'Prescriptive Nature of Th e Code of the Sworn Translator', proclaimed in the 2005 Resolution of the Supreme Board of the Polish Society of Sworn and Specialised Translators 'TEPIS', is described in this article as seen from the perspective of the international and Polish laws and the practice of contemporary translation studies. As recommended by the "Grotius" and the "AGIS" projects, the Code has been prepared in cooperation with representatives of the Minister of Justice. Hence, it constitutes an authoritative reference for the 2004 legislative Act on the profession of the sworn translator.A comparison of the status of the newly established profession of the sworn translator and those of the advocate and the notary in Poland gives the author the grounds to claim that Th e Code of the Sworn Translator constitutes a truly independent and authoritative source of rules of professional ethics and practice. Such status is a natural consequence of its being developed in compliance both with the Polish law and the legislative customs enabling the professional environment to decide about its ethics and good practice itself, based on the long traditions of professional organizations in Poland. ; Wieloletnie starania polskich tłumaczy przysięgłych doprowadziły po raz pierwszy w dziejach tego zawodu do ich skutecznej współpracy z przedstawicielami Ministra Sprawiedliwości. Owocem wspólnych działań było opracowanie zbioru zasad etyki i praktyki zawodowej pt. Kodeks tłumacza przysięgłego. W artykule omówiono przesłanki zawarte w konwencjach międzynarodowych i przepisach prawa polskiego do tworzenia i stosowania takich ujednoliconych zasad wykonywania zawodu oraz genezę, strukturę, treść i preskryptywny charakter Kodeksu.

Current events in Ukraine and the world's response on them, urged the authors of the article to search the answers to a rhetorical question. Why are the Ukrainians not able to properly mold the political system, making repeatedly attempts to establish its distinguished features. The authors of the article aim at a thorough investigating of the Ukrainian scientific thought rather than analyzing the course of events – current or previous – to give the answer to a burning issue. How come? In the past, but mostly at the present time, the problem rises both in a scientific environment and in the society on the whole. As an illustration, the authors have chosen some published research-documentary positions, to figure out the push-pull factors of the present phenomenon, disturbing the Ukrainian society. ; Dzisiejsze wydarzenia na Ukrainie oraz reakcja na nie świata cywilizowanego pobudziły autorów artykułu do poszukiwania odpowiedzi na pytanie retoryczne: Dlaczego Ukraińcy dotychczas nie mogą w należyty sposób ukształtować swojej państwowości, mimo że próbowano to niejednokrot­nie uczynić? Autorzy postawili sobie za cel nie przeprowadzać analizy przebiegu wydarzeń teraźniejszych lub wcze­śniejszych, a spróbować przestudiować myśl naukową Ukrainy w zakresie poszukiwania odpowiedzi na palącą kwestię: Dlaczego?W przeszłości, a współcześnie jeszcze częściej, problem ten podejmowany jest tak w środowisku na­ukowym, jak i w całym społeczeństwie. Autorzy dla przykładu wybrali niektóre pozycje druków ba­dawczo-dokumentalnych, aby wyjaśnić pochodzenie dzisiejszych zjawisk nurtujących społeczeństwo ukraińskie.

