The article is devoted to the consideration of the complex issue of the reasons for the «delay» of political transit in the post-Soviet countries in general and in Ukraine in particular. The main author's hypothesis is the assumption that it is the activities of differently motivated subjects (inhibitors and innovators) in combination with the fundamental features of the cultural background of a particular country that determine the pace, overall trajectory and intermediate results of the democratization process. Particular attention is paid to the discussion around the question of whether transit is the only evolutionary trajectory or can be interpreted as a number of alternative directions of progress towards the standards of democratic governance. The object of this article is the features of the socio-political transformation of the post-Soviet countries. In turn, the subject of the article arises a ratio of the socio-political activity of innovators and inhibitors that is unique in national conditions, which directly affects the content and results of the democratic transition. The complex nature of the central research problem presupposes the use of an appropriate methodology, the central place in which is occupied by: a systemic approach, comparative and structural-functional methods, institutional analysis. From the author's point of view, it is this arsenal of methods and research procedures that helps to clarify the nature of the negative results of the socio-political transformation of the transit process in such post-Soviet countries as Ukraine. An analysis of the characteristic features of socio-political transformation in Ukraine indicates that the elite is motivated to conserve political informal practices and postpone changes in any way, and imitation reforms act as a legitimizer of the elite in the eyes of Western investors, creating a positive reputation for progressive reformers for its representatives. The migration of reformers from the state of innovators to the state of inhibitors is due to their desire to become an elite in order to extract economic rent with the help of power. The idea is substantiated that the way out of the vicious circle of quasi-substitution of the elite is associated with the painstaking work of the real supporters of reforms to diagnose the vulnerable elements of the national trajectory of democratization and education of new generations - carriers of innovative types of thinking and supporters of values and procedures of democracy. ; Статья посвящена рассмотрению комплексного вопроса причин «запаздывания» политического транзита в постсоветских странах в целом и в Украине в частности. Основной авторской гипотезой выступает предположение о том, что именно деятельность разно мотивированных субъектов (ингибиторов и инноваторов) в сочетании с фундаментальными особенностями культурного бэкграунда конкретной страны определяют темпы, общую траекторию и промежуточные результаты процесса демократизации. Особое внимание уделяется дискуссии вокруг вопроса о том, является ли транзит единственной эволюционной траекторией или может быть интерпретирован как ряд альтернативных направлений продвижения к стандартам демократического управления. Объектом данного исследования выступают особенности социально-политической трансформации стран постсоветского пространства. В свою очередь, предметом статьи служит уникальное в национальных условиях соотношение социально-политической активности инноваторов и ингибиторов, которое непосредственно влияет на содержание и результаты демократического транзита. Комплексный характер центральной проблемы исследования предполагает использование соответствующей методологии, центральное место в которой занимают: системный подход, компаративный и структурно-функциональный методы, институциональный анализ. С точки зрения автора, именно такой арсенал методов и исследовательских процедур помогает выяснить природу негативных результатов социально-политической трансформации транзитного процесса в таких странах постсоветского пространства как Украина. Анализ характерных особенностей социально-политической трансформации в Украине свидетельствует о том, что элита мотивирована на консервацию политических неформальных практик и откладывание изменений любым путем, а имитационные реформы выступают в роли легитимизатора элиты в глазах западных инвесторов, создавая её представителям положительное реноме прогрессивных реформаторов. Миграция реформаторов из состояния инноваторов в состояние ингибиторов обусловлена их стремлением стать элитой с целью извлечения с помощью властных полномочий экономической ренты. Обосновывается мысль о том, что выход из порочного круга квази-замещения элиты связан с кропотливой работой настоящих сторонников реформ по диагностике уязвимых элементов национальной траектории демократизации и воспитанию новых поколений – носителей инновационных типов мышления и сторонников ценностей и процедур народовластия. ; Стаття присвячена розгляду комплексного питання причин «запізнювання» політичного транзиту у пострадянських країнах в цілому та в Україні, зокрема. Об'єктом даного дослідження виступають особливості соціально-політичної трансформації країн пострадянського простору. В свою чергу, предметом дослідження постає унікальне в національних умовах співвідношення соціально-політичної активності інноваторів та інгібіторів, яке безпосередньо вливає на зміст та результати демократичного транзиту. Комплексний характер центральної проблеми дослідження передбачає використання відповідної методології, центральне місце в якій посідають: системний підхід, компаративний та структурно-функціональний методи, інституційний аналіз тощо. З точки зору автора, саме такий арсенал методів та дослідницьких процедур допомагає з'ясувати природу негативних результатів соціально-політичної трансформації транзитного процесу в таких країнах пострадянського простору як Україна. Аналіз характерних особливостей соціально-політичної трансформації в Україні свідчить про те, що еліта мотивована на консервацію політичних неформальних практик і відкладання змін будь-яким шляхом, а імітаційні реформи виступають в ролі легітимізатора еліти в очах західних інвесторів, створюючи її представникам позитивне реноме прогресивних реформаторів. Міграція реформаторів зі стану інноваторів в стан інгібіторів обумовлена їх прагненням стати елітою з метою вилучення за допомогою владних повноважень економічної ренти. Обґрунтовується думка щодо того, що вихід із порочного кола квазізаміщення еліти пов'язаний із копіткою роботою справжніх прихильників реформ з діагностування уразливих елементів національної траєкторії демократизації і виховання нових поколінь – носіїв інноваційних типів мислення та прихильників цінностей та процедур народовладдя.

