Este estudio se adentra en las cuestiones culturales que definen un grupo estamental que, como la ideología y la mentalidad, guiaban y dirigían su gusto estético. Por lo tanto, una de las preocupaciones centrales de esta investigación reside en indagar la importancia estética del vestido reflejada en la sociedad madrileña a partir de la segunda mitad del siglo XVII. En concreto, esta tesis trata de las relaciones establecidas entre las prendas y los actores sociales de los siglos XVII, XVIII y XIX. Se reflexiona también sobre la relación existente entre las influencias artísticas y estéticas de la indumentaria y el cambio social y su consecuente relación con los hábitos modernos. Por ello, la inquietud principal de este estudio es el vestido masculino como símbolo del cambio social, eligiendo como la Villa y Corte de Madrid. La delimitación de este tema permite estudiar el vestido a la francesa como objeto y sujeto de estudio y de análisis con un enfoque crítico. Con este fin, se ha necesitado de un trabajo de campo exhaustivo donde los documentos del Archivo Histórico Provincial de Madrid son el núcleo de este estudio. Complemento perfecto de estos bloques documentales es la literatura bibliográfica y artística, donde se puede estudiar bien el grado de aceptación y resistencia del gusto francés. Partiendo de la reflexión de D. Roche acerca de que el estudio de la indumentaria es menos anecdótico de lo pudiera aparecer, se demuestra la importancia relacional de este vestido en su entorno social y cultural, puesto que la vestimenta es parte integrante de la Historia del Arte, de la Historia Social e Historia Cultural. Así, se legitima la vestimenta como rasgo distintivo de la ideología, la mentalidad, las prácticas y los comportamientos. Esto porque la indumentaria siempre ha manifestado los valores formales de la distinción moderna a través de sus estilos y modas, como sucedió con el vestido a la francesa que sedujo tanto a extranjeros como españoles. Sobre todo, este vestido resulta particularmente significativo para el fenómeno social de las apariencias masculinas. Durante esta época, un reducido grupo de hombres –y muy pocas mujeres– poseían el control sobre los recursos políticos y culturales. Así, partiendo del atuendo que viste el hombre a finales del siglo XVI se analiza la decadencia del modelo español y la paulatina filtración del vestido a la francesa que se convirtió en el modelo cortesano en España. La introducción de estas nuevas apariencias -fenómeno provocado por el cambio de dinastía a principio del siglo XVIIII- se manifestó como indicador social de la nueva imagen de la villa madrileña. Este atuendo, procedente del uniforme militar, fue visible en las elites y llegó a definir el capital simbólico de estos grupos de poder. El vestido, manifestación del lujo y protocolo del teatro cortesano, ya se había impuesto como áulico adjetivo del ceremonial aristocrático moderno. Tanto en la corte como en la urbe, esta nueva manifestación estética del traje representó la imagen visual de la época moderna que –atavío y gala social– delineaba el ethos y la estética del Antiguo Régimen. El seguimiento de este atuendo, desde sus esbozos estilísticos hasta su fosilización y superación en el siglo XIX, permite secuenciar su evolución y extrapolar las características generales y las imperceptibles transformaciones que definieron culturalmente el gusto estilístico de la nueva clase social. Como testigo de los avatares y de los cambios históricos, este traje describe el progreso social de ciertos individuos y evidencia su transición –no sólo estética– hacia a la sociedad liberal. De hecho, esta indumentaria evidencia los caracteres y las connotaciones sociales de esta lenta evolución. Therefore, one of the most important theme of this investigation resides in the aesthetic importance of the garment reflected in the Madrid society to departing, especially, during the second half of the XVIIth Century. Especialliy, this thesis is about the relations costume and the social actors during the XVIIth, XVIIIth and XIXth Century. Also about the artistic and aesthetic influences of the moderns habits and the social change. So, the principal worry of this study is the masculine appearance as symbol of the social change, choosing as privileged balcony the Villa and Court of Madrid. The focus of this thesis is the Justaucorps dress as object and subject of study and analysis for a critical approach. So, it has needed exhaustive work evidences where the documents of the Archivo Histórico Provincial in Madrid are the core of this study. Perfect complement of these blocks is the bibliographical and artistic one, to study the degree of acceptance and resistance of the French taste. Based on the reflection of D. Roche that the studies about clothing are less anecdotal than might appear, we demonstrate the relational importance between the costume and its social and cultural settings, considering the dress is part of the Art History, as well as Social and Cultural History. So the dress is legitimized as a feature of the ideology, mentality, practices and behaviors. This is because the garment has always shown the formal values of the modern distinction through their styles and fashions, as did the Justaucorps dress that seduced both foreigners and Spanish people. Above all, this dress is particularly significant for the social phenomenon of male appearances. During this period, a small group of men - and fewer women - possessed the control on the political and cultural resources. So, based on the dress worn by the man in the late sixteenth Century model, we analyze the Spanish decadence and the gradual filtration of the Justaucorps dress that turn into the court model also in Spain. The introduction of these new appearances -phenomenon caused by the change of dynasty at the beginning of XVIIIth Century- manifested as a social indicator of the new image of the town of Madrid. This model, proceeding from the military uniform, was visible in the elites and managed to define the symbolic capital of these groups of power. The dress, manifestation of luxury and protocol court, was imposed as an aristocratic ceremonial modern adjective. Both on the court and in the city, this new aesthetic costume represented the visual image of the modern era and specifically of the Ancient Regime. The monitoring of this dress, from its beginnings until the fossilization and the overcoming at the XIXth Century, can sequence the evolution of the characteristics and the transformations that defined culturally the stylistic taste of the new social class. To witness the historical changes, this dress describes the social progress of certain individuals and their transition -not only aesthetically- to a liberal society. SÍNTESISLa capital política de la CAV es Vitoria, y Bilbao es la capital económicafinanciera, con una población de 400.000 habitantes,donde se enmarca la actuación de BILBAO Ría 2000.La recesión económica internacional de finales de los añossetenta, como resultado de la crisis del petróleo, provocó eldesmoronamiento de la gran industria pesada asentada en lasmárgenes de la Ría de Bilbao. La crisis de los 90, transformóbrutalmente las riberas en ruinas industriales.El conjunto deactuaciones en el entorno de la Ría de Bilbao, tal vez ha sidoel resultado de hacer de la necesidad virtud, y de convertir losproblemas en verdaderas oportunidades.Hasta el año 1800 la humanidad trabajó fundamentalmenteen la agricultura. El sector primario-agropecuario,dio trabajo ala humanidad durante 4.000 años, y el secundario-fabril, diotrabajo durante los últimos 200 años (entre 30% o 35% de lospuestos de trabajo necesarios),hoy el 70% del empleo restantelo proporciona sectores como el comercio, el turismo, los servicios,el ocio, la cultura, la información y otras actividades. Laapuesta estratégica consiste en comprender que la cultura no esnecesariamente sólo un coste sino una inversión de futuro.La mayoría de los oponentes opinaba que en tiempos de crisishabía que concentrar todos los recursos públicos en accionesa favor del empleo y de la industria. Un segundo grupo deoponentes, luchó ferozmente contra un proyecto que consumíasus fuentes de financiación y fue visto como "colonialismo ala americana" .Un tercer movimiento, alzó su voz contra unaconstrucción que iba a ocultar la silueta del monte.Las zonas industriales, ferroviarias y portuarias que quedaronlibres al cesar la actividad que sobre ellas se realizaba. Las actuaciones concretas a través de la sociedad BILBAO Ría 2000,una experiencia piloto en España, incluyeron la depuración susaguas y el traslado de las actividades portuarias hacia la desembocadura,incluyendo:El Metro de Bilbao ,1995.Dos nuevos puentes sobre la Ría, 1997.La terminal del aeropuerto de Bilbao, 2000.La ampliación del Puerto exterior, 1998.El Plan Integral de Saneamiento de la Ría.El nuevo puerto deportivo de Getxo.El Museo Guggenheim Bilbao, y el Palacio de Congresos y dela Música de Euskalduna.Las actuaciones ferroviarias.El tipo de actuaciones, debía favorecer la sostenibilidad. Paraello se abordaron conjuntamente y con un enfoque integradorlos problemas de transporte, urbanismo y medio ambiente. Asímismo, se trabajó con la ciudad existente, sin ocupar suelos vírgenes,y se trató de sacar el máximo partido a las infraestructurasexistentes, transformando los problemas en oportunidades.El ámbito de actuación abarcó los municipios situados a lo largode la Ría y su misión consistió en re-ordenar el territorio de lamano de la planificación de los distintos municipio afectados.La construcción del Museo Gugenheim, se volvió emblemático.El estudio de su viabilidad ,justificaba esta inversión a condiciónde que el museo recibiera 400.000 visitantes al año, cifra quese triplicó en el primer año, sin tener en cuenta efectos menostangibles, como el orgullo recuperado de una sociedad postradaque vuelve a tener fe en el futuro. Se trató, pues, claramente,de una inversión y no de un gasto. El museo suscitó el despertarcultural de Bilbao: su Museo de Bellas Artes se ha renovado yha doblado el número de visitantes; la vida nocturna se ha enriquecido,así como la programación de sus salas de espectáculos;sus tiendas se han renovado para acoger a más grandes marcas;la calidad del diseño y de la arquitectura ha dejado su improntaen toda la ciudad .La cultura crea ciudad y la ciudad hace cultura. Como dice RobertParker, "La ciudad es sobre todo una especie de estado deánimo, un conjunto de hábitos, de costumbres, de tradiciones,no sólo un mecanismo físico y una construcción artificial. Formaparte de los procesos vitales de los habitantes que la componen.Es un producto de la naturaleza, sobre todo, de la naturaleza humana".ABSTRACTThe political capital city of the Basque Autonomy Community isVitoria, being Bilbao its financial capital city with a populationof 400,000 inhabitants and where the projects of BILBAO Ría2000 are carried out.The international economic recession of the late 70's, resultingfrom the oil crisis, caused the collapse of the big heavy industryset up on the bank of Ría de Bilbao. The 90's crisis brutallytransformed the banks into industrial ruins. The activities takingplace on Ría de Bilbao may have been the result of turningneeds into virtue, and problems into real opportunities.Up to 1800, humankind fundamentally developed agriculture.The primary agricultural sector generated jobs for humankind for4,000 years, and the secondary manufacturing sector providedhumankind with jobs for the last 200 years (between 30% and35% of the necessary jobs). Nowadays, the rest 70% of jobsis provided by sectors such as trade, tourism, services, entertainment,culture, information and other activities. The strategicgamble lies in understanding that culture does not necessarilyinvolve costs, but also a future investment.Most detractors though that, in time of crisis, all public resourceshad to be focused on actions favoring employment and industry.A second group of detractors fiercely fought against a projectthat consumed their financing sources and that was seen as"American colonialism." A third movement raised its voiceagainst a construction that was going to hide the landscape.The industrial, railway and port areas were freed after the activitiesundertaken there were stopped. Thus, the transportation,city-planning and environmental problems were tackled togetherby using an integrating approach. Likewise, they workedon the existing city, without occupying virgin lands, and tried tomake the most of the existing infrastructure by transformingproblems into opportunities. The activities covered the municipalitieslocated along Ría, and their goal was to rearrange theterritory according to the planning of the different municipalitiesinvolved.The construction of the Guggenheim Museum became emblematic.Feasibility studies justified this investment under thecondition that the museum received 400,000 visitors per year,a number that tripled in the first year, without considering lesstangible effects such as the restoration of pride in a bedriddensociety that regained its faith in the future. It was clearly an investmentand not an expense. The Museum caused the culturalawakening of Bilbao: the Bilbao Fine Arts Museum has beenrenewed and its number of visitors has doubled; night-life andthe programming of its halls have been enriched; its stores havebeen renewed to receive greater brand products; and the citybears the imprint of the quality of design and architecture.Culture creates city, and city creates culture. As Robert Parkersaid: "The city is, above all, some kind of frame of mind, anumber of habits, customs, and traditions. It is not just a physicalmechanism and an artificial construction. A literature review reveals that the virtual reconstructions 01 cultural heritage made using computer graphics techniques , often lack scientific rigor and lose sight 01 existing knowledge. AlI too often, the criteria used lar recons truction are not accessible, there is no transparencyregarding the process , nor is there an analysis olthe validityolthe recons truction hypothesis, even when the modeling is carried out by scientists . Against this background, I lormulated the lollowing hypothesis : "One can develop a method by which scientific rigor is brought to architectural virtual reconstructions, relevant to Roman architecture and cons idering the cultural heritage in its historical landscape". The methodology I developed to test my hypothesis is organized in 3 steps : 1. Documentation and data collection. 