Articulando as noções de regime de verdade, práticas discursivas e política de escândalo, o texto avança na descrição da formação de uma articulação das classes dominantes, corporações da mídia, Ministério Público e Poder Judiciário para destruir as possibilidades eleitorais das forças de esquerda no Brasil, abrindo caminho para a implementação do receituário neoliberal. O Estado e o mercado são instituições complementares. O Estado é a instituição principal que coordena as sociedades modernas; é o sistema constitucional e a organização que o garante; é o principal instrumento por meio do qual as sociedades democráticas estão moldando o capitalismo de modo a alcançar seus próprios objetivos políticos. Os mercados são instituições baseadas na competição regulada pelo Estado para que contribuam com a coordenação da economia. Enquanto o liberalismo emergiu no século XVIII para combater o Estado autocrático, desde os anos 1980 o neoliberalismo (uma distorção maior do liberalismo econômico) tornou-se dominante e montou um assalto ao Estado em nome do mercado, mas eventualmente também atacou o mercado. A macroeconomia neoclássica e a teoria da escolha pública foram as metaideologias que deram a esse assalto um apelo "científico" e matemático. ; State and market are complementary institutions. The state is the major institution coordinating modern societies; it is the constitutional system and the organizations guaranteeing it; it is the main instrument through which democratic societies have been changing capitalism so as to achieve their own agreed political objectives. Markets are institutions based on competition which the state regulates so that they contribute to the coordination of the economy. While liberalism emerged in the 18th century to fight an autocratic state, since the 1980s neoliberalism (a major distortion of economic liberalism) became dominant and mounted a political assault to the state in the name of the market, but eventually also attacked the market. Neoclassical macroeconomics and public choice theory were the meta-ideologies that gave to this assault a "scientific" and mathematical allure.
OBJECTIVE: To analyze the recommendations of international organizations based on the Washington Consensus on health system reforms of selected countries in Latin America and the Caribbean in the 1980s and 1990s and to investigate the effects of the competitive market logic on public action in the health system. METHODS: Comparative analysis of the characteristics of health system reforms conducted in the 1980s and 1990s, still seen in Brazil, Argentina, Chile, Colombia, Mexico and Peru. Data were collected by documental analysis and literature review. The systems were described based on the characteristics of: co-payment, privatization mechanisms, decentralization, fragmentation of the system, integration of funding sources and coverage of the population (universal or segmented). RESULTS: The reforms were implemented differently, worsening inequalities in health service delivery systems. Changes related to the neoliberal idea of transforming public action in the direction of private logic point to the predominance of competition rules and the reduction in economic costs in all countries analyzed, contrary to the logic of universal health systems. CONCLUSION: The reduction in economic costs, the fragmentation of systems and inequalities in the provision of health services, among others, may mean other future costs resulting from low protection to the population's health. A striking and multidimensional counter-reform is essential to make health a right of all again, in a solidarity system that can lead to the reduction in inequalities and a more democratic society. ; OBJETIVO: Analisar as recomendações dos organismos internacionais pautadas no Consenso de Washington para as reformas dos sistemas de saúde de países selecionados da América Latina e Caribe nas décadas de 1980 e 1990 e investigar os efeitos da lógica concorrencial de mercado sobre a ação pública nos sistema de saúde. MÉTODOS: Análise comparada de características das reformas dos sistemas de saúde realizadas nas décadas de 1980 e 1990, presentes até o momento no Brasil, Argentina, Chile, Colômbia, México e Peru. Os dados foram coletados por análise documental e revisão de literatura. Os sistemas foram descritos quanto às características de: copagamento, mecanismos de privatização, descentralização, fragmentação do sistema, integração das fontes de financiamento e cobertura da população (universal ou segmentada). RESULTADOS: As reformas foram implementadas de forma variada, aprofundando desigualdades nos sistemas de prestação de serviços de saúde. As mudanças, ao serem relacionadas à ideia neoliberal de transformar a ação pública na direção da lógica privada, apontam para o predomínio das regras da concorrência e da redução dos custos econômicos em todos os países analisados, contrariando a lógica dos sistemas universais de saúde. CONCLUSÃO: A redução dos custos econômicos, a fragmentação dos sistemas e as desigualdades na prestação de serviços de saúde, entre outros, poderão significar outros custos futuros decorrentes da baixa proteção à saúde da população. É imprescindível uma contrarreforma contundente e multidimensional, que retome a saúde como direito de todos, em um sistema solidário que possa levar à redução das desigualdades e a uma sociedade mais democrática.
