The Dunning Kruger Effect, which states that individuals with little or no knowledge about a subject have more self-confidence than experts, was first put forward as a result of a social experiment in 1999. Over time, the concept has become a theory that has been accepted in the literature and has been the subject of studies in some branches of science and has been translated into Turkish as Cahil Cesareti. In this direction, the aim of the study is to analyze the Google search frequencies of the words "Dunning Kruger Effect" and "Ignorant Courage" and to determine the level of awareness of the concepts in the USA and Turkey comparatively. As a result of the Google Trends data and literature review, it has been determined that the Dunning Kruger Effect theory is known in the USA both in the general category and in the finance category. In Turkey, it has been seen that the related concept is known in the general category and has been the subject of some studies. In addition, it was stated that the related concept does not have financial awareness, as a result of both Google Trends data and literature search. In this direction, the study adds originality to the national literature at the stage of determining the level of awareness of the Dunning Kruger Effect theory, whose Turkish equivalent is Ignorant Courage, in the finance literature.
Petrol dünya yüzeyinde en fazla tüketilen enerji kaynağıdır. Dünyanın tüm ülkeleri için olduğu kadar Türkiye açısından da vazgeçilmez stratejik öneme haizdir. Küresel ve/veya bölgesel pek çok askeri ve siyasi gelişme bu çok değerli enerji kaynağı etrafında şekillenmektedir. Türkiye, bu enerji kaynağına sahip ülkelere çok yakın komşu ülke olmakla birlikte kendi yer altı zenginlikleri bakımından fakir bir ülkedir ve petrol tüketiminin % 90'dan fazla miktarını ithal etmektedir. Türkiye ekonomisi petrol fiyatlarındaki dalgalanmalardan etkilenmekte, cari açık, ödemeler dengesi, dış borç yükü ve enflasyon gibi makroekonomik dengeler petrol fiyatlarına göre şekil almaktadır. Ülkemizde petrol piyasası dikey bütünleşik bir kamusal örgütlenmeye tabi iken 2000'li yıllarda başlayan özelleştirme çalışmaları ile rafineri, petrokimya petrol dağıtım alanlarında yapısal regülasyon tesis edilmiş ve petrol piyasası rekabete açık bir piyasa yapısına kavuşmuştur. Yapısal regülasyon yanında sosyal regülasyonun bir parçası olarak çevresel hassasiyetler ve tüketicilerin korunmasına yönelik kurallar, akreditasyon, standardizasyon ve ürün/hizmet güvenliğini esas alan teknik regülasyon da yasal çerçeveye oturtulmuştur. Bağımsız bir düzenleyici otorite olarak EPDK'nın kurulması ile birlikte petrol piyasası yakın gözetim ve denetim altında bulundurulmaya başlanmıştır. Petrol açısından dışa bağımlı bir ülke konumunda olan Türkiye hazine gelirlerinin büyük miktarını yine bu enerji kaynağı üzerindeki dolaylı vergilerden karşılamaktadır. Akaryakıt satış fiyatlarının % 60-65'e varan miktarlarda vergi yükü bulunmakta olup petrol satışlarından dolayı 2011 yılında devlet kasasına giren toplam vergi miktarı 39,2 milyar liradır. Bu miktar, ülkemizde 2011 yılında toplanan verginin % 13'üne tekabül etmektedir. Petrol ürünleri üzerindeki bu aşırı vergi yükü, komşu ülkelerde 4-5 kat ucuza satılan bu ürünün kaçak yollarla ülkeye sokulması riskini de beraberinde getirmektedir. Ülkemizin oldukça uzun doğu ve güneydoğu kara sınırları ile bu bölgelerdeki istikrarsız yapı, ayrıca 3 tarafının denizlerle çevrili olması ve bu geniş alanda denetim kurulması noktasında yaşanan zorluklar hem karayolu hem de denizyolu ile yapılan kaçakçılığın artmasına yol açmaktadır. Aynı şekilde akaryakıt olarak kullanılabilen atık yağlardan elde edilen ve 10 numara yağ adı altında yapılan satışlar da rekabetçi piyasa yapısı, can, mal ve çevre güvenliği üzerinde tehditler meydana getirmektedir. EPDK özel ve genel kolluk birimleri ile birlikte petrol piyasasında denetime yönelik yoğun çaba sarfetmekte olup Kurum bütçesinin yaklaşık üçte birini bu alana aktarmaktadır. Ülkemizde ulusal marker uygulamasını merkezine alan bir denetim sistemi yürütülmektedir. Ülkemizde rafineri, işleme, depolama, iletim, taşıma, ihrakiye, serbest kullanıcı, dağıtım, bayilik faaliyetleri EPDK tarafından verilen ve belli kurallara bağlı lisanslar çerçevesinde yürütülebilmektedir. Lisans sahiplerine tehlike sorumluluğu çerçevesinde sigorta yükümlülüğü ile piyasa şeffaflığının sağlanabilmesi ve spekülatif fiyat hareketlerinden korunulabilmesini teminen de