Il sistema basato sulla dottrina politica nazionalsocialista non nacque accompagnato né da una base culturale giuridica propria, né con il presupposto di "appoggiarsi" allo Stato per poter riorganizzare la vita sociale ed economica tedesca. In effetti, furono i numerosi giuristi nazionalsocialisti ad elaborare una sorta di "struttura delle fonti giuridiche" che costituisse una riserva di strumenti giuridici da utilizzare per raggiungere un punto di "fusione" tra impianto istituzionale e dottrina politica di indirizzo.Gli effetti distorsivi che il nuovo "Diritto Nazionalsocialista" ebbe nella gestione dei territori, specie in quelli occupati durante la guerra, si manifestarono con maggiore intensità sul territorio polacco, o meglio su quella porzione di territorio rinominato Generalgouvernement für die besetzten polnischen Gebiete; sia negli alti livelli della Zivilverwaltung, sia nell'amministrazione dei distretti locali (Kreise), i personalismi dei funzionari si manifestarono con forza, anche grazie all'uso di forme di decretazione personale dotate di differente efficacia.L'obiettivo di questo scritto è porre in relazione gli strumenti giuridici di decretazione personale con l'operato dei molti "piccoli Führer" che operarono in una entità amministrativa atipica come il Governatorato generale di Polonia mostrando, talvolta prima conl'inadeguatezza che con la brutalità, il volto peggiore della Zivilverwaltung. ; The system based on National Socialist political doctrine was born neither accompanied by a legal cultural basis of its own, nor with the premise of "relying on" the State in order to reorganize German social and economic life. In fact, it was the numerous National Socialist jurists who elaborated a sort of "structure of legal sources" which constituted a reserve of legal instruments to be used to reach a point of "fusion" between institutional structure and political doctrine.The distorting effects that the new "National Socialist Law" had in the management of territories, especially in those occupied during the war, manifested themselves with greater intensity on Polish territory or, more precisely, on that portion of territory renamed Generalgouvernement für die besetzten polnischen Gebiete, more simply the General Government of Poland; both in the high levels of the Zivilverwaltung and in the administration of the local districts (Kreise), the personalisms of the officials manifested themselves strongly, also thanks to the use of forms of personal decree with different effectiveness. The objective of the "codification" of the regime thus became the object of exploitation, both by the upper echelons of the party (including Hitler), and by those who worked in the administration of the GG, especially some local officials. They, in different forms and with different intensity, fulfilled their functions as petty dictators, using juridically different and territorially limited versions of the personal decree.Frank found himself in the position of having to justify to his Führer the leadership of the «Gau of the Vandals» and his being at the same time a man of law. Hitler expressed his contempt for the category of jurists whom he considered "traitors to the people", calling them «mentally handicapped from birth or destined to become so with the passage of time» and declared in a speech to the Reichstag on April 26, 1942 that he would have no «peace until every German was convinced that being a jurist was a shameful disgrace». Curiously, the actual exercise of power by the dictator, based on his undisputed personal and political authority, was justified on the juridical level by the doctrinal interpretation of some singular normative instruments, the Führererlasse, the maximum expression of "compromise", between justification of existing power and an attempt to codify its strength and contents in a peculiar Nazi "constitutional" structure.They were never formally part of the German legal order, but were de facto an element approved and amply justified by the National Socialist juridical doctrine, which influenced the life of the Reich and the territories it controlled, feeding and amplifying that system of double institutional levels. which had its most chaotic realization in the GG. The attitude of absolute sovereign on the part of the Kreishauptmänner was typical in the local districts; even from these childish behaviors and from the ostentation of a pomp which was often the result of robbery and looting, it was possible to recognize both the amateurism of a large slice of the administrative staff, and the almost unlimited possibilities caused by the use of personal instruments in the hands of district chiefs.The command practice was based on recommended and unpunished violence: the existence of some very rare "oases of normal administration" depended exclusively on the will of the individual local leaders and on the resonance that their actions could have at the top of the state nomenclature. The way the population was treated was aimed at leaving a mark on German occupation policy and showing the efficiency of the administrators, through construction work (Aufbauarbeit) of a testimony of the historische Mission in Ostgebiet.The objective of this paper is to relate the instrument of personal decree with the powers of which they were at the same time cause and consequence, and the behavior of the individual officials who operated in the various institutional levels taken into account, mentioning some cases of an atypical administrative entity like GG.

