학위논문 (석사)-- 서울대학교 대학원 : 철학과(서양철학전공), 2012. 2. 정호근. ; The objective of this thesis is to elucidate the concept of the general will and to make Rousseau's point clear by refuting criticisms which determine the general will as totalitarianism. To this end, I would like to reconstruct the concept of the general will by focusing on Rousseau's paradoxical expression of 'forcing to be free'. Because I think that it is possible to get a correct understanding of the general will through paying attention to this phrase. There are two kinds of 'forcing to be free' in the theory of Rousseau's General will. One is found in the notorious passage arguing that whoever refuses to obey the general will must be forced to be free in the Book 1 chapter 7 of On Social Contract. The other is implicit one in the passage discussing the conditions of the general will in the Book 2 chapter 3 and Book 2 chapter 7(part 4 chapter 8). I would like to examine these problems respectively and try to show that Rousseau's ultimate point consists in not 'forcing' but 'freedom'. Conclusively, the authentic difficulty of interpreting of Rousseau's logic is that nevertheless 'forcing to be free' is necessary to the production of the general will, he permit the possibility of failure of this process in practice. Rousseau's theory of the popular sovereignty argues that the foundation of legitimacy of the state does not consist in the divine or natural foundation but in the autonomous will of the people. Despite this theoretical postulate, the people appear to not only rational and social unity, but also always potentially the multitude as disordered gathering of individuals who are vulnerable to a capricious passion. On the one hand, the people's general will should make a society legitimate, particular deliberation of the people may be contingent and could make an erroneous decision on the other. As a result, Rousseau introduces the legislator or the civil religion which is external to a people in order to transform a multitude into unified people. However, because of the very reason that people are still and always multitude, they consequently could not obey this foreign authority so the problem regarding difficulty of self-ruling of the people remains unsolved. At a glance, Rousseau's theory of popular sovereignty seems to optimistic assertion that the people should and could govern itself. But Rousseau's pessimistic claim that the ideal people cannot be naturally given, but must be constructed by constant effort should not be overlooked as well. Finally, the introduction of the legislator or the civil religion is not contradictory to the principle of popular sovereignty because the success or failure of this heteronomous agency is uncertain and the popular sovereignty keeps still its autonomy. The problems are described as follows: the general will aiming at common good could fell to mere will of all by acquiring of a particular will possessed by some individuals. In the same way, the people who should be unitary and organic are degenerated into a blind multitude and the citizen who must be active and rational in the collective deliberation into a passive, passionate subject. The principle of the popular sovereignty claiming that good law makes a good people but the origin of the good law must be also the people, and the fact that primitive people does not have any capacity to legislate such good law is the source of the circular logic Rousseau engages. It also suggests that the self-ruling of the people is not easily attainable project by the introduction of the legislator or the civil religion because after the initial social contract, passionate, irrational and apolitical properties of the human being who had had those attributes in the state of nature cannot be completely eradicated. So the state of the society in Rousseau is more vulnerable than the traditional reading in that there is always the danger of reemergence of the state of nature. The fact that the sovereignty belongs to the people but the people do not have such capacity to exert the sovereignty is the central ambiguity derived from the theory of popular sovereignty in Rousseau. Rousseau's democracy as self-ruling of the people, therefore, remains always incomplete, contestable and unfinished democracy. This paradox of Rousseau is deduced from the consistent, thorough accomplishment of the principle of the freedom. In other words, Rousseau's premises arguing that the legitimacy of the politics does not have any transcendent and ultimate ground and its source is a unique source of will of the people as free being even permit the freedom to refuse their freedom. That is to say, individual citizens must be forced to be free but also can have the (natural) freedom not to be forced to have (civil and moral) freedom. In short, as though effective denaturalization is necessarily required to make man into citizen, it remains a process without a priori guarantee. Thus, the binary oppositions which support Rousseau's whole system, such as oppositions between the society and nature, the people and multitude and the general will and the will of all always have the possibility of confusion in practice. That danger renders the general will only transient or temporary in the conflictual process of politics. The fundamental problem of politics suggested by Rousseau is that the passage from the state of nature to the state of society is necessary, but is also very difficult and could not be achieved entirely. In conclusion, all these considerations show that Rousseau's political philosophy does not defense the alleged totalitarianism but is the philosophy of 'freedom' in the strict and consistent sense of the word. ; 본 논문의 목적은 을 중심으로 루소의 일반의지 개념의 정체를 해명하고, 이를 전체주의로 규정하는 비판들로부터 루소의 논지를 명료하게 하는 것이다. 이를 위해 나는 '자유롭도록 강제'된다는 루소의 역설적인 표현을 중심으로 일반의지 개념을 재구성하고자 하며, 이 점에 주목할 때 비로소 일반의지 개념에 대한 정확한 이해가 가능하다고 본다. 루소의 일반의지 이론에서는 크게 두 가지의 '자유롭도록 강제됨'이 나타난다. 하나는 일반의지를 거부하는 자들이 자유롭도록 강제되어야한다고 주장하는 1부 7장의 주장이며 다른 하나는 2부 3장 및 2부 7장(4부 8장)에서 일반의지의 성립 조건을 논의하는 대목에서 드러난다. 나는 이들을 각각 살펴보고 루소의 궁극적인 강조점은 강제가 아니라 자유에 있음을 보여주고자 한다. 결론적으로, 루소의 논리를 따를 때 나타나는 진정한 난점은 자유롭도록 강제하는 과정이 일반의지의 산출을 위해 필수적임에도 불구하고, 실천적으로는 이것이 실패할 수 있는 여지를 허용하는 데에 있다. 루소의 인민주권론은 국가 정당성의 토대가 신적인 것이나 자연적인 근거에 있다는 견해를 부정하고 인민의 자율적인 의지가 정치적 권위의 원천이라고 주장한다. 그런데 인민은 항상 이성적이고 사회적인 질서정연한 통일체인 것이 아니라 또한 잠재적으로 정념에 좌우되기 쉬운 개인들의 무질서한 모임으로서 다중으로 현상하기도 한다. 즉 한편으로 인민의 일반의지는 사회를 정당한 것으로 만드는 조건이지만, 다른 한편으로 인민들의 개별 심의는 우연적이며 오류를 범할 수 있는 것이다. 따라서 루소는 다중을 인민으로 만들기 위해서 입법자와 시민종교와 같은 인민 외부의 권위를 도입한다. 그러나 인민은 그들이 다중이라는 바로 그 이유로 이러한 외부적 권위에 복종하지 않을 수도 있기 때문에, 인민이 스스로를 통치하는 것에 관한 난점은 해결되지 않는다. 일견 루소의 인민주권론은 인민이 인민 자신을 통치해야 한다는 낙관적 주장으로 보이지만, 인민은 그 자체로 주어지거나 발견될 수 없으며 다만 이상적 인민으로 구성되어야 한다는 루소의 비관적 주장 역시 간과되어서는 안 된다. 결국 입법자나 시민종교의 도입은 인민주권의 원리와 상충되는 것이 아닌데, 이러한 타율적 장치의 성공 여부는 불확실하여 인민주권은 여전히 그 자율성을 지니기 때문이다. 문제는 공동이익을 지향해야 할 일반의지가 각 개인이 갖는 특수의지의 득세에 의해 한갓 전체의지로 전락할 위험, 통일적이고 유기적이어야 할 인민이 무지몽매하고 개별적인 다중으로 전락할 위험, 집단적인 심의에 있어 능동적이고 합리적이어야 할 시민이 수동적이고 정념에만 사로잡힌 신민으로 전락할 위험에 있다. 