to identify legislation relevant to the right to health of pregnant women deprived of liberty. Methodology: This is an Integrative Literature Review, searching LILACS, SciELO and BDENF databases, in the modality integrated with the VHL Regional Portal, using the respective descriptors: Nursing; Pregnancy; Prisons; Health. Results: A total of 13 articles were included in this study, which pointed out a major deficit in health care for pregnant women due to intrinsic factors in the prison system. Final considerations: The nurse is entirely connected to prenatal care, in the prisons his duties become limited due to the precarious situation that prisons are in, going against what is predicted. ; Objetivo: Descrever desafios da assistência de enfermagem às gestantes no sistema prisional e identificar legislações pertinentes ao direito à saúde das gestantes privadas de liberdade. Metodologia: Trata-se de Revisão Integrativa da Literatura, com busca nas bases de dados LILACS, SciELO e BDENF, na modalidade integrada ao Portal Regional da BVS, usando os respectivos descritores: Enfermagem; Gravidez; Prisões; Saúde. Resultados: Foi incluído nesse estudo o total de 13 artigos que apontaram um grande déficit na assistência à saúde da mulher gestante decorrentes de fatores intrínsecos do sistema penitenciário. Considerações Finais: O enfermeiro é inteiramente conectado à atenção pré-natal, porém no âmbito prisional suas atribuições se tornam limitadas devido a precária situação que os presídios se encontram, indo em contramão com o que é previsto.

The aim of this article is to analyze the way the French philosopher Jean-Paul Sartre modalizes, through the existential psychoanalysis elaborated in 'L'être et le néant' (1943), his existential biography about the poet Charles Baudelaire. In Baudelaire (1947), we will be able to locate the prolegomena to any future existential biography, therefore, Sartre's 'modus operandi' of biographical research/writing.
Liberdades, direitos, políticas públicas e a fluoretação da água ; Liberties, rights, public policies and water fluoridation
OBJECTIVE: To discuss the negative and positive concepts of liberty and postulate its interdependent and complementary relationship in the evaluation of public policy intersectoral actions, taking water fluoridation as a case. METHOD: To describe scopes and limits regarding 1950s Isaiah Berlin's distinction, showing its validity in facing the harmful effects of an uncontrolled market economy and an autocratic political regime. RESULTS: Both the rights that protect citizens against a powerful state and the rights that protect the state against powerful citizens were equally acknowledged as crucial. CONCLUSION: We argued that, in a context in which negative and positive liberties are balanced, regulatory policies have double meaning. Thus, there should be a balance between the establishment of necessary rules for social protection and limits for them not to violate individuals' rights ; OBJETIVO: Discutir os conceitos negativo e positivo de liberdade e postular sua relação de interdependência e complementariedade na avaliação da política pública intersetorial, tomando como caso a fluoretação da água. MÉTODO: Descrevem-se os alcances e limites relativos à distinção formulada por Isaiah Berlin nos anos 1950, demonstrando sua validade para enfrentar os efeitos nocivos decorrentes tanto de uma economia de mercado sem controle quanto de um regime político autocrático. RESULTADOS: Reconhece-se que são igualmente cruciais tanto os direitos que protegem os cidadãos contra um Estado poderoso quanto os direitos que protegem o Estado contra os cidadãos poderosos. CONCLUSÃO: Argumenta-se que, em um contexto de equilíbrio entre a liberdade negativa e positiva, a política regulatória tem duplo sentido, e deve buscar um balanço entre o estabelecimento de regras necessárias para a proteção do público e de limites além dos quais as regras não devem violar os direitos dos indivíduos.

Este artigo argumenta que a esperança tem uma história no sentido de que pessoas em diferentes épocas históricas têm esperança de coisas diferentes. Na verdade, ela tem uma história cultural, social e política, porque diferentes grupos sociais têm esperanças diferentes - de salvação, de liberdade, de segurança, de mobilidade social e assim por diante. ; This article argues that hope has a history in the sense that people in different historical epochs hope for different things. Disclosing actives arquetipos on the woman existence on the hospital delivery: sociopoetic study

Objective: To identified the active archetypes that involved the women's behavior during hospital delivery through of the woman imagination dimensions connected in the woman way of life in this modality delivery. Method: Sociopoetic reaserch was developed with a researcher group modeling a mother goddess as a technique to for data production, which took place in a maternity hospital at Rio de Janeiro in 2009. Results: They would be during delivery revealing the archetypes personified by the grecian goddesses Artemis, Demeter, Persephone and Hestia, the Virgin Mary and the egyptian goddess of destruction, Sekhmet. The perception about the meaning of these archetypes showed their strengths, needs and desires of the: liberty and delivery, loneliness and solitude, to feel relating with her son, passionate donation and with self-esteem. Conclusion: This study alarm to sensitive boarding in the holistic care of the human being, to amplify actions privileging subjectivities and eccentricity.
A normatividade da teoria republicana da justiça