This special date makes us go back in history and, first of all, pay tribute to the personalities thanks to whom modern University attracts young people as a symbol of scientific progress, freedom of thought, respect for the national and world culture and intellect.With no risk to forget mentioning individuals who were involved in the development of Lviv University, the first and the main mention should be about Ivan Franko – a genius of the Ukrainian people, a world-level intellectual thanks to whom "Moloda Ukrayina" ("Young Ukraine") was born in the history of our culture asthe objectivization of the national existence. In one individual the world granted Ukraine a brilliant poet, publicist, literary scholar, philosopher, economist, politician, public figure who was brave enough not just to be believe in, but also to write about independence, freedom, and self-identity of Ukrainians – "not those of Halychyna, Bukovyna, not rusyns, but Ukrainians with no official borders".Ivan Franko's papers dedicated to economic problemsin the life of Ukrainians at the turn of the past centuries were included into a separate volume of the writer's works collection in fifty volumes. The problems Ivan Franko was most interested in within this fields were economic status of Ukrainians of the then Halychyna within theAustro-Hungarian Empire. Realizing, as a scholar, the secondary role ofthe political and property status of his people in the foreign country, Franko-poet, public figure would not give up believing and writing about the unavoidability of national renaissance, political and economic freedom. This faith keeps inspiring his fellow countrymen for the search of the new national idea and its implementation up till now.The year 2021 is a jubilee year for the Faculty of Economics of Lviv University. Founded in 1966 in response to the then need for training professionals in mathematical methods for economics, planning and management, now it is one of the largest structural units of Lviv University. The article analyzes the three stages of the migration of the German ethnic group into the territory of modern Ukraine, different in nature, character and orientation, and their features are clarified. The author reveals the geography of the first migratory flows of the Goths in the second half of the IIcentury, which went from the Wisla delta to Scythia, and were divided into the western (settled on the right bank of the Dnieper) and eastern. The latter, having settled down near the Sea of Azov, founded the state of Germanarich, and in the IV century, under the pressure of the Huns, the center of life of Goths moved to the Kerch Peninsula, the mountainous region of Crimea, where their state association Gothia existed until the XVIIIcentury. It turns out that in the early Middle Ages there was a second wave of German settlements on modern Ukrainian lands from the West European direction. The expansion of the settlements of Germans and immigrants from other European countries on the lands of Kievan Rus was facilitated by political relations, which were also realized with the help of dynastic marriage unions. The princes of Kiev, pursuing a foreign policy worthy of a great power, have equal relations with the main European states of the medieval world - the Holy Roman Empire (Germany) and Byzantium, they invite priests, German craftsmen and merchants. Starting from the XIcentury, small German trade colonies appeared in Kiev, Vladimir-Volynsky, Lutsk and other cities. During the Lithuanian-Polish period, the influx of German settlers to Ukrainian lands is increasing. This was facilitated by various benefits and provision of points to the German immigrants by Lithuanian princes and Polish kings. In the fourteenth and fifteenth centuries, Magdeburg law was acquired by large trading cities. The third period, the most significant resettlement and colonization, that is, large-scale development of the South of Ukraine - the Sea of Azov, the Black Sea region and the lands of Crimea - begins in the second half - the end of the 18th century. The author emphasizes that this most powerful period and the great positive history of the development of our region is largely connected with immigrants of German origin (and representatives of other ethnic groups). This period becomes a powerful colonization and economic development of the entire South of Ukraine, the rich land of the Azov, Black Sea, Crimea. It is noted that then, on the initiative and real support of the government of tsarist Russia, the development of wide steppe spaces took place, which, together with Ukrainian lands, had recently been transferred to the Russian Empire. Since then, the history of immigrants has become part of the history of the Ukrainian people. The dynamics of the development of German colonies in different provinces of the South of Russia is analyzed separately, the social aspects of the life of settlements, the grave consequences for the colonists associated with the First World War, and revolutionary events in the Russian Empire are indicated. The gains and losses in the national development, in the arrangement, in the administrative division of the German and other settlers, which were the consequences of radical fluctuations in the national policy of the Soviet government in the pre-war period, are revealed. ; У статті проаналізовано різні за природою, характером і направленістю три етапи переселень німецького етносу на територію сучасної України, з'ясовуються їх особливості. Автором розкривається географія перших міграційних потоків племен готів у другій половині ІІст., які йшли від дельти Вісли аж до Скіфії, та розділились на західних (що розселилися на правобережжі Дніпра) та східних. Останні, облаштувавшись біля Азовського моря заснували державу Германаріха, а у ІVст. під тиском гунів центр життя готів переходить на Керченський півострів, гористу місцевість Криму, де їх державне об'єднання Готія існувало до ХVІІІст. З'ясовується, що у ранньому Середньовіччі відбувається друга хвиля поселень німців на сучасні українські землі із західноєвропейського напрямку. Розширенню поселень німців та вихідців із інших країн Європи на землях Київської Русі сприяли політичні відносини, які реалізовувалися також і за допомогою династичних шлюбних союзів. Київські князі проводячи гідну великої держави зовнішню політику, мали рівноправні відносини з головними європейськими державами середньовічного світу – Священною Римською імперією (Німеччиною) і Візантією, вони запрошували священників, німецьких майстрів і торговців. Починаючи з ХІст. з'являються невеликі німецькі торговельні колонії в Києві, Володимирі-Волинському, Луцьку й інших містах. За литовсько-польської доби посилюється приплив німецьких поселенців на українські землі. Цьому сприяли різні пільги й надання магдебурзького права німцям-переселенцям литовськими князями та польськими королями. У ХIV-ХVст. магдебурзьке право отримують великі торговельні міста. Третій період, найістотніше переселення й колонізація, тобто масштабне освоєння Півдня України – Приазов'я, Причорномор'я та земель Криму – починається від другої половини – кінця ХVІІІст. Автор підкреслює, що це був найпотужніший період та велика позитивна історія розвитку нашого краю багато в чому пов'язана з переселенцями німецького походження (і представниками інших етносів). Даний період стає потужною колонізацією та господарським освоєнням всього Півдня України, багатих земельних угідь Приазов'я, Причорномор'я, Криму. Наголошується, що тоді за ініціативи й реальної підтримки уряду царської Росії відбулося освоєння найширших степових просторів, які разом із українськими землями недавно відійшли до Російської імперії. Відтоді історія переселенців стає частиною історії українського народу. Окремо аналізується динаміка розвитку німецьких колоній у різних губерніях Півдня Росії, вказується на соціальні аспекти життя поселень, тяжкі наслідки для колоністів пов'язані з Першою світовою війною, революційними подіями у Російській імперії. З'ясовано здобутки і втрати у національному розвитку, в облаштуванні, адміністративному поділі німецьких та інших поселенців, що були наслідками радикальних коливань національної політики радянської влади у довоєнний період.
The article is devoted to the problem of dangers faced by Ukrainians in the diaspora today. In addition to global challenges (environmental, energy, financial, resource, migration, etc.), there are specific threats to the spiritual and religious life of mankind, including and Ukrainians. Largescale secularization and dehumanization of the world is dangerous for everyone. People are at risk of losing their cultural, ethno-national and religious identity. These processes are especially threatening for those who living outside their country of origin, in the diaspora, where the connection with the motherland is rapidly lost. The author analyzes the problems experienced by the current Ukrainian diaspora. Among them are 1) historical problems that date back to the first wave of emigration, which were only exacerbated during the next, second, third and fourth; 2) psychological, which are determined by the nature of Ukrainians; 3) socio-economic, which determine the social status of members of the diaspora; 4) political, exacerbating the heterogeneity of the Ukrainian diaspora environment; 5) cultural, which on the one hand ensure the entry of Ukrainians into global culture, and on the other – preserve them as a relatively autonomous ethnic group. But there are also religious challenges associated with the general dereligiousization of modern society. Secularized Ukrainians who migrate from Ukraine, where they have not been attached to religious traditions and have been brought up in a non-religious spirit, do not become members of Ukrainian churches abroad. The number of Ukrainian believers in the diaspora is declining. In addition, Russian Orthodox structures operating outside Russia are actively dragging Ukrainians into their communities, eroding their own Ukrainian identity. Ukrainian Greek Catholics are being denationalized and deconfessionalized too. The Protestant churches, which unite religious emigrants from the former Soviet republics, are dominated by the Russian component, which influences the original ethno-religious identity of Ukrainians. Taken together, these dangers pose a question of existential importance to Ukrainians in the diaspora – whether Ukrainians in the diaspora will survive as a valuable part of global humanity, as an integral element of World's Ukrainians, as the citizens of the respective state and the members of civil society. ; Посвящено проблеме безопасности, сопряженной с угрозами, перед которыми стоят украинцы в диаспоре в наше время. Кроме глобальных вызовов (экологические, энергетические, финансовые, ресурсные, миграционные и т. д.), существуют угрозы для духовной и религиозной жизни человечества, в том числе и украинцев. Масштабная секуляризация и дегуманизация мира опасна для всех. Люди оказались перед угрозой потери своей культурной, этнонациональной и религиозной идентичности. Особенно эти процессы угрожающие для тех, кто проживает за пределами страны своего происхождения, в