좋은 법이 좋은 인민을 만들지만 좋은 법의 출처는 또한 인민이어야 한다는 인민주권의 원리, 그리고 최초의 인민은 그러한 입법을 할 수 있는 역량을 가지지 못하는 다중이라는 상황이 루소가 사로잡힌 순환 논리의 원천이다. 그런데 사회계약 이후에도 인간이 자연 상태에서 갖던 감성적, 비합리적, 비정치적 속성은 완전히 해소되지 않으며, 이는 입법자나 시민종교 같은 장치를 통해서도 인민의 자기통치가 온전히는 달성될 수 없는 난제임을 보여준다. 이처럼 루소의 사회 상태는 항상 부분적으로나마 자연 상태가 돌발할 수도 있는 위험을 갖는다는 점에서 취약한 것이다. 주권은 인민에 속하지만 인민은 스스로를 직접 통치할 수 있는 역량을 결여한다는 것이 루소의 인민주권론이 보여주는 애매성이다. 그러므로 인민의 자기통치로서 루소의 민주주의는 항상 불완전하여 계속해서 갱신되고 수정되어야 하는 미완의 민주주의로 남는다. 루소에서 이러한 역설은 자유의 원리를 일관되게 관철시키게 됨에서 귀결된다. 즉 정치의 정당성에는 어떠한 선험적이고 궁극적인 토대도 없다는 것, 인민은 자유로운 존재로서 그들의 의지만이 정치적 정당성의 유일한 원천이라는 루소의 전제는 그들이 스스로의 자유를 거부할 자유마저도 허용한다. 다시 말해 각 개인은 일반의지의 실현을 위해서 자유롭도록 강제되어야 하지만, 이들은 '자유롭도록'(즉 시민적 자유와 도덕적 자유) 강제되지 않을 수 있는 자유(즉 자연적 자유)를 가질 수도 있다. 요컨대 인간을 시민으로 만들기 위해서는 효과적인 탈자연화가 요구되지만, 이는 보증없는 과정이다. 따라서 루소의 체계를 떠받치는 이항대립, 즉 사회와 자연, 인민과 다중, 일반의지와 전체의지는 항상 실천적으로는 혼동될 위험을 가지며 이러한 위험은 일반의지가 정치의 갈등적인 과정 속에서 단지 일시적으로만 가능한 것으로 만든다. 루소가 보여주는 정치의 근본 문제는 자연 상태로부터 사회 상태로의 이행이 필수적이지만, 동시에 이것이 매우 어렵고 온전히 달성될 수 없다는 것이다. 결론적으로 이러한 탐구는 루소의 철학이 전체주의를 대변하는 것이 아니라 여전히 '자유'의 철학이며, 그것도 매우 일관적인 의미에서 그러함을 보여준다. ; Master

스위스를 가리켜 다양성(diversity) 그 자체라고 정의하는 이유는 다양한 통치조직 뿐 아니라 다양한 언어와 종교, 그리고 문화를 수용하고 심지어 현재에는 전체 인구의 20%가 외국인으로 구성된 "의지에 의한 국가 (willensnation 또는 nation by will)"이기 때문이다. 이러한 독특한 의지는 스위스 헌법에 명확하게 명시되어 있다. 그렇다면 스위스 사회상에 내포된 문화적 다양성이 스위스 헌법 조문에 명기되어 있기 때문에 스위스의 다문화주의가 그에 상응하는 정치적 영향력을 가지는가? 아니면 헌법 조문에 명기되어 있음에도 불구하고 소수 집단을 규정하지 않는다는 한계를 연방 법제도와 정당제를 통해 실질적으로 극복하려는 정치적 의지가 있기 때문에 결과적으로 다문화주의의 정치적 영향력이 생성되는가? 본 논문은 이러한 논제에 답하기 위해 헌법 조문에서 명시된 또는 명시되지 않은 다양성을 연방국가 간 비교하면서 문화적 다양성을 설명하는 이론적 틀을 이해한 후 스위스가 원론적으로 문화적 다양성을 수용하면서도 다문화사회의 소수 집단 구성원들을 명확하게 규정하지 않는 현실적 괴리를 법제도와 정당제를 통해 보완하고 있음을 분석하여 스위스 다문화주의의 도면을 그려내고자 한다. ; The modern Switzerland appears well integrated such that Swiss polity is often dubbed as the embodiment of diversity. Switzerland is indeed the "willensnation" or the "nation by will" precisely because it embraces the peculiar multiplicities of government machineries, languages, creeds, and cultures. Even foreigners make up about 20 percent of Swiss population. This unique will is expressed in the Federal Constitution of the Swiss Confederation. Then, is cultural diversity politically valid in accordance with its constitutional specification? Or, is multiculturalism turned into a central pillar of nationhood because Switzerland manages to surmount the limits of the constitutional silence on the conception of the minority with the legal-institutional federalism and party system? 학위논문 (석사)-- 서울대학교 대학원 : 법학과, 2012. 2. 권영준. ; 담보제도는 여신금융거래와 밀접한 관계를 가지고 있어서 담보제도의 안정적인 작동은 여신금융거래의 활성화에 기여할 수 있다. 그런데 최근 들어 새롭고 복잡한 금융기법이 등장하고 있는데도 불구하고 대표적으로 이용되고 있는 담보물권의 일종인 저당권은 여신금융거래를 둘러싼 사회적 요구를 충분히 수용하지 못하고 있다. 특히 대규모의 자금이 투입되는 건설사업 등 각종 부동산개발사업을 추진하는 과정에서 이용되고 있는 프로젝트 파이낸싱(Project Financing, 이른바 PF 대출)이라는 금융기법은 막대한 대출금 규모에 비례하는 보다 안전한 담보가 필요하게 되었고, 이와 관련하여 부동산담보신탁은 새로운 담보방법으로 주목받기 시작하였다. 원래 신탁은 영국에서 발달한 제도이고, 현행 우리나라의 부동산담보제도는 대륙법계에서 발전된 제도이기 때문에 신탁을 통한 담보방법의 폭넓은 활용은 용이하지 않았다. 우리나라에서 신탁을 통한 담보방법인 부동산담보신탁의 활용이 관심받기 시작한 것은 불과 20년도 채 되지 않았다. 물론 부동산담보신탁이 완벽한 담보적 기능을 가지고 있는 것은 아니지만, 현행 법체계에서 담보력을 유지하기 위한 강력한 수단이라고 평가받고 있다. 그 이유 중의 하나는 신탁의 도산격리 효과 때문이다. 이것은 위탁자나 수탁자의 파산절차 또는 회생절차에 구속되지 않고 신탁부동산을 독립적으로 취급할 수 있으므로, 채권자인 수익자는 위탁자나 수탁자의 채권자로부터의 간섭 없이 신탁부동산에 대한 권리를 행사할 수 있음을 의미한다. 이러한 도산격리 효과는 신탁제도의 고유한 효과이므로, 부동산담보신탁에서도 동일하게 인정된다. 특히 위탁자에 대한 회생절차가 개시된 경우 수익자로 지정된 채권자는 경우에 따라 위탁자에 대해 가지는 회생채권은 실권될 수 있어도 수탁자에 대해 가지는 수익권은 실권되지 않는다. 이러한 점은 부동산담보신탁을 활성화시키는 강력한 유인이라고 볼 수 있다. 한편 그동안 우리나라에서는 부동산담보신탁에 대하여 신탁의 형식을 빌린 담보제도로 구성하려는 견해가 많았으나. 엄밀히 말하면 부동산담보신탁은 담보제도로 볼 수 없다. 부동산담보신탁에 대하여 형식은 '신탁'이지만 실질은'담보'라는 주장은 물권적 기능을 하는 권리들을 물권법정주의라는 틀에 맞추어 설명하다 보니 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 일종의 비전형담보권으로 보려고 했던 것이다. 그러나 담보신탁을 통하여 얻게 되는 채권자의 담보취득 효과는 경제적인 측면에서 그러한 것이지 법률적인 측면에서 그러한 것이 아니다. 따라서 부동산담보신탁은 어디까지나 신탁제도의 일종이라고 보아야 하고, 신탁제도 자체의 고유한 법리에 기초한 해석으로써도 부동산담보신탁제도를 충분히 설명할 수 있다고 보아야 한다. 미국에서는 부동산을 담보로 금융을 얻는 방법으로 대륙법계의 저당권이 아니라 'Mortgage'나 'Deed of Trust'를 이용하여 왔다. 이러한 'Mortgage'나 'Deed of Trust'는 담보를 위하여 부동산에 대한 소유권을 이전한다는 점에서는 동일하지만, 전자는 채권자에게 부동산에 대한 소유권을 이전하는 반면에 후자는 수탁자에게 그것을 이전하고 채권자는 수익자로 된다는 점에서 차이가 있다. 캘리포니아 州의 경우 1930년 이후부터'Deed of Trust'와 'Mortgage'를 동일하게 취급하여 'Deed of Trust'의 본질을 매각권이 부여된 'Mortgage'로 보았다. 그러나 이와 같이 'Deed of Trust'와 'Mortgage'에 대한 동일한 취급이 우리나라에서도 수용 가능한 것인지는 재고의 여지가 있다. 왜냐 하면 미국의 도산절차에서는 담보권자의 권리가 감축되지 않으므로 'Deed of Trust'를 매각권이 부여된 'Mortgage'로 취급하더라도 별 문제가 없으나, 우리나라의 경우는 채무자 회생 및 파산에 관한 법률의 회생절차에서 회생담보권자로 취급되면 권리감축의 대상이 되므로 부동산담보신탁을 담보제도로 보게 되면 중대한 문제가 발생할 수 있기 때문이다. 즉 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 비전형담보권으로 보게 될 경우 논리적으로 회생담보권이 되어 수익자 보호에 취약해질 수 있다는 것이다. 최근 우리나라에서는 신탁법의 전면 개정(2011. 7. 25. 법률 제10924호)으로 담보신탁의 법적 근거가 마련되고, 어떤 측면에서는 기존의 담보제도가 가진 한계를 극복-예컨대 수익증권의 발행이 가능하게 됨으로써 수익권의 유통성이 확보됨-할 수 있게 되었다. 이러한 점들은 앞으로 부동산담보신탁의 활용을 높이는 계기가 될 것이다. 한편으로는 담보신탁의 대상이 단순히 부동산에만 한정된 것이 아니기 때문에 동산, 유가증권, 금전채권 등의 신탁재산을 포괄하는 담보신탁의 활용 가능성에 대한 관심과 연구가 증대되어 궁극적으로 안정적이고 편리한 담보신탁의 활용을 통하여 여신금융거래의 활성화에 기여할 수 있도록 하여야 한다. ; The stable working of the security system can make a significant contribution to revitalizing the loan financial transaction because both of them are intimately associated with each other. Although new and complicated financial methods recently appear, a typically-used hypothec does not accept social needs surrounding the loan financial transaction. Especially the financing method which is called Project Financing needs a safer security in the process of promoting all sorts of the Real Estate Development Business prodigious funds are invested in. In this situation the real estate security trust began to make a mark as a new type of security method. A wide use of Trust as a security method was not easy because it is originated from the United Kingdom and the real estate security system in Korea has been developed from the Continental law line. It is less than 20 years that the real estate security trust has been noted as a new type of security method. Although the real estate security trust does not have perfect functioning of security, it is appreciated as a powerful means for keeping the value of security. One of the reasons is due to bankruptcy remoteness effect in Trust. This means that a creditor as the beneficiary can exercise his or her right about the trusted real estate being free from intervention of truster or trustee. As this bankruptcy remoteness effect is a peculiar one of the trust system, it is equally admitted in the real estate security trust. If a rehabilitation procedure is started, a creditor as the beneficiary can lose his or her rehabilitation credit about truster but can not lose the beneficiary right about trustee. This aspect is a contributory cause in reinvigorating the real estate security trust. Some people tended to regard the real estate security trust as the security system so far in Korea. In other words those who make an assertion that it is 'the trust' in form and 'the security system' in essence think of the beneficiary right as a kind of non-typical security right. But strictly speaking, it is not the security system. Because the