2. Development 01 the virtual model on a urban scale. 3. Produ ction 01 a detailed photo-realistic models olthe monument. In the 3rd phase, we propose solutions to every detail that defines the architectural building in an iterative way. In this last phase are also embedded the techniques to studythe stabilityolthe construction elements such as walls (isolated or as carriers 01 arcs), arcs (symmetric and asymmetric load) and vaults. By analyzing the stabilityolthe wall, the method allow to check the stability olthe stirrups, while the study 01 arcs is used to determine the line 01 thrust at the bow to check their stability. Regarding data transparency, the reconstruction hypotheses are classified according to 31evels, depending on the reliability olthe underpinning data, namely: confirmed, probable and hypothetical. The reliabilityolthe reconstruction is indicated in each case. The models produced according to this method are accessible, can be searched lor background data and assumptions, display areas 01 uncertainty, and can be easily modified as new data is made available. To test the method, I applied it to produce the virtual reconstruction 01 the Villa 01 Livia, the first imperial residence projected as a country residence and designed with a strong symbolic valence: des pite its apparent simplicity it revealed the political and artistic conception olthe Emperor Augustus and summarized the essence 01 Roman architecture, combining the aomestic and lunctional architecture with representative lunctions . The confidence in the proposed elements olthe reconstruction is indicated bya legend that differentiates the three certainty levels lor both , the decorative elem ents and the structure. To evaluate the correctness olthe 3D model, I first analyzed the structural behavior 01 part 01 the Villa using the MIDAS/Gen software. A task that proved extremelycomplex and ineflicient . I thus generated atable that displays the parameters that have been used to generate the virtual model, and that allows to check elements such as constructive structure 01 decks, dimensions, slopes , water evacuation systems, presence 01 eaves, thickness olwalls , dimensions 01 pillars , type 01 Coatings , paving, windows and carpentry, among others . This exercise altowed to validate myinitial hypothesis. The method I developed is valid lor architectural heritage characterized by strong codes, such as the Roman architecture that was codified since Imperial times. However, it can also be used in other cases ofhistoric buildings, since the static and constructive checks and data transparency approach built in the method are relevant to all the historic architecture, until the emergence ofmodern materials. ; Una revisión de la literatura científica y divulgativa, revela que las reconstrucciones virtuales arquitectónicas realizadas con técnicas icnográficas, con frecuencia carecen de rigor científico. A menudo, no se puede acceder a los criterios seguidos para su reconstrucción, no existe transparencia en el proceso ni en su comunicación, ni se puede demostrar la validez de las hipótesis de trabajo. incluso en aquellos casos que provienen de medios científicos. Frente a esta laguna he planteado mi hipótesis de partida, que se resume así: Es posible desarrollar un método mediante el cual se puede dar rigor científico a las reconstrucciones virtuales desde un punto de vista arquitectónico - constructivo en el ámbito de la arquitectura romana, considerando el conjunto arquitectónico dentro del paisaje antiguo. La metodología que he desarrollado para intentar confirmar mi hipótesis se divide en tres fases: 1. Documentación y recogida de datos. 2. Elaboración del modelo virtual topográfico a escala urbana. 3. Realización de maquetas detalladas foto-realísticas del monumento. En la 30 fase se definen soluciones para cada detalle que define el organismo arquitectónico, en un proceso de trabajo iterativo. Dentro de esta última fase se encuentran los métodos para estudiar la estabilidad de los elementos constructivos tales como muros (aislados o como soportes de arcos), arcos (con carga simétrica y asimétrica) y bóvedas. Mediante el estudio de la estabilidad del muro se pueden comprobar la estabilidad de los estribos, mientras que el estudio del arco sirve para determinar la línea de empujes en el arco y comprobar la estabilidad de éste. En el ámbito de la transparencia de datos, las maquetas desarrolladas en esta tercera fase se clasifican a su vez según 3 niveles llamados "generadores", dependiendo del tipo de la fiabilidad de los datos a disposición, y son: datos ciertos, probables e hipotéticos. El grado de fiabilidad de la reconstrucción se indicará en cada caso. El desarrollo de la maqueta en el nivel generador al que pertenecen los elementos de hipótesis, es posible gracias a la aplicación de criterios constructivos y estáticos. Las maquetas realizadas según este método son accesibles, interrogables, y se pueden modificar fácilmente a medida que aparezcan nuevos datos. Para comprobar la validez de la metodología, he realizado la reconstrucción virtual de la Villa de Livia, primera residencia imperial concebida como residencia de campo, con una fuerte valencia simbólica, pues tras su aparente sencillez debía de esconderse la concepción política y artística del emperador Augusto, y reúne la esencia de la construcción romana, conjugando la arquitectura doméstica y funcional con una impronta representativa. En la reconstrucción, la fiabilidad se ha indicado con una leyenda que diferencia la arquitectura del aparato decorativo, siguiendo la clasificación de los tres niveles: indiscutible, probable, evocativo. Para evaluar la corrección del modelo 3D, estudié el comportamiento estructural de una parte de la Villa mediante MIDAS/Gen, sin buenos resultados. He optado entonces por elaborar una tabla que recoge los parámetros con que se ha realizado el modelo virtual, ya través de la cual se pueden controlar elementos como el esquema constructivo de las cubiertas, dimensiones, pendientes, sistemas de evacuación de aguas, presencia de aleros, grosor de muros, dimensiones de pilares y arquitrabes, tipo de revestimientos, solería, huecos o carpintería, entre otros. Este método es válido para arquitecturas como la romana, con una clara codificación del lenguaje ya desde en época Imperial. Sin embargo, este método se puede extrapolar, y salvo excepciones, puede ser válido en otros casos de construcciones históricas tradicionales, pues el buen funcionamiento estático y constructivo y la transparencia que prevé el método, son elementos comunes a toda la arquitectura histórica hasta la irrupción de los materiales modernos. ; Postprint (published version)
Space is the expression of society, and contemporary society is built around flows; hence the existence of a characteristic spatial form. However, most people still live in places and perceive their space by virtue of them. The coexistence of these two conflicting spatial logics results in a structural schizophrenia that threatens to break the channels of communication in society. The challenge of building bridges between the two entails dealing with processes that involve, in addition to material practices, other dimensions of social space. That is why both that multidimensionality and the procedures that enable the reconstruction of places in the context that it determines have assumed great relevance. With regard to the multidimensionality, the thesis acknowledges the fact that history -which underpins local identities- can be integrated into the physical environment to facilitate its experience simultaneously to that of other strictly spatial facets of what may be called 'interpreted places', where material heritage can play a significant role. With regard to the procedures, it highlights the importance of community processes in the reconstruction both of inclusive narratives and the places that they represent and in which they are represented. However, it is also argued that in the current context, which involves the disintegration of civil society, these processes may not be implemented in the absence of citizen mobilizations that demand the revision of institutional approaches that tend to generate 'altered places'. In Barcelona the gestation of this state of things had a decisive moment in 1986, when the city was nominated as an Olympic venue. That event can be understood as the beginning of a stage in which a quantum leap in the cultural-identitarian claims of the local urban movement took place, both from a quantitative and a qualitative perspective: quantitative, as much as it involved a change of scale in relation to the demands that had addressed the importance of heritage in previous stages, from the architectural element or complex to the urban area; qualitative because, on that scale, non-monumental heritage sites -especially the industrial- became appreciated per se rather than as mere releasers or containers of public space. This phenomenon began to manifest through the renewal of the Port Vell, starting from 1988. After the 1993-1997 period, which was marked both by the ebb of the Olympics and the municipal debt, the period that has been characterized by the urbanization of the so-called New Projects has become a prime setting for its development. This is suggested by the rise of citizen mobilizations in opposition to redevelopment plans that has been registered between 1998 and 2006. Among them, the ones that have affected Trinitat Nova neighbourhood, Lesseps Square, and Parc Central del Poblenou area have had a particular social and spatial impact. From a cultural viewpoint, this reality suggests the possibility of preserving 'spaces of hope' in the construction of an alternative globalization, provided that they acquire and consolidate a structural meaning through the combination of multiple local processes. From a political point of view, it reveals the role of participatory planning as a locus of encounter for actors and strategies that otherwise may be irreconcilable. Finally, a material stance highlights the complex impact of the above on the physical environment, in a time when the social emphasis on images and discourses can result either in a lively coherence between the perception, conception and experience of space, or an extraordinary lack of correlation between them. ; El espacio es la expresión de la sociedad, y la sociedad contemporánea está construida en torno a flujos. De ambas constataciones se deriva la existencia de una forma espacial característica. Sin embargo, la mayor parte de las personas sigue viviendo en lugares y percibe su espacio en virtud de ellos. La coexistencia de estas dos lógicas espaciales opuestas tiene como consecuencia una 'esquizofrenia estructural' que amenaza con romper los canales de comunicación de la sociedad. El reto de tender puentes entre ambas obliga a hacer frente a procesos que involucran, además de las prácticas materiales, otras dimensiones del espacio social. De ahí que tanto la multidimensionalidad de este último como los procedimientos que posibilitan la reconstrucción de los lugares en el marco que determina hayan cobrado gran relevancia. One of the key issues of urban management is the process of drafting and approval of planning. Very particularly with regard to the definition of what in this thesis, we