диаспоре, где связь с материнской землей стремительно теряется. Проанализированы проблемы, которые переживает нынешняя украинская диаспора, а именно: 1) исторические проблемы, тянущиеся со времен первой волны эмиграции и которые только усилены во время второй, третьей и четвертой; 2) психологические, зависящие от национального характера украинцев; 3) социально-экономические, определяющие общественный статус членов диаспоры; 4) политические, обостряющие неоднородность украинской диаспорной среды; 5) культурные, которые с одной стороны обеспечивают вхождение украинцев в глобальную культуру, а с другой – сохраняют их как относительно автономную этническую группу. Но существуют и религиозные вызовы, связанные с общей дерелигиезацией современного общества. Секуляризованные украинцы мигрируют из Украины, где они не были приобщены к религиозным традициям и воспитывались в соответствующем нерелигиозном духе, не становятся прихожанами украинских церквей за рубежом. Количество верующих украинцев в диаспоре постоянно уменьшается. Кроме того, русские православные структуры, действующие за рубежом России, активно перетягивают украинцев в свои общины, размывая собственно украинскую идентичность. Испытывают денационализацию и деконфесионализацию украинские греко-католики. В протестантских церквях, объединяющих верующих эмигрантов из бывших республик СССР, преобладает русский компонент, влияющий на первоначальную этнорелигиозную идентичность украинцев. Во всей своей совокупности эти опасности ставят перед украинцами диаспоры вопрос экзистенциального характера – выживут ли украинцы в диаспоре как самоценная часть глобального человечества, как составной элемент мирового украинства, как граждане соответствующего государства и члены гражданского общества. ; Присвячено проблемі небезпек, перед якими постають українці в діаспорі в наш час. Крім глобальних викликів (екологічні, енергетичні, фінансові, ресурсні, міграційні тощо), існують специфічні загрози для духовного і релігійного життя людства, зокрема й українців. Масштабна секуляризація і дегуманізація світу є небезпечною для всіх. Люди опинилися перед загрозою втрати своєї культурної, етнонаціональної і релігійної ідентичності. Особливо ці процеси загрозливі для тих, хто проживає за межами країни свого походження, у діаспорі, де зв'язок із материнською землею стрімко втрачається. Проаналізовано проблеми, що переживає нинішня українська діаспора, зокрема: 1) історичні проблеми, що тягнуться із часів першої хвилі еміграції, і були тільки підсиленні під час другої, третьої та четвертої; 2) психологічні, що визначаються характером українців; 3) соціально-економічні, що визначають суспільний статус членів діаспори; 4) політичні, що загострюють неоднорідність українського діаспорного середовища; 5) культурні, що, з одного боку, забезпечують входження українців до глобальної культури, а з іншого – зберігають їх як відносно автономну етнічну групу. Проте існують і релігійні виклики, що пов'язано із загальною дерелігієзацією сучасного суспільства. Секуляризовані українці, які мігрують з України, де вони не були долучені до релігійних традицій і виховувалися у відповідному нерелігійному дусі, не стають прихожанами українських церков за кордоном. Кількість віруючих українців у діаспорі зменшується. Крім того, російські православні структури, що діють за кордонами Росії, активно перетягують українців у свої громади, розмиваючи власне українську ідентичність. Зазнають денаціоналізації і деконфесіоналізації українські греко-католики. У протестантських церквах, що об'єднують віруючих емігрантів із колишніх республік СРСР, переважає російський компонент, що впливає на первісну етнорелігійну ідентичність українців. В усій своїй сукупності ці небезпеки ставлять перед українцями діаспори питання екзистенційної ваги – чи виживуть українці в діаспорі як самоцінна частина глобального людства, як складовий елемент світового українства, як громадяни відповідної держави і члени громадянського суспільства.
The article deals with organizational and procedural problems of the translator's participation in criminal proceedings, problems of certification in the competence of the translator, possible unintentional translation errors during criminal proceedings.Implementing the guarantee of legal protection enshrined in international law for participants of criminal proceedings who do not speak the language of the judiciary, the Criminal Procedure Code of Ukraine designed a special institute of translator. If the relevance of the study of this institute has not recently been considered as one of the priority tasks of the science of criminal process, the situation has changed considerably in the current realities. In addition to the many different nationalities that have long resided on the territory of Ukraine, in recent decades there has been another reason for the actualization of the Institute of Translators, namely, mass migration processes. As one of the integral consequences of the great political reforms of the end of the last century, caused the change of the political map of the world, as well as the development of foreign economic activity, these processes attracted many migrants to our country. At the same time, the psychology and mentality of some categories of migrants who come to Ukraine influences their initiation of illegal activities.According to Part 3 of Art. 29 of the Criminal Procedure Code of Ukraine (hereinafter referred to as the CPC of Ukraine) the investigating judge, court, prosecutor, investigator shall provide the participants of criminal proceedings who do not speak or speak the state language with the right to testify, petition and file complaints, to speak in their native or other language. which they own using the services of a translator in the manner prescribed by the CPC of Ukraine.On the basis of this article it is possible to formulate certain conclusions about the participation of the translator in the criminal process of Ukraine.1. At present, science has worked out all the characteristics that a translator must possess in the criminal process: fluency in language, age and conviction, competence and lack of interest in the case. At the same time, these features expand and specify the relevant provisions of the CPC of Ukraine.2. The CPC of Ukraine identifies two possible reasons for a translator's involvement in a criminal proceeding: "not speaking the language" or "insufficient command of the language used in the proceedings" by the criminal proceedings. However, these categories are formally vague and may include several levels of language proficiency that are not practically possible to establish.3. The CPC of Ukraine sets out in detail the rights, duties and responsibilities of the translator, who determine his place in the criminal process and characterize him as a full-fledged subject of criminal procedural law.Thus, it is obvious that the participation of an interpreter in itself violates the usual course of criminal justice, since its participants, who do not speak a foreign language, depend on the interpreter; in addition, there are a number of factors that complicate the latter, described in this chapter.• search for a translator who speaks the required language or dialect;• selection of a translator of the required gender;• exclusion of the possibility of procedural incompetence of the translator;• transportation of the translator to the place of carrying out a specific procedural action / or carrying out of these actions in the territory of the expert translation body;• timely payment for translator services;• formation of a base of incompetent translators or translators who have violations while participating in criminal proceedings, etc. ; У статті розглядаються організаційні та процесуальні проблеми участі перекладача у кримінальному провадженні, проблеми засвідчення компетенції перекладача, можливі ненавмисні помилки перекладу під час кримінального провадження. Реалізуючи гарантію правового захисту, закріплену в міжнародному праві для учасників кримінального провадження, які не володіють мовою судової влади, Кримінальний процесуальний кодекс України розробив спеціальний інститут перекладача. Якщо актуальність дослідження цього інституту останнім часом не розглядалася як одне з пріоритетних завдань науки про кримінальний процес, ситуація значно змінилася в сучасних реаліях. Окрім безлічі різних національностей, які тривалий час проживали на території України, в останні десятиліття з'явилася ще одна причина актуалізації Інституту перекладачів, а саме - процеси масової міграції. Однією з цілісних наслідків великих політичних реформ кінця минулого століття, спричинених зміною політичної карти світу, а також розвитком зовнішньоекономічної діяльності, ці процеси залучили до нашої країни багато мігрантів. У той же час психологія та менталітет деяких категорій мігрантів, які приїжджають в Україну, впливають на їх ініціювання незаконної діяльності. Відповідно до ч. 3 ст. 29 Кримінально-процесуального кодексу України слідчий суддя, суд, прокурор, слідчий надають учасникам кримінального провадження, які не розмовляють або не володіють державною мовою, право на свідчення, клопотання подавати скарги, розмовляти рідною чи іншою мовою. якими вони володіють, користуючись послугами перекладача у порядку, визначеному КПК України. На основі цієї статті можна сформулювати певні висновки щодо участі перекладача у кримінальному процесі України. 1. В даний час наукою розроблені всі характеристики, якими повинен володіти перекладач у кримінальному процесі: вільне володіння мовою, вік та переконаність, компетентність та відсутність інтересу до справи. У той же час ці особливості розширюються та конкретизуються відповідні положення КПК України. 2. КПК України визначає дві можливі причини участі перекладача у кримінальному провадженні: "не володіє мовою" або "недостатнє володіння мовою, якою використовується у провадженні" у кримінальному провадженні. Однак ці категорії формально розпливчасті і можуть включати кілька рівнів володіння мовою, які практично неможливо встановити. 3. КПК України детально викладає права, обов'язки та відповідальність перекладача, які визначають його місце в кримінальному процесі та характеризують його як повноцінного суб'єкта кримінального процесуального права. Таким чином, очевидно, що участь перекладача сама по собі порушує звичайний хід кримінального судочинства, оскільки його учасники, які не володіють іноземною мовою, залежать від перекладача; крім того, існує ряд факторів, які ускладнюють останні, описані в цій главі. Тому очевидно, що для оптимізації процесу кримінального судочинства в Україні для створення проблем необхідно створити спеціальний експертний орган з перекладу. пошук перекладача, який розмовляє потрібною мовою чи діалектом; вибір перекладача необхідної статі; виключення можливості процесуальної некомпетентності перекладача; транспортування перекладача до місця здійснення конкретної процесуальної дії / або проведення цих дій на території експертного органу з перекладу; своєчасна оплата послуг перекладача; формування бази некомпетентних перекладачів або перекладачів, які мають порушення під час участі у кримінальному провадженні тощо.