Dynamics of capitalism have been under-researched within mediatization studies and this paper aims to contribute to filling in some blanks in this regard, by including a critical political economy angle into the mediatisation approach undertaken. In order to do this, the paper focuses on the neoliberal order and explores how such an environment changes the settings in which the mediatisation of politics takes place. The article argues that the neoliberal order in which the media operate is reconfiguring the role of journalism in the mediatisation process. Instead of expressing public concerns and public interest, or perspectives of civil society and other accountability institutions, there is a high level of pressure for the media to perform a role as a colonizing agent of neoliberalism. Hence, as producers of meaning, the media tend to reinforce and naturalize a neoliberal culture in benefit of political and economic elites' worldviews. ; La dinámica del capitalismo ha sido poco investigada en los estudios dedicados a pensar la mediatización. Este artículo pretende contribuir a llenar algunos vacíos tomando en cuenta una perspectiva crítica de la economía política en el análisis de los procesos de mediatización. El interés está centrado en analizar las condiciones bajo las cuales se practica el periodismo actual y cómo estas condiciones alteran la mediatización de la política. El artículo sostiene que el entorno neoliberal en el que operan los medios está reconfigurando el papel del periodismo: en lugar de expresar preocupaciones críticas y orientarse para representar el interés público, o las perspectivas de la sociedad civil y otras instituciones de rendición de cuentas, existe una gran presión para que los medios trabajen como agentes de colonización interna del neoliberalismo. Se argumenta que, como productores de significado, los medios refuerzan y naturalizan las políticas neoliberales en beneficio de la cosmovisión de las élites políticas y económicas que promueven dichas políticas. ; As dinâmicas do capitalismo têm sido sub-pesquisadas nos estudos em mediatização e este artigo pretende contribuir para preencher algumas lacunas a este respeito,integrando um ângulo crítico da economia política na análise dos processos de mediatização. Para tal, centramos o nosso foco nas condições em que o jornalismo é atualmente exercido e de que modo tais condições alteram a mediatização da política. O artigo argumenta que o ambiente neoliberal onde os media operam está a reconfigurar o papel do jornalismo no processo de mediatização política. Em vez de expressar preocupações críticas e orientar-se para representar o interesse público, ou as perspectivas da sociedade civil e de outras instituições de prestação de contas, existe uma elevada pressão para que os media trabalhem como agentes de colonização interna do neoliberalismo. Argumentamos que, enquanto produtores de sentido, os media reforçam e naturalizam o neoliberalismo em benefício da mundividência das elites políticas e económicas neoliberais.