security acquisition effect in the real estate security trust is right in a economical aspect and is not so in a legal aspect. So the real estate security trust is a kind of trust system and we can understand it with an explanation based on the peculiar principle of trust system. They have used 'Mortgage' or 'Deed of Trust' as a method for financing with a real estate in the United States. This 'Mortgage' or 'Deed of Trust' is similar in transferring the ownership about a real estate for a security, the former transfers it to a creditor but the latter does so to trustee. In California 'Deed of Trust' and 'Mortgage' are treated equally as the essence of 'Deed of Trust' is a kind of 'Mortgage' that has the right of disposal by sale since 1930. However we must reconsider whether this treatment in California can be accepted in Korea. Although 'Deed of Trust' in California is similar to the security trust in Korea, they are not identical. It is natural that 'Deed of Trust' is treated as a kind of 'Mortgage' which has the right of disposal by sale because the security right is not reduced in the law related to rehabilitation or bankruptcy procedure of the United States. However the law in Korea is different from that in the United States. If we regard the real estate security trust as the security system in Korea, the serious problem comes into existence because the rehabilitation security right is reduced according to the insolvency law of Korea. In other words if they think of the beneficiary right as a kind of non-typical security right, it is logically the rehabilitation security right. In result we can not protect the beneficiary. The Trust Law of Korea was fully revised in 25th July, 2011. It has not only brought about the legal basis of the security trust but also made a kind of the institutional device which can get over a boundary of the past security system-issuing a beneficiary certificate and securing a circulation of the beneficiary right. These points will enhance the use of the real estate security trust. Additionally as the object of the security trust is not limited only to a real estate, we must study the chance of using the security trust which include movable properties, securities, bonds to be paid in money and so on. This leads to making good use of the security trust which is stable and convenient, and so will eventually revitalize the loan financial transaction. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김상헌. ; 중앙정부는 지방정부의 부족한 재원을 지방교부세, 국고보조금과 같은 지방재정조정제도를 통해 보전하고 있다. 우리나라의 경우 지방 재정조정제도의 하나인 지방교부세에 보통교부세와 특별교부세가 있 다. 특별교부세는 보통교부세의 경직적 산정에 따른 배분의 한계를 보완하여 각 지방재정력의 격차를 고려하여 보전한다는 방침으로 행 정안전부에서 운영하고 있다. 그러나 특별교부세는 배분의 기준과 결 정이 모호하고 불투명하여 그 결정이 정치적으로 이루어진다는 문제 점을 지적하는 연구가 있다. 선행연구로 이루어진 특별교부세 배분에 관한 실증분석에서는 배분의 결정에 영향을 미친다고 상정한 정치적 행위자를 국회 행정안전위원회 소속, 지역구 국회의원 수 등 의회의 영역으로만 한정하였다. 본 논문은 정치적 요인에 의회의 행위자뿐만 아니라 정부의 행위자 를 포함시켜 분석하였다. 본 논문은 전국 234개 시‧군‧구의 2003~2006년도 4개년도의 특별교부세 자료를 이용하여 특별교부세 배분의 결정에 영향을 미치는 요인들에 대해 정부 정무직 공직자를 포함하여 실증분석을 시도하였다. 그 결과 정부 정무직 공직자로 상 정한 변수가 배분의 결정에 영향을 미친다고 파악되었고, 정부 정무 직 공직자 중에서도 국무총리와 국무조정실‧차장이 다른 정무직 공직 자에 비해 더 큰 영향을 미친다고 파악되었다. 특별교부세 배분에 정무직 공직자가 자기 출생지에 더 많이 배분하 려 결정 과정에 영향을 미치는 것뿐만 아니라 정무직 공직자가 임기 후 선출직에 출마할 경우 특별교부세 배분의 결정에 더 큰 영향을 미 친다는 것을 보았다. 이로써 특별교부세 배분의 결정에 정부의 정무 직 공직자가 영향을 미친다는 것을 확인할 수 있었다. ; The national government makes up for any shortfall in finance of the local governments by the local finance coordination system, which includes local revenue sharings and national subsidies. The local revenue sharing, as a kind of the local finance coordination system, consists of an ordinary revenue sharing and a special revenue sharing. The latter is introduced to remedy the shortcomings of the former's allocation system caused by the rigidity of its calculation, and is currently operated by the Ministry of Public Administration and Security. There are some literature criticizing the problem that the SRS allocation is decided politically due to the fact that the principles for its allocation are equivocal and the decisions are arbitrary and not transparent. In previous studies analyzing the SRS allocation empirically, the scope of the political actors who are assumed to exert influences on the allocation decision is limited to the legislative area, such as the members of the National Assembly Public Administration and Security Committee and the number of lawmakers in each electoral district. This study presents a further analysis with a new political factor, the government actors, in addition to the existing legislative actors. Specifically, using the SRS data for the period of 2003 ~ 2006 for the entire 234 cities- counties-districts in the country, the present study attempts to analyze the factors, which affect SRS allocation decisions, including the new variable, the government's political masters. The results demonstrate that the new variable indeed affects the allocation decisions and that, among the political masters, prime ministers and directors generals and deputy directors in the Prime Ministers Office are shown to exert greater influences than others. Moreover, it is also shown that they exercise their power in the SRS allocation decision making process to provide more sharings to their places of birth, and in particular, their intervention is even greater when they decide to run for an elective office from their places of birth after the termination of their government offices. As such, this study verifies that the government's political masters exert influences on the SRS allocation decision. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱. ; 본 연구는 1970년대 이후 미국의 통상정책 결정과정에서 주된 절차적 기제로 작용해온 신속처리절차(Fast-track procedures)가 2002년 무역법을 통해 무역증진권한(Trade Promotion Authority; TPA)으로 재입법되는 과정의 동학을 의회-행정부 관계를 중심으로 설명하는 것을 목적으로 한다. 신속처리절차는 대통령이 비관세장벽 관련 내용이 포함된 무역협정을 체결하고 이행법안을 의회에 제출하면 양원은 수정안 제출 없이 가부만을 결정해서 90일내에 처리해야 한다는 규정으로 1974년 무역법에서 처음 도입된 이래 30년 간 미국의 무역정책결정과정에서 중요한 위치를 차지해왔다. 하지만 자유무역정책에 대한 양당의 합의가 약해지면서 1994년 만료되었고, 2002년 8월 6일 부시 대통령이 법안에 서명을 하면서 8년 만에 통상정책결정과정에 다시 등장했다. 그렇다면 어떠한 맥락에서 클린턴 행정부 시기에는 부결되었던 연장 법안이 부시 행정부 때는 성공할 수 있었을까? 기존의 연구들은 1997년과 2001년 표결 분석을 통해 의원 차원에서 이익집단ㆍ유권자들과의 관계, 정당 차원에서 단점정부를 그 요인으로 지적한다. 하지만 입법과정에서 의회의 행태는 의원 개인, 정당 두 차원 외에도 행정부와의 관계에서 입법부로서의 의회를 강화하고자 하는 유인의 영향을 받는데 본 논문은 마지막 차원에 주목한 설명을 제시하고자 한다. 즉 의회는 국내외 경제적 상황, 유권자와 이익집단에 대한 고려, 행정부 등 다양한 요구에 대응하는 과정에서 입법부로서의 지위 강화를 위해 행정부와의 관계에서 개입을 증대하는 동시에 실패했을 경우에 부담해야 하는 비난, 지지기반의 이탈과 같은 손실을 최소화하는 방향으로 정책을 입안하려고 했고, 그 결과로 2002년에 무역증진권한이 다시 입법되었다는 것을 보이고자 한다. 입법 과정을 보면 초기에는 기존 연구 결과에서 나타나듯 의원 개인의 차원에서는 재선을 위해 유권자와 이익집단을 고려했고 정당 차원에서는 다수당이 되려는 선거 정치에 대한 고려와 이익집단과의 관계에서 통과와 저지의 공을 주장하려는 의도에서 정당 간 대립이 나타나기도 했다. 하지만 입법과정이 본격화되고 상원에서 안데스 산맥 국가들에 대한 무역특혜협정, 무역조정지원과 포괄법안의 형태로 입법되는 것으로 논의되면서 양당의 지도부는 의회가 미국의 전반적인 무역정책의 수립에 어떻게 개입해야 하는가에 대한 고민을 시작했다. 의회는 무역개방이 필요하다는 방향성에는 전반적으로 동의하고 있었고 WTO Doha Round가 임박해오고 있는 상황에서 행정부에 권한을 위임하지 않았다가 미국의 무역과 경제 상황이 악화된다면 그에 대한 책임을 온전히 부담해야 하기 때문에 무역증진권한의 입법을 통해 책임을 공유할 필요가 있었다. 이 경우 직접적인 권한 행사 주체는 행정부이기 때문에 실패했을 때는 행정부에 책임을 전가할 수 있는데다 권한의 위임범위와 재량권을 더욱 축소하고 적극적으로 개입해 무역 정책을 수립할 수 있기 때문에 의회의 입장에서는 결과에 대한 직접적인 책임을 회피할 수 있다. 