[Resumen] En la Europa unida, se ha considerando tradicionalmente que la protección de los trabajadores constituye un límite claro de la libertad de prestación de servicios, a pesar del carácter fundamental de esta última. La virtualidad de este límite ha suscitado un debate muy vivo en la actualidad, como consecuencia de la propuesta de Directiva, adjetivada «Bolkestein», especialmente en su versión originaria de 2004. Ahora bien, la modificación de esta última –materializada sobre todo en la eliminación del «principio del país de origen»– no cierra en absoluto este debate tan actual, puesto que no dejará de influir en el territorio de la Unión Europea el denominado «modo 4» del Acuerdo General sobre el Comercio de Servicios, que claramente implica un resurgimiento del «principio del país de origen», tan criticado por los sindicatos. ; [Abstract] In the united Europe, it has been considered traditionally that the protection of the employees constitutes a clear limit of the freedom to provide services, in spite of the fundamental character of this last one. The potentiality of this limit has provoked a very alive discussion at the present time, as a result of the Proposal for a Directive, described «Bolkestein», specially in its original version of 2004. However, the modification of this last one –materialized mainly in the elimination of the «country of origin principle »– it does not close absolutely this so present discussion, because it will not let influence in the territory of the European Union the denominated «mode 4» of the General Agreement on Trade in Services, that implies a resurgence of the «country of origin principle», so criticized by the trade unions.

El presente artículo examina la libre prestación de servicios en la Unión Europea; esta libertad económica otorga el derecho a las empresas a trasladarse de un Estado miembro a otro para dar respuesta a una demanda de servicios transnacional y, al mismo tiempo, es el fundamento jurídico del desplazamiento de trabajadores cuando las empresas desplazadas deciden llevar consigo a sus empleados. Ahora bien, aun siendo una evidencia positiva del proceso de integración económica en la Unión Europea (ue), esta libertad económica es susceptible de provocar situaciones de competencia desleal entre empresas y/o situaciones de discriminación entre trabajadores locales y desplazados, fundamentalmente por las divergencias que, en términos sociojurídicos y económicos, existen en el territorio de la UE. ; This article examines the free provision of services in the European Union, which entitles companies to move from one member State to another, to carry out transnational services. At the same time, it is the legal basis of posting of workers when the companies that have moved decide to take their employees. Now then, despite of a positive evidence of the economic integration process in the European Union, this economic freedom sometimes causes unfair competition among companies as well as situations of discrimination between local and posted workers; basically, due to disagreements in legal, economical and social issues in the territory of the European Union.

Minerva : revista de estudos laborais. - ISSN 1647-0753. - V.9, n. 2 (2019). - p. 169-200. ; The protection of workers temporarily posted to another Member State of the European Union or the European Economic Area in order to fulfil their company a transnational services' provision has never been a peaceful matter. The solution given by Directive 96/71/EC was accompanied, from the very moment that this text has seen the light, more than twenty years ago, of a lively internal and external polemic to the Union. The point at which the directive placed the balance between that protection and the free provision of services has not succeeded in completely satisfying anyone. There are many voices that have blamed the directive for the establishment of a short, insufficient or unambitious protection, overfolding the demands of the free provision of services and influenced by the purpose of closing the loopholes to the possibility of avoiding the effective application of certain, more advantageous working conditions contained in the rules of police of the host State, open by the then-applicable Rome convention. In spite of having represented, in comparison with the preceding situation, an obvious advance of the protection of the posted workers, this social objective of the directive was overshadowed by which it appeared as its main or predominant objective, which was to prevent the host State from disallowing posted workers from a guardianship that hinders more than is necessary or, if disproportionately preferred, the free provision of services. Time has come to give reason to those who maintained that protection could have been further carried out without falling into disproportionate constraints of free service provision. It is confirmed by the amendments to Directive 96/71/EC set out by directive (EU) 2018/957. Of these, a good part goes directly to the introduction of a major extension of the substantive protection in question. The protection that has just been referred to takes on a greater elasticity, mainly because of its diversification according to the type of posting. On the other hand, it is more imperative for the Member States, in the sense that the application of certain contents ceases to be subject to the provisions of the national transposition regulations. The result of the changes is the establishment of a new equilibrium, more favourable for posted workers, between their protection and the free provision of services. Although the diversity of the national labour regulations of the home and host States continues to be respected, the space in which that diversity remained immune to protection is diminishing. The said diminution takes place in the terms explained in Paragraph 3 of this paper.