call urban model, i.e., trinity formed first by the use of soil, second by the build ability and finally the building typologies. In this thesis, we try to see what factors influence the determination of the urban model enshrined in planning legislation. It starts from the assumption that, besides the classical factors belonging to the urban economy (e.g. accessibility), sociology (e.g. social hierarchy of space), externalities (e.g. environmental quality) and demographics (e.g. housing needs) there are others who may be as important as the ones above. The nature all these new factors would be affiliated with the political will of those involved in drafting I planning approval, the private and the public interests. Ultimately, these conditions could be called agents (e.g. government and stakeholders) and processes (e.g. processes of social demands). Therefore the main objective of this thesis is lo study the weigh that these factors in shaping the urban model. The Thesis has two parts: a Theoretical one, which develops the theory of the urban model, its regulation, its process design, its shaping into a plan that has been approved and the determinants of land use, density and typologies. In the second part, using a logit regression model is studied to what extent the classic factors are able to predict the way in how, in the Metropolitan Region of Barcelona, has configured the model embodied in 168 urban areas of planning legislation. Therefore it the classic factors of land use allocation I density I typology would be able to explain most of the variance of the sample, and then our hypothesis should be rejected. II on the contrary, the unexplained portion was relevant, and then it would mean that the determinants (agents and processes) may have a role in this allocation process. The findings of the quantitative section suggest that the classical factors can explain only 51.2% of cases; lo see it the unexplained portion (Le. the model error) was due to problems in the source lack of information; or it they really could be due to other factors, was performed a detailed analysis of each case. Following this review, it became clear the need to study in detail and with the support of qualitative techniques, two cases in Barcelona where the model was clearly wrong. The analysis performed on the file for approval of plans, a field study and interviews with stakeholders, revealed the enormous complexity inherent to the agents and processes evidenced in the management of the drafting and approval thereof, whose influence over redirecting, i.e. reconfiguring the urban model that would result simply by considering the classic factors of land use allocation I build abilities I typologies. One of the main contributions of this thesis was therefore to highlight the important role of the planning legislation, which being closer to reality, to the agents and the processes of the territory, allows building a city hypothesis inductively, Le. while it drafts I approves I managed; quite the opposite of what happens with the general planning whose hypotheses are propositions to be compared on the occasion of its development, and often contradicted by its frequent modification. ; Una de les qüestions clau de l' urbanisme és la gestió del procés de redacció i aprovació del planejament. Molt particularment pel que fa a la definició del que en aquesta tesi s'anomena model urbà, és a dir, la trinitat formada, en primer lloc per l'ús del sòl, en segon lloc per l'edificabilitat i finalment per les tipologies edificatòries. En aquesta tesi s'intenta veure quins factors tenen influència en la determinació del model urbà consagrat en el planejament derivat. Es parteix de la hipòtesi que, a més dels factors clàssics afiliats a l'economia urbana (p.e. accessibilitat), la sociologia (p.e. jerarquització social de l'espai), les externalitats (p.e. la qualitat ambiental) i la demografia (p.e. necessitats objectives d'habitatge) hi ha altres que poden ser igualment importants com els anteriors. La naturalesa d'aquests nous factors estaria afiliada a les voluntats polítiques dels que tenen ingerència en la redacció/ aprovació del planejament, als interessos particulars i de la ciutadania. En definitiva aquests condicionants podrien ser anomenats agents (p.e. administració i administrats) i processos (p.e. processos de reivindicació social). Així doncs, l'objectiu fonamental d'aquesta tesi és estudiar el pes que tenen aquests condicionants en la configuració del model urbà. La tesi es divideix en dues parts: una teòrica, en la qual es desenvolupa la teorització del model urbà, la seva regulació, el procés de concepció, la seva plasmació en un pla que ha de ser aprovat, així com les condicionants de l'ús del sòl, la densitat i les tipologies. Una segona, en la qual, mitjançant un model de regressió lògic s'estudia fins a quin punt els factors clàssics són capaços de predir la forma en com, a la Regió Metropolitana de Barcelona, s'ha configurat el model urbà plasmat en 168 sectors de planejament derivat. De manera que, si els factors clàssics d'assignació d'usos / densitats / tipologia fossin capaços d'explicar la major part de la variància de la mostra, la nostra hipòtesi hauria de ser rebutjada, si pel contrari, la part no explicada resultés rellevant, voldria dir que els condicionants (agents i processos) podrien tenir un paper en el procés d'aquesta assignació. Les conclusions de l'apartat quantitatiu apunten a que els factors clàssics només són capaços d'explicar el 51,2% deis casos; per conèixer si la part no explicada (i.e. l'error del model) es devia a problemes en les fonts / manca d'informació o si de veritat podrien ser conseqüència d'altres factors, es va realitzar una anàlisi detallada de cada cas. Després d'aquesta revisió es va fer evident la necessitat d'estudiar amb detall, i amb el concurs de les tècniques qualitatives, dos casos a Barcelona on clarament el model es mostrava errat. L'anàlisi realitzada sobre l'expedient d'aprovació dels plans, un estudi de camp i la realització d'entrevistes en profunditat amb els agents implicats, va revelar l'enorme complexitat inherent als agents i els processos, evidenciada en la gestió de la redacció i aprovació dels mateixos, la seva influència va acabar reconduint, és a dir, reconfigurant el model urbà que hagués resultat simplement de considerar els factors clàssics d'assignació d'usos / edificabilitats / tipologies. I believe sometimes it is useful to begin by stating the obvious: Unlike in the case of the international financial system which has belatedly engaged in an exercise to develop a global architecture of rules, a structure of global governance already exists for international trade. The WTO is regarded as a fairly muscular repository of the rules and regulations governing international trade. While the WTO has played a useful and deterrent role through the TPR mechanism in tracking protectionist trends during the crisis, the more effective deterrence has been through the corpus of binding commitments that members have entered into in successive Rounds of negotiations.2. Any discussion regarding the further development of the WTO system has to begin with a shared understanding of the reasons for its present stasis. In my view. the underlying issue is the remarkable changes that have taken place in global competitiveness as a result of which a number of developing countries have begun to enjoy rapid growth while the traditional leaders in developed countries are experiencing sluggishness. The present crisis has only served to highlight this dichotomy. Major economies like the U.S. are going through a protectionist phase, with the latest manifestation being the Border Security Bill approved last month which strangely, seeks to transfer, at least partly, the cost of restricting illegal immigration from across the border to skilled professionals through imposition of higher visa charges. On the other hand, the emerging economies are preoccupied with restructuring their economies to maintain their high growth trajectories. As a result, in Asia at least, domestic consumption is emerging as a key driver of growth. Regional integration has received greater impetus and autonomous liberalization has become a prerequisite to linking with international supply chains. Intra-Asian trade for instance, has become the most dynamic factor in increasing global trade.3. The short point is that the traditional leaders of the multilateral process are preoccupied with economic recovery, while the emerging economies are preoccupied with adjusting to rapid growth. We are therefore witnessing a leadership vacuum in the MTS. I would not like to speculate on how and when this problem will be fixed. But it certainly will be fixed as all stakeholders in the MTS recognize the implications of a WTO weakened by failure of the Doha Round.4. Given this situation, one cannot expect easy consensus on initiatives for further development of the MTS. It also has to be recognized that the WTO of today is a significantly different entity than it was a decade ago and a top down work plan, which is perceived to have been drawn up in some backrooms, will not sell with the membership. Such a work plan can only emerge through an inclusive and consensual exercise over a period. In my view, such an exercise needs to be taken up in 2 phases:5. In the short term, concurrent with the Doha Round negotiations, it is possible to obtain consensus on a number of initiatives to strengthen the deliberative processes in the WTO and enhance the usefulness of the WTO for all stakeholders, public and private. These initiatives can be taken without a fresh Ministerial mandate. Such initiatives could include:Changes in Committee procedures to make the deliberations more effective and relevant to current market situations;A facilitative mechanism to resolve low threshold disputes.A bolder programme on RTA's with the ultimate objective of devising principles for best practices;An integrated data base for NTM's with access to all stakeholders; At the same time, an informal process needs to be launched to explore ideas for a post- Doha work programme.6. As far as the medium term is concerned, the launch of a new work programme has to be linked to the conclusion of the Doha Round. For the reasons I have mentioned, it is essential that such a work programme evolves in a fully transparent and inclusive manner and reflects a balance of interests of all members. It is too early in the day to discuss what such a balanced programme should look like, but nevertheless, some considerations would be valid in drawing up such a programme. Some issues like further liberalization in the market access areas of Agriculture, NAMA and Services would continue to be the major anchor of future negotiations, along with work on the unfinished business in agricultural subsidies. However, in order to reflect the significant changes that have taken place in the global economy as well as the global trading system, the work programme would need to focus on some key issues:Firstly, the major impediments to market access are no longer tariffs but non tariff barriers. The work programme would therefore need to focus on regulatory issues which impinge on market access as distinct from tariff liberalization. This would include a more intensive horizontal engagement on improving the TBT-SPS disciplines to address the issue of Standards in particular and NTB's in general. Similarly, a comprehensive work programme on RTA's with the objective of mainstreaming them into the WTO disciplines, is essential.Thirdly, the remarkable growth being witnessed in several parts of the developing world is being accompanied by a spurt in innovation in these countries. The $2,500 car, the $25 mobile phone, the $10 water purifier, the low cost mobile X-Ray machine are only some examples of this. Much more is to come. These innovations have the potential for revolutionizing global manufacturing. The global IPR disciplines must facilitate, not hinder the process. The new work programme should reflect this new reality.Fourthly, the issue of equity in the global trading system has to be addressed. This would involve dealing with asymmetries in value creation across the world. Trade can only contribute to poverty reduction if it helps in spreading value creation all along the value chain. Africa cannot indefinitely remain only the commodities supplier to the world. Value creation in poor countries has to be a central preoccupation of the new engagement. 7. There would be demands for inclusion of other issues which may not command multilateral consensus but are important for some members. These would include the remaining Singapore issues as well as other issues such as an expanded agreement on global electronic commerce. On these issues, the onus is on the proponents to build consensus by demonstrating that the outcomes will be beneficial for the global trading system.8. The experience with the UR plurilaterals provides a good basis for designing the format for negotiations on those issues which require the participation of a subset of members. In my view, variable geometry means both, variable in terms of participation and/ or variable in terms of the nature of commitments.9. As far as climate change issues are concerned, it is important not to allow the tail to wag the dog. If political differences impede an international agreement in the Climate Change negotiations, they will do the same if the WTO takes up work on the issue. Once there is multilateral consensus in the Climate Change negotiations, the modifications in the WTO rules should involve a fairly straightforward negotiation. My impression is that our experience with the MEAs in force today has been pretty good and there has been little, if any, dispute on their trade implications.