동시에 절차의 적용 요건을 강화하고 감독기구를 늘리고 등의 조치를 통해 협상과정에 의회가 능동적으로 개입할 수 있는 통로를 확대하고, 행정부가 의회의 의사와 반하는 협상을 할 여지를 줄이기 위해 재량의 범위를 제한했다. 하지만 2002년 무역법에서 의회의 무역정책수립에 대한 적극적인 개입 의지가 가장 강하게 드러난 부분은 주도적으로 무역개방으로 인해 피해를 입은 부문에 대한 보상정책을 수립했다는 점이다. 무역조정지원에서 규정한 정책들은 분배정책적인 특성으로 인해 수혜자들에게 공을 주장하기는 쉽지만 비난을 받거나 실패할 확률은 낮기 때문에 의회의 입장에서는 헌법상 수임기관으로서 무역정책을 적극적으로 수립하는 의무를 다하고 있다고 주장하기에 효과적인 조치였다. 의회는 이처럼 무역조정지원 법안을 통해 적극적으로 개입해 직접 무역정책을 수립하고 무역협정체결과정에서 개입을 증대하는 동시에 권한을 위임하지 않았을 경우 WTO Doha Round에서 미국의 협상지위 약화로 미국의 무역과 경제 상황이 악화될 수 있다는 우려 때문에 개입의 정도를 자제하고 행정부에 직접적인 무역협정체결권한을 위임하는 내용의 무역증진권한을 입법한 것이다. ; The purpose of this study is to analyze the dynamics of legislating the Trade Act of 2002 which granted Trade Promotion Authority, previously called fast-track negotiating authority, to the President of the United States focusing on the relations between the executive and Congress. Fast-track procedures were set forth in the Trade Act of 1974, stipulating that once the president formally submits a bill implementing a trade agreement concerning non-tariff barriers, both houses must vote on the bill without any amendments or filibusters. Being continuously in effect for 30 years, they have acted as a principal procedural mechanism for enacting trade agreements since 1970's. As the bipartisan consensus on free trade was eroded by the emergence of social issues like labor and environment in trade talks, however, they expired in 1994 due to failure to reach an agreement on how these issues should be handled. In 2002, a long and enthusiastic debate in both houses finally ended and the procedures were restored after a 8-year hiatus during the Bush presidency. If that is the case, in what circumstances was it possible for president Bush to regain the authority that president Clinton failed to win? The existing studies which conducted a comparative analysis on the roll-call voting that took place in 1997 and 2001 pointed out that representatives' consideration of constituents including pressure from interest groups and divided government had a noticeable effect in the different consequences. But besides these two, the respective members and party, a motive to reinforce the legislative branch as an institution has a impact on the behavior of Congress. This study aims to propose an explanation focusing on the third dimension from a view of interbranch politics. Then, responding to both domestic and international economic condition, demand from interest groups and constituents, and request from the executive branch, Congress approved the measure as a consequence of reflecting the intention to improve its status by increasing engagement with the process of decision making in the executive branch and minimize the loss such as the blame from the public or decrease in support accompanying failure of certain policy at the same time. In the early stage of legislation congressmen's consideration of constituents for winning reelection and partisan rivalry prevailed as other studies predicted. But as the actual legislative process progressed, the situation changed. With the Senate Democrats insisting on enactment of the omnibus trade bill incorporating TPA and two other bills, Andean Trade Preference Act and Trade Adjustment Assistance, concern over how Congress should engage with the establishment of generic trade policy spread throughout the party leaders. Congress agreed with the executive branch on the need of trade expansion and delegating the power to negotiate trade agreements for imminent WTO Doha Round because it would make them share the responsibility for possible deterioration in economy and trade in the future. The fact that the direct agent of exerting the authority was the executive branch had Congress make up its leeway as it could shift all the blame onto the other branch. Furthermore, when the economy got worse Congress could curtail the limit of the delegation and discretionary power given to the executive and establish trade policy firsthand. Delegating the authority, Congress expanded the means to actively involve in negotiating process by reinforcing its role of oversight, downsizing the discretionary power to prevent the executive from concluding the agreement despite congressional opposition, and tightening up the conditions to meet for the application of the fast-track procedures. But the most impressive part of the Trade Act of 2002 is TAA which reflected Congress's intension to play a leading role in making compensation policy for the people who got injured by trade. In conclusion, a broad agreement that TPA should be extended spread over Congress as it would consolidate the firm standing of the United States in trade talks including the upcoming WTO Doha Round. Moreover, Congress did not want to take full responsibilities or blame for the potential deteriorating economy. But at the same time Congress wanted to increase its engagement with trade policy making with the authority originally given to it by Constitution and its grown capabilities. The effort to restore the fast-track negotiating authority; TPA during the Bush presidency was feasible as it was linked to TAA bill, a measure taken by Congress to expand its involvement in trade policy making, and some steps to increase its engagement with the process of negotiation were taken. In other words, the Trade Act of 2002 was legislated as a result of Congress' struggle to balance between two motives, desire to avoid blame and increase its engagement with policy making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 박정훈. ; 오늘날과 같은 지식정보화 사회에서의 전자정부 구현은 정부경쟁력, 더 나아가 국가경쟁력을 제고할 수 있는 핵심수단으로 여겨지기에 세계 각국과 국제기구에서는 전자정부를 도입하고 발전시키기 위해 재정적, 정책적으로 많은 노력을 기울이고 있다. 그러나 전자정부를 발전시키려는 이러한 노력들에도 불구하고 정부의 효과성, 민주성, 투명성 등 정부경쟁력의 개선은 전자정부 도입 시 기대했던 바에 크게 미치지 못하고 있는 것이 현실이다. 본 연구는 이러한 문제의식에서 출발하여 각 국의 정부경쟁력을 한층 강화시켜 줄 것이라 생각했던 전자정부가 과연 실제 그 효과를 나타내고 있는지에 대한 문제를 제기하고 전자정부가 정부경쟁력에 어떻게 영향을 미치고 있는 실증 분석하고자 하였다. 이를 통해 전자정부 도입 시 본래 달성하고자 하는 바들이 얼마나 잘 달성하고 있는지, 또 서로 다른 부문들로 구성된 전자정부 요소들은 정부경쟁력에 각기 어떠한 영향을 미치고 있는지 살펴보고 향후 전자정부의 연구, 정부정책과 관련한 몇 가지 시사점을 도출하고자 하였다. 본 연구는 151개 국가들을 대상으로 실시하였으며 종속변수로는 UN에서 발표하는 'Global E-government Readiness Report'의 전자정부 준비지수(Global E-government Readiness), 독립변수로는 국제투명성위원회의 부패인식지수(CPI), World Bank의 정부효과성지수(GE), Freedom House의 정치적 권리(PR), 시민의 자유(CL)지수를 시차를 고려하여 다중회귀분석을 실시하였다. 분석결과 각 국의 웹과 정보통신인프라의 발전은 정부운영의 효과성과 시민의 정치적 권리와 자유를 증진시키고 정부부문의 부패를 감소시켜 정부경쟁력 강화에 유의미한 영향을 미치고 있는 것으로 나타났다. 이러한 웹과 정보통신인프라의 효과적인 정부운영 및 부패감소 효과는 OECD국에 비하여 비OECD 국에서 상대적으로 더 큰 것으로 나타났다. 반면 정부의 시민참여 노력정도를 반영하는 온라인참여(E-Participation)변수는 기대와 달리 시민의 정치적 권리와 자유를 증진시키는데 기여하고 있지 못하는 것으로 나타났다. 본 연구는 전자정부 운영 및 연구에 있어서 몇 가지 함의를 시사한다. 첫째 전자정부가 정부경쟁력 강화라는 본래 목표를 달성하기 위해서는 무엇보다 정보통신인프라의 확충과 웹사이트의 발전이 동시에 이루어져야 할 것이다. 둘째, 각 국이 처한 경제, 사회 등 여러 부문의 발전수준과 전자정부 각 요소들을 각 국에 도입했을 때 그 영향들을 고려한 전략적 접근이 전자정부를 성공적으로 이끄는데 하나의 중요한 요소로 작용할 것이라는 점이다. 셋째, 현 시점의 전자정부 뿐만 아니라 이전의 전자정부 수준역시 정부경쟁력에 지속적인 영향을 미치고 있는 것으로 나타났다. 이는 전자정부사업에 대한 성과가 나타나는 시간이 길기 때문에 시차를 고려한 전자정부 사업계획 및 성과평가가 이루어져야 함을 보이는 것이다. 