The subject. The paper deals with the search for the place of judicial administrative procedural law in the system of Russian law.The purpose of the paper is to identify is the judicial administrative procedural law an independent branch of Russian law.Methodology. The author uses the methods of analysis and synthesis, as well as dialectic approach. The formal-legal interpretation of the Code of Administrative Proceedings, the Code of Administrative Offences, the Commercial Procedure Code, the Civil Procedure Code of the Russian Federation and is also used.The main results and scope of their application. The adoption of the Code of Administrative Proceedings in Russia in 2015 revealed many problems in science and legislation. A legislative decision to adopt the Code of Administrative Proceedings is considered as a political decision taken without a proper scientific basis and contrary to established scientific doctrine. Definitions of such basic concepts as "administrative process", "administrative dispute", "administrative justice", and others have not been developed in the period up to 2015 and to date, There is a mention of "administrative legal proceedings" as one of the types, along with civil, criminal and constitutional types of legal proceedings, in the Constitution of the Russian Federation. But administrative procedural legislation is referred to the joint jurisdiction of the Russian Federation and the constituent entities of the Russian Federation, in contrast to other procedural laws, in the Constitution of the Russian Federation. Representatives of the science of civil procedural law, with reference to legal theorists, called judicial administrative procedural law (which is referred to the Code of Administrative Proceedings) the secondary formation, a sub - branch of the fundamental (profiling) branch of civil procedural law. The purpose of judicial administrative procedural law – enforcement of substantive law and conflict resolution in the field of administrative and other public relations. It is noted that the public-legal dispute is not limited to the interaction of the citizen with the executive power. Civil procedural regulation of judicial review of cases arising from public relations is a procedural mechanism of judicial protection of constitutional rights, freedoms and legitimate interests. The Code of Administrative Proceedings lowers the status of cases arising from public legal relations to the status of cases arising from administrative legal relations. Representatives of the science of administrative law and procedure, on the contrary, believe that the adoption of the Code of Administrative Proceedings becomes the final act in the formation of a new branch of law – administrative judicial law, although it is a political decision and it's rules are practically copied from the Civil Procedure Code. At the same time, it is recognized that the Code of Administrative Proceedings needs scientific support, which still needs to be created. An alarming factor is the fact that some scientists propose to include cases concerning imposition of administrative sanctions in the this forming branch of law, although it mixes in fact disputes between individuals and a public entity and imposition of administrative sanctions to the offender by the court.Conclusions. It is premature to say that judicial administrative procedural law has emerged as an independent branch of Russian law. Prospects for further development of administrative proceedings are very uncertain due to the high proportion of subjective, political factors in the legislative process. ; Рассматривается поэтапное движение законодательства и научной мысли от неупорядоченного выделения «административных» дел, рассматриваемых судом, к единым процессуальным правилам. Обосновывается авторская точка зрения, что полярные мнения в науке, в совокупности с противоречивыми и непоследовательными действиями законодателя, в настоящее время не позволяют утверждать о наличии новой отрасли права, предметом которой стало бы рассмотрение различных административных дел. Одного лишь законодательного шага – принятия Кодекса административного судопроизводства – при существующей терминологической путанице, неопределенности с предметом и методами регулирования, недостаточно для утверждения новой отрасли права.

The study established the role of electronic evidence in the system of administrative procedures in Ukraine and in the member states of the Council of Europe. Direct observation, comparison and analysis of the content of the documents were used. The key results of the study were the peculiarities identified from the use of electronic evidence in administrative procedures among the 47 member states of the Council of Europe; established sources of creation, origin of electronic evidence to be used in administrative procedures; the resolute attitude of the European Court of Human Rights and the Committee of Ministers of the Council of Europe towards electronic evidence in administrative proceedings. Unlike paper documents, electronic documents require special attention to their review, search and involvement in the case. It is concluded that the study of electronic evidence should be approached from the point of view of the knowledge and skills of specialists, experts and interpreters who have the appropriate license and experience. The prospects for further investigations are establishing the importance of law enforcement agencies in the field of cybersecurity in ensuring the integrity of electronic evidence used in administrative proceedings.