En este sentido, las instituciones pueden ser vistas como unidades productivas de grupos humanos, donde existen culturas heterogenias resultantes de micro-construcciones y procesos sociales con poca identidad. Desde el punto de vista teórico, es posible considerar esas organizaciones como tipologías sociales específicas o construcciones visibles que pueden ser planeadas, coordinadas y supervisadas de acuerdo con las características de los sistemas económico, social y político de la región y de la actividad que desarrollan, por lo que se hizo necesario indagar por la conformación de su cultura organizacional, especialmente en aquéllas que se catalogan como empresas productoras y comercializadoras de flores a nivel nacional e internacional En este contexto la cultura es un conjunto de acciones orientadoras de las interacciones entre los individuos que las conforman, la cual es susceptible de reproducirse superando conflictos, tensiones y contradicciones, de orden técnico, económico, legislativo y social constituyéndose en un conjunto de hábitos rutinas y costumbres inherentes a las formación, ejecución y proyección, para garantizar así su permanencia. Lo anterior significa que la cultura es un conjunto de prácticas, actitudes, roles, comportamiento concurrentes y recurrentes, que permiten reanudar las relaciones entre los individuos que conformen las empresas al interior y, en algunos casos en su exterior, a partir de la codificación, la difusión y la aceptación de políticas y normas compartidas por los individuos y los conglomerados humanos. Sin embargo, a través de la evolución de la empresa dedicada a esta actividad y de la sociedad se generan múltiples niveles de complejidad y diferenciación generando identidad y desarrollando estrategias de competitividad y comparación, tanto en lo social como en lo económico, lo cual permite contextualizar y conceptuar al respecto de la cultura y de las subculturas, mas aun ahora que las reformas laborales y la deslaboralizacion de las relaciones a impactado a este tipo de organizaciones. Aunque hay múltiples escritos sobre el tema de cultura organizacional es necesario elaborar uno que se centre en empresas dedicada a la producción de flores para mercados nacionales e internacionales las cuales adicionalmente están condicionadas a factores no solo económicos sino también climáticos o estacionales a consecuencia de que se constituyen en el punto de referencia para otras más pequeñas y de diferentes sectores al ser dominantes en la economía de la región por el número de personas que vinculan directa o indirectamente, la cantidad de productos generados y el aporte económico que hacen a la región y al país en general. Se puede recordar que el tema de cultura organizacional tiene el apoyo de algunos autores, pero de igual manera tiene opositores Sí se tiene muy en claro que se presenta una coincidencia de propósitos, intereses y saberes, lo que establece niveles de participación y apoyo. Dado que el ser humano en general es la base a partir de sus comportamientos, reacciones, actitudes y toma de posición a partir del cual se genera la cultura se propicia la estabilidad de las organizaciones. Se asume entonces que la cultura está compuesta por tres dimensiones: la intelectual, la afectiva y la social, al igual que la conducta de las persona permitiendo los proceso de conformación y transformación. Al investigar las empresas se hace necesario indagar y estudiar los espacios donde conviven y se desarrollan los seres humanos para satisfacer sus necesidades y, por lo tanto, también obliga a referirse al direccionamiento. Al aceptar que empresa, cultura, direccionamiento y necesidades humanas son elaboraciones sociales, sin olvidar que estas evolucionan a través del tiempo, tienen que estar vinculadas entre sí para generar bienes y servicios que satisfagan a las colectividades. ; Nowadays companies face a continuous division of its social formations, because the dynamic of globalisation tends to fracture them into small and diverse human groups. In this sense, institutions are seen as productive units of human groups, where heterogeneous cultures exist as a result of micro constructions and social processes with little identity. From a theoretical point of view, it is possible to consider those organisations as specific social typologies or visible constructions that can be planned, coordinated and monitored according to the characteristics of the economical, social and political systems of the region and the activity they develop, that's the reason why inquiring on the formation of its organisational culture became necessary, especially for those companies that are catalogued in flowers production and commercialisation internationally. In this context, culture is a set of guiding actions for the interactions among its members which is susceptible of reproducing itself over conflicts, tensions and contradictions from a technical, economical, legal and social order creating a set of manners, routines and customs related to form, execution and projection to guarantee its survival in time. This means that culture is a set of practices, attitudes, roles and concurrent and recurrent behaviours that allow rebuilding relations between individuals that integrate enterprises from its interior and, in some cases its exterior, starting from coding, diffusion and acceptation of norms and policies shared by individuals and human conglomerates. Nevertheless, during societies and companies evolution in the business of flower trading many levels of complexities and differentiation are generated which creates identity and develops strategies of competitiveness and benchmarking in the social and economical realm, allowing the contextualization and definition of culture and its subcultures, even more now that labour changes and the trend to eliminate labour from the relations with the employee has impacted this type of organisations. Although there are many articles on organisational culture, it is necessary to appoint one centred on flower trading companies for national and international markets because these are dependent on economical, social, stationary and climatic factors and build a reference point for smaller companies and for different sectors since they are dominant in the region according to their employment rates, generated products and economical impact in the country. The topic of organisational culture has the support of several authors, but is has also its critics if you have cleared that many coincidences of purposes, interests and specific knowledge is present, establishing levels of participation and support. [spa] La importancia otorgada a la evaluación en educación, desde su prescripción o condición para acceder al financiamiento extraordinario de instituciones o programas, acrecienta su complejidad no sólo técnica sino ética, con riesgos de reproducir las desigualdades de origen de las entidades evaluadas, mediante la desacreditación de un servicio público ajeno a los intereses y modelos de calidad que así lo califican. Inscrita en este contexto, como otras universidades públicas cuyo desarrollo depende de los recursos adicionales a un subsidio cada vez más exiguo, la Universidad Autónoma del Estado de México (UAEM) participa en recientes procesos de evaluación-acreditación de sus programas educativos. Ahora que la evaluación emerge protagonista del cambio y la calidad de la educación, como nunca antes se soslayan las reflexiones sobre la supuesta neutralidad de sus procedimientos, resultados y juicios; el ambiente politizado y una cultura de utilitarismo, relegan el cuestionamiento sobre la calidad de la evaluación. Se elige el estudio de casos como enfoque de investigación evaluación, con un diseño cualitativo orientado a ofrecer una visión sobre la manera en que las políticas y prácticas de la evaluación institucional responden a los principios de la educación universitaria y de la UAEM; y, contribuir a mejorar la comprensión que sobre la evaluación tengan los participantes, como base de la reflexión y el cambio de perspectiva para una nueva y profesional intervención. En congruencia con estos objetivos, el problema investigación interroga sobre: ¿Cómo se realiza la evaluación universitaria y de qué manera influye en ésta el contexto en que se lleva a cabo? ¿Cuál es la comprensión que tienen los participantes sobre los procesos críticos, las características y eventos más significativos que ocurren dentro y como consecuencia de las prácticas de la evaluación universitaria? En el contexto señalado, el examen a la evaluación universitaria se centra en las prácticas del ámbito institucional, éstas son: la evaluación anual del plan de desarrollo, la evaluación del Informe Anual de Actividades por la Comisión de Glosa del Consejo Universitario, la evaluación externa de los CIEES para las funciones institucionales, la auto evaluación institucional CONAEVA y las evaluaciones para fundamentar programas de financiamiento extraordinario. El alcance del estudio se limita al campo de la docencia universitaria, e intenta englobar -con el análisis documental y las entrevistas- un periodo que suma las últimas cinco administraciones universitarias (1982-2001) La fase empírica del estudio se realiza a partir del análisis documental que comprende materiales conceptuales, normativos, planes e informes; la observación no participante (2002 y 2003) centrada en sucesos y actuaciones que informan sobre los componentes de la evaluación (fundamentos, resultados, juicios e interpretación, y recomendaciones); y, finalmente pero como recurso principal, la entrevista con autoridades, y evaluadores. Los resultados preliminares alcanzados con estas técnicas se organizan y analizan para redactar el informe del estudio de caso evaluativo, teniendo por bastidor los criterios fundamentales de la evaluación (veracidad, estética y justicia) propuestos por Ernest R. House (1997), los estándares para la evaluación educacional (utilidad, factibilidad, honradez y precisión) del Centro de Evaluación de la Universidad de Werstern, Michigan (1994). El informe de evaluación (resultados del estudio), bajo el propósito principal de promover la identificación y comprensión de los lectores, presenta una redacción informal, narrativa, con abundantes citas que ilustran juicios, descripciones y explicaciones; presenta las diversas voces que analizan, discuten y reflexionan sobre la evaluación universitaria y cómo influyen en ésta las contingencias del contexto. Una síntesis de los resultados perfila una evaluación institucional universitaria con diversas debilidades en su veracidad, credibilidad y justicia, por factores de naturaleza política y económica, y una cultura que la ritualiza y burocratiza; la actual evaluación está desconectada de los principios universitarios y anclada cada vez más a la política educativa federal para la obtención de recursos; la importancia ahora concedida a la evaluación, no está en su contribución para mejorar la educación, más bien en una «calidad certificada» que facilita el acceso a fondos públicos. Las reflexiones de los participantes plantean: ¿Por qué después de años de evaluaciones se ha mejorado tan poco? ¿por qué si la evaluación ha de hacerse, no aclarar sus intereses, buscar que sea de calidad y obtener los mejores beneficios para la institución y los universitarios? ; [eng] The importance given to the educational evaluation, since the prescription or condition to accede through the extraordinary financing of programs or institutions, increases the complexity, not just in the technique, but the ethics, with risks of reproducing the original inequalities of the assessed entities, by bringing discredit on, of a public service unaware of interests and quality models. Enrolled on this context, as other public universities which development depends of additional resources and a much more scanty grant, The Universidad Autónoma del Estado de Mexico (UAEM) takes part in recent praxis of evaluation-accreditation of its educative programs. Nowadays, that the