Zusammenfassung Der Beitrag diskutiert die Positionierung und die Rolle der Selbsthilfegebilde im Neo-Korporatismus des bundesdeutschen Gesundheitswesens. Dabei bilden sich gewisse Ambivalenzen einer Dialektik heraus, die mit gegenläufigen Trends in der Entwicklung korreliert sind. Einerseits fördern die parafiskalischen öffentlich-rechtlichen Sozialversicherungen des staatsmittelbaren Sektors im § 20h SGB V die genossenschaftsartigen Selbsthilfegruppen (Gebilde der selbstorganisierten und selbstverwalteten Gegenseitigkeitshilfe) und die regionalen Kontakt- und Informationsstellen zur Förderung der Selbsthilfe im lokalen Sozialraum als Sozialkapitalbildung (Lebensweltorientierung in der Förderung der Caring Communities), andererseits werden die Bundes- und Spitzenverbände der Selbsthilfe als Selbsthilfeorganisationen gefördert, die u.a. gemäß § 140f SGB V in die institutionellen Mechanismen der gemeinsamen Selbstverwaltung als Systemlogik funktional integriert werden. Die Selbsthilfebewegung steht damit am Scheideweg – zumindest im Spannungsfeld – zwischen Lebensweltorientierung einerseits und "Kolonialisierung" durch das System andererseits. Abstract The German health care system is organized as an order of collective self-governance in the tradition of neo-corporatism. Part of the political grammar, social health insurances are para-fiscal self-governed institutions with relative autonomy in relation to the state sector. The paper is discussing the role of the health-related self-help movement in this German health care system. § 20h Social Security Code V includes on the one hand financial contributions to mutual aid groups and regional agencies to promote self-help groups in the context of local networks as social capital formation and on the other hand financial contributions to trans-regional and national self-help organizations, which are, as a channel of political participation of patient's perspectives, also involved in the politics of the collective self-governance of the German healthcare systems, anchored in § 140f Social Security Code V. Therefore, we can, connected with several ambivalences, obtain the dialectics of different trends in the development of the role and role settings of the self-help movement: On the one hand the promotion of self-help groups as integrated parts of the Caring Community Building, on the other hand the instrumental functionalism of colonizing the self-help movement by institutional mechanism of involving participation of patient's perspectives into the collective self-governance of the system.

This paper draws some bold conclusions from modest premises. My topic is an old one, the Neohumean view of practical rationality. First, I show that this view consists of two independent claims, instrumentalism and subjectivism. Most critics run these together. Instrumentalism is entailed by many theories beyond Neohumeanism, viz., by any theory that says rational actions maximize something. Second, I give a new argument against instrumentalism, using simple counterexamples. This argument systematically undermines consequentialism and rational choice theory, I show, using detailed examples of their many social science applications. There is no obvious fix.

Die Übergänge der alten in die neue Welt des Miteinanders sind jedoch voller Widersprüche, Konflikte und Ambivalenzen. In diesem normativen Lichte der Inklusionsgrundrechte gibt es keine ausgegrenzten "Sonderwelten". Der homo patiens in allen seinen Erscheinungsformen im Lebenszyklus (als chronisch Kranker, als Mensch mit Behinderungen, mit Demenz oder als pflegeb.

Die Würde des Menschen ist unantastbar - dieses unbedingte Recht ist völker-, europa- und verfassungsrechtlich verbürgt. Dass die Würde des Menschen jedoch auch im säkularisierten sozialen Rechtsstaat letztendlich eine heilige Ordnung ist, kollektiv religiös geglaubt werden muss und sich nicht in einem rationalen Diskurs hinreichend wahrheitsfähig erweist, zeigt Frank Schulz-Nieswandt im Rekurs auf Böckenförde, Habermas, Joas und Agamben. Im Anschluss daran entfaltet er die Idee einer gottlosen Ontotheologie eines existenzialen personalistischen Humanismus, den er mit Verweis auf Paul Tillich und Romano Guardini zugleich gegen jeden Übergriff einer autoritären Theo-Dogmatik supranaturalistischer Art verteidigt.

Zusammenfassung Die Corona-Pandemie hat die Lebensqualität der Menschen in den Heimen als Einrichtungen der Langzeitpflege signifikant negativ geprägt. In der Dichte des stationären Settings wurden im Lichte eines "satt, sauber, trocken und still"-Dispositivs die ohnehin problematischen Strukturen der Entnormalisierung durch hospitalisierende Institutionalisierung eskalierend verstärkt. Selbstbestimmung und Teilhabe als Grundrechte im menschenrechtskonventionellen Sinne wurden pauschal ohne Risiko-bezogene Güterabwägungen zugunsten einer "Kasernierung" zum Zwecke der Sicherung des "nackten Lebens" dethematisiert. Die im Sektor ohnehin als Spuren struktureller Gewalt angelegten Mechanismen sozialer Ausgrenzung wurden im Krisenmanagement akzeleriert. Als Lehre aus diesen sozialen Praktiken muss über die Zukunft stationärer Settings radikal kritisch nachgedacht werden. Die Alternative ist eine Empowerment-orientierte investive Sozialpolitik als sozialraumorientierte Differenzierung der Wohnformen und ihren Care-Settings. Abstract: Normative Challenge of Including De-institutionalization of Long-term Nursing Under Conditions of the Corona Crisis The Corona pandemic is connected with a significant impact on the escalating reduction of the quality of life of old age in the settings of long-term nursing care. The heritage of given tradition of institutionalization as a culture of social exclusion as accelerating pathway towards a dispositive grammar of a regime of risk security and hygienic cleanliness of "naked life" in a limited activating atmosphere of "remain silent" dominating the valued of autonomy and inclusive participation as dimensions of dignity of human personhood. Social exclusion is a mode of performativity of structural violence. The critical result of the societal reflection about this social mechanism is to think about the alternative perspective of social investment in caring community-building as spatial social network supporting normal forms of living outside the institutions but within an inclusive normal social world of moral economy of social capital formation.
