Rechtsfragen zum Austritt aus der Währungsunion
Der mit dem Vertrag von Lissabon geschaffene Artikel 50 EUV ermöglicht einen Austritt aus der Europäischen Union. Aus dem Aufbau der Verträge der Union ergibt sich: Aus der Union ? aus dem Euro. Ein Austritt aus der Union gemäß dem Völkerrecht ist nur in Extremsituationen denkbar. Grundsätzlich genießt das Europarecht Vorrang. Einen Austritt aus der Währungsunion mit dem Völkerrecht zu begründen, widerspricht dem Völkerrecht und den Verträgen der EU. In den Verträgen der EU findet sich keine Rechtsgrundlage für einen Austritt aus der Währungsunion, diese könnte aber mit einer Vertragsänderung geschaffen werden. Ein Ausschluss aus der EU bzw. aus der Währungsunion ist ausgeschlossen. Die Sanktionsmechanismen der Verträge der EU sehen bewusst keinen Ausschluss vor. Eine Auflösung der Union oder der Währungsunion und eine anschließende Neugründung mit einem Mitgliedstaat weniger, ist rechtlich möglich. ; The Article 50 of the Treaty on the EU, established by the Treaty of Lisbon, provides a right of withdrawal from the European Union.