마지막으로 정부의 온라인 국민 참여노력(E-Participation)이 실제 민주주의강화에 이어질 수 있도록 정부의 보다 강한 책임성과 대응성, 법‧제도의 구축이 이루어져야할 것이라는 점이다. ; In the information society, All countries of the world and international organizations have tried to develop E-government, considering it as core means to improve government competitiveness. However, It is true that the results of it fall short of our expectations regardless of our effort in E-government. The results of the analysis are as follows: With awareness of issues above, this study tried to solve research questions: Has E-government which plays a role in improving government competitiveness accomplished its aims? and which components of it have effect on the government competitiveness? In addition, this study aimed to offer proposals related to policies and studies of E-government. In research method, multi-regression analysis was used based on the data : Global E-government Readiness Index reported by UN, Corruption Perceptions Index issued by TI, Government Effectiveness Index reported by World Bank, Political Right and Civil Liberty issued by Freedom House with 151 countries in the world. As a result of analysis, It is verified that Development of Web and Telecommunication Infrastructure have influence on improving Government effectiveness and democracy in society. And Their influence is stronger in OECD countries than non-OECD. On the other hand It is revealed that an effort of government to encourage political participation of nation doesn't contribute to improving level of democracy. The lessons from this study are as follows. First, it is important to expand telecommunication infrastructure for more citizen to get information which is a little bit developing infrastructure highly and improve web site for citizen to get high quality information. Secondly, it is necessary to approach strategically considering a level of economy and society and influence of e-government predicted before planning policies about e-government in order to make e-government business successful. thirdly, It is revealed that not only a level of current e-government but also a level of past e-government have influence on current government competitiveness. It means that time lag has to be considered planning e-government business and evaluating performance of it. Last but not least, More responsibility and responsiveness of government and laws and institutions related to e-government are needed in order that an effort of e-participation each government carries out is connected to reinforcing democracy. ; Master

학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (석사)-- 서울대학교 대학원 : 외교학과, 2012. 2. 윤영관. ; 개발원조가 더욱 중요해지고, 투입되는 금액 또한 증가하면서 개발원조의 효과성에 대한 관심이 증대되고 있다. 본 논문 역시 이에 주목하여, 원조가 수원국의 경제발전에 긍정적인 영향을 미치는 조건을 알아본다. 특히 수원국의 경제발전전략과 원조효과성과의 관계를 살피기 위해서 시장주도적인 경제발전전략을 채택한 방글라데시와 국가주도적인 경제발전전략을 채택한 보츠와나의 원조이용과 그 효과성을 비교하여 살펴보았다. 보츠와나 방글라데시 두 국가 모두 독립 당시에는 매우 가난하여 해외 원조에 의존하였다. 그러나 현재, 보츠와나는 1인당 국민소득이 7,000달러에 달하고 방글라데시의 국민소득은 600달러를 겨우 넘는다. 양국의 개발전략을 비교해보면, 국가주도의 경제개발전략을 택한 보츠와나 정부는 국가개발계획을 작성하고 이에 따라 경제를 관리하였다. 개발계획의 수립, 예산의 작성 등을 재정 및 개발계획부라는 한 개의 정부부서가 통제함으로써 효율적인 관리가 가능했다. 반면 방글라데시는 시장주도의 경제개발전략을 택했다. 1980년대와 1990년대 세계은행과 국제통화기금 등의 공여국의 영향으로 시장주도적인 개방형 경제구조를 위한 자유화, 민영화, 규제완화 조치가 본격적으로 시행되었다. 그러나 방글라데시는 시장 자체나 이를 뒷받침해줄 제도가 제대로 갖춰지지 않았기 때문에 개혁은 제대로 성공을 거두지 못했다. 양국의 원조의 이용 역시 달랐다. 보츠와나는 국가주도의 개발전략에 따라 원조를 이용하였다. 공여국은 국가개발계획을 참고하여 원조 분야와 사업을 결정함으로써 보츠와나 정부의 우선순위에 따른 원조를 하는 것이 가능했다. 반면 방글라데시의 원조는 방글라데시의 필요에 맞춰 이용되는 것이 아니라 공여국의 입장에 따라 이용되었다. 이에 따라 사업이 중간에 중단되거나, 원하는 목표를 이루지 못하는 경우가 생겼다. 그 결과 양국에 제공된 원조의 효과성에도 차이가 있었다. 보츠와나의 경우, 원조가 투자된 교육 분야나 보건, 교통 등의 분야에서는 예전에 비해 많은 발전이 이루어졌으며, 경제발전에 도움이 되었다는 평가를 받고 있다. 반면 방글라데시의 경우, 경제성장을 위해 필요한 부분에 원조를 투입하기 보다는 공여국의 개혁정책을 실시하기 위해 필요한 부분에 원조를 투자하였다. 시장의 발달을 위해 민간 금융 기관의 설립, 국영기업의 민영화 등에 투자된 원조는 공여국의 요구에 따라 성급하고 무리하게 투자된 것이었다. 이렇게 투자된 원조는 제대로 효과를 발휘하지 못하고 오히려 실업이나 채무 부담 증가 등 부작용을 발생시켰다. 국가주도적인 개발전략을 세우고 실행하면서 원조 역시 성공적으로 이용한 보츠와나와 공여국의 영향으로 시장주도적인 개발전략을 세우고 개혁을 시도하였으나 실패하고 개혁에 투입된 원조도 그 효과가 크지 않았던 방글라데시의 사례를 비교해본다면 무조건적으로 시장주도적 경제발전전략을 세우고 이에 따라 개혁을 실시하는 것은 수원국의 경제를 발전시키고 원조의 효과성을 제고하기 보다는 오히려 부작용을 불러올 수도 있는 것으로 보인다. 그보다는 수원국의 정부가 장기적인 안목을 갖고 국가주도적으로 경제발전전략을 정하고 이 과정에 통합하여 원조를 이용하는 것, 그리고 공여국은 최대한 그에 따라 원조를 지원하는 것이 원조의 효과성을 높이는 방법이라고 생각할 수 있다. ; As development aid becomes more important and the volume of it increases, more people develop interest on the effectiveness of aid. In this dissertation, I sought for the conditions to improve aid effectiveness. To find the conditions that positively influence the economy of a recipient country, I compare the development strategy and the use and the effectiveness of aid between Bangladesh and Botswana. Both Botswana and Bangladesh were so poor that they could not help depending on foreign development aid when they became independent. However, the GDP per capita of Botswana is almost 7,000 dollars now while Bangladesh's is barely 600 dollars. Bangladesh has selected a market-oriented economic development strategy and Botswana a state-led strategy. The Botswana government built the National Development Plan and managed their economy according to this. Because the Ministry of Finance and Development Plan controls the development plan, budget, and so on, it managed the economy efficiently. On the other hand, Bangladesh initiated reform policies to have an open market economy under the influence of donors. In the 1980s and 1990s, the policies for liberalization, privatization, and deregulation were placed guided by major donors, such as the World Bank and the International Monetary Fund. However, Bangladesh did not have the proper market and the institution to support it; therefore, its intended reforms did not succeed. The use of aid is also different in both countries. Botswana efficiently used aid according to a national development strategy. Donors could give aid to Botswana in alignment with its priorities because the donors decide an aid project in light of Botswana's development plan. In addition, aid was invested in education, health, and transportation in Botswana. There was improvement in those fields that contributed to economic development. The Bangladesh aid is used according to the opinions of its donors. The aid projects ceased consequently thereby deferring its set goals. Bangladesh invested aid to practice reform policies for a market-oriented economy. It invested aid impetuously on requests by donors for the establishment of private financial institutions and the privatization of state-owned enterprises. These aids could not help the country's economic development and produced side effects, such as unemployment and national debt. As we compare the two, we can infer that building a market-oriented development strategy and practicing reform policy unconditionally according to the purpose of donors do not render aid effective. It is rather more effective if the recipient country makes a long-term development plan, controls the economy, and uses aid according to its strategy. