In the article, based on the analysis of scientific views of scientists and norms of the current legislation, the sub-stantive characterization of the powers of the National Anti-Corruption Bureau of Ukraine is given. The duties and rights of the National Anti-Corruption Bureau of Ukraine have been classified. Proposed ways to improve the legal regulation of the Bureau's mandate, which may be key to strengthening the fight against corruption in Ukraine. It is found out that in order to fulfill the tasks of prevention and prevention of corruption offenses by the National Anti-Corruption Bureau of Ukraine it is necessary to increase its powers to participate in the leg-islative-making process, namely to participate in the de-velopment and improvement of normative-legal acts on prevention and fight against corruption. In the course of exercising its powers, the National Anti-Corruption Bureau of Ukraine accumulates a con-siderable amount of information, which serves as a basis for analytical work to identify the causes, conditions and other circumstances of corruption behavior in Ukrainian society. It would be advisable to indicate directly among the rights of the National Anti-Corruption Bureau of Ukraine its involvement in the development of a strategy for the prevention and fight against corruption offens-es, which is now provided to the National Agency for the Prevention of Corruption. It is concluded that improv-ing the legal regulation of the Bureau's mandate may be the key to strengthening the fight against corruption in Ukraine. Such improvement can be done in two ways: by increasing the powers of the Bureau aimed at enhancing its interaction with the National Anti-Corruption Agency as a body of executive power that provides for the forma-tion and implementation of state anti-corruption policy, and with other subordinate authorities, the activities of which are directly related to anti-corruption functions; unifying the powers of bodies such as the National Agen-cy for the Prevention of Corruption, the National Agency of Ukraine for the detection, search and management of assets obtained from corruption and other crimes, and the National Anti-Corruption Bureau of Ukraine, which will solve the problem of duplication of functions of bodies carrying out to fight corruption, to increase the effective-ness of this fight, and to reduce the expenditures of the state budget accordingly. ; У статті на основі аналізу наукових поглядів вче-них і норм чинного законодавства надано змістовну характеристику повноваженням Національного анти-корупційного бюро України. Здійснено класифікацію обов'язків та прав Національного антикорупційного бюро України. Під час реалізації своїх повноважень Національне антикорупційне бюро України акумулює значну кіль-кість інформації, яка слугує основою для проведення аналітичної роботи з виявлення причин, умов, інших обставин вияву корупційної поведінки в українсько-му суспільстві. Доцільно було б безпосередньо серед прав Національного антикорупційного бюро України вказати на його участь у розробці стратегії запобіган-ня та боротьби з корупційними правопорушеннями, яке надано Національному агентству з питань запобі-гання корупції. Зроблено висновок, що вдосконалення правового регулювання повноважень Бюро може бути ключем до посилення боротьби з корупцією в Україні. The author has formulated own definition of public control over the activities of the National Anti-Corruption Bureau of Ukraine (NABU) on the basis of existing doctrinal concepts of public control and analysis of the current legislation, taking into account the specifics and features of the latter. Particular attention has been paid to the characteristics of the object and the subject composition of public control over the activities of the National Anti-Corruption Bureau of Ukraine. It has been established that according to the organizational and legal form, the public control over the activities of the NABU is an external control, that is implemented in the absence of organizational subordination within relations between the controlling subject and object, to which it is carried out. Such a control is carried out both individually (by individual citizens) and collegially (by the Public Control Council), where not only the object of control, but also the rights of controlling subjects in relation to its implementation depends on this. It has been noted that the specifics of public control over the activities of the NABU is that the latter is carried out by general subjects (individual citizens and public associations, other civil society institutions) and special subjects (in particular, by the Public Control Council of the NABU). In turn, the composition of subjects that implement the public control over the activities of the NABU, defines the content of the exercised rights: 1) general – which follows from the provisions of the laws of Ukraine "On Citizens' Appeals", "On Democratic Civilian Control over the Military Organization and Law Enforcement Agencies of the State", "On Citizens Associations", and 2) special, which are stipulated by the Law of Ukraine "On the National Anti-Corruption Bureau of Ukraine". ; На основі існуючих доктринальних понять громадського контролю й аналізу чинного законодавства сформульовано авторське визначення громадського контролю за діяльністю Національного антикорупційного бюро України з урахуванням її специфіки та особливостей. Окрему увагу приділено характеристиці предмета та суб'єктного складу громадського контролю за діяльністю Національного антикорупційного бюро України.