The normative basis of the republican conception of justice is freedom as non-domination. This concept of political freedom comprises social relations in equality of power. Non-domination represents the social condition of not being submissive to the capacity of arbitrary interference of others. Republican freedom presupposes the development of human capabilities in their fullness. The potential for human capacity development must be protected by the legal structure of the State. The State has the function of equating the differences of individuals' assets and resources with their institutional structure. It acts to offer the necessary conditions, rights and basic liberties, to individuals in their social and political life. The Republican perspective of Philip Pettit leads to the normative deduction of republican liberty and to demonstrating that the theory of justice has to presuppose the resources necessary for the development of human life in its condition of equality and freedom. The democratic structuring of society presupposes the establishment of social relations that are characterized by the social status of non-domination.
A crítica de G. A. Cohen ao pensamento de Rawls: ethos e incentivos

In this paper will investigate the criticisms presented by Gerald Allan Cohen of the difference principle asserted by the American philosopher John Rawls. Cohen claims that the difference principle allows for exorbitant inequalities and that these inequalities would undermine the ethos of solidarity assumed by Rawls. Against Cohen's criticisms, it will be emphasized the fact that the principles of justice as fairness must be read together (holistic reading), and therefore the inequalities allowed by the difference principle are much smaller than Cohen believed, since equal liberty, fair equality of opportunity, and the fair value of the equal political liberties must also be ensured. Thus, to ensure that the principles work together, it will be argued that the scope of the principle is much narrower than Cohen thought. It is emphasized that in Rawlsian thought there is no need for constant economic growth, and the principle of difference should not be seen as a market principle, on which its objective is not to be a mere principle of reparation, but a principle that affirms reciprocity between fellow citizens of a democratic society.
Maquiavel e a função dos tumultos para a potência militar romana

The paper presents an investigation, at the heart of the thought of Niccolò Machiavelli, about the role played by Roman conflicts between nobles and plebs in order for the Republic of Rome became a military power. The clash of desires of great and people was responsible for promoting in that city an authentic vivere civile and libero, but also was the driving force of its military-political expansion. Here, we will intend to elucidate the reasons that have elevated Rome to that greatness. First, the dissensions caused the constitutional improvement of Roman institutions, directing them towards a republican state of mixed government. With the institution of the Tribunes of Plebeians, the people reached its political recognition, which created the possibility for the armies to be formed by the citizens from the plebs. Secondly, the institutional regulation of the conflicts and the expansionist impetus of Rome were the reason why the "guard of liberty" had been entrust to the plebs, promoting a popular government, a measure that allowed the Republic to turn to expansionist campaigns towards the conquest of the empire. Thirdly, recognizing the conflict and institutionalizing it was a mechanism to protect themselves from the caprices of fortune. Therefore, the institutional regulation of the events that afflict the internal political order meant to give guarantees for that those external confrontations could be successful.
A economia moral do turismo ; The moral economy of tourism
Neste artigo, sugiro que a indústria do turismo mundial está mobilizada em torno de um núcleo, a atração turística, que está afastada e protegida do intercâmbio económico. Se o turismo é, de facto, a maior indústria do mundo, é por causa e não a despeito da separação da sua principal estrutura motivacional e moral do mercado. Aqui exploro as implicações do facto de que o sistema global de atrações turísticas é uma enorme coleção de "bens gratuitos" democráticos, abertos e disponíveis para todos verem. A indústria do turismo depende desta oferta interminável de atrações de livre acesso, mantidas por governos, ONG e/ou simplesmente existentes na sociedade e na natureza. A indústria do turismo mundial só pode prosperar se a sua estrutura moral e motivacional permanecer isolada das transações do mercado. O Taj Mahal, a Torre Eiffel, o Partenon, o Grand Canyon, a Estátua da Liberdade, as Montanhas Karakorum, etc., não estão à venda. Mais de mil milhões de turistas gastam 1,5 biliões de dólares por ano para viajar internacionalmente e ver coisas que não podem comprar ou ter no sentido material; que ninguém, por mais rico que seja, pode comprar; que muitas vezes nem conseguem tocar. A enormidade do turismo hoje é possível apenas porque as forças causais que estão no coração da economia do turismo são inteiramente imaginárias e simbólicas. Na sua essência, a economia turística é menos económica do que fenomenológica. E o principal impulso do turismo, a sua motivação mais profunda, não é materialista, mas democrática. O overtourism (excesso de turismo) resulta da própria indústria que explora agressivamente o facto de que não implica matérias-primas, não necessita de desenvolver cadeias de fornecimento, não precisa de fábricas e não se envolve em qualquer conceção, fabrico, montagem ou distribuição. O consumidor trabalha de graça, na realidade, paga para fazer o trabalho do turismo e torna-se o produto. Estas eficiências neoliberais levam ao overtourism. O overtourism pode ser facilmente controlado ao nível local. ; In this article I suggest that the global tourism industry is deployed around a nucleus, the tourist attraction, that is removed and protected from economic exchange. If tourism is, indeed, the world's largest industry it is because, and not in spite of the separation of its primary motivational and moral structure from the marketplace. I explore the implications of the fact that the global system of tourist attractions is a massive collection of democratic "free goods" open and available for all to see. The tourist industry depends on this endless supply of free access attractions maintained by governments, NGOs, and/or simply existing in society and nature. The global tourism industry can thrive only if its moral and motivational structure remains insulated from market transactions. The Taj Mahal, the Eiffel Tower, the Parthenon, the Grand Canyon, the Statue of Liberty, the Karakorum Mountains, etc. are not for sale. Over a billion tourists spend $1,5 trillion annually to travel internationally to things they cannot buy or have in any material sense; that no one no matter how wealthy can buy; often that they cannot even touch. The enormity of tourism today is possible only because the causal forces at the heart of the tourism economy are entirely imaginary and symbolic. At its core, the tourist economy is less economical than phenomenological. And the primary tourist drive, its deepest motivation, is not materialistic but democratic. Overtourism results from the industry aggressively exploiting the fact that it requires no raw materials, need not develop supply chains, needs no factories, and engages in no design, manufacture, assembly or distribution. The consumer works for free, indeed, pays to do the work of tourism, and becomes the product. These neoliberal efficiencies lead to overtourism. Overtourism can easily be controlled at the local level.