Objective: to understand how the contradictions and tensions of neoliberal policy, materialized in precarious work, affect nursing workers' mental health in the context of the COVID-19 pandemic. Method: this is a study with a qualitative and descriptive approach, analyzed in the light of neoliberal economic policy. Data were collected through virtual means, with the participation of 719 nursing workers, from April to June 2020. To organize the data, the IRaMuTeQ® software and thematic analysis were used. Results: the reports revealed the lack of value of workers and the loss of social labor rights; the progressive nature of the neoliberal policy, its threats and repercussions on workers' mental health; and recognition by female workers that political and class participation does not occur in isolation, but collectively. Conclusion: under the aegis of neoliberal policy, the COVID-19 pandemic brought an upsurge precarious work, influencing nursing workers' subjectivity and mental health. ; Objetivo: comprender cómo las contradicciones y tensiones de la política neoliberal, materializadas en la precariedad del trabajo, afectan la salud mental de los trabajadores de enfermería en el contexto de la pandemia de COVID-19. Método: se trata de un estudio con enfoque cualitativo y descriptivo, analizado a la luz de la política económica neoliberal. Datos recolectados a través de medios virtuales, con la participación de 719 trabajadores de enfermería, de abril a junio de 2020. Para organizar los datos se utilizó el software IRaMuTeQ® y análisis temático. Resultados: los informes revelaron la desvalorización de los trabajadores y la pérdida de los derechos sociolaborales; el carácter progresivo de la política neoliberal, sus amenazas y repercusiones en la salud mental de los trabajadores; y el reconocimiento por parte de las trabajadoras de que la participación política y de clase no se da de forma aislada, sino de forma colectiva. Conclusión: bajo la égida de la política neoliberal, la pandemia de COVID-19 provocó un recrudecimiento de la precariedad laboral, incidiendo en la subjetividad y la salud mental de los trabajadores de enfermería. ; Objetivo: compreender como as contradições e tensões da política neoliberal, materializadas na precarização do trabalho, repercutem na saúde mental das trabalhadoras da enfermagem no contexto da pandemia de COVID-19. Método: trata-se de estudo de abordagem qualitativa e descritiva, analisado à luz da política econômica neoliberal. Dados coletados por meios virtuais, com participação de 719 trabalhadoras de enfermagem, no período de abril a junho de 2020. Para a organização dos dados, foi utilizado o software IRaMuTeQ® e análise temática. Conclusão: sob a égide da política neoliberal, a pandemia de COVID-19 trouxe um recrudescimento da precariedade do trabalho, influenciando na subjetividade e na saúde mental das trabalhadoras de enfermagem.
Water resources management has become a prominent issue in Brazil's regional political agendas but understanding the limits of its practices and policy choices is yet to be achieved. This article presents an analysis of environmental management in the state of Minas Gerais during 1995-2014, a period characterized by a neoliberal political and economic approach. It seeks to identify possible trends, limitations, and possibilities for institutional and administrative development in this area. The research included a revision of documents dealing with the insertion of public policies in the institutional agendas linked directly or indirectly with the management of water resources. These documents cover legal, legislative, and executive aspects of State performance in this sector, as well as information related to the models of environmental management implemented in the State of Minas Gerais, during the period of study. The conclusions suggest that the practices of water resources management in the State were greatly influenced by neoliberal prescriptions, whether by the increase in the institutional public deficit of the environmental sector or by the contextual and political difficulties facing the implementation of long-term integrated management of water resources.
The paper initially asks what can be understood by neoliberal city in Latin America in the 1990s and presents some reflections on events that have marked the history of cities. It identifies the categories of the past that clarify the ones that are currently in use in investigations, mainly those referring to systems that organize a specific domain: the metropolis in Latin America. As in anywhere else, the neoliberal city is the financialized city, where construction, in all its forms, in the entire urban territory which is now part of bank assets, leads to the privatization of old services and to the diffusion of new services, which are almost exclusively private. This definition encompasses practically all the cities of Latin America, large and medium-sized, and even diverse cities like São Paulo and Tegucigalpa. The text highlights six analysis paradigms that have guided important research studies on the Latin American urbanization process, allowing to analyze the simultaneity and the similarity of this process in different countries and in different periods of time. ; En Europe, l'existence d'un modèle de ville latino-américaine passe presque pour une évidence. Mais il inclut beaucoup de clichés qui ne sont pas valides partout. Culture et cultures politiques sont les champs qui soutiennent ce modèle, elles-mêmes construites sur l'image et la mémoire qu'ont les sociétés de leur propre dimension temporelle et sur la contemporanéité aux échelles urbaines et/ou nationales des événements qui forment "une mise au présent du passé". ; A partir da indagação sobre o que se pode entender por cidade neoliberal na América Latina nos anos 1990, o artigo apresenta algumas reflexões sobre eventos que pontuaram a história das cidades, identificando quais são as categorias do passado que esclarecem as atualmente em uso nas investigações e, principalmente, as referentes aos sistemas que organizam um domínio particular: a metrópole na América Latina. Como em qualquer parte, a cidade neoliberal é a cidade financeirizada, onde a construção sob todas as suas formas, em todo o território urbano que faz agora parte dos ativos bancários, conduz à privatização dos antigos serviços e à difusão de novos serviços quase exclusivamente privados. Esta definição abarca praticamente todas as cidades da América Latina, grandes e médias, e até mesmo cidades tão diversas quanto São Paulo e Tegucigalpa. O texto destaca seis paradigmas de análise, orientadores de importantes trabalhos de pesquisa sobre o processo de urbanização latino-americano, permitindo analisar a simultaneidade e a similaridade desse processo em diferentes países e em diferentes períodos de tempo.