Il Corpus Iuris si occupa, quasi esclusivamente, della conflittualità confinaria tra privati. Quando il richiamo ai testi del diritto romano viene effettuato serve solo per conferire 'autorevolezza' a soluzioni che assai spesso si fondano su pratiche di composizione legate alla prassi. Le regole elaborate dai giuristi medievali trovano così la loro formalizzazione sul piano del diritto, ma rinviano a un modo di vivere i confini tra comunità legato agli spostamenti, alle abitudini, alle comuni necessità esistenziali. D'altra parte l'esistenza di demarcazioni nette (che pure esistono) rinvia non tanto a una pretesa politica esclusiva e totalizzante, quanto piuttosto all'esercizio di diritti e prerogative determinati. ; In what Paolo Grossi calls «the sapiential Middle Ages» jurists engaged themselves in defining a set of rules aiming at the settlement of boundary disputes, which previously were not established by any normative text. The Corpus Iuris concerns nearly exclusively boundary disputes between private individuals. References to texts of the Roman law were meant to give 'authority' to resolutions often based upon customary praxis. The norms elaborated by Middle Ages jurists are thus given a formal legal shape; yet, they are linked to a perception of the boundaries between communities that was affected by the displacements, the customs, the common needs of everyday life. On the other side the existence of actual neat demarcations was linked to the exertion of certain rights and privileges rather than to an exclusive and absolute political claim.

In the last decades, much work have been done to deconstruct the mechanisms of government in Early Medieval Europe. In that task, the interpretation of the settlement of disputes and royal/imperial diplomas as the basis of the central government strategies in local spheres has been underlined by recent historiography. Following this methodology, the aim of this article is, thus, to analyze the mechanisms of governance in the March of Tuscany in a time characterized by political fluidity, focusing in the role played by the kings and lay and ecclesiastical aristocracies in the construction of complex political systems.

Questa tesi punta a ricostruire il pensiero politico di Bell tra il secondo dopoguerra e la metà degli anni Settanta. In tale arco cronologico, la riflessione politica di Bell si profila, per usare una formula di Jean-François Lyotard, come una «grande narrazione» del capitalismo. Nel complesso, cioè, l'opera di Bell appare come una storia sociologica del capitalismo, che nella fine delle ideologie registra l'apogeo del fordismo e, in seguito, ne mette in luce le trasformazioni in senso post-industriale, indagando le ricadute che tali mutamenti implicano sul piano dei rapporti di potere e della legittimazione del sistema. Nell'ottica di Bell, pertanto, il capitalismo non costituisce soltanto un sistema economico, ma la forma specifica attraverso cui si dispiega la società nel suo complesso, attivando una serie di rapporti di potere mediante i quali gli individui vengono coordinati e subordinati. Una siffatta concezione del capitalismo agisce immediatamente la questione del potere e solleva un interrogativo a esso connesso: «che cosa tiene insieme una società?». Una domanda che attraversa la traiettoria intellettuale di Bell e, sia pure declinata mediante una terminologia sociologica, riflette in realtà l'ambizione delle scienze sociali di farsi teoria politica. Esse si presentano quindi come teoria politica della modernità, nella misura in cui distinguono il potere sociale dal potere politico e, al tempo stesso, instaurano tra i due poli una tensione dialettica produttiva. Mettendo a fuoco la concettualizzazione del potere nell'opera di Bell si analizzeranno le mutazioni nel rapporto tra Stato e società negli Stati Uniti durante la Golden Age del capitalismo. In particolare, si metterà in luce nella grande narrazione di Bell l'ascesa e il declino di un ordine istituzionale che, alla metà degli anni Settanta, appare percorso da molteplici tensioni politiche e sociali che preannunciano l'avvento dell'età globale e il bisogno di una nuova "scala" di governo. ; This dissertations deals with Daniel Bell's political thought between the post-war era and the Seventies. During these years, Bell's political reflection appears to be, to say it in the words of Jean-François Lyotard, a «grand narrative» of capitalism. Overall, Bell's work is a sociological history of capitalism. It points out the height of fordism by assuming the end of ideology, and then sheds