bildirime ilişkin regülasyon yükümlülüğü getirilmiştir. Ayrıca bu enerji kaynağının ülkenin kamu düzeni üzerinde üstlendiği vazgeçilemez rol nedeniyle acil durum stokları tutuma yükümlülüğü de belli lisans sahipleri açısından zorunlu hale getirilmiştir. Petrol rezervlerinin önümüzdeki 40-50 yıllık süreçte dünya ekonomileri, siyasi ve politik gelişmeleri üzerinde rolünü artırarak sürdüreceği hesaplanmakta olup piyasa yapısının yakın gözetim ve denetim altında bulundurulması hayati önem taşımaktadır. Bu doktora tezinde birincil ve ikincil mevzuat hükümleri ile birlikte EPDK ve Danıştay kararları çerçevesinde piyasa yapısı üzerindeki devlet kontrolü ve idari müdahaleler incelenmeye çalışılmıştır. ; Petroleum, consumed mostly on earth with the biggest share, is an energy sourcewith inescapable strategic importance for all the countries in the world as well as Turkey. Many military and political improvements in the world acquire a shape around this valuable energy source. Turkey, along with being a close neighbor country to the countries with this energy source, is a poor country from underground richness point of view and imports more than 90 % of her consumption. As a country at a position dependent on external sources for this energy source, Turkish economy has been affected from the fluctuations in the petroleum prices; macroeconomic equilibrium such as current gap, payment balance, external debt load and inflation take a shape according to the fluctuations in the price of petroleum. For this reason, stability in the petroleum market has a great importance for our country to continue economic public order. As petroleum market in our country used to have a vertical united public organizational structure, with the privatization efforts in the years of 2000, structural regulation was established in the fields of refinery, petro-chemistry, petroleum distribution areas, and the petroleum market has gained a structure open to competition. As a part of social regulation in addition to structural regulation, rules towards protection of environmental sensitivenesses and consumers, accreditation, standardization and technical regulation based on safety of goods/services have been made fit on legal frame. With the establishment of EPDK as an independent organizer framed below liberal economic understanding in the energy markets, petroleum market has also been started to be kept under supervision and inspection. Turkey, as a country dependent on external sources, has been making most of her treasury income through indirect taxes on this energy source. Tax load reaches up to 60-65 % of fuel oil prices and the total tax collection of the government through petroleum sales is 39.2 billion liras in 2011. This amount is equivalent to the 13 % of the total taxes that have been collected in our country in 2011. This excessive tax load on petroleum products brings the risk of illegal transformation of this product into the country since it is 4-5 times cheaper in neighborhood countries. Quite long east and southeast land borders of our country and the inconsistent structure in those regions, besides being surrounded with seas at 3 sides, and the difficulties that have been faced to set up a control system in this wide area causes the smuggling through both overland routes and maritime lines. In the same way, sales under the name Number 10 Oil that is obtained from waste oils but can be used as a fuel-oil, threatens the competitive market structure, life, property and environmental safety. EPDK has been spending intense efforts by allocating almost one third of the institution?s budget for the inspection of petroleum market together with private and general police force. In our country, an inspection system that is centralized on the national marker application has been performed. Refinery, processing, storage, conveyance, transportation, free user, distribution, franchising activities in our country can only be performed under the frame of licenses bound to certain rules and franchising activities given by EPDK. License owners are also held responsible for regulation related to declaration to be protected from speculative price changes and to provide insurance liability under the frame of threat responsibility with market transparency. In addition to all, due to the inescapable role of this energy source over the public order, responsibility of keeping emergency stocks is brought to be obligatory for some license owners.
