Morality politics dans l'Union européenne :un scénario de guerres culturelles à l'américaine ?L'exemple de l'avortement
L'intensification des débats définis en termes de valeurs au sein de l'Union européenne ainsi que la montée en puissance des flux transatlantiques (c'est-à-dire des phénomènes de mimétisme et d'échange d'idées et de pratiques) amènent à considérer la morality politics de l'UE au regard du scénario américain des guerres culturelles. En particulier, la question de la mobilisation de la société civile européenne autour de l'avortement permet de tester les deux facettes du cadre théorique des culture wars :soit il existe une polarisation avérée et irréductible entre deux camps formés et fermés d'acteurs, soit il ne s'agit que d'un répertoire d'actions et d'un style politique particuliers visant à la dramatisation d'une cause en vue d'obtenir une reconnaissance politique et médiatique. Dans tous les cas, il s'agit d'étudier comment une morality issue ponctuelle devient le symbole d'un enjeu plus large :celui de la définition des valeurs, de l'identité et de la culture publiques. ; The intensification of the debates defined in terms of values inside the European Union as well as the growing relevance of the transatlantic flows (i.e. phenomena of mimesis and exchange of ideas and practices) are justifying the study of EU morality politics through the prism of the American scenario of culture wars. The mobilization of the European civil society around the abortion issue in particular enables us to test both facets of the theoretical framework of culture wars, i.e. either there is a patent and implacable polarization between two defined and closed groups of actors, or it only corresponds to a particular political communication style aiming at dramatizing an issue in order to get political and media attention. In both cases, the objective is to analyze how a punctual morality issue becomes the symbol of a broader stake: the definition of the public values, identity, and culture. ; info:eu-repo/semantics/published

The Dignity, a new mask of morality in criminal law ; La Dignité, nouveau masque de la moralité en droit pénal
The hermetic distinction between law and morals is lost as a result of dignity as understood by criminal law. Indeed, while the term 'morality' disappeared from the Criminal Code in 1994, the use of human dignity seems to update the moral basis of certain offences. This concept makes it possible to reconcile these two areas, to such an extent that dignity is now regarded as the new mask of morality. ; The irreconcilable distinction between Law and Morality is shaken by the notion of Dignity as described by the Criminal Law. Indeed, while the notion of « mores » has disapperead from the Criminal Code since 1994, the actual application of the principles of human dignity seems to bring the old concepts of morality back into the spotlights - when it comes to certain types of infractions. This notion appears to reconcile Law and Morality, at such a point that it possible, today, to consider « human dignity » as the very new face of Morality itself. ; The hermetic distinction between law and morals is lost as a result of dignity as understood by criminal law. En effet, alors que le terme « mœurs » a disparu du Code pénal en 1994, l'usage de la dignité de la personne humaine semble réactualiser le fondement moral de certaines infractions. Cette notion permet de réconcilier ces deux domaines, à tel point qu'il est aujourd'hui permis de considérer la dignité comme le nouveau masque de la moralité.

The will rivaled by morality. The example of real estate sale. ; La volonté débordée par la morale. L'exemple de la vente d'immeuble
The real estate sale has become a contract of distrust. In this contract, various rights and obligations conflict. Specifically, there are seller's rights versus purchaser's rights or third party rights like that of the property's occupant. In the face of this crisis of trust, the moral stakes of this contract raise great interest, in particular regarding the moralization of real estate sale by the combined action of the legislature and judges. They are interested in the good of all contracting parties where the mere domain of law is exceeded. Indeed, in terms of morality, an action is evaluated according criteria of right and wrong, whereas, in terms of justice, an action is evaluated according criteria of fair and unfair. Law, which is based on justice, concerns « the fair balance of assets sharing between citizens ». The good consists of « an equilibrium where harmony among all parties is realized by a fair measure ». The subject of this thesis is about balance between the contract of real estate sale and the behavior of contract players. ; La vente immobilière est devenue un contrat de méfiance où s'entrechoquent différents droits et obligations. Ce sont les droits du vendeur contre ceux de l'acquéreur voire des tiers comme les occupants du bien. Face à cette crise de confiance, les enjeux moraux de ce contrat présentent un réel intérêt surtout au regard de la moralisation de la vente d'immeuble par l'action combinée du législateur et du juge. Ces derniers vont s'intéresser au bien des contractants dépassant ainsi le domaine strict du droit. En effet, la morale est évaluée selon des critères d'appréciation de bien ou de mal alors que la justice procède à son évaluation sur la base de critère de juste ou d'injuste. Le droit, objet de la justice, concerne « le juste rapport des biens et des choses réparties entre citoyens ». Le bien consistant « dans une juste mesure, un point d'équilibre où se réalise l'harmonie du tout et de ses parties », le domaine de l'étude concerne tout aussi bien l'équilibre du contrat de vente immobilière que la conduite des acteurs du contrat.

What Morality Has to Do with It? Plagiarism, Model Rewriting and Literary Values ; Quel rapport avec la morale ? Plagiarisme, réécriture des modèles et valeurs littéraires
International audience ; Some critics and writers maintain that the present interest in plagiarism and plagiarism poetics may be interpreted as an evidence of the first stages of the forthcoming literary revolution. New writing practices would be, at last, ultimately discrediting traditional literary values, which were dominant until the end of the 19th century: work, coherence, originality, authorship, etc. A democratic redefinition of literary objects and their uses would have been imposed by the combined effect of an overwhelming excess of writing materials and of technologies allowing endless rewriting of them. Accordingly, we would not be only the witnesses of technological innovations but also of a renewal of literary values, partly related to those innovations. This renewal would include a transformation (and criticism) of the political location par excellence: author-function. More radically, other critics suggest that those literary values have become obsolescent, fraudulent ersatzes of hidden political and moral values. This context would be marked by "uncreative writing" (K. Goldsmith) and "unoriginal geniuses" (M. Perloff); in which readers and authors, humans and machines, texts, fragments, quotations, images, clips, software and tags would get entwined into a World Wide Text, an endless, ephemeral flux –endlessly copied, pasted, mixed, shared and re-tweeted. A limitless writing, by means of which authors will become ephemeral and interchangeable: a literature, at last, "made for all and by all". ; L'intérêt porté au plagiat et aux poétiques "plagiaristes" traduirait aux dires de certains une véritable "révolution littéraire" dont nous n'assisterions qu'aux premières étapes.