O presente trabalho apresenta como pressuposto que o currículo não é apenas uma organização de disciplinas, nem um rol de conteúdos a serem ensinados. Considera-se que o currículo envolve diferentes ações do processo educativo, desde formas sobre a estrutura do funcionamento escolar, passando pela arquitetura e distribuição dos tempos e espaços escolares, a seleção de saberes, a organização e oferta das atividades de ensino, a correção das posturas dos corpos, indo até os discursos que acabam por dizer o que é esperado ou não dos sujeitos da educação. Além disso, por ser uma política de Estado, no processo de selecionar o que constituirá o currículo está o projeto de sujeito que se pretende para a sociedade. Sendo assim este artigo faz parte de uma pesquisa mais ampla a respeito das políticas curriculares promovidas pela Secretaria Municipal de Campinas. Toma como objeto de investigação as Diretrizes Curriculares do município para a educação física. Analisa as concepções referentes ao objeto de conhecimento da educação física e os objetivos anunciados para o componente. Considera a análise de documentos como método e utiliza as teorias de currículo e os estudos acerca das políticas curriculares, a fim de significar seus efeitos. Os resultados indicam que as Diretrizes para o componente apresentam inconsistências epistemológicas e didáticas. Infere que essa situação ocasionará dificuldades para a prática docente e, com isso, o acirramento da disputa pelo controle da agenda de políticas de formação de professores, favorecendo a racionalidade política neoliberal. ; This study presents the assumption that the curriculum is not only an organization of subjects, nor a list of contents to be taught. It considers that the curriculum involves different actions of the educational process, from forms about the structure of school functioning, passing through the architecture and distribution of school times and spaces, the selection of knowledge, the organization and offer of teaching activities, the correction of body postures, to the speeches that end up saying what is expected or not from the subjects of education. Besides this, since it is a State policy, the process of selecting what will constitute the curriculum includes the project of subjects who will be educated for society. Thus, this article is part of a broader research on curriculum policies promoted by the Municipal Secretariat of Campinas. It takes as its object of investigation the municipality's Curricular Guidelines for physical education. It analyzes the conceptions regarding the object of knowledge of physical education and the goals announced for the component. It considers document analysis as a method and uses curriculum theories and studies on curriculum policies to understand its effects. The results indicate that the Guidelines for the component present epistemological and didactic inconsistencies. This probably means that this situation will cause difficulties for the teaching practice and, thus, the dispute for the control of the teacher education policy agenda will intensify, favoring neoliberal political rationality.