Sukuk markets have made significant progress both in terms of market volumes and international awareness in recent years. These financial products are specially designed for investors who avoid interest gain. On the other hand, it is an ongoing issue in the literature whether these markets are a useful alternative for conventional fixed income investors as well. Our main purpose is to explore sukuk market as an investment alternative for conventional fixed income market investors' points of view. Since the integration of assets is one of the key criteria for portfolio investments, this study investigated the long-term comovements between sukuk and other fixed-income indexes via Johansen and Engle-Granger cointegration technique. To proxy international fixed income portfolio, international bond indexes which are prepared by FTSE (Financial Times Stock Exchange Group) are employed. Besides, the vector error correction model is also applied to deepen the results. According to the findings, there is a limited causality in the long run between sukuk markets and conventional bond markets. This can make international sukuk assets highly beneficial diversification alternative to conventional bond portfolios. The study aims to contribute to the literature by examining the benefits of sukuk markets as an investment alternative to conventional, wide-range fixed income markets.
1980 sonrası neo-liberal politikalar, kamu yönetimini, özellikle finansman açıkları gerekçesiyle, hem merkezi yönetimler bakımından hem de yerel yönetimler bakımından reforma etmeyi amaçlamıştır. Bu çalışmada, Almanya, Fransa, İngiltere ve Türkiye'deki yerel yönetim reformları, birlikte değişim yöntemi temelinde karşılaştırmalı olarak incelenmektedir. Karşılaştırma iki açıdan söz konusu ülkelerin benzerlik ve farklılıklarını konu edinmiştir: Birincisi, merkezi yönetim ile yerel yönetimler arasındaki işlevsel değişimdir (dikey bakış açısı). İkincisi ise, yerel yönetimler ile piyasa ve / veya üçüncü sektör arasındaki ilişkilerin yeniden düzenlenmesidir (yatay bakış açısı). Bu yatay bakış açısı, "yerel yönetimden" "yerel yönetişime" doğru evrimi karşılaştırmanın odağına yerleştirmektedir. Çalışmanın amacı, neo-liberal politikaların uygulandığı bu ülkelerdeki desantralizasyon ve piyasalaşma sürecinde ortaya çıkan kurumsal ve işlevsel değişimleri karşılaştırmalı olarak ortaya koymaktır. ; Neoliberal policies after 1980 aimed at reforming public administration, especially owing to financial budget deficit, in terms of both central and local administrations. In this study, local administration reforms in Turkey, Germany and France have been studied comperatively taking method of change together into consideration. The comparison focuses on similarities and distinctness of the above-mentioned countries from two aspects, namely, the first one is functional change between central and local governments (with the help of vertical point of view) and the second one is regulation of the relations between local governments and market or third sector (with the help of horizontal point of view). The second reconsideration surely positions evoluation from "local government" to "local governence" which is in the process of reform into the center of the discussion. The purpose of the study is to reveal comperatively the institutional and functional changes emerging during process of decentralisation and gaining a place in the market in the countries where neoliberal policies are implemented.