Among the countries whose experience is of particular importance for Ukraine is the Federal Republic of Germany (Germany).Recent research and publications analysis. Germany's experience in administrative reforms has been thoroughly researched. Among many researchers, one can distinguish J. Bogumil, S. Grohs, S. Kuhlmann, W. Jann, G. Banner, H. Biermann, Ch. Scheele. Nevertheless, both experience and analysis have not yet been sufficiently reflected in Ukrainian scientific and expert literature.Highlighting previously unsettled parts of the general problem. The purpose of this article is to highlight the experience of administrative reforms at the municipal level of Germany in order to take them into account when planning and carrying out further reforms in Ukraine.Paper main body. Administrative reforms (this applies not only to Germany) can be divided into two types: 1) administrative-territorial reforms, that is, changing the boundaries of territorial units (usually a change to a larger territory) and, accordingly, the structure of community management, and 2) administrative reforms as a change of the principles of the administrative apparatus functioning, a change of the attitude of administrative structures to their management tasks.To cover administrative-territorial reforms, we limit ourselves to the experience of Mecklenburg-Western Pomerania, one of the economic weak German Lдnder with 1,6 million inhabitants, and to describe qualitative changes we use the experience of implementing the "new governance model" (NSM).Since 1990, two administrative-territorial reforms have been implemented in Mecklenburg-Vorpommern. The number of districts decreased from 31 to 6, and the number of independent cities from six to two. Each district is made up of communities governed by either joint or autonomous executive bodies. Today, the land consists of 756 communities (1,118 in the early 1990s). In addition to the two free cities (Rostock, Schwerin), another 38 of these communities are capable enough to hold their own executive bodies. 716 communities have combined governance structures and created 76 executive bodies. The consolidation of districts optimized the management structure, but, in practice, did not lead to a reduction in the costs of maintaining the administrative apparatus as a whole. Because the civil servants were not dismissed during the reform and – later on – by an increase of administrative tasks (for example caused by news European laws and by the migration crises)the number of civil servantswere kept up – at least – on the same level, also the number of office-buildings.The NSM was developed in 1988 – 1991 by the Kommunale Gemeinschaftsstelle, based on NPM.The evaluation of the implementation of this model has given some controversial results. In general, the ideas of this model were positively accepted and more than 92% of the municipal government implemented some of the provisions of this model in their activities, but only 15% used this model for comprehensive reform. In no community NSM has been fully implemented. Hierarchical dependence has decreased, 77% of communities have reduced the number of managerial cores, but the number of staff providing administrative services has increased by 36%. It turns out that communities are not inclined to compete with each other, and the cost of reform sometimes exceeds the benefit. Medium-sized cities were most prone to reform, while others were more likely to wait. Professionalism of public servants, quality of administrative services increased – because of better specialization in bigger administrative units-, but at the same time budget deficits increased too.Conclusion of the research and prospects for further studies. What conclusions can be drawn from German reforms in view of Ukraine's reforms? Reforms are needed. Even welfare countries such as Germany are forced to carry out reforms to meet the demands of the times. Administrative-territorial reforms alone are insufficient concerning the costs and should be accompanied by qualitative changes in administrative processes, for example digitalization of administrative bodies or an evaluation of administrative tasks (to reduce tasks or to delegate it to the private sector). At the same time, one should not expect a conceptual change in the management model. The time-tested model of bureaucracy by M. Weber is a more reliable basis for reform than "new" fashion concepts that broaden discourse but do not take into account the functional features of governing institutions. Reforms are not a one-time act, they do not end with the adoption of a law or a change in the administrative-territorial structure, it is a constant process of improvement and work on deficiencies.Good governance is expensive. Reforms do not lead to budget savings (if there is no quantitative and qualified change). It promotes their efficient use, improves the quality of work of public servants, but does not reduce costs. As a result of the reforms, a large part of the settlements will cease to be administrative centers and therefore some communities suffer economic losses. Mechanisms to compensate for these losses need to be developed. Reforms must be legitimate. Citizens need to understand the nature of the reforms, their consequences, recognize their need and should be one part of the process. So the reforms have to communicated very well. Priority should be given to the quality of administrative service delivery, not to the "management vertical". Reforms should bring public administrations closer to people, not to increase the distance between citizens and public administration. Any reforms have drawbacks; a reform is no "miracle cure" to improve the work of public administration. The existence of some drawbacks cannot be grounds for rejection of reforms, but should lead to further improvement. ; Розглянуто досвід адміністративних реформ у Німеччині в контексті його використання в Україні. The scrupulous and compulsory observance and implementation of the norms adopted in a civilized society is the key to the stable development of the state, therefore the consolidation of efforts to strengthen the rule of law and order is a paramount task of all the state and governmental institutions. Implementation by the state of administrative functions in the field of justice is the vector that determines the course and direction of actions for the development of Ukrainian statehood.Recent research and publications analysis. Such researchers as I. Artemenko, N. Zhelezniak, Y. Melnyk, I. Mykulets, L. Nalyvaiko, I. Onopchuk, S. Thurin et al. in their scientific works raised the questions dedicated to the main principles of public administration in the field of justice. However, their publications mainly reflect only certain aspects of the concept of justice, legal status of justice bodies and peculiarities of public administration in the mentioned area, while complex approach to understanding of the problems of organizational and legal principles of public administration in the field of justice of Ukraine is not disclosed.Highlighting previously unsettled parts of the general problem. The purpose of this article is to evaluate theoretical approaches to understanding the essence of organizational and legal foundations of public administration in the field of justice of Ukraine, to analyze the activities and powers of the main authorities in the field of justice and to present proposals for development of Ukrainian justice in general.Paper main body. The article considers theoretical approaches to understanding the essence of organizational and legal principles of public administration in the field of justice of Ukraine. It is determined that administration in the field of justice should be understood as activities aimed at fulfillment of tasks of organizational nature for exercise of rights and interests of legal entities, individuals and the state, as well as the task of strengthening the law and order in the country. Specific features inherent in the administration of justice are considered, their characteristics are presented.Emphasis is placed on the fact that one of the peculiarities of justice is the plurality of objects in this area of administration. Such objects of justice as judicial institutions, notary offices, civil registration bodies, forensic institutions and the bar are presented for consideration. It was also notes, that they all have different legal status, differ in their purpose and nature of competence.Attention was focused on the organizational aspect of the activities of the judicial bodies, since in most cases they address organizational issues. It is argued that this feature is characterized by the fact that the vast majority of judicial bodies in the course of their activity is independent and carry out actions that are advisory.It was substantiated that the organizational aspect of functioning of judicial bodies is closely related to the legal one, since statutory instruments are the basis for functioning of institutions providing law and order in the society. It was noted that the main purpose of administration in the field of justice is to ensure the legality, organization of protection of rights and legitimate interests of individuals and legal entities, as well as the state. Administrative and legal regulation in the field of justice is carried out on the basis of the following statutory instruments: the Laws of Ukraine "On Notaries", dated September 02, 1993, "On the Bar and Advocacy", dated December 19, 1992, "On State Registration of Civil Status Acts", dated July 01, 2010, "On Bodies and Persons Who Perform