Since the end of the 1970s, capitalism experienced a regressive phase – neoliberal rentier-financier capitalism – and, since 2008, has entered a terminal crisis. Capitalists ceased to control the process of capital accumulation and innovation that legitimized them, and capitalism stop to produce economic development and human progress. In its place, a new social organization is emerging that the author calls "democratic managerialism", in which the class of managers or technobureaucrats once again became stronger and constituted the nucleus of the new dominant class coalition. At thesame time, democracy has been facing the authoritarian challenges well and it is possible to predict that it will deepen in democratic managerialism. ; Desde finales de la década de 1970, el capitalismo experimentó una fase regresiva – capitalismo neoliberal financierorentista– e, desde 2008, ha entrado en una crisis terminal. Los capitalistas dejaron de controlar el proceso de acumulaciónde capital e innovación que los legitimaba, y el capitalismo dejó de producir desarrollo económico y progreso humano.En su lugar, está emergiendo una nueva organización social que el autor denomina "gerencialismo democrático", en laque la clase de gerentes o tecnoburocratas nuevamente se fortaleció y constituyó el núcleo de la nueva coalición de clasesdominante. Al mismo tiempo, la democracia ha enfrentado bien los desafíos autoritarios y es posible predecir que seprofundizará en el gerencialismo democrático. ; A partir do final dos anos 1970, o capitalismo experimentou uma fase regressiva – o capitalismo neoliberal financeiro rentista – e, desde 2008, entrou em crise terminal. Os capitalistas deixaram de controlar o processo de acumulação de capital e inovação que os legitimava, e o capitalismo deixou de produzir desenvolvimento econômico e progresso humano. Em seu lugar, está surgindo uma nova organização social, que o autor denomina "gerencialismo democrático", no qual a classe dos gerentes ou tecnoburocratas voltou a se fortalecer e a constituir o núcleo da nova coalisão de classes dominantes. Ao mesmo tempo, a democracia vem enfrentando bem o desafio autoritário, e é possível prever que ela se aprofundará no gerencialismo democrático.
The article analyzes the university democratic management from a theoretical-political reflection on the contradictions of the capitalist State as an instance of domination and bourgeois power in the context of neoliberal policies. The theoretical reference is Florestan Fernandes´ conception of democracy and bourgeois- autocracy in countries with dependent and underdeveloped capitalism. The procedures are a theoretical study based on references to the concepts of democracy, education management, university autonomy and neoliberal policies. The limitation of the constitutional principle of university autonomy resulted in a restriction of democratic management by the managerial model and by the neoliberal project. ; El artículo analiza la gestión democrática universitaria desde una reflexión teórico-política de las contradicciones del Estado capitalista como instancia de dominación y poder burgués en el contexto de las políticas neoliberales. El referencial teórico es la concepción de Florestan Fernandes de la democracia y la autocracia burguesa en países con capitalismo dependiente y subdesarrollado. Los procedimientos son un estudio teórico que tiene como referencia los conceptos de democracia, gestión educativa, autonomía universitaria y políticas neoliberales. La limitación del principio constitucional de autonomía universitaria produjo una restricción a la gestión democrática por el modelo de gestión gerencial y por el proyecto neoliberal. ; O artigo analisa a gestão democrática universitária a partir de uma reflexão teórico-política das contradições do Estado capitalista como instância de dominação e poder burguês no contexto das políticas neoliberais. O referencial teórico é a concepção de Florestan Fernandes de democracia e autocracia-burguesa em países de capitalismo dependente e subdesenvolvido. Os procedimentos são um estudo teórico que faz referências aos conceitos de democracia, gestão da educação, autonomia universitária e as políticas neoliberais. A limitação do princípio constitucional de autonomia universitária produziu uma restrição da gestão democrática pelo modelo de gestão gerencial e pelo projeto neoliberal.