The article considers the current conditions in which such anti-corruption bodies as the National Anti-Corruption Bureau of Ukraine, the Specialized Anti-Corruption Prosecutor's Office, and the Supreme Anti-Corruption Court of Ukraine have to operate. Based on the opinions of scientists and experts, it has been established that anti-corruption bodies now face the following challenges: constant pressure from the authorities, irresponsibility of the majority of people's deputies, which makes it very difficult for these bodies to work; most citizens of our state perceive corruption as a relatively simple way to solve problems quickly. Ordinary citizens are accustomed, so to speak, to solving either complex or simple issues (in health care or education institutions, courts and other public institutions) "mainly through bribes to officials of lower levels of government who abuse their official position, using it for the purpose of illegal profit or for other selfish purposes; obvious abuse of power by top officials, misappropriation of state property, land, concealment of wealth. In view of this, corruption has been perceived for many years by scholars and ordinary citizens as perhaps the greatest threat to the progress of socio-economic development of the state, its formation as a democracy. The problem of combating corruption as one of the most dangerous phenomena of modern Ukrainian society, which has penetrated almost all spheres of life, is extremely acute not only in Ukraine but also in many developed European countries, including Italy, Germany, Great Britain, etc.). It has been proved that anti-corruption bodies have never become independent and autonomous in their activities. They are often pressured by the Prosecutor General's Office, deputies, and interfere in the investigation, which, of course, alarms international partners and civil society

On the basis of working out the current legislation of Ukraine and a number of scientific views of scholars the author of the article defined and characterized certain directions of improvement of administrative legislation regulating interaction of the National Anti-Corruption Bureau of Ukraine with other law enforcement agencies. It is argued that the legislation is the basis of anti-corruption activities of the state and the key to its effective implementation, however, the legal framework in this field suffers from a significant load of declaratory norms that set principles and tendencies, but do not provide information on how the data principles and tendencies must be implemented. It is found out that administrative legislation regulating the interaction of the National Anti-Corruption Bureau of Ukraine with other law enforcement agencies is the system of normative and legal acts of administrative branch regulating the procedure, sequence, format and other administrative features of the interaction of NABU with law enforcement agencies. It is established that NABU's interaction with law enforcement agencies is a large, complex direction of our state's anti-corruption component, which requires defining the goals, principles, directions and levels of interaction at the legislative level. Thus, interaction, as a form of work, needs to be broadly defined at the level of legislation not within the limits of several norms, but to give this topic a separate section of the Law of Ukraine "On the National Anti-Corruption Bureau of Ukraine". This will create a legislative guarantee for NABU's interaction with law enforcement agencies, consolidate it as an integral and necessary aspect of anti-corruption activities. It is emphasized that the by-law regulatory framework for the implementation of the relevant interaction is currently rather small in volume, so that the potential of cooperation between NABU and other law enforcement agencies cannot be disclosed, since it actually has no basis for its implementation. In this regard, it is most appropriate to consolidate the mechanisms of the Bureau's interaction with the state law enforcement agencies by extending the range of joint orders. ; В результате анализа законодательства Украины и научных разработок ученых определены и охарактеризованы отдельные направления совершенствования административного законодательства, регулирующего взаимодействие Национального антикоррупционного бюро Украины с другими правоохранительными органами. Охарактеризованы ключевые нормативно-правовые акты административной сферы, положения которых определяют стратегические ориентиры антикоррупционной деятельности государства и механизм ее осуществления, регулируют порядок, последовательность, формат и другие управленческие особенности взаимодействия НАБУ с правоохранительными органами нашего государства. Раскрыто содержание взаимодействия НАБУ с правоохранительными органами и предложено создать законодательную гарантию для взаимодействия НАБУ с правоохранительными органами, закрепить ее как неотъемлемый и необходимый аспект антикоррупционной деятельности. ; На основі аналізу законодавства України та наукових поглядів учених визначено й охарактеризовано окремі напрями вдосконалення адміністративного законодавства, яке регулює взаємодію Національного антикорупційного бюро України з іншими правоохоронними органами. Охарактеризовано нормативно-правові акти адміністративної галузі, положення яких визначають стратегічні орієнтири антикорупційної діяльності держави і механізм її здійснення, регулюють порядок, послідовність, формат та інші управлінські особливості взаємодії НАБУ із правоохоронними органами. Розкрито зміст взаємодії НАБУ із правоохоронними органами, а також запропоновано створити законодавчу гарантію для взаємодії НАБУ із правоохоронними органами, закріпити її як невід'ємний і необхідний аспект антикорупційної діяльності.