the Enforcement of Court Decisions and Decisions of Other Authorities", dated June 02, 2016, Regulation on the State Migration Service of Ukraine, dated September 20, 2014, etc.The interrelation between organizational and legal aspects of the public administration in the field of justice is presented; it is noted that this interrelation can be traced on the example of the Ministry of Justice of Ukraine. It is noted that, along with the Ministry of Justice, State Archive Service of Ukraine, State Executive Service of Ukraine, State Penitentiary Service of Ukraine, State Registration Service of Ukraine, State Service of Ukraine for the Protection of Personal Data also belong to the system of entities in the field of justice of Ukraine. It is noted that the Constitution stipulates that the judicial bodies of Ukraine have a prominent place among the law enforcement agencies of the state.The basic powers of the entities in the field of justice are considered. It is noted that in practice in practice, there is a distinction between two categories: judicial bodies and bodies of the Ministry of Justice of Ukraine. It is substantiated that the bodies of the Ministry of Justice of Ukraine are a part of the bodies of justice, as these bodies as it is much wider in structure and in the range of authorities.Conclusions of the research and prospects for further studies. It is argued that the priorities for the development of the Ukrainian justice today are the following: formation of a new, higher level of legal awareness and legal culture of citizens; reforming of the judicial system to ensure the accessibility of justice and the effectiveness of judicial protection; reforming of the criminal justice and the criminal executive system; creating legal frameworks for prevention and counteraction to corruption; ensuring the efficiency of the enforcement of court decisions; improvement of the system of protection of state interests in the courts of Ukraine; formation of a free legal aid system.Perspective of further research in this area is represented by the study of institutional aspects of public administration in the field of justice and priorities for development of the institutional sector. ; Розглянуто теоретичні підходи до розуміння сутності організаційно-правових засад державного управління у сфері юстиції України. In the article it is paid an attention to Circassian (Chercasy) version of the question on origin of Cossacks. On the Christian population of the North Caucasus named Circassians and also who used Slav speech, for the first time was mentioned in the historic and geographical works in XVI century. In the historiography the connection between concept Circassians-cherkasy and Cossacks occurred, probably, in the XVIII century. This fact we can see in the work of Bayer, Tatischev, which were created under the conditions of the Russian Empire. One of the reasons of turning historians to the Circassian (Cherkass) version of the origin of Cossacks it was using from 16 century concerning Cossacks the term «Cherkasy». In the second half of XVIII century to this theme turned the historians, who specialized in the history of Don and Ukrainian (Zaporozhian) Cossacks (Rigelman), or pursue in their historiography activity the specific political purposes (Boltin). With the comparison of a number of documents, it occurs that Boltin as intellectual was especially valued by well-known Russian statesman Potyomkin, who dealt with the matter of renewal, after the destruction of New Sich, the Cossack troops collecting the former Zaporozhian Cossacks, for the purpose to use them on the service of the Russian Empire. Our attention the fact drew that the Boltin's work, in which he deals with the Circassian (Cherkass) origin of Cossacks, issued in the same period (1788 year), when Ekaterina II wrote Potyomkin about the probability of the migration of the former Zaporozhian Cossacks to Taman, where they had to fulfill the military functions which were important for the empire. Thus, the using of the Circassian version of the origin of Cossacks in the Boltin's work acquired political nature, it made the possibility to connect with the historical arguments Zaporozhian Cossacks with the North-Caucasian region. At the turn of XVIII-ХІХ century another author, who visited Taman, and who have seen Black Sea Cossack army, mostly composed of former Zaporozhian Cossacks, applied theCircassian (Cherkass) version to them, connected this army with the region of North Caucasus. This fact allows to confirm our conclusion that in the Boltin's work this version appears under the effect of the concrete political factors, connected with the circumstances of creation of Black Sea Cossack army and determination its territory. In the first third of ХІХ century this concept was defends, as his own, by historian Bantysh-Kamienski. In the article it is paid an attention to Circassian (Chercasy) version of the question on origin of Cossacks. On the Christian population of the North Caucasus named Circassians and also who used Slav speech, for the first time was mentioned in the historic and geographical works in XVI century. In the historiography the connection between concept Circassians-cherkasy and Cossacks occurred, probably, in the XVIII century. This fact we can see in the work of Bayer, Tatischev, which were created under the conditions of the Russian Empire. The article is aimed at investigation of social effectiveness of business entities. Social aspect of business is becoming a necessary component of success, increase of profitability and competitiveness as well as minimization of risks. Social effectiveness is referred to as correspondence between economic activity and main social needs and aims of society, interests of the staff and interests of a certain person. Investigation of social effectiveness of business entities is suggested to analyze with the help of social factors. Social factors are characterized by variability of expectations, relations and interests of society, staff and individuals. We suggest generalized classification of factors which have an impact on social effectiveness of business, we single out external and internal factors. To external factors belong: income of the population, differentiation of population according to income, migration, level of salaries, level of legality of income of population, family status of population, employment rate, age structure of population etc. As for internal factors we single out the following: low level of basic professional training, use of unskilled workers, absence of conditions for creativity, imperfection of system of motivation of professional growth, absence of specialized centers for certification training etc. Quantity and quality analysis of the above mentioned factors will enable to determine the level of social effectiveness of business entities. For analyses of degree of influence of factors on effectiveness we worked out a questionnaire of expert assessment which is represented in the form of assessment scale. We conducted a questionnaire and analyzed expert results and determined degree of influence of factors on social effectiveness of business. Assessment of level of social effectiveness of business entities was carried out by expert method of certain factor and was represented by a formula. The scale of assessment of level of social effectiveness of business entities in percentage by separate factors: 100-90 – high level, 89-75 – middle level, 74-60 – satisfactory level, 39-40 – low level, 30-0 – absent level. In the article we calculated separately levels of social effectiveness of business entities for external and internal factors. We found out that both external and internal factors are on the middle level, between 79-85%. The given calculations demonstrate reserve for increase of social effectiveness of business entities. Main measures for increase of social effectiveness of business entities are logically united into the following groups: science and technology group; management and economic group; social and psychological group; foreign group. These provisions allow to minimize the social impact of reserve businesses, which, in turn, increase their efficiency and competitiveness, and reduce business risks. Thus growth of effectiveness reveals itself in maximization of social and economic effect and minimization of working hours. Social effect of business entities expresses itself in providing better conditions of life, preconditions are created for further development of the staff in general as well as individual. Mechanism of social effectiveness of business entities is the basis for development, transition from simple to complex needs, from materialistic to spiritual, from economic to political and thus to fully developed personality. Meanwhile higher needs should be considered as main wealth of the society, main factor of social and economic progress. Contradiction between endless growth of social and economic needs and limited resourses of additional time, which can be aimed at satisfaction of them at every certain period of time appears as a driving force of social and economic development. Соціальний аспект підприємництва стає необхідною компонентою ділового успіху, зростання прибутковості та конкурентоспроможності, а також мінімізації ризиків. Соціальна результативності представлена як відповідність розвитку господарської діяльності основним соціальним потребам і цілям суспільства, інтересам трудового колективу і окремої людини. Дослідження соціальної результативності суб'єктів підприємницької діяльності запропоновано аналізувати за допомогою соціальних