La adaptación de la legislación turística –de competencia autonómica en nuestro ordenamiento jurídico- a la Directiva 123/2006/CE ha sido y está siendo desigual, de manera que algunas regulaciones sustituyen por completo la autorización previa por la declaración responsable, otras distinguen aquellas actividades turísticas que pueden afectar a razones imperiosas de interés general para someterlas a licencia; unas vinculan la declaración responsable a la inscripción en el registro de empresas y actividades turísticas, otras permiten el inicio de la actividad sin más trámites que una comunicación. Por ello resulta indispensable una aproximación a las diecisiete regulaciones autonómicas al objeto de analizar en qué se distinguen y en qué coinciden unas adaptaciones que debieran caracterizarse por la homogeneidad en desarrollo de una directiva comunitaria. ; Tourism is a regional competence in Spain. Touristic legislation is being adapted in different terms to Directive 123/2006/CE. Some regions make license disappear in favor of a responsible declaration, others separate those activitiesthat can affect general interest reasons that justify a license; some bind the declaration to the inscription in touristic registers, others allow to beguin the activity with nothing else than a communication. That's the reason why it is necessary to study the seventeen regional regulations in order to see differences between laws that should be similar as they develope a european directive.

The conditions of the principle of equal treatment or national treatment are specified and the scenario of the proportionality principle is studied.Judicial review of the freedom to provide services implies a trial of equalization in treatment, which follows the methodological pattern of a trial of equality: it brings the requirement of equivalence in treatment (liberalization of charges) between cross-border services and services internal, which rejects unjustified discrimination or obstacles to cross-border services in contrast to internal services.The trial of equalization with the national presupposes accepting the validity of the national rule in a possible situation of domestic law". When the appellant questions the national rule then the matter must be resolved in a prior proportionality test.The free provision of cross-border services usually involves the exercise of a self-employed activity on a temporary basis, compared to the vocation of permanence that characterizes the establishment of the entrepreneur for the exercise of an economic activity on their own, in the State of reception. The subjective element in the typical cases of freedom to provide services is an entrepreneur not established in the territory of the State of destination of the service. ; El trabajo aborda la metodología, sistema conceptual y estructuras argumentativas empleadas por el Tribunal de la Unión en el examen de la liberalización o libre prestación de servicios transfronterizos entre Estados de la Unión, que pone en juego al Estado de acogida y al Estado de origen del prestador, precisando las condiciones del principio de igualdad de trato o trato nacional y en qué escenario se introduce el principio de proporcionalidad.El control judicial de la libre prestación de servicios envuelve un juicio de equiparación en el trato, que sigue el patrón metodológico de un juicio de igualdad: supone la exigencia de una equivalencia en el trato (liberalización de cargas) entre los servicios transfronterizos y los servicios internos, que rechaza la injustificada discriminación u obstaculización en contra del servicio transfronterizo frente al servicio interno.El juicio de equiparación con el nacional presupone aceptar la validez de la norma nacional sobre la prestación del servicio, en una eventual "situación interna". Si el actor pone en cuestión la norma nacional en liza entonces debe dirimirse la cuestión sobre el Derecho de la Unión en un previo juicio de proporcionalidad.La libre prestación de servicios transfronterizos supone, de ordinario, el ejercicio de una actividad por cuenta propia con carácter temporal, frente a la vocación de permanencia que caracteriza el establecimiento del empresario para el ejercicio de una actividad económica por cuenta propia, en el Estado de recepción. En los supuestos típicos de libre prestación de servicios el elemento subjetivo es un empresario no establecido en el territorio del Estado de destino del servicio.

La prestación de servicios a los ciudadanos es una parte fundamental de la actividad de las entidades locales. La remunicipalización de servicios es una tendencia importante en los últimos años, a la vez que la legislación impone requisitos más estrictos para la asunción de nuevos servicios y para la gestión directa. El artículo revisa críticamente esos últimos desarrollos, especialmente el énfasis en controles procedimentales sobre las decisiones sobre la forma de gestión de los servicios, frente a otros sobre la calidad en la prestación de dichos servicios. También se analiza la imposición de condiciones relativas a la organización municipal o la prestación de servicios mediante colaboración entre distintas entidades locales.