The text aimed to understand the limits and the training possibilities enhanced by democratic management in the context of prison education. With a qualitative approach, based on the multiple case study method, the investigation included as a technique for collecting information: document analysis and interviews with two school administrators from a Youth and Adult Education Center (CEJA) and three administrative managers from prison units that offer Youth and Adult Education (EJA) classes in the municipalities of Capistrano, Ocara and Pacoti, in the Maciço de Baturité-CE. The interviews revealed the search for a shared work between the school management of CEJA and the administrative management of prison units in actions aimed at education in the prison context, but also some obstacles, such as the lack of structural and human resources. The data set revealed the potential of democratic management, triggering the collaboration of the diverse involved with the pedagogical work in order to enable a quality education for the Private Person of Liberty (PPL), understanding it as a human being capable of learning, reinvent itself and rewrite a new life story, with socio-professional reintegration. It is concluded that the concept of democratic management articulated to the principles of collaboration between school management and administrative management favors the realization of a re-socializing formation. The survey also showed a lack of public policies that effectively ensure the provision of education in prison in order to guarantee prison well-being and social reintegration. ; El texto tuvo como objetivo comprender los límites y las posibilidades de formación que potencia la gestión democrática en el contexto de la educación carcelaria. Con un enfoque cualitativo, basado en el método de estudio de casos múltiples, la investigación incluyó como técnica de recolección de información: análisis de documentos y entrevistas con dos administradores escolares de un Centro de Educación de Jóvenes y Adultos (CEJA) y tres directores administrativos de unidades penitenciarias que ofrecen clases de Educación para Jóvenes y Adultos (EJA) en los municipios de Capistrano, Ocara y Pacoti, en la región del Maciço de Baturité-CE. Las entrevistas revelaron la búsqueda de un trabajo compartido entre la dirección escolar del CEJA y la dirección administrativa de las unidades penitenciarias en acciones orientadas a la educación en el contexto penitenciario, pero también algunos obstáculos, como la falta de recursos estructurales y humanos. El conjunto de datos reveló el potencial de la gestión democrática, lo que propició la colaboración de los diversos involucrados con el trabajo pedagógico para posibilitar una educación de calidad para la Persona Privada de la Libertad (PPL), entendiéndola como un ser humano capaz de aprender, reinventarse y reescribir una nueva historia de vida, con reintegración socio-profesional. Dignidade humana à luz da Constituição, dos Direitos Humanos e da bioética ; English ; Human dignity in the light of the Constitution, human rights and bioethics
Introduction: Human dignity, as coined by the Universal Declaration of Human Rights (UDHR / 1948), is an expression social solidarity, which should cement the relations between people. Human dignity is the foundation of all rights, such as freedom, equality, justice and peace in the world, and in Brazil, human dignity was deemed a fundamental pillar of the country's post-1988 constitutional order. Objective: This article seeks to a deeper investigation about the social nature of human dignity and its definition over time. Methods: This is an exploratory research meant to unpack the concepts of "human dignity", "bioethics", "human rights" and "constitution". After describing the conceptual evolution of human dignity and the facts relevant to its conceptual formation in world history - as a normative standard and a legal rule -, we address the Universal Declaration of Human Rights (UDHR/1948), the Declaration of Helsinki (DH/1964), the Universal Declaration on Bioethics and Human Rights (UDBHR/2005), and the definition adopted in the Constitution of the Federative Republic of Brazil (CFRB/1988). The study was carried out without temporal limitation, and included a