Orta Asya'nın kuzey doğu ülkesi olan Kırgız Cumhuriyeti (Kırgızistan), 1990 yılına kadar Sovyet Sosyalist Cumhuriyetler Biriliği'nin (SCCB) bir üye ülkesi idi. 1990'da egemenliğini, 1991'de 31 Ağustos'ta da bağımsızlığını kazanan Kırgızistan'ın ekonomik yapısı, 1990'a kadar SSCB'yi oluşturan ve merkezi ekonomik programla yönetilen diğer devletler gibi sosyalist sistemden liberal ekonomiye geçme çabasına girmiştir. SSCB zamanında birliği oluşturan ülkeler arasında merkezi planlı yönetimin oluşturduğu sistemle karşılıklı ekonomik bir yardımlaşma söz konusuydu. Buna göre, ülkeler ekonomik sektörlerde birbirinin tamamlayıcısı veya müşterisi durumundaydı. Bu dönemde Kırgızistan'da daha çok tarım ağırlıklı üretime ağırlık verilmiştir. Bağımsızlığın ilk döneminden itibaren Kırgızistan'da serbest piyasa ekonomisine geçmek amacıyla Ekonomik Reform Programları uygulamaya koyulmuş, yerel para birimi "Som" tedavüle çıkarılmıştır. Ancak, ilk yıllarda reform programları uygulamada başarılı olamamış, başlangıç koşulları ve ülkenin stratejik öneme sahip doğal kaynaklarının az olmasının da etkisiyle 1990-1995 yılları arasında negatif bir büyüme gerçekleşmiştir. 1996-2000 yıllarında ise Kırgızistan ekonomisinde tarım sektöründeki iyileşme ve sanayi sektörüne yapılan yatırımlarla olumlu bir büyüme gerçekleşmiştir. Dış ticarette, Birleşik Devletler Topluluğu (BDT) ülkeleri başta olmak üzere Avrupa ve Orta Doğu ülkeleriyle ticaret hacmi artmıştır. Kırgızistan'da yapısal reformun başlıca politika aracı özelleştirme olmuştur. Özelleştirme ile serbest piyasa ekonomisinin rekabet ortamını yaratma ve geliştirme hedefinin yanı sıra dünya ekonomisine entegre olacak bir sosyal-toplumsal ortamın oluşturulması da amaçlanmıştır. Reform programları dahilinde Kırgızistan'da stratejik öneme sahip işletmeler dışında kamu kurumlarının neredeyse tamamı çeşitli özelleştirme yöntemleriyle özelleştirilmiştir. Emek piyasasında ise, bağımsızlığın ilk yıllarından itibaren meydana gelen özelleştirme ve üretimin düşüş göstermesinden dolayı istihdam daralması olmuş, işsizlik artmış ve buna bağlı olarak bölgeler arası ve ülke dışına göç meydana gelmiştir. ; Kyrgyz Republic (Kyrgyzstan) which is located in the North-East of Central Asia was a member country of Union of Soviet Socialist Republics (USSR) until 1990. Kyrgyzstan proclaimed its sovereignty in 1990 and the independence on 31st August 1991. The economical structure of Kyrgyzstan, like all of the other governments which were governed by the central system of USSR until 1990, started changing from the socialist system to the liberal system. During the USSR period there was an economical solidarity between the republics. According to this, countries were either complementaries or the customers of each other. At that time Kyrgyzstan concentrated on agricultural production. Beginning from the first period of independency, to pass to free market economy, Kyrgyzstan started applying economical reform programs, so local Money "Som" was put into circulation. But in the first years the reform programs were not applied successfully and because of the beginning conditions and luck of the natural resources, between 1990-1995 there was a negative growth. But between 19962000 there was a positive growth because of the improvement in the agricultural sector and investments in the industry. In the foreign trade, the trading volume of Kyrgyzstan has increased with leading of Commonwealth of Independent States (CIS), European and Middle Eastern countries. In Kyrgyzstan the main politics means of structural reform was privatization. The aim of privatization was not only to create a rivalry atmosphere and develop the free market economy, but also to create a social-societal atmosphere that will be integrated to the world economy. Depending on the reform programs except for some of the strategical institutions almost all of the public institutions were privatized. In the labor marketing, because of the privatizations from the beginning of the independency and the decrease in productivity, unemployment increased and because of this, migrations between the regions and migrations to the other countries started.