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 이승종. ; 민선 5기 지방선거 이후 우리나라 지방자치는 새로운 양상으로 진행되고 있다. 지방자치의 정치화, 지방정치의 중앙화가 가속화되었으며 특히 무상급식이라는 정책이슈가 지방자치의 주류 현안으로 등장하게 되었다. 이 논문은 무상급식 이슈가 대표적인 양대 지방자치단체인 서울시와 경기도에서, 유사한 정책 환경에도 불구하고 전혀 다른 정책결과를 낳은 점에 주목하였다. 이를 위해 서울시와 경기도의 무상급식과 관련된 정책 환경의 공통점과 차이점을 알아보고 어떤 요소에 의해 상이한 정책결과가 나타났는지를 분석하고자 하였다. 급식정책 실시 결과라는 종속변수에 영향을 주는 독립변수로는 지방선거 결과, 지방의회 특성, 자치단체 재정규모, 마지막으로 단체장의 특성을 설정하였다. 연구 결과 두 지방자치단체는, 단체장의 정당배경 및 무상급식에 대한 소신, 지방의회의 정당간 분점정도, 의회규모, 의원 보수, 자치단체 재정규모 면에서 극히 유사하였으나 단체장 특성 가운데 정당배경 및 성장배경 보다는 갈등해결 전략에서 차이가 있음을 알 수 있었다. 그 결과 경기도에서는 김문수 지사가 명분을 지키면서도, 의회와 타협하여 상생의 길을 모색하였고 서울시에서는 오세훈 시장과 의회가 강경대응으로 일관하여 시장 사퇴라는 나쁜 선례를 남기고 말았다. 또한 당초 설정된 '단체장의 특성에 따라 급식정책은 영향을 받을 것이다' 라는 가설이 확인되었다. 정책적 함의로 첫째는 '지방선거의 지방화'를 위해 정치권이 노력해야한다는 점을 들 수 있다. 6.2 지방선거에서는, 행정학자들이 우리나라 지방정치의 문제점으로 거론해 온 지방정치의 중앙화 현상이 더욱 극심해진 결과를 보여주었다. 중앙당은 지방선거를 중앙선거의 대리전 또는 전초전으로 간주하는 태도를 버려야 할 것이다. 둘째는 정당들이 더욱 정책개발에 노력할 필요가 있다는 것이다. 민선 5기 선거는 무상급식 이슈가 전국을 휩쓴 선거로서, 여야 정당들은 지방차원의 정책 개발보다는 선거이슈 선점에 따른 공세 및 방어에 급급한 모습을 보여 주었다. 교육정책에는 무상급식 외에 절실한 문제들이 많이 있음에도 불구하고 마치 과거 민주화항쟁 당시의 대통령 직선제 요구를 방불케 하는 양자택일 양상으로 진행되었다. 또한 근거 없이 무상급식 요구를 포퓰리즘으로 매도한다거나, 선별적 급식지원 정책이 아이들에게 눈칫밥을 먹이는 것이라고 선동하는 것은 지방선거에서 우선 승리하고 보자는 식의 후진성을 보여주는 사례라고 할 수 있다. 정치권이 더욱 성숙해질 필요가 있다. 셋째 복지정책은 개별 지방자치단체의 재정상황 여건에 따라 추진할 필요가 있다. 연구결과 복지 선진국들도 국가별, 지역별로 다양한 급식 정책을 실시하고 있음을 알 수 있었다. 또한 지방자치단체와 의회는 일방적인 '힘'의 논리만 앞세우지 말고 서로 화합하여 선진 지방자치 문화 정착에 기여하여야 할 것이다. ; After the 5th local election by popular vote, Korea's local autonomy is taking on a new aspect. Party politics and centralization of local politics are accelerating. Especially free meals policy has become the mainstream issue of local autonomy. This paper paid attention to the fact that free meals issue brought about different outcome in two big typical local governments such as Seoul city and Gyeonggi province. For this research, first I tried to discern similarities and differences related to free meals policy environment and to analyze what factors brought about different outcome. I set up the local election result, financial ability of local government, and characteristic of local government head as independent variables which have influence on school meals policy. This reserch finds out that there was significant difference in characteristic of local government head, particularly conflict solving strategy rather than political backgrounds although there were many similarities in their parties, belief on free meals policy, inter-party domination structure, size of assembly, annual salary, local finance of the two local governments. In Gyeonggi province, Governor Kim negotiated with local assembly for peaceful coexistence, in Seoul city Mayor Oh and city assembly called for tighter controls. Finally Mayor Oh resigned because of the low turnout in inhabitant's poll on free meals policy. This is a bad precedent in local autonomy history. Also the hypothesis that free meals policy will be influenced according to the characteristic of local government head was confirmed. This study implies, first, all politicians should make a greater effort for localization of local election. In the 5th local election by popular vote, centralization of local politics which many scholars have mentioned so far was intensified. Central parties have to come off regarding local elections as proxy war and skirmish of the central general election. Second, parties should develop policies. The 5th local election was only for free meals policy issue all over Korea. Most of parties manage to cope with electoral situation related to free meals issue rather than policy development of local level. Free meals policy was considered as the only matter like direct presidential election system issue in 1987 although there are other urgent matters except free meals policy in education policy field. Also the ruling party politicians denounced free meals policy as populism, otherwise the opposition party politicians condemn selective welfare policy for vulnerable groups as discrimination of the poor. These cases are backward behaviors which aim at short-term election victory. All politicians must be more mature. Third, welfare policy need to be carried out depending on each local government's financial conditions. As mentioned earlier, even advanced countries implement various school meals policy on a case by case basis. Also local governments and local assemblies should cooperate each other for establishing desirable local autonomy culture not depending on the unilateral power. ; Master

"내외 귀빈 여러분, 유라시아 대륙은 세계인구의 약 71%가 살고 있고, 동쪽 끝에서 서쪽 끝까지 12개의 시간대에 걸쳐 있는 세계 최대의 단일 대륙입니다. (중략)···저는 이제 유라시아에 새로운 소통의 길을 열어 협력의 잠재력을 끌어내야 할 때라고 생각합니다. 단절과 고립, 긴장과 분쟁을 극복하고 소통과 개방으로 평화롭게 교류하며 함께 번영하는 유라시아를 건설해야 합니다. 이를 위해 저는 유라시아를 '하나의 대륙', '창조의 대륙', '평화의 대륙' 으로 만들어 가는 몇 가지 방향을 제안하고자 합니다." 라고 하며 '유라시아 이니셔티브' 를 주창하였다. 이처럼 유라시아 이니셔티브는 유라시아 국가들 간 물류, 시장, 문화 등을 통합해 나가는 것을 주요 내용으로 하였으며 핵심은 물류 및 교통의 통합을 통해 유라시아 대륙의 공동번영을 이룸과 함께 한국은 유라시아 대륙의 물류 허브로 거듭나는 것이었다. 다수 전문가들은 유라시아 이니셔티브의 추진에 있어 여러 도시 중에서도 세계적인 항만을 보유하고 있고, 한반도의 기점이자 종점이며 세계 전역으로 뻗어나갈 수 있는 지정학적 위치를 갖춘 부산시의 역할에 주목하였다. 이러한 상황에서 당시 부산시장은 부산시의 도시 비전을 '유라시아 관문도시 부산' 으로 정하고 부산이 주도적으로 유라시아 이니셔티브를 이끌어가야 한다고 주장하였다. 이러한 주장에 기반하여 부산시는 2015년부터 본격적으로 유라시아와 관련한 여러 사업을 추진하였다. 하지만, 대부분의 사업은 일회성에 그치거나 큰 효과를 내지 못하였다. 반면, '유라시아 관문도시 부산' 이라는 부산의 비전을 국내외에 전파하고 유라시아 여러 도시들과의 교류협력을 강화하기 위해 추진한 『유라시아 부산원정대』 사업은 정책결정 과정에서는 사업효과에 대한 의문이 다수 제기 되었으며 일회성 행사에 그칠 것으로 우려 하였으나 2019년 현재까지도 지속적으로 추진될 만큼 부산시를 대표하는 유라시아 관련 정책으로 자리매김 하였다. 따라서 본 논문에서는 『유라시아 부산원정대』의 집행과정을 분석해보고, 어떻게 본 정책이 다른 사업들과는 달리 지속될 수 있었는지에 대해 살펴보았으며 이 과정에서 Mazmanian과 Sabatier의 연구를 활용하여 분석을 진행하였다. 따라서 본 연구의 목적은 다음의 세 가지로 나눌 수 있다. 첫째, 『유라시아 부산원정대』의 집행과정을 분석해보고 집행이 잘된 부분과 그렇지 않은 부분을 찾아본다. 둘째, 정책집행과정의 분석을 통해 어떻게 본 사업이 다른 유라시아 관련 정책들과는 달리 일회성에 그치지 않고 지속될 수 있었는지에 대해 알아본다. 마지막으로, 정책집행 연구에서 빈번하게 활용되는 Mazmanian과 Sabatier의 연구를 분석하여 이론이 담고 있는 함의 및 구체적 내용을 알아본다. 이러한 목적의 달성을 위해 본 연구는 우선 부산시 및 여러 유관기관들의 문헌 자료와 함께 집행과정에 참여했던 주요 행위자들을 면담하여 정책집행과정을 면밀히 분석하였다. 다음으로 Mazmanian 과 Sabatier 가 제시한 '정책집행이 효과적으로 이루어지기 위한 조건'을 활용하여 원정대 사업의 정책집행과정이 해당 조건에 부합하는지 여부를 통해 정책집행이 잘 된 부분과 그렇지 못한 부분을 구분하였다. 연구의 결과는 다음과 같다. 첫째, 『유라시아 부산원정대』의 정책목표는 명확하며 일관성을 갖추었다. 특히, 외교부, 경상북도 등 타 기관이 추진한 유사사업들과 비교했을 때 원정대의 정책목표는 상당히 명확하며 구체적이었다. 둘째, 정책목표의 달성을 위해 부산광역시 차원의 개입이 필요하다는 것은 분명하나, 굳이 원정대라는 수단을 선택해야 하는지에 대해서는 원정대 이외에도 본 정책목표를 달성할 수 있는 여러 가지 다른 방법이 있을 수 있기 때문에, 본 정책목표와 원정대라는 정책수단 간의 인과관계는 명확하지 않았다. 셋째, 정책집행 담당기관이었던 부산광역시 통상진흥과 남북경제협력팀 및 부산국제교류재단은 본 정책과 업무관련성이 매우 높고, 조직원들은 본 사업에 대해 상당히 긍정적인 반응을 보였기 때문에 집행기관은 모두 원정대 사업에 대해 상당히 호의적이었던 것으로 나타났다. 넷째, 부산시 및 부산국제교류재단 모두 원정대 사업에 대한 의사결정 과정은 3단계로 이루어져 공식적으로 정해진 절차에 비해 단순화 되었으며, 의사결정 방식 역시 하향식이며 대체로 시장의 지시에 전적으로 순응하는 편이었기 때문에 빠른 정책집행이 가능했다. 다섯째, 부산시 의회 및 부산시 내 관련 부서 등 정책집행 유관기관과 정책결정자인 부산시장은 원정대 사업에 대해 호의적이었으며 지지를 보냈던 것으로 나타났다. 특히, 부산시장의 경우 원정대에 대해 상당히 높은 관심을 보였던 것으로 파악되었다. 마지막으로 원정대 사업의 집행과정에서 동남권 신공항의 유치 문제가 이슈화 되면서 '유라시아 관문도시 부산' 이라는 비전의 홍보 및 국내외 확산이 더욱 중요해졌고 이로 인해 원정대 사업의 정책목표가 갖는 중요성은 정책결정 시에 비해 더욱 높아졌다고 볼 수 있다. 연구결과를 종합해보면, 『유라시아 부산원정대』의 정책집행과정은 Mazmanian 과 Sabatier가 제시한 정책집행이 효과적으로 이루어지기 위한 조건을 대체로 만족하는 것으로 나타났다. 