La Directiva de Servicios y, con ella, la Ley 17/2009 han conmocionado las bases del Derecho Administrativo español. En el presente artículo se parte de dos hipótesis de trabajo: en primer lugar, se acepta que los cambios producidos en el ordenamiento jurídico-administrativo español son de tal calado que justifican las opiniones de quienes aluden a un cambio de paradigma. En segundo lugar, este fenómeno revolucionario queda matizado por lo que constituye la segunda hipótesis, a saber: que la Directiva no es sino una plasmación de un proceso de mutación constitucional labrado durante varios años en el Derecho de la Unión Europea. Tanto las libertades de circulación entre sí como estas en relación con la libre competencia se están acercando en el Derecho positivo y, fundamentalmente, en la jurisprudencia del Tribunal de Justicia. Alguna de las confusiones que en su momento generó la Directiva puede verse debida, precisamente, al hecho de que libertad de circulación de servicios y libertad de establecimiento se abordan como dos elementos de una misma realidad. Si bien es cierto que la norma incorpora algunas diferencias de régimen jurídico entre uno y otro ámbito, parece que las fronteras, en cualquier caso, se van desdibujando. A ello se une el argumento de que la Directiva condiciona el ejercicio y la interpretación de la libertad de empresa, abundando por lo tanto en cuestiones vinculadas a la libre competencia y no tanto a las libertades de circulación. La mutación constitucional ofrece aquí uno de sus frutos, en el que el régimen jurídico del acceso y la prestación de los servicios queda plasmado como una ponderación de principios constitucionales, de modo que a los operadores jurídicos nacionales les quedaría vedada la posibilidad de abrir de nuevo dichas ponderaciones. La existencia de un amplio elenco de servicios excluidos, además, prueba que se han realizado ponderaciones específicas para constelaciones jurídico-fácticas asimismo específicas. Ello determina, en fin, una reflexión sobre las características de esta ponderación y, en particular, sobre la necesidad de incorporar en la argumentación principios sociales y culturales, en línea con la evolución del Derecho de la Unión. Estos debates son los que sirven de contexto para ir desgranando el concepto de servicio que sirve de criterio para determinar la aplicación o no de la Directiva de Servicios. ; The Services Directive and therefore also the Spanish Statute 17/2009, implementing it, have affected the foundations of Spanish Administrative Law. This article departs from two working hypotheses: firstly, it is accepted that the changes that have been produced in Spanish Administrative law are of such a dimension that they justify the opinions of those who point at a paradigm change. Secondly, this revolutionary phenomenon is nuanced by what constitutes the second hypothesis, namely: the fact that the Directive is just one example of a process of constitutional mutation forged along various years in European Union Law. All freedoms of movement and free competition are moving closer in written law and, more importantly, in the case-law of the Court of Justice. Some of the perplexities that the Directive once provoked can be attributed, precisely, to the fact that the freedom of movement of services and the freedom of establishment are but two elements of the same reality. The norm does include some differences in their corresponding legal regimes, but frontiers among them are fading away. There is still one argument that needs to be put forward: the Directive shapes the exercise and interpretation of the freedom to conduct a business, thus addressing questions linked to free competition. The constitutional mutation offers here one of its results, whereby the legal conditions for access to and provision of services are an expression of a balancing of constitutional principles, so that national legal operators would be impeded to open up that balance. Further, the existence of a wide array of services that have been excluded from the general regulation is also explained by the fact that particular balances have been reached in specific sectors. This leads finally to a reflection on the characteristics of such a balancing and, in particular, on the need to incorporate social and cultural principles in the argumentation, in line with the evolution of Union Law. These are the debates that frame the theoretical context required to analyse the concept of service, i.e. the criterion that defines the scope of application of the Services Directive.

The current study seeks to make the reader familiar with the changes that have suffered some services that used to be provided by the State, and currently are subject to economic liberalization. In this context, the political, economic and juridical structures have changed in terms of administrative intervention and economic regulation of the services. The analysis is principally based on juridical and factual relations maintained between different actors, and the accuracy of the concepts applying in a regime of competition. ; El presente estudio pretende dar a conocer al lector la evolución que han sufrido algunos servicios que venían siendo prestados por el Estado y, que en la actualidad son objeto de la liberalización económica. Ante ello, las estructuras políticas, económicas y jurídicas han variado en lo que se refiere a la intervención administrativa y la regulación económica de los servicios. Base importante del análisis han sido las relaciones jurídicas y fácticas que se desarrollan entre los distintos actores, así como la precisión de los conceptos que en un régimen de competencia se aplican.

RESUMEN: La presente tesis doctoral aborda el estudio de la prestación de servicios sanitarios desde la óptica del denominado Derecho de Consumo, utilizando las categorías tradicionalmente acuñadas por esta disciplina para analizar la relación clínica y, de este modo, demostrar que el usuario de servicios sanitarios constituye un supuesto de consumidor especial. Por ello, el estudio defiende la aplicación cumulativa y combinada de la legislación sanitaria sectorial y de la normativa general de defensa de los consumidores, criterio hermenéutico que permite el incremento de las técnicas preventivas y reparadoras de las que dispone el paciente. En este sentido, además de los sujetos de la relación prestacional, se estudian como contratos de consumo los títulos de acceso a la asistencia sanitaria, tanto mediante su prestación directa -contrato de servicios médicos y contrato de clínica- como indirecta – contrato de seguro de asistencia sanitaria-. Finalmente otra parte, se analizan los específicos parámetros culpabilísticos aplicables los actos médicos así como la objetivización de la responsabilidad por daños causados por aspectos funcionales del servicio y por medicamentos y productos sanitarios defectuosos. ; ABSTRACT: This doctoral thesis deals with the study of the provision of healthcare services from the perspective of so-called consumer law, employing categories traditionally minted by this discipline in order to analyze the clinical relationship and thus demonstrate that the user of healthcare services is a special consumer. Therefore the study advocates the cumulative and combined application of special healthcare legislation and the general rules of consumer law as a hermeneutical criterion for increasing the preventive and remedial techniques available to the patient. In this regard, besides the position of parties in the juridical relationship, the paper analyzes possible agreements for accessing to healthcare as consumer contracts: medical services and hospital services agreements for the direct provision of health services and health insurance for the indirect one. Finally, the paper specially considers specific negligence parameters applied to medical procedures and the non-fault liability system for damages caused by functional aspects of the service and by defective medicines or medical devices.