Devletin ekonomik ve toplumsal yaşamdaki değişen rolünün kamu yönetimine yansıması olarak değerlendirilen ve yaşamın hassas sektörleri olarak kabul edilen rekabet, bankacılık, enerji, finans, insan hakları ve gıda ve ilaç güvenliği gibi sektör ve alanlarda düzenleme ve denetim yapan bağımsız idari otoriteler, ekonomik,toplumsal ve siyasal yaşamı gün geçtikçe daha fazla etkilemektedirler.Politikacılar ve ilgili oldukları sektördeki aktörlerin karşısında konumlarının güçlendirilmeleri ve söz konusu aktörlerden gelebilecek telkin ve baskılardan izole edilmeleri amacıyla bağımsızlık ile donatılan bağımsız idari otoriteler, sahip oldukları özellikleri, görev ve yetkileri, sorumlulukları, örgütlenmeleri, personeli ve bütçeleri ile idari örgütlenme içerisinde yer alan klasik idari birimlerden farklılık arz etmektedir. Anglo-Sakson yönetim geleneğinde uzun bir tarihsel geçmişe sahip olan bağımsız idari otoriteler, sahip oldukları özellikleri nedeniyle üniter devlet yapısının temel ilke ve prensipleriyle çatışmaktadır. Bu bağlamda, söz konusu kurumlar meşruiyet ve hesap verebilirliklerindeki yetersizlikler açısından eleştirilmektedir.Dolayısıyla, bağımsız idari otoritelerin ülkelerin kendi iç ihtiyaçlarından varlık bulması ve kendine has ilke ve özelliklere göre yapılandırılması gerekmektedir.Türkiye'de bağımsız idari otoriteler Avrupa Birliği'ne üyelik süreçleri veya ekonomik krizlerin atlatılması sürecinde uluslar arası örgütlerin telkini gibi konjonktürel ve zorlayıcı gelişmeler sonucu ortaya çıkmıştır. Türkiye'deki bağımsız idari otoritelerden biri olan ve 2001 yılında benzer süreçler sonrasında oluşturulan Enerji Piyasası Düzenleme Kurumu, özellikleri, görev ve yetkileri, sorumlulukları,örgütlenmesi ve idari ve mali özerklikleri açısından üst düzey bir bağımsız idari otoritedir. ; Independent administrative authorities which are assessed as reflection of thechanging role of state in economic and social area to public administration and whichregulate and audit critical sectors and fields such as competition, banking, energy,finance, human rights and food and drug safety affect the economic, social andpolitical area.Independent administrative authorities are granted independence in order tostrengthen their positions against the politicians and actors in related sectors and to beinsulated from mentioned actors' pressures and instilling. These authoritiesdifferentiate from traditional administrative units in terms of their characteristics,functions and competences, responsibilities, organizational structures, personnel andbudgets.These authorities, which have a long history in Anglo-Saxon administrativetradition, as a result of their unique characteristics, are in conflict with the mainprinciples of the unitary state structure. In this regard, they are criticized in respect oflacks of their legalities and accountabilities. In this study, it is suggested that theseauthorities should base on internal needs of countries and be structured in respect ofprinciples and characteristics peculiar to countries.In Turkey, independent administrative authorities have appeared as aconsequence of some historical developments such as the process of membership ofEuropean Union or instilling of international organizations in process of coping witheconomic crisis. Energy Market Regulatory Authority, which is one of theindependent administrative authorities in Turkey and was established in 2001 aftersimilar process, with its characteristics functions and competences, organizationalstructures and organizational and financial autonomy is a supreme authority.