review of referenced books, legal doctrines, as well as articles and books in the SciELO database. Results and discussion: The findings ratify that human dignity is the foundation of all rights, including those of freedom, equality, justice and peace in the world, and must also guide the rights and duties of social regulation. Human dignity has changed from a criterion of power attributed to the social position of individuals to a value of the right to freedom, which now goes beyond the right of freedom and is the basis of modern constitutional democracy, which makes possible the realization of solidarity, as well as the duty and purpose of the state and the community. The will of the subject, of society, of the science and of the state, as well as the rules of domination and regulation, must have a limit on human dignity, and human dignity is not just fundamental right, in the sense of the Constitution, and must prevail over the exclusive will of science, the State and society. Therefore, in the making of power decisions and in realization of possible innovations of science involving human beings, human dignity demands the explicit consideration of respect and promotion of it. Conclusion: Human dignity is enshrined in Brazilian constitutional law, as well as in bioethics and in human rights, and it constitutes all the fundamental rights of the human person. It is not merely a rule of autonomy and liberty, and it is an obligatory and non-derogable precept in the making of power decisions, a true main foundation of constitutional democracies. ; Introdução: A dignidade humana, cunhada pela Declaração Universal dos Direitos Humanos (DUDH/1948), é uma expressão de solidariedade social, que deve cimentar as relações entre as pessoas. A dignidade humana é a base de todos os direitos, como liberdade, igualdade, justiça e paz no mundo, e no Brasil, a dignidade humana foi considerada um pilar fundamental da ordem constitucional pós-1988 do país. Objetivo: Este artigo busca uma investigação mais profunda sobre a natureza social da dignidade humana e sua definição ao longo do tempo. Método: Trata-se de uma pesquisa exploratória que visa revelar os conceitos de "dignidade humana", "bioética", "direitos humanos" e "constituição". Após descrever a evolução conceitual da dignidade humana e os fatos relevantes para sua formação conceitual na história mundial - como padrão normativo e norma jurídica -, abordamos a Declaração Universal dos Direitos Humanos (DUDH/1948), a Declaração de Helsinque (DH/1964), a Declaração Universal sobre Bioética e Direitos Humanos (DUBDH/2005) e a definição adotada na Constituição da República Federativa do Brasil (CFRB/ 1988). O estudo foi realizado sem limitação temporal e incluiu uma revisão de livros referenciados, doutrinas jurídicas, bem como artigos e livros no banco de dados SciELO. Resultados e Discussão: As conclusões ratificam que a dignidade humana é o fundamento de todos os direitos, incluindo os de liberdade, igualdade, justiça e paz no mundo, e deve também orientar os direitos e deveres da regulação social. A dignidade humana passou de um critério de poder atribuído à posição social dos indivíduos para um valor do direito à liberdade, que agora ultrapassa o direito à liberdade e é a base da democracia constitucional moderna, que possibilita a realização da solidariedade, bem como o dever e propósito do Estado e da comunidade. A vontade do sujeito, da sociedade, da ciência e do Estado, bem como as regras de dominação e regulação, devem ter um limite na dignidade humana, e essa não é apenas um direito fundamental no sentido da Constituição, devendo prevalecer sobre a vontade exclusiva da ciência, do Estado e da sociedade. Portanto, nas decisões de poder e na realização de possíveis inovações da ciência envolvendo seres humanos exige-se a consideração explícita do respeito e da promoção da dignidade humana. Conclusão: A dignidade humana é ponto consagrado no direito constitucional brasileiro, assim como na bioética e nos direitos humanos e constitui todos os direitos fundamentais da pessoa humana. Não é apenas uma regra de autonomia e liberdade, trata-se de preceito obrigatório e inderrogável na tomada de decisões de poder, verdadeiro fundamento principal do Estado democrático de direito.