light on the post-industrial transformations, looking at the effects produced on power relations and the legitimacy of the socio-political system. In Bell's view, capitalism is not only an economic system, but a complex social system which places individuals in the power structure by means of subordination and coordination. «What holds a society together?» is the question that go trough the whole trajectory of his reflection. It looks a sociological question, but actually it is a political question, because the order of society depends on the legitimacy of obligation relationships. The link between politics and sociology marks Bell's thought and shows how social sciences are assumed to be the political theory of modernity: they analyze the political side of social relations as well as the social element inherent to the workings of political institutions. In other words, I look at the way in which Bell, «the sociologist of capitalism» as «The Economist» put it, distinguishes between social power and political power and then makes them interact. Focusing on Bell's view of power I analyze the transformations occurred in the relationship between State and society in the US during the so-called Golden Age of Capitalism. Particularly, drawing the trajectory of this «grand narrative» of capitalism up to mid-seventies, I highlight that Bell recognizes the coming of a global age, full of political and social strains, and the need of a new institutional scale to cope with them.

ITALIANO: Il volume raccoglie gli interventi tenutisi al Convegno Internazionale "Al di là del repubblicanesimo. Modernità politica e origini dello Stato. Esperienze e discipline a confronto (1350-1600)", celebrato a Napoli nell'aprile del 2018, e incorpora un certo numero di altri contributi, ritenuti in linea con lo spirito dell'operazione. I lavori, nel loro insieme, conformano il quadro della ricca varietà di tradizioni e linguaggi intellettuali che dialogano e s'incrociano nel grande snodo della modernità, grosso modo tra XIV e XVII secolo: dalla tradizione giuridica a quella dell'ars dictaminis, a quella umanistica rinascimentale e post-rinascimentale, nutrite di pensiero classico, la riflessione investe le strutture concettuali e discorsive che – tra conflitti, contraddizioni e adattamenti – concorrono a formare l'idea moderna di Stato. Il "caso di studio" della Napoli aragonese (1442-1503), dimostra come questa realtà, storicamente determinata, abbia rappresentato un laboratorio d'avanguardia di tale modernità etica e socio-politica europea. L'ultima sezione affronta, da un punto di vista storico-critico e filosofico-politico, le sfide che l'epoca contemporanea pone alla modernità politica e alla dottrina, ma forse ancor più alla realtà stessa, dello Stato. Sullo sfondo, l'invito ad esplorare un approccio rinnovato alla concettualizzazione della politica e dei comportamenti pubblici, a partire dalla riflessione sul pensiero europeo tra basso Medioevo e prima Età moderna. / ENGLISH: The volume collects the interventions held at the International Conference Beyond Republicanism. Political modernity and the origins of the State. Comparing experiences and disciplines (1350-1600), that took place in Naples during April 2018. It also includes a number of external contributions deemed in line with the spirit of the conference. The works included in the volume describe the rich variety of intersecting traditions and specialist languages that, roughly between the fourteenth and seventeenth centuries, cross their paths during the great junction of modernity: from the juridical tradition to that of the ars dictaminis, to the humanities of the Reinassance and post-Reinassance period, all nourished by classical thought, the book's reflection invests the conceptual and discursive structures which - amid conflicts, contradictions and adaptations - combine to form the modern idea of the State. The "case study" of Aragonese Naples (1442-1503) demonstrates how this historically determined reality has represented an avant-garde laboratory of the European ethical and socio-political modernity. The last section addresses, from a historical-critical and philosophical-political point of view, the challenges that the contemporary era poses to political modernity and doctrine, and perhaps even more so to the nature of the State itself. In the background, the volume suggests to explore a renewed approach to the conceptualization of politics and public behavior, starting with a reflection on European thought between the late Middle Ages and the early modern age.