Bu çalışmada, anayasacılık düşüncesinin gelişimi, özelde de politik anayasacılık anlayışının mahiyetinin 1961 Anayasası üzerinden değerlendirilmesi amaçlanmaktadır. Anayasacılık akımı doğal hukuk, toplum sözleşmesi ve kuvvetler ayrılığı ilkesi çerçevesinde geliştirilmiştir. Anayasacılık temelde siyasal iktidarın keyfi yönetimine karşı temel hak ve özgürlüklerin garanti altına alınmasıyla birlikte bu iktidarın denge-fren mekanizmasıyla kontrol altında tutulmasını amaçlamaktadır. Politik anayasacılık, anayasanın toplumla olan bağlarına dikkat çeker. Anayasanın asıl sahibini kurucu iktidar olarak görmez; toplum iradesinin bizzat sahibi olan halkı esas alır. Politik anayasacılık anlayışı, özünde politik bir metin olan anayasaların, siyasal iktidar ile toplum arasında imzalanan bir sözleşme niteliğinde olması gerektiğini ve bu durumun da anayasaların sosyo-politik meşruiyetini arttırıcı bir unsur olduğuna vurgu yapmaktadır. 1961 Anayasası yapım sürecinde uygulanan "kurucu meclis" sistemi anayasanın toplum sözleşmesi niteliğinde oluşu açısından önemli olmakla birlikte, meclisin oluşumu ve halkı temsil niteliğinin eksikliği yönünden demokratik bir şekilde gerçekleşmemiştir. 1961 Anayasası, çoğulcu demokratik düzeni gerçekleştirebilmek için bir dizi hüküm kabul etmiştir. Bunlardan belki de en önemlisi Anayasa Mahkemesi'nin kuruluşudur. Anayasanın üstünlüğü ilkesi teorik düzeyde ifade edilmekle yetinilmemiş, kanunların anayasaya uygunluğunun yargısal denetimi yoluyla gerçek güvence ve müeyyidesi sağlanmıştır. Çift meclis sistemi ile parlâmentonun çoğunluk gücüne dayanarak keyfi uygulamaları engellenmek istenmiştir. Hak ve özgürlükler alanında ise sistemli ve ayrıntılı düzenlemeler yoluna gidilmiştir. Ancak bütün bu düzenlemelerin yanında özellikle 1971 ve 1973 yıllarında yapılan değişiklikler ile askerî otoritenin sivil otorite karşısında ayrıcalıklar elde edeceği düzenlemeler getirilmiştir. ; In this study, it is aimed to evaluate the development of constitutional thought, in particular the nature of political constitutionalism through the 1961 Constitution. Constitutionalism has been developed within the framework of natural law, social contract and the principle of separation of powers. Constitutionalism mainly aims to guarantee fundamental rights and freedoms against the arbitrary administration of political power and to keep this power under control by the checkbalance mechanism. Political constitutionalism draws attention to the bonds of constitution with society. It does not consider the real owner of the Constitution as constitutive power; it considers the people who are the owners of the will of society. The concept of political constitutionalism emphasizes that constitutions, essentially political texts, must have the characteristics of a contract signed between political power and society, which in turn increases the socio-political legitimacy of constitutions. Although it is important in terms of being a constitution of society, the "constituent assembly" system applied in the 1961 Constitution was not democratic in terms of the constitution of the assembly and the lack of representation of the people. The 1961 Constitution adopted a number of provisions to achieve a pluralistic democratic regime. Perhaps the most important of these is the establishment of the Constitutional Court. The principle of the supremacy of the Constitution was not satisfied by being expressed at the theoretical level, but by the judicial review of the conformity of the laws to the constitution, real assurance and sanctions were provided. With the dual-parliamentary system, it is desired to prevent arbitrary applications based on the majority power of parliament. As to the field of rights and freedoms, systematic and detailed regulations have been made. However, amendments made in 1971 and 1973, along with all of these regulations, introduced regulations for the military authority to obtain privileges in the face of civilian authority.

Przedmiotem zaprezentowanej w artykule analizy jest samorząd korporacyjny, którego podstawę stanowi związek osób o przymusowym charakterze członkostwa. W tym kontekście kluczowe stało się scharakteryzowanie istoty i kierunków rozwoju samorządu terytorialnego jako fundamentu władzy lokalnej. Samorząd korporacyjny nie jest jednak pojęciem jednowymiarowym odnoszącym się wyłącznie do stosunków terytorialnych. Bardzo ważną rolę w systemie reprezentowania interesów określonych środowisk odgrywa także samorząd specjalny, który wyodrębnia się według innych kryteriów. W jego ramach wyróżnić możemy związki personalne, reprezentujące interesy osób wykonujących profesje zaufania publicznego oraz związki ekonomiczne, których zadaniem jest rzecznictwo interesów środowiska gospodarczego. Odpowiednio do zaprezentowanego powyżej podziału, w ramach samorządu specjalnego wyróżniamy samorząd zawodowy i gospodarczy. Warto zauważyć, że w kontekście takich procesów jak globalizacja, metropolizacja czy demokracja uczestnicząca na samorząd należy spojrzeć z nieco innej perspektywy, nie tylko przez pryzmat społeczności zorganizowanych terytorialnie, ale również z punktu widzenia przedsiębiorców oraz osób wykonujących profesje zaufania publicznego, a więc w kategoriach governance. Jest to szczególnie istotne ze względu na potrzebę poszukiwania nowych, efektywnych i równoprawnych form współpracy pomiędzy jednostkami samorządu terytorialnego a organizacjami samorządu specjalnego. ; The analysis presented in this paper concerns corporate self-regulatory associations (in Polish: samorząd korporacyjny) based on the principle of mandatory mem- bership of individuals. In this context, it was necessary to outline the nature and directions of development of local governments (in Polish: samorząd terytorialny) as the core of local authorities. A corporate self-regulatory association, however, is not a unidimensional term that exclusively concerns territorial relations. The system that represents the interests of certain circles also encompasses a highly significant type of special self-regulatory entities (in Polish: samorząd specjalny) identified by different criteria. This includes personal associations that express the interests of individuals representing professions of public trust and business associations whose task is to act in the name of different economic circles. This division is reflected by professional and business self-regulatory associations respectively (in Polish: samorząd zawodowy and samorząd gospodarczy). In the context of globalisation, metropolisation and participatory democracy, self-regulatory associations should be viewed from a slightly different perspective - not only through the prism of communities organised in terms of territories, but also from the point of view of persons who perform professions of public trust, that is in terms of governance. This is particularly important on account of the necessity to seek new, effective and equal forms of collaboration between local government units and the organisations of special self-regulatory associations.

