Organizational means of ensuring the implementation of state anti-corruption policy in Ukraine ; Організаційні засоби забезпечення реалізації державної антикорупційної політики в Україні
The article is focused on the comprehensive study of methodological principles and practical aspects of the implementation of organizational means for the realization of state anti-corruption policy in Ukraine. The author has considered the main features of organizational and legal measures within public administration; has analyzed the main organizational means of ensuring counteraction to corruption within the public and power sphere. It has been stressed that the necessary prerequisite for the effective implementation of anti-corruption policy of the state is the proper provision of anti-corruption activities of the authorized subjects of combating corruption through the system of organizational means and legal guarantees. The author has distinguished the two broadest groups of organizational means and guarantees of anti-corruption policy implementation – general and special. The general include the following means and guarantees that are common to the whole process of public administration and the functioning of public authority in the whole, and the special – are those provided by the anti-corruption legislation to ensure the professional activities of the subjects of combating corruption taking into account the object, tasks and the objective of counteraction to corruption On the basis of the conducted analysis, the author has made certain conclusions: a) democracy occupies the central place among general organizational means and guarantees of the proper implementation of state anti-corruption policy; b) we should understand the result compared to the expenses for its achievement as organizational effectiveness of the implementation of anti-corruption policy in a democratic state; c) to ensure an adequate level of conducting anti-corruption expertise of regulatory acts of Ukraine, it is necessary to form an independent collegial agency – the National Commission of Anti-corruption Experts. At the same time the status of such an agency should be determined by a special law, and its chairman should be elected by the commission itself from among its members. ; Досліджено методологічні засади і практичні аспекти застосування організаційних засобів реалізації державної антикорупційної політики в Україні. Розглянуто основні ознаки організаційно-правових заходів у державному управлінні, проаналізовано основні організаційні засоби забезпечення протидії корупції в публічно-владній сфері. Застосовано системний підхід до аналізу організації процесу реалізації антикорупційної політики як ключового функціонального напряму публічного адміністрування в сучасній правовій державі. Сформульовано пропозиції щодо подальшого реформування уповноважених суб'єктів протидії корупції.