This article examines the concept of 'populism' in the light of its neoliberal opponents' discourse. The heuristic scope of the term, which its current political use has been devaluing, both in lay and scientific debates, is put into question. Starting from Quentin Skinner's theory, we propose a political reading of the concept and postulate that its use (and, therefore, the content assigned to it) teaches us much (or more) about the person, movement, or party using it than about the party or the person that it designates. The anti-populist discourse is at the same time a rejection of the people/ethnos (nationalism as the essence of populism), a denial of the people/démos (populism as a pathology of democracy because it establishes the tyranny of majority against the elite), an accusation of the people/pléthos (the fragile mass manipulated by a leader and the intellectuals), and a critique of the 'idolatry of State' on the part of populists who oppose economic liberalism in the name of an obsessive egalitarianism. We conclude that 'populism' is a 'kampfbegrief' (a 'battle concept'), as totalitarianism once was and it may be seen as a continuation of Cold War anticommunism. ; Este artículo examina el concepto de "populismo" a la luz del discurso de sus oponentes neoliberales. Se cuestiona el alcance heurístico del término, que su uso político actual ha ido desvalorizando, tanto en los debates profanos como en los científicos. Partiendo de la teoría de Quentin Skinner, se propone una lectura política del concepto y se postula que su uso (y el contenido por ende que se le da) nos enseña tanto (o más) sobre la persona, el movimiento o el partido que lo usa que sobre el partido o la persona que designa. El discurso antipopulista es a la vez un rechazo del pueblo/etnos (el nacionalismo como esencia del populismo), una negación del pueblo/démos (el populismo como patología de la democracia porque establece la tiranía de la mayoría en contra de la élite), una acusación al pueblo/pléthos (la masa frágil manipulada por un líder e intelectuales) y una crítica a la "estadolatría" de los populistas opuestos al liberalismo económico en nombre de un igualitarismo obsesivo. Se concluye que el "populismo" es un "kampfbegrief" (un "concepto de combate"), como lo fue otrora el totalitarismo y puede entenderse como una continuación del anticomunismo de la Guerra Fría.
With the rise of neoliberalism and the deflation of socialist perspective, the left-wing field has been criticized for taking the identity issue as its main engine for social struggles. This article aims to analyze this identitarian debate in the 2018 electoral campaign in Brazil. The polarization on the issue in the discourses of two left-wing parties will be considered – Partido dos Trabalhadores (PT) and Partido Socialismo e Liberdade (PSOL) – in relation to the discourses of the conservative party Partido Social Liberal (PSL). The intention is to observe those positions in a social network, noticing and problematizing the limits of the struggles for identity and recognition that guides the political debate. ; With the rise of neoliberalism and the deflation of socialist perspective, the left-wing field has been criticized for taking the identity issue as its main engine for social struggles. Serão consideradas as polarizações sobre o tema entre os dois partidos localizados à esquerda do espectro político – PT e PSOL – em relação à campanha majoritária do campo localizado à direita, representada pelo PSL. The polarization on the issue in the discourses of two left-wing parties will be considered – Partido dos Trabalhadores (PT) and Partido Socialismo e Liberdade (PSOL) – in relation to the discourses of the conservative party Partido Social Liberal (PSL). The intention is to observe those positions in a social network, noticing and problematizing the limits of the struggles for identity and recognition that guides the political debate.
