Since 2008, sharia courts were postulated that they may be positive for the English law and for English justice in general, to facilitate for a more pluralist legal system in which people can choose which law they wish to comply with, religious or English one. This idea was recognized as very controversial. Anyway the Muslim Arbitration Tribunal, supposed to operate within a civil jurisdiction, was established already in 2007. MAT is treated as any other alternate dispute resolution tribunal, what means that parties can consent to have their disputes decided by a third party and that these decisions are recognized in an English court. It is very important that abuse has, until fairly recently, often been seen as a matter of private rather than public law within the English system and this delineation between public and private family matters has been maintained by Muslim law to a large extent. The concern raised by the use of private arbitration in the field of domestic violence is that it undermines the role of the state to prosecute offences which a society find particularly abhorrent. A possible safeguard for victims of domestic violence in the face of Sharia or Jewish the Beth Din jurisdiction is the requirement of independent legal advice for both parties before acquiescing to Sharia as the Beth Din.

Hay un amplio reconocimiento sobre el hecho de que los cambios ambientales globales actuales no pueden ser entendidos, analizados y respondidos sin reconocer el rol de la globalización neoliberal en su misma perpetuación y exacerbación. El feedback y la superposición entre estos dos principales cambios globales llevan a dobles exposiciones, donde las vulnerabilidades se hacen irremisiblemente visibles y la intervención adaptativa para salvaguardar intereses políticos y económicos se convierte en imperativa. Los resultados de la investigación sobre este campo sugieren que las asimetrías de poder, los intereses particulares y diversos valores presentes en las políticas de adaptación al cambio climático y el desarrollo nacional son decisivas en la elección de unos u otros caminos de adaptación. Estos caminos, cargados también de valores morales, pueden limitar las políticas nacionales a soluciones técnicas y de gestión, al minusvalorar las medidas políticas de redistribución social y por lo tanto ocluir el debate político sobre imaginarios futuros alternativos. Basándose en tres estudios empíricos sobre la agricultura de trabajo intensivo en Turquía, esta tesis explora cómo las intervenciones adaptativas dirigidas por el Estado configuran las vulnerabilidades, y a la vez fracasan en su intento de reducirlas, al no obstaculizar la continuidad de la acumulación de capital. Con esta finalidad, esta tesis utiliza las herramientas de la ecología política para analizar un grupo de población relativamente poco estudiado pero clave para la agricultura de trabajo intensivo: los trabajadores agrícolas de migración estacional. En consecuencia, esta tesis identifica cómo la política de adaptación al cambio climático en la agricultura turca, mediante su visión del sector agrícola como una unidad homogénea, facilita el desplazamiento de los costes socio-ecológicos. Whatever we speak about enhancement as the, just, one array of the wide range of the bioethical fields, or as the kind of ideological and theoretical field, it is necessary to emphasize relevant ideological and theoretical distinctions between different approaches. Trying to give some fundamental shape to debate among them, as well within themselves, I specified three possible streams with more or less arbitrary boundaries. First one is transhumanistic stream, whose representatives openly promote the practice of genetic, prosthetic and cognitive enhancement of human kind - transition from human to a post human society; bioconservative, whose representatives perceive a threat in the violation of human dignity, meddling in "God's business" (playing God), and in changes to the nature of human beings; representatives of the "middle standpoint" consider that danger lies within the dialectic relation of capitalism and medicine. I present the three ideological standpoints trying to building consistency through different ethical arguments. Discussing the relevant theoretical/ideological distinction between standpoints and their claims, I will argue that ideological distinction among standpoints is less relevant than contingency within their arguments. Such mutual contingence creates some similarity regarding epistemological and social issues.