evaluation and quality in the education appears as a main character, as never before, the reflection have been avoided, about the supposed neutrality of its process, results and judgments; the political atmosphere and the utilitarian culture, relegate the interrogation about the quality in the evaluation. I chose the chases focused in the evaluation research, with a qualified design oriented to offer a different view about the way, politics and institutional praxis evaluation reply to the university educative principles (UAEM); by the way assisting to improve comprehension in the participants about evaluation, as a basis in the reflection and «a change of view» applying a new and professional intervention. In the appointed context, the university evaluation is focused on the praxis immersed in this institutional atmosphere; these are: the evaluation of The Development Plan, the evaluation of the Annual Activity Report, by the Glosa Commision of the University Council, The external evaluation of the CIEES for their institutional functions, an institutional self-evaluation CONAEVA and some evaluations to establish programs with extraordinary financing. The empirical phase of this research come across the documental analysis, the non-participant observation (2002 and 2003), ultimately, interviews with authorities and evaluative personnel, all of these, as a main resource. The reached preliminary results are analyzed and organized, to draft the research inform of the evaluative subject, holding as a basis the fundamental criterion of evaluation, proposed by Ernest R. House (1997) of veracity, esthetic and justice, and the educational evaluation standard, as utility, facility, honesty and precision of the Evaluation Centre of the Western University of Michigan (1994). The evaluation report, trying to instigate the comprehension and identification of the reader, presents an informal writing, narrative, with some quotations that illustrates judgments, descriptions and explications; proposing the different voices that analyze, debate and reflect about the university evaluation, and how the context eventualities have influence on these.
ABSTRACT The findings of human skeletons are a sign of violence in the Moche valley as made by Dr. Steve Bourget in 1995. This was quite notable on a worldwide level, and raised many questions. As such, we were determined to investigate further. Was the evidence of violence found in the bone remnants of individuals of the Patio 3 A Platform II of the Moon Huaca an indication of human sacrifices executed within the framework of a cult during crisis? With the purpose of describing the physical characteristics and to identify the pathological evidence; identify the signs of violence present in the human bones; establish the relationship between the laboral activity developed by these individuals and the sacrificial rite within the archeological context and to establish the possible cause of the crisis cult carried out by the recovered group of individuals. The field methodology used was using the archeological registry and drawings on a 1:10 scales, as well as the film and photographic footage; using vertical and horizontal photographs in various perspectives according to the details or requirements of the samples. Additionally, the scene was treated with guidelines for exhuming and forensic registries. The human bones were patiently freed using instruments that would not scar them. The registry of each bone was done using grids and at its corresponding level, as well as complementary usual data: location, grid location and observations. They were numbered, gathered, stored in bags and placed in boxes, keeping in mind the anatomical position and lateral positioning (right, left), its nature (vertebras, ribs, etc.), having been drawn according to its exact position in the plane. The bone remains were well preserved, however, some of them presented the existence of salt crystals and a very fragile state, as well as a layer of fungus that enveloped them. This was removed. At the lab, we freed and cleaned the dirt and sand in order to carry out the osteological and osteometry analyses in order to arrive at a minimum quantifiable number of individuals, sex determination, age, height, pathological condition, variations and anomalies, labor stigmas, cultural evidence of violence and taphonomy, since the analysis has its angular stone in its meticulous and in-depth analysis, that the data allowed us to gather through systematic observation. The obtained data were registered in the Standards (BUIKISTRA-UBELAKER 1994) publication, and adapting them to the needs of the samples. The evidence of fractures, blunt blows, cuts, dislocation of the appendicular skeleton, among other characteristics of the biological profile, pathologies and epigenetic variations in the bone remains of the individuals (associated to layers of sediment y successive sands with indications of exposure to the environment), were compared with chemical analysis, taphonomy and iconographic data, ethnohistorical and ethnological. We concluded that: the bone remains correspond to 50 masculine individuals, approximately between 14 and 35 years, who were professional warriors, who were sacrificed and whose causes of death were: throat slitting, decapitation, and fractures or blunt injuries to the cranium, as evidenced by the ritualistic deaths within the probable framework of a crisis cult within the cosmovision of the Moche World, with diverse reasons and motives: political, social, religious, environmental and not just because of a mega nino, as the taphonomy evidence presents. ; RESUMEN Los hallazgos de esqueletos humanos con signos de violencia, en el valle de Moche, en 1995 hechos por el Dr. Steve Bourget, fue notable a nivel mundial, surgiendo diversas interrogantes, por lo que nos propusimos investigar acerca de si, ¿Las evidencias de violencia física en los restos óseos de los individuos encontrados en el particular contexto del Patio 3 A de la Plataforma II de Huaca de la Luna, corresponden a sacrificios humanos efectuados en el marco de un culto de crisis? Siendo el propósito: describir las características físicas y precisar las evidencias patológicas; identificar los signos de violencia presentes en los restos óseos; establecer la relación entre la actividad laboral desarrollada por estos individuos y el rito sacrificial en el contexto arqueológico; y, establecer la posible causa del culto de crisis efectuado con el grupo de individuos recuperados. La metodología de campo empleada fue utilizando el registro arqueológico y con dibujos a escala 1:10 así como el registro fílmico y fotográfico, plasmando fotos verticales, horizontales y en diversa perspectiva de acuerdo al detalle o requerimiento de los elementos de la muestra. El escenario fue tratado adicionalmente con pautas de exhumación y registro forense. Los huesos humanos sueltos fueron liberados pacientemente, utilizando instrumentos que no los laceren. El registro de cada hueso fue por la cuadrícula y el nivel correspondiente, así como datos complementarios usuales: lugar, cuadrante y observaciones. Fueron numerados, recolectados, guardados en bolsas y puestos en cajas; considerando la posición anatómica y lateralidad (derecha, izquierda), su naturaleza (vértebras, costillas, etc.), habiéndolos dibujado, para su localización precisa en un plano. Los restos óseos presentaron un buen estado de conservación; sin embargo, algunos mostraban cristales de sal y un estado físico muy frágil, así como una placa de hongos que los envolvía, por lo que fueron removidos. En el laboratorio realizamos la limpieza para liberarlos de tierra y arena y efectuar el análisis osteológico y osteométrico para lograr la cuantificación del número mínimo de individuos, determinación de sexo, edad, estatura, condiciones patológicas, variaciones y anomalías, estigmas laborales, evidencias culturales de violencia y tafonomía, por lo que el análisis tiene su piedra angular en la observación minuciosa y a profundidad, que nos permite recolectar los datos, mediante la percepción sistemática. Los datos obtenidos los registramos en las fichas establecidas en la publicación Standards (BUIKSTRA - UBELAKER 1994), y adaptándolos a las necesidades de la muestra. Las evidencias de fracturas, golpes contundentes, cortes, desarticulación de partes del esqueleto apendicular, entre otras características del perfil biológico, patologías y variaciones epigenéticas en los restos óseos de los individuos (asociados a capas de sedimento y arena sucesivas, con huellas de exposición al medio ambiente), fueron contrastadas con análisis químicos, tafonómicos y los datos iconográficos, etnohistóricos y etnológicos. Concluimos que: los restos óseos corresponden a 50 individuos masculinos, de entre 14 a 35 años aproximadamente, fueron guerreros profesionales, quienes fueron sacrificados a juzgar por las causas de muerte: degollamiento, decapitación y/o fractura contundente en el cráneo, evidenciando muertes rituales en el marco de probables cultos de crisis dentro de la cosmovisión del Mundo Moche, motivadas por razones diversas: política, social, religiosa, ambientales y no sólo por un mega niño, como lo evidencian las huellas tafonómicas. ; Tesis
INTRODUCCION-OBJETIVOS: La presente tesis describe la problemática provocada por los delitos de peligro abstracto. La tensión permanente entre norma primaria y principios del Derecho penal clásico -reserva, culpabilidad, inocencia, lesividad u ofensividad y proporcionalidad-; generado, básicamente, por una "Sociedad de riesgo". El legislador se ha volcado hacia un Derecho penal de autor, dejando atrás un Derecho penal de acto. El Derecho penal se ha expandido, no actúa como última ratio, se convierte en una especie de conformación social o instrumento de cambio de la sociedad. Lo dicho lleva a una reconceptualización del bien jurídico protegido. Asimismo, se ha buscado desentrañar si esa conducta legisferante de mayor endurecimiento punitivo, tiene justificación empírica, en base a datos criminológicos. También se analiza, brevemente, advirtiendo posiciones dogmáticas y doctrinarias, las últimas reformas del CP y con más precisión los delitos contra la seguridad vial. Se analiza la política criminal actual que radica en un constante y permanente adelantamiento de la barrera punitiva -tolerancia cero- y, con ello, un enfrentamiento con ciudadanos "peligrosos". METODOLOGÍA: Estudio descriptivo de bibliografía jurídica, revistas especializadas y jurisprudencia. Análisis estadístico. Asistencia y participación en cursos de especialización en derecho penal. CONCLUSION: A) Desde una visión dogmática: argumentos negativos 1) tipificar conductas peligrosas o aquellas que traen consigo peligro de peligro –delito obstáculo-, vulneran principios clásicos (reserva, lesividad, inocencia, culpabilidad, proporcionalidad e intimidad); 2) preeminencia de prevención general; 3) Conversión en un Estado paternalista de permanente control; 4) adelantamiento de la barrera punitiva, bajo intereses electorales. Argumentos a favor: 1) los códigos penales, no pueden, ni deben ser estáticos; 2) Intensa búsqueda de avanzar y "crecer" con la sociedad y su constante evolución; 3) Reformulación del concepto de bien jurídico protegido para adecuarlo a un moderno Derecho penal; B) Desde una visión político criminal, 1) obrar legislativo teñido de desidia por falta de estudios criminológicos serios o, a espaldas de los existentes, con fuerte influencia de los medios de comunicación 2) Utilización de los delitos de peligro abstracto como "arma" predilecta para regular conductas sociales, 3) Cuestionamientos a las últimas reformas del Código penal, entre ellos, los delitos contra la seguridad vial; 4) Aplicación de un Derecho penal del enemigo "apartando" al sujeto peligroso del todo social, -aumento de reclusos condenados por delitos contra la seguridad vial-. 