Dengeli beslenmede oldukça önemli yeri olan zeytinyağı ve sofralık zeytin gerek sahip olduğu özellikler ve gerekse bu sektörde ürünün yetiştirilmesi ve pazarlanması ile uğraşan nüfus itibari ile Türkiye ve Avrupa Birliği'nde önem taşıyan ürünler arasındadır. Bu araştırma ile Türkiye ve AB'nde zeytin ve zeytinyağı sektörünün önemi belirtilmiş ve bu sektör analiz edilerek karşılaştırmalar yapılmıştır. Dünya zeytinyağı üretim ortalaması 1.850 bin ton'dur. Bunun 'lik kısmını AB karşılamaktadır. Diğer üretici ülkeler Tunus, Türkiye ve Fas'tır. Üretim yıldan yıla değişiklik göstermekle beraber dünya pazarını AB etkilemektedir. 1980 öncesi 9 üyeli topluluğun başlıca üretici ülkesi İtalya idi. 1981 'de Yunanistan'ın 1986'da İspanya ve Portekiz'in girişi ile Topluluk zeytinyağı üretimi yılda 1.000.000 ton'un üzerine çıkmıştır. AB'nde Yunanistan, İspanya ve İtalya başlıca üretici ülkelerdir. Bununla birlikte İtalya, aynı zamanda önemli dış alımcı ülkedir. 100 milyona yaklaşan zeytin ağaç varlığı, 90 bin üretici aile ve 1000'den fazla yağhanesi ile Türkiye, dünya zeytin ve zeytinyağı sektörü içinde önemli bir konuma sahiptir. Ancak görünüşte bu önemi belirgin iken, ülkemizin ürünler dünya üretimi ve ticaretinde istenilen konumda olduğunu söylemek güçtür. Bunun nedenleri arasında, üretim düzensizliği son yıllarda ortaya çıkan pazarlama organizasyonundaki olumsuzluklar ile dış ticarete ilişkin politikaların eksikliği ön sıralarda gelmektedir. Karşılaştırmalar sonunda Türkiye ve Avrupa Birliği'nde zeytin ve zeytinyağı sektöründe genel yapı, dış ticaret ve destekleme politikalarında bazı benzerlikler yanında önemli farklılıkların olduğu da tesbit edilmiştir.Bunun içinde öncelikle sektörde yapısal iyileştirmelerin sağlanması gerekmektedir. Türk zeytin ve zeytinyağı sektörünün geleceği, mevcut destekleme politikalarının gözden geçirilmesinin yanı sıra üretimdeki yıllık dalgalanmaları önleyecek tedbirlerin alınması ve sektördeki teknolojinin yenilenerek uluslararası standartlara uyumlaştırılması ile Türk zeytin ve zeytinyağlarının tanıtımının sağlanmasına bağlı olacağı sonucuna varılmıştır. ; Olive oil and table olive, owing to its important place in human nutrition has a significant place in Turkey and in the European Union. In this study, olive and olive oil sector has determined to important and analysed as comparative for Turkey and for the European Union. Average world production is some 1.850.000 tonnes, of which 80% comes from the European Union. The other producers are Tunusia, Turkey and Morocco. Production varies considerably from one year to another, but the world market fluctuates as a direct result of the Community market. In the early 1980 s, when the Community had nine Member States, Italy was the main producer. With the entry Greece in 1981, followed by Spain and Portugal in 1986, olive oil production to over a million tonnes a year. Greece and Spain normally the main suppliers and Italy, although on exporting producer, remains the main purchaser. Turkey has a very important position in the world olive oil sector with almost 100 million olive trees, 90.000 families, that grow olives as their sole crop and over 1000 olive oil processing plants. This importance is clear in terms of the physical wealthy it represents. However, it is not so apparent. In terms of Turkish olive oil production and exports. At first, this was because there were significant problems in production amongst other things. More recently, inadequate marketing organisation and foreign trade policy measures were the main reasons. Under the light of the comparisons, it is concluded that there are significant differences as well as a few similarities in the general formation and the foreign trade policies, in the support policies for olive and olive oil sector in Turkey and the European Union. Therefore, primarly, certain precautions mentioned in the study should urgently be taken to better and promote sector, Future of the olive and olive oil sector depends or to be modernize and existing support policies must be scrutinized besides preventive precautions must taken for years of roughness for productions. Aim of the olive and olive oil of Turkey is to introduced as like international Standard and working for promotions must be important.
Bu çalışmanın amacı Türkiye'de hisse senedi fonları piyasasının etkin bir şekilde çalışıp çalışmadığı, Bireysel Emeklilik Sistemi (BES)'teki fonların ve bankalarla ilişkili fonların diğer fonlara kıyasla performans farkına sahip olup olmadığının incelenmesidir. Araştırma kapsamında 2010-2022 döneminde 115 fona ait veri kullanılmıştır. Aylık frekansta fonların getirileri, standart sapmaları ve Sharpe oranları hesaplanarak birbiriyle kıyaslanmıştır. Araştırma bulgularına göre bankalarla ilişkili portföy yönetim şirketleri ve BES'teki fonlar bağımsız fonlara kıyasla daha düşük performansa sahip olmakta ve fon yönetim performanslarından bağımsız olarak müşterilere ulaşabilmekte ve fonlarını oldukça yüksek büyüklüklere ulaştırabilmektedirler. Araştırma sonuçları Türkiye'de hisse senedi fonları piyasasının etkin bir şekilde çalışmadığını ve bağımsız portföy yönetim şirketleri aleyhine bir yapının söz konusu olduğunu ortaya koymaktadır.