특히, 원정대 사업은 ① 정책목표가 상당히 명확하며, ② 정책집행기관 및 정책결정자가 사업에 대해 상당한 관심 및 지지를 보내었고, ③ 사회·경제적 조건의 변화로 인해 정책집행과정에서 정책목표의 상대적 중요성이 더욱 높아졌기 때문에 다른 유라시아 관련 사업들과는 달리 정책이 일회성에 그치지 않고 지속될 수 있었던 것으로 나타났다. 다만, 정책목표와 정책수단 간의 인과관계가 불명확하여 정책이 지속되고 집행에 따른 성과가 창출되었음에도 정책이 갖는 효과에 대한 의문이 지속되었던 만큼 이에 대한 보완이 필요한 것으로 나타났다. ; Former President Park Geun-hye delivered her keynote address at the opening of the 'Global Cooperation in the Era of Eurasia' conference in Seoul Silla hotel on October 18 ; "Ladies and Gentleman, Eurasia is the biggest continent in the world which contains 71% of the world's population and 12 different time zones. .Now is the time to open a new channel to Eurasia in order to lift its cooperation potential. We need to revive Eurasia, a geographic area disconnected by the Cold War, as a space for communication, openness, creation and fusion. I would like to propose a new vision, to make Eurasia, one continent of creation and peace." and then suggest her new vision 'Eurasia Initiative'. The main concept of Eurasia Initiative is integrating logistics, market and culture among Eurasian countries and key point is by integrating logistics and transportation we'd like to achieve prosperity of Eurasia Countries and at the same time, Korean peninsula should role as a logistic hub and the gate way of Eurasia continent. Many specialists focused the role of Busan Metropolitan city to achieve the goal of Eurasia Initiative because of it's global port facilities and geographical location which is the origin and destination of Korean peninsula. In this situation, former Mayor of Busan set the city vision as 'The Eurasia Gateway Busan' and stressed that Busan should lead the Eurasia Initiative. Based on this opinion, Busan Metropolitan City implemented many policies from 2015, but most of them were just one time event and failed to succeed. However, the policy 'Eurasia Expedition from Busan' which focused on publicizing the vision of Busan (Eurasia Gateway Busan) and strengthening the cooperation with Eurasian cities is still maintaining in 2019 and becoming the most famous and symbolic policy about Eurasia in Busan eventhough there were lots of doubts about being one time event in the policy decision process. Thus in this study, analyzing the policy implementation process of 'Eurasia Expedition from Busan' and finding the reason how this policy can be maintained unlike other policies by using the Mazmanian-Sabatier model. The goals of this study can divided into three things. First, analyzing the policy implementation process of 'Eurasia Expedition from Busan' and finding the good and bad points of implementation. Second, by analyzing the policy implementation process, how this policy can be maintained unlike other Eurasian policies in Busan. Lastly, analyzing the Mazmanian-Sabatier model which is frequently used in the study of policy implementation, and finding the exact meaning of that model. To achieve these goals, first of all, reviewing much data of Busan Metropolitan cities and other related organizations and also interviewing some people who participated the policy implementation process. Next, using the "Conditions of effective policy implementation which is argued by Mazmanian-Sabatier, analyzing the policy implementation process of 'Eurasia Expedition from Busan' whether it is fit to that conditions or not. The results of this study are as follow. First, the objectives of 'Eurasia Expedition from Busan' are clear and consistent. Especially, comparing with the similar policies which was implemented by the ministry of diplomacy and Gyeongsangbuk-do, the objectives of these policies are very obvious and concrete. Second, to achieve this objectives, it's clear that the intervention of government is necessary, but the causal theory between this policy and the objectives is not clear. Third, both Inter-Korean cooperation team in Trade promotion division of Busan Metropolitan City government and Busan Foundation for International Cooperation which were in charge of implementing 'Eurasia Expedition from Busan' were quite related to this policy and all of members were so much positive to this policy. Thus both organizations are so much favorable to this policy. Fourth, the decision rules of both organizations were in a three stages which was quite simplified than formal steps, and quite top-down ways especially complying the order of mayor thus it can simplify policy implementation process and facilitate effective implementation. Fifth, the related organizations of policy implementation like Busan city council and other divisions of Busan Metropolitan City and the mayor of Busan who is a policy decision maker were favorable and supportive to 'Eurasia Expedition from Busan'. Especially, mayor of Busan gave considerable support to this policy. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 임도빈. ; 신 공공관리론의 영향으로 행정기관으로의 시장경제원리 도입에 대한 관심이 지속되고 있다. 정부는 고권적 입장에서 시민을 바라보았던 기존 관점에서 벗어나 시민을 고객으로 보고 고객만족행정을 실현하는데 힘을 기울이고 있다. 그리고 그러한 행정에 대한 측정지표로써 '시민 만족도'를 조사하여 연구하는 경향이 활발해지고 있다. 시민 만족도에 대한 조사는 시민들이 시 행정에 얼마만큼 만족하고 있는지를 살펴보고 이를 행정에 대한 성과로 치환할 수 있다는 점에서 의의가 있다. 그러나 기존의 만족도 조사로는 '과거' 성과에 대한 측정으로서의 역할을 할 뿐 '미래'에 어떤 정책을 추진해야하는지 한정된 자원을 어디에 투입해야하는지를 알려주는 지표로서는 한계를 가진다. 이러한 관점에서 시장부문에서 활용되고 있는 IPA 분석(중요도-성과 분석)을 행정학에 도입하려는 움직임이 대두되고 있다. 사부문과는 달리 성과를 가시적인 산출물로 나타내기 힘든 공공부문의 특성상 행정학에서의 성과는 시민 만족도로 대체되는 경향이 있어 이를 중요도-만족도 분석이라고 부르기도 한다. 여기서 주목할 점은 기존의 만족도만 조사하였던 방식에서 탈피하여 '중요도'에도 초점을 맞추기 시작했다는 것이다. IPA분석을 통해 한정된 자원을 좀 더 효율적으로 투입할 수 있는 방안이 생겼는데 이는 중요도와 만족도를 함께 조사하기 때문에 가능한 일이다. 그러나 '성과'를 '시민 만족도 조사' 로 치환하여 사용할 수 있는지, 그 방법에는 어떠한 것이 있는지 등 '만족도'에 대한 논의는 활발함에도 불구하고 아직까지 '중요도'에 대한 논의는 국내에서 미미한 실정이다. 이러한 이유에서 본 연구는 개별 행정서비스의 '중요도' 를 좀 더 정확하고 설명력있게 파악하기 위한 작업으로 사부문에서 활용되는 Derived importance를 소개하고 직접 설문을 통한 결과를 도출하여 기존에 활용되던 Stated importance 와는 어떤 점에서 다른 특성을 갖는지 살펴보았다. Derived importance 는 개별행정서비스에 대한 만족도를 독립변수로, 전체 행정 만족도를 종속변수를 두고 다중회귀분석을 통하여 나온 설명변수값(Beta)으로 중요도를 도출해내는 통계학적인 수치이다. 이는 Stated importance 보다 더 설명력이고 예측성이 있으며 심층적인 시민의 의식을 엿 볼수 있다는 점에서 실질적인 중요도로서의 가치가 증대되고 있다. 직접 설문조사를 통하여 각각의 중요도 값을 도출해낸 결과 24개의 개별 행정서비스의 중요도로 Stated importance 에서는 '공원과 여가활동시설'의 중요도는 12순위 밖에 되지 않았으나 Derived importance 에서는 1순위임을 확인할 수 있었으며, '공중보건 및 의료' 항목도 Stated importance 는 14위이나 Derived importance 에서는 2순위의 값을 가지는 등 여러 차이를 확인할 수 있었다. 이는 일반인들이 '실업문제 해결 및 경제활성화'나 '주택가격안정 및 주택공급' 과 같이 상대적으로 범주가 크고 사회적으로 이슈가 되는 문제해결을 위한 행정서비스 개선이 중요하다고 표면적으로 응답하나 실질적, 심층적으로 서울시의 전체 행정 만족도의 개선을 증진시키는 가장 중요한 서비스는 자신의 주변에 '공원과 여가활동시설' 이 얼마만큼 있는지, 자신이 아플 때 이용하는 '공중보건 및 의료'에 대한 행정이 잘되어있는지의 여부라는 것을 의미한다. 즉, 개인이 중요시 여기는 실질적인 개별 행정서비스의 개선은 자신의 피부에 직접 와닿고 자신이 느낄 수 있는 범주의 것이라는 점이다. 정책결정자의 최종 목표는 전반적인 만족도의 향상이다. 