Ukraine is trying to effectively counteract corruption not only through the creation and further maintenance of such institutions as the National Anti-Corruption Bureau of Ukraine, the Specialized Anti-Corruption Prosecutor's Office of the General Prosecutor's Office of Ukraine, the National Anti-Corruption Court, but also by improving criminal legislation. An example of this was Art. 368-2 of the Criminal Code of Ukraine as amended on 11/10/2015, which, however, after a short period of time was declared unconstitutional and lost force. As a result, due to the application of retroactive force of the criminal law in time, namely part 1 of Art. 5 of the Criminal Code of Ukraine, all criminal proceedings for committing a criminal offense under Art. 368-2 of the Criminal Code of Ukraine as amended on 11/10/2015, were closed on a non-rehabilitative basis, provided for in paragraph 4 of Part 1 of Art. 284 of the Criminal Procedure Code of Ukraine (hereinafter - the CPC of Ukraine). Now in Ukraine, the fight against the acquisition of assets by officials in excess of the legal income of the latter continues, because the Criminal Code of Ukraine has been supplemented by the legislator with Art. 368-5 in accordance with Law No. 263-IX of October 31, 2019, which contains a new version of such a criminal offense as illegal enrichment. The scientific article compares two versions of the norm of the law on criminal liability for illegal enrichment, namely Art. 368-2 of the Criminal Code of Ukraine as amended on 11/10/2015, which is recognized as such that does not comply with the Constitution of Ukraine (unconstitutional) and Art. 368-5 of the Criminal Code of Ukraine. The grounds for recognizing Art. 368-2 of the Criminal Code of Ukraine as amended on 11/10/2015 is such that it does not comply with the Constitution of Ukraine. Corruption is one of the biggest problems in Ukraine today. It has a negative impact on the economic and political situation in the country.Corruption is the process of degradation of the state as a result of adoption by authorized persons of certain decisions considerably deviating from the key criteria that such a decision must be based on, who do so for the sake of expected gain [3: 8].A number of reforms connected with this question have been undertaken since the existence of Ukraine. Finally, The High Anti-Corruption Court has started to work on September 5 this year. Ukrainians consider it as a source of corruption overcoming.

The second part of the article deals with the activities of the National Anti-Corruption Bureau of Ukraine, Specialized Anti-Corruption Prosecution Office of Ukraine, the State Bureau of Investigation and other anti-corruption institutions. Following the results of research conclusion has been drawn that to ensure the national security of Ukraine it is necessary to review the mechanisms for bringing public to the work of the National Agency on Corruption Prevention. At the same time, it is necessary to introduce legislative restrictions for the selection of personnel and work of the NACP due to the lack of professionalism and incompetence, their involvement to various commissions by interested politicians and foreign advisors who were not checked by the State Security Service of Ukraine. The author proposes to introduce individual liability for the members of the Commission, clear criteria for selection of members of the NACP and requirements which prove the decisions of the Commission in legislation. Taking into account the conducted analysis it is necessary to change the procedure of organizing a competition to hold positions in the agency and review whether management of the NACP complied with the held positions. Only people who have a perfect reputation and a significant public standing should select members of the NACP. All employees and public officials of the Agency should undergo a polygraph. As an alternative the NACP can join the National Anti-Corruption Bureau of Ukraine which will guarantee independence from political influence. The main factor of the lack of progress in counteraction to corruption in Ukraine is political dependence of all anti-corruption bodies.