факторів. Соціальні фактори характеризуються мінливістю очікувань, відносин та інтересам суспільства, колективу чи індивіда. Запропонована узагальнена класифікація факторів, що здійснюють вплив на соціальну результативність підприємницької діяльності, виділено зовнішні та внутрішні фактори. До зовнішніх факторів віднесли: рівень доходів населення; диференціація населення за доходами; міграційні процеси; рівень заробітної плати; рівень легалізованості доходів населення; сімейний статус населення; рівень зайнятості населення; вікова структура населення тощо. Стосовно внутрішніх факторів, то доцільно виділити наступні: низький рівень професійної базової підготовки, використання низько кваліфікованих працівників, відсутність умов для застосування креативних здібностей, недосконалість ефективної системи мотивації професійного зростання, відсутність спеціалізованих центрів для підвищення кваліфікації тощо. Кількісний та якісний аналіз вище зазначених факторів дасть змогу визначити рівень соціальної результативності суб'єктів підприємницької діяльності. Для аналізу ступеня впливу факторів на результативність діяльності розроблена анкета експертного оцінювання, яка представлена у вигляді оціночної шкали. Проведене анкетування та оброблення думок експертів і визначений ступінь впливу факторів на соціальну результативність підприємницької діяльності. Оцінка рівня соціальної результативності суб'єктів підприємницької діяльності експортним методом конкретного фактора і представлена формулою. Шкала оцінки рівня соціальної результативності суб'єктів підприємницької діяльності у відсотковому еквіваленті за окремими факторами: 100-90 – високий рівень; 89-75 – середній рівень; 74-60 – задовільний рівень; 59-40 – низький рівень; 30-0 – відсутній рівень. В статті окремо розраховані рівні соціальної результативності суб'єктів підприємницької діяльності для зовнішніх та внутрішніх факторів. Встановлено, що і зовнішні, і внутрішні фактори знаходяться на середньому рівні, тобто попадають в проміжок 89%-75%. Дані розрахунки демонструють резерв для підвищення соціальної результативності суб'єктів підприємницької діяльності. Основні заходи щодо підвищення соціальної результативності суб'єктів підприємницької діяльності доцільно об'єднати в наступні групи: науково-технічна група; організаційно-економічна група; соціально-психологічна група; зовнішньоекономічна група. Дані резерви дозволяють максимально скоротити резерв рівня соціальної результативності суб'єктів підприємницької діяльності, що, у свою чергу, підвищить їхню ефективність і конкурентоспроможність, а також знизить підприємницькі ризики. Отже, зростання результативності виявляється в максимізації соціального та економічного ефекту і мінімізації робочого часу. Соціальний результат суб'єктів підприємницької діяльності знаходить вираження у забезпеченні кращих умов життя створюються передумови для майбутнього розвитку як колективу, так і індивіда загалом. Механізм соціальної результативності суб'єктів підприємницької діяльності є основою розвитку, переходу від простих до складних потреб, від матеріальних до духовних, від економічних до політичних, отже, до всебічно розвиненої індивідуальності. При цьому вищі потреби повинні розглядатись як головне багатство суспільства, головний чинник його економічного і соціального прогресу. Суперечність між необмеженим зростанням соціальних і економічних потреб та обмеженими ресурсами додаткового часу, який може бути спрямований для задоволення їх в кожний певний момент, виступає рушійною силою соціально-економічного розвитку.
The main idea of this paper refers to the resumption of torture as a phenomenon in ХХ century and also the spread of this undoubtedly disgusting phenomenon in the new Millennium. It is it linked to the category of «security», which has become a pagan cult of modern society. We believe that the views of Michel Foucault and Stanley Cohen on «net widening» can explain expansion of the phenomenon of torture in the XXI century through increased variations of classes and types ofdeviants for the aims of «security». On the one hand, national criminal justice systems cannot cope with dealing with numerous deviants within the framework of formal national legal procedures. On the other hand, citizens born at the time of III and, more importantly, IV modulation of social control demand more «security», so the ways and methods of achieving the appropriate level of security do not longer matter. This is confirmed by numerous sociological studies and surveys in Europe and North America showing that one third to one half of citizens allow the use of torture against terrorists forthesake of «security». All this happens in a context of total social control over space and thoughts. However, the main danger is that the practical possibility of torturing «terrorists» opens a «Pandora's box» to a wide prospect of torture against other «dangerous criminals» – sex offenders, members oforganized crime groups, etc. And this list tends to be expanded. It can be concluded that the «fight against torture» in XXI century is a reflection of a dualistic process: anattempt to develop «secure society» with a simultaneous fiasco of the nature of such «security». The use of torture on suspects is unfortunately happens even in Western democracies, but the extensive system of legal safeguards established in the second half of XX century has helped to make the use oftorture and inhuman treatment as rare as possible. It becomes possible due to activities of the Council of Europe, the CPT and the ECtHR (including through the expansion of the concepts of «torture» and«inhuman treatment»). It is worth emphasizing that torture is not a legal category, but primarily a political and economic one. Analysis of the phenomenon of torture within the formal framework of national criminal justice systems only is dangerous given also the highly questionable effectiveness and efficiency of torture. Recalling E. Durkheim and R. Merton on indicators of deviance and crime, which indicate the state ofanomie in society of the XXI century, it should be emphasized that the state of anomie largely depends on the saturation of the political body of modern society with the phenomenon of torture. In case of other types of crimes, the state tries to reduce the appropriate level of crime to a certain normal rate, influencing relevant individuals. However, in case of torture, we must point out that torture itself is one ofthe most dangerous forms of crime, committed mostly by agents of a state, on behalf of a state, using the powers granted by a state to achieve what they claim is in the public interest. That is why the fight against torture is often when, unfortunately, «the snake bites itself on the tail». And this is quite important problem for future researches. Therefore, the fight against torture should not be narrowly linked to policemen, prosecutors, judges orpunishments. The fight against torture is not also linked to crime detection rates. This should be considered, first of all, in a context of anti-discrimination, human rights, protection of social diversity andthe rights of relevant social groups, migration and social policy, transparency of public administration and accountability of law enforcement agencies, fair redistribution of income in society, state support forvictims of violent crimes. Today it is a common view that «torture is committed in an atmosphere of secrecy and does not like light». Therefore, prevention of torture starts with the policy of maximum openness of law enforcement agencies and complete, comprehensive, constantly updated state statistics on torture (unfortunately, it is almost non-existent in Ukraine). It is no coincidence that the European Parliament's resolution on torture by the CIA in Europe placed special emphasis on accountability: «Accountability for extraordinary renditions, abductions, illegal secret detentions and torture is essential in order to protect and promote human rights effectively, and to ensure legitimate and effective security policies based on the rule of law». In addition, zero tolerance for torture culture and careful selection of law enforcement officers should be paramount, where moral categories need to be an important part of professional compliance. Moreover, «moral» must be supported by message that torture does not work for the purpose of investigating crimes and also has great negative psychological effect, both for victims of torture and for state agents who open this «Pandora's box». Numerous studies show that only moral arguments are effective in motivating people to resist torture. An important question must be put: can torture be considered necessary to perform any of the tasks facing modern states to protect societies? Given the moral and ethical issues, we can express a strong negative answer. Given the more pragmatic arguments put forward by proponents of so called «enhanced interrogation techniques», it should be emphasized that even the alleged pragmatism is broken down into facts that indicate that information obtained under torture is often not, in fact, reliable information, and the price of such information will be too high both for the perpetrators themselves and for the taxpayers who internally support torture. ; Стаття присвячена дослідженню феномену тортур у ХХІ столітті. Головна теза, яка пояснює не лише відновлення тортур як феномену у ХХ столітті, проте й на додаток поширення цього феномену уновому тисячолітті, пов'язана з категорією «убезпечення». Так, для цілей пояснення феномену тортур у ХХІ столітті особливого значення набуває концепція розкидування мереж соціального контролю