5) Erosión de la cultura garantista y de aquella orientada hacia la reinserción; 6) La delincuencia ya no es vista como la consecuencia, a nivel individual, de desajustes sociales; sino como expresión de la actividad de un sujeto delincuente, disfuncional al todo social; 7) Quebrantamiento del welfarismo penal, incursionando en políticas de "tolerancia cero"; 8) Utilización de expresiones como terrorismo urbano, provocando estigmatización en sujetos no "incluidos" al todo social, 9) Falta de elaboración de políticas integradoras –política criminal, criminología y derecho penal-; 10) Acreditación empírica, en delitos contra la seguridad vial, que aún con baja en los números de víctimas mortales, se optó por endurecer los tipos penales, con ello: aumento de reclusos, incremento de juicios rápidos y urgentes, mayor número de condenados a TBC; 11) En consecuencia, aquella, tensión entre reglas primarias y principios se decanta por la primera; 12) Se propone hablar de un Derecho penal de confianza excluyente; 13) Proyectar un Derecho penal intermedio entre lo nuclear y accesorio, entre Derecho Administrativo y Derecho penal, 14) Proponer un concepto personal de bien jurídico protegido y 15) La administrativización de delitos de peligro abstracto. INTRODUCTION, OBJECTIVES: This tesis describes the problem area caused by crimes of abstract danger. The permanent tension between the primary rules and basic the principles of criminal law -reservation, culpability, inocence,harmnfulness and proportionality-: basicly generated by a "risk society".The legislator has turned his activity into an authoring criminal law, leaving away an acting criminal law. The criminal law has expanded, not only acting as a última ratio, but its becomes into a sort of social confrontation, or an instrument for socia change. That drives into a re-conceptualisation of the legal protected good. Furthermore, the unraveling of if there is a empirical justification on the basis of criminological data for endure the punishment for this legisferante conduct has been sought. The brief analysis, begining in a dogmatic position, of the last changes in the criminal law is also included, and more precisely the crimes against road safety. The analyse of the criminal policy, which lies in a constant and permanent hardening of the punitive barrier -Zero Tolerance- and a subsequent confrontation against "dangerous" citizens is also included. METHODOLOGY: Descriptive study of legal bibliography, specialized magazines and jurisprudence. Statitistical analysis. Attendance and participation in criminal law. CONCLUSION: A) Taking a Dogmatic approach: negative points 1) typify dangerous behaviour or that conducts thath may cause danger of a danger-obstacle crime- they violate the classic principles (reservation, harmfulity, inocence, culpability, proporcionality and intimacy); 2) General prevention preeminence; 3) Conversion into a paternalistic state of permanent control; 4) advance of the punitive barrier,due to electoral interest. En 1929 la Sociedad Anónima Importadora y Exportadora de la Patagonia, la empresa comercial y ganadera más poderosa del sur argentino, fundó la Revista Argentina Austral que se editó hasta 1968. La continuidad y la calidad de la edición, la amplia circulación y su trascendencia convirtieron a esta revista en una de las publicaciones más significativas de la Patagonia argentina y clara expresión de los intereses económicos y sociales de los sectores dominantes del sur. The continuity and quality of the publishing, scope of the circulation and its transcendence converted the review into one of Patagonia's most significant publications, in a clear expression of the economic and social interests of the south's dominant sectors. The review's founding contract centered on defending the south's interests, expressed by means of discursive representations of Patagonia, its inhabitants and the society responsible for the publication, which served to justify the arguments and demands. De la revisión bibliográfica se puede observar que existe un debate todavía abierto sobre comunidad, comunalidad, bienes comunes, gestión comunal. Numerosos autores sostienen que esta construcción social presenta potencialidades económicas, sociales y culturales que configuran formas de vida alternativas al capitalismo, mientras que otras líneas de pensamiento advierten sobre su desarticulación ante el avance de la mercantilización en las tierras comunales. Este trabajo está orientado a responder las siguientes preguntas de conocimiento: ¿Constituyen los sistemas comunales modelos alternativos de organización social bajo los cuáles es posible lograr una reproducción ampliada de la vida sin que impere la lógica capitalista como principio ordenador? ¿Bajo qué condiciones estructurales y de funcionamiento es esto posible? ¿Qué factores actúan como limitantes a la mercantilización total de la vida comunal? El trabajo se realizó a partir de un estudio de caso único que comprende la comunidad Colonia Jaime, ubicada en el departamento Robles de la provincia de Santiago del Estero. La estrategia metodológica giró alrededor de tres aspectos principales: 1) análisis de fuentes documentales; 2) entrevistas grupales e individuales y 3) observación participante. El trabajo de campo implicó estancias consecutivas en la comunidad pudiendo acceder a la biblioteca que contiene gran parte de la obra del fundador y vivenciar distintas actividades cotidianas. Tomando como referencia el enfoque de sistemas de producción y los teóricos de la comunalidad se diseñó una propuesta de abordaje de los sistemas comunales, identificando elementos estructurales y elementos de funcionamiento. A manera analítica, se expusieron estos elementos en forma separada, pero en la realidad se entremezclan manifestando la integralidad de la vida económica, social, cultural, política de los sistemas comunales. A partir de los resultados del caso se pueden extraer tres grandes reflexiones. La primera tiene que ver con la incorporación y utilización de los avances tecnológicos y del conocimiento de la sociedad moderna, pero tal adopción está subordinada a la lógica comunal que queda establecida previamente a partir de la discusión en Asamblea. La segunda reflexión se relaciona con el rol del Estado que ha venido actuando de catalizador e incluso como creador de propuestas tecnológicas que son transformadas al interior de la Colonia como alternativas contra hegemónicas. El éxito de tales alternativas se basó principalmente en la construcción en redes de colaboración y apoyo mutuo entre comuneros e instituciones del Estado, pero también en la capacidad de un sistema comunal que supo tomar ciertos aspectos de la modernización para asimilarlo a una visión comunal, donde la lógica capitalista perdió su centralidad. La tercera reflexión está en relación con el rol activo de los comuneros y su capacidad de toma de decisiones respecto a qué recibir y qué rechazar, a partir de los objetivos construidos en forma colectiva. A modo de cierre, el caso de Colonia Jaime pone en escena no solo las diversas formas de organización social que merecen ser rescatadas, sino también muestra posibilidades de generar procesos de acumulación en sistemas comunales diferentes a los históricamente conocidos. La problemática que surge al pensar en términos de aportes para las políticas públicas se refiere a su replicabilidad bajo condiciones sumamente adversas como las que caracterizan a importantes territorios rurales de América Latina y su viabilidad a más largo plazo sin un considerable apoyo externo. ; From the literature review it can be observed that there is still a debate open about community, commonality, common goods and communal management. Many authors argue that this social construction has economic, social and cultural potential life forms that make up alternatives to capitalism, while other lines of thought warn about their disarticulation before the advance of marketization on communal lands. This work is aimed at answering the following knowledge questions: Do communal systems constitute alternative models of social organization under which it is possible to achieve an enlarged reproduction of life without capitalist logic as a ruling principle? Under what structural and operational conditions is this possible? What factors act as constraints to the total commodification of communal life? The work was carried out from a single case study comprising the Colonia Jaime community, located in the Robles department of the province of Santiago del Estero. The methodological strategy revolved around three main aspects: 1) analysis of documentary sources; 2) group and individual interviews and 3) participant observation. The field work involved consecutive stays in the community, being able to access the library that contains a large part of the founder's work and experience different daily activities. Taking as a reference the approach of production systems and the communality theorists, a proposal for approaching the communal systems was designed, identifying structural elements and functioning elements. In an analytical way, these elements were exposed separately, but in reality, they intermingle, manifesting the integrality of the economic, social, cultural and political life of the communal systems. From the results of the case three great reflections can be extracted. The first has to do with the incorporation and use of technological advances and knowledge of modern society, but such adoption is subordinated to the communal logic that is previously established from the discussion in Assembly. The second reflection is related to the role of the State that has been acting as a catalyst and even as a creator of technological proposals that are transformed within the Colony as alternatives against hegemonic. The success of such alternatives was based mainly on the construction of networks of collaboration and mutual support between commoners and state institutions, but also on the capacity of a communal system that knew how to take certain aspects of modernization to assimilate it to a communal vision, where the capitalist logic lost its centrality. The third reflection is related to the active role of the commoners and their ability to make decisions about what to receive and what to reject, based on the objectives built collectively. To conclude, the case of Colonia Jaime enacts not only the various forms of social organization that deserve to be rescued, but also shows possibilities of generating processes of accumulation in various communal systems to historically known. The problem that arises when thinking in terms of contributions to public policies refers to their replicability under extremely adverse conditions such as those that characterize important rural territories in Latin America and their longer-term viability without considerable external support. ; Fil: Suarez, Maria Victoria. Mención Internacional en el título de doctor ; Ciberespacio: la última frontera. Aquí es donde empieza la nueva misión de los juristas en buscar nuevas formas de ejercicio de los derechos humanos. Afortunadamente, no es una misión de ciencia ficción, sino un desafío real, actual y lleno de oportunidades. Consideramos que es el mejor momento para proponer esta tesis e iniciar un trabajo de investigación sobre la dinámica del derecho en la era de las nuevas tecnologías. La tesis está fundamentada en la investigación de este nuevo espacio donde ha entrado el ser humano, titular de los derechos y libertades fundamentales. Como cualquier entorno nuevo, despierta la curiosidad, la necesidad de explorar, pero también la necesidad de estar seguro. El ser humano está programado genéticamente para proteger su vida, integridad y libertad en cualquier entorno, tanto físico como virtual. La ciberseguridad es un tema nuevo, que empezó a fomentar los debates solo desde 1988. Estados, empresas privadas y especialistas se dieron cuenta rápidamente de la necesidad de regular este campo, incluso adaptando el derecho internacional a las nuevas realidades. Los conflictos, eventos frecuentes en la sociedad humana, han migrado rápidamente del espacio físico al espacio virtual, al igual que las armas. Los virus informáticos, las aplicaciones invasivas y el software de espionaje sustituyen a las armas y herramientas de guerra clásicas. Las medidas de seguridad propuestas e implementadas por las autoridades estatales con responsabilidades en el ámbito de la seguridad nacional, así como por empresas privadas que desarrollan programas para combatir ciberataques, basados en medidas de ciber espionaje o hack-back1, se adaptan a los nuevos desafíos tecnológicos, pero evitan solucionar problemas importantes para el individuo como el respeto a sus derechos fundamentales, cuyo reconocimiento y regulación le han costado años de lucha y fundamentación filosófico-legal. En este contexto, cuando la vida del ciudadano se traslada, cada vez más al espacio virtual con todos sus elementos - banca por internet, telemedicina, información e investigación de fuentes digitales, comercio electrónico, citas virtuales, realidad virtual - se deben proponer medidas para proteger el ciberespacio que pueden ser diseñadas en correlación directa con las medidas de seguridad aplicadas en el entorno offline. Si el entorno offline está claramente determinado, y hay actores con papeles muy claros (estados, territorios administrativos, instituciones con responsabilidades en el campo de la seguridad y protección de los ciudadanos, etc.), el espacio virtual sigue siendo una jungla, sin límites conocidos y con incipientes formas de órganos de control, que deberían proteger a los usuarios vulnerables para no ser víctimas de los manipuladores digitales. En este momento, las Naciones Unidas a través de sus comisiones y grupos de expertos, ha asumido el papel de garante de los derechos humanos en el ciberespacio, interpretando las disposiciones de los tratados