A Escola Nacional da Magistratura da Venezuela (ENM) é um órgão administrativo judiciário localizado em Caracas, com compêtencia nacional. Para cumprir sua missão, debe usar tecnologias de informação e comunicação. No artigo, parte-se de uma análise dos processos, bem como dos atos administrativos da ENM. Em seguida, abordam-se os argumentos a favor e contra a suficiencia da legislação atual para usar as TIC na Administração, com especial destaque das formalidades que devem ser cumpridas de acordo com diversos textos legais do século XXI que modernizaram a lei de 1981, e, ao final, propõe-se como digitalizar a ENM. ; The National School of Judiciary of Venezuela (NSJ) is a judicial agency with administrative responsabilities located in Caracas with nationwide competencies. To fulfill its mission, it shall use Information and Communication Tecnologies (ICT). This paper begins analizing NSJ administrative procedures and acts. Then, the study is addressed toward the arguments, in favor and against, sufficiency of current legislation to use ICT in government, specially, considering the formalities that must be completed according to different 21st century laws that modernized the law of 1981. Finally, it is proposed how to modernize the NSJ.
The aim of this work is to show that the administrative law of a social and democratic state based on the rule of law is the right that the government has to freedom with solidarity. The method used is one specific to legal research, in this case, by means of argumentation and by showing the importance that the constitutional principles have on administrative law. The study opens with an introduction, in which the matter is presented, followed by an analysis of constitutional law and by a comment on the incidence of the social state clause on Public Administration and administrative law that leads to the main conclusion: the general interest in a social and democratic state based on the rule of law is inextricably connected to the promotion of people's fundamental, individual and social rights. The purpose of this paper is to address confidentiality in electronic public procurement, since current legislation in Uruguay determines that public procurement must be guided, in a very broad rule, by the principle of transparency, considering that it is the true basis of contracting democracy, which makes it the main instrument to combat corruption. It happens that the legal system foresees exceptions, in which the information can be classified as secret, reserved and confidential, as defined by the legislation. Finally, it addresses the Electronic Opening modality to be used by the Public Administration in its contracts. ; El propósito de este artículo es abordar la confidencialidad en la contratación pública electrónica, ya que la legislación vigente en Uruguay determina que la contratación pública debe guiarse, en una regla muy amplia, por el principio de transparencia, considerando que es el verdadero sustento de la contraer la democracia, lo que la convierte en el principal instrumento para combatir la corrupción. Ocurre que el ordenamiento jurídico prevé excepciones, en las que la información se puede clasificar como secreta, reservada y confidencial, según lo define la legislación. Nos planteamos analizar la emergencia de una concepción de otro cuerpo como superación del dualismo, donde se inscribe el lenguaje. El cuerpo otro, sustancia de goce, permite analizar el lenguaje y el discurso en cuanto estructura y acontecimiento. Este análisis es planteado para futuras reformulaciones de lo didáctico.

The evolution of symmetric and asymmetric armed conflicts has led to the proliferation of hybrid scenarios where threats move exponentially, generating multidimensional disputes impacting on the balance of power. From this approach, technology plays a major role in the development of artificial intelligence and the boom of algorithms in the service of military capabilities, the third revolution of war being a fait out, followed by the discovery of the explosive and the development of nuclear weapons. It is clear that investing hard resources and autonomous devices, industrial powers and emerging countries will lead to competition with serious implications for global governance. Latvian Autonomous Weapons Systems (LAWS) will have the power to select and attack targets without the need for any human intervention, where the selection and use of lethal force towards a target potential would be left to an autonomous choice. In this regard, artificial intelligence serving military capabilities would incorporate significant operational benefits and reduce the cost of lives of military members by incorporating a wider remote destructive reach, but would undermine the lack of control and human judgment in complex decisions, challenging the general rules governing both hostilities in the context of war and the protection of human dignity in armed conflicts.