та, як наслідок, збільшення класів, типів та видів девіантів, яких потрібно контролювати для цілей «убезпечення». З одного боку, національні системи кримінальної юстиції не можуть впоратися з таким завданням – поводитися з девіантами у рамках формальних процедур, закріплених у національному законодавстві. З іншого боку, самі громадяни, народжені у часи III та, що є більш важливим, IV модуляції соціально-контрольних практик, в обмін на свою споживацьку свободу вимагають більшого «убезпечення», де вже не мають значення шляхи та методи досягнення відповідної «концентрації безпеки». Підтвердженням цього є дані численних досліджень та опитувань населення країн Європи та Північної Америки, де від третини до половини громадян допускають застосування тортур до терористів з метою того самого «убезпечення». Причому це все відбувається на фоні тотального соціального контролю за простором і думками. Практична можливість застосування тортур до «терористів» відкриває «скриньку Пандори», де відкривається широка перспектива застосування катувань проти інших «небезпечних злочинців» – колаборантів, sex-offenders, членів організованих злочинних угруповань тощо. Причому цей список має небезпеку піддаватися розширенню. Можна зробити висновок, що «боротьба з катуванням» уХХІ столітті – це відображення дуалістичного процесу: спроба ще більшого «убезпечення суспільства» з одночасним фіаско такого «убезпечення». Застосування тортур до підозрюваних, нажаль, є поширеною практикою навіть у західних демократіях, але розгалужена система правових гарантій, створена у другій половині ХХ століття, допомогла зробити застосування катувань та нелюдського поводження максимально рідким явищем, наскільки це можливо, у чому на регіональному рівні це – велика заслуга Ради Європи, КЗК та ЄСПЛ.
The main idea of this paper refers to the resumption of torture as a phenomenon in ХХ century and also the spread of this undoubtedly disgusting phenomenon in the new Millennium. It is it linked to the category of «security», which has become a pagan cult of modern society. We believe that the views of Michel Foucault and Stanley Cohen on «net widening» can explain expansion of the phenomenon of torture in the XXI century through increased variations of classes and types ofdeviants for the aims of «security». On the one hand, national criminal justice systems cannot cope with dealing with numerous deviants within the framework of formal national legal procedures. On the other hand, citizens born at the time of III and, more importantly, IV modulation of social control demand more «security», so the ways and methods of achieving the appropriate level of security do not longer matter. This is confirmed by numerous sociological studies and surveys in Europe and North America showing that one third to one half of citizens allow the use of torture against terrorists forthesake of «security». All this happens in a context of total social control over space and thoughts. However, the main danger is that the practical possibility of torturing «terrorists» opens a «Pandora's box» to a wide prospect of torture against other «dangerous criminals» – sex offenders, members oforganized crime groups, etc. And this list tends to be expanded. It can be concluded that the «fight against torture» in XXI century is a reflection of a dualistic process: anattempt to develop «secure society» with a simultaneous fiasco of the nature of such «security». The use of torture on suspects is unfortunately happens even in Western democracies, but the extensive system of legal safeguards established in the second half of XX century has helped to make the use oftorture and inhuman treatment as rare as possible. It becomes possible due to activities of the Council of Europe, the CPT and the ECtHR (including through the expansion of the concepts of «torture» and«inhuman treatment»). It is worth emphasizing that torture is not a legal category, but primarily a political and economic one. Analysis of the phenomenon of torture within the formal framework of national criminal justice systems only is dangerous given also the highly questionable effectiveness and efficiency of torture. Recalling E. Durkheim and R. Merton on indicators of deviance and crime, which indicate the state ofanomie in society of the XXI century, it should be emphasized that the state of anomie largely depends on the saturation of the political body of modern society with the phenomenon of torture. In case of other types of crimes, the state tries to reduce the appropriate level of crime to a certain normal rate, influencing relevant individuals. However, in case of torture, we must point out that torture itself is one ofthe most dangerous forms of crime, committed mostly by agents of a state, on behalf of a state, using the powers granted by a state to achieve what they claim is in the public interest. That is why the fight against torture is often when, unfortunately, «the snake bites itself on the tail». And this is quite important problem for future researches. Therefore, the fight against torture should not be narrowly linked to policemen, prosecutors, judges orpunishments. The fight against torture is not also linked to crime detection rates. This should be considered, first of all, in a context of anti-discrimination, human rights, protection of social diversity andthe rights of relevant social groups, migration and social policy, transparency of public administration and accountability of law enforcement agencies, fair redistribution of income in society, state support forvictims of violent crimes. Today it is a common view that «torture is committed in an atmosphere of secrecy and does not like light». Therefore, prevention of torture starts with the policy of maximum openness of law enforcement agencies and complete, comprehensive, constantly updated state statistics on torture (unfortunately, it is almost non-existent in Ukraine). It is no coincidence that the European Parliament's resolution on torture by the CIA in Europe placed special emphasis on accountability: «Accountability for extraordinary renditions, abductions, illegal secret detentions and torture is essential in order to protect and promote human rights effectively, and to ensure legitimate and effective security policies based on the rule of law». In addition, zero tolerance for torture culture and careful selection of law enforcement officers should be paramount, where moral categories need to be an important part of professional compliance. Moreover, «moral» must be supported by message that torture does not work for the purpose of investigating crimes and also has great negative psychological effect, both for victims of torture and for state agents who open this «Pandora's box». Numerous studies show that only moral arguments are effective in motivating people to resist torture. An important question must be put: can torture be considered necessary to perform any of the tasks facing modern states to protect societies? Given the moral and ethical issues, we can express a strong negative answer. Given the more pragmatic arguments put forward by proponents of so called «enhanced interrogation techniques», it should be emphasized that even the alleged pragmatism is broken down into facts that indicate that information obtained under torture is often not, in fact, reliable information, and the price of such information will be too high both for the perpetrators themselves and for the taxpayers who internally support torture. ; Стаття присвячена дослідженню феномену тортур у ХХІ столітті. Головна теза, яка пояснює не лише відновлення тортур як феномену у ХХ столітті, проте й на додаток поширення цього феномену уновому тисячолітті, пов'язана з категорією «убезпечення». Так, для цілей пояснення феномену тортур у ХХІ столітті особливого значення набуває концепція розкидування мереж соціального контролю та, як наслідок, збільшення класів, типів та видів девіантів, яких потрібно контролювати для цілей «убезпечення». З одного боку, національні системи кримінальної юстиції не можуть впоратися з таким завданням – поводитися з девіантами у рамках формальних процедур, закріплених у національному законодавстві. З іншого боку, самі громадяни, народжені у часи III та, що є більш важливим, IV модуляції соціально-контрольних практик, в обмін на свою споживацьку свободу вимагають більшого «убезпечення», де вже не мають значення шляхи та методи досягнення відповідної «концентрації безпеки». Підтвердженням цього є дані численних досліджень та опитувань населення країн Європи та Північної Америки, де від третини до половини громадян допускають застосування тортур до терористів з метою того самого «убезпечення». Причому це все відбувається на фоні тотального соціального контролю за простором і думками. Практична можливість застосування тортур до «терористів» відкриває «скриньку Пандори», де відкривається широка перспектива застосування катувань проти інших «небезпечних злочинців» – колаборантів, sex-offenders, членів організованих злочинних угруповань тощо. Причому цей список має небезпеку піддаватися розширенню. Можна зробити висновок, що «боротьба з катуванням» уХХІ столітті – це відображення дуалістичного процесу: спроба ще більшого «убезпечення суспільства» з одночасним фіаско такого «убезпечення». Застосування тортур до підозрюваних, нажаль, є поширеною практикою навіть у західних демократіях, але розгалужена система правових гарантій, створена у другій половині ХХ століття, допомогла зробити застосування катувань та нелюдського поводження максимально рідким явищем, наскільки це можливо, у чому на регіональному рівні це – велика заслуга Ради Європи, КЗК та ЄСПЛ.