시장의 경우 전체적인 시의 운영 및 시 행정에 대한 만족도가 올라가는 것을 가장 첫 번째 목표로 삼을 것이며 시민들이 실질적으로 원하는 곳에 자원을 투입해야 한다는 측면에서 Derived importance 의 활용은 획기적인 시도라 할 수 있다. Derived importance 에 따라 개별 행정서비스 부문 중 높은 중요도를 가진 부문에 예산과 자원을 투입한다면 지방정부의 가장 첫 번째 목표인 지방 정부의 전체 만족도의 상승 효과를 예상할 수 있어 매우 효과적인 지표로써 활용될 수 있을 것이다. ; New Public Management lead consistent attention of introducing market economy principle to administrative institutions. As index of measuring such administration, there is a growing tendency of studying 'citizens' level of satisfaction'. Survey on citizen's level of satisfaction has the implication that finding out to what extent citizens are satisfied with municipal administration and apply it to administrative performance. Previous survey on the level of satisfaction, however, previous index only had a role of measuring 'past' performance but had limitation in guiding which policy should be promoted in the 'future' as well as where limited resources should be inputted. For such reasons, so as to figure out 'the level of importance' of each administrative service more accurately and in a more explanatory manner this study introduces Derived importance which is utilized in private sector and takes results through direct survey to find out which features are different from Stated importance which is utilized previously. Derived importance is statistical figure of which independent variable is the level of satisfaction on each administrative service and dependent variable is the level of satisfaction on general administration, and derives the level of importance through multiple regression analysis in the form of explanatory variable (Beta). As the result of the level of importance through direct survey, among 24 individual administrative services, it is found out that the rank of 'park and leisure facility', which is only 12th in Stated importance, is the first in Derived importance; the rank of 'public health and medical treatment', which is only 14th in Stated importance, is the second in Derived importance. This result means that citizens ostensibly answer that it is important to enhance administrative services concerning subjects, which are relatively big and receive attention from society, such as 'solution of unemployment and economic revitalization' or 'stabilization of housing price and housing provision', however, the most important service to them in substance and in depth, which enhances the level of satisfaction on Seoul city administration in whole, is 'park and leisure facility' around the neighbor and 'public health and medical treatment' which they can use when they are sick. That is, the substantial enhancement of individual administrative service which is important to individuals is about categories which people click and feel. The final goal of policy maker is to raise overall level of satisfaction. In case of mayor, it may be fairly said that the utilization of Derived importance is epoch-making attempt from the aspect that the first priority will be enhancement of general municipal operation and satisfaction on municipal administration and resource should be inputted where citizens want in substance. 학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 지리학과, 2020. 8. 신혜란. ; 본 연구는 정책이동(policy mobility)의 관점에서 서울로 7017의 조성 과정을 분석하였다. 특히 본 연구는 정책이 이동하는 과정에 있어서 도시 정치가 어떠한 방식으로 개입하게 되는지를 집중적으로 살펴보았다. 정책이동은 도시 연구 분야에서 주요 연구 주제로 떠오르고 있다. 전 세계 도시 간 협력과 교류가 활발해짐에 따라 정책의 이동 - 선진 정책의 벤치마킹 및 수입과 모방, 정책 관련 국제 컨퍼런스 발표 및 수상 등 - 은 활발하게 진행되고 있고, 이러한 현상은 도시정책의 추진 및 의사결정에 있어서도 직접적인 영향을 미치고 있다. 한편 기존 정책이동 관련 연구들은 정책이 이동되는 과정자체에 초점을 맞추어 도시들 간의 지역적 맥락이나 정치구조의 차이가 정책의 적용과 변용 등에 어떠한 영향을 미치는지를 주로 살펴보았다. 이에 반해 정책 이동 현상이 넓은 범위의 도시정치와 거버넌스에 어떠한 영향을 미치는지를 활발하게 연구되지는 못하였다. 본 연구는 이러한 부분에 있어서 기여하고자 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹이나 정책 홍보 등의 정책이동 과정이 서울시 도시정책에 어떠한 영향을 미쳤는지를 분석하였다.연구의 결과는 다음과 같다. 첫째, 서울로 7017 조성과정에서 나타난 정책의 이동 – 뉴욕 하이라인의 벤치마킹 또한 서울로 7017 정책의 홍보와 선전 - 은 서울시가 도시정책을 정당화하는 주요한 방법으로서 활용되었다. 서울로 7017은 별다른 공론화 과정 없이 박원순 시장의 정치적 추진력을 통해 급하게 추진되었기 때문에 서울시는 사업에 대한 정당성을 보여주는 것이 필요했다. 이에 서울시는 이미 진행되었던 뉴욕 하이라인의 성공을 통해서 사업의 필요성과 당위성을 보여주었다. 또한 서울시는 사업의 가치와 성공을 국내와 해외로 홍보하는 과정을 통해서, 서울로 7017 대한 성공적인 이미지를 스스로 다듬어갔다. 이처럼 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹과 정책 홍보는 서울시가 도시 정책을 정당화하기 위한 목적에서 진행되었다. 둘째, 서울로 7017의 조성에 있어서 서울시는 하이라인을 벤치마킹 하였지만, 이는 서울시의 정책적 목표와 필요에 따라 선별적으로 이루어졌다. 또한 이처럼 정책적 필요에 맞추어 벤치마킹과 모방이 진행되는 과정에서, 처음 모방하고자 하였던 하이라인의 운영방식과 내용은 큰 폭으로 변용되었다. 일례로 하이라인의 디자인은 유사한 형태로 모방되었지만, 시민참여를 대표하였던 하이라인의 운영방식은 보수적인 서울시의 행정 구조에 맞추는 과정에서 큰 폭으로 변용되었다. 또한 이와 같은 모방과 변용의 과정에서 서울시의 정책, 행정구조, 공간은 빠르게 변화되었다. 본 연구는 전세계적으로 활발하게 진행되고 있는 정책이동 현상이 도시를 어떻게 변화시키고 있는지를 서울로 7017의 실증사레를 통해서 확인하였다. 한편 본 연구는 정책이동을 통해서 이루어지고 있는 다양한 변화들을, 다소 개괄적인 범위에서 살펴보았다는 점에서 한계를 갖기도 한다. 발전된 후속 연구를 통해서 정책이동이 도시의 변화에 갖는 의미를 더욱 면밀하게 검토하고 구체적인 정책적 시사점이 제시할 수 있기를 기대한다. ; This study analyzes the development process of Seoullo 7017 through the theoretical lens of policy mobility. In the past few decades, transfers, diffusion, and movement of urban policies across national borders have increased rapidly. Accordingly, researches on policy mobility have developed in the fields of geography and urban studies. These studies have critically investigated the processes of adaptation, assemblage, and mutation of a certain policy, but have little focused on how the ordinary urban policymaking and the urban area has changed in the process of policy movement. In this regard, this study explores how the mobilization of certain policy has changed and reconstructed the urban policy and planning system. Especially, this research has focused on the interaction of local decision-making and policy mutation processes. The results of the study are as follows. First, the mobilization of policy that appeared in Seoullo 7017 including benchmarking and policy promotion was strategically used by the Seoul city government. The main purpose of these mobilizations was to legitimize the city's urban policy. Seoullo 7017, which was a mayor's landmark project, has proceeded rapidly without the civic consensus process. In this regard, the New York High Line's success was used as a tool to represent the legitimacy of the Seoullo 7017 project. Also, the branding and promotion of Seoullo 7017, which received great attention from the city government, was used as a self-curation tool to make the success story of Seoul's urban policy. Second, the mobilization and adaptation of the High Line were proceeded selectively according to specific political goals of the Seoul city government. Seoullo 7017 benchmarked both the design and governance of the High Line. Lots of critics pointed out that the design should be differentiated, as the regional context of Seoul and New York was different, However, the design was similarly imitated into Seoullo 7017 because of the symbolic image of the High Line's design itself. Also, the management style which emphasized citizen participation and governance were also imitated, but it ends with instrumental form due to bureaucratic political structure. As such, adaptation, mobilization, and mutation has been carried out in accordance with the process of legitimizing local policy and political authority. The importance of this research is that it investigates the consequences and implications of mobile urban policies through an empirical case at various points. However, it also has its limitations as this study looks into various aspects of mobile policies on a superficial level.