Neoliberal hegemonya, toplumların sadece ekonomik ve siyasi yapılarını değiştirmekle kalmamış aynı zamanda bu toplumların üyeleri olarak neoliberal öznelerin duygusal dünyalarını da dönüştürmüştür. Günümüzde hegemonik neoliberal düzenin sürdürülmesinde hazzın üstünlüğü ve acının müstehcenleştirilerek yok edilmesi iki temel duygulanım biçimi olarak ortaya çıkmaktadır. Neoliberal toplumlar farklı düşünürlerce farklı biçimlerde tasvir edilmişlerdir. Palyatif toplumdan akışkan modern toplumlara kadar birçok toplum modelinin betimlenmesinin temelinde neoliberal siyasal rasyonaliteye hakimiyet vurgusu yatmaktadır. İçinde yaşadığımız toplumda yaşam ve verimlilik övülürken acı ve olumsuzluk gizlenmektedir. Neoliberal toplumlar birer performans ve olumluluk toplumlarıdır. Bu makalede acının toplumsal ve siyasal gelişime koşut bir biçimde gelişiminin ana momentleri vurgulanmaya çalışılacaktır. Bunun için toplumsal gelişmenin üçlü doğası üzerinden bir düşünce geliştirilerek acının da üçlü doğası olabileceği iddia edilecektir. Modernlik öncesi pastoral acıdan, acının ahlakileştirildiği neoliberal topluma uzanan süreçte acının dönüşümü üzerinde durulacaktır. Sonuçta insanın siyasal bir hayvan olduğu vurgusuyla, içinde bulunduğumuz neoliberal haz toplumunda yerinden edilmiş acının doğası üzerine düşünme teşvik edilecektir.

Türkiye'de siyaset, geçmişten bugüne her daim bir "merkez" temelinde şekillendirilmiştir. Merkez, hem yönetim gücünün belirleyicisi hem de idarenin uygulayıcısı konumunda olmuştur. Buna karşılık taşraya; merkezin hükümlerinin uygulayıcılığını yapmak ve merkezin askeri, tarımsal, beşeri ve bunun gibi birçok alandaki sermayeye dayalı ihtiyaçlarını karşılamak şeklinde roller biçilmiştir. Dolayısıyla merkez açısından taşra, siyasal sermaye bağlamında düşünüldüğünde, siyasal idareye ortak olabilme rüştüne haiz görünmemiştir. Bundan dolayı taşranın merkeze yönelik çeşitli refleksleri de ya görmezden gelinmiş ya da bastırılmaya çalışılmıştır. Böylelikle taşra; hem siyasal yönetim hem de toplumsal bağlamda, ötekileştirilen, dışlanan ve küçümsenen bir politikaya maruz kalmıştır. Oysa taşra, sadece merkezin iaşesini ve insan sermayesini karşılamakla mükellef coğrafi bir alan olmanın ötesinde bir rezerve ve pratiğe sahiptir. Taşra, gündelik siyasal yaşam pratikleri ve merkezi yakından takip etmesiyle, siyasetin önemli bir aktörüdür. Kaldı ki taşra, pasif ve güçsüz bir yapıya sahip gibi görünse de, esasında merkezi çepeçevre kuşatan bir yetkinlikte ve dirayettedir. Bu çalışmada, öncelikle merkez-çevre teorisi bağlamında taşranın tarihsel ve siyasal gelenek bakımından ne tür rollere sahip olduğu üzerinde durulacaktır. Bununla birlikte bir çevre olarak taşranın siyasal kültürdeki konumu ele alınacaktır. Ayrıca taşranın geçmişten günümüze temsiliyetlerine ve siyasette ve idarede taşranın ötekileştirildiğine dikkat çekilecektir. Son olarak ise, günümüz taşrasından insan manzaralarına, toplumsal tiplere, siyasal aktörlere ve politik ilişkilere yer verilerek merkez-taşra diyalektiğinin görünümleri üzerinde durulacaktır. ; Politics in Turkey has been always shaped on the basis of a "center" from the past to present. Center has been in position both as the determinant of government forces and the practitioner of political administration. In contrast to this, the country is given the roles that is being a practitioner of the central provisions and to satisfy the center's need based on capital such as the military, agricultural, human and in many areas like this. Thus, in the face of center, the country has been recognized as being unable to be included in political governance when it is considered within the context of political capital. Therefore, the country's various reflexes to the centre either have been ignored or have been tried to be suppressed. Thus, country has been exposed to a policy that is marginalized, excluded and despised in both political management and social context. However, the country, beyond being a geographical area that only supplies center's needs and human capital, has a reserved and practical side. The country, with her daily practices in political life and her close pursuit of centre, is a significant player in politics. Besides, although the country seems to have passive and weak structure, actually it has an ability and power in surrounding center circumferentially. In this study, primarily in the context of center-periphery theory, the focus will be on what kinds of roles the country keeps in terms of historical and political traditions. In addition to this, the position of the country as a periphery at political culture will be discussed. It will also draw attention to the country's representation from the past to the present and the country that is marginalized in politics and in administration. Finally, the appearances of dialectical structures among center and the country will be focused on by illustrating people living in the country, the social types, the political actors and political relations observed in the country.