Toplu pazarlığın geliştiği piyasa ekonomisine sahip İngiltere, Amerika Birleşik Devletleri, Kanada, Japonya, İsveç, Federal Almanya, Fransa ve İtalya gibi sanayileşmiş ülkelerde toplu iş sözleşmesinin taraf iradeleri dışında oluşmasının incelenmesinin nedeni, bu ülkelerin kendilerine özgü farklı kurumsal düzenlemelere sahip olmakla birlikte sosyal, politik ve ekonomik alanda bazı unsurları ortaklara paylaşmaları ve model olabilme niteliğine sahip olmalarıdır. Batıda toplu iş sözleşmesi özerkliğine devlet tarafından müdahale edilemeyeceği ve çalışma koşullarının düzenlenmesinin tarafların karşılıklı iradesine bırakılması gerektiği kabul edilmektedir. Ancak, pek çok ülkede devletin zaman zaman geçici veya kalıcı olarak toplu iş sözleşmesi özgürlüğüne müdahale ederek taraflar arasında doğan çıkar uyuşmazlıklarında greve izin vermediği ve toplu iş sözleşmesinin tarafların özgür iradesi dışında bir üçüncü kişinin iradesi ile oluştuğu da görülmektedir. ; The reason for studies on formation of collective agreements without party wills in industrialized market economy countries with developing collective agreement concept, such as England, USA, Canada, Japanese, Sweden, Germany, France and Italy is that; although each of them have specific institutional regulations, they share some common elements in politic and economic sense and they carry the nature of being a model in their capacity. In western countries the leading opinion is that the governments shall not interfere in the autonomy of collective agreements and that the regulation of working conditions must be left to the mutual wills of the parties. On the other hand in many countries governments occasionally intervene the freedom of collective agreements in temporary and permanent means by way of not leaving the disputes lead up to strikes and occasions happen when collective agreements are concluded by will of a third person other than the parties.
Helal Gıda Sertifikası Türkiye'de 2005 senesinden itibaren uygulanmaya başlayan bir sertifikalama süreci olup o günden bu yana farklı platformlarda ve konu başlıklarıyla tartışılmaktadır. Bu çalışmanın konusunu da bu tartışma başlıklarından birisi olan Helal Gıda Sertifikası Türkiye iç piyasasında uygulanmalı mıdır? sorusu oluşturmaktadır. Bu çalışmada, canlı bir televizyon programında HGS'yi savunan ve karşısında olan tarafların argümanları, Fairclough ve Fairclough'a ait olan Politik Söylem Analizi metodu ile analiz edilerek "iki taraf arasında uzlaşma zemini için bir içgörü oluşturulabilir mi" sorusuna cevap aranacaktır. Helal Gıda Sertifikası dini bir kavramdan türemiş olsa da taraflar arasındaki tartışma daha çok insan hakları ve kutsal bir kavramın pazarlaştırılması konu başlıklarına odaklanmaktadır. Tarafların gerek din ve dünya görüşleri gerekse teknik ve bilimsel altyapıları çok farklı olduğu için derin bir anlaşmazlık içinde görünseler de, aralarında bir uzlaşı zemininin sağlanabileceği mümkün görünmektedir. ; Halal Food Certification is a certification process that has been implemented since 2005 in Turkey and it is discussed on different platforms and with topics since then. The subject of this study is, one of the discussion topics of "Halal Food Certification" that whether it should be implemented in the domestic market in Türkiye or not? In this study, the arguments of the parties arguing and opposing HGS in a live television program will be analyzed with the Political Discourse Analysis method of Fairclough and Fairclough (2012), and it will be searched that whether it is possible to create insight for the ground for a compromise between the two parties? Although the Halal Food Certificate is derived from a religious concept, the discussion between the parties is mostly focused on human rights and the marketization of a sacred concept. Although the parties seem to be in deep disagreement due to their very different religious and world views, as well as their technical and scientific infrastructures, it seems possible that a compromise ground can be established.