internacionales y elaborando recomendaciones, para ciber conflictos y alianzas entre Estados y grandes empresas con control tecnológico sobre Internet, tanto en términos de contenido como de conexiones informáticas. A nivel de la Unión Europea, el papel de las instituciones comunitarias, bien definido en el proceso de desarrollo y aplicación de las normas jurídicas, permite diseñar un marco jurídico coherente para la política de ciberseguridad, asegurando un sistema de protección eficaz basado en la cooperación entre los Estados miembros, al mismo tiempo con una protección efectiva de los derechos individuales en el entorno virtual. La tradición democrática de los estados europeos contribuye a la identificación de soluciones viables con respecto a la libertad del ciberespacio y la importancia del individuo en la sociedad. El surgimiento y el fortalecimiento del papel de ENISA en la política europea de ciberseguridad, ofrece la ventaja de estandarizar, centralizar y explotar de manera coherente los datos comunicados por los Estados miembros con el fin de desarrollar normativas bien fundamentadas. Asimismo, esta tesis estudia algunas categorías de derechos fundamentales para descubrir la forma en que se ven influenciados por la nueva realidad de la vida cotidiana. El entorno en el que se ha estudiado y conceptualizado estos derechos a lo largo de la historia, hasta la confirmación en diversos instrumentos de derecho internacional, ha cambiado profundamente. Las amenazas comienzan a ser diversas, y para los juristas no especializados en informática, es un gran reto identificar las brechas en los mecanismos informáticos que garanticen y protejan los derechos fundamentales cuando el individuo actúa en el entorno online. Es posible que la generación de juristas nativos digitales se haga cargo del trabajo de los juristas adaptados digitalmente y sea capaz de construir un sistema legal aplicable a este nuevo entorno de vida del individuo. Esto será posible solo dentro de 10 años, cuando la nueva generación creada en la era de las nuevas tecnologías, posea la capacidad de analizar y proponer soluciones legales. La investigación se centra en el derecho a la privacidad y los elementos que lo componen, siendo considerado como uno de los derechos fundamentales más vulnerables en el entorno online. Los derechos derivados, como el derecho al nombre, la identidad, el honor, la dignidad y la integridad física se están transformando y adquiriendo nuevos valores en la era de las nuevas tecnologías. Algunos de estos derechos se transforman, se trasladan al ciberespacio, se adhieren al ser virtual y se convierten en derechos digitales, propios del nuevo entorno social. En el contenido de la tesis se desarrolló un capítulo dedicado a esta nueva categoría de derechos en el que se intenta establecer sus contenidos y las formas de manifestación. Con respecto a los mecanismos necesarios para garantizar el ejercicio de los derechos y libertades fundamentales, el trabajo analiza los distintos niveles de protección: desde el nivel supranacional (internacional), hasta el regional y nacional, específico de cada Estado. Los mecanismos institucionales y jurisdiccionales están organizados en gran medida de acuerdo con las mismas reglas, guiándose por las regulaciones internacionales sobre derechos humanos, en particular, continuando con las regulaciones a nivel regional y estatal. En el nuevo contexto tecnológico, es necesario revisar dichos mecanismos para que mantengan la misma eficiencia deseada en el momento de su creación. Un punto importante de la investigación consiste en el análisis de las restricciones aplicadas a los derechos humanos bajo el imperio de la Ley. Sin referirse a las injerencias ilegales, sino analizamos la injerencia permitida por la ley, especialmente en nombre de la seguridad colectiva. Seguidamente, se muestran los debates y análisis destinados a establecer el punto de equilibrio entre la importancia de un derecho fundamental u otro. Tanto el derecho a la vida privada como el derecho a la seguridad se consideran fundamentales, pero no absolutos. Desde esta perspectiva, se deben establecer límites claros para que la protección de uno no afecte la integridad del otro. Los Estados a veces imponen medidas excesivamente restrictivas del derecho a la privacidad en nombre de la seguridad nacional, y el ciberespacio es el entorno adecuado para tales prácticas. Cualquier práctica de este tipo, situada a uno de los dos extremos, ya sea muy invasiva en la esfera personal o ineficaz desde una perspectiva de seguridad, debe ser reevaluada y relacionada con los derechos humanos, tanto desde una perspectiva individual como colectiva. Por ejemplo, el derecho a la vida privada o el derecho a la seguridad del ser humano puede, dentro de límites razonables, restringir el derecho de otra persona a expresarse o manifestar ciertas necesidades mentales en el espacio digital. Teniendo en cuenta los objetivos propuestos al principio, aplicando los métodos de investigación correspondientes y analizando la literatura, el marco normativo vigente y la jurisprudencia en derechos humanos, esta tesis identifica y enfatiza la interacción entre los derechos humanos fundamentales y los efectos sociales de las nuevas tecnologías, incluyendo las consecuencias sobre los derechos conexos. En este contexto particularmente dinámico, el mayor desafío para la nueva generación de juristas será adaptar el marco legal actual, a las nuevas realidades del mundo digital. Dado que las normas de derecho que rigen nuestra vida cotidiana han evolucionado lentamente y durante un largo período de tiempo, la rápida evolución tecnológica y la migración del individuo al espacio virtual requieren una urgente adaptación del marco legal a las nuevas realidades para que la Ley pueda mantener su misión de guardián del bienestar público. Además, esta nueva pandemia, origina y causa inciertos ampliamente cuestionado en el entorno online, ha provocado una restricción en masa de los derechos humanos similar a la última guerra mundial. Se ha restringido el derecho a la: libertad de circulación, manifestación, reunión, expresión, educación, trabajo e incluso el derecho a buscar la felicidad. Por la limitación de estos derechos la gente, por temor al enemigo invisible e incomprendido, aceptó sin oposición la mayor parte todas estas injerencias de las autoridades en su vida privada y en el conjunto de sus libertades fundamentales. Solo pequeños grupos de activistas continúan luchando por defender sus derechos fundamentales. No sabemos si este evento global llamado pandemia COVID 19 reescribirá la historia de los derechos fundamentales, pero es cierto que su impacto en el ámbito de las libertades individuales ha tenido un efecto muy fuerte e inquietante con respecto a otra transformación, incluida la revolución tecnológica. En estas condiciones, nos queda una única opción o desafío: defender al individuo, con todos sus atributos, en una sociedad dinámica, caracterizada por transformaciones atípicas. ; Spațiul cibernetic – ultima frontieră. Aici începe misiunea juriștilor în căutarea noilor forme de exercitare a drepturilor omului. Din fericire, nu este o misiune science- fiction, ci este o provocare reală, actuală și plină de oportunități. Consider că am ales cel mai bun moment pentru a propune această teza și a iniția o muncă de cercetare asupra dinamicii dreptului în era noilor tehnologii. Această eră este abia la început. Lucrarea de față pornește de la cercetarea acestui nou spațiu în care a pătruns ființa umană deținătoare a drepturilor și libertăților fundamentale. Ca orice mediu nou, stârnește curiozitatea, nevoia de a explora dar și nevoia de a fi în siguranță. Ființa umană este programată genetic să își protejeze viața, integritatea și libertatea în orice mediu s-ar afla, atât fizic cât și virtual. Securitatea spațiului cibernetic este o temă nouă, se discută despre acest subiect abia din anul 1988. Statele, companiile private și specialiștii au conștientizat rapid necesitatea reglementării acestui domeniu, inclusiv prin adaptarea dreptului internațional la noile realități. Conflictele, evenimente frecvente în societatea umană, au migrat rapid din spațiul fizic în spațiul virtual, la fel și armele. Virușii informatici, aplicațiile intruzive, softurile de spionaj iau locul clasicelor arme și unelte de război. Măsurile de securitate propuse și implementate de autoritățile statale cu atribuții în domeniul securității naționale, cât și de companiile private care dezvoltă programe de combatere a atacurilor cibernetice, bazate pe spionaj cibernetic sau măsuri de tipul hack-back se adaptează noilor provocări tehnologice, dar ocolesc teme importante pentru individ cum ar fi respectarea drepturilor sale fundamentale, a căror recunoaștere și reglementare au costat ani buni de luptă și fundamentare filosofico-juridică. În contextul în care viața cetățeanului migrează din ce în ce mai mult către spațiul virtual, cu toate elementele ei – internet banking, telemedicină, informare și cercetare din surse digitale, comerț electronic, virtual dating, virtual reality – măsurile de protecție a spațiului cibernetic trebuie gândite în directă corelare cu măsurile de securitate aplicate în mediul off-line. Dacă mediul off-line este clar determinat și există actori cu roluri clare (state, teritorii administrative, instituții cu atribuții în domeniul securității și siguranței cetățeanului etc.), spațiul virtual este încă o junglă, fără limite cunoscute și cu organisme XIV de supraveghere în stadiu incipient de dezvoltare care ar trebui să poată proteja utilizatorii vulnerabili în cazul în care devin victime ale unor manipulatori digitali. La acest moment Organizația Națiunilor Unite, prin comisiile și grupurile de experți, și-a asumat rolul de garant al drepturilor omului în spațiul cibernetic, interpretând prevederile tratatelor internaționale și elaborând recomandări pentru conflictele cibernetice și parteneriatul dintre state și marile companii care dețin controlul tehnologic asupra Internetului, atât din perspectiva conținutului cât și al conexiunilor informatice. La nivelul Uniunii Europene, rolul instituțiilor comunitare, fiind bine definit în ceea ce privește elaborarea și implementarea normelor de drept, permite creionarea unui cadru legal coerent în ceea ce privește politica de securitate cibernetică, asigurarea unui sistem efectiv de protecție bazat pe cooperarea dintre statele membre, dar și protecția efectivă a drepturilor individuale în mediul online. Tradiția democratică a statelor europene contribuie la identificarea unor soluții viabile în ceea ce privește libertatea spațiului cibernetic și importanța individului în societate. Apariția și întărirea rolului ENISA în politica europeană de securitate cibernetică oferă avantajul uniformizării, centralizării și exploatării coerente a datelor raportate de statele membre în vederea elaborării unor reglementări corect fundamentate. Teza studiază și categoriile de drepturi fundamentale din perspectiva modului în care acestea se văd influențate de noua realitate a vieții cotidiene. Mediul în care aceste drepturi au fost studiate și conceptualizate de-a lungul istoriei până la momentul proclamării lor în diverse instrumente de drept internațional, s-a schimbat profund. Amenințările încep să fie altele decât cele cunoscute, iar pentru juriști, eminamente atehnici, este o mare provocare identificarea breșelor din mecanismele de garantare și protecție a drepturilor fundamentale atunci când individul acționează în mediul online. Este posibil ca generația juriștilor nativi digitali să preia munca juriștilor adaptați digitali și să poată construi un sistem legal aplicabil acestui nou mediu de viață al individului, dar acest lucru va fi posibil abia peste 10 ani când noua generație, născută în epoca noilor tehnologii, va avea capacitatea de a analiza și propune soluții juridice. Cercetarea s-a focalizat cu precădere asupra dreptului la viață privată și a elementelor care îl compun, considerat fiind ca unul dintre cele mai vulnerabile drepturi fundamentale în mediul on line. Drepturile derivate, precum dreptul la nume, la identitate, la onoare, la demnitate, la integritate fizică se transformă și capătă noi valențe în era noilor tehnologii. O parte dintre aceste drepturi se transformă, migrează în spațiul cibernetic, se atașează ființei virtuale și devin drepturi digitale, specifice noului mediul de viață socială. În cuprinsul tezei a fost dezvoltat un capitol dedicat acestei noi categorii de drepturi în care se încearcă stabilirea conținutului și a formei de manifestare. În ceea ce privește mecanismele de garantare a exercițiului drepturilor și libertăților fundamentale, lucrarea analizează diversele niveluri de protecție: de la nivelul suprastatal (internațional), la cel regional și cel național, specific fiecărui stat. Mecanismele instituționale și jurisdicționale se organizează în mare parte după aceleași