One of the most important vectors of Ukraine's contemporary development is its active policy in bilateral relations with the leading European countries, since such a policy opens the way for recognition of its European identity and forms unlimited opportunities for international cooperation on a mutually beneficial basis. Among the closest partners and the most reliable allies of Ukraine was and remains Poland, because here, hundreds of thousands of Ukrainians live, work and study without any special problems. In addition, the strengthening of strategic partnership with Poland contributes to the practical realization of the European choice of Ukraine. On the other hand, Poles are interested in the territorial integrity, independence and European orientation of Ukraine, seeing it an ally in confronting external threats.In connection with the aforementioned one of the most important directions of the study of the state and prospects of modern Ukrainian-Polish relations is the elucidation of the sources and methodology of their comprehension comprehension. Although any classification is conditional, it is still worth trying to identify the main sources whose potential is intended to strengthen the relations between the two countries and outline the methodological aspects of their use in order to strengthen Ukrainian-Polish cooperation. First of all, such sources should include the following.1. The ideological and theoretical work of the representatives of Ukraine and Poland, aimed at finding ways to deepen mutual understanding between the two peoples. At the same time, particular attention should be paid to strategic considerations expressed on both sides, as well as reservations about the risks that accompany bilateral relations. Along with this, the important points for studying are the positions of people who are distinguished for their diligence, openness to mutual respect and mutual understanding. The ideological and theoretical potential of Ukrainian and Polish intellectuals, aimed at convergence, the dialogue of the cultures of the two countries, still needs to be properly studied and systematized, and can serve as an important basis for the state-building efforts of Ukraine and Poland in the future.2. External and domestic legal acts and documents of strategic direction aimed at strengthening of bilateral relations. This vector of relationships was already established at the turn of the 20th - 21st centuries in the relevant international legal and internal documents: the Declaration on the Principles and Main Directions of Ukrainian-Polish Relations (October 13, 1990); Treaty on Good Neighborhood, Friendly Relations and Cooperation (May 18-19, 1992); Agreement on the legal status of the Ukrainian-Polish border (January 12, 1993); Communique on the results of the meeting of the Consultative Committee of the Presidents of Ukraine and the Republic of Poland (September 27-28, 1995); Joint Statement for Understanding and Integration (May 21, 1997); Security Strategies of the Republic of Poland (2000); National Concept of Strategic Partnership Relations with the Republic of Poland (July 27, 2001); in a paper presented by the Polish political experts «The Eastern Policy of the Union in the Perspective of its Expansion through the States of Central and Eastern Europe - the Polish Point of View» (October 2003). Sufficiently strong legal and regulatory framework for bilateral relations between Ukraine and Poland is evidence of a gradual strengthening of political, economic, international legal and cultural cooperation. At the same time, a number of problems remain inadequate. First of all, it concerns border cooperation, common historical heritage, education, labor migration, etc.3. Institutional system for the provision and coordination of mutual strategic interests of the two states. Today, this coordination is jointly carried out by: the Advisory Committee of the Presidents of Ukraine and the Republic of Poland; Ukrainian-Polish Mixed Commission on Trade and Economic Cooperation; Ukrainian-Polish and Polish-Ukrainian parliamentary groups; Permanent Ukrainian-Polish Conference on European Integration; Polish Institute in Kyiv; Ukrainian-Polish, Polish-Ukrainian forums, Foundation Research Center Poland-Ukraine and others. In addition, there are a number of research structures in each of the countries that are highly specialized in the Polish-Ukrainian and Ukrainian-Polish issues. Accordingly, this direction should be monitored and the current evaluation of the effectiveness of these or other structural units should be carried out on the subject of a real impact on the quality of bilateral relations. At the same time, mutual understanding should be sought on the basis of openness, dialogue, compromise, and the avoidance of the formation of structures focused on unilateral consideration of disputed problems.4.State-political decisions in the field of security policy, anti-hybrid foreign-policy threats. A real threat to the entire European security system was the aggressive policy of Russia in 2014. Under these conditions, Ukraine was the leading outpost of protecting European values and democratic order. Systemic comprehension of the existing experience in a vital military-strategic sphere will help to optimize the directions of further cooperation, in particular on such important issues as: the final determination by Ukraine of the transition to international standards in the military sphere; exchanging experience of reforming the troops and maintaining their combat readiness at an appropriate level; combining the efforts of all EU countries in combating hybrid threats, as well as conducting a single foreign and security policy; consolidated actions of the European states in relation to the offending state (point of application of sanctions, embargo, etc.); to develop, on the basis of the UN, a common position on the unconditional implementation by all countries of the world of the requirements of international law and the search for ways to improve it in order to resolve non-standard situations; the study of the NATO countries by the unique Ukrainian experience of functioning the state in a hybrid war.5. The ideological and theoretical potential of public events (scientific conferences, debates, discussions, official meetings) that promote reconciliation with respect to controversial historical events, the dissolution of persistent stereotypes. From time to time, the recurrence of historical hostility between the two neighboring countries is given significant, including at the official level. First of all, these are the negative manifestations of mutual opposition, such as: the war of monuments to the dead Poles and Ukrainians; the dissemination at the level of mass consciousness of outdated stereotypical ideas humiliating national dignity; attempts to politicize the policy of memory through speculation on the tragic events of the past, in which the representatives of both nations suffered; the criticisms of the Polish radicals about the re-establishment of the Commonwealth at the borders of 1939 and the ill-conceived statements of some Ukrainians, which prompted «to forget about Poland for 25 years». The realization by Poland of offensive historical politics in Ukraine creates a reciprocal reaction in the issue of Ukraine's implementation of its policy of memory and causes various kinds of distortions. Therefore, under the current conditions, monopolization of the policy of memory at the state level, without involving the general public, is extremely dangerous for the future. This remark applies to both Poland and Ukraine.Thus, despite current problems, today we have every reason to state the significant level of Ukrainian-Polish cooperation. At the same time, in the bilateral relations between Ukraine and Poland it is worth looking first and foremost on positive things, consolidating in the mass consciousness what unites the two Eastern European countries, to highlight the views of people who for years build a Polish-Ukrainian understanding: translate books, establish scientific cooperation, restore cemeteries, collect help for soldiers who guarantee European security in eastern Ukraine. The progressive forces of both countries, regardless of the various kinds of provocations, should be abstracted from the insinuations of the marginal environment, reveal wisdom in assessing historical events, and determine common priorities not only for the medium term, but also for the long-term perspective. The level of mutual relations between the two countries depends on the possibility of realizing the needs of national minorities - Ukrainian in Poland and Polish in Ukraine.