Much has been said about teacher training. This is not a new speech; however, it is gaining new contours every day, as there is a latent concern about teacher training. This concern is not only related to the legitimacy of this training, but to the way it is taking place, its real conditions and its scenarios. The debate on teacher training has always been present in the Brazilian educational scenario, revolving around teaching, the curriculum, the teacher-student relationship, the teaching and learning process and the articulation between theory and practice. Thus, we bring to the focus of our discussion the political, economic, cultural and social context in which these relationships take place. The transformations that have been taking place worldwide, especially those related to the phenomenon of globalization, scientific and technological advances, in addition to the adherence to a neoliberal project for education, bring with it an immediate and urgent demand for the professionalization of teaching. All of this motivates the questioning regarding the formation and performance of teachers in the face of the challenges imposed by capitalist society. ; Se ha hablado mucho sobre la formación del profesorado. Este no es un discurso nuevo; sin embargo, está ganando nuevos contornos cada día, ya que existe una preocupación latente por la formación del profesorado. Esta preocupación no solo está relacionada con la legitimidad de esta formación, sino con la forma en que se desarrolla, sus condiciones reales y sus escenarios. El debate sobre la formación docente siempre ha estado presente en el escenario educativo brasileño, girando en torno a la enseñanza, el currículo, la relación profesor-alumno, el proceso de enseñanza y aprendizaje y la articulación entre teoría y práctica. Por lo tanto, traemos al centro de nuestra discusión el contexto político, económico, cultural y social en el que se desarrollan estas relaciones. Las transformaciones que se han venido produciendo a nivel mundial, especialmente las relacionadas con el fenómeno de la globalización, los avances científicos y tecnológicos, además de la adhesión a un proyecto neoliberal de educación, traen consigo una demanda inmediata y urgente de profesionalización de la docencia. Todo ello motiva el cuestionamiento sobre la formación y desempeño de los docentes frente a los desafíos impuestos por la sociedad capitalista. ; Muito se tem falado acerca da formação docente. Não se trata de um discurso novo; entretanto, ganha a cada dia novos contornos, pois há uma preocupação latente quanto à formação de professores. Essa preocupação não diz respeito apenas à legitimidade dessa formação, mas ao modo como ela está ocorrendo, suas reais condições e seus cenários. O debate sobre formação de professores sempre esteve presente no cenário educacional brasileiro, girando em torno da docência, do currículo, da relação professor e aluno, do processo de ensino e aprendizagem e da articulação entre teoria e prática. Assim, trazemos para o foco de nossa discussão, o contexto político, econômico, cultural e social em que essas relações acontecem. As transformações que vêm ocorrendo em nível mundial, em especial os relacionados ao fenômeno da globalização, os avanços científicos e tecnológicos, além da adesão de um projeto neoliberal para educação, trazem consigo uma exigência imediata e urgente no sentido da profissionalização do magistério. Tudo isso motiva o questionamento com relação à formação e à atuação dos professores frente aos desafios impostos pela sociedade capitalista.
Community Land Trusts are established models designed to protect the maintenance of vulnerable communities in certain territories. The figure emerges in the United States in the 1960s, tied to civil rights movements and the population living in rural areas. The present article will evaluate the potentialities and limits of the application of the Community Land Trusts instrument in Brazil as resistance and biopotent practice in an urban space marked by high percentages of irregularity and by a serious situation of socio-spatial inequality. In a context that worsens after the mega-events at the beginning of the second decade of the twenty-first century and with the democratic rupture and deepening of neoliberal logic in cities from 2016 onwards, it is necessary and urgent to establish new practices and forms of property management in a way to draw possible subversions to the logic of Power. CLTs are proposed here as a form of subversive legal practice, either from the defense of the design of a specific legislation on the subject, or by the use of existing legal instruments in order to base the creation of an emancipatory proprietary model. ; O Community Land Trust é um modelo estabelecido com vistas à proteção de permanência de comunidades vulneráveis. Ela surge nos Estados Unidos, na década de 1960, atrelada aos movimentos por direitos civis e à população residente em áreas rurais. Este artigo busca avaliar as potencialidades e os limites de sua aplicação no Brasil enquanto resistência e prática biopotente em um espaço urbano marcado por elevados percentuais de irregularidade e por uma grave situação de desigualdade socioespacial. Em um contexto que agrava após os megaeventos no início da segunda década do século XXI e com a ruptura democrática e o aprofundamento da lógica neoliberal nas cidades a partir de 2016, torna-se necessário e urgente o estabelecimento de novas práticas e formas de gestão da propriedade que desenhem possíveis subversões à lógica do Poder. Os Community Land Trusts são propostos aqui como forma de prática jurídica subversiva, seja a partir da defesa da necessidade de uma legislação própria sobre o tema, seja pela utilização dos instrumentos jurídicos já existentes de forma a basear a criação de um modelo proprietário emancipatório.