reguli fiind ghidate de reglementările internaționale în materia drepturilor omului, cu precădere, continuând cu reglementările la nivel regional și statal. În noul context tehnologic, inclusiv aceste mecanisme necesită o revizuire astfel încât să își poată păstra eficiența dorită la momentul creării lor. Un punct important al lucrării îl reprezintă analiza restrângerilor aplicate drepturilor omului sub imperiul legii. Așadar nu ne referim la ingerințele aflate în sfera ilegalului, ci la ingerințele permise de lege, în special în numele securității colective. Aici apar dezbaterile și analizele care vizează stabilirea punctului de echilibru între importanța unui drept fundamental sau al altuia. Atât dreptul la viață privată, cât și dreptul la securitate sunt considerate fundamentale, dar nu absolute. Din această perspectivă, trebuie stabilite limite clare astfel încât protejarea unuia să nu afecteze integritatea celuilalt. Uneori statele stabilesc măsuri restrictive exagerate asupra dreptului la viață privată în numele securității naționale, iar spațiul cibernetic este mediul propice pentru acest gen de practici. Orice practică de acest gen, aflată la una dintre cele două extreme, fie intrusivă în sfera personală, fie ineficientă din perspectiva securității, trebuie reevaluată și corelată cu drepturile omului, atât din perspectivă individuală cât și colectivă. De exemplu, dreptul la viață privată sau dreptul la securitate al ființei umane poate restrânge, în limite rezonabile, dreptul altei persoane de a se exprima sau de a-și manifesta anumite nevoi psihice în spațiul digital. Ținând cont de obiectivele propuse, cu aplicarea metodelor de cercetare asumate și analizând literatura de specialitate, cadrul normativ în vigoare și jurisprudența referitoare la drepturile omului, această teză identifică și subliniază interacțiunea dintre drepturile fundamentale ale ființei umane și efectele sociale ale noilor tehnologii, inclusiv consecințele asupra drepturilor conexe. În acest context deosebit de dinamic, cea mai mare provocare pentru noua generație de juriști va fi adaptarea cadrului legal în vigoare la noile realități ale lumii digitale. În condițiile în care normele de drept care ne guvernează viața de zi cu zi au avut o evoluție lentă și extinsă pe o perioadă lungă de timp, evoluția tehnologică rapidă și migrarea individului în spațiul virtual impun o adaptare urgentă a cadrului legal la noile realități astfel încât norma de drept să își poată păstra misiunea de gardian al binelui public. Mai mult, această nouă pandemie, cu origini și cauze incerte, aprig dezbătute în mediul online, a determinat o restrângere în masă a drepturilor omului poate la fel de acerbă cu cea provocată de ultimul război mondial. Ne-au fost restrânse pe rând dreptul la libertatea de mișcare, dreptul la întruniri, dreptul la manifestări, dreptul la exprimare, dreptul la educație, dreptul la muncă și inclusiv dreptul la căutarea fericirii. Iar oamenii, de teama inamicului nevăzut și neînțeles, au acceptat în cea mai mare parte toate aceste ingerințe ale autorităților în viața lor privată și în cercul libertăților lor fundamentale. Grupuri mici de activiști continuă lupta de apărare a drepturilor lor fundamentale. Nu știm dacă acest eveniment global numit pandemie va rescrie istoria drepturilor fundamentale, dar cert este că impactul lui asupra sferei libertăților individuale a avut un efect mult mai abrupt și mai intrusiv decât orice altă transformare, inclusiv cea tehnologică. În aceste condiții, ne rămâne o singură opțiune: aceea de a apăra individul, cu toate atributele sale, într-o societate dinamică, caracterizată de transformări atipice. ; Cyberspace - the last frontier. This is where the mission of the lawyers begins: to search new forms of human rights manifestation. Fortunately, it is not a science-fiction mission, but a real, current and full of opportunities challenge. We consider that this is the best-chosen moment to propose this paper and to initiate a research work on the dynamics of law under the era of new technologies. Because this era has just begun. This thesis aims to explore this new space where the human being, holder of fundamental rights and freedoms, has entered. Like any new environment, the digital world arouses curiosity, engages the human need to explore but also activates the need to be safe. The human being is genetically programmed to protect his life, integrity and freedom in any type of environment, no matter if is real or virtual. Cybersecurity is a new topic; this topic has been brought in public debates only since 1988. States, private companies and specialists have quickly become aware of the need of regulation in this area, including by adapting international law to new realities. Conflicts, as frequent events in human society, have rapidly migrated from physical to the virtual space. The weapons as well. Cyber viruses, spyware, worms, malware took the place of the classic weapons and tools of war. The proposed security measures were implemented by state authorities with responsibilities in the field of national security, as well as by private companies. The efforts made to develop programs to fight against cyber-attacks, based on cyber espionage or hack-back measures, must be adapted to ever new technological challenges, but not forgetting the important issues for the individual human being, such the respect for his fundamental rights, whose recognition and regulation have cost years of legal struggle and philosophical debates. In this context, where the life of the citizen migrates more and more to the virtual space, with all its elements - internet banking, telemedicine, information and research from digital sources, electronic commerce, virtual dating, virtual reality – protective measures for cyberspace must designed in direct correlation with the security measures applied in the offline environment. If the offline environment is clearly determined, populated with actors playing key roles (states, administrative territories, institutions with responsibilities in the field of XVIII security and safety of citizens, etc.), the virtual space is still a jungle, with unknown limits and incipient supervisory bodies struggling to protect vulnerable users against digital criminals. At this moment, the United Nations, through its commissions and expert groups, has taken on the role of human rights protector in cyberspace, interpreting the provisions of international treaties and developing recommendations for cyber conflicts and partnerships between states and large companies with technological control over the Internet, both in terms of digital content and computer connections. In the European Union, the specific role of the public institutions in the legal area allows drafting a coherent legal framework for cybersecurity policy, ensuring an effective system of protection based on cooperation between Member States, also bringing an effective protection of individual rights in the online environment. Also, the democratic tradition of Member States contributes in finding viable solutions regarding the freedom of cyberspace respecting, in the same time, the social importance of the human being. The creation on ENISA, with its determined role in the European cybersecurity policy, offers the advantage of a coherent approach in standardizing, centralizing and exploiting the data reported by Member States in order to develop well-founded regulations. The thesis also studies some categories of fundamental rights observing the new perspective of human liberty and privacy induced by technology and digitalization of reality. It is obvious that the initial environment where these rights have been studied and conceptualized has radically changed and their legal confirmation in the international law must be adapted to the new reality. The new digital threats to human fundamental rights are different from the known ones, and for the lawyers, who are non-technical by nature, it is a great challenge to identify the gaps in the informatics mechanisms of protecting fundamental rights when the person acts in the online environment. Maybe the generation of digital native lawyers will take over the work of digitally adapted lawyers and will be able to build a legal system applicable to this new living environment of the individual, but this success will be possible only after the next 10 years, when the new generation, born in the age of new technologies, will have the ability to analyze and propose legal solutions. The research focused mainly on the right to privacy and its legal components, being considered as one of the most vulnerable fundamental rights in the online environment. Connected human rights, such as the right to a name and to a nationality, identity, honor, dignity, physical integrity, are transforming and gaining new values in the era of technology. Some of these rights are reinvented and relocated into cyberspace, where they attach to the virtual human being and become digital rights, specific to the digital social environment. In the thesis there we dedicated a chapter to this new category of human liberties, aiming to establish the content and the limits of these new digital rights. Regarding the mechanisms for guaranteeing the exercise of fundamental rights and freedoms, the paper analyzes the various levels of protection: from the supranational (international) level, to the regional and national level, specific to each state. The institutional and jurisdictional mechanisms are largely organized according to the same rules, being guided by international human rights framework, at a global level, and particularly regulated by regional or local specific legal regulations. In the new technological context, these mechanisms need to be revised so that they can maintain their desired efficiency as the moment of their creation. Another important point of this paper is the analysis of the restrictions applied to human rights under the rule of law. So, we are not referring to any illegal interference, but we analyze the limitations allowed by law, especially in the name of collective security. This is the point where debates and analyzes converge in finding the perfect balance between the importance of one fundamental right to another. Both right to privacy and right to security are considered fundamental, but not absolute. From this perspective, clear boundaries must be set so that the exercise of one right does not affect the integrity of the other. Sometimes states impose overly restrictive measures on the right to privacy in the name of national security, and cyberspace is the perfect environment for such practices. Any practice situated at one of the two extremes, either intrusive in the personal sphere or inefficient from a security perspective, must be re-evaluated and correlated with the human rights, both from an individual and a collective perspective. For example, the right to privacy or the right to security of one person may interfere, in reasonable limits, with the right of another person to express himself or herself or to manifest certain psychical needs in the digital space. Fallowing the proposed objectives, applying the specific research methods and analyzing the legal literature, the regulatory framework and the jurisprudence on human rights, this thesis identifies and emphasizes the interaction between fundamental human rights and the social effects of the new technologies, including the consequences on related rights. In this particularly dynamic context, the biggest challenge for the new generation of lawyers will be to adapt the current legal framework to the new realities of the digital world. Given that the rules of law governing our daily lives have a long and slow evolution, this rapid technological revolution and the migration of the individual into virtual space urge for a quick adjustment of the legal framework to new realities so that the rule of law to be able to keep its mission of guardian of the public welfare. Moreover, this new pandemic, with uncertain origins and causes, hotly debated in the online environment, has led to a more severe human rights restriction than the last world war. We have been restricted in our right to freedom of movement, right to public meeting, right to manifestation, right to expression, right to education, right to work and even our right to pursue happiness. Under the fear of the unseen and unknown enemy, people accepted the most part all these interferences from the authorities in their private lives and in their circle of fundamental freedoms. Small groups of activists continue the fight to defend their fundamental rights. We do not know whether this global event called the pandemic will rewrite the history of fundamental rights, but it is certain that its impact on the individual freedoms has already determined a huge and more intrusive impact than any other transformation, including technological.
